The legal doctrine of Res Ipsa Loquitur, drawing upon excerpts from the lecture, "Res Ipsa Loquitur (The Thing Speaks for Itself) Explanation." What is Res Ipsa Loquitur? Res Ipsa Loquitur, meaning "the thing speaks for itself," is a legal doctrine used in tort law, particularly in negligence claims, when direct evidence of wrongdoing is scarce or absent. It allows plaintiffs to establish a presumption of negligence based on the nature of the incident itself, shifting the burden of proof to the defendant. Key Elements For Res Ipsa Loquitur to be successfully invoked, three key elements must be satisfied: The Event Ordinarily Does Not Occur Without Negligence: The incident itself must be unusual and unlikely to occur unless someone acted negligently. For instance, a surgical instrument left inside a patient after surgery points to negligence, as such an event wouldn't typically happen with proper care. As the lecture states, "Courts essentially acknowledge that some events are inherently so rare without negligence that the occurrence itself serves as sufficient preliminary proof." The Instrumentality Was Under the Defendant's Exclusive Control: The plaintiff must demonstrate that the defendant had exclusive control over whatever caused the harm. This ensures that the inferred negligence is appropriately attributed. The example provided in the lecture is a collapsing grocery store shelf: "Since the store has exclusive control over the maintenance and placement of shelves, they would bear responsibility for ensuring the safety of the setup." The Plaintiff Did Not Contribute to the Cause of the Injury: The plaintiff must not have played a role in causing their own injury. This ensures the inference of negligence falls solely on the defendant. The example given is a falling sign: if the plaintiff tampered with the sign, Res Ipsa Loquitur wouldn't apply. Importance in Tort Law Simplifies Plaintiff's Burden of Proof: Res Ipsa Loquitur simplifies the burden of proof for plaintiffs in cases where proving specific negligent actions is difficult due to lack of accessible information. This is particularly relevant in complex fields like medicine. Shifts Burden to Defendant: Once Res Ipsa Loquitur is invoked, the burden shifts to the defendant to prove they were not negligent or that an external factor caused the incident. Access to Justice: The doctrine promotes fairness and access to justice, particularly in cases where the defendant's control over the situation limits the plaintiff's ability to gather direct evidence. Real-World Examples: Byrne v. Boadle (1863): This foundational case involved a barrel of flour falling from a warehouse window and injuring a pedestrian. The court ruled that barrels don't typically fall without negligence, establishing the principle of inferring negligence from the event itself. Ybarra v. Spangard (1944): This case involved a patient waking up from surgery with an unexplained injury. The court applied Res Ipsa Loquitur, holding that the medical personnel involved had exclusive control and were obligated to prove they weren't negligent. Colmenares Vivas v. Sun Alliance Insurance Co. (1986): A plaintiff was injured when an escalator handrail stopped suddenly. The court applied Res Ipsa Loquitur, holding the defendant responsible for maintaining the escalator and presuming negligence in its malfunction. Challenges and Limitations: High Threshold for "Exclusive Control": Proving exclusive control can be challenging, especially in situations with multiple parties potentially involved. Ambiguity of "Ordinarily Does Not Occur": What constitutes an event that "ordinarily does not occur without negligence" can be open to interpretation. Not a Guarantee of Winning: While Res Ipsa Loquitur creates a presumption of negligence, it doesn't guarantee victory for the plaintiff. Defendants can still present evidence to rebut the presumption. (Part 2) Black Spy Podcast Season 15, Episode 0003 This week's Black Spy Podcast sees the return of the terrible two, in part 2 of the question: ‘does the British electorate get the parliament it deserves?' Regardless of which party wins a general election. The incredible banner headline, highlighting the fact that out of the 650 MPs in Britain's Parliament in 2012, an unbelievable 243 (43%) had criminal convictions. This included members of parliament who actually served terms of imprisonment! (The above data was provided by Parliament's own inspection body - The IPSA (The Independent Parliamentary Standards Authority) Interestingly, in 2021 MPs, had the gall to challenge London's Metropolitan Police Commissioner for having,150 police officer with convictions, within the force's over 30,000 strong police ranks. (This was less than 0.5% of all the force's police officers!) (Note: practically all of these convictions were gained prior to officers being recruited into the service) It is worth remembering that MPs have one of the most powerful roles in British society, in that they are responsible for making the laws that we all live by. Whereas, all the police officers do, is to enforce these laws. The Black Spy and his panel, also discussed the conviction, or lack thereof, of the various political party leaders, and indeed politicians in general. Consequently, the team assessed in a more general manner, the truthfulness of politicians, their reasons for gaining and remaining in power and the generous level of remuneration, about £100,00 per year and an equally generous opportunity to claim a multitude of additional expenses. Finally the team considered every aspect of electioneering, geo-political processes of government, the make up of government and the constitutional position of elections in the UK. Additionally they debated all aspects of the UK globally, including the UK's involvement in the Ukraine, costing at least ten billion pounds and the UK's policy of following the USA into all its foreign adventures in its attempt to remain the global hegemon. Intern Surrogate Partners Trainees who successfully complete the first phase of training are approved to begin working as Intern Surrogate Partners. Interns work with real clients, closely collaborate with each client's therapist, and prepare for and review every session with an experienced surrogate partner mentor. Interns are providing benefits to clients while continuing their learning through these real-world experiences. While there are some cases that are too complex for a new intern, many cases are appropriate for intern surrogate partners. IPSA Training staff and mentors help evaluate cases to determine whether an intern has sufficient experience