Techdirt has finally accepted the inevitable and gone full democracy blog—because let's face it, politics and tech are now the same dumpster fire. Google rolled out AI Mode for Search, proving once again that the internet is just Clippy with better branding. Meanwhile, Billy McFarland insists Fyre Festival 2 is totally happening, despite Mexican officials pointing out that his coordinates literally lead to the ocean. Speaking of fraud, Tesla sales are in freefall thanks to Elon's alt-right cosplay, and people are setting Teslas on fire in protest. And in rich-guy disconnect news, Google's Sergey Brin thinks engineers should work 60-hour weeks to build the AI that will replace them. That's some late-stage capitalism poetry right there.Elsewhere, Trump Media paid Don Jr. nearly a quarter of its revenue to show up twice, while indie musicians can't afford to tour, proving once again that grifting is more profitable than making art. Technicolor shut down overnight, stranding 10,000 workers because Hollywood's financial planning is apparently as stable as a Starship rocket launch. Oh yeah, SpaceX exploded another one.Meanwhile, Netflix's attempt to upscale A Different World turned it into a Lovecraftian horror show. A quarter of Y Combinator startups now run on “vibe coding,” meaning their software is basically a Ouija board with extra steps. The AI takeover continues as OpenAI plans to charge $20,000 monthly for specialized AI "agents," proving once again that the revolution will be monetized. Meanwhile, Moscow's Pravda network has been poisoning Western AI chatbots with Russian propaganda, because if you can't convince humans, just brainwash the robots that humans increasingly trust. On the bright side, hackers brought the Humane AI Pin back to life after it was bricked, transforming an overpriced paperweight into... a slightly less useless overpriced paperweight. ChatGPT can now directly edit code in macOS development tools, making it easier for AI to introduce bugs you never would have thought of yourself. Over At the Library, check out "The Tempest" by Peter Cawdron for your first contact fix, and if you're worried about where society is heading (and who isn't?), Timothy Snyder's "On Tyranny" offers a survival guide for our slow-motion constitutional collapse. Finally, in "everything is fine" news, 82% of indie artists can't afford to tour anymore.Enjoy the dystopia, kids – at least we still have our sense of humor.Sponsors:DeleteMe - Head over to JoinDeleteMe.com/GOG and use the code "GOG" for 20% off.Private Internet Access - Go to GOG.Show/vpn and sign up today. It's Friday, August 9th, A.D. 2024. This is The Worldview in 5 Minutes heard at www.TheWorldview.com. I'm Adam McManus. (Adam@TheWorldview.com) By Adam McManus 20 people murdered since Bangladesh Prime Minister resigned Bangladesh Christians are calling for urgent prayer for Christian converts who left Islam to follow Jesus, reports Open Doors. The South Asian nation is in significant turmoil after Prime Minister Sheikh Hasina, age 76, resigned and left the country, seeking safety after weeks of anti-government protests alleging rampant corruption throughout her regime.   One Christian in northern Bangladesh said, “We spent a sleepless night praying to our Lord for the protection of all our believers.  In many areas, radical groups are compiling lists of converted Christians to attack their houses. Some homes have already been attacked, while others live in fear and hiding, seeking security for their lives.” With Hasina's resignation, Bangladesh's constitutional process requires the formation of an interim government to manage the country's affairs.  The situation on the ground remains volatile.   Over the last three weeks, millions of protesters took to the streets, expressing their dissatisfaction about a quota system that would award jobs to the children of fighters in Bangladesh's war of independence. This led to a violent crackdown on the dissent by government forces. Government structures were targeted and in a particularly striking act of boldness, many individuals entered Ganabhaban, the official residence of the prime minister in the nation's capital of Dhaka. Reportedly, at least 20 people have been killed in the violence since her resignation, adding to the more than 90 deaths on Sunday—which already marked the worst single-day casualty figure from any demonstrations in Bangladesh's recent history. Bangladesh is the 26th most dangerous country worldwide in which to be a Christian. Harris leads Trump in new poll Democrat Kamala Harris leads Republican Donald Trump 42% to 37% in the race for the November 5th presidential election, reports Reuters. The Ipsos poll found Harris had widened her lead since a July 22-23 Reuters/Ipsos survey, which found her up 37% to 34% over Trump. The nationwide poll of 2,045 U.S. adults, conducted Aug. 2-7, found 4% of those surveyed backed independent candidate Robert Kennedy Jr., down from 10% in July. J.D. Vance: Tim Walz is as radical as Kamala Harris President Trump's running mate Ohio Senator J.D. Vance commented on the selection of Minnesota Governor Tim Walz as Kamala Harris' Vice