This is Garrison Hardie with your CrossPolitic Daily News Brief for Wednesday, April 12th, 2023. https://nypost.com/2023/04/11/truck-carrying-soil-from-east-palestine-overturns-on-highway/ Truck carrying toxic soil from East Palestine train derailment overturns on highway A truck carrying about 40,000 pounds of toxic soil from East Palestine, Ohio, overturned on Monday, spilling roughly half its contents onto the highway before it even got out of the state. The open-top tractor-trailer was traveling north on SR-165 in Columbiana County when the accident occurred, CBS News reported. Driver Phillip Falck, 74, went off the right side of the road and hit a ditch and a utility pole before overturning, the outlet said. Officers who responded found the truck “on its side,’” per the Ohio State Highway Patrol. The local fire department and the Ohio Environmental Protection Agency also responded. It was decided that the 20,000 pounds of spilled soil was contained and did not threaten any waterways. Falck sustained minor injuries and was cited for operating a vehicle without reasonable control, WFMJ reported. The soil onboard was being transported away from East Palestine, where a Norfolk Southern train derailed on Feb. 3, releasing multiple hazardous substances into the surrounding area. Residents were evacuated, and thousands of fish reportedly died from exposure to the toxins. More than two months later, the process of removing contaminated soil and water from the site remains ongoing. On Monday, state officials said approximately 11.4 million gallons of wastewater had been hauled out of the area, in addition to 19,900 tons of soil. A new health clinic, the East Liverpool City Hospital East Palestine Clinic, also opened in the area on Monday. It will replace the temporary assessment clinic that opened in the wake of the derailment. https://www.foxnews.com/politics/manhattan-da-alvin-bragg-sues-rep-jim-jordan-trump-indictment-subpoena Manhattan DA Alvin Bragg sues Rep. Jim Jordan over Trump indictment subpoenas Manhattan District Attorney Alvin Bragg on Tuesday filed a federal lawsuit against Rep. Jim Jordan, alleging that the Republican lawmaker is trying to wage a campaign of intimidation over his prosecution of former President Donald Trump. In his lawsuit, the Democratic D.A. said he's taking legal action "in response to an unprecedently brazen and unconstitutional attack by members of Congress on an ongoing New York State criminal prosecution and investigation of former President Donald J. Trump." Bragg is asking a judge to invalidate subpoenas that Jordan, the chair of the House Judiciary Committee, has or plans to issue as part of an investigation of Bragg's handling of the Trump case. "The Manhattan D.A.'s Office focuses on the law and the evidence, not political gamesmanship or threats. We look forward to presenting our case in court to enjoin enforcement of the subpoena." The case is assigned to U.S. District Mary Kay Vyskocil, a Trump appointee who previously served as a federal bankruptcy court judge. In recent weeks, the Judiciary Committee issued a subpoena seeking testimony from a former prosecutor, Mark Pomerantz, who previously oversaw the Trump investigation. The committee has also sought documents and testimony about the case from Bragg and his office. Bragg has rejected those requests. Trump was indicted late last month on 34 felony counts of falsifying business records related to hush-money payments made during the 2016 presidential campaign to bury allegations that he had extramarital sexual encounters. The 2024 presidential contender has denied wrongdoing and pleaded not guilty at an arraignment in Manhattan last week. The House Judiciary Committee is scheduled to hold a hearing in Manhattan on Monday on crime in New York City and what it alleges are Bragg's "pro-crime, anti-victim" policies. The D.A.'s office, however, points to statistics showing that violent crime in Manhattan has dropped since Bragg took office in January 2022. https://justthenews.com/government/state-houses/newsom-stockpiles-2-million-abortion-pills-so-californians-can-access-them Newsom stockpiles 2 million abortion pills so Californians can access them after judge's ruling California Democrat Gov. Gavin Newsom is stockpiling as much as 2 million misoprostol pills used to terminate a pregnancy – after a federal judge's