Hard to believe in these inflationary times: My recommended plan HDG (known as G+ in New York) is the only plan in its family not being forced to endure a rate increase. Shocking: Financial analyst describes the damage to Humana caused by a government rating reduction. The company is described as "reeling"! M has her choice of Part D prescription drug plans: After a scientific search, her agent advises a Wellcare plan that will cost $60 all year. Her dopey friend suggests a Humana plan at $4000. Finally, a valued client moves to Washington State. She finds a cheaper company we don't have a contract with so she sadly leaves the fold. If your agent doesn't perform a scientific search for the best Part D drug plan for you, don't believe his recommendations! Wellcare plan cost $0 while a Humana plan cost $1,760! Same guy, same generic drug, same little town in Missouri produced dramatically different results: In the Medicare Advantage Minute, some insurance companies say they are "shrugging off the headwinds" of the current MA turmoil that has the big firms dropping hundreds of thousands of current clients! Wikipedia page "Medicare" discusses the ACA (Obamacare) in very sterile terms. How are injections covered under Medicare? Finally, the story of two new MLM clients: One is a renowned Medical doctor whose MA plan refused his prior authorization request then booted him out. The other wonders whether her husband should stay on her employer plan or should he get the boot? Dr. Jenny Quartano -- Shortly after beginning her private practice as a pediatric physical therapist, Dr. Quartano found herself in an unexpectedly challenging personal situation that led her to a place of focusing the lifestyle factors she could control to manage her health and continue to show up every day for her patients—without medications, aches, pains, or fatigue that seemed to be what the traditional medical model offered. Through this experience, she found a passion and training in functional medicine so she could help other families undergoing the same. She doesn't subscribe to common symptoms being normal or deteriorating health being a symptom of age and seeks to help other women find their best self to be the best mom, wife, professional or athlete they desire to be. As families continue to seek alternate healthcare solutions outside the traditional clinic, All Together Wellness has seen a huge demand from the community to meet their needs in new ways. Dr. Quartano has curated a team to create a village of support for our All Together women and children in helping them thrive! Our team shares a vision of creating an experience for families where help is provided when and where you need it in a way that minimizes the burden and intrusion in your day to day rhythm but rather works with your family's needs the way health and wellness support should. Dr. Jenny Quartano Vroom Vroom Veer Grew up outside of Green Bay Wisconsin (GO PACK!) pretty much knew two facts when she was young 1) She would move away from Wisconsin 2) Be a Doctor; we both grew up in the Packerland in the "Frozen Tundra" and love to back to visit in the summer and for Christmas Did some grad school in Florida and decided the Sun and the beach beats the Frozen Tundra After she started her private practice, she was feeling sick, tired, and her doctor told her nothing was wrong; being a doctor she knew something else was going on; she also saw the women she worked with in her practice didn't have enough energy to live a healthy happy life She joined a gym with a friend and challenge with together with work out everyday, meditation/stretchy, big diet restrictions (not fun), had to schedule and sleep 8 hours a night--amazed herself with how much better she felt We compare notes on our health journies; cleaning up our diets, finding all the hidden sugar in packaged and junk food (it's everywhere!); Jeff in his 30's experienced pain when trying to stand up long enough to brew beer (about 3 hours); now he prefers a stand up desk to sitting Dr. Jenny noticed that as a group health care works (nurses, therapists) are overworked, with high stress levels and eat junk on the run; Dr. Jenny agrees as a group they are not great at self care She came from a background of Pediatric Physical Therapist-she spent a lot of time teaching parents about healthy eating as well as healthy parents; the vision was to have a one-stop shop for families with kids Connections Website

Verna shares trends and tactics from her decades of experience in senior living. She stresses the need to empower residents and staff through multicultural as well as multigenerational experiences, educating on selfcare, and using AI technologies to enhance operations and resident services. About Verna Verna Chisman, President of Allure & Wellness Management Services and Vice President of Client Engagement for Muir Salon Group. Allure is a consulting firm and resource for active adults, developed from her years of experience at multiple premier Life Plan and 55+ communities across the country. During her tenure with Life Care Services, Verna was a member of the Corporate Resource Team, Corporate Health & Wellness Committee, Task Force Committee, and development of Odyssey(technology platform) and Director of Community Life Services for Sagewood & Acacia Health Center. In 2015, Verna was recruited by John Knox Village of Pompano Beach & The Woodlands. She held the position as Director of Wellness, which required considerable involvement on the development of a comprehensive Master Plan inclusive of reframing the culture and integrating the Green House Project within the community. Verna has a Bachelor of Business Administration (B.B.A). Certifications include ICAA Leadership in Wellness Management Course. She is also honored to be appointed as Co-Chair on ICAA's Education Committee. Additional certifications include Green House Project Core Training, Best Life Train the Trainer Green House Project, Train the Brain, “Better with Age” Training Program, Heartfelt Connections Certification, Banner Health's Alzheimer Institute Compass Certification and Certified Meeting Professional. Key Takeaways Self-care inevitably equals wellness, which diminishes the need for healthcare. Senior living communities need to step aside and let residents live their lives. Older adults need to take ownership of their own self-care. Ageism is a major challenge inside senior living communities, showing up in interactions with staff, executives, and resident to resident. Ageism depletes older adults' confidence and destroys their dignity. A multicultural environment expands horizons. Programming should embrace different cultures—staff should share their cultural experience with residents, and vice versa. Have a “culture night” with slideshow and regional cuisine.