Presidential pick, reports Real Clear Politics. VANCE: “The big news of the day is that Tim Waltz is now the V.P. for Kamala Harris. It just highlights how radical Kamala Harris is. This is a person who listened to the Hamas wing of her own party in selecting a nominee. “This is a guy who's proposed shipping more manufacturing jobs to China … and has proposed defunding the police just as Kamala Harris does. “They make an interesting tag team because. of course, Tim Waltz allowed rioters to burn down Minneapolis in the summer of 2020. And then, the few who got caught, Kamala Harris helped them out of jail. “So, it is more instructive for what it says about Kamala Harris that she doesn't care about the border. She doesn't care about crime. She doesn't care about American energy. And most importantly, she doesn't care about the Americans who have been made to suffer under those policies.” In addition, Minnesota Governor Walz supported putting tampons in the public school bathrooms of boys and mandated that all public school teachers use biologically inaccurate pronouns to describe trans students. President Richard Nixon resigned 50 years ago yesterday Exactly 50 years ago yesterday, August 8th 1974, a beleaguered President Richard M. Nixon entered the Oval Office, stared into a television camera and resigned the presidency, reports USA Today. Listen. NIXON: “Throughout the long and difficult period of Watergate, I have felt it was my duty to persevere, to make every possible effort to complete the term of office to which you elected me. In the past few days, however, it has become evident to me that I no longer have a strong enough political base in the Congress to justify continuing that effort. “I have never been a quitter. To leave office before my term is completed is abhorrent to every instinct in my body. But, as President, I must put the interests of America first. To fight through the months ahead for my personal vindication would almost totally absorb the time and attention of both the President and the Congress in a period when our entire focus should be on the great issues of peace abroad and prosperity, without inflation, at home. “Therefore, I shall resign the presidency effective at noon tomorrow. Vice President Ford will be sworn in as president at that hour in this office.” Canadian Supreme Court vs. Jordan Peterson On August 8th, the Canadian Supreme Court refused to hear an appeal by Dr. Jordan Peterson after the College of Psychologists of Ontario mandated he undergo so-called social media “training” or risk losing his license to practice after he challenged the homosexual/transgender agenda online, reports LifeSiteNews.com. Peterson is a best-selling Canadian author and clinical psychologist who gained fame for his opposition to compelled speech and gender ideology. Peterson tweeted that he has been vilified “primarily for publicly opposing the butchers and liars subjecting children to sterilization and mutilation.” The Canadian Supreme Court should heed the Biblical admonition found in Matthew 18:6. “If anyone causes one of these little ones—those who believe in Me—to stumble, it would be better for them to have a large millstone hung around their neck and to be drowned in the depths of the sea.” Australian high jumper praises God after earning Olympic silver And finally, Australian Christian high jumper, Nicola Olyslagers, formerly McDermott, won silver for Australia at the Paris Olympics, repeating her triumph in Tokyo 2021, reports Evangelical Focus. On Instagram, she posted this statement: “Praise be to God my Rock! He is my strength and song!!” Psalm 150:6 says, “Let everything that has breath praise the Lord.” After her victory, she told ABC Sports, jumping "is like being in a church. My worship might not be my singing, it's in my feet jumping over a bar.” Close And that's The Worldview on this Friday, August 9th, in the year of our Lord 2024.  Subscribe by iTunes or email to our unique Christian newscast at www.TheWorldview.com. Last week in crypto, 7 day prices were up across the market, with a 6% growth in Bitcoin, and 4% in Ethereum. The Canadian Supreme Court has given its approval for the merger of Hut 8 Mining Corp. and US Bitcoin mining company, Bitfury. This decision signifies a significant development in the cryptocurrency industry, as it allows Hut 8 to acquire Bitfury and expand its Bitcoin mining operations. The merger is expected to bolster Hut 8's position as a prominent player in the Bitcoin mining sector and enhance its mining capabilities. This news reflects the growing importance of the cryptocurrency market in Canada and the broader global crypto landscape, showcasing the increasing legitimacy and acceptance of digital currencies in the financial world. Stacks token price surged over 12% in the last 7 days, in response to Bitcoin's rise above $27,000. Stacks, an Ethereum-compatible blockchain, saw a notable increase in value, leading investors to consider it a potential buy. This price surge could be attributed to the growing interest in blockchain projects aiming to enable smart contracts on Bitcoin. Stacks offers this functionality and has gained attention as a viable solution.  