Marcus MonroeTake a walk with me down Fascination Street as I get to know Marcus Monroe. Marcus is a comedian now, but was a juggler for many, many years. I guess he is still both. In this episode, we chat about why Marcus decided to learn magic as a child, and then not long after, decided to be a juggler. He tells me a few stories from his juggling days; including some of his time juggling on various cruise ships. From Celebrity Cruises, to Disney Cruise, Marcus has performed on them all. He even tells a crazy story about how he got to juggle on Late Night With David Letterman, and an even more insane story about the time he was the opening act for the band Cake. Marcus and I exchange Neil Patrick Harris stories. Mine makes me look like a psychopath, his turns out pretty good! Next we turn to comedy. Marcus explains why he decided to get into comedy, and we talk about his "Subway Series"; which is how I found him. He releases videos of him telling VERY corny jokes to unsuspecting NYC commuters. These videos are a ton of fun! Finally, we discuss he previous podcast Talkie Walkie, and his newest podcast The Boy Friends Podcast. Check out his videos on Instagram, and get his podcasts everywhere you listen.

It's late April 2024, but Doctor Who Literature takes us back to mid-February, and to the Gallifrey One convention in Los Angeles, where Mark from the Trap One Podcast joined me over dinner for a My Dinner With Andre-style conversation about the 1969 Doctor Who serial The Seeds of Death, and its 1986 novelization by Terrance Dicks. Nicole talks about the difference between creation and nervous activity and how hard it is to distinguish between the two. We also talk about procrastination, Elvis Costello, the need to let ideas simmer, collaborating on a show, making an album, the meaning of music, the tricks to productivity, and the joy of baby steps. Bio: For two decades, Nicole Atkins has created her own brand of spectral American rock & roll. She's an old-school torch singer for the modern world, funneling her award-winning songwriting chops and genre-spanning influences — including psychedelic rock, Muscle Shoals soul, the pop grandeur of Roy Orbison, and the dark drama of Nick Cave — into six albums that have earned a global audience. Regularly featured on year-end "best of" lists by Rolling Stone, NPR, and The New York Times, Atkins has collaborated with artists from across the musical spectrum, including David Byrne, Chris Isaak, Spoon, Elvis Costello, Tommy Stinson, and the Old 97's. The title track of her major-label debut album won The ASCAP Foundation Sammy Cahn Award, and her songs have appeared in prime-time TV shows like Dexter, national ad campaigns for American Express, and on the Billboard charts, with tracks like "Domino" becoming Top 40 AAA hits. A road warrior who has performed everywhere from Carnegie Hall to Late Night With David Letterman, Atkins is also a professional illustrator and painter whose work has appeared in The Wall Street Journal and No Depression.

Following the dreams of her best friend who moved to New York City to play guitar for John Lennon, Sandra Furton Gabriel, she discovered that she loved having that All Access pass that got you backstage, but she didn't want to be an entertainer. Starting out doing odd jobs, she soon found herself interning at Rogers & Cowan, the internationally recognized public relations firm. Although that job didn't pan out, she wound up transcribing tapes for Sam Merrill, who was doing interviews for Playboy Magazine. That in turn led to a gig with D.I.R. Broadcasting, where she was hired to book talent for comedian Robert Klein's radio show, and the rest is history. Sandra soon found herself becoming the producer for a newly developed TV show with a young comedian by the name of David Letterman. Now it was only a matter of booking guests for the show. It sounds easier than it was, but needless to say that the role was full of challenges including guests who didn't know who David was (actor Peter O'Toole had no idea who Letterman was), those that didn't show up at all (drummer Levon Helm of “The Band” fame), and actor Bill Murray (the very first guest on “Late Night With