Rules of the Game: The Bolder Advocacy Podcast

When nonprofits speak out on issues in the public square, the line between education and electioneering can get blurry – especially during election season. On this episode of Rules of the Game, we break down what the law allows when organizations comment on statements made by candidates and campaigns, and how those rules shift when addressing the actions of incumbents who may also be on the ballot. From issue advocacy to the risk of impermissible political intervention, we walk through practical scenarios and key guardrails to help your nonprofit stay compliant while engaging in advocacy to advance your mission. Shownotes Basic rule: 501(c)(3) organizations are prohibited from supporting or opposing candidates for public office, which means that their advocacy and actions have to remain nonpartisan. ·      Black and White: 501(c)(3)s can't endorse candidates, and they can't explicitly tell people who not to vote for. On the other hand, nonprofits can emphasize the importance of voting in a nonpartisan way, and they can continue to educate voters about issues core to their missions without suggesting who people should vote for in an upcoming candidate election. ·      Shades of Gray: IRS utilizes a facts and circumstances analysis to determine whether a nonprofit's communication is permissible or a violation of the tax code's electioneering prohibition for 501(c)(3)s. While not an exhaustive list, some facts and circumstances the IRS might consider include… o   Timing of the communication o   Targeted audience o   How the message relates to what candidates and political parties are saying, and more! ·      The IRS has also indicated that messaging that includes distorted facts, disparaging language, or statements not aimed at developing the audience's understanding of a mission-related issue can indicate a violation of the law.   Commenting on Candidates and Campaigns ·      No clear guidance from IRS on how to do this safely, but based on the required facts and circumstances analysis, best practices could include: o   Focusing on what was said (the issue), not who said it (the candidate) o   Avoiding discussions about candidate qualifications or whether someone is a good or bad candidate o   Scripting responses before talking to reporters or the public (since you may very well get a question related to the election and who people should vote for) o   Avoiding comments about a candidate's record or personal characteristics o   Avoiding references to voters and the upcoming election o   Not comparing your position on an issue to where the candidates stand on that issue ·      Remember: It is permissible to monitor what candidates say and do so that you can prepare for the future. o   The risk arises for 501(c)(3)s when they communicate in a way that could be perceived as attempting to influence the outcome of a candidate election. ·      Examples[NRO1] : o   "What if Candidate X states during a candidate debate that "our community's water quality meets all safety standards." Can a local environmental justice 501(c)(3) correct the record if that statement is false? §  Yes. The organization could clarify that the claim is inconsistent with recent state water quality reports. It could then point to publicly available testing data. §  The key is to avoid discussing the particular candidate who made the statement and instead to focus on the issue itself. Use this as an opportunity to educate the public on issues core to your mission. §  To minimize risk, avoid mentioning the candidate by name, issue disclaimers (reminders that you are a 501(c)(3) and that you do not support / oppose candidates for public office), and focus on issues in alignment with the organization's mission.   Commenting on the Actions & Statements of Incumbents ·      501(c)(3) public charities can criticize or praise the votes and official statements of current government officials. Best practices include: o   Focus on official actions only (without mentioning if an incumbent is up for reelection) o   Time communications to coincide with policy actions (as opposed to increasing praise or criticism in the days leading up to the election). o   Have a track-record of working on the issue, and make sure it's central to your mission. o   Include commentary on legislators and other government officials who are NOT up for reelection. If you focus solely on the actions of incumbents running for office, that can raise a red flag. o   Use nonpartisan criteria when deciding on which official actions and statements to call out and respond to. o   Exercise particular caution when commenting on an issue position that clearly distinguishes candidates in an upcoming election. ·      Example: o   What if a mayor in a 501(c)(3)'s jurisdiction decides to support funding cuts to programs that provide housing to the unhoused and services for housing-insecure community members? Can the 501(c)(3) public charity chime in? §  Yes. A 501(c)(3) could issue a press release criticizing the mayor's statement in support of funding cuts and urge the city to restore services where needed. §  The charity would want to have a history of working on related issues to ensure the statement is in alignment with its mission and history of advocacy. §  It would also want to avoid mentioning any upcoming elections or noting that the mayor is up for re-election. §  In addition, it's important for the