Eric is joined by Wayne Pinkstone (shareholder, Philadelphia) and Robert Rodriguez (shareholder, Sacramento), co-chair of the firm's Workplace Violence Prevention Practice Group, to cover what's to come in 2024—OSHA's new standards on infectious diseases and workplace violence. As a bonus, Robert reviews the latest from the California Division of Occupational Safety and Health (Cal/OSHA).
In this episode, Carmen discusses her work in family therapy and her Socioculturally Attuned Family Therapy. Carmen shared that she entered the field when there were feminist critiques of family therapy and a focus on power in the therapeutic relationship. She explained that she went to Loma Linda University to direct the family therapy doctoral program, and worked with Douglas Huenerardt, Ph.D. doing cotherapy. They invited students to observe, and their goal was to be able to articulate the work they were doing, and later finalized it into a research study. She explained that the model that evolved out of that work was named Socioemotional Relationship Therapy. Later, she moved to Oregon to teach at Lewis and Clark College, and worked with Teresa McDowell, EdD, LMFT, and wrote the textbook, Socioculturally Attuned Family Therapy, with Teresa and Maria Bermudez, Ph.D., LMFT. We discussed how Carmen's background in sociology led her to always be thinking about sociocultural aspects and how they play out in relationships. She explained that Teresa introduced the idea of Third Order Thinking or Third Order Change to her, which goes beyond the Systemic concept of Second Order change, to bring awareness to the therapist and client of how the sociocultural system the relationships are embedded in and influence their experiences. She also discussed how this helps therapists be aware of how they are accountable for possibly unknowingly reinforcing and repeating larger societal patterns. Carmen discussed the Socio-Emotional Relationship Therapy Model and how it is influenced by experiential, structural therapy, and social constructionist theory and technique, while centering sociocultural awareness. She discussed how emotions are the window into the larger context by helping us see the thinking that is happening and how that thinking may be a product of social-cultural influences. She also discusses the role of power in the model, and being aware of how that determines what is important, what is valued and the meaning of things, and seeing how power plays out in the couple or family dynamics. She explained that they operationalize relational equity as the Circle of Care, which consists of four parts: 1) Mutual Vulnerability - openness and willingness to admit mistakes, safe to express one's sensitivities, 2) Mutual Attunement - that each person is aware of the other person and their needs, as often the person with more power is less attuned, 3) Mutual Influence - whose interests are organizing the relationship and whether there is a willingness to be influenced, and 4) Shared Relational Responsibility - where both are taking responsibility for the wellbeing of the relationship. Carmen discusses how when these are balanced, there is a more equitable relationship, and by the therapist's awareness of power, they can support the changes in the relationship to be more equitable and mutually supportive. Carmen Knudson-Martin, Ph.D., LMFT is a professor emerita in the Marriage, Couple, and Family Therapy program at Lewis and Clark College. Her scholarship focuses on how the larger social context influences health and well-being and how therapists can address the inequities that result. Carmen especially loves working with couples and is widely recognized for her work regarding gender, marital equality, and relational health. She is a founder of Socio-Emotional Relationship Therapy, an approach that attends to the ways couple interaction, emotion, and socio-cultural context come together in clinical process. Carmen's teaching and practice are based on her conviction that how therapists conceptualize client concerns is an ethical issue and that clinical practices have consequences that are never neutral. Carmen is an AAMFT approved supervisor and licensed MFT. She served as an associate editor of the Journal of Marital and Family Therapy, vice-president of the Family Process Institute, board member of the American Family Therapy Academy (AFTA), and president of the California Division of the American Association for Marital and Family Therapy (AAMFT-CA). She is currently editor of the AFTA Springer Series in Family Therapy. Prior to coming to Lewis and Clark, she directed family therapy programs at Loma Linda University in Southern California, Montana State University, and Valdosta State University in Georgia.

In this episode of Flanigan's Eco-Logic, Ted speaks with Panama Bartholomy, Founder and Executive Director at the Building Decarbonization Coalition.Panama discusses his youth in Northern California, and from an early age, seeing the importance of the human dimension on forging a healthy and sustainable future. He then describes his academic career which focused on sustainable community development. Panama goes on to share his works for the California Division of the State Architect on a sustainable schools initiative, for the California Conservation Corps, for the California Energy Commission, and as an advisor the Speaker of the California State Assembly. He then moved to Europe and worked for over three years in the Netherlands for the Investor Confidence Project, an Environmental Defense Fund initiative to standardize certification of energy efficiency retrofits to ease financing and lower interest rates.He later moved back to the states to found the Building Decarbonization Coalition, now in its fourth year with a prestigious list of sponsors. The Coalition he leads is a force, now marshalled to enact policies and to foster collaboration between manufacturers, designers, and installers. So far, nearly 100 cities have passed ordinances that ban natural gas use in new construction. He concludes with a discussion of scale, and scaling decarbonization. He talks about "Zonal Decarbonization," taking neighborhoods and sequentially removing the gas. He sees the 2020s as preparation.... and 2030s as the decade of scale.