David Letterman”) who wandered off the set before taping, who finally arrived in the studio just as he was being announced. After leaving Letterman, she went on to produce “The Joan Rivers Show” up until Joan started her home shopping show. Sandra went on to create a daytime talk show pilot tentatively titled “Girlfriends”, featuring women of different views, cultures, and ethnicities, and pitched it to ABC Television. Unfortunately the show didn't get picked up, but in Sandra's words, “The View” came out of her proposal, although she was left out of the production. She went on to file a lawsuit against ABC and Barbara Walters, but lost in the end. Picking herself up, and dusting herself off, she went on to work with actress, producer, and syndicated daytime talk show Rolanda Watts. Sandra Furton Gabriel has worked with such legends as Robin Williams, Stevie Winwood, Ringo Starr, William Shatner, Kenny Loggins, Rodney Dangerfield, Michael J. Fox, along with Stevie Nicks and Art Garfunkel. © 2023 Lotta Dogs Productions LLC Showrunner and Executive Producer Emeritus: Tom Sabella Producer and Host (the guy who has a face for podcasting): Bob Bender Management Representation: Chuck Thompson for Thompson Entertainment Group, LLC Co-Producer - Audio/Video Editor (the man behind the curtain): Mark Sabella Director of Video and Continuity (the brains of the entire operation): Deborah Halle Marketing and Social Media (all knowing): Sarah Fleshner for 362 Entertainment All Around Problem Solver (and Mental Health Therapist for us): Connie Ribas Recorded inside what could be an old beat up Airstream Trailer located somewhere on what's left of Music Row in Nashville TN (Man we sure do miss Noshville, and the Longhorn Steakhouse) Mixed and Mastered at Music Dog Studios in Nashville, TN Editing and Post at Midnight Express Studio located in Olian, NY Production Sound Design: Keith Stark Voice Over and Promo: Lisa Fuson Special Thanks to the creator and founder of the podcast, Tom Sabella, along with Traci Snow for producing and hosting over 100 episodes of the original "Business Side of Music" podcast and trusting us to carry on their legacy. On today's new episode Jonah and Vanessa welcome the delightful Bridger Winegar to dig deep into the world of spooky games like "Light as a Feather Stiff as a Board" that haunted them as kids. And did you know there were several films inspired by the game "Bloody Mary"? It seems no one did. Plus, Bridger and Vanessa recall their days of being interns in late night tv and the various ways they humiliated themselves. And a lively game of "Legit Moan or Unnecessary Groan" has them debate whether kids in commercials are cute or annoying? Finally, we ask the question, is Bridger the first person to ever be named Bridger like The Bayer's dad Todd? You'll have to listen to find out!See omnystudio.com/listener for privacy information.

We kick off True Stories, a series on autobiographical and nonfiction comics, with a look at Harvey Pekar's American Splendor! While not the first comics work to chronicle the real-life exploits of its creator, American Splendor broke ground as an ongoing series that told an impressively diverse range of stories within the confines of an autobiographical, slice-of-life title. Along the way, it also made him a minor celebrity—first through a series of appearances on Late Night With David Letterman and later via a 2003 feature film starring Paul Giamatti as Harvey. From observational musings about everyday moments to warts-and-all depictions of Pekar's obsessions, grudges and personal foibles, American Splendor helped to redefine what comics could be and do. But is that enough to help it survive on those mean streets known as ... The Comics Canon? In This Episode! “You're doing a bit!” “This guy's a huge JERK!” What can Wallace Shawn do for ME?!! American Splendor, Crumb and Ghost World Our Cancer Year Join us in two weeks as True Stories continues with Lynda Barry's emphatically punctuated One! Hundred! Demons! Until then: Impress your friends with our Comics Canon merchandise! Rate us on Apple Podcasts! Send us an email! Hit us up on Twitter or Facebook! And as always, thanks for listening!

