On parle en particulier d'anxiété, de dépression.De l'autre, les RH mettent en place des systèmes et des pratiques dont le but est d'être dans la légalité et d'améliorer performance des collabs: conception des fonctions / rôles, récompenses justes, niveaux de rémunération équitables, possibilités de formation et de développement, sécurité de l'emploi, programmes de participation des employés.Or il semble que ces pratiques soient bénéfiques pour l'organisation, mais pas forcément pour les personnes. Qu'en est-il? While the meat and egg industries in the grand picture have still been largely unaffected by plant-based competitors, that's not the case in the milk industry, where the explosion of plant-based milks has very tangibly cut into demand for cow's milk. Gone are the days when almond milk and soy milk were for vegans—now they're for everyone.  But just a few years ago, a new entrant into the plant-based milk world emerged. In 2015 oat milk was far less than 1 percent of the plant-based milk world. In fact, people hearing the term “oat milk” were probably more likely to think they'd heard people talking about “goat milk.” Not anymore. Thanks largely to one company, Oatly, oat milk is now the belle of the alt-milk ball. After three decades of toiling away far out of mainstream consciousness, Oatly has boomed, leading to its mega-successful 2021 IPO.

When he's speaking about mental health to schools and corporations, he's not afraid to talk about tough issues like drug addiction, mental illness, and suicide. That's because he has personal experience with all three. After you hear what Archie had to say in our conversation, you'll understand why there's so much power in being vulnerable. There's no point trying to pretend you're okay when you're not. You'll end up finding unhealthy ways to deal with the pain. Take Archie's advice to heart. It's 2021, and oat milk has become a mainstream phenomenon. One brand leading that charge is Oatly. It's a nearly-30-year-old Swedish company, but only expanded to the U.S. in the last five years. But its expansion helped spur a nationwide acceptance of dairy alternatives. Mike Messersmith, Oatly's president of North America, joined the Modern Retail Podcast this week and talked about the brand's growth, as well as the category as a whole. Oatly started its U.S. expansion in coffeeshops, and that helped it expand into retail; “people discover it, they talk about it and they want to buy a larger carton at the grocery store to bring home,” he said. With that, Oatly is now available nationally and in major retailers including Target and Whole Foods. In tandem with this increased distribution, the last two years have been huge for the milk alternative brand. According to Messersmith, over half of Oatly's customers in 2020 were new to the brand that year. According to its most recent earnings report last June, the company brought in $146.15 million in revenue, a 53% jump from the year before. And while oat milk is often considered a more bourgeois product, Messersmith said he is intent on getting everyone in the country to drink it. “Our goal in this was not just to bring oat milk to Brooklyn and the arts district in LA,” he said. “I want people ordering oat milk lattes where I grew up in northeast Pennsylvania.” So far, those plans seem to be working out. The milk alternative category as a whole is exploding. Plant-based milk saw 20% year-over-year growth in 2020, hitting $2.5 billion in revenue, according to data from Spins. Oat milk sales specifically tripled in 2020. For now, his focus is on getting people to try oat milk, as well as very conscientiously expand Oatly's product line. Last summer, for example, the company launched a series of soft-serve flavors. Even with this growth, Messersmith was clear that his strategy isn't to take things for granted. “We're still at the very early stages.”