Listening as the CXR community discusses a wide range of topics focused on attracting, engaging and retaining the best talent. We're glad you're here. Chris Hoyt, CXR 0:20Welcome, everybody to another CareerXroads podcast. This segment or this session, or this special edition is called a Have You Met? And I'm pretty excited today. We have industry, individual personality has been around quite a while in the space. She's got some pretty impressive history, I mean, she comes out of Edward Jones, I think you were there for nearly a decade BJC Healthcare all this and talent acquisition, and now you're at centene? Corporation. Right? So yep. Mirandah Thomas, you are the leader of talent intelligence at Centene. Mirandah Thomas, Centene 0:55Yep. Chris Hoyt, CXR 0:56I got to ask you, what does that even mean? Mirandah Thomas, Centene 0:58Yes, yes. Well, the funny thing is, is that we've had to kind of figure it out along the way, believe it or not, believe it or not. But where we are today, and what we are is. So we are focused on providing external market talent, market intelligence, to our stakeholders, which would include both RTA full cycle recruiting partners, and leaders. And then we also are focused on sourcing strategic sourcing, for difficult to fill or challenging roles across our organization. So we've been kind of been experiencing a little bit of an evolution. Chris Hoyt, CXR 1:47Yeah, well is, is the term talent intelligence, at least in your world is not being used external talent intelligence, like a research Intel, or is it also internally like from mobility and maybe internal search standpoint? Mirandah Thomas, Centene 2:04So so far, it has really been focused more externally than internally, but as the world changes, we we so too evolve and change with it. But yes, right now the focus has really been external. So we're kind of helping our leaders and our stakeholders to connect the dots and really understand what the talent market and landscape looks like, particularly for some of these critical skill sets and roles where we are having to go external, because we don't already have an internal pipeline. So our team is there to kind of help connect those dots and build a strategy help build an external marketing strategy. But we do that with other partners as well. We have a brand team that we partner with, when it comes to branding, and also our delivery team or full cycle talent attraction team, we do it all in partnership, it takes a village really, so. Chris Hoyt, CXR 3:03So if you've got a village, it says, it says, it says a lot about your organization, can you just for those who may not have heard of Centene? Can you can you give us sort of the escalator pitch of, of what Centene is and what you guys do? Mirandah Thomas, Centene 3:15Yes, we're a managed care, health organization. And really, we primarily focus on bringing health care to some of the country's most underserved communities primarily focused in the Medicare and Medicaid space. And so, you know, you can imagine that with, you know, what's been going on with the economy, the country, COVID, the demand for medicaid medicare Services has has just continued to increase. And so with that, we've seen some some definite organic growth. And then also, we've acquired companies. You know, last year, that a year ago, we completed, you know, the acquisition of Wellcare, which is also a very large managed care company. So within the span of three years, we've almost doubled in size. So you know, and kind of that's catapulted us to, you know, essentially a fortune 50 company in a very short amount of time. So you can imagine how ta has been at the forefront of that growth, and trying to help the organization navigate that. Chris Hoyt, CXR 4:36Well, I mean, to go through that in a normal year, right,

