Fair Repair Act Audio Sources May 16, 2024 Senate Armed Services Committee Witnesses: Carlos Del Toro, Secretary of the Navy Clip Sen. Elizabeth Warren: So the Navy acquires everything from night vision goggles to aircraft carriers through contracts with big defense contractors, but the contractors often place restrictions on these deals that prevent service members from maintaining or repairing the equipment, or even let them write a training manual without going back through the contractor. Now the contractors say that since they own the intellectual property and the technical data underlying the equipment, only they have the right to repair that equipment. These right to repair restrictions usually translate into much higher costs for DOD, which has no choice but to shovel money out to big contractors whenever DOD needs to have something fixed. So take the Navy's littoral combat ship, General Dynamics and Lockheed Martin considered much of the data and equipment on the ship to be proprietary, so the Navy had to delay missions and spend millions of dollars on travel costs, just so that contractor affiliated repairmen could fly in, rather than doing this ourselves. Secretary Del Toro, when a sailor isn't allowed to repair part of their ship at sea, and a marine isn't allowed to access technical data to fix a generator on a base abroad. One solution is for the Navy to buy the intellectual property from the contractors. So can you say a little bit about what the benefits are of the Navy having technical rights for the equipment that it has purchased. Sec. Carlos Del Toro: The benefits are enormous, Senator, and we've actually had tremendous success, I'd say, in the last year and a half to two years, through the taxpayer advocacy program that we initiated when I came in. There have been three examples, one, gaining the intellectual property rights for the new ACV class of ships that will replace the AAVs. The F-35 negotiations really proved themselves out in a significant way as well, too. And lastly, the 20 F-18s that the Congress authorized in ‘22 and ‘23, we were able to make significant gains in terms of the government finally getting the intellectual property rights that were necessary for us to be able to properly sustain those moving forward. Sen. Elizabeth Warren: So I am very, very glad to hear this. I like the taxpayer advocacy project and how you're training contract officers to secure technical equipment that the Navy buys, but I think you should have the support of Congress on this. Senator Braun and I have introduced the Stop price gouging the military act to give DoD more tools to get cost and pricing data so that you will be in a better position to negotiate better deals with contractors. There's also more that we can do to ensure that the Navy and the rest of the services have the rights they need to bolster readiness. So let me ask you, Secretary Del Toro, would having a stronger focus on right to repair issues during the acquisition process, like prioritizing contract bids that give DoD fair access to repair materials, and ensuring that contract officers are looking into buying technical rights early on, would that help the Navy save costs and boost readiness at the same time? Sec. Carlos Del Toro: Very much. Senator, in fact, one of the things that we have prioritized since I came in as Secretary of the Navy, given my acquisition background, is actually those negotiations need to happen as early as possible before that we even as we develop the acquisition strategy for that contract to go out to bid, and by doing so, we will reap tremendous returns. Lacchia Professor of Law, University of Michigan Law School , Legal Fellow, Hudson Institute's Forum for Intellectual Property Kyle Wiens, Co-founder and CEO, iFixit Paul Roberts, Founder, SecuRepairs.org; Founder and Editor-in-Chief, the Security Ledger Scott Benavidez, Chairman, Automotive Service Association; Owner, Mr. B's Paint & Body Shop Clips 41:25 Scott Benavidez: My name is Scott Benavidez. I'm the Chairman of the Automotive Service Association's Board of Directors. I am also a second generation shop owner from Albuquerque, New Mexico, Mr. B's Paint and Body Shop. Scott Benavidez: We do have concerns when some insurers insist on repairs that are simply cheaper and quicker, without regard to quality and safety. Repairers understand better than anyone the threat of replacement crash parts or lesser quality. We can and should have a competitive marketplace that doesn't compromise quality or safety, deciding to only cover the cheapest option without understanding implications for quality leaves collision shops and their customers in a tough position. Very few consumers have the knowledge about these types of crash parts used on their vehicles as numerous crash parts in the marketplace, such as OEM (original equipment manufactured) parts, certified aftermarket parts, aftermarket parts, reconditioned crash parts, and recycled crash parts. Repairers can make recommendations, but their customers are unlikely to hear if the insurance won't cover them. 46:45 Paul Roberts: My name is Paul Roberts, and I'm the founder of Secure Repairs. We're an organization of more than 350 cyber security and information technology professionals who support the right to repair. 46:55 Paul Roberts: I'm speaking to you today on behalf of our members to make clear that the fair access to repair materials sought by right to repair laws does not increase cyber risk, and in fact, it can contribute to a healthier and more secure ecosystem of smart and connected devices. Paul Roberts: Proposed right to repair legislation considered by this Congress, such as the Repair Act, or last session, the Fair Repair Act, simply asks manufacturers that already provide repair information and tools to their authorized repair providers to also provide them at a fair and reasonable price to the owners of the devices and to third parties that they may wish to hire to do their work. 47:35 Paul Roberts: By definition, the information covered by right to repair laws is not sensitive or protected, as evidenced by the fact that the manufacturers already distribute it widely to hundreds, thousands, or even tens of thousands of workers for their authorized repair providers. This could be everyone from mechanics working at auto dealerships to the folks staffing the Geek Squad at Best Buy. 48:00 Paul Roberts: Also, we have yet to find any evidence that the types of information covered by right to repair laws like schematic diagrams, service manuals, diagnostic software and replacement parts act as a portal to cyber attacks. The vast majority of attacks on internet connected devices - from broadband routers to home appliances to automobiles - today exploit weaknesses in the embedded software produced and distributed by the manufacturers, or alternatively, weak device configurations so they're deployed on the internet in ways that make them vulnerable to attack. These security weaknesses are an epidemic. A recent study of the security of Internet of Things devices, by the company Phosphorus Labs, or a cybersecurity company, found that 68% of Internet of Things devices contained high risk or critical software vulnerabilities. As an example, I'd like to call attention to the work of a group of independent researchers recently led by Sam Curry, who published a report, and you can Google this, "Web Hackers vs. the Auto Industry" in January 2023. That group disclosed wide ranging and exploitable flaws in vehicle telematics systems from 16 different auto manufacturers. At a leading GPS supplier to major automakers, the researchers claimed to obtain full access to a company-wide administration panel that gave them the ability to send arbitrary commands to an estimated 15.5 million vehicles, including vehicles used by first responders, police, fire and so on. Hacks like this take place without any access to repair materials, nor is there any evidence that providing access to repair software will open the doors to new attacks. 50:05 Paul Roberts: For the last 25 years, Section 1201 of the Digital Millennium Copyright Act has given manufacturers an incentive to deploy software locks widely and to limit access to security researchers. That's kind of a model what we call in cybersecurity, security through obscurity. In other words, by keeping the workings of something secret, you're making it secure. But in fact, that doesn't work, because cyber criminals are very resourceful and they're very determined, and they don't really care what the law says. 50:35 Paul Roberts: Section 1201 has also enabled what one researcher has described as dark patterns in the design and manufacture of hardware that includes everything from locking out customers from access to administrative interfaces, administrative features of the products that they own, as well as practices like part pairing, which Kyle will talk to you more about, in which manufacturers couple replaceable components like screens and sensors and cameras to specific device hardware. Such schemes make manufacturers and their authorized repair providers gatekeepers for repairs, and effectively bar competition from the owners of the devices as well as independent repair providers. 54:45 Kyle Wiens: You think about what is local? What is American? Main Street you have a post office and a repair shop. And unfortunately, we've seen the whittling down of Main Street as the TV repair shops went away when the manufacturers cut off access to schematics, as the camera repair shops went away when Nikon and Canon decided to stop selling them parts. We've seen this systematically across the economy. In the enterprise space, you have Oracle and IBM saying that you can't get security updates to critical cyber infrastructure unless you buy a service contract with them, so they're tying long term service contracts with the security updates that are necessary to keep this infrastructure secure. 56:45 Kyle Wiens: Over the last decade plus, I've been working on Section 1201, trying to get exemptions for the ability to repair products. The challenge that we've had in the section 1201 process every triennial I go back and we ask for permission to be able to fix our own things is that the exemptions we've gotten really only apply to individual consumers. They aren't something that I could use to make a tool to provide to one of you to fix yourself. So in order for someone to take advantage of a 1201 exemption that we have, they have to be a cybersecurity researcher and able to whittle their own tools and use it themselves, and that just doesn't scale. 57:45 Devlin Hartline: My name is Devlin Hartline, and I'm a legal fellow at the Hudson Institute's forum for intellectual property. 57:50 Devlin Hartline: I'd like to start with a question posed by the title of this hearing, is there a right to repair? And the answer is clearly no. A right is a legally enforceable claim against another, but the courts have not recognized that manufacturers have the duty to help consumers make repairs. Instead, the courts have said that while we have the ability to repair our things, we also have the duty not to infringe the IP rights in the process. So it is in fact, the manufacturers who have the relevant rights, not consumers. 58:30 Devlin Hartline: Right to repair supporters want lawmakers to force manufacturers to make the tools, parts, and know-how needed to facilitate repairs available to consumers and independent repair shops. And the assumption here is that anything standing in the way of repair opportunities must necessarily harm the public good, but these tools, parts and know-how, are often protected by IP rights such as copyrights and design patents. And we protect copyrighted works and patented inventions because, as the Constitution recognizes, this promotes the public good. We reward creators and innovators as an incentive for them to bring these things to the marketplace and the public benefits from the introduction of new products and services that increase competition. Thus, the right to repair movement isn't based on a pre-existing right. It's instead asking lawmakers to create a new right at the expense of the existing rights of IP owners. 