What do peaches and the FMCSA Safety program have in common. You'll have to listen to find out, but I will tell you, understanding the low hanging fruit principle can help you stay out of hot water with the FMCSA. We cover a lot in this first episode of a two part series on the FMCSA Safety program. It can be tempting to neglect safety, especially when you are struggling to survive in a tough market. However, failing to manage your safety and your FMCSA scores can sink your company faster than low freight rates. Listen to the episode as Craig and I share some great tips when it comes to safety. What To Expect From Episode 160 BLUF (Bottom Line Up Front), If you want to have good CSA scores, be safe, maintain your vehicles, obey traffic laws, and don't break the hours of service rules. With that being said, we give a lot of tips about what the CSA scores are, how they are calculated, and some of the best practices to keep them low. Lower is better. Here is an outline of what we cover. What Are CSA Scores Most Motor Carriers receive scores in 7 Behavior Analysis and Safety Improvement Categories, which wrapped up in a nice little acronym called BASICs. The categories are: Unsafe Driving 65% Crash Indicator 65% Hours-of-Service Compliance 65% Vehicle Maintenance 80% Controlled Substance 80% Hazardous Materials Compliance 80% Driver Fitness 80% Insurance and Other (This one isn't really scored, it's more like pass or fail) The percentages are the thresholds, we explain those during the episode. How You Get Your CSA Score The simple answer to this question is they come from interventions with the FMCSA/DOT Officers. Those can be anything from roadside inspections to an audit. Most inspections occur at Ports of Entry or because of an inspection that happens when a driver is pulled over for a moving violation or obvious vehicle maintenance issue. One of the biggest contributors to the number of inspections you get is your ISS Score (Inspection Selection System). You can check your score and a lot of other important things regarding your company's history with the FMCSA by logging into their system here. Understanding The Scoring System The scoring process is a bit complicated. I am going to over simplify it, but here is the general idea. Every time you are inspected your company receives a score. If there is a violation, you get bad points. If the inspection report is clean, you get good points. The formula the FMCSA uses basically divides the bad points by the good points. If you have more good points than bad, your resulting "measure" will be less than one. If you have more bad points than good points, your "measure" will be higher than one. Good inspections will give you more good points and lower your "measure". Your "measure" is then compared to all the other fleets that are roughly your same size. If you are right in the middle, meaning half the companies have a "measure" lower than yours and half the companies have a "measure" higher than yours, your BASIC score will be 50%. If you are in the top 10%, your score will be 10%, etc. Every BASIC has a threshold, if you are above the threshold you are going to be on the FMCSA's radar. You just became low hanging fruit, if you don't know what that means, listen to the episode. Understanding The Consequences Of Your CSA Scores There are several things that happen if your CSA Score exceeds the threshold. You are going to get a letter from the FMCSA saying you need to behave and do better Your ISS Score is going to increase and your are going to get inspected more, when that happens, most scores get even worse If your score stays elevated for a while or if you exceed the threshold in multiple categories, you are way more likely to be audited, that's when the fun really begins Most audits result in a Safety Rating, either Satisfactory, Conditional or Unsatisfactory. In part two of the series we will talk about what happens if you get a bad safety rating or if the FMCSA tells you that you need to complete Corrective Action Plan.

The Department of Justice's Drug Enforcement Administration on May 20 officially published its notice of proposed rulemaking that, if finalized, would reschedule marijuana from a Schedule I controlled substance to Schedule III: https://www.regulations.gov/document/DEA-2024-0059-0001 The Biden Administration signaled its intent to move forward with such a proposal earlier this month, and the NPRM's publication formalized that effort. The DEA's proposal said moving marijuana from Schedule I to Schedule III under the Controlled Substances Act would be “consistent with the view of the Department of Health and Human Services (HHS) that marijuana has a currently accepted medical use, as well as HHS's views about marijuana's abuse potential and level of physical or psychological dependence.” That, ultimately, is the difference between the two scheduling levels, as previously reported. Schedule I drugs are defined in the Act as “drugs with no currently accepted medical use and a high potential for abuse.” Those include heroin, LSD, ecstasy and, at least for now, marijuana. Schedule II drugs, in the terms of the legislation, show “high potential for abuse, with use potentially leading to severe psychological or physical dependence,” and are considered dangerous. These include combination products with less than 15 milligrams of hydrocodone per dosage unit (Vicodin), cocaine, methamphetamine, methadone, fentanyl and more. Drugs classified under Schedule III, how DEA is looking to classify marijuana, are those “with a moderate to low potential for physical and psychological dependence,” and have a lower abuse potential than Schedule I and Schedule II drugs. Currently, these include products containing less than 90 milligrams of codeine per dosage unit, like Tylenol with codeine, as well as ketamine, anabolic steroids, testosterone and more. Typically, according to Brandon Wiseman, attorney and president of Trucksafe Consulting and guest for this week's Overdrive Radio podcast, Schedule III drugs “are still controlled in the sense that they require a prescription.” As such, having a Schedule III drug in your system is not necessarily a disqualifying factor in DOT drug testing. The driver must have a valid medical prescription for that