The case, spearheaded by Texas Attorney General Ken Paxton and supported by 10 other state attorneys general, alleges that these firms have used their substantial ownership stakes in major coal producers to suppress competition and artificially raise energy prices. The states listed as plaintiffs are” Texas Alabama Arkansas Indiana Iowa Kansas Missouri Montana Nebraska West Virginia Wyoming According to the 108-page complaint, BlackRock, Vanguard, and State Street collectively hold controlling stakes in multiple coal companies, including Peabody Energy and Arch Resources, which account for significant portions of U.S. coal production. The suit alleges that these firms formed an “output-reduction syndicate,” leveraging their shareholder influence to force coal companies to cut production, ostensibly in alignment with environmental goals like the Net Zero Asset Managers Initiative. The complaint details how these firms' actions have allegedly suppressed coal supply despite rising demand for electricity. The result? Skyrocketing coal prices and increased costs for consumers at a time when many are already grappling with inflation.

Environmental groups that work to protect the Black Mesa region in northeast Arizona say that Peabody Energy has not done a sufficient job of reclaiming the now-defunct Kayenta coal mine, and shouldn't be refunded millions of dollars in bond money. Recently, the coal company Peabody Energy applied for the release of $17.3 million, part of a larger bond held by the Office of Surface Mining, or the OSM, for parts of the Kayenta Mine that have undergone some phases of reclamation. The office is under the Department of the Interior, and is tasked with ensuring coal mines adequately restore land damaged during strip mining. The bonds were posted with the OSM by Peabody to be returned only after the mine lands had been reclaimed to certain standards. In late August, the OSM held a public meeting on the bond release at the Navajo chapter house in Forest Lake where some community members also raised concerns about the long-term impact of mining on local water resources.

Worst investment everIn 2014/15, high debt and low energy prices knocked the entire coal industry down. Regulators were circling, trying to limit the coal generation capacity in the United States. But still, a third of the US energy grid was generated by coal, so this was still a viable resource that people were using. The stocks in the energy industry were down by almost half. Joseph was fully aware of what was happening in the industry. He decided to do a bottom-up analysis of the stocks. He found Peabody Energy, the world's largest private-sector coal producer at the time. The company had a solid market share and relatively good fundamentals relative to many other stocks in that sector. He started buying Peabody Energy stocks in 2015. At the time, the stock was already 50% lower from its peak just a couple of years ago. The stock kept falling, and he kept buying. Like many investors, Joseph fell into the gamblers' trap. Eventually, he was just praying to get even. Peabody Energy ended up filing for bankruptcy in 2016, and in the process, Joseph lost about $30,000. This loss embarrassed him because he had already worked in the industry for about four years and had passed all three levels of the CFA in 2011. He was a charterholder and had worked with venture capital and private wealth management. Still, Joseph just ignored the basics of investing. He thought he had a strong investment case in that coal was still something the US would need to generate electricity. The world was not about to get rid of it overnight. A lot of these stocks seemed to be trading at a discount. Joseph picked the one stock he thought had the financial size and scope to survive, supposedly, but it didn't survive. Lessons learnedWhen buying a specific industry is down, always consider the debt-to-equity ratios. This will help you know if the company can survive this period of market weakness. Just because you think a company or even an entire industry is indispensable doesn't mean that that specific company can't file for bankruptcy or that it can't wipe out its shareholders. Don't think any companies or investors are sacrosanct. Set percentage caps on the stocks in your portfolio. Bad things...

Business Day TV — Drikus Combrink from Capicraft chose Peabody Energy as his stock pick of the day and Graeme Körner from Körner Perspective chose Discovery Combrink said: "I'm looking at stuff that's more cyclical that's hated, there is very little out there that's hated as much as coal. There is a company in North America called Peabody, BTU on the New York Stock Exchange. It was a fairly large company, I think it's down to about two billion dollar market cap, that restructured tremendously over the last few years with the weak coal prices. More than half of their production is now coking coal, coking coal can't go away, you can't produce steel without coking coal and the ebitda will be about half the market cap in 2020" Körner said: "One of the winners today was Discovery. it was up today but it's been hit really hard. I think a combination of NHI and you know SA Inc financial services. We still think it's a great story and the simple reality is that they've gone from circa three million vitality members to twelve million and total vitality is twenty million around the world. We still think it's a really good business. We think they're doing some amazing things, we don't think the bank is going to contribute on the short term but I think it's one of those businesses that you'll look back through five or 10 years from now and say you know I really should have bought some at a hundred and fifteen bucks. We drink the kool-aid, we buy the story and I think that as they add services to it becomes a formal powerful cross selling machine."

