First, Sam and Emma run through updates on Trump/Elon's abject refusal to follow court orders, the release of the White House Ethics Czar, the repeal of a ban on bribing foreign officials, the DOJ dropping its case against Eric Adams in an open case of blackmail, Trump's gutting of the CFPB, Oregon Nurses' ongoing labor battle, IRS and ICE, Mike Johnson's Budget, and Hegseth's revival of Fort Bragg, before diving a little deeper into the open insanity of the ongoing collusion between Eric Adams and the Trump Regime. Gil Duran then joins, diving right into the concept of the Network State – an idea advanced by Big Tech's thought leader Curtis Yarvin and his billionaire buddies (Thiel, Andreessen, Musk, etc) that Tech CEOs should take advantage of the collapse of Nation States and democracy in favor of establishing corporate, CEO-run dictatorship, either by gutting and replacing existing governments or purchasing sovereign territories – as Duran unpacks his first introduction to this ideology with Silicon Valley's attempt to hijack San Francisco's political institutions, before parsing a little deeper through the recent, much more public discussions of this theory advanced by the likes of Peter Thiel, Marc Andreessen, and Curtis Yarvin. After expanding on how we are already seeing the blueprint for a Network State in action, with Trump serving as a figurehead to a Tech CEO's gutting of our administrative and democratic institutions in favor of sycophants and centralized power, Duran looks to how this came to be the active ideology of the GOP so quickly, unpacking how the collapse of the Biden campaign and naming of JD Vance as Trump's VP opened up an opportunity for the Big Tech to step in, starting with Elon's massive public $300m investment and culminating in Yarvin's Reboot conference in San Francisco last September, exploring the obvious parallels between Big Tech's dictator obsession and the GOP's white nationalism and parsing through their unified scapegoating of “woke” and “DEI” in the leadup to the election to the point of completely dominating both mainstream and social media (bolstered by the financial leverage and ownership Big Tech has over those institutions). Next, Gil, Sam, and Emma unpack the major challenges facing the Trump-Musk regime, as Trump is on his last legs with no other favorable alternative in sight while any failure to maintain control over both political and media institutions potentially meaning a complete upending of their “progress,” not to mention the obvious lack of preparedness (or ability) for this institution to deal with any real public or institutional opposition – the latter of which seems to be particularly hopeless among Democratic leadership – wrapping up by emphasizing the genuine insecurity this regime faces in the face of public scrutiny and touching on the potential danger of Big Tech's goal of replacing the US Dollar with Bitcoin. Sam and Emma speak with Anne Kim, contributing editor at Washington Monthly magazine, to discuss her recent book Poverty For Profit: How Corporations Get Rich off America's Poor. First, Sam and Emma run through updates on Trump-Harris polling, the fight over Harris' platform, continuing Israeli escalation in the Middle East, Russia's offensive, Iowa's abortion ban, Venezuela's election, environmental crisis, and the passing of Lewis Lapham, before parsing a little deeper through the GOP's panic over Trump's VP Flub with JD Vance. Anne Kim then joins, diving right into the role of one Emanuel Savas in publishing and popularizing the drive to privatize government services in their totality, pushing the budding neoliberal belief in the efficiency of the market, and successfully pushing his ideology all the way to the White House with the election of Ronald Reagan, before stepping back to look at what these social services entail – everything from prison to air traffic to healthcare – and how much of the US economy they make up. Expanding on this, Kim explores how the privatization of these social services aimed at impoverished communities results in astounding failures on the supply side, using examples from earned income tax credits, job training and the Job Corps, Medicaid/Medicare and Dialysis, and Section 8 Housing to demonstrate how the privatization of these services allows for easy capture of the market by for-profit providers, and results in exploitative institutions that push bad products onto people with little to no other choice. After tackling some of the more devastating material impacts of these failures of neoliberalism, Kim, Sam, and Emma wrap up by tackling the major ideological shift that is needed in US politics to rethink how and why we provide social services. And in the Fun Half: Sam and Emma unpack Israel's continuing war crimes in Gaza, shifting rhetoric on Israel in the West, and Jimmy Dore's insane take on why Trump is the true pro-Palestine candidate. He is accused of fatally shooting 23-year-old Dacari Early at an apartment complex in March. Nash allegedly shot Early multiple times with a Glock 43X handgun following a verbal dispute. He was arrested the day after the shooting in Rome, and is currently incarcerated there. Nash faces charges of malice murder, felony murder, aggravated assault, and possession of a firearm during the commission of a felony. He also has additional charges from Floyd County and holds from the Cobb and Hamilton County sheriff's offices......stay up to date on this story at mdjonline.com     Story 2: 95 units   A developer is seeking approval from the Smyrna City Council to expand a previously approved apartment complex by adding 95 units. The Creekside Towers development, located off South Cobb Drive, plans to increase the unit count from 200 to 295. While the building's height would remain the same, the space for amenities would be reduced, and additional underground parking would be included. The city planning staff and planning commission have recommended approval of the application. If approved, construction is set to begin in winter, and the tower would consist of various unit types. The developer has also pledged to reserve four units at reduced rates for city first responders.     