'It would have been annihilation' Nick McKenzie on Nine's high stakes defamation battle with Ben Roberts-Smith

Today's edition features an interview with one of Australia's most storied investigative journalists, Nine's Nick McKenzie. It coincides with the publication of McKenzie's book about disgraced SAS soldier Ben Roberts-SmithThe Age and Sydney Morning Herald's Nick McKenzie is one of Australia's most acclaimed investigate journalists. With 14 Walkley Awards and a stint as president of the Melbourne Press Club under his belt, McKenzie's latest battle had the highest possible stakes - with the future of investigative journalism in Australia and indeed his own career on the line. The investigative reporting of McKenzie and colleague Chris Masters into the misconduct of Ben Roberts-Smith and other Australian SAS troops in Afghanistan resulted in the most significant defamation battle in at least two decades.McKenzie's book on the Ben Roberts-Smith saga, Crossing The Line, has now been published. In conversation with Unmade's Tim Burrowes, McKenzie discusses the realities of the investigative process, what it was like battling a formerly lauded Anzac war hero in courtrooms over the last five years and the personal toll it took.“It's a miracle that we won this case because the law is geared to favour applicants, it's geared to favour rich people suing journalists,” McKenzie says.“Knowing that the weight of law and precedent is against you, and knowing how hard it is to prove war crimes in a civil court, it was unbelievably stressful. To contest this case, we had to keep digging through evidence and information, we could never rest.”The fight was also on company lines, with BRS, who was until recently employed as GM of Seven Queensland, being funded in the case by Seven West Media proprietor Kerry Stokes.McKenzie decries the tribalism of Australian media. “That tribalism and competitiveness exists in all companies. The ABC's at war with commercial media, commercial media's at war with itself, everyone is fighting. That's partly a function of there being some unpleasant people, but it's also a commercial reality. We're all fighting for our commercial lives - it's a tough environment out there, there's a limited ad market, there are fierce contest for sporting rights, there is literally commercial war at play.”McKenzie undertook much of his work alongside his long-time ‘mentor' - investigative reporter Chris Masters of the Sydney Morning Herald.“Chris Masters and I endured a very difficult process. We were there for each other through that process,” McKenzie says.“It's not to say there wasn't tension in the relationship; we're two very different journalists with different ways of reporting. But that camaraderie and us applying our two different ways of doing journalism was so effective, so powerful.”“I think journalism is best done as a partnership.”Nine's 60 Minutes report on the court case featured an image of Masters and McKenzie working in the NSW State Library. It was reminiscent of an iconic scene in All The President's Men, the classic movie of investigative journalists Bob Woodward and Carl Bernstein's work on the Watergate scandalAsked about the similarity of the images, it's one of just a couple of occasions in the interview when McKenzie slips away from the question. The other is when he's asked about the possibility of Nine or its streaming service Stan making a docu-drama about the case.Audio production was courtesy of Abe's Audio, the people to talk to about voiceovers, sound design and podcast production.Message us: letters@unmade.media This is a public episode. After winning the Victoria Cross and numerous other medals, Australian SAS veteran Ben Roberts Smith became a national hero. But then allegations started to circulate - of bullying within his unit and, more seriously, of prisoners mistreated and executed in Afghanistan. Chris Masters, one of Australia's best known journalists, had been trusted by the military to write a book about the war in Afghanistan. He then became interested in the story of Ben Roberts Smith. The result would be that Chris, along with a handful of other reporters, was taken to court for defamation in one of Australia's longest and most bitter legal dramas. Investigative journalist Nick McKenzie has called revealing the truth behind Australia's most decorated soldier the toughest assignment of his 21 year journalism career. Ben Roberts-Smith lost his defamation case against three newspapers who reported he had murdered civilians in Afghanistan. McKenzie was the first to report the story - and has now released his new book Crossing the Line. He told Mike Hosking no one - including himself - wanted to believe Roberts-Smith was a war criminal. But McKenzie says while it's weighed heavily upon him - his stress in exposing the story is nothing compared to what the S.A.S soldiers faced in standing up to Roberts-Smith. The Late Night History podcast returns in 2023 with Cmdr. Robert “RJ” Thomas. RJ served 32 years in the US Navy (30 of those years within Naval Special Warfare).  