What the Constitution says about Lidia Thorpe's 'hairs' oath

The Briefing

Senator Lidia Thorpe made international headlines when she shouted at King Charles, rejecting the monarch's sovereignty and accusing him of genocide, in Parliament House this week. The Gurnai Gunditjmara and Djab-Wurrung woman has since claimed she did not really swear allegiance to the late Queen Elizabeth's heirs, as in King Charles, but to the Queens' “hairs”. Senator Thorpe has rejected calls for her to resign after she disavowed – however absurdly – her oath of office. But several real questions remain: What does the Constitution have to say about all this? Can Senator Thorpe be forced from parliament? Is it fair to ask a First Nations person to pledge allegiance to the monarchy? What about all those MPs that want Australia to become a republic? On this episode of the Briefing, Bension Siebert dives into all of these questions with Luke Beck, Professor of Constitutional Law at Monash University. Late last month Attorney General Jaclyn Symes announced a backflip by the government on reverse onus bail reforms, and the concerning introduction of an electronic monitoring system to track children on bail in Victoria. Sheree Lowe is a Djab Wurrung and Gunditjmara woman with a strong connection to South West Victoria, and has lived most her life on Wadawurrung Country in Ballarat. She has been advocating within the Aboriginal Community in Victoria for over 20 years, and previously worked as a management consultant at PWC on projects related to organisational transformation through an Aboriginal lens and cultural safety program design.// Dr Rebekah Hoffman, General Practitioner at Kirrawee Family Medical Practice in Sydney and NSW/ACT chair of the Royal Australian College of General Practitioners (RACGP), spoke with us about the latest Drug Checking Service pilot running out of Kings Cross' Medically Supervised Injecting Centre. James is a PhD student in the Faculty of Business, Government and Law at University of Canberra. For more than 35 years, he has been active in many campaigning organisations fighting for social justice, locally and internationally, including the Non-Stop Picket of the South African Embassy in London (1986-1989). Amielia is a 21 year old Djab Wurrung woman and this week we would like to share her birth stories in celebration of NAIDOC week.Amielia only found out about the details of her indigenous ancestry when she was 12 and who her family were related to. She grew up learning about her cultural practices and a part of the disappointment in her first birth was the disconnect between these practices and the public hospital system. Later she would learn there was a program dedicated to indigenous women that she would seek to be a part of in her next pregnancy. When she first fell pregnant it was unexpected but despite this her partner vowed to support her no matter which path she took. She speaks about the lack of knowledge she had going into the pregnancy and how it felt going through her first pregnancy amid Covid lockdowns in Victoria. At 41 and 5 days, doctors suggested an induction which she agreed to. She had tested positive for Group B Strep. After what was deemed ‘failure to progress' at 2cm dilation Amielia felt powerless and agreed to an emergency caesarean after her baby's heart rate started to show signs of distress. After this experience Amielia did not want to be induced again. She hired a student doula and ended up experiencing the vaginal birth she always wanted at almost 43 weeks. Due to her baby passing meconium in her womb she agreed to have her baby tested for infection and tells us how her baby ended up staying in hospital for 5 days and what that experience was like for her.Thank you Amielia for sharing your VBAC journey with us. In this interview, Sarah Ghassali is joined by Australian Greens Senator for Victoria and Gunnai Gunditjmara and Djab Wurrung woman Lidia Thorpe, during NAIDOC Week 2021. Thorpe, who became the first Aboriginal person to be elected to Victorian Parliament in 2017, shares her thoughts on NAIDOC Week, its history as a day of protest against colonisation, how we can make it more inclusive and progressive and tips for more ethical allyship for non-Indigenous listeners.  Thorpe also shares her views about the importance of the development of a treaty – a legal agreement between Indigenous Australians and the Australian Government – as the next step beyond reconciliation, and the necessity of having diverse voices in politics to enable real societal change.