ruling last week sought to halt the FDA's approval of another abortifacient, mifepristone. "We will not cave to extremists who are trying to outlaw these critical abortion services," Newsom said Monday in announcing his plan. "Medication abortion remains legal in California." Mifepristone is used in conjunction with misoprostol to terminate a pregnancy through 10 weeks of gestation, according to the FDA. Misoprostol still can effectively terminate a pregnancy when used alone, according to a National Institutes of Health study but the Food and Drug Administration has not approved it for abortions. The Biden administration is appealing the ruling from the Texas-based federal judge that brought mifepristone's status into question. The case is expected to be heard by the Supreme Court. https://bongino.com/15-days-to-slow-the-spread-ends-after-1120-days "15 Days to Slow the Spread" Ends After 1,120 Days https://dailycaller.com/2023/04/11/governor-shut-down-church-pay-fee-kentucky-andrew-beshear/ On Monday, Joe Biden signed a GOP-led resolution that brought the national emergency over the COVID-19 pandemic to an end. And just like that, “15 days to slow the spread” was over….. after 1120 days. As the New York Post reported: Biden signed the legislation behind closed doors on the eve of his trip Tuesday to Northern Ireland and the White House acknowledged the milestone without fanfare in a brief late-afternoon email that read: “On Monday, April 10, 2023, the President signed into law: H.J.Res. 7, which terminates the national emergency related to the COVID-19 pandemic.” The legislation drafted by Rep. Paul Gosar (R-Ariz.) passed the House 229-197 in February, with a handful of Democratic supporters, and then the Senate 68-23 last month with about half of the chamber’s Democrats voting in favor. In January, the White House said that Biden would end both the national emergency and a separate public health emergency on May 11 after more than 1 million Americans died from the respiratory disease that originated in Wuhan, China. If the national emergency and the powers it afforded the government prevented even a single person from contracting COVID, the evidence has yet to be seen. Randall Daniel, Theodore Roberts, and Sally O’Boyle sued in August 2020 after they received notices logging their attendance at Maryville Baptist Church’s Easter Service and informing them they must quarantine or face “further enforcement measures.” The group alleged Democratic Governor Andrew Beshear’s bans on religious gatherings and interstate travel violated their constitutional rights, which the Sixth Circuit affirmed in May 2020, according to court documents. On Monday, the Sixth Circuit upheld a district court ruling awarding the congregants $272,142.50 in attorney’s fees, rejecting the governor’s challenges. “I know a lot of people who are outraged that the TAXPAYER is on the hook for ANDY’S constitutional violation,” said Roberts in a tweet. “I share this outrage, but this outrage must be aimed at Beshear. If the people of Kentucky want to quit being taxed to pay for these court judgments, Kentucky MUST elect a governor who will actually follow the constitution.” Republican Kentucky Rep. Thomas Massie responded to the ruling on Monday, congratulating attorney Chris Wiest and TJ Roberts on the win. The Sixth Circuit previously barred the governor from enforcing a prohibition on in-person services, disputing the lower court’s ruling which upheld the ban. “[The] unexplained breadth of the ban on religious services, together with its haven for numerous secular exceptions, cannot co-exist with a society that places religious freedom in a place of honor in the Bill of Rights: the First Amendment,” the court found in May 2020. “Here in Kentucky, there are so many different ways to worship, and all but one church in this commonwealth are engaged in them,” Beshear said after the initial lawsuit was filed, according to WDRB. “You can do it virtually. You can do it in a drive-in service, and in many states they are not allowing those drive-in services like we are. So this work — this opportunity to worship, which is so important, is still there. We just ask people to choose one of the versions that doesn’t spread the coronavirus, and I think that’s what our faith calls us to do.” Beshear did not immediately respond to a request for comment.