A house-filling favorite in Las Vegas since she opened as one of the hottest tickets in town in June 2000, Rita Rudner is known for her epigrammatic one-liners. Over the course of a multi-year run she sold almost two million tickets, grossed over a hundred million dollars and become the longest-running solo female comedy show in the history of Las Vegas. She was named Las Vegas's Comedian of The Year nine years in a row and in 2006 received The Nevada Ballet's Woman Of The Year Award. In October 2017 she was given the Casino Entertainment Legend Award. Rita's first solo HBO special, “Rita Rudner's One Night Stand”, was nominated for several awards, as was her eponymous English BBC television show that later appeared in the USA on A&E. Rudner's two one-hour specials for HBO, “Born to Be Mild” and “Married Without Children,” were ratings standouts and she performed all over the country, filling Carnegie Hall in New York three times. In 2008 Rita Rudner: Live From Las Vegas was PBS's first ever stand-up comedy special. Rita Rudner has written five books; her bestselling non-fiction titles, Naked Beneath My Clothes Rita Rudner's Guide to Men and I Still Have It…I Just Can't Remember Where I Put It, plus the novels Tickled Pink and Turning the Tables. The audio version of Naked Beneath My Clothes received a Grammy nomination. She is currently working on her autobiography, My Life in Dog Years. Rudner is a frequent collaborator with her writer/producer husband of thirty years, Martin Bergman. The couple's first produced film script was “Peter's Friends.” The film, starring Emma Thompson, Hugh Laurie, Kenneth Branagh, Imelda Staunton, Stephen Fry, and Rita, won the Evening Standard Peter Sellers Award for Best British Film and was nominated for the Goya Award for Best European Film of 1994. The script was nominated for a WGA Best Screenplay Award and Rita won Best Supporting Actress at the American Comedy Awards. Rita Rudner moved to New York at the age of fifteen to become a dancer on Broadway. She appeared in several shows, including the original productions of “Follies” and “Mack and Mabel.” It was while in “Annie” on Broadway that she began exploring the comedy clubs of Manhattan. In the early ‘80s, Rudner took a full-time leap from chorus lines to punch lines and was soon a regular guest on both Late Night With David Letterman and The Tonight Show. In June 2016 Rita was invited and honored to speak about her career and technique in comedy at Cambridge University, England. In 2017 she was invited by Oprah Winfrey to appear on a cruise to Alaska that Oprah did in partnership with Holland America. In 2018, Rita's tenth TV special was released – A Tale Of Two Dresses. The special also featured Rita and Martin's singer/songwriter daughter Molly Bergman. In September 2018, Rita appeared at the Laguna Playhouse in the new musical comedy “Two's A Crowd.”The show was staged off-Broadway in New York in 2019, and plans were in the works to transfer it to a larger New York theater in 2020 when the Covid pandemic forced those plans to be abandoned. Zig At The Gig with Jared Michael Nickerson of Burnt Sugar The Arkestra Chamber Jared Michael Nickerson is a Grammy-nominated Bold Soul, Rock & Roll Brother from Ohio. He experienced his first taste of live performance at local high school talent shows, one of the”labs” along with the church and basement dens of the legendary Dayton funk scene which spawned the Ohio Players, Slave, Roger Troutman & Zapp, Sun, Dayton, Steve Arrington's Hall of Fame, Faze-O and members of Heatwave. He continued his musical development at the University of Notre Dame under the direction of Father Wiskerchen, (noted for his development of three-fourths of the “Chicago”horn section). After graduating with a B.A. in Business Management, Jared moved to Boston, studied for two years at the New England Conservatory of Music before embarking on his professional music career with a local seven-piece funk band, Hypertension. After six years in Boston he returned to Dayton, Ohio and a year later joined the Cleveland Ohio band The Human Switchboard. After three years of touring the Midwest & East Coast still based in Ohio, he moved with the band to New York City and back-flipped into the local music scene of CBGBs, Danceteria, The Peppermint Lounge, Maxwells ( Hoboken N.J.) and The World. After HS dissolved Jared started his own band JJ Jumpers; joined the Black Rock Coalition becoming the B.R.C.'s first Director of Operations. His first booking was the B.R.C.'s first, two-day, mini-fest at CBGBs entitled “Stalking Heads” on February 11th and 12th,1987. When he departed a few years later the new Director of Operations and BRC East & West Coast Booking Committees had access to rock & roll venues all across the country. Jared has “laid the bottom” for folks such as Nona Hendryx, Wadada Leo Smith, Human Switchboard, JJ Jumpers, Vernon Reid, Marshall Crenshaw, Melvin Van Peebles, Freedy Johnston, Catie Curtis, Ivan Julian, John Paul Bourelly, Katell Keineg, Bernie Worrell, The The, Gary Lucas's Gods and Monsters, Chocolate