organization to comment on the official statement and action immediately, as opposed to waiting until just before candidate elections occur. Nelson Dellis delivers yet another epic memory improvement book with Everyday Genius: Hacks to Boost Your Memory, Focus, Problem-Solving and Much More. In my view, this book is also a corrective to the increasing mountains of bad memory training advice online. I mean, spend ten minutes browsing memory improvement forums and you’ll start to see the rot. Same recycled advice. Same flat explanations lacking nuance. Same people “teaching” techniques they've: Never stress-tested in public Never pushed to the limits Never offered anything more than mostly copied explanations of standard mnemonic methods The toxicity for the serious student of the memory arts and mental skills is only getting worse as people ramp up their use of AI to produce even more untested “teaching” of these techniques. So the fact that Nelson actually demonstrates and performs a kind of “immersion journalism” when it comes to the techniques he teaches provides just one of many reasons why Nelson Dellis's Everyday Genius matters so much. https://www.youtube.com/watch?v=PJoc5gLIx2c How Everyday Genius Takes Memory Training Into New Terrain It’s not that Nelson has invented any new memory techniques in this book, which you can learn more about on Abrams Books. He hasn’t. And it’s unlikely that anyone ever will. As someone who has received and read Amazon reviews on memory improvement books for decades, I always find it odd when someone writes, “nothing new here.” Since even Giordano Bruno essentially announced that nothing new would be coming to the field of mnemonics back in the 1600s, the real task is to: Stop Confusing Activity with Accomplishment Nelson’s book matters first and foremost because it comes from a mnemonist of actual accomplishment. A real practitioner, not just a reader of memory improvement books who then comments on them. He’s someone who has put his mind on the line under pressure, in competition, with nowhere to hide. In other words, Nelson’s history of accomplishment adds weight to every page. And you can feel it almost immediately. Everyday Genius is written by someone who has actually lived inside the machinery of memory and various mental tactics and then extended these into real life situations: Giving a speech Making new business contacts Solving real-world problems Exploring the nature of the mind At the risk of repetition, this distinction matters more than ever, because the internet is drowning the memory arts with all kinds of secondhand certainty written by people lurking behind anonymous user accounts. What Kinds of Real-World Problems Will This Book Help You Solve? As most memory improvement books worth their salt do, Nelson covers the Memory Palace technique, a.k.a. the method of loci. But he doesn’t just recite the classic approach to this technique. He describes it from lived experience. And his approach to mnemonic images and pegword systems likewise comes from accomplishment. Then, when you go through his explanations of how to apply these mnemonic systems to remembering names or speeches, you’ll have a deeper understanding of how to implement them. Likewise when it comes to critical thinking. Nelson takes you through actual real-world scenarios and shows you how various critical thinking examples can make life a lot smoother and more successful. Making Memory & Learning Both Relevant & Fun Another major thing Nelson gets right in Everyday Genius is that he doesn’t shy away from blending the use of memory and thinking tactics for fun with more serious learning outcomes. I know that I’m guilty of not finding that balance in my own writing, even if personally I perform card magic with a memdeck and play music, etc. The cost, however, is that using memory techniques for activities like card counting can be learned a lot more readily when you have at least some of the foundational mnemonic strategies working for you. In reality, learning them doesn’t have to be a grind. And the stories and profiles of polymathic geniuses Nelson shares throughout the book will help you see the multiple layers of fun in store for you. The key is to find ways to make these techniques integrate into your everyday life. Figuring out how to do that can be a challenge, but that’s all the more reason to pay attention to the examples distributed throughout Everyday Genius. The Potentially Controversial Aspect of Everyday Genius Now, you might be wondering… Is Everyday Genius perfect and free from critique? No. And unlike his previous books like Remember It! and Memory Superpowers, Nelson takes risks that I partly admire and partly question. And one of my criticisms goes back to at least two years prior to its publication when Nelson first told us about his “remote viewing” experiments on this episode of the Magnetic Memory Method Podcast. https://www.youtube.com/watch?v=j240eFZNq04 Now, I worry about being hypocritical if I lean too heavily against Nelson when he enters such contested territory. I’ve run similar experiments myself at various times, and perhaps entered just as questionable territory with The Victorious Mind. I’m talking about: Intuition. Remote viewing. Out-of-body experiences. Lucid dreaming. To take just one example, learning to remember your dreams is easy enough to do. But Nelson talks about practicing memorizing a deck of cards while lucid