1:00:45 Devlin Hartline: IP owners are merely exercising their federally protected IP rights, and this is not actionable anti-competitive conduct. It is instead how the IP system is supposed to work. We grant IP owners exclusive rights so they can exclude others, and this, in turn, promotes the investments to create and to commercialize these creative innovations in the marketplace, and that promotes the public good. Aaron Perzanowski: My name is Aaron Perzanowski. I am a professor of law at the University of Michigan, and for the last 15 years, my academic research has focused on the intersection of personal and intellectual property rights in the digital economy. During that time, the right to repair has emerged as a central challenge to the notion that we as consumers control the devices that we buy. Instead consumers, farmers, small businesses, all find that manufacturers exert post-sale control over these devices, often in ways that frustrate repair. Aaron Perzanowski: Repair is as old as humanity. Our Paleolithic ancestors repaired hand axes and other primitive tools, and as our technologies have grown more complex, from the Bronze Age through the Renaissance, to the high tech devices that we all have in our pockets here today, repair has always kept pace. But today, manufacturers are employing a range of strategies that restrict repair, from their hardware and software design choices to clamp downs on secondary markets, and we also troublingly see attempts to leverage IP rights as tools to restrict repair. These efforts are a major departure from the historical treatment of repair under the law, the right to repair is not only consistent with nearly two centuries of IP law in the United States, it reflects half a millennium of common law property doctrine that rejects post-sale restrictions on personal property as early as the 15th century. English property law recognized that once a property owner sells an item, efforts to restrain how the new owner of that item can use it are inconsistent with the essential nature of private property and obnoxious to public policy. As the Supreme Court has repeatedly recognized, IP laws' respect for the property interests of purchasers of copyrighted and patented goods was profoundly shaped by this common law tradition. In 1850, the Supreme Court recognized that the repair of a patented machine reflected "no more than the exercise of that right of care, which everyone may use to give duration to that which he owns." A century later, the Court held that the repair of a convertible car roof was justified as an exercise of "the lawful right of the property owner to repair his property." And just a few years ago, the court reaffirmed the rejection of post-sale restrictions under patent law in Impression Products vs. Lexmark, a case about refurbishing printer ink cartridges. Copyright law, not surprisingly, has had fewer occasions to consider repair restrictions. But as early as 1901, the Seventh Circuit recognized "a right of repair or renewal under US copyright law." When a publisher sued to prevent a used book dealer from repairing and replacing damaged components of books, the court said that "the right of ownership in the book carries with it and includes the right to maintain the book as nearly as possible in its original condition." A century after that, Congress itself acknowledged repair as a right that owners enjoy, regardless of copyright restrictions, when it enacted section 117 C of the Copyright Act. That provision was designed to undo a Ninth Circuit decision that allowed copyright holders to prevent third party repairs of computers. Section 117 C explicitly permits owners of machines to make copies of computer programs in the course of maintenance or repair. And finally, the US Copyright Office over the last decade has repeatedly concluded that diagnosis, repair, and maintenance activities are non-infringing when it comes to vehicles, consumer devices, and medical equipment. So the right to repair is firmly rooted in basic principles of US IP law. Aaron Perzanowski: Section 1201 of the DMCA makes it practically impossible for consumers to exercise their lawful right to repair a wide range of devices, from tractors to home electronics, even though the copyright office says those activities are not infringing, and the weakening of standards for design patents allow firms to choke off the supply of replacement parts needed to repair vehicles, home appliances, and other devices. Aaron Perzanowski: One way to think about a right is as an affirmative power to force someone else to engage in some behavior, and in some cases, that is what we're talking about. We're talking about imposing, especially on the state level, regulations that impose requirements on manufacturers. I think that's true of the Repair Act on the federal level as well. But, I think part of what we also need to keep in mind is that sometimes what you need to effectuate a right is to eliminate barriers that stand in the way of that right. So we can think about this, I think, helpfully in the context of tools that enable people to engage in repair. The state level solution has been to require manufacturers to give their own tools to repair shops, sometimes compensated under fair and reasonable terms. The other solution would be to change section 1201 to say, let's allow independent repair shops to make their own tools. I think both of those solutions have some value to them. I also think it's really important to keep in mind that when we're talking about IP rights, there are always multiple sets of interests at stake, and one of the key balances that IP law has always tried to strike is the balance between the limited statutory exclusive rights that the Patent and Copyright Acts create and the personal property rights of consumers who own these devices. And so I think a balancing is absolutely necessary and appropriate. 1:15:20 Aaron Perzanowski: I think the best solution for Section 1201 is embodied in a piece of legislation that Representatives Jones and Spartz introduced in the last Congress, which would create a permanent exception to Section 1201 for repair that would apply not only to the act of circumvention, but would also apply to the creation and distribution of tools that are useful for repair purposes that does not open the door to broad, unrestrained, creation of circumvention tools, but tools that are that are targeted to the repair market. 1:16:40 Devlin Hartline: He cited a case about where you can repair a cover on a book. That's very different than recreating the book, every single word in it, right? So there's a difference between repairing something and then crossing the line into violating the exclusive rights of IP owners in the patented product or the copyrighted book. And so the things that repair supporters are asking for is that, if somebody has a design patent that covers an auto body part, well, they have the right to exclude other people from making that part, but repair supporters say they shouldn't have that exclusive right, because, you know, we could increase competition if we just took away their design patent and now other people could make that part, and so that's competition. But that's not the type of competition that IP law and competition law seek to support. That's like saying, if we just let the Pirate Bay copy and distribute all of the Disney blockbuster movies, then that's competition, and prices would go down. But that's not the way that we do it, right? So competition means other people come up with new products and new services, and so that's what we should be trying to support. 1:26:45 Rep. Jerrold Nadler (D-NY): Repair advocates argue that section 1201, prevents non-infringing circumvention of access controls for purposes. But Congress contemplated this use when it passed the DMCA in 1998, allowing for a triennial exemption process. Is the exemption process working as intended? And if not, are there actions Congress can take to expand exemptions or make them easier to acquire? Devlin Hartline: What's important about the triennial rulemaking is that the proponent of an exemption has to come forward with evidence and demonstrate that there's actually a problem and it relates to a certain class of works, and then they can get a temporary exemption for three years. And so it is true that the Librarian of Congress, the last few rulemakings, has said that because using a copyrighted work in a way for repair, maintenance, etc, is Fair Use that they grant these exemptions. But these exemptions are quite narrow. They do not allow the trafficking of the computer programs that can crack the TPMs. And so it's very narrowly done. And the concern is that if you were to create a permanent exemption that opens things all the way up with access controls, copy controls and trafficking thereof, is now you're getting to the point of why we even have these TPMs under 1201 in the first place, and that's because they guard against piracy. And so the concern is that you're opening the piracy floodgates. You make these devices less secure, and then content owners are going to be less likely to want to put their content on these devices. Rep. Ben Cline (R-VA): How does section 1201 of the DMCA impact the ability of consumers and independent repair shops to modify or repair devices that have proprietary software and data in the consumer electronics industry? Aaron Perzanowski: Thank you so much for the question. As we've been talking about the copyright office in 2015, 2018, 2021, and they're in the process for the current rulemaking, has determined that engaging in circumvention, the removal or bypassing of these digital locks for purposes of repair, is perfectly lawful behavior, but there is a major practical mismatch here between the legal rights that consumers enjoy under federal law today and their practical ability to exercise those rights. And that's because, as Devlin was just describing, the section 1201 rulemaking does not extend to the creation or distribution of tools, right? So I have the right under federal law, to remove the technological lock, say, on my video game console, if I want to swap out a broken disk drive. How do I do that? I'd like to think of myself as a pretty technologically sophisticated person. I don't have the first clue about how to do that. I need a person who can write that code, make that code available to consumers so that I can. All I'm trying to do is swap out a broken disk drive on my video game. But you would argue that code is proprietary, correct? So I'm talking here about a third party making their own code that is simply allowing me to engage in activity that the Copyright Office has repeatedly said is non-infringing. Rep. Ben Cline (R-VA): So you want to give them a map. Is that, essentially, what you're saying? Aaron Perzanowski: Absolutely, yes, I do. Rep. Ben Cline (R-VA): Do trade secrets play a role in the right to repair debate? Aaron Perzanowski: There are occasions where trade secrets are important. I don't think in the context that we're talking about here with section 1201, that we're typically running into trade secret issues. The state-level bills that have been introduced do typically address trade secrets and often have carve outs there. And I think that's something worth considering in this debate. But I think it's important to keep in mind that just because we have some hypothetical worry about some unknown bad actor taking a tool that I use to fix my video game console -- Rep. Ben Cline (R-VA): It's not unknown. The Chinese do it all the time. Aaron Perzanowski: I don't think the Chinese are particularly worried about whether or not I can fix my video game console, and in fact, I think that point is important, but the bad actors already have these tools. All we're trying to do is get very targeted tools in the hands of law abiding citizens who just want to repair the stuff they buy for their kids for Christmas, right? If the Chinese are going to hack the PlayStation, they've already done it. 1:32:25 Aaron Perzanowski: So the 1201 process is what established the legality of circumvention for repair purposes. But when Congress created that rulemaking authority, it only extends to the act of circumvention, the actual removal. Congress did not give the [Copyright] Office or the Librarian [of Congress] the authority to grant exemptions to the trafficking provisions, and that's where I think legislative intervention is really important. 1:39:00 Kyle Wiens: One of the challenges was section 1201. It doesn't just ban repair tools, it also bans the distribution of cybersecurity tools. And so we've seen security researchers....Apple sued a company that made a security research tool under 1201 and that tool has markedly made the world more secure. It's very popular amongst government security researchers. So I think that's kind of the sweet spot is, allow some third party inspection. It'll make the product better. 1:41:25 Kyle Wiens: These ice cream machines are made by Taylor, and there is an incredibly complex, baroque set of touchscreens you have to go through. And then there's a service password you have to be able to get past in order to access the settings that really allow you to do what you want. And so, in an ideal world, you'd have an entrepreneur who would come along and make a tool to make it easier for McDonald's, maybe they could have an app on their phone that they could use to configure and help them diagnose and repair the machine. Unfortunately, the company who made that tool is struggling legally because of all these challenges across the board. If we had innovation outside of the manufacturers and to be able to develop new tools for fixing ice cream machines or anything else, you have a whole flowering ecosystem of repair tools right now. It doesn't exist. The US is like this black hole where innovation is banned in software repair. There's all kinds of opportunities I could see, I had a farmer ask me for help fixing his John Deere tractor, and I had to say, I can't do that particular repair because it's illegal. I'd love to build a cool app for helping him diagnose and fix his tractor and get back back in the field faster. We don't have that marketplace right now. It's like farmers have been forced to, like, use cracked Ukrainian versions of John Deere diagnostic software, right? Rep. Russell Fry (R-SC): So it's not just ice cream machines. I led off with that, but it's farmers, it's farm equipment, it's iPhones, it's somebody's Xbox, right? I mean, these are all things.... in your experience, what are the challenges that these customers and stakeholders face when they're trying to repair their own devices? What are some things that they face? Kyle Wiens: It's absolutely infuriating. So my friend, farmer in San Luis Obispo, Dave grows all kinds of amazing products. He has a $300,000 John Deere tractor, came to me and said, Hey, there's a bad sensor. It's going to take a week to get that sensor sent out from Indiana, and I need to use the tractor in that time. Will you help me bypass the sensor? I could hypothetically modify the software in the tractor to do that. Practically, I didn't have the legal ability, and so he had to go and rent an expensive tractor for the week. This is impacting people's lives every single day. 1:43:50 Rep. Russell Fry (R-SC): So, to pivot a little bit, what role do you see from a federal side, from legislation, and what specific measures do you think might be included in such legislation? Kyle Wiens: So we've seen the solutions being approached from two angles. At the state level, you have states saying John Deere and other manufacturers, if you have a dealership that has fancy tools, sell those tools to consumers and to independent shops, allow that competition. At the federal level, what we can do is enable a competitive marketplace for those tools. So rather than compelling John Deere to sell the tool, we can say, hey, it's legal for someone, an entrepreneur, to make a