Genius, Darlene Love, Jeff Buckley, The Yohimbe Brothers with DJ Logic & Vernon Reid, Tammy Faye Starlite and the Angels of Mercy, Pheeroan akLaff, Divine Pocket Bouncers, Cynthia Sley, Dayton Flic, The Raybeats and the Band of Gypsy's Revisited Band. Jared co-wrote a tune, recorded and toured with Charlie Musselwhite. “Sanctuary”, on Peter Gabriel's Real World label, found itself on numerous critic top ten lists and received a Grammy nomination. A suggestion from a mutual friend, led to a call from Greg Tate landing Jared among a number of “Badasses” which included Vijay Iyer and Ronny “Wirepuller” Drayton for a jam session that morphed into Burnt Sugar The Arkestra Chamber. Burnt Sugar Index LLC soon followed with Jared handling all BSAC's business affairs such as arranging an eight-week residency with BRIC studios (The organization that presents Celebrate Brooklyn) to workshop and preview Melvin Van Peebles theatrical version of “Sweet Sweetback's Badasssss Song”. The workshop culminated with three sold-out BRIC performances before BSAC departed for Paris to perform two sold-out performances at the Sons D'Hiver Festival in 2010. Jared, overseeing “bookings” throughout the United States, Canada, France, England, Portugal, Spain, Finland, the Netherlands and Italy, just celebrated his twentieth year as BSAC's CEO last year. He's even “dipped his toe” in tour managing having worked with Concord Records Alt-Folk artist Valerie June including the set-up of her August 21st, 2013 debut television appearance on David Letterman. His television appearances include Late Night With David Letterman, The Jools Holland Show, MTV, VH1, The Tonight Show with Conan O Brien, The John Stewart Show and as bassist with The Kennedy Center Honors BB King Tribute Band; jamming with Bonnie Raitt, Dr. John, Etta James, Joe Williams and Steve Cropper to name a few. You'll find him in Nelson George's “Finding The Funk” documentary speaking about growing up while playing music in Dayton Ohio in the late Sixties. Jared has toured extensively performing at venues such as the Toronto Skydome, Red Rocks, the L.A. Forum, the Oakland Coliseum, England's Brixton Academy, Brighton Dome & Reading Festivals, The Beacon Theater, Lincoln Center and Madison Square Garden. After a successful TV producing career which included co-creating The Daily Show, as well as Emmy and Peabody Awards, Madeleine Smithberg walked away from it all to follow her heart—literally. With a lifelong passion for food, Madeleine did something she'd dreamed of: she kicked off her own cooking show, Mad In The Kitchen, which seamlessly weaves together her love of cooking with her keen sense of humor. During the pandemic, she also moved from New York to Seattle to marry a man she hadn't seen in 20 years, the love of her life who broke her heart back in her twenties. Madeleine also dishes on the early years of producing all those funny cooking segments for Late Night With David Letterman (remember those hilarious ones with Julia Child?); how she persuaded Jon Stewart to host The Daily Show; and how she helped discover several of today's biggest names in comedy like Stephen Colbert and Steve Carell. Mad In The Kitchen has been featured on numerous national outlets including The Today Show. You can view and subscribe to it on YouTube here.

The obesity-related death of his mother was a wakeup call to young, overweight Jeffrey James Binney. He could continue down the same path, or he could change his fate. And so he started running. And running. And running. All the way to the grueling Leadville 100 ultramarathon. Jeffrey’s film Once is Enough chronicles his journey from couch potato to ultramarathoner. Fueled by grief and the desire to write jokes, his film is part documentary, part standup, and definitely unique! Jeffrey and Coach Claire tackle such interesting subjects as why on earth he set his non-athletic sights on doing a 100-mile ultramarathon, how he trained, his plant-based lifestyle, and the scourge of blisters and chafing. If you like your motivation served with a side of laughs, this episode’s for you! Jeffrey is a Salt Lake City based actor, singer, comedian, and "athlete." He grew up on a farm in Laredo, MO before moving to Brooklyn, NY and later Los Angeles after receiving his B.F.A. in Musical Theatre Performance from Missouri State University. Jeffrey has been seen on Late Night With David Letterman, in the 1st National Tour and Chicago Company of the Broadway musical The 25th Annual Putnam County Spelling Bee, and at comedy clubs and festivals across the country. Questions Jeffrey is asked: 5:22 The reason I wanted to have you on the show is because I saw your film Once Is Enough on Amazon Prime this summer with my family. I subject my kids to a lot of documentaries and this is one that they actually liked! Can you tell us a little bit about the movie and why you wanted to make it? 6:42 While sitting in the hospital waiting room, you happened to pick up a copy of Trail Runner Magazine. What happened next? 7:54 Most people don’t go running a 100-miler basically off the couch, let alone the Leadville 100. What were you thinking?!?! :) 9:51 What was it like running the race under-trained and overweight? That must have been a huge challenge physically for you. 11:20 Don’t you have to qualify for Leadville? How did you get into Leadville? 