After the fights, Zechs collapses from exhaustion; he's not in harm's way, but shows no signs of waking up. Before leaving the site, Galahad displays a sign ensuring that no more sacrifices will happen here, as per the vow of the Champion of Bahamut. The group takes Zechs to his parents' place so he can rest and wake up in a familiar setting with his parents watching him. The night is young, and after a night like they had, revelry is long overdue. With that, they head out to the Faint Mandolin and enjoy the many drinks the establishment provides, some mood enhancers courtesy of Salix, and the melodic sounds of their new ally, Turk. What is now par for the course for the party, the drinks keep coming, a deep conversation is had, and they run into a familiar face at their next venue, The Jaded Kitty Kat. A wide grin and enthusiastic voice greet the party as Little G is in town and doing some celebrating of his own. The group updates Turk on how they know their associate Little G dubs Turk, THE Turk, which gets a welcome response. Towards the end of the evening, Greyleaf and The Turk discuss their origins, fondness for magic, and Greyleaf's family before heading back to Zechs' parents' place for the night. The following day, in Rinde and Setti's home, the party is joined by a familiar face: Iqra of the Cloak of Feathers. She gives news that she is a messenger for JM as they are otherwise held up, but offers to answer any questions they have. There is an exchange as The Turk works out which JM they're referring to as he realizes that the JM he knew was Mr. Bell, and the JM who sent them was the one who last spoke to the party, presenting as a woman. She tells the party to let Zechs know that Argo is safe and recovering in Nereas, that Cenari received word from the Circle of Friends that are looking into a group known as the Light of Elrin in Luxenborough, and that one of their party members has received the boon from the Daughter of the Flame. Iqra informs Arguile that an army of fiends has overtaken Ors Themar for the first time in history and is making their way toward Nakoroa. Additionally, the Masterful Gains Guild in Gamsby is trying to stop a splinter group known as the Umbral Viel that is trying to disrupt the weave throughout the city. At the same time, some operatives were dispatched from the guild to stop them. None have reported back in and have since gone missing. They say that if Mechfall loses its arcane power, it's the same as putting a lit match next to a powder keg. Upon asking about The Constable and any of his Generals, Galahad is told that The Executioner has also been mentioned as pulling her punches. It's not information they saw firsthand, but they were informed of it. Iqra informs Arguile that Enich is not his only alternate and to beware of the one carrying a rifle with him. HERB'S WORK at the clam-packing plant was noticed from the start; he seemed to have a talent for culling, and he was so dexterous that he came to be regarded with the kind of awe and envy that athletes inspire when they perform feats so far beyond the capabilities of the average person that they seem by performing them to be enlarging the aspirations of the species, to be outlining a new bulge along the frontier of human endeavor. Herb enjoyed his growing reputation, and he was surprised to find how content he was to do this work, this work that required so little of him. He hid his true ambitions well, so well that Lorna hardly saw any evidence of them herself. She saw him reading the Reporter every day, but never looking at the help-wanted ads, and she wondered whether he really meant what he said when he told her that he'd been inspired by what Dan Whitley had told him that very first night when they arrived in Babbington: that it's amazing how much you learn about a person from an obituary, amazing how much you didn't know or didn't notice when the person was alive. From that, Herb had gone on to the realization that in a small town the key to selling, or any kind of advancement, was information, information that an outsider had to make a special effort to acquire. Much later, when he and Lorna were retired in Punta Cachazuda, he put the idea this way: “You've heard people say, ‘It's not what you know that counts; it's who you know.' Well, that's not quite right. I found that it's what you know about who you know that counts.” Herb was finding out a great deal about the people of Babbington, but the more he found out, the more he found there was to find out. He began keeping notes, on cards.     His affection for tinkering, for fixing things, improving things, served him as well in Babbington as it had in Quelquepart-sur-Marne; he was always ready to do anyone a favor of the tinkering type, and an unanticipated reward of his doing these little favors was that he obtained, incidentally, close-up glimpses into the lives of many Babbingtonians. His very first repair job in Babbington was his work on the Mikszaths' sagging front door. When he had made the door as good as it once had been, he went on to make it better: he added a secret lock, a spring-loaded bolt, that could be opened by pushing an ordinary-looking nail that projected slightly from the door frame, just to the right of the doorknob. This arrangement allowed Miklos, for whom the effects of his stroke and of arthritis made manipulating a key nearly impossible, to lock and unlock the door on his own.     When Herb demonstrated his ingenious handiwork to the Mikszaths and Lorna, the women, moved by the generosity of thought that underlay Herb's work, hugged him in turn. Mrs. Mikszath blinked away her tears; Lorna let hers run down her cheeks. Miklos locked and unlocked the door again and again. He turned to Herb, and the strength of his emotion was clear on his gaunt face. He clapped one gnarled hand on Herb's shoulder and squeezed it as well as he could. He swallowed hard.     “Dut, dut, dut,” he said.     “Aw, don't say that, Miklos,” said Herb. “It was fun for me. I like doing this sort of thing.”     