Will The Browns Star Defensive End Be Available Against Falcons? Cleveland Browns star defensive end Myles Garrett was involved in a single-car crash after leaving practice on Monday. Garrett suffered non-life-threatening injuries and was taken to a local hospital, the Browns confirmed to Fox News Digital. The team said it was in the process of gathering more information. The Ohio State Highway Patrol told Fox News Digital that it's currently investigating the single vehicle, rollover, injury crash in Sharon Township. Troopers were sent to the scene near State Road and Ridgewood Road where they found Garrett's gray 2021 Porsche Turbo S off the right side of the road with rollover damage. A female passenger was also in the car and taken with Garrett to the hospital with non-life-threatening injuries as well. Both passengers had seatbelts on at the time of the crash. There was no impairment from drugs or alcohol suspected in the crash, police said. The status of Garrett for next week's game against the Atlanta Falcons is uncertain at this time, but his agent, Nicole Lynn, released a statement saying that he is "alert and responsive." He is also expected to be released from the hospital Monday night, per ESPN. Garrett, 27, is a key piece on the Browns' defensive line as the team captain already has three sacks on the season. He collected two against the Carolina Panthers in Week 1 and another in the loss to the New York Jets in Week 2. In Week 3, Garrett had two combined tackles and one quarterback hit in the win over the Pittsburgh Steelers, 29-17. The three-time Pro Bowler and two-time All-Pro edge rusher is in his sixth season with Cleveland, who took him with the first overall pick of the 2017 NFL Draft. Garrett has 61. 5 career sacks dating back to his seven in 11 games during his rookie campaign. Since then, he's totaled at least 10 sacks in each of the last four seasons. Welcome to this incendiary new episode of Light ‘Em Up! As you read this, we are now being downloaded in 94 countries! This episode is our most ambitious of our entire three season catalogue. We've gone to great lengths to bring you exclusive audio that you won't hear anywhere else but on Light ‘Em Up! Gunned down in a hail of bullets. Some reports say as many as 90 rounds were fired. 46 bullet wounds killed Jayland Walker in the parking lot of the Bridgestone Center for Research & Technology in Akron, Ohio in the early morning hours of June 28, 2022. From multiple FOIA (Freedom of Information Act) requests we've uncovered a treasure trove of primary source material exclusively for you! With lights flashing and sirens blaring, 10 police vehicles caravanned down Route 8 southbound chasing Jayland Walker, a 25-year-old black man, much like bloodhounds chased Frankenstein in the dark of the night. Firing upon him in ways that you wouldn't even shoot a rabid animal. For what started as a minor equipment and traffic violation ended in the brutal killing of yet another unarmed black man. While a gun was in fact found in the vehicle, and police maintain that a “shot came from the door of the suspect's vehicle during the pursuit” the fact pattern shows that Jayland was unarmed when he was gunned down. You'll hear exclusive in-car police radio audio transmissions with dispatch from the officers involved in the 10-car chase. You'll be an ear-witness on scene to the body worn camera footage: the raw, intense, crude and nearly unintelligible commands the 8 officers that were super-charged with adrenaline and filled with fear were screaming at the top of their lungs while running – as they pursued Jayland, ordering him to “stop” and “show them his hands” before gunning him down in what seems like an endless barrage of bullets. In the hope that it truly resonates with you, you'll hear multiple times throughout the broadcast the actual gunfire from beginning to end. We put you at the scene as it unfolded. Making national and international news – this case has the entire City of Akron, Ohio on the edge of exploding! The city has witnessed repeated protests. People demanding, “Justice for Jayland”! We place you on the front lines at the street level protest – in front of the Harold K. Stubbs Justice Center, which houses the Akron Police Department. You'll hear the red-hot, heartfelt pain-filled words from a young mother who is filled with anguish over Jayland's killing as she expresses her fears for the future of her young black children in this country. At night you can hear the Ohio State Highway Patrol helicopters hovering overhead as they use their infrared cameras capturing endless video footage of the protestors. Since day one of this incident, we've been gathering information – cataloguing and compiling the facts in order to deliver them to you! We now have this exclusive episode ready for you!Tune in and be empowered as we put you in the eye of the current storm that is brewing! We'd like to thank our friends at Feedspot, as recently we were honored by being ranked #8 in their most recent poll out of the 40 Best Criminal Justice Podcasts. On this week's episode we return to the Buckeye State to speak with Steve Click, Director of the Ohio Office of First Responder Wellness. We discuss how his professional, personal and professional experiences have facilitated his appointment to this unique position. Steve is poised to help all first responders and