12:26 What was your typical training week like or how did it progress over your 14 months of training? 13:51 How did you change physically through training? 15:23 Speaking of nutrition, you and I have a couple of things in common besides our gorgeous red hair. You and I are both plant-based! How did that fit into your training, your nutrition? What kind of things were you eating? 18:26 Most people think, “Oh, you’re on a plant-based diet. That means that you’re only eating twigs and potatoes and you’re going to be super thin, and clearly that’s not always the case for everybody, right? 19:17 Without giving away too much from the film, what kind of lessons did you learn? Just going through it and the whole filming and making a beautiful movie? What kind of lessons? 20:26 Do you think anybody can do this? 21:03 I would like to talk about the ultra running community. It’s kind of a special group of some very strange and wonderful people. Would you agree? 23:20 The aid stations are much better for ultrarunning, right? 23:40 I would love to talk about gear, like what kind of gear that you were using. 24:19 Do you still wear a bro? 24:49 Every ultrarunner, every runner, has to deal with chafing obviously. How do you deal with that? 26:58 There’s a point in the movie where you talk about your blisters that you had, and how did you deal with that? You look like you were in some serious pain there. 28:10 You manage your blisters better nowadays when you get them? 29:10 What kind of misconceptions have you come across in your running journey? When you started this, you had so much optimism about what this was going to turn out to be. What changed throughout your journey? What things were you surprised about? 31:21 What’s next for you? Are you still running? Obviously, COVID, there’s not a lot of races on the horizon, but what are you doing? 32:36 Some of the smaller trail races are still going on in person, so maybe there’s something you can sign up for that you could actually do in real life. 33:07 You’re still being coached by Ian Sharman, or are you on your own? 34:09 Questions I ask everyone: If you could go back and talk to yourself when you started running, what advice would you give? What is the greatest gift running has given you? Where can listeners connect with you? 36:08 Any new films on the horizon or was once enough? Quotes by Jeffrey: “I just went on a hike a few years ago with some friends to one of the taller peaks here in Utah. I was getting to the top and I was really beating myself up because I just could not keep up with them. And I finally got to the top and I was like, ‘Why are you beating yourself up? You have 100 lbs on all of these people. You don’t come from a lifetime of fitness other than five years.’ And you’d think after this whole journey that I’ve been on that I would be able to keep that in better perspective, but there’s still time like that when I still have to check myself.” “I never considered myself particularly outdoorsy. I certainly didn’t consider myself tough. And it turns out I was wrong. It turns out I am way, way stronger and tougher than I realized.” “Most of the time I was running 20-plus hours per week on top of a full-time job. It’s literally a part-time job.” Take a Listen on Your Next Run Want more awesome interviews and advice? J Chris Newberg is a comedian, writer, and musician that has performed on America’s Got Talent, the Tonight Show, Jimmy Kimmel Live & Comedy Central. Some of your favorite comedians have used his jokes on SNL, Late Night With David Letterman, Chelsea Lately and The Conan O’Brien show. J Chris stops by to talk to Stephen about how he got into comedy (and out of a rock band), what it was like to perform on America's Got Talent and return to roast Piers Morgan, how he got a job on Ben Gleib's "Idiotest" and so much more. Once is Enough, a documentary that depicts the transformational journey of LGBT husky comedian who, after losing his mother to obesity-caused heart disease, sets out to lose 100 pounds and run one of the world’s most difficult 100 mile ultramarathons – and lives to tell jokes about it. Once is Enough will launch on Amazon on May 8th and will soon-after be made available on all VOD platforms via Indie Rights. Part documentary/part stand up comedy, Once is Enough is an award- winning hybrid film following a young overweight comedian, in the wake of his mother’s obesity- caused death, setting out on a desperate mission to avoid the same fate. The first component documents the journey of Jeffrey training for and running one of the world’s most difficult 100-mile marathons, the Leadville Trail 100. The second component is story-based comedy commentary on the journey. The final product, a seamless juxtaposition of these two components, is a heart-felt and inspiring 75-minute journey that