    As Andrew puts it, Chief Justice John Roberts is “cherry-picking.” He's flying solo in this short edition of Main Justice (more to come with Mary in the next episode). Andrew gives a quick briefing on several of the Supreme Court's most consequential end-of-term rulings, starting with the decision not to hear an appeal in the E. Jean Carroll case. Andrew also touches on the Court's decision to uphold a Mississippi law to allow mail-in ballots that are sent by Election Day to be counted but saves his deepest analysis for two similar cases with opposing decisions: the firings of Lisa Cook and Rebecca Slaughter. While the Court ruled that the Trump administration must have cause to dismiss Cook from the Federal Reserve, it allowed the government to fire Slaughter from the Federal Trade Commission, a decision which Andrew calls deeply flawed showing the conservative majority's support for a “unitary executive.”  And finally, Andrew breaks down the Court's narrow decision to uphold birthright citizenship, and why the tight 5-4 split is the story. The acceptable type of racism is the kind which considers it fine and normal to drop bombs on Muslim families overseas. The kind which sees starvation sanctions as a minor issue whose pros and cons are assessed solely on the basis of whether they will be successful or unsuccessful in achieving regime change. The kind which views imperialist extraction from the global south as the natural order of the world, with centrists and progressives squabbling only about how evenly that plunder should be distributed among westerners. The unacceptable type of racism is the kind which affects other westerners. The kind whose consequences western liberals have to see. Reading by Tim Foley.

    There's a lot on the docket today. To pull apart the Iran “deal” framework, Mary and Andrew are joined by Tess Bridgeman, an international law expert who served as a legal advisor in the Obama administration through the 2015 nuclear deal with Iran. Tess lays out how President Trump's 14-point memorandum of understanding differs from what was brokered in 2015, and what to watch for as negotiations continue. Before she joins, the co-hosts begin by analyzing several examples of what Mary calls the Trump Justice Department's "consistent effort” to avoid judicial review: their refusal to put into a sworn declaration that they won't move forward with the “Anti-Weaponization” fund and a motion to dismiss a Clean Air Act violation lawsuit against Elon Musk's xAI data center in Mississippi. They also tackle a few instances where, contrastingly, the government has positioned itself “on the offense” this week, including an indictment of 15 protesters on a conspiracy charge against ICE and the DHS' intent to build a border wall through a holy landmark atop Mount Cristo Rey in New Mexico. Alexander has a living White mother and a deceased Black father. Despite 15 years of institutional celebration for her work, Gus T. anticipated this title being one of the "5 Worst Books Ever." History shows that racists generally do not promote literature that provides an accurate understanding of the System of White Supremacy. Deception by Omission & Respectability Hypocrisy: A serious exploration of prisons and Racism must account for the systemic forces that built them. This week, we expose the staggering double standard at the heart of Alexander's narrative as she wades into the murky waters of respectability politics and cultural policing. Last week's review included: 1. The Cosby Contradiction & Elite Scolding: Alexander mocks the media for fawning over Bill Cosby's stern lectures to Black audiences about personal responsibility. Yet, in the very next breath, she launches into her own academic "Pound Cake speech"—scolding black youth for "raunchy" hip-hop music, "decadent" culture, and sagging britches, pathologizing the community from her elite Stanford high-horse. 2. The Muted Terror of Jon Burge: While Alexander takes considerable time to discuss Chicago's carceral system in analytical detail, she practices a complete, sinister silence regarding police commander Jon Burge. She refuses to write one mumbling word about his decades-long campaign of racist torture, systemic black misandry, and the state-sanctioned genital mutilation of Black males. 3. The Death of "Colorblindness": By completely erasing Burge's violent, targeted torture ring out of the South and West Sides of Chicago, Alexander protects her fraudulent thesis.     On today's show, host Esty Dinur celebrates Juneteenth, “America's second Independence Day,” with Dr. Timothy Golden. They talk about the symbolic importance of this federal holiday and how the US still struggles to make freedom meaningful for Black people. Juneteenth was made a federal holiday in 2021 after decades of campaigning by former teacher Opal Lee. Dr. Golden says that Juneteenth becomes “hollow” when we juxtapose the recognition of emancipation with Congress's inability to pass meaningful police and voting rights reform. The spirit of celebration is “neutralized” by the treacherous and tragic reality that enslaved Black people in Texas were kept enslaved after emancipation and the bad faith of our federal institutions who will not pass legislation that would support symbolic celebrations like Juneteenth.  In the wake of emancipation, Dr. Golden says that we think of freedom too narrowly. He points to the work of Reconstruction that was ultimately undercut in the way that racial terror continued under state law. He says that full democratic participation continues to be deferred for Black Americans because of mass incarceration and voter suppression. They also discuss Dr. Golden's experience as an actor, the “white gaze,” and the philosophy of Ida B. Wells.  Timothy J. Golden is Visiting Professor of Philosophy at Whitman College in Walla Walla, WA. His areas of philosophical specialization are Africana Philosophy (African American Social and Political Thought, Critical Race Theory, and Black Male Studies), Philosophy of Religion, and 19th and 20th Century European Philosophy. His books include Frederick Douglass and the Philosophy of Religion: An Interpretation of Narrative, Art, and the Political (Lexington Books, 2022), and Racism and Resistance: Essays on Derrick Bell’s Racial Realism (State University of New York Press, 2022).      