From August 8, 2023: Just weeks ago, the U.S. Court of Appeals for the D.C. Circuit upheld the life sentence of a Yemeni national serving out his time at the Guantanamo Bay detention center. He had appealed this life sentence, in part on the grounds that his conviction was based on evidence obtained by torture. Meanwhile, at the Guantanamo military commissions, another detainee tried to appeal charges against him on the basis that torture-obtained evidence was used in his referral for trial by the military commissions—but in June, the body that reviews referrals for trials at Guantanamo denied this appeal. He and his co-defendants are currently set to have pre-trial hearings in October. All of this is happening despite the fact that in 2022, in a case about a different Guantanamo detainee, the Biden administration's Justice Department committed to a reinterpretation of a key statute that blocks the use of torture-obtained evidence in Guantanamo litigation and reaffirmed that it would not try to admit statements that the detainee gave while in CIA custody. So how and why is it that torture-obtained evidence still seems to be being used in certain GTMO cases? To understand the issues, Lawfare Associate Editor Hyemin Han spoke to Scott Roehm, Director of Global Policy and Advocacy at the Center for Victims of Torture, and an Adjunct Professor of Law at Georgetown Law School. They talked about the history of torture evidence at GTMO, dove into a few cases in context of the Justice Department's 2022 re-interpretation, and discussed what this all might mean for other GTMO detainees moving forward. I had the great privilege of serving with Tim at GTMO. As my deputy, Tim ran the office, putting out fires, taking care and holding people accountable, and doing the other thankless tasks. When John Baker took over as the lead defense counsel for the Military Commission Defense Organization at Guantanamo Bay, he could not imagine the abuse of power that he would go up against. Guantanamo Bay has been in the news, at least within the alternative media sphere again, after former Gitmo prisoner Mansoor Adayfi claimed in an interview with Mike Prysner of The Empire Files and Eyes Left Podcast that he was tortured by U.S. 2024 Presidential hopeful Governor Ron DeSantis at the infamous military prison. This conversation is a bit interesting as when it was recorded Andy was skeptical that the timelines surrounding DeSantis' time at Guantanmo Bay lined up with Mansoor's testimony (although this is not to say that he thinks Mansoor was lying, but rather that the story needed more clarification). However, about five days after our initial conversation, Andy and I spoke again. At that point Andy had spoken with Mansoor in order to clarify the issues. This clarification appears to add more weight to Mansoor's claim and means that the DeSantis/Gitmo story merits serious investigation. Drew Massucco and I were classmates in the basic lawyer course at the Naval Justice School in 1994, After a short stint on active duty, Drew transitioned to the Reserves, but ended up spending approximately one-half of the last 28+ years on active duty stints. When not deploying to Afganistan, the Horn of Africa, and GTMO, Drew served as a prosecutor in the US Attorney's offices in Puerto Rick and the U.S. Virgin Islands. In this episode, we talk about the advantages that JAGs have when seeking employment with the Department of Justice. Drew also explains why he remained in the employment of the U.S. Government all these years, decisions that must be made in the near future, and even sitting for a bar exam almost 20 years after sitting for his last one. (Note: Contrary to the dates discussed in this episode, Drew has not yet had his retirement ceremony, which is now scheduled for September 30, 2022, in Tampa, Florida.) As for the nickname "Chupacabra," it was his code name in GTMO and is a nod to his Puerto Rican connections.

The Mauritanian is a powerful film about a young man named Mohamedou Slahi who was held for fourteen years in GTMO. He was accused of being an Al-Qaeda operative who recruited the hi-jackers for the 9/11 attacks. He was once viewed as one of the most significant high-value detainees and under direct order of then Secretary of Defense Donald Rumsfeld he was subjected to special interrogation methods. He was beaten, kicked, and smashed across his face. Subjected to extreme cold and sexual humiliation by female interrogators. And also threatened with execution during a boat ride where he was force-fed sea water. After earning a degree in hotel and restaurant management from Drexel University, Celina Tio started cooking at Philadelphia’s Ritz-Carlton hotel. By age 23 she had become the chef of the hotel’s Grill Room. Celina moved to Orlando, Fla., to work for Walt Disney World. There she helped open two specialty restaurants: Spoodles, which features Mediterranean cuisine, and Citricos, specializing in Southern French dishes. In December 2014, the Senate Select Committee on Intelligence released its study on the CIA's Detention and Interrogation Program. Among the many infractions alleged were unlawful torture, coverups, wrongful detention, and unauthorized dissemination of classified information. Since its release, there have been many critics of that report including the Senate Republican Minority, former Vice-President Dick Cheney, the CIA, and its former directors. In this episode of Lawyer 2 Lawyer, host Bob Ambrogi interviews Guantanamo Bay (GTMO) attorney Professor Mark Denbeaux, Project 21 Chair Horace Cooper, and Cato Institute Policy Analyst Patrick Eddington. Together, they discuss the legalities of enhanced interrogation, whether or not it's effective, and the morality of its use in the theatre of war. Professor Mark P. Denbeaux is the director of the Seton Hall Law School Center for Policy and Research, which is best known for its distribution of the internationally recognized series of reports on the Guantanamo Bay Detention Camp. Professor Denbeaux's interest in the conditions of detainment arose during his representation of multiple detainees including Abu Zubaydah, who was held in a CIA dark site, as well as two Tunisian detainees from GTMO. Horace Cooper is co-chairman for Project 21's National Advisory Board and adjunct fellow with the National Center for Public Policy Research. In addition to having taught constitutional law at George Mason University, Mr. Cooper was general counsel to U.S. House Majority Leader Dick Armey. Patrick Eddington is a policy analyst in Homeland Security and Civil Liberties at the Cato Institute. A former senior policy advisor to U.S. Representative Rush Holt from New Jersey, Mr. Eddington's legislative portfolio includes security, intelligence, and detainee interrogation issues.