leaves the audience cackling through tears. Along the way, the spunky Jeffrey manages to wrangle in the talented Ian Sharman, ultramarathon runner, coach and blogger for iRunFar, who holds the record for the Grand Slam of Ultrarunning and is the winner of the 2013, 2015, 2016 and 2017 Leadville Trail 100, to be his coach. As the marathon provides a much-needed respite from the emotional torment and grief that seemed inescapable, Sharman’s encouragement helps provide Jeffrey with the confidence and determination to keep his eye on the prize. “Having just moved to Los Angeles to pursue a career in film/television/comedy, all I wanted to do is run, write jokes and repeat, “says Binney. “Having shared this with a concerned friend, they suggested that I combine this into one creative project and the light bulb flipped on – Once is Enough.” “Better than any therapy could buy, this project was just ridiculous and grand enough to help me navigate through, and emotionally process losing the most important person in my life. Hopefully, my story helps inspire someone else to seek theirs,” he continues. Jeffrey James Binney is a Salt Lake City based actor, singer, comedian and “athlete.” He grew up on a farm in Laredo, Missouri before moving to Brooklyn, New York and later Los Angeles after receiving his B.F.A. in Musical Theater Performance from Missouri State University. Jeffrey has been seen on Late Night With David Letterman, in the first National Tour and Chicago Company of the Broadway musical The 25th Annual Putnam County Spelling Bee, and at comedy clubs and festivals across the country. Steve Cooper talks with musician Matthew Nelson. Matthew is best know for being half of the popular rock band Nelson. Nelson achieved success during the early 1990s with their double platinum debut album After the Rain, which featured the number-one hit Love and Affection. That album ended up selling more than 3,000,000 copies and as a result the band began a World Tour with over 300 concerts. Every magazine from Rolling Stone to People did cover stories, and Nelson performed on television shows like Late Night With David Letterman and Saturday Night Live. They also did television hosting work for VH1 and E!. They are currently still recording and tour nationally as Nelson and on the shows Christmas with The Nelsons and Ricky Nelson Remembered.

Growing up in Dallas, John Thomasson found the bass guitar the same way many did - a friend started a band and no one else played bass. He attended the Booker T. Washington School for the Performing and Visual Arts, and then the University of North Texas, where he studied music. After that, he was part of a band called Little Sister (later changed to Sister 7) and had some minor radio hits in the 90s. After moving to Austin, John started playing with one of his heroes - Davíd Garza, playing on his first major label record called This Euphoria. In 2000, John got married, quit playing music for the most part and went back to school to get a degree in Psychology and focused on musical cognition. After working some tech jobs at Apple and Hewlett Packard, he wanted to play a little bit more while preparing for grad school. He started recording and touring with Matt Nathanson in 2004, and one of Matt's songs that John played on was "Come on Get Higher", a double-platinum single. Working with Matt also gave him the chance to play on the original Conan O’Brien show and Late Night With David Letterman. After the birth of his first son, John and his growing family moved to Nashville in the fall of 2009. There, he learned about the family-friendly way that Nashville acts toured and that sealed the deal for him. He landed the gig with Little Big Town in April of 2010 and has toured with them ever since. During that time, he also recorded with LBT on numerous successful records, including: Tornado (platinum album) which featured hit singles "Pontoon" and "Tornado", Pain Killer (Platinum album) which including the triple-platinum single "Girl Crush" and gold single "Day Drinking", The Breaker, Wanderlust (produced by Pharrell Williams), and most recently, Nightfall (Self Produced).Spotify playlist of some of John's work:https://open.spotify.com/playlist/0s9wubeza5T6XMKuZNyeED?si=vj4C1X7fTiWhrsQnU7E-MwJohn Thomasson on Instagram:https://www.instagram.com/johnthom/Little Big Town website:http://www.littlebigtown.com/Support the show (https://www.paypal.com/cgi-bin/webscr?cmd=_s-xclick&hosted_button_id=9JCBNUCRNRVKY&source=url)
