The Pennsylvania Association of Community Bankers are pushing for new laws to better protect seniors from elder financial abuse. Kevin Shivers, President and CEO of PACB, and Christina Carden, VP of Marketing and Communication at Cross State Credit Union Association were guests on The Spark to shed light on this issue. Below is a op-ed from PACB that explains their partnership on this effort and what they would like to see happen in 2025. Letter to Santa to Protect Older Pennsylvanians Dear Santa, Older Pennsylvanians deserve a new law to help protect them from financial exploitation. Elder financial exploitation comes in many forms. Scammers are constantly targeting older adults through a variety of schemes, like romance scams and investment frauds. Tech support scams were the most reported last year by older adults. Criminals pose over the phone as tech or customer service representatives, impersonating technology, banking, or government officials to convince victims that foreign hackers have infiltrated their bank account. They then instruct the victim that to “protect” their money, they should move it to a new account – one secretly controlled by the scammers. Nameless, faceless scammers are constantly finding new ways to steal money from older adults. Sadly, even people known and trusted by an older adult can be the perpetrators of elder financial exploitation. In these situations, a family member, friend, or someone else known to the older adult exerts pressure on financial decisions, asks for sums of money, or convinces the older adult to sign over investments, real estate, or other assets through the use of manipulation, intimidation, or threats. On a positive note, these scams often raise the suspicions of trained bank employees who are effective guards against financial abuse of older adults. Recognizing the warning signs of frauds and scams is a goal that is shared by many, including the Pennsylvania Association of Community Bankers and AARP Pennsylvania. That is why this holiday season, we are urging older Pennsylvanians to be on high alert for scammers, fraudsters, and manipulators who want to steal their money, their financial information, and even their identity. We believe if you can spot a scam, you can stop a scam. But this is where our wish list gets a bit longer. Currently, the state’s Older Adults Protective Services Act (OAPSA) does not mandate reporting of elder financial abuse. We believe this act also needs to be updated to allow banks and credit unions to place a temporary hold on transactions they suspect are fraudulent and report the matter to the local area agency on aging and law enforcement. Providing this “safe harbor” will ensure banks play an even more active role in preventing elder financial abuse, while adding a needed device to the Commonwealth’s toolbox to detect and deter frauds and scams. While we’ll be good and working hard on this effort, we hope you can help make our wish for the Commonwealth to pass a law to better protect older Pennsylvanians from elder financial abuse can come true in the new year. Something old, something new: In 2022, check fraud remains a focus of bank risk professionals, while instant P2P payments are an increasingly popular platform for scammers seeking to take advantage of consumers. With respect to the latter, consumers need to realize that “this stuff behaves like cash,” says Peter Tapling on the latest episode of the ABA Banking Journal Podcast, sponsored by Intrafi Network. Community bankers are slightly more optimistic about future business conditions and the economic outlook than they were at the end of last year but are more concerned about future profitability than at any point since the pandemic began, according to the most recent Community Bank Sentiment Index (CBSI). "States of the Economy" is a monthly look at the economic picture across the country. In this episode CSBS Senior Economist Tom Siems and host Matt Longacre discuss what the latest inflation and jobs numbers, business confidence measures and more are telling us about the current trajectory of the U.S. economy.

Jill Castilla leads Citizens Bank of Edmond as its President and Chief Executive Officer. Jill joined Citizens Bank of Edmond in 2009, transforming the struggling institution into one of the most innovative community banks in the nation. Under her leadership, Citizens Edmond was one of the first in her state to deploy Interactive Teller Machines, and Citizens Edmond recently applied for a provisional patent for the nation’s first unmanned electronic banking facility. Her entrepreneurial and visionary spirit spills over into her community engagement as the founder of “Heard on Hurd,” a Citizens Edmond-sponsored event that draws upwards of 100,000 people into downtown Edmond for a musical festival, local shopping, and food trucks, delivering a $6.2 million economic impact.On the national stage, Jill serves as an appointed Civilian Aid to the Secretary of the Army (CASA) for Oklahoma and on the board of the American Bankers Association, as well as the content advisory committee for Money 20/20. Jill also serves on numerous local boards to include Allied Arts, Community Bankers Association of Oklahoma, and the Edmond Chamber of Commerce. She recently served on the Governor of Oklahoma’s Transition Team, the Edmond Public Schools Foundation Board of Trustees, the UCO Foundation and Oklahoma Bankers Association Board of Directors. The answer: a community bank president named J. Irwin Miller. CSBS, the FDIC, and the Fed have this annual conference every year about community banks. And we get together these brilliant economist, and statisticians, and we even do a poll! A poll of community banks all across the country. And we look at all the data and research, and it’s pretty informative. But we also learned pretty quickly that we weren’t capturing everything that was going on. Community banks are local, just like these local interviews that I’ve slowly learned to appreciate. So we started doing a sort of “Vox Pop” of our own, focused just on community bankers, and we call it “Five Questions for Five Bankers.” Today, I have on an expert from CSBS who works with the state regulators that gather the feedback from bankers across the country, summarizes, and publishes it for the conference. Some of what they say can be seen in data we have, and some of what they say is pretty surprising.