Mrs. Mikszath could not be prevented from telling the story of Herb's work on her front door. She broadcast the news of Herb's generosity and tinkering talent far and wide, and she described in precise detail just how the ingenious lock worked. A welcome consequence of her advertising was Herb's being called upon to fix and improve things all over town; an unwelcome one was the visit of a burglar, who, after overhearing Mrs. Mikszath's precise description from the other side of the vegetable counter at the Main Street Market one morning, found himself irresistibly tempted to make use of the knowledge. Meanwhile, Vaelena helps Meria infiltrate the office to gather whatever information they can. Cynfrith is a terrible person who is also terribly cocky, so they are able to gather enough information to tear down his network and ruin his life. They also discover plans for a robbery he has planned the following day. He wants to steal vital medicine from people who need it to turn into a party drug. The DOJ Evaluation of Corporate Compliance Programs states: Risk Management Process – What methodology has the company used to identify, analyze, and address the particular risks it faced? Information Gathering and Analysis – What information or metrics has the company collected and used to help detect the type of misconduct in question? How has the information or metrics informed the company’s compliance program? I continue my exploration of the risk management process by focusing today on risk assessments. One cannot really say enough about the role of risk assessment in compliance programs. Each time you hear a regulator talk about compliance programs, it starts along the lines of you cannot manage your FCPA risk without first determining what your company’s risk is; and to determine that compliance risk, the process you should utilize comes through a risk assessment. We previously considered forecasting. The differences between forecasting and risk assessment is that risk assessment attempts to consider things which forecasting either did not reliably predict for, or those things which the forecasting models have raised as potential outcomes which could be troubling, critical themes and issues. As Ben Locwin has explained, “What you’re trying to do then is decide on how you would address these. Risk assessments should create your risk registry. Those items which are most consequential for your organization, whatever it happens to be.” Within the context of an anti-corruption compliance program, you are trying to make adjustments based on the risks of violation of the law, out in the marketplace. For instance, in a compliance forecast, third-party risk should be considered at the top of your ordinal list of risk and you should consider a multitude of factors such as the operating procedures, processes and systems and training. Of course, the execution of that process is a critical component as well. All these things, to some degree, should appear in a risk assessment for the organization. Meaning, at the corporate level, what happens if you change products or sell into a new geographic area which is perceived to be more high-risk? There should be a risk assessment node which has a component that notes these changes so that you can adapt as necessary. Locwin stated, “The risk assessment itself is designed to be able to elevate these, and if something does happen, the next step would be to take appropriate course of action to address any of those risks.” An example which illustrates the differences between forecasting and a risk assessment, yet how the two are complimentary. This winter when I began purchasing hot coffee products from Starbuck, as opposed to the cold drinks I buy during the hotter parts of the year, I discovered that baristas’ no longer put sleeves on coffee cups but now require you to ask for one. The second time I had to ask for a sleeve, I inquired from the barista why I had to do so. She replied that corporate had changed the policy for environmental reasons and that she could only provide a sleeve at the specific request of the customer. When I pointed out that it slowed the line down and was much less efficient in the delivery of Starbuck’s coffee, she replied, “You're absolutely right. I hate it. Would you please email Starbucks and tell them of your dissatisfaction?” I will let Locwin pick it up from here, “what you’ve put your finger on is the crux of the balance of forecasting versus risk assessment. They’re two very different things, but at the same time, as they weave through time, they interchange. For example, Starbucks would potentially say, “We forecast that consumers are going to be more concerned about paper use, sleeves, the economic costs to the world, of extra paper waste and things. We’re going to, in certain locations, let’s say across Texas, we’re going to pilot that we don’t give out sleeves unless they’re asked for.” In their risk assessment, which I can tell you didn’t change from that forecast, what they then should have had was a commensurate line item which said, “If consumers start to have a problem with what’s being done at these locations, our immediate contingency plan is to do the following, to strip it away immediately, full stop, so that every cup gets a sleeve, so that they’re not slowing down lines, consumers say you heard us immediately, and then the organization is back on track.” Their forecast plans something, the risk assessment should have had countermeasures to address, and instead if they didn’t have this in place, they’re going to have to wait until they start to have a Twitter feed that blows up… The risk assessment model should say, “Then we will do the following.” Really they don’t have the capability in a lot of cases to measure the effect of this and immediately course correct. It’s probably going to be a month, two months, four months before they start to get wind of this in a consistent way to say, “Texas was dissatisfied by this change and same in our pilot in Wisconsin. Let’s stop not giving out sleeves… Then eventually that starts to dissipate and they get rid of this whole new silly paradigm.” Locwin’s point was that your risk assessment can help to inform your response to FCPA violation, corporate crisis or even (in my opinion) the misstep of requiring Starbucks customers to ask for sleeves for their coffee purchases. In another article by Locwin, entitled “Quality Risk Assessment and Management Strategies for Biopharmaceutical Companies”, he noted, “knowledge is power”. He went on to add, “Once we have assessed risks and determined a process that includes options to resolve and manage those risks whenever appropriate, then we can decide the level of resources with which to prioritize them. There always will be latent risks: those that we understand are there but that we cannot chase forever. But we need to make sure we’ve classified them correctly. With a good understanding of each of these, we’re in a much better position to speak about the quality of our businesses.” Three Key Takeaways The Evaluation put renewed emphasis on risk assessments. Risk assessments logically follow and are complimentary to forecasting.