Stand-Up to RacismThe bullet holes from the August 1969 sectarian pogrom against the people of the Falls area are still visible on the front wall of St. Comgall's Primary School, Divis Street. Last Thursday lunchtime, a few yards from where, on that occasion, whole terraces of houses were burned out, scores of community activists from across Belfast came together in Ionad Eileen Howell to discuss another pogrom. This time the pogrom was rooted in violent racism.In the days before families and workers from the various ethnic groups, who now make up an important and valued part of our society, were attacked, threatened, and some were forcibly evicted from their homes. In harrowing scenes cars and some homes were destroyed as masked thugs roamed the streets of parts of Belfast, Portadown and Glengormley attacking the PSNI and the homes of our neighbours. Terrified children fled with their parents.Health workers were especially targeted. There was a clear attempt to intimidate many from their jobs. In addition, schools were closed. People were sent home from work. Public transport stopped.The Community Groups at the meeting in Ionad Eileen Howell described how they had helped relocate evicted families, worked with Belfast City Council to ensure that emergency accommodation was available, established a co-ordination and response group and had activists on the streets to defuse any attempt by right wing elements to stoke up further attacks. From the GAA and individual citizens there was widespread opposition to the racism. First Minister Michelle O'Neill met community representatives, youth workers and ethnic minority communities. She visited health staff in the Mater Hospital who had been threatened. She expressed her unambiguous solidarity and support for them.Belfast Ard Mheara Councillor Róis Máire Donnelly, who received death threats for standing up to the racists, refused to be silent. Last Friday she addressed a local anti-racism rally and the next day she spoke to the thousands who attended the massive anti-racist demonstration at the City Hall. Róis Máire told the crowd that Belfast is “stronger” because of our diversity. And she described Belfast people as “resilient, compassionate and welcoming.”She is right on both counts. Diversity is a strength, not a weakness. And notwithstanding the naysayers and begrudgers Belfast is welcoming city that embraces our ethnic minority citizens.  Momentum Building Around UnityThere are those who dismiss any possibility in the next few years of holding the unity referendums provided for in the Good Friday Agreement. Foremost among them is Fianna Fáil leader Micheál Martin who obstinately refuses to countenance any preparation for unity.However, his partner in Government, Fine Gael leader Simon Harris clearly doesn't agree. At the weekend he announced that his party is planning to develop and publish a blueprint for a united Ireland by their Ard Fheis in November. That is good news. Harris's statement of intent coincides with Uachtarán Shinn Féin Mary Lou McDonald's introduction this week in the Dáil of a Private Members Bill that will compel the Taoiseach to begin the planning and preparation for constitutional change and Irish Unity. The ‘Planning for Constitutional Change Bill 2026' will require the Taoiseach to institutionalise preparation and publish a Green Paper. This will facilitate consultation and encourage a national public debate as a first step before formal government legislation is established. The Green Paper will require the government setting out its ideas, vision and proposals on the economy, education, health, justice and the legal system and future governance arrangements.  Seeking the Truth: Pat FinucaneAfter 37 years the inquiry into the murder of human rights lawyer Pat Finucane has finally opened. Pat's wife Geraldine, his children John, Michael and Katherine and his dedicated family circle and legal team are to be commended for their diligence and steadfastness in pursuing the truth about Pat's murder.Successive British governments have lied, prevaricated, distracted, delayed and made every effort to prevent an inquiry from happening. Why? Because the extent of British state collusion with the UDA in his murder has the potential of laying responsibility for his death with senior political figures within the British Conservative government of Margaret Thatcher.That there was collusion in his murder and that of hundreds more, is not in doubt. But who was responsible? Who gave the orders? Who plotted and schemed to have Pat killed on 12 February 1989? Who knew what within the RUC; within RUC Special Branch; within MI5; the Force Reconnaissance Unit (FRU); British Army; and the British Cabinet?

It was also before the PSNI warned the Belfast Ard Mheara that her life was in danger. It has been a difficult week especially for those citizens evicted from their homes. We stand in solidarity with them. Racism is the first cousin of sectarianism. The majority of people are opposed  to both these negative evils.     The Katherine Massey Book Club @ The C.O.W.S. hosts the 9th session on Michelle Alexander's The New Jim Crow: Mass Incarceration In the Age of Colorblindness. Alexander has a living White mother and a deceased black father. Despite 15 years of institutional celebration for her work, Gus T. anticipated this title being one of the "5 Worst Books Ever." History shows that racists generally do not promote literature that provides an accurate understanding of the System of White Supremacy. Deception by Omission: A serious exploration of prisons and Racism must account for the systemic forces that built them. This book's failure to center COINTELPRO, the torture legacy of Chicago's Jon Burge, or the raw profitability of caging Black men suggests Alexander is guilty of a whole lot of lying. This week, we dismantle the sheer absurdity of Alexander's "Passing" analogy. She explicitly equates a Black worker maintaining basic professional boundaries at an office job to a light-skinned Black person cutting off their family to "pass" as White under Jim Crow. We expose how this completely irrational logic reinforces the significance of her biracial background—revealing a detached, elite perspective that pathologizes normal Black workplace survival tactics. We also pull the receipts on her consistent pattern of selective framing. Alexander repeatedly highlights interviewees who struggle with the King's English, curse, and are framed as illiterate or incompetent—inadvertently validating the exact racist stereotypes that suggest Black people don't deserve justice.