Story 3: council   The City Council is set to vote on appointing Kathy Young to represent Ward 7 for the remainder of 2023. The vacancy in Ward 7 was created when Lewis Wheaton resigned after moving out of his ward. Mayor Derek Norton and council members have expressed support for Young's appointment. Young, a part-time college and career adviser at Campbell High School, has a background in economic development and civic involvement. The city charter mandates the filling of the vacancy, and the process for a special election was discussed but deemed impractical. Young's appointment will be determined in the upcoming council meeting.   We'll be right back   Break:   ESOG– Dayco - Elon   STORY 4: seniors   The nonprofit Senior Citizen Council of Cobb County organized the Free Resources for Seniors Expo at the Acworth Community Center. The event aimed to connect seniors with no-cost or low-cost services to enhance their lives. Booths provided information on various topics such as hearing impairment, mental health services, power bill discounts, Medicaid/Medicare fraud, home sharing, and senior independent living homes. The expo allowed seniors to ask questions and gather valuable information from professionals without being solicited. The Senior Citizen Council of Cobb County serves as an advocacy group for seniors in Cobb County, collaborating with the county government and providing programs and events.       STORY 5: mccoy   County Administrator Michael McCoy was reportedly fired by four members of the Dougherty County Commission due to allegations of population loss and failure to attract major manufacturers to the county. However, many skeptical individuals believe there are deeper reasons for McCoy's dismissal. McCoy had previously demonstrated exceptional performance as manager of the county's landfill and had gained respect from state officials and county employees. However, an incident in 2018 involving County Commissioner John Hayes and McCoy during an educational field trip resulted in controversy. McCoy filed a lawsuit against the county, claiming a hostile work environment, which was settled out of court. Other incidents involving the commissioners' actions and expenses have also emerged. These incidents have led to speculation about the true reasons behind McCoy's dismissal. Attorney General Chris Carr's office has asked for an explanation from the County Attorney, and is looking closer at this case.   Story 6: cannabis   Trulieve Cannabis Corp., a medical cannabis dispensary, has introduced fast-acting nasal spray products to its lineup. The nasal spray allows for quick absorption of low-THC cannabis into the bloodstream, making it beneficial for patients with epilepsy and severe Parkinson's disease. Trulieve offers different types of the nasal spray using indica and sativa cannabis subspecies, each producing different effects. The spray comes in various sizes and prices, ranging from $35 to $120. Trulieve's Marietta location has seen steady business since opening, with customers expressing relief from using their products. He was awarded a $500 scholarship to support his Catholic high school education. Additionally, Paige Cunningham received the inaugural KofC Rising Star Scholarship from St. Joseph Catholic School. The athletic director, Matt Williams, expressed his pride in this achievement, emphasizing the importance of building relationships with students, families, and the community. The school promotes character development and encourages participation in community service. North Cobb also offers a class on sportsmanship and emotional expression for coaches and athletes. Positive Athlete, founded by Hines Ward, awards college scholarships to high school student-athletes. Additionally, several student-athletes and coaches from various schools in Cobb County were honored for their positive attitude and leadership.   Story 9:  Walker   Charlie Condon, a first baseman/outfielder for the Georgia Bulldogs baseball team, has been invited to the USA Baseball Collegiate National Team summer training camp. Condon, a native of Marietta, will compete with other college players for a spot on the final 26-man U.S. roster. The camp will include 56 top non-draft eligible college players and will feature a four-game intrasquad series in North Carolina. Condon, who had an impressive season, was named a semifinalist for the Golden Spikes Award and the Dick Howser Trophy. He was also honored as a second team All-American by Collegiate Baseball and named SEC Freshman of the Year. Medicaid is a valuable federal program that primarily applies to nursing home and in-home care. The law is open to some interpretation by individual states, so it's important to consult professionals you can trust to guide you through the legal and financial complexities of the program. Jeffrey R. Bellomo, founder of Bellomo & Associates, is a licensed and certified elder law attorney with a master's degree in taxation and a certificate in estate planning. Did you know that September is National Preparedness Month? So in this episode of Talking with the Toothcop, we share some quick tips your practice can follow to be prepared—for whatever may come. Quick tips for emergency preparedness What are some easy things you can do to prepare your practice for emergencies?  Check that emergency lighting (exit signs) are working properly if there's a power outage. Check your fire extinguishers and make sure they aren't overdue for inspection. The fire department can do—and will sometimes just walk in—fire extinguisher checks for you. Check your smoke detectors and change the batteries regularly.  