Jonathan Mearns OBE, has a job role topical to the festive season.Jonathan is a founder of London Christmas Tree Rental. The company rents out living Norway Spruce trees in England's capital city over the Christmas period. Trees are picked up by their temporary owners, then returned to their nursery after a brief encounter with the indoors. The idea of renting out Christmas trees sprang to life when, one January, Jonathan saw dozens of desiccated and discarded trees awaiting refuse collection on London's streets and thought 'There's got to be a better way than this.' Research showed that seven million trees were chucked, cast off or chipped every year and Jonathan's new business plan began.But that's not where Jonathan's career story starts, or even where it's going to end. A former police officer, who was awarded an OBE for services to international counter-terrorism in the King's New Years Honours 2023, Jonathan is now a life and career coach, an ambassador for IAfrika children's home in Nairobi, where he promotes and financially supports children's education in Kenya. And when he's not doing all of that he's an adventurer and mountaineer. In fact, it was an encounter with his own mortality on a mountain that prompted him to write a book, One Mountain, Two Minds: Taking the Mountain Metaphor to the Next Level.Jonathan is open about his lack of glowing school reports and still recalls one parents' evening when his primary school teacher made dire predictions about his future. Instead he has had an exciting, challenging, life affirming career. Rachel Johnson's career was going swimmingly. In the two decades since graduating from University of Leeds, she had worked her way up through various early careers and student research organisations, such as Milkround, Not Going to Uni, UCAS and Cibyl at Group GTI, an independent market research agency specialising in student research projects across the UK and Ireland. She was a business director, owned her own flat and when holidays came around, Rachel was ticking off a bucket list of places to see. Rachel was continuing with the running she had taken up during the pandemic and quietly, in her spare time, she volunteered at Samaritans, the charity that offers 24/7 listening support to people struggling to cope.Then in 2024, Rachel handed in her notice to take up a place as a trainee mental health social worker. Jo Faulkner-Harvey studied theatre design but left her degree early when she was offered an amazing internship. It meant working on productions and prop-making behind the scenes on such classic films as Alien. But a twist of fate a few years later found her back in Northamptonshire, working at Silverstone racing circuit before she landed a job at Oxfordshire's hospice, Katharine House.In this episode Jo talks about switching from her first love, art, and developing a passion for charity fundraising. Duncan's career change really happened when, as an advertising and marketing executive, he decided to go on a six-month motorbiking trip and sold up his home and possessions. Two years, a hurricane and several life-changing experiences later, he returned to the UK with a vision. To sell bottled water for good causes and use the profits to bring clean water projects to the one billion people worldwide who lived without access to it.In this episode of ProGRESS Duncan explains why he went into marketing rather than medicine, what made him leave a job he enjoyed and how he ended up running an ethical organisation, based on values instilled by his grandparents and parents.He also discusses:• the importance of One being carbon neutral• why One opted for green energy from the get-go• using recycled plastic for bottles before it became 'the right thing' to do.• why One was among the first UK organisations to get B Corp certification.Since his vision for One preceded the Corporate Social Responsibility (CSR) statements so many organisations make now, the private equity funders Duncan originally approached still wanted significant financial returns, while charities wouldn't get on board with a business model that handed over profits. Prior to joining KKR, he was the chief compliance officer of Prudential Investments, the mutual fund and distribution business of Prudential Financial. The US Department of Justice Criminal Division has been increasingly vocal about what makes organizations' ethics and compliance programs effective. This input on program effectiveness takes the form of guidance to prosecutors about what questions to ask when companies negotiate to resolve DOJ investigations into corporate wrongdoing on favorable terms. What does this guidance on program effectiveness mean in practice for E&C professionals? In the season 10 premiere of LRN's Principled Podcast, host Susan Divers speaks with John Michelich, who retired last November after 35 years as a federal prosecutor with the Department of Justice's Criminal Division. Listen in as they explore how the DOJ evaluates E&C programs, as well as best practices for companies settling misconduct investigations.  For a full transcript of this podcast, visit the episode page at LRN.com   Guest: John Michelich John Michelich is a retired career prosecutor, who has served at the state, federal, and international levels for 45 years. A native of Illinois, John received his undergraduate education at Illinois Wesleyan University and then attended Drake University Law School in Des Moines, Iowa. For 10 years, John served as Assistant State's Attorney and First Assistant State's Attorney in Springfield, Illinois, where he prosecuted all types of state criminal felony violations including armed robbery, aggravated sexual assault and capital murder.    