   Eric J. Segall graduated from Emory University, Phi Beta Kappa 27  and summa cum laude, and from Vanderbilt Law School, where he was the research editor for the Law Review and member of Order of the Coif. He clerked for the Chief Judge Charles Moye Jr. for the Northern District of Georgia, and Albert J. Henderson of the 11th Circuit Court of Appeals. After his clerkships, Segall worked for Gibson, Dunn & Crutcher and the U.S. Department of Justice, before joining the Georgia State faculty in 1991. Segall teaches federal courts and constitutional law I and II. He is the author of the books Originalism as Faith and Supreme Myths: Why the Supreme Court is not a Court and its Justices are not Judges. His articles on constitutional law have appeared in, among others, the Harvard Law Review Forum, the Stanford Law Review On Line, the UCLA Law Review, the George Washington Law Review, the Washington University Law Review, the University of Pennsylvania Journal of Constitutional Law, the Northwestern University Law Review Colloquy, and Constitutional Commentary among many others. Segall's op-eds and essays have appeared in the New York Times, the LA Times, The Atlantic, SLATE, Vox, Salon, and the Daily Beast, among others. He has appeared on CNN, Fox News, MSNBC, and France 24 and all four of Atlanta's local television stations. He has also appeared on numerous local and national radio shows. Washington Post: Many countries ban circuses with wild animals. These lawmakers want the U.S. to follow suit.   Mexico, Peru and several other Latin American countries have banned or restricted the use of animals in traveling circuses in recent years. Performing animals are even rarer in Europe, where many nations prohibit them.   There is no such federal law in the United States. But dozens of local bans, as well as Ringling Bros. and Barnum & Bailey's recent decision to fold its tent, have some lawmakers hoping the American political terrain might now be fertile enough to send all circus elephants, tigers and bears to retirement.   U.S. Reps. Ryan Costello (R-Penn.) and Raul Grijalva (D-Ariz.) appeared on Capitol Hill this week to introduce a bill that would prohibit wild or exotic animal performances in traveling circuses. Flanked by television actors Jorja Fox and Eric Szmanda, the representatives argued that the Traveling Exotic Animal and Public Safety Protection Act — known by the unwieldy acronym TEAPSPA — would end the suffering of creatures that profit-motivated humans force to perform unnatural behaviors and live in cramped conditions.   “I don't think that those practices have any place in the fabric of our society,” said Costello, who added that his constituents are keenly interested in animal welfare issues.   [One problem with shutting down the circus: Where will the animals go?]   The question is whether they and lots of other Americans are interested enough to push for a nationwide ban on circus animals. The bill is only the latest iteration of a proposal that's been introduced in Congress several times before but has never gotten far. Also at the Hill event was former U.S. representative Jim Moran of Virginia, who noted that he was “sorry” it had never passed before but said the idea “did make some inroads.”   There's little question that public sentiment about performing and captive animals, particularly those considered highly intelligent, is changing. The Ringling Bros. announcement in January, which cited a decline in ticket sales, came after local laws and pressure from animal protection groups prompted the show to retire its elephants. Last year, SeaWorld decided to stop breeding orcas, and the National Aquarium in Baltimore is planning to move its dolphins to a sanctuary.   And animal welfare issues, as Costello suggested, have far more bipartisan support than many topics under consideration in Washington.   [Ringling's elephants are retiring. Will their lives be better?]   What's more, backers of the bill say, the Trump administration's zeal for cost-cutting could work in their favor. Circuses with animals are subject to federal inspection under the Animal Welfare Act. Retiring the animals would therefore reduce spending on inspections, making it a “win-win” for the government and for the creatures, said Jan Creamer, president of Animal Defenders International, whose campaigns helped drive the Latin America bans.   “There's an immediate budget cut,” Creamer said. (Henry Romero/Reuters) But there's also an anti-regulatory zeal these days in Washington, and many lawmakers are loathe to dole out sweeping new restrictions to industries — and that includes circuses. One opponent of TEAPSPA is the Cavalry Group, an advocacy group for “animal enterprise,” which last year said the idea “would deprive countless Americans the ability to experience endangered animals up close, such as elephants and tigers.”   The company that runs Ringling Bros., of course, has also lobbied against the bill in the past. Stephen Payne, a spokesman for Feld Entertainment, indicated it would no longer be a priority now that the circus is closing. But, he said, it remains a bad idea premised on inaccurate information about how circus animals are trained and cared for.   “This is clearly driven by animal rights groups, rather than being based in any factual information or talking to people who work with exotic animals,” Payne said. “There are exceptions for film, television, advertising and rodeos. This is clearly driven by these organizations who are targeting circuses.”   Moran and Creamer, for their part, seemed to acknowledge that the idea is not very likely to sail through Congress, though Moran said a lot of “grass-roots activity” would help. In other words: Public pressure — plus a plethora of competing entertainment options — helped bring an end to the 146-year-old Ringling circus, and it would probably take a whole lot of public pressure on lawmakers to lead to a national ban.   