The world was first introduced to the term “cigar butt” shares in what Warren Buffett regards as the best investment book ever written. Published in 1949, Benjamin Graham’s masterpiece is called The Intelligent Investor. And Buffett reckons it provided the skeleton around which all his other investment knowledge was built. Graham, who changed his surname from Grossbaum in recognition of those anti-Semitic times, likens some shares to a mostly smoked cigar. They are shares in companies whose circumstances have changed significantly for the worse so have been shunned by most investors. But often this neglect can push the unloved orphan’s share price below what is realistic, providing an opportunity for the smart analyst to see value where others don’t. Hence the analogy with a cigar butt that still has a couple of good puffs left. Peabody Energy, the world’s largest private sector coal miner, was one of many coal companies that hit the wall after the mineral’s price plunge. Shareholders in Peabody were wiped out, but thanks to $800m in financing from banks led by Citigroup, the company’s coal mines continued producing running. Last April, a year after opting for Chapter 11 bankruptcy protection, a rehabilitated Peabody re-emerged onto the New York Stock Exchange. While off the market it raised fresh capital at $25 a share. Those who jumped into the stock at that level when it relisted a year ago have enjoyed a 64% paper profit. And judging by the Orbis stock picker, that’s only the start. While its track record and coal’s poor long-term prospects will ensure many will keep seeing Peabody as a cigar butt, shareholders may well be smoking away luxuriously for many years to come.

Mon 5th March 2018BULGA to BYLONG- Locking the Gates This is an audio voyage up the Hunter Valley where brave communities are holding out against climate changing coal expansions. We meet:     Wannarua Elder- Pat Hansson     Ex Miner- Frank Turnbull     Community Leader – John Krey     Local Historian – Stewart Mitchell     Goldman Prize Winner – Wendy Bowman     Veteran Campaigner – Bev Smiles     Bylong Grazier – Peter Grieve AO     Guide at The Drip – Phyllis Setchell     Environmental Justice- Dr James Whelan     Lock the Gates Guides – Steve Phillips and Nic Clyde    The Bulga Community is famous for having taken Rio Tinto to court and won!     The extension of the mine was prohibited by the Supreme Court. Aboriginal sacred places and significant woodlands were protected. But their victory was short lived as the head of Rio made a special trip from London and the NSW Government promptly changed the law. Pat Hansson told us how sickened she was by the thought of the massive Warkworth Mine swallowing up more land. This area has great significance for Wonnarua People. They used to gather for Bora Ring ceremonies witnessed by European settlers but going back for untold generations. I interviewed these brave people last year when they were out protesting the sale of a road which stands between the Rio mine (now Yancoal) and the next big coal lode. Local Historian Stewart Mitchell explains how this is part of the Great North Road built by convicts and part of our National heritage while John Krey and Frank Turnbull dramatise for us why they are not giving up.      This local battle has global importance. As fossil fuels are consigned to history the people have Bulga have stood firm, fought fair and must win. This is their finest hour.      At Camberwell we met a farmer who is recognised internationally. Wendy Bowman tells of their thriving dairy farm which was made impossible by the encroaching coal mine. Despite being offered millions by Yancoal she is the last farm in the path of the mine and determined that her place will be protected. She was recognised by the Goldman Environmental Prize in 2017 https://www.goldmanprize.org/recipient/wendy-bowman/ You can join Wendy in demanding that politicians stop allowing mining to destroy rural communities. http://www.lockthegate.org.au/stop_the_coal_land_rush      The next ghost town was Wollar where only four families are between the mine and its extension. Bev Smiles and two others face seven years jail if tough new anti coal protest laws prevail. She talked to the listening tour as we gazed around at empty houses, a church and school, the services all still intact but most of the residents bought out by Peabody Energy. From Wollar we had a police escort . Maybe they thought we’d stop the bus and riot!      We bushwalked around the Great Dripping wall which will be at risk if the tunnels under the river are approved. You can join the Save the Drip campaign by contacting Phyllis Setchell at prpatita500@gmail.com      The end of the tour was in Bylong Valley. Gag Clauses prevented land owners talking to us about any negotiations with Korean Energy Company Kepco. They have bought up most of the property in this pristine valley but no sod has yet been turned Peter Grieve AO spoke to us of the old days when the Mouse races raised a million dollars for charity. The champion racehorse and sire HEROIC was born here and the land is perfect for high end farming.       Peter Andrew trialled his natural sequence farming here. http://tarwynpark.com/ His ideas to rehydrate the land and restore it have caught on around the continent but we saw men in high vis vests now in command at Tarwyn park and mine machinery parked in his sheds. It could become part of the National Trust instead of another grand canyon of coal.      It’s a climate cliff hanger for all of us. We can measure the amount of carbon dioxide pouring into the atmosphere. We can see the effects in the Antarctic, the Arctic and the Ocean but can we stop a new coal mine in a valley that looks like Switzerland? As poet Judith Wright said about the plans to drill for oil in the Barrier Reef and use the coral for limestone. It is like destroying the Taj Mahal for road rubble. But she was vindicated . It is now protected by UNESCO as world heritage.      Bylong, Wollar,Camberwell and Bulga. They are our call. 05 Mar 2018|Categories: Community Show