In 1988, John moved to Washington, DC where he began his 35-year career as a prosecutor with the US Department of Justice, Criminal Division. As a federal prosecutor, John has handled a wide variety of cases including child pornography and obscenity, narcotics distribution and all types of white-collar criminal cases. John served for 30 years as a prosecutor with the Fraud Section of the Criminal Division where he handled numerous cases including health care fraud, bank fraud, telemarketing fraud, commodities and securities fraud and violations of the Foreign Corrupt Practices Act. Because Washington DOJ lawyers are traveling prosecutors, John has handled grand jury proceedings or jury trials in more than two dozen federal districts nationwide from Guam and Hawaii to Puerto Rico, and California to New York. Over his long career, John has tried dozens of jury trials to verdict.   In 1998, the Justice Department sent John on loan to the United Nations' International Criminal Tribunal for the Former Yugoslavia, also known as the War Crimes Tribunal, in the Hague, Netherlands, where he handled investigations and Tribunal proceedings involving crimes against humanity and serious breaches of the Geneva Convention that occurred during the Yugoslavian civil war.    For over 40 years, John has been an active instructor of Trial Advocacy and has appeared regularly on the faculty of the NITA Trial Practice course offered at Georgetown University Law Center. In addition, John has served as an Adjunct Professor at Georgetown, teaching Trial Practice courses to third-year law students. In his retirement, John is available as a legal consultant to trial lawyers to advise them in preparation for jury trials and to consult with corporate counsel concerning internal investigations and to advise them on how to approach the government when there are allegations of wrongdoing, especially foreign bribery.  John is licensed to practice in the states of Illinois and Iowa, and several federal courts, and is a licensed Solicitor of the Senior Courts of England and Wales.      Host: Susan Divers Susan Divers is a senior advisor with LRN Corporation. In this role, John leads the company's ethics and compliance program, which he designed and implemented, in addition to GF's environmental, social, and governance (ESG) functions.  Previously, John held various positions in human resource (HR) leadership for the company, including global talent acquisition and global learning and organizational development leader.    Prior to GF, John was employed by medical device maker Boston Scientific Corporation. His professional experience includes leading all aspects of HR at an ~800 employee operations facility; leading a global initiative to transform HR service delivery to include creation of service support centers in Hungary and Canada; and the creation and leadership of an internal HR Service Excellence function. John also led training and development for Global Operations, where he established the function and an integrated network of training representatives from each of the company's manufacturing facilities in the US, Costa Rica, Ireland, and the Netherlands.  Before his corporate roles, John was previously engaged in private legal practice with a focus on labor and employment matters. By Adam Turteltaub Getting employees to come forward and raise issue can be difficult. There is often genuine fear of retaliation, and many don't trust that the company will do anything. It's a topic that Cindy Morrison CCEP (LinkedIn), Director, Global Ethics and Compliance, Post Holdings, Inc. will be addressing at the 2022 SCCE Compliance & Ethics Institute and tackles in the latest Compliance Perspectives podcast. Her own journey of discovery in this area was jolted by an assessment revealing that employees did not think the company had a speak-up culture. The key to creating one, she realized, is encouraging respectful dialogue. A true, two-way discussion is necessary to help build the trust that is so essential. Employees want to be heard, and if the company isn't listening to them, they are never going to feel safe. Showing that the organization is listening begins with making the effort to know the employees, a difficult challenge in this remote-working world where employees tend to change jobs frequently. Still, it must be done and managers need to practice active listening and adapting communications style to the listener. It also means demonstrating that when employees speak up, actions are taken: bad actors get disciplined or fired, policies are changed or publicly reinforced. In addition, it is essential to remember that each facility may have its own distinct culture. That may stem from the history of the facility and who has worked there, or the ethnic makeup of the employees. It's also important to remember that not all facilities in the same country will share a common culture. As she notes, their operation in Minnesota is 70% Somali. Finally, she underscores the importance of constant education. Make sure the workforce knows all the ways it can raise issues and what to do if they feel they are being retaliated against. Susana is an assistant professor based at the Department of Logic, History, and Philosophy of Science of UNED, working on animal ethics and the philosophy of animal minds. She holds a BA in Philosophy from Complutense University of Madrid, an MA in Global Ethics and Human Values from King's College London and a PhD in Philosophy from UNED, Spain. She has been a post-doc fellow at the University of Graz and at the Messerli Research Institute in Vienna. Post By: Adam Turteltaub Perhaps the most intriguing title for a session at the 2021 SCCE Compliance & Ethics Institute was “Re-Thinking Employee ‘Engagement': What's on Your Compliance Program's Dating Profile.” Not often you see references to dating the compliance department. To learn more about the session and the ideas behind it we sat down with the speakers:  Asha Palmer, Chief Ethics and Compliance Officer, Convercent; Scheretta Wilson, Director, Ethics and Compliance, Endo1Partners; and Ronnie Kann, Head of Global Ethics & Compliance, Energizer. While the title is a bit fun and out there, the lessons are very practical and close to home. The central idea is that people are watching and listening to see what compliance does and how it