Creamer seemed unfazed. Bills her organization has pushed in other countries have gone through “three, four or more evolutions,” she said. Guest, Congressman Jim Moran JAMES P. MORAN Former Congressman from Virginia's 8th district During his time in Congress, Rep. Jim Moran was a leader on the Appropriations Committee, bringing billions in economic investment to Northern Virginia to assist underserved communities – building up the region's transportation infrastructure and creating thousands of jobs, particularly in the defense and intelligence communities. Moran played a major role in funding the Woodrow Wilson Bridge Project, the Metro to Dulles, the widening of Route 1 to Fort Belvoir and the construction of numerous local road, bridge, environmental and public transit projects. The front page of the Washington Post cited the fact that “companies based in Representative James P. Moran's district in Northern Virginia reaped $43 billion in federal contracts – roughly as much as the entire state of Texas.” Moran was an outspoken opponent of the Iraq War from the very beginning and helped lead opposition in committee and on the floor to what he deemed a war of choice whose outcome would not strengthen American security, but rather align Iraq with the Shiite dominated Iran. In 1996, he co-founded the New Democrats – one of the largest caucuses in the House. Through the New Dems, he has supported free and fair trade and has been active on a range of issues promoting a stronger, center-left vision for our nation's economy. Since 2016, Moran has served as the Senior Legislative Advisor at McDermott, Will and Emery. In March 2016, he was appointed Professor of Practice in the School of Public and International Affairs in the College of Architecture and Urban Studies at Virginia Tech.

Daniel Schneider (Instagram: rustedrebar) is a letterpress printer with an undergraduate degree in journalism and a master's in industrial archeology, a field I am dying to talk to him about. His research has centered on the transformation of nineteenth century artisanal skills within the context of industrialization. She lives in Arlington, VA, with her two teenage daughters.   Christian Finnegan  is an American stand-up comedian, writer and actor based in New York City. Finnegan is perhaps best known as one of the original panelists on VH1's Best Week Ever and as Chad, the only white roommate in the “Mad Real World” sketch on Comedy Central's Chappelle's Show. Additional television appearances as himself or performing stand up have included “Conan”, “The Late Late Show with Craig Ferguson”, "Would You Rather...with Graham Norton", “Good Afternoon America”and multipletimes on The Today Show and Countdown with Keith Olbermann, and on History's I Love the 1880s. He hosted TV Land's game show "Game Time". As an actor, Finnegan portrayed the supporting role of "Carl" in the film Eden Court, a ticket agent in "Knight and Day" and several guest roles including a talk show host on "The Good Wife". In October 2006, Finnegan's debut stand up comedy CD titled Two For Flinching was released by Comedy Central Records, with a follow-up national tour of college campuses from January to April 2007. “Au Contraire!” was released by Warner Bros. Records in 2009. His third special "The Fun Part" was filmed at the Wilbur Theatre in Boston on April 4, 2013 and debuted on Netflix on April 15, 2014.

On this first episode in the new run in 2021, please welcome Jim Moran, the master printer and collections officer at the Hamilton Wood Type & Printing Museum in Two Rivers, Wisconsin. Hamilton is a unique institution in all sorts of ways. It preserves the manufacturing history and remaining wood type assets of the historical Hamilton Wood Type Company, the dominant producer of wood type in America from the late 1800s through the 1990s.But it’s a lot more. Hamilton perpetuates the knowledge of the past by being an active printing museum. Volunteers cut wood the old-fashioned way and train apprentices. Hamilton has commissioned the design of new wood faces that can then be produced with vintage equipment, but also in conjunction with P22 Type Foundry releases versions of historic faces from their collection and newly made ones in digital form.The museum has also expanded its collection by acquiring massive collections of hand-carved billboard and poster pieces from the Cincinnati Enquirer. It’s also acquired a lot more wood type than it started with, having the largest collection of wood type in the world.Jim and other staff members, board members, affiliated friends, volunteers, and workshop participants print with historic type on historic presses. Each November for the last decade-plus, hundreds of people gather for the Hamilton Wayzgoose, the traditional name for the annual dinner a printing shop would have to celebrate its apprentices moving up. In 2020, that gatherings was virtual—the Awayzgoose—but it went on.Over the pandemic year of 2020, Hamilton reached out to its community and immediately started up the Hamilton Hangs, informal gatherings via Zoom that started around no topic in particular, and quickly shifted to feature printers and artists from around the world. Thousands of attendees across the more than 50 Hangs so far include old friends of the museum and people who might never be able to get to Two Rivers, but have discovered the joy of letterpress, history, and community online.Jim talks about his background, returning to his printing roots, and making lemonade during a year that might seem fallow of lemons.