and skills to successfully assist each client. Confirmation of a specific surrogate partner's training, certification, and good standing in IPSA can be verified through IPSA Membership Committee or the IPSA Referrals Coordinator. You may also consult our list of IPSA-Certified Surrogate Partners The Character of a Surrogate Partner Although there are no specific academic degrees required of a surrogate partner, there are certain personal qualities and life experiences that seem to provide a valuable foundation for surrogate partner skills. These include intelligence, compassion, warmth, comfort sharing one's own body and sexuality, empathy, patience, knowledge of sex therapy principles and practices, and good communication skills. Non-judgmental attitudes toward sexual orientation, choice of lifestyle, and consensual sexual activities are also highly important. Gender and Sexual Orientation Surrogate partners work with clients of all sexual orientations and genders. Gender and sexual orientation are often a consideration when the client's difficulties present at the intersection of emotional intimacy and sexuality, and the intention of the therapy is to create experiential learning at that intersection. “Sex surrogate therapy vs. sex workers Many people may see sex surrogate therapy as a form of sex work. However, the two have different goals. Sex workers receive payment in exchange for consensual sexual services. Sex surrogate therapy aims to provide a safe, structured environment where the client can explore intimacy and resolve barriers that prevent them from developing physical and emotional intimacy with a partner. Sex surrogate therapy may also include sensual and sexual contact, but the focus is on developing skills and healing. In some cases, surrogate partners never have physical contact with their clients. The International Professional Surrogates Association (IPSA) Code of Ethics states that the term “surrogate partner” applies only when the therapeutic relationship includes the involvement and participation of a licensed therapist. The surrogate may act as a substitute partner or a co-therapist. Legality There are currently no laws regulating or prohibiting sex surrogacy therapy. While paying for sex is illegal in most of the United States, this type of therapy does not always involve the exchange of money for sexual services, so it may fall into a legal gray area. Sexual gratification is not necessarily the sole aim of the treatment. The treatment is also a therapeutic tool to help people overcome sexual challenges and improve their sexual health. Although the rationale for using a surrogate partner may be for sexual engagement, sexual contact is not mandatory and occurs only if necessary for the client to reach their goals. Like any decision in a traditional therapeutic relationship between a client and a therapist, the decision to engage in intercourse as part of treatment is the choice of both parties and requires informed consent. Since its establishment in 1973, IPSA has not experienced any legal issues. How to find a surrogate A person may be able to access a partner surrogate through a licensed therapist, who can tap into their network of partner surrogates. A person may also refer to IPSA's list of surrogate partners. However, because not all surrogate partners want to post their personal information publicly, a person may also connect with IPSA's referrals coordinator to be connected with a trained and certified professional surrogate partner. Moreover, because some surrogate partners have profiles on social media platforms, a person may encounter people who claim to be IPSA certified or IPSA members. Individuals or therapists may contact the IPSA referrals coordinator to confirm. Training While a specific degree or course is not a prerequisite for applying to IPSA's Professional Surrogate Partner Training Program, the training committee does look for certain qualities, such as: emotional maturity evolution through personal therapy or other growth-oriented life experience comfort with one's body and sexuality readiness to be involved in a close, caring relationship with others who are having difficulties with emotional, physical, and sexual intimacy Interested applicants may begin their training application process with IPSA. They will need to fill out forms that require them to share very personal information. Applicants need to go to Southern California for training, which has two phases. The first involves a 100-hour didactic and experiential course. It's that sneaky second gifting season of the year (dads, grads, retirements, anniversaries…you get it!), and we're here to answer your calls for help. For hobby gifts, how about a surfboard, a film camera from Photodom, ceramics classes (s/o to Artshack near us!), or pickleball gear from Recess or Nettie (on the topic of pickleball, this New York mag profile of Connor Pardoe). Last but not least, NORMALIZE GIVING MEN FLOWERS! For retirement gifts: Ask close coworkers to participate in something personal—maybe use Tribute or Padlet or go old-school and collect pictures and letters to make a scrapbook. We also love Storyworth! Or how's about helping them get oriented with a new hobby: For the dad in our VM, maybe a Backroads Bike Tour or a Bianchi bike (find them and other snazzy bikes used on Bike Exchange). There's also personal training: For a virtual option, check out Future (a good review). When someone's having a baby but not their first one: Set the parent up with a massage (maybe an at-home one through Zeel) or food delivery from Ipsa, Three Owls, or The Culinistas. Treat them to a robe, slippers, a weighted blanket from Bearaby, or a bed tray (Chairish and 1stdibs for cool vintage ones and West Elm, and Offi for new ones) Or: Get something to keep the sibling busy! Non-messy craft projects like needlepoint/sewing kits (love Unwind Studio and LittleExplorersPlay) or a subscription to The Picture Book Club. For the new baby, what about a not-hand-me-down, home-from-the-hospital look from Makie or Lewis? Or something keepsake that second (and third and fourth) kids tend to get less of like a handknit blankie or a puzzle name stool from Damhorst Toys. What to maybe, possibly ask for when you move into a new home: A return-address stamp from Paper Source or custom house numbers from House Number Lab or Casson. Outdoor stuff can be pricier than expected, so ask for plants from Fast Growing Trees, Plant Gem, and David Austin Roses, a local-nursery gift card, or gardening tools from The Floral Society or Terrain. Get into composting with an indoor bin from Bamboozle.