Today's episode takes a deep dive into the recent 5th Circuit ruling you may have heard about that... is supposed to have declared the ACA unconstitutional? How can that possibly be the case? We break it all down for you. Oh, and yeah, we also talk about the fact that the third president in American history has been impeached. We begin, however, with an Andrew Was Wrong segment about the procedural history underlying the Syed appeal. Then, it's time to break down the 5th Circuit's ACA opinion. How is it possible? How is the case ripe? Wasn't all of this decided in 2012 in the NFIB v. Sebelius case? We explain everything you need to know -- and what you need to know about the future -- in this main segment. Then, it's time to tackle some impeachment questions like, "what the hell is going on?" and "is it true that the President can't be pardoned for crimes over which he's been impeached?" (No.) You definitely won't want to miss this one. After all that, it's time for a brand new #T3BE involving jury instructions during a criminal trial. Can Thomas build on his amazing 1-question winning streak? There's only one way to know for sure! Appearances None! If you’d like to have either of us as a guest on your show, drop us an email at openarguments@gmail.com. Show Notes & Links We tackled the Syed case for the very last time in Episode 340. You can read the 5th Circuit's ACA opinion here. Finally, on impeachment, don't forget to check out (a) Episode 90 where we explain that Trump can probably pardon himself, and also (b) Laurence Tribe's article that changed how the House handles impeachment. Today's episode takes a deep dive into something the Supreme Court didn't do last week -- namely, it declined to grant certiorari to reverse an obviously incorrect decision of the Sixth Circuit (EMW Women's Surgical Center v. Meier), in which that court upheld a blatantly unconstitutional Kentucky law mandating that women undergo a medically unnecessary ultrasound and listen to a script before undergoing an abortion. We begin, however, with a delightful Frozen-themed listener question about the extent of copyright law and whether Josh Gad can start singing songs about how Brett Kavanaugh is a monster. (Hint: this is a fantastic idea.) We truly drill down on all the different ramifications of when you create an original character for yourself versus your employer. After that, it's time for the main sequence deep dive on EMW Women's Surgical Center v. Meier and exactly why it's surprising -- and depressing -- that the Supreme Court declined to grant certiorari in this case. Then, it's time to check in on #T3BE and see if Thomas can get this homebuying question right. Do you get to cancel a sale when the buyer hides water damages, and if so, why? Listen and find out! Appearances None! If you’d like to have either of us as a guest on your show, drop us an email at openarguments@gmail.com. Show Notes & Links If you want to go down memory lane, check out "Larry 'Bud' Melman" advertising "Mr. Larry's Toast on a Stick" from the old Late Night With David Letterman show. You can read the 6th Circuit's opinion in EMW Women's Surgical Center v. Meier, 920 F.3d 421 (6th Cir. 2019) for yourself. The Kentucky law at issue is KRS 311.727. The 4th circuit decision we referenced is Stuart v. Camnitz, 774 F.3d 238 (4th Circ. 2014). Before the Supreme Court, check out (a) the cert petition; (b) the State's opposition; and (c) the petitioner's reply brief. -Support us on Patreon at: patreon.com/law -Follow us on Twitter: @Openargs -Facebook: https://www.facebook.com/openargs/, and don’t forget the OA Facebook Community! -For show-related questions, check out the Opening Arguments Wiki, which now has its own Twitter feed! @oawiki -And finally, remember that you can email us at openarguments@gmail.com!
Paco and George are joined by magician Andy Deemer to discuss both of the Amazing Johnathan documentaries out now: Always Amazing (Steve Byrne 2018) from All Things Comedy and The Amazing Johnathan Documentary (Ben Berman 2019) on Hulu.Whether sawing into his arm with a butcher’s knife or pulling pranks with audience members, The Amazing Johnathan was a reliable source of manic energy at many a ’80s and ’90s stand-up show. The Amazing Johnathan described himself as the “Freddy Krueger of Comedy,” and used that manic energy to regularly catapult his way onto Late Night With David Letterman and Comic Strip Live. His gory, smart and silly deconstructions of magic and coked-up circus geek tricks eventually earned him Las Vegas headlining gigs for a decade or longer. Then, in 2014, he announced that he’d been diagnosed with a serious heart condition, saying doctors had given him only a year to live. The Amazing Johnathan retired, seemingly destined to fade into the annals of cult comedy and the memories of ’80s kids who watched too much cable. But then came the kicker: Johnathan kept on living. And after a while, he grew bored and anxious to return, even if it meant dying on stage. Literally. And this is where both documentaries pick up the story. And the story of the two competing documentaries become a story within the story.Andy Deemer has been a screenwriter, magazine editor, product manager, and now Macaulay Culkin’s personal Magician. We learn all about Andy’s crazy lives while also getting to the bottom of the Berman Vs. Byrne controversy, documentary ethics, and behind-the-scenes info on Jonathan’s condition.Follow Andy on:Twitter: @andydeemerInstagram: @andy.deemerFollow Sup Doc on:Twitter: @supdocpodcastInstagram: @supdocpodcastFacebook: @supdocpodcastsign up for our mailing listAnd you can show your support to Sup Doc by donating on Patreon.

