In this episode of Trekking Through Compliance, we consider the episode The Ultimate Computer, which aired on March 8, 1968, and occurred on Star Date 4729.4. The Enterprise is ordered to be part of a test of the new M5 Multitronic System, a computer designed to replace a starship crew. In an unscheduled drill at Alpha Carinae 2, M5 defends the Enterprise against attacks from the starships Excalibur and Lexington. The M5 is declared the victor of the simulated contest, prompting Commodore Bob Wesley to call Kirk "Captain Dunsel." Spock explains the meaning of "dunsel" to McCoy as a term used by midshipmen at the Federation Academy for a part that serves no useful purpose. In a short time, however, M5 takes control of the Enterprise. Daystrom is surprised by the M5's actions but views its behavior as mistakes made by a "child" who is still learning. At the scheduled rendezvous point, the M5 attacks the Excalibur, Lexington, Hood, and Potemkin. Kirk finally shuts off M5 by pointing out that killing humans has violated its programming of saving men from dangerous activities such as space exploration. Since the penalty for murder is death, the M5 concludes that it must die and shuts itself down. Daystrom is committed to a rehabilitation program, but Spock still refuses to respond to McCoy's prodding that human compassion outweighs any advantages computers may have in computational ability. Dr. Kemplin earned her BNSc at Queen's University, MScN and Doctorate in Nursing Practice at Loyola University (New Orleans), and PhD from Rush University (Chicago). Kate was a civilian emergency/trauma nurse specialist for the United States Army before becoming faculty in Nursing and Operational Medicine at the Medical College of Georgia with subsequent appointments in the University of North Carolina and University of Tennessee systems. In early 2020, Kate was appointed Chief Nursing Officer of Columbia/Presbyterian's 220-bed COVID hospital during New York City's worst pandemic surges to date. Dr. Kemplin returns home to Queen's from the University of Windsor Faculty of Nursing where she directed the Kemplin Lacesso Research Lab.SOF suicides are a major area of her research, and her ex-husband Michael Froede sadly took his own life in 2019 while assigned to a secretive Army intelligence unit.Michael Froede suspected he was being followed. For weeks after he returned from a highly classified mission in Vietnam, he would see people watching him in Washington, D.C. They'd be parked outside his house or tailing him while driving. Sometimes while on the road, Froede would pull a U-turn and swing back around on the suspected surveillance team to take their pictures, to let them know that he knew they were there.At 9:30 a.m. on June 23, 2019, Froede drove his Dodge Ram to the third floor of the Carroll Creek parking garage in Frederick, Md. After backing into a parking space, he sat back in his seat, lit up a Camel cigarette and flicked the ash out the window.Froede was a member of a secret Army unit known by the innocuous-sounding cover name Communications Technology Research Activity, or COMTECH, part of an elite group of Army hackers who received tasks from the National Security Agency. Working from the U.S. or deployed abroad, Froede was one of America's secret soldiers, a military spy. What will be the role of AI in compliance going forward? LawTech disrupted the legal profession and reshaped many areas of private practice. I believe there will is a nascent ComTech industry lurking down the road with multiple implications for the compliance function. Obviously, document review is one area where ComTech would be most useful. There are many companies which provide key word searches and these same concepts translate readily into the compliance world through massive database searches for key words, such as an ongoing review through email sweeps. There is yet another set of AI tools that can review contracts to see if any specific types of clauses are non-standard. Soon compliance will be pushed more to the forefront in AML. AI will allow a more robust KYC approach. Another area where compliance is often left behind is in the arena of M&A. AI can help in this area. There are companies which have software that allows thousands of documents to be reviewed in the M&A context. A prime example of where AI can assist the compliance function is with third-parties in supply chain management. There have always been technological innovations which help make compliance disciplines run more efficiently, more smoothly and more profitably. AI is simply another step in this line of technological developments. There is certainly no reason to be afraid of using it. Given the disruption which has impacted the legal profession through LawTech; disruption is not far behind in the compliance world through ComTech.  Three key takeaways: AI has already disrupted the legal profession; the compliance profession will be next. ComTech will be the result. Document review will be the first area of significant AI use in compliance. Beware the limitations and disadvantages of ComTech. In this chapter, we will consider innovation in compliance from a variety of angles including artificial intelligence (AI) and computer technology (ComTech), structural innovations, tools and tactics and innovation in leadership. This will provide you a number of solid ideas you can use to move your compliance program forward. Begin by considering the starting point, which is an innovation strategy. In the most recent DPAs and NPAs issued by the DOJ they all include an element along the following strictures: The Company will conduct periodic reviews and testing of its anti-corruption compliance code, policies, and procedures designed to evaluate and improve their effectiveness in preventing and detecting violations of anti-corruption laws and the Company’s anti-corruption code, policies, and procedures, taking into account relevant developments in the field and evolving international and industry standards.  This means that the DOJ expects innovation in your compliance program to keep up with evolving international and industry standards. This requires you to implement an innovation strategy. Three key takeaways: Both the DOJ and SEC expect innovation in your compliance program. Innovation in compliance should have a strategy going forward. The key is to demonstrate how the compliance innovation will benefit the business going forward. A 64-year-old Ohio man received a 20-month prison sentence for illegally exporting industrial equipment to Iran, and he did it for more than a decade.In November 2006, Behrooz Behroozian became the owner and operator of Comtech International, a computer parts supplier in Dublin, Ohio. The problem was that Comtech didn't have a storefront or any domestic sales, and it rarely exported computer parts. Instead, according to the Department of Justice, the shell company exported gas and oil pipeline parts to Sumar Industrial Equipment in the United Arab Emirates. Sumar acted as a middleman, passing the parts to Iran and covering up the Columbus man's scheme. His actions violated sanctions imposed upon Iran by the U.S. in May 1995.He exported manifolds, valves, and connectors used for industrial pipelines in the gas and oil refinement industry and made from $35,000 to $40,000 per year. Behroozian was born in Iran in 1955. He entered the U.S. in 1976 and became a naturalized U.S. citizen in 1987.