Michael E. Hebrard, M.D. is a board-certified Physiatrist specializing in physical medicine, pain management, and work injury. Dr. Hebrard has extensive experience in rehabilitation and functional medicine which aims to enhance and restore functional ability and the quality of life to those with physical impairment or disabilities affecting the brain, spinal cord, nerves, bones, joints, ligaments, muscles, and tendons. Dr. Hebrard has procedural experience in large joint and trigger point injections, Electromyography and Nerve Conduction Study (EMG), and comprehensive medical disability evaluations. Given his vast experience, Dr. Hebrard has been deposed regarding various patient cases, and has been requested to provide expert testimony related to injury, functional impairment, and appropriate future medical treatment plans. Joanna Morales is a cancer rights attorney, author, speaker, and CEO of Triage Cancer, a national, nonprofit organization providing free education on practical and legal issues that may impact individuals coping with cancer and their caregivers, through events, materials, and resources.Ms. Morales has spent nearly thirty years working on behalf of individuals with cancer, including five as an Adjunct Professor of Law at Loyola Law School, teaching a seminar in Cancer Rights Law, and eight at the John Wayne Cancer Institute's Psychosocial Care Program and Positive Appearance Center. She has also taught a Community Advocacy Clinic, as an Adjunct Professor of Law at Wayne State University Law School.Ms. Morales co-authored the book, Cancer Rights Law, for the American Bar Association – the first and only book of its kind. In 2020, she wrote a chapter Cancer-Related Legal Issues, for the Oncology Nursing Society's book, Oncology Nurse Navigation: Delivering Patient-Centered Care Across the Continuum. In 2017, she wrote Preventing or Minimizing Financial Toxicity Across the Continuum of Cancer Care, a chapter for the Oncology Nursing Society's book, Cancer Survivorship: Transdisciplinary, Patient-Centered Approaches to the Season of Survival. In 2009, she also contributed to a book entitled, Work and Cancer Survivors. And, her work has appeared in a variety of other publications, such as Psycho-Oncology, Heal, Cure, Coping with Cancer, Women, and Ability Magazine.Ms. Morales has presented nearly one thousand educational seminars on employment, insurance, health care, and advocacy issues throughout the country for individuals diagnosed with cancer, caregivers, health care professionals, advocates, lawyers, employers, and the general public.In addition, she has served on numerous cancer community committees and boards, including as Chair of the Board of Directors for the California Division of the American Cancer Society, ZERO Prostate Cancer's Medical Advisory Board, the National Advisory Board of CancerForward, the Stupid Cancer Survivorship Advisory Council, and the Executive Committee of the American Bar Association's Breast Cancer Task Force.Ms. Morales has received several awards and recognition for her service to the cancer community and her work in the area of legislative advocacy, including the 2009 Susan G. Roberts was born on January 17, 1955 in Fresno, California. He has an Associate Degree in Criminology. In 1977, Roberts for one year was a firefighter with the California Division of Forestry (presently now known as Cal-Fire). Firefighting was not his cup of tea. Roberts later in life worked at the Department of Fish and Wildlife as a Supervising Program Technician III and Custodian of Records. As the Custodian of Records, my job was to provide critical data to agencies like the Alaskan State Troopers, FBI, Texas Rangers, US Marshalls, DEA and other law enforcement agencies. Roberts is now retired from his State government service.

