Cien millones de mexicanos están llamados el 1 de junio a la primera elección popular del Poder Judicial para designar por primera vez 881 cargos de entre más de 3,400 candidatos que incluyen la Suprema Corte, el nuevo Tribunal de Disciplina Judicial y el Tribunal Electoral.

La guerra comercial se pelea en los tribunales estadounidenses. Un tribunal federal de apelaciones acordó preservar temporalmente muchos de los severos aranceles impuestos por el presidente Donald Trump a China y otros socios comerciales, congelando así el fallo emitido la víspera por el Tribunal de Comercio Internacional de Estados Unidos que bloqueaba el arma más poderosa de la guerra comercial del republicano. Compás de espera, mientras el tribunal de apelaciones analiza los argumentos, incluyendo la solicitud del Gobierno de una prórroga. 24 horas duró apenas el bloqueo que la Corte de Comercio Internacional de Estados Unidos impuso a los draconianos aranceles de Donald Trump dirigidos contra una serie de países, incluida la Unión Europea, China, India y sus vecinos, México y Canadá. Este fallo del miércoles respondía a la demanda de una docena de estados del país que denuncian haber sufrido directamente perjuicios financieros por la inflación que ha generado el aumento de impuestos a bienes importados.“Incluso las grandes potencias están sujetas a reglas”Para Nelson Espinal Báez, abogado del programa de disputas públicas del MIT Harvard, la decisión de la Corte de Comercio Internacional estadounidense, adscrita al Sistema de Controversias de la Organización Mundial del Comercio (OMC), “presenta un hito en la defensa del multilateralismo comercial frente al creciente uso del proteccionismo”.El presidente Trump hace una nueva interpretación de la Ley de Poderes Económicos de Emergencia Internacional que data de 1977 para imponer los gravámenes radicales que han puesto patas arriba al comercio mundial.  Pero la Corte de Comercio Internacional de su país dictaminó que la legislación no le otorgaba autoridad ilimitada al mandatario republicano para promulgar aranceles.“Tras examinar las medidas, la Corte determinó que el argumento de seguridad nacional fue usado de manera desproporcionada y contraria a las normas del comercio internacional”, explicó Espinal Báez a Radio Francia Internacional (RFI).Para el experto en disputas públicas de Harvard, el fallo de la Corte “es una señal clara de que incluso las grandes potencias están sujetas a reglas y el comercio global no puede ser rehén de agendas nacionales ni populistas”.Consecuencias importantesEl abogado adscrito al programa MIT Harvard destaca tres consecuencias importantes derivados de este fallo que bloqueó durante un día los aranceles impuestos por Trump: “Primero, reivindica el valor de las instituciones internacionales en un momento donde el orden basado en reglas está siendo cuestionado por el ascenso de tendencias autárquicas. Segundo, afecta directamente a la estrategia y a la narrativa del presidente Trump de que puede negociar a base de presión, castigo y medidas unilaterales, sin consecuencias diplomáticas ni legales. Y tercero, marca un precedente para otros países que han sufrido medidas similares y que ahora podrían sentirse legitimados en tomar acciones y represalias legales”.La Corte de Comercio Internacional estadounidense tampoco aceptó el argumento del tráfico ilícito en la frontera mexicana que ha utilizado la administración Trump para justificar su amenaza de aranceles por las nubes promulgados unilateralmente por el presidente Trump y sin la aprobación del Congreso.Sobre este punto, Báez precisa que “se puede perfectamente   interactuar con el país vecino, llámese México o el que sea, para contrarrestar ese contrabando o ese trasiego de comercio ilegal. Es decir, manejarlo directamente de manera bilateral con ese país, pero no afectando el comercio global”.La sentencia emitida el miércoles por la Corte de Comercio Internacional de Estados Unidos declaraba ilegales gran parte de los aranceles de Trump, tras entrar en el fondo del asunto. La nueva resolución del tribunal federal de apelaciones no revoca esta sentencia, sino que deja en suspenso su aplicación de forma cautelar mientras se examina el caso. Tal vez no sea una victoria para el presidente de Estados Unidos, pero si una batalla ganada en su guerra comercial.

De todos los reveses judiciales que se ha llevado hasta ahora Donald Trump, el que ha recibido esta madrugada es el mayor. Tres jueces que forman el Tribunal de Comercio de Estados Unidos han anulado los aranceles, por lo que dejan en suspenso la medida con la que Trump ha contraído la economía -y la geopolítica- de todo el mundo justo cuando Trump enfocaba su política ahora contra Harvard y los visados a los extranjeros y cuando acaba de anunciar que va a revocar visados de estudiantes chinos y a revisar lo que cada extranjero publica en su red social.

El Tribunal del Comercio cree que Trump se ha excedido en sus competencias y considera que su guerra arancelaria es inconstitucional. El fallo es recurrible y eso lo que va a hacer la Casa Blanca. Este último varapalo judicial llega la misma noche en la Elon Musk ha confirmado que abandona el Gobierno de Trump cuatro meses después de la toma de posesión. Y noticia que adelanta la SER: Sanidad quiere ampliar los espacios públicos donde no estará permitido fumar. La nueva ley antitabaco incluirá las terrazas de los bares, las marquesinas de autobuses, los vehículos de uso laboral, las salas de fiesta exteriores y todos los espacios de los campus.