This is a 7-month period: 3 months before you turn 65, the month you turn 65, and 3 months after you turn 65. As a result, you can NEVER be disqualified for coverage based on your health condition during this period. In other words, you can have health conditions and your coverage will NOT be denied. Moreover, the plan can NEVER charge more if you have health issues during OEP. When you apply for Medicare during this period your acceptance into a Medigap Plan is guaranteed. According to Medicare.gov the best time to buy a Medigap policy is during your open enrollment period. When is Medigap insurance underwriting required? If the first time you enroll in Medicare Supplement Plan is AFTER your initial Open Enrollment Period, Medigap underwriting is required. In other words, you did NOT apply for Medicare during your initial OEP. When you switch to a different Medigap Plan after your initial Open Enrollment Period, then underwriting is required. Likewise, when you switch from Medicare Advantage Plan to Medigap Plan after your initial OEP, then underwriting is required. Anytime you apply for Medicare Supplement Plan (Medigap) outside your initial Open Enrollment Period (OEP), you will have to answer underwriting questions. Medigap policies are sold by private insurance companies. As a result, some underwriting questions insurance carriers ask will be different. However, many insurance companies ask similar questions. The Medicare premiums, deductibles and co-payment amounts have been officially updated for 2020. Social security saw a rather small increase of only 1.6%, which will be eaten up by Medicare’s Part B premium increase. 2020 Medicare Part A Deductible and Coinsurance Inpatient hospital deductible: $1,408.00 Daily Coinsurance Days 61-90: $352.00 Daily Coinsurance-Lifetime Reserve: $704.00 Skilled Nursing Facility Days 21-100: $176.00 2020 Medicare Part B Premium and Annual Deductible Standard Monthly Premium: $144.60 Annual Deductible: $198.00 How will the Medicare Part B annual deductible increasing impact you if you have a Medicare Supplement? If you have a Medicare Supplement Plan F, the deductible is paid for you so you would not have to worry about that increase as far as what your out-of-pocket costs are going to be. If you have the Medicare Supplement Plan G, then the only out-of-pocket cost that’s going to increase for you is the Part B deductible going up $13.00 from $185 to $198. If you have the Medicare Supplement Plan N, the only out-of-pocket increase will be the Part B deductible as well. The co-pays will stay the same as well as the Part B excess charges. Many people are asking if the Plan F will be a better option than the Plan G because the Part B deductible increased. Look at it from the carrier’s perspective: Imagine that Plan F and Plan G both have one million people in each plan and the Part B deductible increased by $13.00. The Plan F is now going to have to pay an additional $13 million out of their budget to cover the deductible increase for their clients. However, the one million people in the Plan G all pay their own deductible so the insurance company is not going to have to pay any more money for their clients in the Plan G to cover that deductible increase because all of those clients already pay their own deductible. In this situation, it’s much more likely that the Plan F is going to see the more significant premium increase to make up for the $13 million increase. There have been some changes with Medicare Part D plans as well. CVS purchased Aetna but in order for them to do so, Aetna had to sell all of its Part D plans. WellCare, another Medicare Part D company, purchased all of Aetna’s Part D plans. Those clients that were on an Aetna Part D plan are now going to rollover into a WellCare Plan. Humana made another huge change to their Part D plan, Humana Walmart. If you have the Humana Walmart plan, you should have received a letter from the carrier in September or October explaining that you’re being rolled over into what’s called Humana Premier plan and the premiums are going to be around $56 to $60 per month depending on where you live. This is a very high increase specifically because most clients on the Humana Walmart plan are taking only a few generic medications. If you have that plan, you do not have to take that roll over. There are other options out there. You have until December 7th to shop your options which we can help you do at this link: https://www.seniorhealthcaredirect.com/2020-medicare-part-d-finder-form-lead-form/

Today I thought it would be fun to take a break from talking about legal and regulatory obligations and talk about how we can make compliance engaging and maybe even a little fun. Corporate Compliance and Ethics Week is coming up the week of November 5th – 11th. I know a lot of organizations use this week to highlight their compliance program. I also know a lot of other organizations maybe don’t celebrate any particular week, but may do something outside of the box every once in a while to help raise the profile of the compliance function.  Every organization is different and has its own tolerance for fun and innovation, and the activities I talk about today can all be modified to fit the culture of your company. Criminal Regulatory Statutes: Is “Deliberate Indifference” Sufficient Mens Rea For A “Knowing" Violation? Case Update: Farha v. United State

Farha v. United States, currently pending on a petition for writ of certiorari to the U.S. Supreme Court, is a case study raising basic notions of due process, fair notice, the rule of lenity, mens rea, and whether administrative and civil remedies would be more appropriate. What began as a highly publicized raid by some 200 FBI agents on a Florida health care company over an accounting dispute ended in the indictment, conviction, and prison sentences for the Wellcare executives for fraud. -- On appeal, where the case was captioned Clay v. United States, the U.S. Court of Appeals for the Eleventh Circuit upheld the convictions over the objections of the defendants that the jury instruction impermissibly allowed the jury to convict if the defendants were “deliberately indifferent” to the law’s requirement as opposed to finding a “knowing” violation as the statute requires. The Supreme Court in 2011, in Global-Tech Appliances, a civil case involving patent infringement, held that "knowledge" cannot include "deliberate indifference" to show sufficient mens rea to establish infringement. Accordingly, the cert petition, filed by Seth Waxman of WilmerHale, seeks to have the Court rule that the jury instructions should require a higher mens rea standard, all the more so in a criminal case. -- This case is particularly important for all regulated industries, where there are numerous laws and complex regulations governing conduct subject to administrative, civil, and criminal enforcement. -- Featuring: Paul Kamenar, Washington, D.C. Public Policy Attorney and Senior Fellow, Administrative Conference of the U.S. and Jeff Lamken, Partner, MoloLamken. Moderator: John G. Malcolm, Director and Ed Gilbertson and Sherry Lindberg Gilbertson Senior Legal Fellow, Edwin Meese III Center for Legal and Judicial Studies, The Heritage Foundation.