Community Banks fund over half of the small businesses in the US. They are an essential and often overlooked part of the economy. Tina Giorgio is the President and CEO at ICBA Bancard. Jill Castilla, President and CEO of Edmond Citizen’s Bank is one of those rare finds. Charlie Schmalz is optimistic about the policy environment for community banks. As chairman of ABA’s Community Bankers Council and president and CEO of East Wisconsin Savings Bank in Kaukauna, Wis., he outlines provisions in S. 2155 that will help his bank — including Qualified Mortgage designation for portfolio loans and the community bank leverage ratio — and describes it as “the beginning of common-sense banking legislation that needs to be passed.” “As primarily a mortgage lender, [Dodd-Frank] has put a tremendous amount of work and extra scrutiny into what is traditionally a plain-vanilla kind of business,” says Schmalz, who was profiled in the January/February 2019 issue of the ABA Banking Journal. “That’s a tremendous benefit to the country…that small community banks like ours are out there doing quality work.” In this episode, Schmalz highlights the program for the upcoming ABA Conference for Community Bankers, Feb. 10-13 in San Diego, and he talks about the persistence of the mutual banking model, capital issues that mutuals face, community bank technology plays, the economy in eastern Wisconsin — and the best place to get Wisconsin cheese curds.

Yet, while his accolades in business are many, he brims with pride when talking about his family and the philanthropic work he has done to fight kidney disease and different forms of cancer. Ron is a high character human who has faced all kinds of set-backs in his life, yet he maintains a strong sense of self and understanding of his values. Luz Urrutia, the global head of retail at Oportun, has been carrying the same credit card in her wallet for 30 years. Having moved from her native Venezuela to the U.S. to study finance at Georgia State University, Luz was thrilled when she landed her first job in the banking industry – only to have her credit card application rejected by the same bank where she worked! Having little or no credit can make adjusting to life in a new country extremely onerous. In our conversation, Luz points out that anything from getting a job to renting an apartment and hooking up utilities is often impossible without a FICO score. Currently, almost half of the Hispanic community in the U.S. is underserved. Luz decided years ago to help the 25 million individuals who represent the un- and under-banked in her community by offering responsible credit-building and affordable loans. Before moving to California to broaden her mission, Luz co-founded and served as President and Chief Operating Office for El Banco de Nuestra Comunidad in Atlanta. Since then, her career has been characterized by a relentless drive to use technology and creative techniques to “score the unscorable” and serve those overlooked by traditional financial institutions. Oportun, formerly Progreso Financiero, was founded in 2005 with the same goal of empowering underserved Hispanic consumers. Its proprietary technology platform scores applicants, even those who do not have credit, and enables Oportun to provide a highly personal experience with back-office efficiency. Headquartered in Redwood City, CA, the customer experience at Oportun is designed with the Hispanic customer in mind. This experience is disseminated through a network of more than 160 stores in five states, often conveniently co-located with or near Hispanic grocery stores, are open 7 days a week into the evening, and staffed by team members who speak Spanish. In recognition of Oportun’s goals of increasing economic opportunity for its clients, promoting community development, and serving low-income or underserved communities, Oportun was certified by the United States Department of Treasury as a Community Development Financial Institution in November 2009 and re-certified in October 2013. I spoke with Luz at the Center for Financial Services Innovation’s (CFSI) EMERGE conference in Austin, on whose board she has served since 2004 (full disclosure, I am also on the board). Luz has often been recognized for her commitment to improving the lives of underserved financial consumers, including being named as 2009’s Latina Business Woman of the Year and American Banker’s “Community Banker of the Year” in 2006. Perhaps the greatest reward for Luz, however, is the joy she feels pursuing her mission every day.