El próximo 1° de junio marca una jornada electoral inédita en México: las primeras elecciones por voto popular del Poder Judicial. Los ciudadanos irán a las urnas para elegir cargos de impartición de justicia en posiciones clave como la Suprema Corte de Justicia de la Nación (SCJN) o el Tribunal de Disciplina Judicial. RFI entrevistó a Adrián Ramírez López, presidente de la Liga mexicana de DDHH y vicepresidente de la FIDH, sobre este hecho histórico.  Serán unas elecciones históricas y, además, las más grandes de la historia de México. El 1 de junio, se elegirán por voto popular 881 cargos, resultado de una reforma a la justicia aprobada por el Congreso.  Es una reforma constitucional "necesaria en aras de tener jueces para la democracia y no corruptos", defiende el gobierno. Sectores detractores alegan, sin embargo, que jueces, magistrados y ministros de la Suprema Corte de Justicia caerán presa de la politiquería electoral.En entrevista con Radio Francia Internacional (RFI), Adrián Ramírez López, presidente de la Liga mexicana de DDHH y vicepresidente de la FIDH explica los pasos del mecanismo de selección de candidatos a jueces, magistrados y ministros de la Suprema Corte de Justicia de la Nación (SCJN) que ha legitimado este proceso electoral.RFI: ¿Qué tipo de criterios y filtros se usaron en esta selección? ¿Y cuáles organismos o instituciones se encargaron de ese proceso?    Adrián Ramírez: Contrariamente a lo que fue la reforma de Ernesto Zedillo, que jubiló a todos los ministros de la Suprema Corte de Justicia de la Nación y eligió ministros a su modo, hoy se abrió la posibilidad de un proceso de participación electoral en el que las personas en funciones y candidatos que quisieran aspirar pudieran, primero, participar en un proceso de selección por competencias y, luego, desde las tres instancias del poder público, es decir, el judicial, el Legislativo y el Ejecutivo, se hicieron las entrevistas y verificación de los datos para que los candidatos pudieran registrarse.A pesar de eso, hubo casos en los que personas que podían estar cuestionadas en su probidad pasaron a la siguiente parte de las listas. Pero ha habido un proceso de impugnaciones. Los partidos políticos no tienen cabida y se ha generado un mecanismo de regulado por el INE, el Instituto Nacional Electoral.RFI: Visto así, estamos hablando de un grupo de candidatos selecto por sus calidades, porque serían idóneos después de pasar por este colador. ¿Pero cómo se hizo para que la ciudadanía tenga la posibilidad de saber por quién vota? Porque es un abanico muy grande de candidatos. Son 881.Adrián Ramírez: Esos 881 candidatos no van a ser votados por cada persona, sino que de ellos vamos a elegir algunos como ministros de la Suprema Corte de Justicia. Ese número es reducido. Luego tenemos otro número también reducido de magistrados. Y el número más amplio es el que constituye los cargos de los jueces de las diferentes instancias. Pero de acuerdo a la entidad federativa y a la sección distrital que cada persona tiene en su credencial de elector, el número se reduce significativamente.Se ha tratado de hacer un gran esfuerzo para que se conozcan los currículos de cada candidato. El INE tiene en su página entrevistas y perfiles, los diferentes factores de la vida pública, opinólogos, expertos, medios de comunicación e incluso personas con tintes partidistas, han sacado a la luz las bondades y los defectos de cada uno de los candidatos desde su óptica y, de alguna manera, esto puede formar el criterio.RFI:  En una elección tan suis generis, ¿en qué consiste la campaña de un juez o de un candidato a magistrado o a ministro de la Corte Suprema de Justicia?Adrián Ramírez: Nada está escrito. Hay desde quien exalta su físico o  su territorio diciendo "Ven a Puebla, Puebla tiene comida, tiene turismo", etc.  Incluso hay candidatos que han hecho papeletas y han ido con grupos sociales a repartirlas y ofrecer a la gente que, si votan por ellos, de alguna manera, se beneficiará. Pero también hay quienes hacen propuestas claras de planes de trabajo o se presentan diciendo 'mis fallos se han orientado en esto, se han tratado tales y tales asuntos y los he resuelto de tal o cual manera'. Hay una diversidad de propuestas. La misma forma en que las personas se presentan como candidatos ya les está calificando de antemano.RFI:  Algunos sectores descontentos han llamado a boicotear las primeras elecciones judiciales en México.Adrián Ramírez: Primero, el papel que el Poder Judicial tuvo respecto a estar boicoteando el proceso. Pero son los partidos políticos y los grupos de interés manifiestamente beneficiados de la libre empresa, de los más poderosos, los que están llamando a boicotear la elección haciendo creer que la disminución de la participación será un rechazo a este proceso.Pero este proceso no se legitima por el número de participantes o de abstenciones, sino por los resultados de quienes pasaron por un proceso de selección, luego pasar un proceso de insaculación [selección aleatoria de personas] . Y tercero, van a pasar por un proceso de elección. Es ahí que apenas empieza el proceso para lograr tener jueces para la democracia."Hay deseos de participar", ha dicho la presidenta del país, Claudia Sheinbaum. La mandataria mexicana cuestionó también las ironías del Financial Times, que en un editorial consideró que México iba a un experimento kafkiano. La Presidenta subrayó que en Estados Unidos los ciudadanos eligen jueces y en algunos estados los de las Cortes estatales, aunque no a los integrantes de la Corte Suprema estadounidense.