competing tool. And you have this in the car market. You can take your car down the AutoZone, you can buy a scan tool, plug it into your car, and it'll decode some of the error messages. Those tools exist on the auto market because we have a standard diagnostic interface on cars that you can access without circumventing a TPM. We don't have that for any other products. So another farmer in my town, he showed me how if he has a transmission go out on a truck, he can fix that. But if he has a transmission go out on his John Deere tractor, he can't. He can physically install the transmission, but he can't program it to make it work. I'd love to be able to make a software tool to enable him to replace his transmission. Aaron Perzanowski: So I think if we see passage of the SMART Act, we can anticipate significant reductions in the expenses associated with auto collision repairs. Estimates are that design patents on collision parts are responsible for about $1.5 billion in additional expenditures. We see price premiums on OEM parts over third party parts often reaching into like the 40% range, right? So these are pretty significant cost savings associated with that. Part of this problem, I think, does relate back to the kind of unique structure of this market. Most consumers are not paying out of pocket for collision repairs. Those costs are being covered by their auto insurance provider, and so the consumer doesn't see that the - I'm pulling this from memory, so don't hold me to this figure - but the side view mirror of a Ford Fiesta costing $1,500, that's not something that the consumer is confronted with, right? So this goes back to the question of notice. Do consumers know when they buy that vehicle that the repairs are going to be that expensive? I think in most cases, they don't. And so I think the SMART Act is a very targeted solution to this problem. I do think it's important to note that the design patent issue for replacement parts is not limited to the automotive industry. I think it's the most, I think that's the area where the problem is most pressing. But home appliances, consumer electronics, we see companies getting design patents on replacement water filters for refrigerators so that they can charge three times as much when the little light comes on on your fridge to tell you that your water might not be as clean as you want it to be. So I think we have to think about that problem across a range of industries, but the automotive industry, I think, is absolutely the right place to start. Paul Roberts: I mean, one point I would just make is that with the Internet of Things, right, we are facing a crisis in the very near future as manufacturers of everything from home appliances to personal electronics to equipment, as those products age and those manufacturers walk away from their responsibility to maintain them. So we're no longer supporting the software. We're no longer issuing security updates. Who will step in to maintain those devices? Keep them secure, keep them operating right? The manufacturers walked away. Do we just get rid of them? No, because the equipment still works perfectly. We're going to need a market-based response to that. We're going to need small businesses to step up and say, hey, I'll keep that Samsung dishwasher working for another 20 years. That's a huge economic opportunity for this country, but we cannot do it in the existing system because of the types of restrictions that we're talking about. And so this is really about enabling a secure future in which, when you buy a dishwasher with a 20 year lifespan, or 25 year lifespan, it's going to last that 25 years, not the five to six years that the manufacturer has decided, you know, that's how long we want to support the software for. Paul Roberts: My understanding is the use of design patents has increased dramatically, even exponentially, in the last 10 to 15 years. If you go back to the 90s or 80s, you know, parts makers, automakers were not applying these types of patents to replaceable parts like bumpers and rear view mirrors. Somebody had a business decision that, if you can do so, then we can capture more of that aftermarket by outlawing identical aftermarket replacements that has a huge downstream impact on car owners and on insurers and on all of us. 2:10:15 Paul Roberts: Both of the things that we're really proposing or talking about here, which would be changes to Section 1201 of the DMCA as well as passage of robust right to repair laws, would empower a market-based response to keeping the internet of things working, secure and functioning. DMCA 1201 reforms by making it clear that you can circumvent software locks for the purpose of repair and maintenance and upkeep, right? So that would take the threat of the federal crime away from small business owners as well as security researchers who are interested in, you know, plumbing that software for purposes of maintenance, upkeep and repair. And on the right to repair by making the tools available to maintain and upkeep products - diagnostic software, schematic diagrams, service manuals - available. Once again, you'll be empowering small business owners to set up repair shops and say, I'm going to keep your smart appliance running for its full 25 or 30 year lifespan, and I'm going to support my family doing that locally, and not be basically choked out of business by a company that says, Well, you don't have the right to access this product. From a cybersecurity perspective, that is really important, because one thing we don't want is a population of millions or tens of millions of out of date, unsupported, unpatched, insecure internet connected home appliances, webcams, home routers out there available to nation state actors, cyber criminal groups, to compromise and use for their own purposes. And that's something we already see, particularly around broadband routers and other types of devices, and it's a real threat going forward that I think this type of these types of changes would support. Aaron Perzanowski In a lot of instances, this conversation, and we've touched on this earlier, focuses on cost savings, right? And cost savings are an important consideration, right? Farmers aren't thrilled that they have to pay a technician from the John Deere dealer to drive maybe hours to get to their farm and connect their laptop and, you know, download these payload files to enable their equipment to work. But in the agricultural space, the thing I hear most often in the conversations I have with farmers is and Kyle touched on this a bit earlier, is a real concern about the time sensitivity of their work. If your tractor is out of commission for a week or two in the wrong part of the season, that is going to have disastrous effects, right, not only on that farm's economic outlook, but collectively, it can have an impact like, not to be hyperbolic here, but on our national food supply, and so I think it's really important that farmers have flexibility in terms of where and how they execute repairs, so that they can get their equipment back up and running. If my laptop breaks and I can't get it fixed for a week or two, I'm annoyed there will be emails that go unanswered, but like the world will continue to spin. That is not the case in the agricultural space where we, I think, have to be much more concerned. Rep. Darrell Issa (R-CA): If I remove from my BMW, at least during certain models, I remove the radio, unplug it, and then plug it back in, simply because I was fiddling around with the dash, I now have to go back to the dealer to reinstall it. Similarly, the transmission example. I've got two John Deere tractors. One's got a busted engine, the other's got a busted transmission. Currently, they will prohibit you from moving the transmission from one to the other. From a standpoint of intellectual property, where, in God's green earth or the Constitution, are any of those designed to be rights that belong to the manufacturer, rather than rights that belong to the owners of those two John Deere tractors? Devlin Hartline: So those are a bunch of different situations, and so I think there would be underlying facts that differ with each right. So we started on the iPhone, and I was going to point out that iPhone will actually give you the tool to synchronize it. In those other situations, I don't know the business justification for it. How is that an IP problem? Right? So if that's locked up with the TPM, and you have to bypass the TPM, well then that's a violation of 1201, so that's how they can that's how they can lock -- Rep. Darrell Issa (R-CA): So what you're saying is that Congress has created impediments to the right to repair. Mr. Roberts, would you say that is correct? That, in fact, the right to repair, were Congress never to have done anything since, you know, George and Thomas were our presidents, so to speak, knowing those two presidents, we'd be able to do things we're not able to do because they're now prohibited by acts of Congress. Paul Roberts: Yes, and we certainly know going back to the 50s, 60s, 70s, there was a much more you know....First of all, companies would ship products with service and repair manuals with detailed schematic diagrams with the understanding that owners would want to replace and service them. And what I would say is, yes, absolutely. I doubt very much. And I know we had members who were here in 1998 authoring the DMCA. I think if you had said to them, in 25 years time, this law will be used to prevent somebody with a broken dishwasher from getting that serviced by their local repair shop or by for fixing it themselves, this law will prevent them from doing that, I doubt very much they would have said, yeah, that's pretty much what we want. Rep. Darrell Issa (R-CA): Well, I will tell you that the I was the chairman of what is now the Consumer Electronics Association in 1998 and we did predict a lot of these items were going to be expanded beyond the scope of the original. Paul Roberts: Right now this is not an urgent issue, because most of the cars out there are older vehicles. As we move forward, as telematic systems evolve, as automakers continue their trend of moving more and more information to telematic systems, this is going to become a bigger problem. I'll point out another problem, which is the Massachusetts law is contingent on data transfers of diagnostic and repair information via the OBD or onboard diagnostic two port under the dashboard. That's only there because of federal Clean Air law. Electronic vehicles don't have that port because they don't have emissions, and so in the very near future, as we shift to electronic vehicles, that data access port will no longer be there. It will all be telematics data, and so the utility of the Massachusetts law is going to decline over time, going forward. And again, I you know, when you start talking about right to repair, you become like this crazy person who talks about right to repair every time it comes up. But one thing I try and stress to people when I talk to them about auto repair is, if you live in Michigan or California and you have taken your vehicle to the local independent repair shop, you have only done that because the voters in Massachusetts passed a ballot measure over a decade ago and then updated it in November 2020. That is the very thin thread that our right to use independent auto repair hangs by in this country. That's not the way it's supposed to be. This is something that affects vehicle owners, hundreds of millions of them in all 50 states. And it's a type of thing that the federal government needs to address with federal legislation. It should not hang by this very thin thread. 2:30:20 Rep. Hank Johnson (D-GA): Are software updates new creations, and thus copyrightable? Devlin Hartline: Software updates, yeah, they're computer programs, and so Congress said explicitly in 1980, but it was understood before then, that computer programs are literary works and they're protected, just like any other copyrighted work. Rep. Hank Johnson (D-GA): Thank you, Professor Perzanowski, do you disagree? Aaron Perzanowski: I don't disagree at all that software updates are protectable subject matter under the Copyright Act. But what I think is important to keep in mind right is the Copyright Act and copyrights exclusive rights, and all of the exceptions and limitations to copyrights exclusive rights are created by Congress, and so if you think those rights are interfering with other important issues and concerns, then I think Congress clearly has the power to make changes to the copyright law in order to best serve what you ultimately determine to be in the public interest. 2:35:30 Aaron Perzanowski: Access to firmware and other code is really essential to the functioning and repair of lots of devices. I think there's some important differences between the standard essential patent context and kind of what we're talking about here in that in the standard essential patent context, we're relying on standard setting bodies to identify technologies and to require companies to license their patents under fair, reasonable and non-discriminatory terms. We don't quite have that infrastructure in place in the copyright context, but what we do have are compulsory licenses that exist within the Copyright Act already, one of which you were alluding to earlier, the mechanical license for musical works. We also have compulsory licenses for retransmissions of satellite and broadcast content that essentially say the copyright owner is entitled to compensation of some form, but they're not entitled to prevent people from using or accessing that underlying work, and I think that could be a useful framework here for getting owners of devices access to the firmware that they need. Welkom allemaal bij een nieuwe aflevering van onze podcast met de missie de online automotive beter maken. Vandaag gaan we het doen met Hielke Ytsma, oprichter van CarQall, en hij gaat ons alles vertellen over hoe en op welke manier eigelijk de inbound, vooral de inbound inkomende telefoontjes beter afgehandeld kan worden. Hielke, wat fijn dat je er bent. Wie is Hielke Ytsma Hielke Ytsma, uit Groningen deze keer, met een redelijke automotive achtergrond. Ik ben ooit afgestudeerd aan HTS Autotechniek te Arnhem. Ik ben ook afgestudeerd bij een mooi bedrijf Volkswagen in Wolfsburg wat sowieso een unieke ervaring is geweest. Ik heb mij ook veel bezig gehouden met embedded technology. Terug gekomen in Nederland, daar heb ik samen met een andere zakenpartner een bedrijf opgericht, wat zich voornamelijk bezig houdt met complexe automotive accessoires zoals multi media systemen, DAB-tuners en noem maar op. En uiteindelijk ook IUT-oplossingen voor auto's, dat zijn blackboxen die data realtime kunnen verzenden vanuit voertuigen, met het geloof dat we data nodig gaan hebben om de klant te kunnen gaan ontzorgen, maar ook relevante data te kunnen leveren voor de dealers en uiteindelijk ook de OWM's. In de jaren 2008-2009 zijn wij gegroeid aan de OBD-dongels en we hebben daar andere oplossing voor gevonden waarmee je eigenlijk veel meer data eruit kunt halen. De dongels worden nog steeds gebruikt, omdat ze makkelijk te implementeren zijn, maar de nieuwe systemen/technieken zijn veel uitgebreider.   