After stratospheric commercial success in the 1980's, Duran Duran had been on a downswing before releasing this seventh studio - and second self-titled - album. They would hit the top 5 once again with what became known as “The Wedding Album” due to the album artwork showing wedding pictures from the band members' parents. This album was a comeback and reinvention of the group for the 90's. It has a wide variety of sounds and tempos, but maintains the distinctive harmonies for which Duran Duran was known. Join us a Rob takes us through this excellent album. Too Much Information This rocking track starts the album, and gives a sense of the information overload that was just beginning in 1993. While there was a sense of the old Duran Duran at times, The Wedding Album really serves as a reinvention of the group. Love Voodoo This is a more club/dance-oriented track in a minor key. Duran Duran became superstars on the strength of MTV as "new romantics." Shelter This has a James Bond feel, and is a good song to hear with headphones. It continues the dance feel with interesting percussion crashes and vocal effects. ** Ordinary World This is the first single released from the album, and it hit number 1. Much slower than the dance oriented tracks, this shows some of the diversity of the album. The single was released several months in advance of the album. ENTERTAINMENT TRACK: Theme from “The Late Show with David Letterman” March 1993 marks the start of David Letterman on CBS after being passed over for host of The Tonight Show on NBC in favor of Jay Leno. STAFF PICKS: “Blood and Thunder” by Ultra Vivid Scene Wayne showcases a hidden gem with a southern rock feel. Kirk Ralske was the driving force behind this alternative rock band. “Pride and Joy” by Coverdale Page Bruce's pick highlights a rock/blues track by the supergroup formed by Whitesnake's David Coverdale and Led Zeppelin's Jimmy Page. “Romeo” by Dolly Parton and Friends Brian crosses over to the country genre with a supergroup including Mary Chapin Carpenter, Pam Tillis, Tanya Tucker, Kathy Mattea, and Billy Ray Cyrus. “Two Princes” by The Spin Doctors This song hit number 7 on the US tracks, and the highest international charting song for the group. The syncopated percussion was typical of 90's alternative rock. Believe it or not, the Spin Doctors performed a special version of this on Sesame Street. COMEDY TRACK: “Come to Butthead” We finish off this session with a comedy song based on MTV's "Beavis and Butthead" cartoon created by Mike Judge. “SCHUTTUP BEEVITH!”
Dave Leslie of Baby Animals joins Eric in conversation to take a track by track look back at their self-titled 1991 debut album. Recorded at Bearsville Studios in New York, the Baby Animals album was produced by Mike Chapman, it went eight times platinum in Australia, spawned five highly charting radio friendly rock hits (Rush You, One Word, Ain't Gonna Get, Early Warning, and Painless), won tons of ARIA awards and various accolades and sat as the highest selling Australian debut rock album for well over a decade. In the United States, their single Painless was picked up by MTV and put into heavy rotation, they appeared on Late Night With David Letterman, and toured the country opening for Van Halen. Unfortunately, a faltering record label and distance would prove to be major obstacles for growing success in the United States unfortunately. If you're familiar with Baby Animals, you'll enjoy this in-depth discussion of their legendary debut. If you're new to the band, hopefully you'll listen and discover a truly solid rock album from 1991 that you may have missed the first time around.

Gang! Behind every genius, there's another genius with a vagina. This week's guest is the legendary MERRILL MARKOE, friend to dogs, hilarious novelist and essayist, and the woman who created so many important television comedy things, it's overwhelming. Listen as Julie chats with Merrill about her contributions to the original LATE NIGHT WITH DAVID LETTERMAN, her new dog Wally, Laugh-In 2, and many more wonderful things you will delight to hearing about from somebody as intelligent as Markoe. Hooray for her! Also! Julie went on the HELTER SKELTER death tour while she was still in LA, and she has a very long, extensive story about it. Sorry. A lot of the monologue is just that. But there is also talk about Jim Henson's Creature Challenge on SyFy, Dave Barry's daughter and his desire for her to never be made love to, the latest dumb prop in HOUSE OF CARDS season 2, and how weird it is to get used to not hearing the Doors playing all the time now that Julie is back in NYC. Mister MOJO RISING!