acts. That means compliance teams need to focus on being approachable, engaging with their audience and, frankly, trying to be likable. Or, as they put it, and to borrow from the dating apps, you want them to swipe right, not left. So what does that mean in practice? For one, being a good listener. Just as someone who talks all the time is a bad date, while a good listener is usually a much better one, compliance needs to be a place where others feel comfortable speaking, raising concerns, and asking questions. Compliance also needs to adjust to who is on the other side of the table. For leadership the keys they see are securing buy in early, keeping it simple, and using their own language, such as demonstrating financial ramifications. For the rank-and-file workforce, success comes from helping them understand risk and what to look out for. It also means being approachable and present. And, when it comes to middle management, a group that is often overwhelmed with demands from above and below, be collaborative. Ask them how things are going both personally and for the business. Find out what's keeping them up at night. Talk about data, metrics, business impact and financial outcomes. It's the love language of business. Post By: Adam Turteltaub So much attention is paid to vetting third parties, it's easy to forget that it is just the start of the process. Monitoring needs to be done on an ongoing basis as well. Ronnie Kann, head of Global Ethics & Compliance at Energizer Holdings and Trent Sandifur, partner at Taft Law will be addressing that topic in their virtual session “What Does Third-Party Compliance Monitoring Look Like in Real Life?” at the 2021 SCCE Compliance & Ethics Institute.  In this podcast they caution that it's advisable to think of monitoring not as something separate but as a part of a larger third-party due diligence program. That program includes: Keeping an eye on what's going on with the third party Understanding what the risks are Thinking about how to monitor Making any improvements necessary to ensure the risk is effectively managed How do you get the vendor on board for the monitoring process? They recommend beginning by ensuring that monitoring is included in the initial agreement. That helps both set and manage expectations. Also, work with the vendor to make sure that while getting the information you need you are not unnecessarily burdening them. Be sure also to avoid overburdening your own business people, but, at the same, time, it's essential that they recognize that they own the risk. This can help create a spirit of partnership that will help protect your organization and make the process go smoother. Finally, they close the podcast with a discussion of what to think about as the pandemic ends and business starts catching up on all the due diligence that was done only partially when the pandemic made travel impossible. They recommend taking a risk-based approach to what you were unable to do. About the book, "Ethics, Law, and Natural Hazards: The Moral Imperative for Intervention Post-Natural Hazard": This book argues that the international community has a moral duty to intervene on behalf of a population affected by a natural hazard when their government is either unable or unwilling to provide basic, life-saving assistance. The work draws on law, international relations theory, and political philosophy to articulate that non-response to a natural hazard is unethical. In providing policy suggestions the author articulates what should happen based on an ethical analysis. Readers will thus gain an ethical lens with which to view intervention in the aftermath of a natural hazard. The book encourages readers to consider the nuances of arguments from various disciplines about whether or not intervention is appropriate. Whilst arguing throughout that an intervention policy in response to natural hazards should be developed by the international community, the study also accounts for why intervention should only be used in very limited situations. This interdisciplinary approach makes the book essential reading for researchers, academics, and policy-makers working in the areas of international law, humanitarian studies, human rights, international relations, and political science. About the speaker: Dr. Lauren Traczykowski is an American living in Birmingham, England. She started her education at Boston University studying International Relations. Whilst completing her undergraduate degree, she studied American Foreign Policy at IWP for one summer. After completing her degree and with three internships under her belt – the U.S. Department of State, Fine Gael HQ (Dublin), and Demos (London) – Dr. Traczykowski moved to Washington, D.C. to work for the U.S. Federal Emergency Management Agency (FEMA) to contribute to the Hurricane Katrina response and recovery from within the Office of International Affairs. Dr. Traczykowski then moved to the U.K. to do an MA in International Studies: Globalisation & Governance. Later, she completed a Ph.D. in Global Ethics focusing on the research she will present. Whilst still working on her Ph.D., Dr. Traczykowski taught modules on Bioethics, Contemporary Ethics, Politics and the State, Professional Ethics, and Medical Ethics at institutions around the West Midlands of the United Kingdom. Dr. Traczykowski now teaches at Aston University (Birmingham, U.K.) as a Senior Lecturer (Associate Professor). Her main teaching is in Business Ethics and Ethics in a Crisis. The mission of Pacific, Asian, and North American Asian Women in Theology and Ministry, or PANAAWTM, is to contribute to transnational feminist theological conversations and to constantly challenge the Christian church and the interpretations of scripture that have proliferated division and hatred. The New Generation Thinkers is an annual competition run by BBC Radio 3 and the Arts and Humanities Research Council. In this event, recorded with an audience at Sage Gateshead, the 2018 selection make their first public appearance together.