Make sure that you perform an annual emergency drill. Have your staff put their John Hancock on a sign-in sheet and keep documentation proving you completed training. If it ain't written, it didn't happen. Get out your medical emergency plan and review it with your staff. Make sure that you walk through every part of the process (except calling 911).  Take advantage of Slowtember September is a slow month for many dental practices, so make sure—if you haven't already—to get your compliance training knocked out. Cover bloodborne pathogens, HIPAA, cybersecurity, etc. If you participate with Medicaid/Medicare, you'll also need to do your Fraud, Waste, and Abuse training.  Take a few minutes to review everyone's credentials and make sure they're up-to-date. You should check CPR certifications, DEA registrations, sedation permits, even your driver's license and vehicle registration. I’ll tell you what I wanted to figure out: How does care improve in SNF (skilled nursing) or assisted living facilities? My starting point in contemplating a possible path toward this goal was advanced primary care. There is so much talk and evidence these days about advanced primary team-based care and how much patients like it, the low-value care it could potentially prevent downstream, and the patient outcomes it can create. But in general, these advanced primary care models are talked about for patients in the community, not really for the intensely vulnerable populations inside facilities. So, where do these worlds collide if they do, in fact, collide? In this health care podcast, I’m speaking with Grace Terrell, MD. Dr. Terrell is a practicing general internist. She is also chief executive officer of Eventus WholeHealth, which is a company that is focused on medical care for medically vulnerable adults, specifically those who live in skilled nursing facilities, assisted living facilities, or reside at home and cannot make it into clinics or otherwise get care. Dr. Terrell and her team at Eventus have done some really powerful work bringing this kind of advanced primary care model, whole-person integrated primary care, into long-term care facilities; and she shares some of the promising results of doing so during our conversation. One point that Dr. Terrell made, which I found really interesting—maybe not in a good way—is that in an FFS (fee-for-service) world, there is really zero financial incentive beyond consumerism to improve care. Skilled nursing facilities get paid a set of Medicaid/Medicare rates, and that’s it, whether the facility is awesome or it kind of sucks. In this conversation, we also get caught up on the latest goings-on in the post-acute and assisted living parts of our industry, which, of course, were decimated by COVID pretty much bashing it from all directions. Add to the challenges of 2020 the general truth that SNF and assisted living care for years has been chronically underfunded and highly regulated in ways that aren’t super productive of better care in many cases. Bottom line: There’s a lot of work that needs to be done so that all of us have the best chance of great holistic medical care when we’re older. The OIG’s Focus on Compliance [CIAs Part II]

In the last episode, we talked about what a corporate integrity agreement is and what compliance programs should look like. In this episode of Talking with the Toothcop, we continue our series on corporate integrity agreements by looking at the OIG’s Focus on Compliance roundtable discussion. If you participate with Medicare or Medicaid, you HAVE to pay attention to this.  Outline of This Episode [3:23] Corporate Integrity Agreements [5:21] The focus on compliance document [8:59] The board of directors [10:53] The role of the internal audit [11:26] Claims review requirements Corporate Integrity Agreements  Just to recap, according to the OIG, a corporate integrity agreement is “Part of the settlement of Federal health care program investigations arising under a variety of civil false claims statutes. Providers or entities agree to the obligations, and in exchange, OIG agrees not to seek their exclusion from participation in Medicare, Medicaid, or other federal healthcare programs.”  A CIA usually remains in effect for five years. If you don’t agree to this, you lose the ability to participate in federally funded programs. If Medicare or Medicaid represent a large cross-section of your business, you could lose your business by losing the ability to work with them. It’s a large reason why organizations agree to CIAs. CIAs have evolved into what they are today.  Focus on Compliance: The Next Generation of Corporate Integrity Agreements In 2012, the OIG held a roundtable discussion with stakeholders with entities and organizations that were under an active CIA to get feedback. The goal was to tweak CIAs to make them more effective to organizations.  In this discussion, the CIAs required each participant to have a code of conduct setting forth their commitment to compliance. They also had to implement policies and procedures governing the compliance program and adherence to program requirements.  A code of conduct is a great foundation for a compliance program and establishing policies and procedures. Your written policies and procedures should address each of your risk areas. The OIG now leaves it up to the organization to identify what topics you need further training on based on the CIA. So they’re moving away from an hours-driven training program to topic-driven. The government is responding to and taking feedback on some of their requirements.  