Waar gaat de data naar toe en waarvoor is het precies? Uiteindelijk gaat de data naar het platform toe waardoor je als eigenaar/rijder rechten geeft wie deze data mag zien. De data kan dan met toestemming doorgegeven worden aan het autobedrijf/fabrikant zelf. Men stopt heel wat focus en tijd in het verkopen van de auto, maar ik denk dat de data die de auto genereert heel belangrijk is voor de customer journey in die aftersales. Een van de belangrijkste data die voor de dealer veel kan betekenen is de voorspelling wanneer een auto daadwerkelijk voor een onderhoudsbeurt moet komen. In de ideale wereld, als je ervoor kunt zorgen dat een dealer inzicht heeft over wanneer de auto's voor een servicebeurt moeten komen, dan kun je zo ook de piek momenten afvlakken en vooral ervoor zorgen dat de mensen tijdig voor onderhoud komen en dat ze niet geconfronteerd worden met een wachttijd van dagen.   Demo digitale assistent Er worden een aantal services aangeboden door de digitale assistent van CarQall, waarbij er in het planningssysteem van de dealer gekeken kan worden wanneer de eerste mogelijkheid is van de combinatie services. Bij deze heeft de klant de mogelijkheid om akkoord te gaan met de gegeven optie, of de klant mag een andere datum en tijd kiezen die beter schikt. Binnen maximaal 2 minuten heb je een werkplaats afspraak gemaakt. Deze afspraak wordt vastgesteld in het systeem van de dealer en de beller krijgt ook een sms'je. Je kunt zelfs kiezen tussen een mannelijke stem of een vrouwelijke stem. We hebben ook diverse talen.   Hoe is het begonnen? Het begon eigenlijk bij klantenservice. Er werden telefoontjes gemist, mensen belden buiten openingstijden. Dus zijn wij nagegaan hoe wij dit kunnen oplossen, hoe kunnen wij ervoor zorgen dat wij ook buiten openingstijden beschikbaar zijn, ook telefonisch, dat mensen alsnog een terugbel afspraak dan wel een proefrit kunnen plannen. Toen we dat eenmaal hadden staan en gebruik maakte van de technieken was natuurlijk de eerste vraag waar een dealer mee komt: ‘Leuk dat jullie het voor sales en voor occasions doen, maar aftersales daar zit de grote telefonische druk. En daar moesten dan wat meer partners gaan aansluiten voor je DMS, planningssoftware, zodat je die koppelingen in orde kan krijgen.   Slot Als dealers autobedrijven leasemaatschappijen geïnteresseerd zijn in de diensten kunnen zij in contact komen via www.carqall.com. En daarop kun je bellen of een mail sturen. Als je belt dan krijg je gelijk Max aan de telefoon en dan maken we een afspraak met je. We komen heel graag langs om samen te kijken waar de behoeftes liggen en welke processen er zijn, en hoe wij ervoor kunnen zorgen dat een digitale assistent werkt voor het bedrijf, maar ook voor de klant. Please only listen when you can safely Close your eyes. Alo. Wow. You know what? So much to tell you so many things to talk about. Yes. Yay. Let me start with how long has it been since my last recording? 12th of August? No. The 11th of August. And it's now the 18th yet a week. Exactly a week. Wow. Now, you know, those that listen regularly know that? Very, very, very rare that I would go a whole week without making a recording. Very, very unusual. And that's it. Oh, yeah. Did I say that right stuff to say didn't know what was it? Basically, I've managed to save my podcast, which is good on my podcasts, just quite a few. But it got canceled on me because I didn't have the funds to pay for the monthly subscription, which was last week. And so I wasn't able to make a new recordings. And then xsigo Khan put on kind of hold, but they didn't cancel anything. And then eventually, they tried to take payments, I think three four times, and then they cancelled it like cancelled. And every time one sort of webs onto the podcast is said I was you know, obviously I couldn't make any new recordings. But they put me on to a free the free one. Luckily, they didn't delete any of my old stuff, as far as I know. But they had a big red warning saying that I was 14,000 hours over limit 14,000 hours. Wow. 14,000 hours. This is so this is that's a brain freeze. Oh, if ever there was one. Because I'm only on the free one. I'm only allowed allowed five hours. And they said that they would start to I don't know if they stopped the old stuff being available, but I don't think they did. Because I was still getting over 4000 downloads a day. Which kind of surprised me really are the stats were even though I wasn't producing anything. The stats were okay. In a weird Carnival way. I mean, the last two days so far, some a few a couple of hours left. But I've had nearly 4000 yesterday 4400 4900 the day before 4300 day before that. Just under 4000 day before that 4900 the day before that. And then 7724 the day before that. So obviously went down. But it still didn't go down to a really small amount. Still, like a million and a half a year, he did nothing. If I did zero if I made no podcasts, which was quite nice, which I guess that means that either the audience is growing or people are just listening to some of the oldest stuff. Because I mean, some of the older stuff might be better than the newest stuff. I don't know. It's all down to personal opinion, I guess. But yeah, here I am. I'm back. I'm back, baby. I'm back with a vengeance. I'm not sure. We've anger here. A little bit of anger. A little bit of a little Have a resentment that I There you go. I'm only human. So yeah, I got helped. I did, I did reach out for a bit of help with this. And you know, I didn't didn't get much help. The thing is, in fairness, I've had a lot of help from a lot of people over the years. So I'm not in a position to really moan about any familly, when it comes to that is just, I was a little bit concerned, I was gonna lose all of my work. Now, I wouldn't lose everything. But I want to say thank you to Helen Hayward, who did actually send me a PayPal gift to help me to pay. It went towards what I paid. But you know, it's the amount was $120. So I had to wait till I got paid today in order to pay it. So now it's all back, as it were, I hope I hope he did. OBD. The thing is, well know that there is no thing is this. Even though it's it's been like a week or whatever, since I last pilot, since I was due to pay, it will now be another three weeks when I pay again, because they don't, I don't pay a month after today, because they kept everything on there. So I'll have to pay it a month after when I should have paid it. So there'll be three weeks time I'll have another payment to make. But that's okay. Is this all right? It's okay. It's not on. So being so angry. It's it is what it is. But you know, what? My eyes to a few things. So I kind of realized that, um, you know, the can't rely on any any outside situation to keep this going. So I have to be a little bit more organized a little bit more organized. And I've done all right, really considering was it now every 16 years, or 15 years, coming up to 16 in January. So he's 16 years old, I've been making podcasts and videos and stuff like that online. So I kind of must have done all right, if you've kept it going this long. So I'll I'll intending to keep again, for the rest of my life. So however long there is some, I've got no intention of stopping. Or even if I did stop properly. Or if I stopped for a while or a break or you know, went on holiday for a bit, you know, still went to prison or even knows whatever. I still keep the podcast going. I'd still still keep it all keep all everything going, even if I didn't make any new recordings for a while. And something that I'm going to be doing. And this won't be available anywhere else. But my podcast is I'm going to be making versions of the early recordings on all podcasts. So for example, my stop smoking, or the whistling stop smoking podcast, I'm going to do each of those recordings of music, as you know, two hours or five hours like I do now. But they weren't, they might be on the podcast. But for the let me boil to sleep, I'm going to go back to the very first recorded. And this won't be today this will be over the next few months probably because it will take a long time to do it because of the quantity. And all of those recordings that I've done in the past that are eligible, where it works. We'll have music in the background. But they will only be available on my website. So you'll be able to just go to the page where we have the recording. And we'll have three different episodes embedded into the page so you can listen to it without music with two hours music three and five hours of music as it is now with the up to date stuff but that's all I'll be doing. Just add into the pages are already there. Because there are 1000s of pages on my website where for each individual recording you know, there's so fails 14 1500 something like that. So without 1000 only with server that has and always growing, always growing unfortunately body parts will keep growing but they don't shrinking. Things start to shrink i think you know what dude knows so also don't have a lot of back fat that's why I'm telling you that but I saw someone with like a similar but tracksuit top that I wear the hoodie. And someone was walking past me that big old floppy, back that anaphor I don't have that I've got a belly. I think mobile is going down a bit of income starting to not so much to lose weight, but I think distribute the fat, you know, trying to move some of it more into a hot area. But yeah, I haven't got I'm not sad, my back's fat free. But I haven't got like massive. I've got big love love handles, on my back, or my lower back. So I think I might have I'm not so maybe you still don't know, I think you might have slimmed down a little bit. I do a lot of stretching now from from my lower back has been problematic to me. I do stretches every single day, a variety different stretches, and also squats and stuff like that, trying to strengthen my lower not just my lower back balls or my hips, and my core and my legs as well. Because it's really weird because when I first started doing the squats, the first one that is with my knees is to be quite sore. And it used to be almost a strain to sort of do a few. Now I could do like 30 4050 and it's not even an effort. It's just really weird. And I can go further down than I used to out to my record if I kept doing it, I'll probably be able to nearly put me bomb on the floor. Although to be fair, I've only got to lean back a little bit me bombs touching the floor. I've got a message to say I was so I didn't reply to this yet. Sorry. To message once from Ben. Hi, Jason. But I had to draw it out because it just keeps getting taken out my bank by direct debits and just continuously so I had to take it out. Otherwise I wouldn't have any money to get me through to next week. But what I did do is Oh, you're his mother. What I might do. Rachel is Go through the years of 1980 all the way through to maybe, you know, just the 80s every year for the 80s. And just go through some of the songs maybe some of the news that happened in my country on Rachel Rachel's country as well. Now I could do like 30 4050 and it's not even an effort. It's just really weird. And I can go further down than I used to out to my record if I kept doing it, I'll probably be able to nearly put me bomb on the floor. Let me start with how long has it been since my last recording? 