New York regulators have introduced new transparency regulations for cryptocurrency firms regarding coin listings and delistings, exchanges operating in the city will be required to provide clear information about the criteria used for listing and delisting digital assets, as well as any changes to those criteria. New York regulators claim these rules aim to enhance consumer protection and market integrity by working to prevent market manipulation and fraudulent activities while promoting transparency and accountability within the crypto industry.  Kazakhstan has established a Central Bank Digital Currency (CBDC) development agency, marking a significant move into the world of digital currencies. This agency will oversee the creation and implementation of a national CBDC. Kazakhstan aims to harness the benefits of CBDCs, including improved payment efficiency, financial inclusion, and reduced transaction costs. The move is part of the country's broader efforts to modernize its financial infrastructure and promote digital innovation in the financial sector. This is a fast follow to Hong Kong and Israel, who a couple of weeks ago announced their planned collaboration and knowledge sharing initiatives around building their own CBDCs. Dr. Mark Pickering joins Tim to talk about the disturbing spread of  and interest in human euthanasia throughout western cultures, particularly in Canada, the U.S., and the U.K. Mark is a general practitioner of family medicine. He focuses his work on prisons and other similarly secure facilities. In addition, he is the head of the Christian Medical Fellowship in the United Kingdom. In this conversation, we talk about the myths and the realities of assisted suicide. https://traffic.libsyn.com/forcedn/shapingopinion/Human_Euthanasia_is_Here_auphonic.mp3 In 1997, the state of Oregon passed the Death with Dignity Act, which allowed the medically assisted suicide for people who were terminally ill. Since that time, over 3,280 people received prescriptions for legal doses of medications under the act's provisions. The state reports that of those who received prescriptions, 2,159 people actually took the medications and died from the lethal dosages. Since 1942, the nation of Switzerland has allowed assisted suicide. But according to the government, it only allows this form of euthanasia so long as, “the motives are not selfish.” Closer to home, in Canada in 2016, the Canadian government legalized medical assistance in dying. The acronym for this is MAID. The Canadian Supreme Court had decided that existing laws that prohibited assisted suicide were an afront to individual rights. Here's how the MAID program started. Medical professionals - doctors and nurses - would administer lethal injections or fatal medications to patients who met a specific criteria. The individual had to have a serious illness or disability; the individual had to be in what the government described as an “advanced state” of decline that could not be reversed; the individual had to be experiencing unbearable physical or mental suffering; or the individual had to be at the point where natural death had become “reasonably foreseeable.” Notice that nowhere in Canada's original requirements did the individual have to be terminally ill. But that was just the beginning.  Before long, anyone who wanted help with suicide was able to get it. Canadians who were depressed, stressed, or just economically poor or in a state of mental distress could get help with their own suicide. In 2021, the government relaxed the condition that that natural death must be “reasonably foreseeable.” After that, the stories of Canadians being presented with suicide as a medical option included some who were just temporarily homeless or in some kind of pain that otherwise could be treated. Consider the story of Alan Nichols. When he was a child, he lost his hearing. He had had a stroke. But overall, at 61 years old, he was able to live on his own. Then in 2019 he was admitted to the hospital over concerns that he might be at risk of committing suicide. He was mentally unstable. Not in his right mind. While he was in the hospital, he pleaded with his brother Gary to get him out of the Canadian hospital. Over the course of the next four weeks, he then was reported to have applied for medically assisted suicide under the MAID program. The only medical condition he listed as his reason for wanting to die was being hard of hearing. Instead of treating Nichols' obvious mental instability, the hospital supported his desire to kill himself and provided its own justification. It said Nichols had some vision loss, that he was frail, that he had a history of seizures and in their words, he had a “failure to thrive,” whatever that means. The hospital framed the process as Nichols requesting to die by lethal injection, and it saw that rationale as valid. The procedure was carried out expeditiously. When the Associated Press talked to Nichols' brother Gary, he said that his brother Alan, “was basically put to death.” Inmates on death row are forced to wait much longer. Mark Pickering is on the front lines of this issue.