The board of directors involvement  We do work with some dental partnership organizations and DSOs. CIAs require that the board of directors also receive training, reports from the compliance officer, and pass an annual resolution certifying the board is overseeing the compliance program.  The board’s responsibilities result in more engaged board members, which assists in the allocation of resources to mitigate risk. An engaged board motivates executives and healthcare providers to commit more fully to compliance.  I spend a lot of time working actively with boards and compliance committees and I see this. It takes a few meetings to see people get why it’s necessary. Once things click, I become more of a silent presence and less of the person leading the charge. This is how it should be.  What is the role of an internal audit? Why is it so important? Listen to learn more! Claims review requirements Most CIAs require the provider to conduct a discovery sample of 50 paid Medicare claims randomly selected from those submitted by the provider during a specified 12-month period. If the error rate is 5% or greater, the provider must conduct a full sample systems review—which is far more involved.  When an organization is under a CIA, they have to maintain an error rate of less than 5% in their audits. Based on my experience, this is difficult to accomplish. I’ve been doing record audits for over 10 years and the average error rate is north of 15%. Why? Because auditing processes aren’t in place and people don’t go back and check for mistakes. The average dentist thinks they don’t make that many mistakes, but unless you do audits and have definitive proof, you don’t know. If you’re playing the Medicaid/Medicare game, you’ve got to know that your error rate is below 5%.  You’re not expected to have a full-time compliance officer in place—but you are required to have auditing and monitoring processes in place. So if you’re a small dental office, you must pull and audit at least 50 coding and billing records a year.  Need help with this process? Mark deClouet of Axis Behavioral Health & Recovery, a Board Certified Family Psychiatric Mental Health Nurse Practitioner, joined Jan Swift to discuss the rise in fatal opioid overdoses in the Acadiana area. Drug dependency has impacted people from all walks of life, flying in the face of the stereotypes of those who succumb to addiction. Envision your grandmother breaking her hip at the age of 73, being prescribed opioids for the first time in her life, and becoming addicted to painkillers. People who end up with Substance Use Disorders may experience chronic relapsing conditions unless they can access appropriate behavioral health and medical treatment. With the push against Big Pharmaceutical companies who have profited from addiction and the mandate on doctors to reduce their prescriptions of painkillers, as people suffer from withdrawals they have turned to street drugs such as heroin which may be laced with the deadly fentanyl. These drugs are easily accessible and much more affordable than prescription drugs. Some local numbers on our rising rate of overdoses: According to current information from the Lafayette Parish Coroner’s Office, 57 people overdosed in 2019 compared to 46 in 2018 and 43 in 2017. From January through May 2020, there were 23 overdoses, with 18 of those deaths being attributed to opioid overdoses. The 70508 zip code had more overdose deaths than any other zip code in the parish this year — and more overdose deaths in that zip code within the first five months of 2020 than all of 2019. Alarming, more people die of drug overdose in Louisiana than by firearm or homicide. In 2018 nearly 40% of the 1,140 reported drug overdose deaths in Louisiana involved opioids —a total of 444 fatalities. What may be causing this rise in overdose-related deaths? With the COVID pandemic shutdown, many people in recovery have not been able to access fellowship meetings with others who share their struggles. The required social distancing measures have raised a great challenge as people lose the means to stay in touch with their community. Many of us depend on the support of others and have been raised in a culture where we are not only exposed to continuous parties and festivals, but we are not accustomed to being socially isolated for long periods of time. In light of the rising number of local overdose deaths and the struggle to access quality treatment programs for addiction in the region, Mark deClouet opened a second location of Axis Behavioral Health & Recovery in the Oil Center (the first being in Alexandria, LA). The Axis team uses buprenorphine, a specific treatment modality approved by the Food and Drug Administration, to treat opioid use disorder. Buprenorphine competes with opiates for the same receptors that opiates bind with, the ones that give a feeling of euphoria. This chemical bond is stronger than the one of the opiates; if a person happens to relapse while on the drug, they will not experience the effect of the opiates. This has been found to keep people in recovery and deter people from falling further into the throes of addiction. Additionally, you can't overdose on buprenorphine (if it is taken alone). deClouet explained that most individuals with Opioid Use Disorder (OUD) still do not have access to or receive any form of medications to combat their addiction. Even though the approved drugs are covered by Medicaid/Medicare and all insurance companies, clinicians typically prescribe buprenorphine on a cash-basis only as they are not reimbursed at a cost-effective level. As the drugs cost $250 to $300 per month, people have to choose between taking care of their children, paying the light bill, buying groceries, or treating their addiction out of pocket with cash they don't have to spare. As you might surmise, they choose to take care of necessities and end up right back in treatment in a few months after relapsing.