12th of August? No. The 11th of August. And it's now the 18th yet a week. Exactly a week. Wow. Now, you know, those that listen regularly know that? Very, very, very rare that I would go a whole week without making a recording. Very, very unusual. And that's it. Oh, yeah. Did I say that right stuff to say didn't know what was it? Basically, I've managed to save my podcast, which is good on my podcasts, just quite a few. But it got canceled on me because I didn't have the funds to pay for the monthly subscription, which was last week. And so I wasn't able to make a new recordings. And then xsigo Khan put on kind of hold, but they didn't cancel anything. And then eventually, they tried to take payments, I think three four times, and then they cancelled it like cancelled. And every time one sort of webs onto the podcast is said I was you know, obviously I couldn't make any new recordings. But they put me on to a free the free one. Luckily, they didn't delete any of my old stuff, as far as I know. But they had a big red warning saying that I was 14,000 hours over limit 14,000 hours. Wow. 14,000 hours. This is so this is that's a brain freeze. Oh, if ever there was one. Because I'm only on the free one. I'm only allowed allowed five hours. And they said that they would start to I don't know if they stopped the old stuff being available, but I don't think they did. Because I was still getting over 4000 downloads a day. Which kind of surprised me really are the stats were even though I wasn't producing anything. The stats were okay. In a weird Carnival way. I mean, the last two days so far, some a few a couple of hours left. But I've had nearly 4000 yesterday 4400 4900 the day before 4300 day before that. Just under 4000 day before that 4900 the day before that. And then 7724 the day before that. So obviously went down. But it still didn't go down to a really small amount. Still, like a million and a half a year, he did nothing. If I did zero if I made no podcasts, which was quite nice, which I guess that means that either the audience is growing or people are just listening to some of the oldest stuff. Because I mean, some of the older stuff might be better than the newest stuff. I don't know. It's all down to personal opinion, I guess. But yeah, here I am. I'm back. I'm back, baby. I'm back with a vengeance. I'm not sure. We've anger here. A little bit of anger. A little bit of a little Have a resentment that I There you go. I'm only human. So yeah, I got helped. I did, I did reach out for a bit of help with this. And you know, I didn't didn't get much help. The thing is, in fairness, I've had a lot of help from a lot of people over the years. So I'm not in a position to really moan about any familly, when it comes to that is just, I was a little bit concerned, I was gonna lose all of my work. Now, I wouldn't lose everything. But I want to say thank you to Helen Hayward, who did actually send me a PayPal gift to help me to pay. It went towards what I paid. But you know, it's the amount was $120. So I had to wait till I got paid today in order to pay it. So now it's all back, as it were, I hope I hope he did. OBD. The thing is, well know that there is no thing is this. Even though it's it's been like a week or whatever, since I last pilot, since I was due to pay, it will now be another three weeks when I pay again, because they don't, I don't pay a month after today, because they kept everything on there. So I'll have to pay it a month after when I should have paid it. So there'll be three weeks time I'll have another payment to make. But that's okay. Is this all right? It's okay. It's not on. So being so angry. It's it is what it is. But you know, what? My eyes to a few things. So I kind of realized that, um, you know, the can't rely on any any outside situation to keep this going. So I have to be a little bit more organized a little bit more organized. And I've done all right, really considering was it now every 16 years, or 15 years, coming up to 16 in January. So he's 16 years old, I've been making podcasts and videos and stuff like that online. So I kind of must have done all right, if you've kept it going this long. So I'll I'll intending to keep again, for the rest of my life. So however long there is some, I've got no intention of stopping. Or even if I did stop properly. Or if I stopped for a while or a break or you know, went on holiday for a bit, you know, still went to prison or even knows whatever. I still keep the podcast going. I'd still still keep it all keep all everything going, even if I didn't make any new recordings for a while. And something that I'm going to be doing. And this won't be available anywhere else. But my podcast is I'm going to be making versions of the early recordings on all podcasts. So for example, my stop smoking, or the whistling stop smoking podcast, I'm going to do each of those recordings of music, as you know, two hours or five hours like I do now. But they weren't, they might be on the podcast. But for the let me boil to sleep, I'm going to go back to the very first recorded. And this won't be today this will be over the next few months probably because it will take a long time to do it because of the quantity. And all of those recordings that I've done in the past that are eligible, where it works. We'll have music in the background. But they will only be available on my website. So you'll be able to just go to the page where we have the recording. And we'll have three different episodes embedded into the page so you can listen to it without music with two hours music three and five hours of music as it is now with the up to date stuff but that's all I'll be doing. Just add into the pages are already there. Because there are 1000s of pages on my website where for each individual recording you know, there's so fails 14 1500 something like that. So without 1000 only with server that has and always growing, always growing unfortunately body parts will keep growing but they don't shrinking. Things start to shrink i think you know what dude knows so also don't have a lot of back fat that's why I'm telling you that but I saw someone with like a similar but tracksuit top that I wear the hoodie. So a thousand Hills ranch, we have the men's gathering. 0 (43s): There's a free dinner worship and then testimonies. And you're asked to bring a friend. So if you've never been, maybe grab a friend, go out to the M six gathering. There's no RSVP needed to show up. And then lastly got one more announcement. That's the Kings, the kids spring keeps saying Kings. I don't know why. I'm sorry. The kids spring choir. And this is the last week to sign up. So if you have a child from second grade and up and you're, and they're interested in joining the choir performance at the end of may, email Leslie or head for the info center for more information on that in the rehearsals will be on Sundays from 10 20 to 10 50. We're so grateful. Lord, You got to pray that you would touch every person in this room and on this campus whoever's watching online. And so I pray that we'd just be anxious and hungry for it. Lord, like, like we're anxious and hungry for a good meal. When we're really hungry, Lord that we would just be anxious and hungry for our time with you today. And then God that you would fill us to overflowing with abundance. So we leave this place filled up with you and, and we can spill it out on everybody else, Lord, and with love and grace and truth and hope kindness. 3 (19m 2s): Thank you Lord. We need you. I, since I was a young guy, I've just always appreciated worship and the time just that, that is set apart just to seem to the King and to give our hearts fully to him. And so I'm thankful for the opportunity this morning, thankful for Easter last week. So many people came out and spent days setting everything up. Mike Apadaca was out there with his tractor, grading, everything and our back area and dozens of people helping to set things up beginning like on Thursday and through Friday and Saturday and Sunday. And it was just really, really powerful. 4 (19m 60s): And then the cleanup, you know, happen in a couple hours, thanks to so many people who just, who stuck around and, and helped us out with that. It was just really, really good. After Easter. We had this crazy idea that we'd go backpacking. So we, my son and I, so the youth were planning this backpacking trip and they were planning to leave Tuesday to go back off of figure a mountain off of one 54. And it's about a 6.8 mile hike. And so Jeremy, our youth and family pastor said, Hey, why don't you guys leave a day early and make sure that there's actually camping spots available for another 25 people or so coming back. 4 (20m 40s): So, so Curtis and I got up after the long Easter weekend and we left about seven 38 in the morning and we began to hike and just had a wonderful, wonderful time as I was hiking. I thought there's so many parallels, so many parallels to the Christian life, the Christian walk and this hike we're on this backpacking trip that we're on. In fact, when we finally made it there, we, we didn't, we didn't share this thought with each other until we actually got to the, the, the destination we both said to each other, Curtis said, Hey dad, if you weren't with me, I probably wouldn't have made it all the way. 4 (21m 21s): I probably would have stopped and camped along the way, because there were, it was just a lot of uphill and that sort of thing. I said, Curtis, that's exactly what I was thinking. If you weren't here, I would have stopped like a mile back and just said, that's enough. But we both realized we would have totally missed the amazing destination that we experienced if we would have given up and so much like the Christian walk, the Christian life. If we don't have people spurring us on holding us accountable and challenging us to continue what we're going to settle for something far less than what God has for us. And so I was super grateful. Curtis was there and then we got there and there was plenty of spots. And so we called back to Jeremy and said, Hey, come on out, man. 4 (22m 4s): There's lots and lots of room. And so he came out and they all 25 of them, it was really, really powerful that the day that they were supposed to come out, it was getting about four o'clock and they had been on the trail for a while. So I was kind of getting anxious for them to be out there and I wanted to see them. And so I just started down the trail and I got about a mile back from the, the main campsite there and there they were, they were all settled there and kind of taken a break before they made the final descent. And it was yeah, really, really good. But one guy had pulled a muscle in his leg and he was really struggling carry his backpack. And so we got a chance to help him carry his backpack. The last mile that isn't, that just like the Christian life. 4 (22m 44s): Sometimes we get injured or we're discouraged. We don't know how we're going to press on. We don't know how we're going to finish and get to the destination, but others come along, come around us and help us to carry the burdens that we have to get us moving. And to our destination, I tell you, what is the best, most beautiful destination? There were two waterfalls. I should've brought a picture, a video right. Or something, but there were two waterfalls coming down and flowing into this big, big, like eight foot deep pool of water that you could swim in and refresh yourself. And it was so amazing, so much better than the campsite that was a mile earlier, or even the ones that were just along the way we would have totally missed it. 4 (23m 29s): I think that's kind of, God's message to us is that we will totally miss out on God's best if we give up and maybe you're here today and you're kind of wondering whether you want to press on in your faith as your, as a follower of the Lord, Jesus Christ. And you've got this big backpack on and you're just kind of feeling weary and just kind of feeling worn out. I just want to encourage you that God is with you and he will help you get there. He will help you get there, but maybe you got this pack on and, and there's, there's an art to packing a backpack, right? Like you don't want to pack too much. There are things that you need. Like, you need a tent, a sleeping bag, a sleeping pad. You need, you know, cookware and food and that sort of thing. 4 (24m 10s): But there are certain things that you don't need to carry in like big, heavy stuff that just kind of wear you out. So you gotta be careful not to have too much on your pack. Otherwise it's cumbersome and it's difficult to keep going forward. So some of us in our lives, we're carrying all of this extra unnecessary weight, this baggage, this burden burdensome stuff that the Lord just wants to lift off off of us. It's it's really a picture of God's. You know, Jesus said, my yoke is easy, so there's a yoke, but he said, my burden is light. So he wants to lift it off of you. So if you're carrying around just old baggage from past mistakes and failures, sins, whatever it is, just confess that to the Lord. 4 (24m 54s): If we confess our CNC is faithful and just to forgive us and to cleanse us from all unrighteousness. So what he'll do is he'll lift that, that bag of that burden off of our bag. And then we'll be able to kind of March on through. I remember when I got to the campsite and took off the backpack, it was just like, Oh man, you feel like you're walking on air because all of that weight is off of you. I think that's kind of the experience that God wants us to have like something of a lighter load in our lives. So confess whatever you need before the Lord today, and just watch his grace and mercy wash over you and watch your, your law, your load kinda lighten up. It was just a powerful deal, but as kind of back, as long as we were walking and I'll just kind of share this story for a little bit and the, can we start the clock? 4 (25m 37s): Thank you. Because now I'm not, I'm not going to know how much time I have and it doesn't really matter cause I'm just going to go till I'm finished anyway, but now there we are, but it's helpful to know that I'm over, right? So it's just helpful to know. So as, as we were hiking, there was a lot of incline and my son would tell me, he kept, he kept telling me, Hey, dad look up. Cause I'm I got, you know, I'm just going, you know, it's just trying to get the job done. And he would tell me, look up Dan, look at, look at what we're hiking in. And, and he would just remind me of all of the beauty, the wonder of what God had created and is sustaining even now. And it was just like this refreshing experience. 4 (26m 18s): We're going to be talking about a biting with God today. We're actually going to be answering the question. What does godliness look like? What does godliness look like? And I, I couldn't help, but make a lot of para a lot of comparisons to that backpacking trip because I was reminded of so many wonderful things as I just chose to look up and abide with God and appreciate his presence 5 (26m 45s): And appreciate his beauty. I think sometimes we can just get busy, right? We've got our head, 4 (26m 49s): It's Dan, we got stuff to do. And we don't look up 5 (26m 53s): And just say, thank you Lord for life and for breath and for 4 (26m 57s): Family and for whatever it is that you want to thank the Lord for, we can get burdened down by maybe illness or disability or whatever it is. And we don't, if we don't look up, we're just kind of stuck with our heads down. And like my son told me, I'm telling you look up, look up, God's doing some really, really amazing things. If we'll just stop and pay attention. So what does godliness look like? We're going to kind of unpack that today. We're going to kind of discover that today because I think God wants us to experience something of newness in our walk with him, our relationship with him. He wants to breathe life into us in such a powerful way that we walk out of this place with new perspective. 