Sex with animals and ANY FORM OF ABUSE NEEDS to be a A REAL CRIMINAL CRIME. We need your help to advance Canadians and Canada. We call on YOU to SHARE and LIKE our Video to inform and bring advancement. "Generally, Canadian people are compassionate, caring, and nurturing towards animals and specifically their animal companions. There are over 5 million dog owners, and close to 6 million cat owners in Canada. In addition, there are hundreds of animal rights and animal welfare groups across Canada. This humane approach to animals helps define who we are and what we are as a people and a country. However, there is a pervasive disconnect between establishment politicians' actions or lack of towards animals and the Canadian people's actions towards animals. We must remember that silence in the face of facts, denial of facts, or putting self-interest and industry lobbyists first are complicity in animal cruelty and abuse. Canadian law, as determined by the establishment politicians to date, falls well short of the standard most Canadians have for animals and their welfare. For example, the Canadian Criminal Code allows sex with animals as long as there is no physically harm to the animal and no penetration. Like most Canadians, we find that current legal reality revolting. In addition, the Canadian Criminal Code is ineffective in prosecuting animal abusers and view animals as property, rather than as sentient beings. Further, the Canadian Criminal Code is absent in any standard of animal welfare. How we treat animals through our laws, whether to companion animals, farmed animals, wildlife, or strays, is reflective of who we are as a people. Here are some examples showing the gravity of the cruelty and abuse towards animals in Canada, which link to the lack of political will by the establishment politicians to address effectively this systemic cruelty and abuse. In 2016 Canadian Supreme Court ruled that sex with animals is not a crime as long there is no physical harm to the animal and no penetration. This disturbing decision based on limits to the Bestiality Act was not acted on in any meaningful way by the House of Commons as Assembled to date. Halal slaughter in Canada, part of a growing national industry, is based in many instances on abusive treatment of animals and cruelty through not stunning the animals prior to ending their lives. Warning graphic video: Poultry and livestock in Canada often times face cruel treatment, cruel containment, and cruel transportation. Warning graphic video: ****video clip***** Marine life in Canada often times face cruel containment and treatment. ****video clip***** These are numerous other examples. The National Citizens Alliance believes that we as people need to address the cruel, abusive treatment of animals immediately. As part of our National Advancement, we support a number of measures to deal with animal cruelty and abuse such as: The National Citizens Alliance supports animal welfare, and the five principles from the Universal Declaration on Animal Welfare: freedom from hunger, thirst, and malnutrition, freedom from fear and distress, freedom from physical and thermal discomfort; freedom from pain, injury, and disease; and freedom to express natural patterns of behaviour. We apply these freedoms to all animals such as companion animals, farmed animals, animals in scientific research, and wildlife. The National Citizens Alliance supports replacing “wilful neglect” in the Canadian criminal code with “standard of welfare” based on the five freedoms as outlined. Also, the National Advancement Party of Canada supports increasing the fines and prison sentences for acts of animal cruelty. Please help us advance Canadians and Canada by liking and sharing this video." --- Send in a voice message: https://anchor.fm/yeenaaldlooshii/message

Intellectual property: Copyright troll / Limitations and exceptions to copyright / Idea–expression distinction

Law School

Play Episode Listen Later Oct 21, 2020 19:42

A copyright troll is a party (person or company) that enforces copyrights it owns for purposes of making money through litigation, in a manner considered unduly aggressive or opportunistic, generally without producing or licensing the works it owns for paid distribution. Critics object to the activity because they believe it does not encourage the production of creative works, but instead makes money through the inequities and unintended consequences of high statutory damages provisions in copyright laws intended to encourage creation of such works. Both the term and the concept of a copyright troll began to appear in the mid-2000s. It derives from the pejorative "patent trolls", which are companies that enforce patent rights to earn money from companies that are selling products, without having products of their own for sale. It is distinguished from organizations such as ASCAP, which collect royalties and enforce copyrights of their members. Limitations and exceptions to copyright are provisions, in local copyright law or Berne Convention, which allow for copyrighted works to be used without a license from the copyright owner. Limitations and exceptions to copyright relate to a number of important considerations such as market failure, freedom of speech, education and equality of access (such as by the visually impaired). Some view limitations and exceptions as "user rights"—seeing user rights as providing an essential balance to the rights of the copyright owners. There is no consensus among copyright experts as to whether user rights are rights or simply limitations on copyright. See for example the National Research Council's Digital Agenda Report, note 1. The concept of user rights has also been recognized by courts, including the Canadian Supreme Court in CCH Canadian Ltd v. Law Society of Upper Canada (2004), which classed "fair dealing" as such a user right. These kinds of disagreements in philosophy are quite common in the philosophy of copyright, where debates about jurisprudential