Penley served as the Deputy Attorney General for Criminal Justice at the Attorney General's Office under Ken Paxton, and is one of the four former employees who joined the lawsuit under the Texas Whistleblowers Act. The prosecution then called Katherine “Missy” Cary, Paxton's former chief of staff, to the stand, a long-time employee of the Office of the Attorney General (OAG) who provided details about Paxton's affair and the inner workings of the agency.  Gregg Cox, a former employee of the Travis County District Attorney's Office, was called to testify, along with Margaret Moore, the former Travis County district attorney herself.  Some big parts of the day included:Lt. Gov. Dan Patrick, who is presiding over the trial, said that time for witness examination should be up by Thursday evening. The Senate would then begin deliberations, and Patrick said there would be no days off until a verdict is reached.In regards to Paxton requesting staff to look into Nate Paul's allegations against federal authorities, Penley testified he thought it was “insane” that the OAG would investigate a U.S. magistrate and federal agents. Penley said Paxton was “under Paul's influence,” “biased against law enforcement to his detriment,” and that he feared he would be fired by Paxton if he could not convince the attorney general to distance himself from the Austin real estate developer. Paxton and Penley reportedly met in McKinney four days before Penley and his colleagues went to the FBI.Penley testified that he had “circumstantial evidence” that the attorney general was being bribed, and Paxton's defense questioned him as to why he did not tell his boss. The defense argued that Penley, like other whistleblowers, didn't do his due diligence in investigating Paul's allegations before reporting Paxton to law enforcement. Cary testified that she overheard a conversation at an Austin restaurant regarding some personal information of the attorney general between a man and a woman she did not recognize. She took a photo of the woman, and spoke privately with Paxton about what she heard. Paxton told her that the woman was his realtor, and did not appear concerned. Cary later found out the woman was Laura Olson, with whom Paxton was having an extramarital affair.Recalling a meeting where Paxton, with his wife Sen. Angela Paxton (R-McKinney) in attendance, confessed to the affair in September of 2018, Cary said her “heart broke” for Sen. Paxton and that she believed the affair had ended at that point. She later testified that she found out the affair had continued in the summer of 2019. Cary said that morale among OAG employees was low, particularly among the security detail and travel aides. She testified that Sen. Paxton would call the office to ask about the attorney general's whereabouts, and that “the staff was sometimes uncomfortable answering those questions.”Cox was asked by the prosecution to describe “potential” crimes Paxton may have committed while in office. The defense brought forward the fact that Cox has applied for a job with the OAG after writing a memo outlining Paxton's potential crimes.

After reviewing Marie’s effort to take time for lunch, Dr. Schwab introduces her to Margaret Moore, MBA (a.k.a. Coach Meg), founder of the first health and wellness coaching school in the United States.  Coach Meg points out that physicians are trained first and foremost to focus on their patients' well-being and often feel guilty when they pause to take care of themselves. "We’re not a healthy society, emotionally or physically. And it’s hard to imagine us getting that [patient care] done without the health care workforce also being well." Coach Meg presents multiple definitions of well-being and delineates the relationship between resilience and positive emotions.  Maintaining an upbeat, open-minded, and flexible perspective may counteract the stress encountered during a busy clinic session. Coach Meg talks to Marie about coaching herself during the course of the work day. Short breaks, deep breaths, and glancing at a pleasant image may be helpful. Meg motivates Marie to take a high-level look at herself and her life, and to start re-examining the path forward and its sustainability. He began his musical career with piano lessons at the age of 4 under the guidance of his aunt, Aurora Flores. Since then, he has been a regular participant at the Albury-Wodonga Eisteddfod and has won the age championships several times throughout his school years. He has also been Junior Champion of the Bernstein Piano Competition held at Shepparton and a finalist at the Bernstein Piano Competition held in Ringwood. James also studied the violin, with the late Margaret Moore, and participated in numerous Border Music Camps and as a member of the Murray Conservatorium Orchestra. James successfully completed the piano AMEB grades and attained the AMusA in 2009. In 2011, James became interested in sacred music and the organ. He first began lessons on the organ under the instruction of Benedict Wilson and subsequently became sub-organist for the Schola Cantorum at St Patrick's Church, Albury. James was actively involved in the Schola's liturgical activities, concerts and the production of three CDs. From 2014, he continued his organ studies under the guidance of Dr Allan Beavis as Organ Scholar of the St Matthew's Music Association. In 2017, James placed second in the Ringwood Classical Organ Competition (Melbourne, VIC). James has participated in masterclasses with renowned organists such as Daniel Moult (London, UK) and Johann Vexo (Choir Organist, Notre Dame de Paris). James has successfully attained the Licentiate Diploma with Honours from the St Cecilia School of Music (SCSM) in organ and the Associate Diploma from the Australian Music Examinations Board (AMEB) in organ and piano. He also holds a Diploma in Church Music (SCSM) and the Archbishops' Award in Church Music (Guild of Church Musicians). James' involvement in church music ministry spans over several parishes of the Albury, NSW, area. James enjoys the demanding but rewarding challenges in contributing to the various liturgies of the Christian church and his ongoing development as a recitalist and liturgical organist. James hopes that the organ will be a treasured instrument for many more generations to come. Apart from his musical endeavors, James completed an IT degree from the University of Wollongong and currently works as an Enterprise Systems Engineer at Fairfax Media. He is also strongly interested and skilled in many web related technologies. In fact, his website (jamesfloresorganist.com) was created by James along with the assistance of his talented wife Leysa Flores (Graphic Designer). Coach Meg said that one of the simplest distinctions that she borrows from her colleague who is the director of our Institute of Coaching is that coaches follow the trail of dreams and therapists follow the trail of tears. Coaches are not in the business of healing. They are not there to fix problems, remedy pathology or really heal from a deep place. Coaches are all about where do I want to go that seems kind of challenging.

In Harvard Medical School's Institute of Lifestyle Medicine's online program to teach physicians the basics of health coaching, the virtual patient is a doctor himself, explains Dr. Edward Phillips, founder and director of the institute. Physicians who have completed this training say the background enhances their relationships with patients and relieves stress, since it helps them accept that they are not directly responsible for patients' poor health choices. Dr. Phillips, assistant professor of physical medicine and rehabilitation at Harvard Medical School where the institute is based, hopes this subject will one day be covered thoroughly in medical schools. And his message to health plans seeking improved health coaching outcomes: engage the physician in the process, because as the person "sitting knee to knee" with the patient, the physician is ideally positioned to help the patient process all health messages.