In this episode we discuss RJ's life story. It began growing up hunting on his family's cattle ranch in central California. He had always wanted to become a US Navy frogman, but back in the early 1960s, one had to go to the fleet before arriving at UDT training. Eventually, RJ would pass UDT training and become a frogman. After that, he moved to SEAL Team 2 and deployed to Vietnam. RJ is most known as a Navy Cross recipient of the Vietnam War. At the time, he was the among the best shooters in the Navy. His skills were tested after his helicopter was shot down and he had to defend the crash site with only a M1911 handgun.  RJ tells this story. However, as we do on this show, we also cover the history of Naval Special Warfare through RJ's eyes. We discussed his tours with UDT-22 using the SDVs, his experiences with SEAL Team 2 in Vietnam, and later, his career as an officer, which included an exchange program with the Australian SAS. Beyond his deployments, RJ is also a competitive shooter and was instrumental in the development of the SEAL sniper courses as well the .50 caliber sniper rifles, .300 win mags, and other SEAL Team specific gear. A former New Zealand solider who gave key evidence in a trial centred around a now disgraced former Australian SAS soldier has been deemed an unreliable and dishonest witness, by the trial judge. Ben Roberts-Smith, who won the Victoria Cross for his actions in Afghanistan, had sued Australian newspapers who'd accused him of war crimes, including the murder of prisoners. But the court dismissed the defamation action against the newspaper and journalists, finding the allegations to be "substantially true". The evidence of "person 35" who was in the NZ SAS before serving for Australia - was discredited in the detailed judgement. One of the investigative journalists who revealed Roberts-Smith's war crimes and who was subject to the defamation action, Nick McKenzie from the Melbourne Age, talks to Lisa Owen.

Australian police have arrested a decorated former SAS soldier and will soon charge him with war crimes after he was allegedly caught on camera shooting an Afghan man in a field while deployed in Afghanistan. Former Special Forces soldier Oliver Schulz, 41, was arrested in regional NSW – reportedly in the Goulburn area – on Monday morning and was expected to face court later that day. “It will be alleged he murdered an Afghan man while deployed to Afghanistan with the Australian Defence Force,” the Australian Federal Police said in a joint statement with the Office of the Special Investigator. “The maximum penalty for a War Crime Murder offence is life imprisonment.” Schulz's arrest is the first made by AFP of a former Australian special forces soldier in relation to alleged war crimes in Afghanistan, The Australian reported. He's accused of shooting an Afghan man in a wheat field in the country's southern Uruzgan province. He is expected to be charged imminently over the alleged 2012 killing. The AFP said the arrest was the result of a joint investigation by federal investigators and the OSI, which was set up to probe alleged war crimes following a damning inquiry into the Australian Defence Force. “The OSI and AFP are working together to investigate allegations of criminal offences under Australian law related to breaches of the Laws of Armed Conflict by Australian Defence Force personnel in Afghanistan between 2005 and 2016,” the AFP said. It is understood the investigation into the alleged killing has been underway for more than two years. “The OSI and AFP are working together to investigate allegations of criminal offences under Australian law related to breaches of the Laws of Armed Conflict by Australian Defence Force personnel in Afghanistan between 2005 and 2016,” the AFP said. This show, as always, was a true honour to create.Originally planned to be Pat McNamara of Delta Force, Joe Hotai of Australian SAS and Clint Emerson of Seal Team 6 and CIA, Clint couldn't make it due to a book launch commitment for " The Rugged Life". SO as always with Special Forces types, we pushed on and achieved the mission objective ( Sorry Clint) and it turned out to be an amazing show. We spoke about how Special Forces skills  can carry over to everyday life and self defence. The differences and similarities between the units they have all worked for, and worked alongside. Pat served with the US Green Berets, Served in the Cold War in Berlin and Soviet Germany and then on to 12 yrs in Delta Force and finished the Sergeants Major Academy.