reasoning tend to act as proxies for more substantial disagreements about good policy. The idea–expression distinction or idea–expression dichotomy is a legal doctrine in the United States that limits the scope of copyright protection by differentiating an idea from the expression or manifestation of that idea. Unlike patents, which may confer proprietary rights in relation to general ideas and concepts per se when construed as methods, copyrights cannot confer such rights. An adventure novel provides an illustration of the concept. Copyright may subsist in the work as a whole, in the particular story or characters involved, or in any artwork contained in the book, but generally not in the idea or genre of the story. Copyright, therefore, may not subsist in the idea of a man venturing out on a quest, but may subsist in a particular story that follows that pattern. Similarly, if the methods or processes described in a work are patentable, they may be the subject of various patent claims, which may or may not be broad enough to cover other methods or processes based on the same idea. Arthur C. Clarke, for example, sufficiently described the concept of a communications satellite (a geostationary satellite used as a telecommunications relay) in a 1945 paper that it was not considered patentable in 1954 when it was developed at Bell Labs. --- Send in a voice message: https://anchor.fm/law-school/message Support this podcast: https://anchor.fm/law-school/support

He begins by describing the sources of Canadian constitutional law, when they were adopted, and which institutions have interpreted them. He explains that the prevailing view of Canadian constitutional law rejects originalist methods of interpretation in favor of a form of living constitutionalism. But he observes that this position is overstates, as the Canadian Supreme Court actually engages in a form of originalist interpretation on a regular basis. He argues that the Court should acknowledge its use of originalist methodologies and that they may promote the rule of law. Over the years, Unist'ot'en has become home to various structures to not only block the passage of the pipeline but also to create opportunities for indigenous folks to heal themselves and promote their culture.  On December 14th, the Canadian Supreme Court pushed through an injunction on behalf of Coastal GasLink (owned by TransCanada) threatening the Wet'suwet'en community defending its land at Unist'ot'en with police invasion. Following this, a public statement was made by the 5 hereditary chiefs of the Wet'suwet'en for all of the clans to block pipelines on their land. The Wet'suwet'en people have no treaties with the Canadian or provincial government, their land is unceded and sovereign territory within the bounds of what's claimed by Canada. According to United Nations Declaration on the Rights of Indigenous Peoples, Article 10: “Indigenous Peoples shall not be forcibly removed from their lands or territories.” This includes RCMP, and/or military removal of Indigenous Peoples occupying their territory , say the land defenders. They also point out that the 1997 Supreme Court of Canada ruling in the Delgamuukw/Gisdaywa court case affirmed that Wet'suwet'en title, based on the traditional clan governance system, was never extinguished. In the days since this interview was recorded, an update to the injunction by the Canadian Supreme Court was released that updated names and places to be targeted by police action and the chiefs were informed by the Royal Canadian Mounted Police, or RCMP, a Canadian Federal police force that their people and their spaces would likely be attacked by the RCMP in coming days to move forward on the building of the Coastal GasLink pipeline. The Wet'suwet'en resistance to the pipeline is asking for native folks to come to help defend the land from further Canadian incursion, for allies and accomplices to engage in solidarity actions to pressure and embarrass the Canadian government and spread word of the resistance of Wet'suwet'en people on their sovereign lands in defense of the earth, air and water that all of us share on this planet. You can inform yourself more by visiting wetsuweten.com and keep up on updates via their fedbook page named "Gidimt'en Checkpoint visit: Wet'suwet'en Access Point on Gidimt'en Territory". Workplace collective agreements must be based on human rights legislation, Canadian Supreme Court rules. When Joanne O’Brien went on maternity leave before she’d completed her probationary work period at Parry Sound, Ontario’s social services administration board, she returned to find herself fired. That was 1998. She complained to a labour board, which ruled that her employer had violated her rights under Ontario’s human rights code. After further appeals, on September 18, 2003, the Supreme Court of Canada ruled that under Ontario law, a labour board is responsible for spelling out human rights and other employment-related laws in their collective agreement. This established human rights legislation as the basis on which employers must build employer/employee agreements, whether or not the rights they promise are written into their collective agreements. Severely wounded by two M-16 bullets in his back, Khadr, who was just 15 at the time, was flown to Bagram airbase where he was treated for his injuries and later subjected to “enhanced interrogation techniques” before being transported to the notorious US prison camp in Guantanamo Bay, Cuba. The US government deemed Khadr an “enemy combatant” in 2002 which allowed US military interrogators to use “enhanced techniques” on the teenager that are described by various human rights groups as forms of torture that would otherwise be banned under the Geneva Conventions. Khadr's “enemy combatant” status also allowed an American military tribunal to prosecute the young Canadian for war crimes despite being defined as a child soldier by the United Nations. Khadr is the only child soldier ever to be tried for war crimes.