ultimately, the citizens of Ohio. He also explains how his state is taking a progressive approach in addressing first responder wellness. According to Blue H.E.L.P., more than 940 first responders nationwide have taken their own lives over the last five years, with the majority of those deaths involving law enforcement officers. According to the National Alliance on Mental Illness, more officers die by suicide than in the line of duty, and compared to the general population, law enforcement officers report much higher rates of depression, PTSD, burnout and other anxiety-related mental health conditions. Research also shows that stress from a career in law enforcement causes higher rates of secondary trauma such as heart diseases, divorce, alcoholism and other psychological illnesses.Guest Bio: Steven M. Tim DelVecchio has worked in the business of criminal justice for 50 years. More than half this time was spent as a high ranking officer with the Ohio State Patrol, retiring as Commander of the Cleveland Metro Office in 2000. There was no time for grass to grow under Tim's feet before his security know-how was again put into action, this time at an international level. Tim was hired by the State Department to travel to Kosovo as part of the United Nations' first armed police mission anywhere in the world. Kosovo at the time was deemed "the most dangerous place on Earth," and according to Tim, it was. He stayed on with the State Department after Kosovo and spent the next decade involved in highly sensitive police work around the world. When he finally returned to the States, Ohio Homeland Security tapped his knowledge for the good of schools. Tim began working with school districts on establishing their emergency plans and crisis response. He now provides consulting services to the Ohio Schools Council and runs the OSC's School Safety Program. Tim is a partner in this work at Elyria City School District. "We want to develop a mindset and give people the skills to respond to an emergency," Tim said of his work in school safety. "In a catastrophic event, you won't rise the to the occasion, you'll sink to your lowest level of preparedness. That's why we want to always have people prepared to a degree so they can respond effectively."

Happy holidays, everyone! On this episode, Jodi Salvo talks with Sergeant William Bower from the Ohio State Highway Patrol and Jennifer Demuth from the Tuscarawas County Health Department. The conversation dives into the increase in alcohol consumption during the holiday season and how young people learn habits - either good or bad - from their parents and other adults. As parents, we must be aware of our behaviors and actions around children. Young eyes are always watching and documenting what adults are doing, so be careful what examples you're setting. Also, it's important to be involved with your children regarding alcohol and substance abuse. Did you know that kids whose parents discuss substance abuse with them are 50% less likely to use in the future? If you haven't had conversations with your kids yet, take this holiday season as an opportunity to set them on a positive course. The holidays are a time for celebrating, and if you have teens or young adults gathering with friends during this time, make sure they have a plan. If your child is at a party and things become uncomfortable, have a plan or safe word your child can text you so you can safely pick them up. And be conscious of your reactions in these types of situation; your reaction will set the standard for how future situations are handled by your kids. Will they be afraid you'll get mad, or will they feel confident and trusting to ask you for help? One final note, and this pertains to impaired driving. Sometimes, young drivers are living in the "invincible" stage of life, and preaching about car crashes and fatalities doesn't always register. Something to know is that the average OVI costs $10,000 - and that's not to mention the loss of a license, loss of a job, scholarship, etc. So please enjoy the holidays, and enjoy them safely! Take the opportunity to build stronger relationships with your kids and set examples and standards to shape their futures. Are you scared every time your loved one gets behind the wheel of the car? Are you sure there is something wrong? Are you ready to have “the talk”? Will you be able to do what is needed? Let's face the truth. Some seniors should not be driving any more. But it is so difficult for family to do anything about it. My guest on this podcast, Matt Gurwell, CEO of Keeping Us Safe, LLC, can help you “have the talk”. He can help you to know whether your loved one should still be driving. He even created a comprehensive “Self-Assessment Program for Older Drivers” to objectively evaluate driving performance. Matt knows why this is important. He is retired from a very distinguished and successful 24-year career as an Assistant District Commander with the Ohio State Highway Patrol. He says he started “Keeping Us Safe” because, “It was the result of 20-plus years of holding dying people in my arms at terrible car accidents, and delivering dozens and dozens of death notifications to families. I would much rather work with families to bring a peaceful resolve to this sensitive and uncomfortable issue now, rather than have them deal with it when a State Trooper is knocking on their front door".