Members of Congress are notorious for being tight-lipped about the details of the legislative process -- especially when they’re talking to journalists. In part this is because of the intense polarization of our day. It's also because lawmakers are wary of describing the kind of compromise and flexibility it takes to actually get legislation passed. At the same time, the two-year election cycle in the House of Representatives and the narrow margin of control in both chambers makes for an environment in the Capitol of constant campaigning. Sound depressing? It is for us, too. But luckily there are exceptions to the informational lock-down reporters face: Members of Congress who are on their way out. Retiring lawmakers suddenly become great sources of honest information about how the legislative branch operates. Today we’re introducing a new feature to our podcast and blog: “DecodeDC: Exit Interviews.” In the next few months we’ll be interviewing some of the dozens of lawmakers who have announced their retirement at the end of this year. Our hope is to pull back the curtain on the congressional process, and, perhaps, collect some ideas about what could be done to get Washington back on track. First up, Virginia Congressman Jim Moran, who is retiring with a long list of un-achieved priorities. The 69-year-old lawmaker spent more than two decades passionately advocating for bedrock democratic issues, including stronger environmental protections, and the the closure of the U.S. military prison at Guantanamo Bay, Cuba. But as we begin our interview, the white-haired Virginia Democrat slumps into a leather sofa as if to hide from the world. Moran is burnt-out. In the past four years Moran has introduced six bills regarding Guantanamo Bay and eighteen bills dealing with animal or environmental protection. None of them made it past committee consideration. "It's been extremely frustrating because the presence of Guantanamo Bay serves as a recruitment tool and a rallying cry for those who would do America harm,” Moran says. He worries that the detention center undermines the values of the U.S. justice system. "We are founded on a principle that everyone is innocent until proven guilty. That everyone should have the right to be represented in a legitimate court of law, that they can't be held without charges being filed against them." In fact, Moran will leave Congress with few bills to his name and a dubious sense of accomplishment. Of the 298 bills Moran introduced since 1991, only nine passed into law. Of those, three renamed post offices. The most weighty of his legislative accomplishments is a law requiring that products containing traces of animal fur be labeled correctly. "The Congress is not the institution that it was intended to be by the Founding Fathers, that it is expected to be by the voters of this country. It is a dysfunctional institution right now. It doesn't act on behalf of what are the best interests of the public. It's more inclined to act on what is in the best interests of its contributors." Moran is only one of several dozen lawmakers who’ve announced their retirement at the end of this year. And his outlook for the future members of Congress is none too bright. "I think that they're going to be all the more dependent on the money they can raise," he says. “I think that it's going to be even more messaging from the leadership rather than the following of their own course. I think things are going to get worse before they get better--and I think that's very unfortunate."