dreaming, and it’s just not clear how you could test the accuracy or measure the contribution of such untestable practice to your skills. At least in the case of remote viewing, Nelson has practiced a kind of immersion journalism. Whether those tests are “scientific” or not is itself a critical thinking exercise, but I admire that Nelson: Goes into the field to report back from lived experience Is willing to face tough questions about the claims people make about such phenomena And unlike the lucid dream claim, various aspects of the claims about remote viewing and out-of-body experiences can be tested In any case, Dellis doesn't build the book on the foundation of these more experimental activities. And it is of great importance that you are invited to experiment using the protocol Nelson provides. I tried the provided remote viewing protocol myself. And frankly, I would rather explore strange terrain from Nelson Dellis who has proven all kinds of astonishing accomplishments than from yet another forum philosopher who has yet to demonstrate… anything they make claims about. The Future of Memory Training And the whole realm of claims that people make is the larger issue here for me. In our growing culture of cognitive indifference, people forget names, forget what they read, forget what they meant to say halfway through saying it, then shrug and call it normal “because internet”. But digital amnesia is not normal. And you don’t have to outsource your memory or your attention. Your standards can go up. And your self-respect along with it when you join the ranks of those who have actually done the work. That is why I think you should read Everyday Genius. Not because it is safe. Not because it is perfect. But because it is something that few books ever are: It is alive. Alive with real accomplishment. Alive with a pulse that pushes ancient tactics into modern use and combines them with other disciplines. Alive with the real signs of genius that anyone can achieve. And it treats memory as something you train, not something you talk about. But don't stop with reading and implementing this book. Do your part to help fix the culture. Stop letting the swamp of bad information on the internet define what memory training is. Memorize the most challenging information you can find and demonstrate that you can do it. Take on hard skills and prove that you’ve got them. That is your duty now if you want to distinguish yourself from the swamp and the robots. Raise the standard. That would be truly genius.

It's as if—since birth—we've been steeped in a trance. We speak these stories on loop, and they shape our reality more than we might realize.Ive learned that the key to escaping this trance, to truly coming alive, is to pause. When we catch ourselves mid-thought—especially with self-criticism—each pause becomes an invitation to rewrite our story. Let's explore how patterns of thought keep us stuck, how negative “shadow” frequencies run the show, and how to shift to higher perspectives through self-regulation.The Power of the Pause1. Recognizing the TranceEvery belief we hold about ourselves is fueled by a story. Repeated long enough, these stories become trance-like. From feeling “sick and tired of being sick and tired” to having your nervous system locked in a loop of anxiety or self-criticism, a pause in your inner monologue marks the start of transformation.2. Changing the NarrativeWhen you consciously stop negative self-talk, you leave space for something helpful to emerge. In that silence, new possibilities unfold. Over time, inserting these pauses retrains your mind to choose empowering stories instead of limiting ones.Shadow Frequencies: When Strengths Turn ToxicMany of our defining traits have a light and a shadow side. Society often honors the shadow side without realizing its damage. Consider these pairs:* Commander → Dictator: Leading becomes controlling.* Challenger → Manipulator: Healthy challenge mutates into covert pressure.* Motivator → Performer: Inspiring others degrades into seeking approval.* Healer → Wounded Healer: Helping morphs into self-neglect and bitterness.* Professor → Diminisher: Teaching becomes belittling others to feel in control.* Seer/Mystic → Perfectionist: Vision becomes obsession with an unachievable ideal.We may adopt these shadow frequencies because our culture celebrates them: the most forceful commander, the cut-throat competitor, and the relentless perfectionist are often applauded. Yet these traits, left unchecked, can hollow out our souls.Regulating Your Nervous SystemNo matter how deep your insights, if your nervous system is overloaded, transformation can remain out of reach. Feeling perpetually stressed, triggered, or anxious means your body is in constant fight-or-flight mode, and it's challenging to access inner wisdom from that state.Working from the “bottom up” (beginning with the actual physiological patterns of tension, trauma, or overwhelm) allows you to:* Release the Energy: Stored trauma—large or small—can hold us back.* Access New Storylines: A calmer body helps you reclaim choice over your internal narrative.* Ground Your Insights: Self-regulation ensures your knowledge becomes lived wisdom, not just theoretical understanding.From the Shadow to the Light* Burn Down the Old HouseSometimes, to build the life you truly desire, you have to let the old structure collapse: the beliefs, identities, or illusions that no longer serve you.