Intentional Acts Exclusions and Fortuity https://zalma.com/blog Implicit in the concept of insurance is that the loss occur as a result of a fortuitous event not one planned, intended, or anticipated. Oddly, the fortuity principle never appears in insurance contracts. The principle is rooted in common law and in the statutes of at least six states. The fortuity principle has the effect of an exclusion. That is, an all-risk policy might provide coverage for all risks minus named exclusions, but never provides coverage for non-fortuitous events, even though non-fortuitous events are not named exclusions in the policy. For this reason, the fortuity principle is sometimes called the unnamed exclusion. A fortuitous event is an event which so far as the parties to the contract are aware, is dependent on chance. It may be beyond the power of any human being to bring the event to pass; it may be within the control of third persons; it may even be a past event, such as the loss of a vessel, provided that the fact is unknown to the parties. Compagnie des Bauxites de Guinee v. Ins. Co. of N. Am., 724 F.2d 369,372 (3d Cir. 1983) (quoting Restatement of Contracts § 291 cmt. A (1932)) “The purpose behind the fortuity doctrine applies with full force where a party attempts to purchase insurance against the consequences of his own ongoing wrongful conduct.” (Scottsdale Ins. Co. v. Travis, Court of Appeal of Texas, 68 S.W.3d 72 (2001)) Judge Cardozo, in 1923, stated a simple and obvious rule of law that “no one shall be permitted to take advantage of his own wrong. [Messersmith v. American Fidelity Co., 232 N.Y. 161, 133 N.E. 432 (1921).] California, by statute, covers has codified Cardozo's statement. Almost every insurance policy issued in the US excludes the intentional acts of the insured. Those that do not are covered by the public policy adopted by most states. Exclusions to Coverage for Construction Defects https://zalma.com/blog Implicit in the concept of insurance is that the loss occur as a result of a fortuitous event not one planned, intended, or anticipated. Oddly, the fortuity principle never appears in insurance contracts. The principle is rooted in common law and in the statutes of at least six states. The fortuity principle has the effect of an exclusion. That is, an all-risk policy might provide coverage for all risks minus named exclusions, but never provides coverage for non-fortuitous events, even though non-fortuitous events are not named exclusions in the policy. For this reason, the fortuity principle is sometimes called the unnamed exclusion. A fortuitous event is an event which so far as the parties to the contract are aware, is dependent on chance. It may be beyond the power of any human being to bring the event to pass; it may be within the control of third persons; it may even be a past event, such as the loss of a vessel, provided that the fact is unknown to the parties. Compagnie des Bauxites de Guinee v. Ins. Co. of N. Am., 724 F.2d 369,372 (3d Cir. 1983) (quoting Restatement of Contracts § 291 cmt. A (1932)) The purpose behind the fortuity doctrine applies with full force where a party attempts to purchase insurance against the consequences of his own ongoing wrongful conduct.” (Scottsdale Ins. Co. v. Travis, Court of Appeal of Texas, 68 S.W.3d 72 (2001)) Intentional Acts Exclusions Judge Cardozo, in 1923, stated a simple and obvious rule of law that “no one shall be permitted to take advantage of his own wrong. {Messersmith v. American Fidelity Co., 232 N.Y. 161, 133 N.E. 432 (1921).] California, by statute, covers has codified Cardozo's statement. Almost every insurance policy issued in the US excludes the intentional acts of the insured. Those that do not are covered by the public policy adopted by most states. To insure against wrongful acts would be to allow people to act wrongfully with no adverse effect since their victims would be compensated by insurance. Insurance involves the transfer of the risk of possible losses from the policyholder to the insurer. It is not available for losses that the policyholder knows of, plans, intends, or is aware are substantially certain to occur. Insurers faced with a construction defect claim may attempt to exclude coverage by claiming that the insured intended to build a defective structure. Just as the brand was shifting into high gear, the engine driving one of the hottest brands in food and beverage had basically stalled. Oatly, a Swedish-based brand of oat milk and oat milk-based products, has been available in Europe for over 25 years and entered the American market in 2016. The U.S. launch was timed to meet surging interest in plant-based dairy alternatives, but while Oatly anticipated a strong start, the overwhelming demand for product was more than the company could handle. Just months after its debut, Oatly was faced with severe out-of-stock issues and enraged customers as it sought short and long-term solutions to its supply chain challenges. Although Oatly has gotten back on track and is the leading brand in a thriving oat milk category, Mike Messersmith, the general manager of Oatly’s U.S. operations, was candid about the company’s early mistakes -- and the likelihood that more will follow. “We’ve already failed in the biggest ways possible; we’ll do it again,” he said in an interview included in this episode. “It’s all about progress,” Messersmith said. “Next week will be better than this week, a month from now will be better than that week. It will be messy. It’s always been messy. The thing I have to do more than correcting failure is reminding people -- and remind myself -- that it’s going to get better. And it still won’t be perfect, but the only way is forward.” As part of our interview, Messersmith explained how Oatly leans on its origin story to differentiate itself from the growing number of oat milk brands coming to market and why focusing on the unnecessary has been a valuable part of its business strategy. How do researchers test new glues for fetal surgery? Bioengineer Phillip Messersmith of the University of California, Berkeley is synthesizing bio-inspired glues to seal the delicate amniotic sac during a procedure. The glues are based off an adhesive used by mussels, the hard-shelled mollusks, to stick to wet surfaces. And it takes multiple rounds of testing to make sure such a product does in fact work. "The entry level testing would involve some mimic of a tissue. We could use, for example, and do routinely use, sausage casing, which actually has relatively similar mechanical properties to the fetal membranes." If some of these formulations look promising, the next step is to test them on fetal membrane tissues like discarded placentas from births. "For formulations that work well in that situation, then we can advance to a third stage which would be pre-clinical animal studies." Messersmith and his team are currently working to strengthen their second generation of glues.

It’s been 35 years since the first fetal surgery was performed by Dr. Michael Harrison of the University of California, San Francisco . And now engineers at the University of California, Berkeley are teaming up with Harrison to develop a fetal surgery glue that’s inspired by mussels – yes, the edible ocean dwellers. UC Berkeley engineer Phillip Messersmith says they’re synthesizing a glue that’s based on the tough adhesive that mussels produce to stick to rocks. "The idea that we could borrow ideas from the mussel and use them in a synthetic material is something that we embraced. And so if you want to do that, you have to at least have some basic level of understanding of how this glue works in nature." Mussels secrete a series of protein threads to anchor to a wet surface, so Messersmith and his team have created synthetic polymers that mimic the glue. The hope is that this glue may alleviate current risks of rupturing the protective membrane of the amniotic sac. "Now we’re embarking on a four-year project for fetal surgery glues."
