He was in trial almost continuously for 11 years. He attributes his success to meticulous preparation and emphasizes that there are no shortcuts in trial practice. Ben describes the evolution of criminal trials over the last 40 years, noting that trials are shorter and less frequent today due to an increase in plea deals. John and Ben also discuss trial strategies. Many cases are won on cross. A successful cross requires deep knowledge of every piece of evidence in the case. He describes one case in which he essentially memorized months of taped conversations to dismantle a key witness's credibility. Ben often uses cross-examinations of prosecution witnesses to establish parts of the defense and contradict the testimony of other witnesses. Most cases today are won or lost on emails or texts because they are so prevalent and an incriminating email or text by a defendant cannot be discredited on cross-examination. Ben also reflects on some of his most notable cases, including the acquittal of Sean "Diddy" Combs on gun and bribery charges in 2001 and the acquittal of nightclub mogul Peter Gation after an eight-week racketeering trial. J.J. and Dr. Yonatan Brafman define philosophy of halakha and discuss the competing halakhic philosophies of Yeshayahu Leibowitz and Eliezer Berkovits. Yonatan Brafman is an assistant professor of Modern Judaism in the Department of Religion and a member of the Program in Judaic Studies. He is a scholar of modern Jewish thought and a philosopher of religion. His research focuses on the intersection of Jewish thought, Jewish law, and contemporary moral, legal, and political philosophy. He also studies the implications of religious ritual for critical social theory and praxis.Previously, he was assistant professor of Jewish thought and ethics and the director of the Handel Center for Ethics and Justice at the Jewish Theological Seminary of America. He has held fellowships in the Department of Religion and Program in Judaic Studies at Princeton University (2014–2015), the Tikvah Center for Law and Jewish Civilization at New York University Law School (2012–2013), and the Center for Jewish Law and Contemporary Civilization at the Benjamin N. Cardozo School of Law, Yeshiva University (2008–2010). He holds a PhD in Philosophy of Religion and Jewish Thought from the Department of Religion at Columbia University, where he also received his BA, MA, and MPhil.
Today I talked to Michelle Brafman about her novel Swimming with Ghosts (Keylight Books, 2023). Until her unemployed husband Charlie volunteers to step in as team coach, professional organizer Gillian Cloud has also controlled the neighborhood swim club and its team. She's a beautiful, much-admired part of the community, but Gillian is living behind a façade, refusing to accept the truth about her father's alcoholism and philandering, suppressing any unpleasantness in order to present her well-known positivity. Her best friend Kristy learns the truth about her own hidden addictions, which surface in a dangerous way and require the support of a former mentor. It's the summer of 2012, and after the ghosts of family addictions appear, and a real derecho destroys the clubhouse and destroys the power grid for several days, both Gillian and Kristy need to come to terms with their past trauma. Michelle Brafman is the author of Bertrand Court: Stories and the novel Washing the Dead. Her essays and short fiction have appeared in Oprah Daily, Slate, LitHub, The Forward, Tablet, and elsewhere. She teaches fiction writing in the Johns Hopkins University MA in Writing Program. She's worked as a coffee barista, radio advertising salesperson, and television producer, among other jobs. She got hooked on writing fiction while she was producing television because she craved another outlet to tell the stories she was gathering. Brafman grew up in Whitefish Bay, Wisconsin, earned an MA in Fiction Writing from Johns Hopkins University, and in addition to writing, her grand passion is helping others find and tune their narrative voices. In this episode of the Epigenetics Podcast, we caught up with Karmella Haynes from Emory University to talk about her work on synthetic chromatin epigenetics. The Haynes lab focuses on the design of synthetic chromatin sensor proteins. The first one of this kind, the Polycomb Transcription Factor (PcTF), was published in 2011. It senses H3K27me3 and recruits effector proteins to the sites of this modification. This sensor can be brought into cancer cells to activate hundreds of silenced genes. The lab now focuses on characterizing the effects of these sensor proteins genome wide, and seeks to find a way to deliver those sensor into cancer cells, without affecting healthy cells. In this Episode we discuss how Karmella Haynes got into the field of Epigenetics, how she designed the PcTF sensor proteins, and the way she came to learn how important the right control experiments are. Tulsa Police Sgt. Brandon Watkins says the person who died Wednesday was a 52-year-old man. He says the man pulled a gun, jumped behind the photo counter to take photos from a clerk and then climbed back over the counter. Watkins says that while other employees tried to call police, a 28-year-old Walgreens employee shot and killed the man. Factors slowing U.S. population growth are a record low birthrate that continues to fall and a death rate that is rising slightly. For the year that ended July 1, the birthrate fell to 59.8 births per 1,000 women aged 15 to 44, according to preliminary data from the National Center for Health Statistics. That’s 14% below the most recent peak, in 2007. Preliminary data show the death rate for the year that ended July 1 rising to 867.6 per 100,000, up 3% from the same period two years earlier. The judge rejected the contention that the grand jury proceeding was flawed and then turned his attention to whether police and prosecutors exhibited bias and pervasive bad deeds to warrant a dismissal. Burke found that "there is no basis for the defendant's claim of prosecutorial or law enforcement misconduct in the proceedings." Not only will he reject the dismissal bid, but he is turning down Brafman's call for an evidentiary hearing to examine the issue. "The defendant may explore any issues of witness credibility at a trial should such witnesses testify," added the judge. The next hearing is March 7. The next phase of pretrial proceedings could have prosecutors and the defense warring over the potential for trial testimony from other women who have publicly accused Weinstein of misconduct.