This episode highlights the bills that passed the House of Representatives in March, including a bill that allows toxic mountaintop removal waste to be dumped in streams, a bill that skips environmental reviews for new nuclear power plants, a bill that wasn't meant to become law but could screw over every government employee if it did, a bill that prevents the government from managing water rights, multiple bills to chip away at ObamaCare, and more. Bills Presented in This Episode Every one of these bills passed the House of Representatives in March, 2014 and is now awaiting action in the Senate. HR 311: “Farmers Undertake Environmental Land Stewardship Act” FUELS Act Sponsored by Rep. Eric “Rick” Crawford of Arkansas Relaxes the EPA rule that requires farms install spill prevention equipment if they store oil on their properties. This bill became law as part of the Water Resources Reform and Development Act, although with different numbers. The previous law said that a farm would need to install spill prevention equipment if they stored more than 1,320 gallons of oil on their property and would have to have that equipment inspected and certified by an engineer if they stored more than 10,000 gallons of oil. The new law says that the farm must get oil spill prevention equipment if they store more than 6,000 gallons of oil on their property and must have that equipment inspected and certified by an engineer if they have over 20,000 gallons of oil. H.R. 311 would have allowed farms to store up to 42,000 gallons of oil before they would have to have oil spill prevention equipment installed and certified by and engineer. The author of H.R. 311 was Rep. Rick Crawford of Arkansas; he has taken over $278,000 from the crop production and basic processing industry. H.R. 938: United States-Israel Strategic Partnership Act of 2014 Sponsored by Ileana Ros-Lehtinen of Florida Would add Israel to a list of countries that gets approved faster for weapons shipments from the United States. Title II: Takes a $2 million a year grant program for renewable energy research and development and shifts its money towards natural gas. Ileana Ros-Lehtinen's top contributor is the "Pro-Israel" lobby, which has given her over $893,000. The bill passed 410-1. Additional Information: Analysis: Israeli natural gas fields hold big promise for Noble Energy, Reuters, February 10, 2014. HR 1459: Ensuring Public Involvement in the Creation of National Monuments Act Sponsored by Rob Bishop of Utah Changes the rules for creating a National Monument. Requires environmental reviews of proposed National Monuments. The President can only create one National Monument per state per term; any additional National Monument declarations must be created by Congress. Rep. Rob Bishop’s campaign’s top contributing industry for the upcoming election is the oil and gas industry, which has given him $22,000. In total, the oil and gas industry has given Rep. Rob Bishop over $150,000. Another industry that benefits from this bill is real estate, Rep. Rob Bishop's fourth most generous contributing industry, which has given him over $100,000. This bill had the closest vote of the month, passing 222-201. HR 1814: Equitable Access to Health and Care Act (EACH Act) Sponsored by Aaron Schock of Illinois On Monday, June 30, the Supreme Court ruled that corporations can pick and choose what is included in their employee’s health coverage, so long as they say that that coverage is against the owners' religion. This ruling means that H.R. 1814 would have far wider implications than originally intended if it were to become law. HR 1814 let’s people get out of buying health insurance entirely if they say their “sincerely held religious beliefs” say they can’t get medical care. If someone went to the doctor that year voluntarily, the exemption would be nullified. There’s no penalty for lying. After the Supreme Court decision, if H.R. 1814 were to become law, corporations might be able to get out of providing for their employees by claiming that doing so is against their religion. The bill passed overwhelmingly in March, without a recorded vote, but it's future now looks bleak in the Senate. H.R. 2641: Responsibly and Professionally Invigorating Development Act (RAPID Act) Sponsored by Rep. Tom Marino of Pennsylvania Prohibits more than one environmental impact statement and one environmental assessment per project. Allows the company applying for a permit to conduct that environmental review. Lets the Federal government, at the company’s request, accept an environmental analysis that was prepared under State laws; the State laws have to be “substantially equivalent to NEPA” - not entirely, meaning that the Federal government can accept environmental studies that are not as stringent as NEPA. The Federal government can use the environmental analysis of a completely different but similar project in “geographical proximity” that was prepared within the last five years. “Geographical proximity” is not defined. All project reviews must be done at the same time. If other agencies are supposed to be involved in the environmental study process. they will have 30 days to respond to the lead agency or forever hold their peace. The other agencies won’t be allowed to participate or even submit comments if they didn’t respond in those first 30 days. Once a project schedule has been created, the lead agency is not allowed to respond to or include any NEPA document, comment, or new information that was submitted outside the time allotted for environmental analysis in the schedule. Sets time limits for environmental impact statements and public comment periods. If the lead agency doesn’t meet these deadlines, the permit is deemed approved. The permit can not be reversed by any agency or the courts. Bars judicial review of Federal permits, with a few narrow exceptions Representatives Quoted in This Segment (in order of appearance): Rep. Tom Marino of Pennsylvania Rep. Sheila Jackson Lee of Texas HR 2824: Preventing Government Waste and Protecting Coal Mining Jobs in America Sponsored by Bill Johnson of