The Terminal Island Freeway is a 3.1-mile freeway extending from Seaside Boulevard on Terminal Island north to Willow Street in the city of Long Beach. The Terminal Island Freeway was constructed by the California Division of Highways at the behest of United States Navy for access to the numerous Naval facilities once present on Terminal Island. The Terminal Island Freeway is carried by California State Route 47 north from Seaside Avenue to Henry Ford Avenue, California State Route 103 north to California State Route 1 at Pacific Coast Highway and under local maintenance north to Willow Street in Long Beach. On today's IGN The Fix: Games, Riot Games, the company behind such games as League of Legends and Valorant, will pay out a total of $100 million - including an $80 million settlement, plus an additional $20 million in fees and expenses - after reaching a global settlement agreement with the California Department of Fair Employment and Housing (DFEH), California Division of Labor Standards Enforcement (DLSE), and several private Plaintiffs to resolve its gender discrimination lawsuit from 2018. As per the agreement, Riot will pay $80 million to all current and former full-time employees and temporary agency contractors in California who identify as women and worked at the company from November 2014 to the present day. The other $20 million will go towards "attorneys' fees and miscellaneous expenses." Remedy Entertainment, the company behind Control and Alan Wake, has signed a global development, license, and distribution agreement with Tencent for a new co-operative multiplayer game that is currently codenamed Vanguard. Announced by Remedy, Vanguard - which should obviously not be confused for Call of Duty: Vanguard - will be a "free-to-play, co-operative PvE shooter that combines Remedy's narrative expertise and action gameplay into an immersive multiplayer experience." On today's IGN The Fix: Games, Riot Games, the company behind such games as League of Legends and Valorant, will pay out a total of $100 million - including an $80 million settlement, plus an additional $20 million in fees and expenses - after reaching a global settlement agreement with the California Department of Fair Employment and Housing (DFEH), California Division of Labor Standards Enforcement (DLSE), and several private Plaintiffs to resolve its gender discrimination lawsuit from 2018. As per the agreement, Riot will pay $80 million to all current and former full-time employees and temporary agency contractors in California who identify as women and worked at the company from November 2014 to the present day. The other $20 million will go towards "attorneys' fees and miscellaneous expenses." Remedy Entertainment, the company behind Control and Alan Wake, has signed a global development, license, and distribution agreement with Tencent for a new co-operative multiplayer game that is currently codenamed Vanguard. Announced by Remedy, Vanguard - which should obviously not be confused for Call of Duty: Vanguard - will be a "free-to-play, co-operative PvE shooter that combines Remedy's narrative expertise and action gameplay into an immersive multiplayer experience." Farmworkers in California work outside even during wildfires that fill the air with toxic smoke. California law requires employers to provide mask and safety guidance during those periods of dangerous air. But, an investigation by KQED and The California Newsroom found that state officials rarely enforce those rules putting roughly 4 million outdoor workers at risk. Despite those failures, Douglas Parker, the former head of California Division of Occupational Health and Safety responsible for enforcing the regulations, was recently appointed by President Joe Biden to lead the nation's worker health and safety efforts. We talk about the investigation's findings and whether California regulators are falling short in protecting workers.

Since 1980, the University of California Master Gardener Program has been extending UC research-based information about home horticulture and pest management to the public. The UC Master Gardener Program is a public service and outreach program under the University of California Division of Agriculture and Natural Resources, administered locally by participating UC Cooperative Extension county offices. The UC Master Gardener Program is an example of an effective partnership between the University of California and passionate volunteers. In exchange for training from the University, UC Master Gardeners offer volunteer services and outreach to the general public in more than 1,286 demonstration, community and school gardens across 52 California counties. Last year 6,154 active UC Master Gardener volunteers donated 446,237 hours, and 6.8+ million hours have been donated since the program’s inception. The program impacts communities by enhancing local, sustainable, healthy food systems for families, neighborhoods and communities. On May 20, 2019, esports and Fortnite star Turner Tenney (also known as Tfue), sued his esports team, FaZe Clan Inc., for violations of contract and California law. Among the allegations Mr. Tenney asserts that FaZe (i) stole his profits, (ii) restrained trade in violation of California law, (iii) engaged in other bad acts related to young adults and minors (drinking, injury), and (iv) operated as an unlicensed talent agency. Simply put it is the climate of a very small or restricted area, especially when this differs from the climate of the surrounding area. Microclimates can allow the growing of plants in an area that normally would not grow in the hardiness zone or the season of the area. Microclimates are created and vary due to soil, water, weather, sun, and warmth. Variances in these areas can be caused by many reasons including garden direction, exposure to wind, slopes, and berms, structures and overhangs, the topography of the land, and soil drainage along with many other factors. Locating microclimates on your property. University of California Division of Agriculture and Natural Resources has a great Garden Site Microclimate Evaluation Form that can be downloaded or printed off to help locate microclimates on your homestead. Creating microclimates. To create a microclimate you simply need to mimic what causes microclimates naturally. This can be done by adding things like trees, boulders, ponds, and berms. I discuss some of the ways I have done this on my homestead on the podcast. Utilizing microclimates. Identify what plants you want to grow and what those plants like then find or create the microclimate that best fits that plant. As an example of what gardening this way can do, creating microclimates has enabled me to grow leaf lettuce throughout the summer without it bolting too quickly.