Joe served in the NZ Army, Passed NZSAS Selection and Cycle of training. He then served with 4 RAR Commandos and went on to pass Australian SAS  Selection and served with them for 5 yrs. They speak with such wisdom and humility and I am sure you will be surprised at their openness. From Seal Team 6, Ranger Battalion, FBI HRT, British SAS,  US Airforce JTAC to name a few- they have worked with them all. Watch out for the middle of. the show where I may be the only person who has stumped Pat with a question!! It is hilarious. This show is a rare insight into the mindset of former Special Forces Operators and how we are currently using our knowledge, training and skills to help others, ourselves, and our loved ones.

Today we hear our first Combat Story from a member of our close partners in New Zealand: Joe Hotai. Joe successfully completed not only the New Zealand SAS Selection and Training Course, but then (likely because he enjoys pain) also went on to complete the Australian SAS Selection and Training course. Joe then served in combat with the Australian SAS in direct action operations. [Support us on Patreon and get exclusive content and insights at www.patreon.com/combatstory]Since leaving the service, Joe overcame a childhood fear of putting himself out there and has created two podcasts (the Epich Podcast which explores people making a positive change in the world - and which he has graciously invited me to be on - and the Move Sweat Suffer Podcast which promotes a more healthy way of life). Joe has also co-founded the Mill Gym in Australia and is the founder of Zero Alpha, which puts on ultra endurance events combining some of the experiences from his time in Special Operations, and is also a consultant. His YouTube channel is full of pragmatic workouts that remind me of Pat Mac!Joe has an incredibly humble persona with a great sense of humor. Today, I spoke with Mark Willacy, the journalist behind the ABC report ‘Killing Field' as well as the recently published book ‘Rogue Forces: an explosive insiders' account of Australian SAS war crimes in Afghanistan'. Even though I stated that I will recommence publishing new episodes on the 21st of February 2022, I am releasing this one as a Special Release as I feel that the contemporary relevance of this conversation warrants it. As you will hear, some of the topics Mark and I covered include the intent behind his journalism, his initial exposure to war and conflict in the Middle East, how ‘Killing Field' and ‘Rogue Forces' came about, the people who approached him, impact of the environment on our soldiers, impunity of politicians and much more. On a personal note, this was by far the most difficult interview I have conducted because of the highly volatile and close-to-home subject. All I ask of my audience is that they take heed of my opening remarks before diving into the interview. This is an important topic that we need to talk about and do so respectfully. Lastly, you can see my recently published article that I mention here.   --- Full show notes: My guest today is Mark Willacy. Mark has been a journalist for more than 25 years and has reported for the Australian Broadcasting Corporation, Australia's national broadcaster, from more than 30 countries. Mark is a seven-time Walkley Award winner and in 2020 he was awarded Australia's highest honour in journalism, the Gold Walkley, for exposing alleged Australian SAS war crimes in Afghanistan. His winning Four Corners report ‘Killing Field' made headlines around the world and sparked a federal-police war crimes investigation. Mark's investigations provided evidence for 12 cases named in the Brereton Report, the independent Australian Defence Force inquiry into war crimes in Afghanistan between 2005 and 2016. Earlier in his career, as the ABC's Middle East correspondent for four years, Mark also reported on the ground from the Israeli-Palestinian conflict and the 2003 war in Iraq. He was also the Japan correspondent in 2011 when the country was hit by its most powerful earthquake in more than a thousand years. Mark has twice been named Queensland Journalist of the Year and in 2019 he won a Logie Award for his Four Corners' world exclusive on the Thai cave rescue. Mark has authored several books, including ‘The View From the Valley Of Hell' a book about his time in the Middle East in the early 2000s, ‘Fukushima', which is an account of the 2011 earthquake and the twin catastrophes of the subsequent tsunami and nuclear meltdown. And more recently, he published the book ‘Rogue Forces: an explosive insiders' account of Australian SAS war crimes in Afghanistan'. He joins me today to discuss this last book, how it came about and its impacts. Some of the topics we covered: Marks entry into investigative journalism His time in the Middle East in the early 2000s Motivation behind extreme violence in the Middle East Lessons learnt about human nature First encounters with the Australian SAS in Iraq How ‘Killing Field' and ‘Rogue Forces' came about Why Mark released the book when he did The sources of information for Mark's book Impact of the environment on our soldiers Impunity of politicians Current state of the media Narratives surrounding Mark's book Mark's response to Heston Russell's recent public complaint The way forward Lastly, you can see my recently published article that I mention here.