Ohio Forces the States to comply with a rule that allows the waste from mountaintop removal for coal mining operations to be dumped into rivers and streams. The rule was implemented in the last days of the Bush Administration and was recently thrown out by the courts because it didn't comply with the Endangered Species Act. Bill Johnson, the author of this gift to the coal industry, has taken over $200,000 from the mining industry. The bill passed 229-192. Representatives Quoted in This Segment (in order of appearance): Rep. Rush Holt of New Jersey Rep. Jim Moran of Virginia Rep. Bill Johnson of Ohio Rep. Alan Lowenthal of California HR 3189: Water Rights Protection Act Sponsored by Rep. Scott Tipton of Colorado This bill prohibits the Federal government from requiring companies operating on public land to turn over their water rights as a part of their lease renewals. The bill was written to settle a dispute over a Forest Service directive that would have required ski resorts operating on public land to turn over their water rights to the government in order to keep operating on public land. The Forest Service had already retracted that directive at the time this bill passed. The bill however, would prohibit the entire Department of Agriculture and the entire Department of the Interior from requiring the relinquishment of water rights as part of a permit to operate on public land, meaning the bill would effect far more than just ski resorts. The bill passed 238-174. No Republicans voted against it. Grace Napolitano of California HR 3826: Electricity Security and Affordability Act Sponsored by Rep. Ed Whitfield of Kentucky The EPA will be not be allowed to enact any standard on fossil fuel powered electric utilities that regulates emissions of carbon dioxide, methane, nitrous oxide, and a few other gases unless at least 6 utilities have already been meeting the standard for over a year; no results of demonstration projects can be included. Prohibits some specific proposed EPA rules from ever going into effect. Rules enacted by the EPA to set emission standards on fossil fuel utilities can’t go into effect until Congress passes a Federal law to set the enactment date. Ed Whitfield’s second highest contributor over the course of his career has been electric utilities; he’s taken over $614,000 from them. Electric utilities are his top contributor for the upcoming 2014 election; he’s taken over $157,000 and counting for this election alone. Ed Whitfield has also taken almost half a million over the course of his career from the oil and gas industry, over $100,000 of that for this upcoming election. The bill passed 229-183. HR 4015: SGR Repeal and Medicare Provider Payment Modernization Act of 2014 Sponsored by Michael Burgess of Texas This bill repeals the Sustainable Growth Rate (SGR) method of paying doctors who treat Medicare patients. The SGR rate ties the doctors' payments to the growth of the economy, which has short changed the doctors as medical costs have risen and the economy has remained flat. In it’s place, HR 4015 establishes what they call a “merit-based incentive payment system” that would come into effect on January 1, 2018. It creates a complicated system of scoring doctors based on their performance. Section 10, however, waives the tax penalty for not buying health insurance until 2019. This provision will kill the bill in the Senate. The bill passed 238-181. No Republicans voted against it. HR 4118: SIMPLE Fairness Act Sponsored by Rep. Lynn Jenkins of Kansas Delays the tax penalty assessed if you fail to buy health insurance for one year. The Congressional Budget Office determined that the result will be that one million fewer Americans sign up for health insurance over the next few years, with half of those being poor people eligible for Federal subsidies. The government would save a few billion over the next ten years, therefore, by not giving health insurance to poor people. Rep. Lynn Jenkins top five contributing industries include both health professionals and insurance. She’s taken over $300,000 from both. Representatives Quoted in This Segment (in order of appearance): Rep. Lynn Jenkins of Kansas Rep. Jim McDermott of Washington HR 4138: ENFORCE the Law Act of 2014 Sponsored by Rep. Trey Gowdy of South Carolina Allows the House of Representatives, the Senate, or the Congress as a whole to to “bring civil action” against another part of the government if Congress doesn’t think that part of the government is “faithfully executing the law” Allows either part of Congress to sue over the actions of the Executive branch, any department or agency or “any other officer or employee” of the United States for formal or informal policies, practices or procedures. Before Congress can file these civil suits, Congress needs to pass a resolution. After the lawsuit is filed in a district court, the rules are that the lawsuit will be heard by a three-judge court and their decision can only be appealed directly to the Supreme Court. This bill was presented as a solution to the "problem" of an Executive Branch that refuses to enforce the law. This bill, however, is so broadly and carelessly written that it appears to allow Congress to sue any part of the government, individual employees included, if Congress determines they have not "faithfully executed the law." [caption id="attachment_1453" align="aligncenter" width="625"] Stars of the "President Obama Sucks" montage[/caption] The only clear winners if this bill became law are the lawyers who would get to argue these civil cases. The author of the bill, Rep. Trey Gowdy, is a lawyer. Trey Gowdy’s most generous contributing industry are lawyers and law firms, which have given him over $188,000 during his two terms in Congress. The bill passed 233-181, with the support of every, single Republican. It stands no chance in the Senate. Representatives Quoted in This Segment (in order of appearance): Rep. Jim McGovern of Massachusetts Ignored Subpoena Rep. Chaka Fattah of Pennsylvania informed the House of Representatives that he is not going to comply with a subpoena.