4 (27m 42s): I remember just sitting around the campfire when we were there just before the kids got there. And even after the kids got there, just sitting around the campfire, just being so filled with gratitude for what the Lord has done. I mean, I just, I looked around at his creation and then that caused me to ponder about my, my own life and my family and the way that God has just blessed our church and taking care of us. And I just, I just was filled with this refreshing gratitude. It was so important and so necessary for, for my life as I just sat there and just thought about the Lord. There's something about abiding with him and allowing him to buy it to abide in us. That is just life-giving and powerful. And we get busy and distracted and we miss out on those things. 4 (28m 26s): So let's take a look at what Paul wrote to Timothy in first Timothy chapter four. And we'll get to that answer. What does godliness look like with that? Let's say as you guys turn to first Timothy four, I just want to pray, 5 (28m 37s): Lord Jesus. We just pray. And we thank you for your presence here. 4 (28m 42s): We were able to sing that last song and just talk about how much we love you with all of our hearts and minds and soul and strength or got God. I know you're blessed by that Lord. And I just want to declare that as a church, we love you Lord, and we want you to have your way with us today. 5 (28m 59s): We want you to speak to us where we need. 4 (29m 2s): I need you to speak to us, to challenge us where you need, where we need to be challenged, Lord God, that we would be 5 (29m 10s): Encouraged today and put back on the right path. Maybe it's been a tough journey and some of us are feeling the burden, the weight of it all. Lord, I just pray that you would bless us as we trust you in Jesus name. Thank you, Lord. Amen. 4 (29m 28s): The 41. Now the Holy spirit tells us clearly that in the last times, in the last days, some will turn away from the true faith and they will follow deceptive spirits and teachings come from demons. There's a temptation as the return of Christ draws near. And this has been going on for the last couple thousand years since its Ascension, there's this, there's this temptation to walk away from it. So walk away from the Lord and to pursue other things. But God has got us on this path and he doesn't want us to give up. Although there challenges and difficulties along the way, coming back out of the hike while going into the hike, I had been wearing these boots and they weren't, I guess they weren't broken in very well. 4 (30m 16s): So I was getting these hotspots and these blisters. And so I decided just to put on my sandals, he saw these, you know, strap on sandals and I hiked the rest of the way. And then I was hiking out and I realized I'm getting gnarly blisters on my feet. As I'm hiking out with these sandals, I would've wore socks with the sandals, but then I would've been, looked like an old guy. So I, I didn't want to look like an old guy. Although I do typically wear socks with sandals, but I decided I would just, just go for it. I thought, what choice do I have? Like I gotta get outta here. Like I five miles from the trail head. I gotta just keep going. I can't stop and wait here for three days until my blisters heal up. Right? Cause then I'm going to walk another mile and get some more blitzers I got to stop again. 4 (30m 59s): I think the challenge for us is that we've got to just continue to move forward two hours or destination. Although we do deal with troubling things, temptation and sickness and all kinds of challenges in our life. But what I noticed is that God gave me the grace just get to continue to walk out. I literally have silver dollar size blisters in between my toes, but I was like, I know they're there, but I'm not going to look at them. I'm just going to keep marching forward because I don't have a choice, right? I'm not going to, you know, I'm not going to stand out there until, till they get cleared up. So what I noticed is that God gave me the grace and then I get home. I get to my destination. 4 (31m 39s): Wife makes this hot water with Epson salt, you know, Epsom salt. I don't know what it's called, but you put your feet in there and it just creates this nice soothing experience. I wouldn't have had that soothing experience if I were to quit on the trail, right? God's got such blessing for us. If we just don't give up, if we refuse to give up, but continue to March forward. Now the Holy spirit tells us clearly that, that in the last time, as the time of Christ return draws near some will turn away from the true faith and they will follow deceptive spirits and teachings that come from demons. Listen, there's only one true faith that leads to heaven. 4 (32m 19s): There are many faiths in the world, many counterfeit faith, but only one faith leads to the God who created and sustains the universe. There's one God that offers salvation by grace, through faith. And some are tempted to turn away. Some will turn away from faith in Jesus alone, and they 6 (32m 40s): Will follow deceptive spirits and teachings that come from demons. So anything that is contrary to the scripture and what the scripture says about Jesus and who he is and what the scripture says about God and who he is is, is a contrary gospel. It's a counterfeit gospel perpetuated by demons by the fallen angels. That the enemies 5 (33m 3s): Of God, there's one God that offers salvation through grace, by grace, through faith. And the Holy spirit has revealed this 6 (33m 12s): Truth, that in the as time wears on, 5 (33m 15s): And this has been going on for the last couple thousand years, people will be tempted to walk away from the faith. 6 (33m 21s): Mark 1322 says for false messiahs and false prophets will rise up and perform signs and wonders. So as to deceive, if possible, even God's chosen ones, watch out. I have warned you about this ahead of time. So there's a warning of, for the church, for the believers of Christ that says, Hey, be careful not to get distracted or to be hindered from your faith in the Lord. Jesus Christ in acts 2029. Luke wrote, I know that false teachers like vicious wolves will come in among you. After I leave, not sparing the flock. Even some men from your own group will rise up and 5 (34m 1s): Start the truth. In order, in order to draw a following, 6 (34m 6s): What kind of people would do this? Like what kind of people would intentionally draw others away from the truth? Well, Paul tells us in first Timothy four, two, these people are hypocrites 5 (34m 16s): And liars and their conscience is, are dead. 6 (34m 21s): So these people are not who they claim to be. They are deceivers like their father, the devil himself, who is the father of lies. And they, they are without a functioning conscience. So their conscience and sear, they're dead, they're liars and deceivers. So these are the people. These are the entities that are trying to draw us away from our faith. And so don't, don't be surprised when you feel like giving up. It's it's an age old ploy of the enemy to get us distracted and hindered, getting us to refuse, to believe the truth of who Jesus is and what he wants to do 5 (34m 59s): In our lives. These people are not who they claim to be. 6 (35m 2s): They're deceivers without a functioning conscience, they will do what counterfeit religious leaders have always done. Counterfeit religious leaders have always heaped, heavy burdens and restrictions and expectations on 5 (35m 15s): Their followers. That's what we see throughout the throughout history and in the scripture of religious leaders, 6 (35m 23s): This is what verse three says. They will say it is wrong. These these religious leaders, they will say it's wrong to be married and wrong D certain foods, but God created those foods to be eaten with. Thanks by faithful people who, the truth, the Bible knowledge commentary States, the false teachers plaguing the Ephesians church were the forerunners of the Gnostics of the second century. The Gnostics believed that spirit is good and matter is evil. So anything that is got matter to it is evil, but spirit is good. So they believed all appetites relating to the body are therefore evil and should be rooted out, including normal desire for sex and food. 6 (36m 9s): And so they're saying don't get married, don't eat certain foods. It's all of these heavy duty restrictions that these religious leaders want to keep on us trying to get us to conform to their, their plan and purpose. So it's wrong to be married. Ron, what does God say about that? This is, this is what needs to be our response to anything that we hear that is sideways or seems different than the, than the word of the Lord. What does God think? Genesis two 18 in the new living translation, it says, then the Lord, God said it. It's not good for the man to be alone. I will make a helper who is just right for him. And so God has created marriage to be a blessing to humanity. 6 (36m 49s): Now there are single people in the world who are called to it, or just in their circumstances. They're single right now. And God's blessing is upon them, but God has created marriage as a good thing for the world. The early deceivers also said that it's wrong to eat certain foods. What a bummer. I got a quick, quick joke. So this Catholic nun in this Catholic school was in the cafeteria with all of the Catholic kids. And there was this big bowl of apples in the line of the food. And so the Catholic nuns brought a little note that said only take one, Apple, God is watching. 6 (37m 31s): So, but at the other end of the line and the cafeteria was that big old platter of chocolate chip cookies. And so one of the students said, take all you want because Dodd is watching the app 7 (37m 44s): Bulls. 6 (37m 48s): I would prefer a chocolate chip cookie over an Apple any day. In fact, the only reason I eat healthy food like apples is so that I can have a chocolate chip cookie and enjoy the food that God has had called, called us to enjoy. But the early deceivers would say, it's wrong to eat certain foods. What does God say that? What does God think about that? And acts chapter 10, the apostle Peter fell into a trance and had a vision from the Lord acts 10, 11 through 16, says this. He saw the sky open and something like a large sheet was let down by its four corners in the sheet were all sorts of animals, reptiles, and birds. Then a voice said to him, get up Peter kill and eat them. 6 (38m 33s): And what does Peter say? No, no Lord was his response. Listen, it's never a good idea to say, no Lord, it's a contradictory term. Like it's an oxymoron. You can't have Jesus as Lord and leader and King of your life and say no to him. Because by saying no to him, it declares that he's no longer your King and Lord and leader. And so for Peter to say, no Lord, he was showing a bit of his old nature. Have you ever had that creep up in your life where your old nature pops up and you're like, no Lord. Like I was arguing with the Lord the other day about meeting with some guy for prayer. 6 (39m 13s): It's like, Lord, I don't have time. I don't want to meet with this guy. Although I felt like I was supposed to meet with the guy. As soon as I'm having this argument with the Lord, I get a text from the guy that I'm supposed to. Hey, are we still praying together? I'm like, of course we're still praying together. Get over here. So, but we have this tendency to resist the good stuff Lord wants to do in our lives. No Lord Peter declared. I've never eaten anything that our Jewish laws have declared impure or unclean, but the voice spoke again, do not call something unclean. If God has made it clean, the same vision was repeated three times. Then the sheet was suddenly pulled up to heaven. 6 (39m 55s): Verse four says since everything God created is good. This is back to first Timothy four. Since everything God created is good. We should not reject any of it, but receive it with things where we know it has made acceptable by the, by the word of God and prayer made acceptable by the word of God and prayer. So now we have, I have to think, okay, God has created all of these wonderful things in the world and they're all good. Can we just indulge in anything and everything that God this created. And so we think about this, you know, this, the, the, we have this idea when it comes to food and when it comes to this new legalized thing called marijuana, and we think, well, if it's legal, then it must be okay, but it's clear that we're not to take anything that altered our mind. 6 (40m 49s): The scripture's very clear about this. So these are the guidelines for how we're to enjoy what God has created. We follow the word of God and we enjoy what God has provided for us with prayer. And thanks giving. So can I have anything I desire without measure? Well, let's look at a couple of verses here. You Zeke, you'll see. 1649 says Sodom sins were pride, gluttony and laziness. Well, the poor and needy suffered outside the door. So we know that we're allowed to enjoy everything, everything that God has given to us in the area of food, as long as we're not doing it in excess gluttony, we have to exercise some self control. 