Cricket was a source of comfort and fun for the Australian soldiers in the midst of the horrors of war, helped build bridges with locals in Afghanistan, Iraq and East Timor and even helped when it came to tactics and diplomacy. Harry was extremely candid in his interview and, as you will soon realise, he's a top bloke and a highly intelligent deep thinker who is now a psychologist. No topic was off limits for Harry, including the current very serious allegations of war crimes involving the SAS. In this first section of our interview, Harry talks about playing cricket under enemy fire, the role cricket had in relations with local people in a warzone, how he feels about comparisons between war and sport, the incredible effort it took to qualify for the SAS and much more. The 2020 winner of the Gold Walkley Award, the highest prize in Australian journalism, was ABC’s Mark Willacy and the ABC Investigations team, Four Corners, for the shocking program “Killing Field” revealing alleged war crimes committed by Australian SAS soldiers. Working tirelessly to find sources within the secretive ranks of the Special Air Service Regiment, the SAS, and spending weeks verifying allegations with family members of alleged murder victims on the ground in war zones, Willacy produced gut-wrenching reports too powerful for the public and the defence hierarchy to ignore. Willacy was interviewed by Chris Masters, Gold Walkley award-winning journalist and author, and the first Australian journalist to be embedded with special forces in Afghanistan, to discuss the program, the difficulties of conducting investigations into one of the more secretive organisations in the country, and the obfuscation of the Australian Defence Force, at the 2020 Walkley Winners' Dinner in Sydney on February 26.

Tim and Ben have previously drawn extensively on Dave Snowden's material as a means of sense-making in complex environments. And here he is in person (virtually). In particular, Snowden's Cynefin (pronounced ‘kin-ev-in') framework has proven consistently to be an incredibly useful and intuitive sense-making tool for leaders in all contexts.    In the period of heightened COVID-19 risk it has been highly instructional to the management teams that Tim and Ben work with.   In this episode, Dave joins us from the UK and speaks to not only Cynefin, but also complexity.   BYO notebook for the knowledge from this one!   Intelligence Summary (INTSUM) 03:20   Dave and Ben's first meeting at the SAS Regiment back 04:00   Dave provides an overview of his Cynefin framework 04:50   The domains – simple, complicated, complex and chaotic 09:20   Leading in complex environments – parallel probes 11:25   Every intervention into a complex system fundamentally changes it 12:00   ‘Nudges' towards ‘adjacent possibles' – stepping stones towards better results.  An alternative to trying to predict the future 13:45   The key to operating in complexity – know where you are and the rough direction you want to head 14:20   What can you control in a complex system? 17:00   Negative boundaries – teaching through failure, not success 18:20   Commander's Intent – ‘metaphorical examples with counter-factuals' – Dave's Gettysburg example, taken from his time at DARPA 22:25   Are contemporary Western militaries doing ‘mission command' well? 23:25   The Black Lives Matter protests through a Cynefin lens 27:00   Using ‘trios' to validate decision-making in complexity 28:45   Neuroplasticity and its impacts in various stages in life 32:20   Why Dave got thrown out of the Pentagon 34:50   Human-mediated wargames: ‘far more malicious' 36:30   Ben on the benefits of Dave's visit to the Australian SAS in 2009 39:00   Dave's work with Peter Drucker 40:00   COVID-19 as a ‘Black Elephant' – a cross between a Black Swan and the elephant in the room 43:15   The importance of narrative and storytelling 48:10   Using anecdotes to increase resilience 50:20   The importance of experience in training 51:30   COVID-19 – who got it right: the economists or the doctors? 52:30   Dave's prognosis for contemporary political leadership   External Links Dave's company website Cognitive Edge   Music The Externals … Available on Spotify (plus a bit of Ben's guitar work, recorded in the bathroom of one of Saddam's palaces in Tikrit, Iraq!)