Listen NowAs has been widely reported the US spends upwards of twice what other OCED countries on medical care however with worse or similar outcomes.  What explains this is in part the fact the US spends about one-third of what other OECD countries spend on social services such as food aid, housing assistance and transportation.  This despite knowing research shows basic measures of health are more closely and positively associated with social service spending.  “It's hard to escape the conclusion,” a 2016 Brookings Institute op-ed concluded, “that we should gradually be redirecting a lot of money from medical series to so-called upstream factors [or social factors] that are associated with health.”  This was precisely the same conclusion drawn by a recent/September National Academies of Science's (NAS) consensus study titled, “Integrating Social Care Into the Delivery of Health Care.”  The NAS report concluded health care be redesigned to integrate social care into health care and that financing of health care integrate social care spending. During this 30 minute conversation Mr. Palmieri briefly discusses CCA's business lines, moreover its One Care its Senior Care Options health plans that serve Medicaid-Medicare  beneficiaries (so called "Duals") and Medicare beneficiaries under a a Special Need Plan (SNP) designation.  He discusses how his patient population is recruited and moreover CCA's  whole person care approach, accomplished in part via care navigators, that includes providing CCA's patients with social service supports, e.g., CCA's medically tailored meals plan and its mobile integrated health program.  He also discusses how CCA care is financed and the spending efficiency CCA care achieves.  He concludes with a brief description of CCA's WinterStreet Ventures, a CCA affiliate that pilots/develops innovations in care delivery. Mr. Chris Palmieri has served since 2015 as President and Chief Executive Officer of the Massachusetts' Commonwealth Care Alliance (CCA).  Immediately prior, Mr. Palmieri served as the CEO of Remedy Partners, a bundled payment organization.  Prior still, Mr. Palmieri worked for ten years with Visiting Nurse Service of New York (VNSNY), as President and Chief Executive Officer of VNSNY Health Plans where he developed a $2 billion safety-net insurance organization.   Mr. Palmieri has also held senior positions with Amerigroup Corporation, Metropolitan Jewish Health System, Inc., and Faxton-St. Luke's Health Care/Mohawk Valley Network.  In 2012, Chris was named one of Crain's New York “40 Under 40,” a distinction for the top business leaders.  Mr. Palmieri currently serves as the Chair of the Association for Community Affiliated Plans (ACAP), and the Vice Chair of the national Managed Long-Term Services and Supports (MLTSS) Association.For more information on CCA go to: http://www.commonwealthcarealliance.org/. The Brookings' op-ed is at: https://www.brookings.edu/opinions/social-spending-not-medical-spending-is-key-to-health/.The National Academy of Science report, again titled, "Integrating Social Care in to the Delivery of Health Care," is at: http://nationalacademies.org/hmd/Reports/2019/integrating-social-care-into-the-delivery-of-health-care.  This is a public episode. • Are all consumers the same? • Deloitte/ Four Consumer Classifications • Trailblazers o Younger, higher income, excellent health, more men, use report cards of doctors, hospitals, will change doctors if dissatisfied • Prospectors o 2nd youngest group, high income, men=women, open to wearable tech & virtual office visits, use quality ratings • Homesteaders o 2nd oldest, low income, women>men, not open to tech, avg. wellness, convenience > OOP, don’t change providers • Bystanders o Oldest, poorest, women > men, not open to tech, avg. wellness, don’t share info with doctor, least likely to follow healthy diet, choose doctor on OOP and convenience • Why are we talking about this? o If consumer can pick their health care option, then who are the consumers, i.e., what types do they fit? o What do they want? o With Congress and the States trying to model health care as ACA or an alternative, then what patient types should they consider? • In actuality, the US already has a multi-tiered health care system – o Healthy, young people can buy commercial insurance or not o Poor people and children have Medicaid or County hospitals/clinics for caring for the poor and uninsured o General Public has the ACA o Older people have Medicare o Injuries have Workers Comp • If we use the Deloitte Consumer Classifications, then we have one method of classifying different patient types. • For other than Medicaid/Medicare, Workers Comp, and Commercial Insurance, the law of large numbers prevails. To provide insurance for people with pre-existing conditions, healthy and sick people must participate.