6 (41m 30s): So I, I stand up here and I, my gut constantly sucked in because if I don't suck it in, then it shows my Ponch, right. But my Ponch is there because I refuse to exercise. Self-control regarding sweets in my life. And so yesterday my wife said, Hey, would you like a cinnamon roll? And I said, no, I'm not going to eat the cinnamon roll because I just had a snack. I'm not having another snack. So an hour later, she's outside in the garden and I decide it's time for another snack. So I had a cinnamon roll that she made for my birthday because my birthday was just last week. And she made these amazing homemade cinnamon rolls with all of this icing on top. 6 (42m 10s): And then my daughter had, had bought me some, this, these donuts that I enjoyed as well. And then Jolene also had made this Apple pie that was just calling me. So I had donuts and I had Apple pie and I as cinnamon roll. And there was no, no wonder why I wasn't hungry for dinner, but I found a way to get dinner in me as well. It was just this incredible experience. And so that's called the sin of gluttony and I did lose 10 pounds, but I need to lose about 10 more. I, I, I, I think if I lost 10 more, I'd get rid of that gut. I wouldn't have to suck it in everywhere. It's uncomfortable to have to suck in your stuff 4 (42m 48s): Like everywhere. But that's what I gotta do. Cause I'm bill gluttonous. One of the, 6 (42m 56s): The fruit of the spirit of self-control. And I've realized that when I'm like, self-control in one area of my life that tends to spill over into other areas of my life. And so we have to be careful, 4 (43m 5s): Well that we're exercising. Self-control in all areas of our life. Now I know some of you is like, shut up Henry about your gut, right? You're like, I can barely hear 6 (43m 14s): You. See it. Listen. If I took my shirt off, you'd really see it right. Took it off bare chesty to be like, whoop, all of a sudden, there it is. Right. I've never had a gun. So now that I got one, I'm like, 4 (43m 26s): I'm trying to, I'm trying to hide it. That's why I wore these flowery shirts. They kind of nevermind, whatever. 6 (43m 33s): What else does the Bible say about our appetite? Galatians five 19 through 21 says when you follow the desires of your sinful nature, the results are very clear. Sexual immorality in purity, less skull pleasures, idolatry, sorcery, hostility, quarreling, jealousy, outbursts of anger, selfish ambition, dissension, division, envy, drunkenness, wild parties, and other sins like these. Let me tell you again, as I had before that anyone living that sort of life will not inherit the kingdom 4 (44m 5s): Of God. So there's 6 (44m 7s): A word in verse 20 that mentioned, it's mentioned it's the word is sorcery. That word is also witchcraft. The Greek word. There is farming KPI, a pharma Kia, depending on how you pronounce it. And it means which 4 (44m 21s): I think what happens is, is when we avail ourselves to the, the unhealthy 6 (44m 33s): Use of drugs in our life, whether we're smoking dope, listen, 5 (44m 36s): The kid smoking dope is my favorite thing to do in the whole world. Why? Because it's a great escape, right? I would smoke. I would get high. I would go to sleep and I'd be out for a few hours. He was great. 6 (44m 48s): But then I realized that God has called us to live a life that we're not meant 5 (44m 54s): To escape from. And 6 (44m 56s): When I realized that over the course of my life, I realized I don't need to run 5 (44m 60s): Toward farming, farm 6 (45m 2s): Makiah. I don't need to run toward drugs. I can run to Jesus and find this stuff that I need. Often we're running to the wrong stuff, whether it be food 5 (45m 12s): Or drugs, 6 (45m 13s): And especially with legalized marijuana. Now I just got back from Colorado about a month or so ago. And 5 (45m 19s): There's, there's dispensaries 6 (45m 21s): All over. Like you can walk in anywhere and get marijuana. It's just a 5 (45m 26s): Early thing. It will wreck your life. I'm just going to tell you it will wreck your life. And just because it's legal in California, doesn't mean that you should be taking it. Anything that is going to alter your mind, whether it be drunkenness or any really any kind of addiction, some are addicted to sex or pornography. Some are addicted to wine. Alcohol, some are addicted to drugs. I know a guy who was addicted to drugs, painkillers for a year, 6 (45m 55s): And I've known this guy for years. And I, I I'm on the phone with him one day. I'm like, dude, are you loaded? Seriously? You sound like you're loaded. And I didn't know that he was loaded, but he was loaded. Right? And it was a wake up call 5 (46m 7s): To him. And he realized 6 (46m 10s): That he was hooked and he needed to get clean from his drugs. And so he's been clean for about the last year, 18 months or so. And you know, what's improved in his life, 5 (46m 19s): Everything right? His, his financial problems got cleared up. Why? Because he stopped spending so much money on drugs because it's black market drugs that he had to get because he couldn't get his doctor to prescribe anymore. His marriage got fixed. His family got fixed because he wasn't jacked up on drugs anymore. His spiritual life got squared away because he wasn't jacked up on drugs anymore. Listen, drugs, 6 (46m 43s): Addictions, all of these things will Jack 5 (46m 46s): You up. 6 (46m 48s): I didn't even realize how jacked up he was until he got off the drugs. When he got off the drugs and he realized, man, my, this is the life Jesus said, I've come that you might have life abundantly. This is you can't enjoy that. If you've 5 (47m 1s): Got an addiction in your life, you just 6 (47m 3s): Can't. You got to get all of the addictions out of your life and trust Jesus in every arena of your life. Addiction is just an escape, right? 5 (47m 14s): It's a way to get some, some help, kind of a counterfeit help and escape. When we're in trouble. God doesn't want that for you. He wants you to be free in Jesus name. And he just want you to be free. He makes the way to freedom possible because he's good. And he's faithful. Somebody told me this morning, I've turned that 12 step program into a two-step program. She said, I decided to quit drinking. And then I quit drinking. 6 (47m 46s): I said, what a great story? You know, we, we run to the wrong stuff. This is the wine capital of like, I mean, there's wine everywhere, right? So we have this temptation to run to all this alcohol and that 5 (47m 58s): Sort of thing. And listen, I'll say wine 6 (48m 0s): In the scripture tends to be spoken of in a positive light. It's a blessing, but drunk. 5 (48m 5s): And this has never spoken of in a POS in a positive light. It's Ephesians five says don't be drunk with wine. They will ruin your life instead. Be filled with the Holy spirit. So if you're drinking to excess, getting yourself drunk, you just need to stop. If you're running into pornography, trying to find fulfillment there by God's grace, she just need to stop. If you're running to drugs, trying to find something to numb your life, God, God, hasn't called us to live a life that we're trying to numb. 6 (48m 39s): He's trained. He's called us to live a life that 5 (48m 41s): We're trying to enjoy by his grace. We can do that. So run from all of those things that are deceptive and destroying your life. Drugs 6 (48m 50s): Bugs that alter our mind or alcohol that alters our minds is not for God's people. So there are some parameters 5 (48m 58s): For the stuff that God has created in 6 (49m 1s): World. Paul told Timothy, if you explain these things to the brothers and sisters, Timothy, you will be a worthy servant of Christ. Jesus. So Timothy's responsibility was to explain this truth to his people. He would be a worthy servant of Christ. Jesus, who, if he did this, who one, who would be one who is nourished by the message of faith and the good teachings you have followed. So pastors and Bible teachers actually do. 5 (49m 31s): I don't have a choice, but to teach the whole counsel of 6 (49m 35s): God's word, it would be easier to talk about rainbows and butterflies, but that's not what you want to hear. And that's not what I want to talk about. I don't think you want to talk about rainbows and butterflies. I think we need to hear the word of God, that truth and allow that truth to be, to challenge our lives so that we properly align ourselves with him so that we can abide in him and have him abide in us. James three one says there's actually a stricter judgment for pastors and teachers for teachers of the word of God. We're actually going to stand before the Lord and give them 5 (50m 10s): Account for what we taught. I don't want to be in trouble. 6 (50m 16s): I don't want to be in trouble with God and I don't want to be in trouble with you. So I'm just going to teach God's word to the best of my ability, 5 (50m 23s): Where we need to get challenged and move forward. Amen. Verse 4 (50m 28s): Seven says do not waste time. Arguing over godless ideas and old wives tales. Instead, train yourself have to be godly. Physical training is good, but training for godliness is much better promising benefits in this life and in the life to come. So what does godliness look like? Number one, God, Salinas is abiding in God, John 15. Jean says that if we abide in him and he abides in us that we will, we will produce spiritual fruit. Spiritual fruit is eternal. It doesn't have a shelf life. It's always credited to our account. So spiritual fruit is anything that, that impacts the kingdom of God for eternity. 4 (51m 10s): So when people get saved, when we're do a good deed for someone, when we pray for someone, when we love the unlovely, all of those things. When we're allowing the spirit of God and the word of God to come out of us and to bless those around us, we can, you can't actually accomplish anything of spiritual value. Apart from that abiding relationship with Christ, we can do a lot of busy stuff. We can volunteer for Sunday school for 10 hours a week. We can serve in all kinds of small groups. We can greet at the front door. We can write large checks to the church, but none of that stuff actually matters if we're not biting in Christ, right? 4 (51m 52s): Sometimes people write a big check to the church and that substitute that's kind of a substitute for their abiding and their service to Christ. But God has called us to serve him and love him wholeheartedly with all of our time, talent and treasure so that we honor him. And the way that we live our lives abiding in Christ gives us the grace to do all the things that he's called us to do. I was talking with this young couple and we're doing some counseling with them. They're about ready to get married. And, and they used to come to church here, but now they live in Nashville. And so I was doing stuff over zoom and doing some counseling and it got to, you know, we started talking about finances and I went on this rampage about tithing. 4 (52m 38s): I said, Hey, I'm going to talk to you was about tithing because it's really just gonna be foundational to your walk with Jesus. And so I did this whole teaching on tithing and I said, what do you guys think? And they said, Oh yeah, we already give 20%. It was like a total waste of my time and to talk to them about diving. But they're there something about, there's something about trusting God. And we're going to look at that in the next portion, but there's something about trusting God and believing him that comes out of that abiding relationship with him. What does godliness look like abiding with God, number one, number two. What has godliness like obedience to God abiding and obedience? 4 (53m 23s): Obedience is defined the general concept 6 (53m 28s): Of obedience, both in the old and the new Testament relates to hearing or hearkening to a higher authority. So hearing it or hearkening is not just 4 (53m 38s): Hearing, but it's actually hearing and doing it's obeying 6 (53m 42s): One of the Greek terms for obedience in the Bible conveys the idea of positioning oneself, 4 (53m 48s): There, someone by submitting to their authority and, 6 (53m 52s): And another Greek word for obey in the new Testament means to, this'll be surprising to us to trust another word in the new Testament for obey is actually it means to trust. We will never fully obey God. If we don't fully try. 4 (54m 10s): I asked him with our lives, our time talent and our treasure 6 (54m 15s): Measure, according to Holman's illustrated Bible dictionary, a succinct definition of biblical obedience is to hear God's word and act accordingly, to hear and act, to hear and respond, to listen and obey IRD men's Bible dictionary States, shew hearing, or obedience involves the physical hearing that inspires the hearer and a belief or trust that in turn motivates the hearer to act in accordance with the speaker's desire. Thus biblical obedience to God means to hear trust, submit, and surrender 4 (54m 53s): To God and his word. So 6 (54m 56s): Part of godliness has everything to do with obedience. Eight reasons why OBD 4 (55m 2s): Hands to God is important. Let's take a look at these really quick eight reasons. I don't know if they're up on the screen or not, but let's just go for it. 6 (55m 8s): Jesus calls us to obey is number one. What a great reason to obey simply because Jesus has called us to obey. I was talking to pastor Dave earlier. We were talking about baptism and he was having a conversation with the person where the guy about baptism. And he asked the guy, why should you get baptized? And he kept trying to come up with all these theological reasons why you should get baptized. And Dave said, Hey, why can't the answer be? Because Jesus told us to be baptized. I mean, if Jesus asks us to do something, we don't need to jump through all kinds of theological hoops to make our point. We just say, yeah, Jesus told me 4 (55m 42s): To do it. God told me to do it. So I'm going to do it. 6 (55m 44s): Jesus calls us to obey Jesus. John 14, 15 says, if you love 4 (55m 48s): Me, obey my commandments. 