Auspol Snackpod: Australian Politics and Memes

It's the return of Le Snak this week, we have a super long episode and - April Fools! - everything is totally awful. There are a LOT of content warnings for this episode, I've included the time codes below and we also mention it while we're talking so you can skip past. Coronas: We are very behind on our vaccination roll out; the Federal Government claims we are not behind on our vaccination roll out  Positivity Corner: the Victorian Government seems to be backing down from the highway expansion that would destroy more Djab Wurrung heritage sites  First Nations: the Dhadjowa Foundation has been formed to support Indigenous people who have had loved ones killed in custody. We use the names of Indigenous people who have died; if you want to skip this segment it runs from 0:12:23 - 0:21:40  SPOTW: Broriginals are back with the Broriginals First Nation Party  Fashy Australia: It's a fashy roundup because we've just got too many freaking Nazis running around the country. We talk about Tom Sewell & the Base.  UFU: Goes to huge creep and probably criminal stalker, Andrew Laming. We spend basically the rest of the show talking about sexual harrassment but this story runs from 0:45:40 - 0:55:15  Blurst Take: goes to huge creep Eric "Nazism doesn't run in the family I swear" Abetz, for being the absolute blurst in his comments about sexual assault in Parliament. If you want to skip it it runs from 0:55:15 - 0:59:40  Mains: The Federal Government has had a Cabinet Reshuffle, so we talk about some of those changes, the new Women's Issues Taskforce, and some other related terrible behaviour from Scott Morrison and Peta Credlin. Again, a lot of the discussion is about the sexual harrassment and assault going on in Parliament so if you want to skip this story it goes from 0:59:40-1:29:50  ACAB: heavy content warnings; this story is about a trans woman being killed. It runs from 1:29:50 - 1:34:20  Potluck: we play a potluck we got a few weeks ago about International Women's Day.  And you'll just have to wait to the end for our Pupdate!  Support the show financially: www.patreon.com/AuspolSnackpod Send us a potluck at contact@auspolsnackpod.com  Part 1 of Tom Tanuki's coverage of the Tom Sewell incident: https://www.youtube.com/watch?v=CEQGL1ZKLY0  Read the open letter from the #JusticeforMhelody campaign groups: https://docs.google.com/document/d/16fP2v6LX50tEceELfRWwfSmLE6XHZJzysXZCvd0bDEA  Go to the rally in Melbourne: https://www.facebook.com/events/436109990827165/?ti=ls

Our guest today is Greens Senator Lidia Thorpe and she's a passionate advocate for human rights, social justice and the environment. She's also a proud Gunnai Gunditjmara and Djab Wurrung woman, who takes inspiration from a long line of strong matriarchs in her family. In 2017, Lidia made history by becoming the first Aboriginal woman to be elected to the Victorian Parliament. And in 2020, she made the leap to Federal Parliament as the first Aboriginal Senator for Victoria. But Lidia's path into politics has not been typical. Growing up in public housing, she left school early to start working and her professional experience covers everything from Aboriginal services to running her own businesses. As an activist, Lidia spent years fighting the system from the outside. Now she's in the halls of power, determined to use her lived experience as a catalyst for change. In this special episode to mark International Women's Day, Lidia shares the story behind her move into politics, the hardest and most rewarding aspects of her work, what she hopes to achieve in her role as a Senator and why we need more women from diverse backgrounds in public office. Hoy bleakers, Darcy's back and there's a couple weeks before Kieran's gone. So here's a bit of a megasode, a two hour paean to political monstrosity that orbits around the dark star of the UK Tories. Darcy runs down the origins of the name and the deep legacy of vicious ineptitude that lives on in the current party. He also takes a look at how they differ from our tories and also how the two parties resemble each other. There's kind of a mini B Topic where we gripe about how shit the current Labor party are. Our stories are: Australian aged care facilities are killing their residents through the totally normal and understandable malady of malnutrition; Victorian authorities are doing sweet fuck-all to prevent the bulldozing of the sacred sites of the Djab Wurrung people; George Calombaris fully got away with stealing nearly eight million dollars and I guess the powers that be barely give a fuck; and a little bit of a Musk Update, which is mostly an excuse to talk about the Grimes fitness regimen thing that fooled way too many people.