drug, and the medical review officer (MRO) that validates the results of the drug test has to be comfortable that the use of that drug won't impact the driver's ability to safely operate a truck. “Some prescription drugs will inhibit a driver's ability to safely operate a truck,” Wiseman said in the podcast. “And so we just weed those drivers out. Those drivers aren't going to be physically qualified. Gov. Jeff Landry signed a first-of-its-kind law Friday that designates common pregnancy medications as “controlled dangerous substances” in Louisiana. The law easily passed the legislature last week and takes effect October 1. Reproductive health reporter Rosemary Westwood tells us why hundreds of local physicians have argued that the law could endanger women's health. The Louisiana Supreme Court recently struck down a 3-year “look-back window” for sexual abuse survivors to file legal claims. Sophie Hayssen is a reporter and fellow at Mother Jones covering the ruling. She tells us why some abuse survivors are devastated by the ruling.For the first time in more than two centuries, two broods of periodic cicadas are expected to emerge from the ground at the same time. Brood XIX is on a 13-year cycle, while Brood XIII is on a 17-year cycle. The last time they lined up was 1803. But scientists have noted the last time Brood XIX emerged in 2011, there were no recorded sightings in Louisiana, meaning it could be extinct in the region. A bill that would restrict access to abortion pills has been signed into law in Louisiana. The law reclassifies the drugs as a controlled substance, grouping them with Xanax and Valium. LSD has been banned in the United States for decades and became a Schedule 1 Controlled Substance in 1970, but it has experienced a resurgence among Silicon Valley entrepreneurs to overcome mental roadblocks and psychiatrists running tests to use it as a treatment for addiction, PTSD, and other mental illnesses. Hundreds of doctors across Louisiana are asking lawmakers not to pass a bill that would make abortion medications controlled substances in Louisiana. They've signed an opposition letter to Republican state Senator Thomas Pressly, the bill's main sponsor. Reporter Rosemary Westwood joins the show to update us on the proposal and opposition to it. Nearly half the natural gas pulled out of the ground in the U.S. gets exported overseas, and that number could get even higher over the next decade. The Biden administration will move Tuesday to reclassify marijuana as a lower-risk substance, a historic move that acknowledges the medical benefits of the long-criminalized drug and carries broad implications for cannabis-related research and the industry at large. The US Department of Justice is expected to recommend that marijuana be rescheduled as a Schedule III controlled substance, a classification shared by prescription drugs such as ketamine and Tylenol with codeine. “The DOJ continues to work on this rule. We have no further comment at this time,” an administration official said Tuesday. In his budget address last month, Governor Josh Shapiro called for the legalization of marijuana for recreational purposes. The latest Franklin and Marshall College poll found that almost two-thirds of Pennsylvania voters who were surveyed support marijuana for adult use being legal. Support is a trend that has been growing over the past decade. Several Republicans in key positions in the General Assembly have changed their positions and now favor legalization. Twenty-four states have legalized marijuana. Gov. Shapiro estimated legal weed would generate $250 million for the state once it was up and running. So, is it just a matter of time that marijuana is legalized in Pennsylvania? Not so fast. The federal government still classifies marijuana as a Schedule 1 Controlled Substance.Opponents say it needs more study, law enforcement organizations have mostly opposed legalization and some opponents have pointed out there's been an increase in vehicle crashes in states that have legalized. As a U.S. Army Apache helicopter pilot, Adam Marr deployed to Iraq where he flew more than 400 combat hours and was awarded the combat action badge. In 2017, Marr co-authored the best-selling book, "Tales from the Blast Factory” where he shared the challenges his brother, a Green Beret, faced transitioning out of the Army because of his TBI and PTSD injuries sustained in combat. This book was the inspiration for the Academy Award-qualified documentary film Quiet Explosions: Healing the Brain (2020). The investigation began after family members reported her missing when they had not seen or heard from her since Thursday. When officers conducted a welfare check at her apartment, they found neither Dubignon nor her boyfriend, Freddrick Durham, who lived with her, and her car was missing. Dubignon's body was later discovered in a suitcase inside her apartment. Durham was tracked to Atlanta and taken into custody by the Atlanta Police Department and Georgia State Patrol. In this episode, we dive into the highly publicized indictment of Hunter Biden, son of President Joe Biden. From the charges laid against him to the collapse of his previous plea agreement, we unravel the legal complexities surrounding his case. Here are the three key takeaways from the episode:1️⃣ Hunter Biden is facing three felony charges related to gun possession and his gun purchase. He allegedly lied on a federal form when purchasing a gun, stating that he was not using controlled substances when he actually was. Additionally, he was in possession of a firearm when he shouldn't have been allowed to.2️⃣ The plea agreement that was previously in place fell apart in open court. Part of the agreement included a pretrial diversion program, which would have allowed Hunter Biden to avoid prosecution on these gun-related charges. However, the judge expressed concern about the structure of the plea deal, and the Department of Justice couldn't reach an agreement with Hunter Biden's defense team.3️⃣ Hunter Biden may present two key defenses. First, he may argue that the pretrial diversion agreement still remains in effect and should be honored. However, the Department of Justice maintains that it was never signed by a probation officer and is null and void.