Monika Georgieva was the first female to attempt Australian SAS selection …. twice! Monika was also Australia's first female Infantry Officer, having commanded a Rifle Platoon and a Reconnaissance/ Sniper Platoon. And before we start (or continue) to stereotype. Monika is around 5 foot 4 and has been 56kg at her heaviest! She has been called a ‘little girl'- but you'll see that she is far from that! What if we told you that being first wasn't important to her. She just 'pursues her bliss' (Ref: Greg Wallace episode). Monika talks us through her amazing life – from gunfights in Bulgarian nightclubs, through boarding school in Scotland, to her ground-breaking military career and beyond.  In the process, she speaks to her motivational techniques, her (strange!) relationship with pain and how breaking paradigms is far less important to her than the simple act of going – always – a little further.   Intelligence Summary (INTSUM) 03:18     The 98 Gym Podcast with Monika – a must-listen! 03:30     Mon's early childhood in Bulgaria 04:26     UK Army recruiting – how to lose applicants! 06:40     First combat experience.  Age:8.  Location: Bulgarian Nightclub 08:47     Ben speaks on ‘complexiness'.  It's a technical term… 09:40     Boarding school in Scotland 11:50     Tough love from Mon's parents 14:00     To Canberra, where Mon recalls her Mooseheads years… 15:45     Life lessons from working in a pub 17:05     Mon's time at the Royal Military College, Duntroon 18:20     Graduation to Artillery Corps as one of the first female officers – and more recruiting lies! 19:15     Corps transfer to logistics and a posting to Townsville 19:30     ….and straight onto Accelerated Infantry Training and Commando Selection 21:00     Physical preparation for selection 21:31     Mon's bête noire – the 3.2km run! 24:20     The pressure of being the first – Imposter Syndrome and self-doubt 28:45     Tim's single piece of advice for SAS selection 30:15     Ben and Tim struggle with maths.  Again. 32:30     Working with Kev Toonen to prepare for the second SAS selection course attempt 33:50     Extrinsic and intrinsic motivation for the course 34:20     Mon's relationship with pain…and an out of body experience! 36:30     Tara Mohr and the two Hebrew words for fear 39:00     Breaking paradigms and glass ceilings (….is not something Mon cares about) 41:00     On being the first female infantry officer in the Australian Army 45:20     The importance of authenticity as a leader 50:30     Mon on leadership presence – ‘always own the ground you're standing on' 51:42     Amy Cuddy on body language and power poses   Contact Us debrief@unforgiving60.com  www.unforgiving60.com   Music  By: The Externals…. 20 years ago, a team of four Australian SAS guys, attempted to be the third climbing party ever to summit Mawson's Peak, otherwise known as Big Ben - Australia's only active volcano on the sub Antarctic Heard Island- 3,500 south-west of Australia. 20 years later we got the climbing party back together to make this episode. Stu and Matt are still serving SAS officers and Robb Clifton is now in a senior role at Australian Antarctic Division. In 1998-99, the SAS had supported anti-poaching activities in the Southern Ocean. As a result, Austral Fisheries were sympathetic to taking an SAS team south to Heard Island.  The team put ashore at Atlas Cove on the 1st of January 2000 after nearly a month at sea on the 88 metre Fishing Trawler, SOUTHERN CHAMPION. The team worked in the Ship's fish factory through the incredibly challenging Southern Ocean. On the very first night at Heard Island the team realised how difficult this was going to be …. And it only got worse! They got a lot of things terribly wrong. And Mother Nature was never going to be helpful. But sometimes fate does (and will) smile. It's a great story of adventure. Facing challenges and accepting fate. Homicidal desires to summit but the need to calculate the risks. And of course, the indefatigable and enduring nature of mateship.   Intelligence Summary (INTSUM) 3:50   The Team 5:15   About Heard Island 8:30   What is at Heard Island 11:15  The mad idea to climb an active volcano on a sub-Antarctic Island!? 13:00  How do you get there? 14:10  How did the voyage start…. of course, with logistics challenges! 15:45  The voyage south! And even more problems. 42:00  ‘The most vivid moments are the hard bits'. 42:50  Failed summit attempt …. And facing (accepting) death 45:00  It just gets worse. If you’re trying to transition out of a old group, it might be helpful to distance yourself for a little bit from the people in that group. Are your relationships with your old tribe the reason you can’t move on? 3. Understand that civilians that haven’t lived what you have can not understand you and you shouldn’t expect them to. Don't expect your service and what you have done to give you anything more than just a foot in the door 4.