6 (55m 51s): Number one, Jesus calls us to obey. Number two. Obedience is an act of worship. Romans 12 tells us to give our whole lives. All of our bodies, everything is an act of worship to the Lord. Obedience is an act of worship, more so than singing and lifting up our hands along the same lines as worshiping. And when we come, come together gathered because what we do when we obey God is we declare that he is God and that he is worthy of our adoration. He is worthy our obedience. And so when we walk out obedience before the game of games were declaring worship before him and say, because you are God and I am not because you are the King of Kings and the Lord of Lords, I will be obedient to you. 6 (56m 37s): OBT obedience is an act of worship. Number three, God rewards obedience in Genesis 22. God told Abraham, listen, your descendants in the whole world will be blessed because of your obedience. To me, 5 (56m 54s): Obedience is rewarded by God. You'll see it in your life. As you decide, 6 (57m 0s): I'm going to be a person of obedience. Every time the Lord asks me to do something, I'm just going to do it and watch the blessings that the rewards that come your way as a follower of the Lord, Jesus Christ it's and it's so much, so much fun. It's more fun than just kind of wrestling with God all the time about everything that he asked you to do. If you just say yes, Lord, not, not Peter, no Lord, no Lord doesn't work. As, as a kingdom follower of the Lord. Jesus Christ. Yes, Lord works every time. Number four obedience to God proves our love. All you have to do is read first and second, John, and you see that there's a direct correlation, a connection between obedience and the love that we say. We have the book of first and second, John clearly explains that obedience to God demonstrates love for God, loving God implies following his command. 6 (57m 48s): So we can't say we love God. If we don't walk obediently in his presence. Number five obedience to God demonstrate 5 (57m 55s): Space. Interesting. Huh? When we open 6 (57m 59s): Bega, we show our trust and faith in 5 (58m 2s): God. It's an, it's a demonstration 6 (58m 6s): Of our faith. We're saying, Lord, I believe you. And so if you're asking me to do this, 5 (58m 11s): I'm going to trust you. I believe it. Lord. 6 (58m 13s): I'm going to, I'm going to demonstrate my faith by saying yes to you. And first John, two, three through six, it says we can be sure that we know him. If we obey his commandments, if someone claims, I know God, but doesn't obey. God's commandments. That person is a liar and is not living in the truth. 5 (58m 33s): But those who obey 6 (58m 35s): God's word surely show how completely they love him. That is how we know we are living in him. Those who say they live in God should live their lives. As Jesus did obedience to God demonstrates faith. Number five, number six, obedience is better than sacrifice in the old system. The old covenant old Testament. If somebody said that they would offer a sin, offering an animal sacrifice, but that's not what God was after. That was God's grace extended in that time so that people might be forgiven. 5 (59m 15s): But the scripture 6 (59m 17s): Says obedience is, 5 (59m 19s): Is better than sacrifice. 6 (59m 25s): Obedience is better than the sacrifices 5 (59m 27s): That we offer. New Testament. We, we sin and we say, Lord, forgive me. And then that's a great model. Obviously. That's what God wants us to do. But how about if we just decide we're going to be obedient. Obedience is better than sacrifice. I mean, I don't want it 6 (59m 41s): Offer. I don't want to have to offer. I don't want to have to say forgive me 5 (59m 44s): Lord and said, I just want to walk purely before the King of Kings. Thank God for his mercy 6 (59m 50s): Sanctification means I I'm asking for forgiveness less and less in a sense I'm still sending, but it's not the same old gnarly sins that I used to sin in. Maybe it's sins that are representative of my, my growth in Jesus. We still have to guard against a moral failure. We still have to guard against the pride or the flesh and pride and all of those things. But, but sanctification, meaning that the longer we're walking with Jesus means that we're not doing those same gnarly sins that we used to do, but there's an obedience connected to our 5 (1h 0m 29s): Lives and obedience that honors the Lord and requires us less of us grovelling before the Lord and saying, God, I'm sorry, I've done this a thousand time. There's victory available for us in Jesus. Number seven, disobedience leads to sin and death. The disobedience of Adam brought sin and death into the world. This is the basis of the term original sin, but Christ perfect obedience restores fellowship with God, for everyone who believes in him, Romans five 19 says for as by the one man's disobedience, Adam, the many were made sinners. 5 (1h 1m 12s): So by the one man's obedience Christ, the many will be made righteous in first Corinthians five 22. It says for as Adam, for, as in Adam, all die. So also in Christ shall all be made alive. First Corinthians five 22, number eight through obedience. We experienced the blessing of Holy living. And that's what I'm talking about. There's a blessing connected to Holy living. That is the decision to be obedient. And listen, if you're, if you're jacked up with addiction, you're going to miss out on this blessing. You're going to miss out on his blessing. I don't want you to feel picked on today. I want you to feel like there's hope today. I want you to feel like man, there's hope on the other side of this addiction, whatever it may be. 5 (1h 1m 54s): There's hope maybe you're here today and you're struggling with porn online porn, pretty, pretty pervasive sin in our culture for men and for women. There's a there's art there's software that you can load onto your computer called covenant eyes. That will hold you accountable for what you're watching online. You get an accountability partner and you say, Hey, I want you. And that accountability partner will actually get a report of everything that you read. I looked at online and, and they'll flag things that are inappropriate so that you have one more opportunity to say no to that sin. 5 (1h 2m 43s): So maybe yeah, this online porn or some other kind of sex addiction, maybe it's just an addiction to wine, alcohol drugs. There are paths forward. We have a, an AA program that meets here on Thursday nights for people who are trying to overcome their addiction to drugs. There are Christian based recovery programs that are available in the community for people who want to get free from drugs and alcohol and other types of addiction. So there's steps that can be taken if we will just decide to take it by God's grace and move forward in freedom through obedience, we experienced the blood sings of a Holy life. 5 (1h 3m 26s): What does godliness look like? Number three, discipline disciplined under God, disciplined unto God. Godliness speaks of a disciplined life in word thought and deed, listen, we're all in this journey, carrying our backpacks, moving toward a destination, just to be on the journey requires discipline. You've got to pack your bag and take the stuff that you need to take. You need to put on the armor of God and do what God has called you to do so that you survive the experience and thrive in the experience. It's it's the, the root of the word disciple is discipline. And God has called us to go make disciples of all nations. 5 (1h 4m 8s): He's called us to be disciples and to go make disciples of all nations. And so that means that we must activate discipline in our lives and be disciplined unto God as followers of the Lord, Jesus Christ. And with that activation of discipline in our lives comes victory comes the ability to be obedience comes just joy and speakable and full of glory. Some of us don't even realize what we're missing out on because we keep falling short of the destination. We keep missing what God has for us and we fall short. And so we keep, keep missing out on God's best discipline is what God has for us. If we will move forward in that we will experience godliness like never before. 5 (1h 4m 53s): Let me just wrap up these last few verses and then we'll call, call the worship team back in just a few minutes and we'll stand and worship here. It says, this is a trustworthy saying verse nine and everyone should expect apt it. This is why we work hard and continue to struggle for our hope is in the living God, who is the savior of all people. And particularly of all, believers teach 6 (1h 5m 18s): These things and insist that everyone learned them. Don't let anyone think less of you because you are young. Be an example to all believers in what you say in the way you live in your love, your faith and in your purity. I think we have way too low of expectations for young people. That's why I love it. When we've got young people here on the worship team, people, young people greeting young people involved in leadership because obviously Paul had an expectation of this young leader named Timothy. He said, don't let anyone despise you because you're young. Sometimes we, we think, wow, I'm young. It's my time to mess around. 6 (1h 5m 59s): And then I'll get serious with the Lord later on. Don't waste your time falling into that trap. Sometimes though, we, we, when we get old, we fall into that same trap. We say, ah, I'm too old to be doing anything helpful for the kingdom. I'm just going to play golf or do whatever I do and don't get me wrong. I love golf, but not at the expense of the kingdom work that God has called us to do. There's kingdom work that God has called us to do so, whatever your hobbies are, make sure they're in alignment with God's plan for your life. And if you're young or old, make sure God is on the throne of your life. And if you're middle-aged and you're raising kids, you've got all this stuff going on. Make sure Jesus is at the throne is on the throne of your life. He'll make you a better parent and make you a better husband, make you be a better spouse wife to make you a better person in Jesus' name. 6 (1h 6m 44s): Don't let anyone think less of you because you're young. Be an example to all believers in what you say and the way you live and your love, your faith and your purity. Until I get there, focus on reading the scriptures to the church, encouraging to believers and teaching them do not neglect the spiritual gifts you received through the prophecy, spoken over you. When the elders of the church laid their hands on, you gave you your complete attention to these matters. Throw yourself into your tasks so that everyone will see your progress. Keep a close watch on how you live and on your teaching. Stay true to what is right for the sake of your own salvation, Timothy and the salvation of those who hear you. 6 (1h 7m 24s): What does godliness look like? It looks like a biting obedience and discipline. How's your backpacking trip. How's your journey with that? Let's go ahead and stand up and we're going to invite the worship team forward and we're going to worship some more and just see what the Lord will do as we honor him with our time. Thank you, Lord. Thank you for this time. Be glorified. As we sing, be glorified. As we think about ponder and decide what we're going to do with this information, help us to decide to abide and to be obedient and to be disciplined in you in Jesus name 2 (1h 8m 52s): . 2 (1h 13m 27s): Jesus died for me. I see his wounds, his hands, his feet, him down to the edge by heavy stone. 2 (1h 14m 16s): robes, Y blazing shop yeah, blazing C sharp. 2 (1h 16m 28s): And 1 (1h 17m 56s): Just ask you to help us each one of us be obedient in that next step. Like what are you calling us to God? What are you calling us to to give that's that we're trying, maybe we're trying to escape from, from the life that you count on us to leak out. And I just, we should just convict each one of us. If something there's always something we can do to get closer to you. God, just ask really? If I just ask you for that Jesus name. Amen. Are You The BEST End User For Every Car?

Target Retail aka: consumer selection. A number that is based on the characteristics of the VIN, mileage, equipment, colour, condition, history, keys, service history, etc in the retail market.  Target Trade, aka: adverse selection, or STRIV: Short Term Residual Insurance Value, an underwritten number that dealers can base a trade value on.  Target Auction, aka: conscious selection. This value is what you would anticipate the vehicle bringing in an auction marketplace if the best end user was present.  By adding a data-driven process you can trade cars without  FEAR or uncertainty. You make money when you acquire vehicles, not when you sell them. By acquiring vehicles based on their VIN-specific characteristics, you're able to avoid welding yourself into cars that you can't retail or wholesale your way out of.  5:50 The hum-line or insurance number (target trade) gives the dealer confidence to call the car, then find the best end user. Does your appraisal process include an OBD reader for decoding the truth about each VIN? Know the status of the VIN before you acquire the vehicle to ensure profitability on every trade.   8:00 What process will allow you to mitigate the risk of losing a customer?  8:30 Target Retail based on the VIN-specific characteristics, mileage, equipment, colour, condition, history, keys, service history, etc in the retail market. Are you going to certify the car? That will bump up the relevant retail ask. It's not based on what your neighbour has going on, it's based on what you'd have to pay to replace that vehicle in it's current condition.  10:50 Who is the best end user? Bob shares a story of one of his friends that just took in an S-Class Mercedes at their Toyota dealership. It's competitively priced but the dealer can't sell the car. Problem # 1) He's in Florida and the car has no AC. Problem #2) He's only got one of them. What does this reveal? He is not the best end user. The theory that everybody is the best retail dealer for every car is simply not true. There is typically a better end user.  19:50 Be careful when you're buying. Some cars are colour sensitive, equipment sensitive, history sensitive. You need you to input these data points. It's not sustainable to buy trades without fully understanding the VIN-specific characteristics. The auction reveals a better end user that is willing to overlook certain items and pay the ultimate amount of money for that vehicle. Do you want to pay the ultimate amount of money before presenting the consumer with the condition of their vehicle to rationally understand where your offer is coming from?Like what you hear?
