Hace unos días, el profesor Yaniv Roznai visitó México para presentar una serie de conferencias sobre su obra Reformas Constitucionales Inconstitucionales y sobre el activismo que ha realizado desde la academia para combatir lo que el llama el judicial overhaul que se vive en Israel. Si has escuchado Upstanders, estarás familiarizado con estos temas y el trabajo del profesor Roznai. Sin embargo, mucho ha cambiado en nuestro país desde septiembre de 2024. Hoy estamos viviendo las campañas electorales de candidaturas al Poder Judicial Federal y, con ello, mucha incertidumbre sobre el futuro de nuestro sistema de imparticion de justicia. Bajo este nuevo contexto, Daniel y yo nos sentamos a platicar con él sobre la importancia de hacer frente a los actos que ponen en peligro el estado de derecho y los principios que han definido a nuestras democracias constitucionales. Pero, tal vez más importante, hablamos sobre cómo podemos materilizar esos esfuerzos –no bajo una narrativa vacía y superficial sobre el acceso a la justica– sino bajo una perspectiva que atienda a lo que llamamos literacidad constitucional. ¿Cómo podemos lograr que la ciudadania entienda el peso que tiene el Derecho en sus vidas cotidianas y cómo podemos hacer el trabajo del poder judicial forme parte de la cultura de las y los mexicanos?Estas son preguntas complicadas y por ello, nuestra conversación se extendió al punto de que se nos hizo tarde para llevar al profesor Roznai al aeropuerto. Afortunadamente, las virtudes de Daniel van más allá del ámbito del derecho y logramos que tomara su avión a tiempo, pero hemos decidio compartirles esta entrevista en dos episodios.
Nos encontramos en un momento sin precedentes en la vida pública de México. Solo esta semana, atestiguamos la renuncia y declinación de 8 ministras y ministros de la Suprema Corte y la de 859 personas juezas y magistradas; además de la aprobación de una reforma constitucional que establece que las adiciones o reformas constitucionales no se pueden impugnar. A la par, se publicó el proyecto de una sentencia que busca declarar la inconstitucionalidad parcial de una reforma constitucional, la cual es la raíz de todos estos acontecimientos. La reforma al poder judicial publicada el 15 de septiembre del presente año, establece que las y los ministros de la SCJN; así como magistrados y jueces federales deben de ser electos por voto popular. Al mismo tiempo, la reforma elimina al Consejo de la Judicatura Federal y delega sus funciones a un órgano de administración y un tribunal disciplinario. A partir de su publicación, surgieron amparos, acciones de inconstitucionalidad y controversias constitucionales presentadas por partidos políticos y personas juzgadoras. Esto nos ha llevado a reflexionar sobre los límites a los cambios constitucionales que deberían existir en una democracia constitucional como la nuestra. El 18 de octubre pasado, académicas y académicos mexicanos y de otras nacionalidades firmaron un Amicus Curiae en torno a las controversias y acciones presentadas, abordando la cuestión del control de constitucionalidad de las reformas constitucionales. Este tema ha generado discusiones y debates acalorados que han despertado un interés por parte de la comunidad estudiantil por comprender a profundidad a qué nos referimos cuando decimos que una reforma constitucional puede ser declarada inconstitucional. Por ello, la asociación de estudiantes de la licenciatura en derecho del CIDE y Upstanders organizaron un webinar, en el que académicas y académicos nos compartirán sus reflexiones en torno al amicus curiae que han presentado a la SCJN y que fue citado en el proyecto de sentencia del ministro Juan Luis González Alcántara Carrancá.
October is Bullying prevention month. I couldn't let the month get past without touching on the importance of teaching students to be "upstanders" as a key bullying prevention strategy. I am introducing the concept of an upstander as someone who witnesses bullying and intervenes to stop it, in contrast to a bystander who does nothing.We will discuss the benefits of empowering students to be upstanders, including preventing future bullying, supporting targets, and reducing bullying-related anxiety and depression. I will also touch on several teaching strategies for introducing the upstander concept, such as traditional lessons, interactive games, and digital resources. Some highlights from this episode include: Learning the importance of teaching students the different roles in bullying (bully, target, bystander) and avoiding stigmatizing language like "victim." Diving deeper on the concept of an upstander is defined as someone who witnesses bullying and intervenes to stop it, in contrast to a bystander. In May every year, kura and workplaces across Aotearoa celebrate Pink Shirt Day. It's a chance to visibly demonstrate our intolerance of bullying, and our commitment to diversity and being an upstander. With research showing that victims of bullying often find the inactions of bystanders more hurtful than the actual bullying behaviour, Mark Wilson (Pink Shirt Day), Mace Malcolm (InsideOUT) and Meg Craig (Elephant Trust) discuss what being an upstander means in the context of playground bullying: basically, taking action to support the victim. Their core message is that 'little things' can make a huge difference, and that acts of kindness and awhi can take place after the bullying act, not only in the moment.

Having been a doula for over 20 years now, I've seen the impact of the ‘mommy wars' worsen significantly. How you deliver your baby, how you feed them, how they sleep…mom-shaming is everywhere. While social media has many positives, it hasn't always helped people share their values in a supportive way. This made me think about how our children are being affected by this too. Our kids are exposed to endless outside influences that will shape their opinions if you don't have a parenting manifesto of values to support them. In this episode, I want us to think about creating another paradigm where we're teaching our children that they have the right to stand up for what they believe in, but not at the expense of someone else. Durante mi primer semestre en la escuela de derecho, tuve la oportunidad de leer el libro Voto en Contra, escrito por el Dr. José Ramón Cossío Díaz. En él, describe diversos votos concurrentes que emitió durante su cargo como ministro de la SCJN. Esta compilación reflexiona sobre temas de coyuntura nacional como la libertad de expresión, la relación entre derecho y moral y la importancia de interpretar la ley desde una perspectiva multidisciplinaria. Este libro tuvo un impacto importante en mí. Leer al ministro, amplió la imagen que tenía sobre lo que puede ser el derecho y me hizo reflexionar sobre la diversidad de problemáticas que enfrenta la sociedad mexicana. Este libro transmite la pasión que el ministro Cossío tiene por la justicia y es inspiradora la forma en la que defiende sus argumentos, a pesar de que en todos los casos se encontraba en el grupo minoritario o incluso votando solo. Este libro es el ejemplo perfecto de la importancia que tiene la disidencia, el dialogo y el pensamiento critico en sociedades democráticas como la nuestra. Ministro de la Suprema Corte de Justicia de la Nación de 2003 a 2018, Cossío Díaz es uno de los abogados más destacados en el gremio jurídico mexicano. Ha ejercido su profesión desde el servicio público, la docencia y la investigación en Derecho constitucional. Es autor de más de 30 libros y es columnista y colaborador en diversos periódicos y revistas. Joining us to talk about the depth of the problem are Liz Kari, daughter of the woman whose hate crime was witnessed by millions on social media, and founder of AAP I Belong. Also, Thear Sy Suzuki, a child survivor of Cambodian genocide who has risen to become a respected Dallas leader and was featured in former President George W. Bush's new book, OUT OF MANY, ONE: Portraits of America's Immigrants. Both advocate for fewer bystanders and more Upstanders against all racism.

Today I speak with Liz Vogel from Facing History and Ourselves who gives us a snapshot of how to use history to strengthen our students and help them become true up-standers. As this episode comes out on April 19th, 2020, most of us have been hunkered down in our homes, dealing with distance learning and lots of other issues right now. One thing that is always a problem whenever troubling times arise whether it’s a health crisis or a financial crisis – or in this case both – is the rise of hate – racism, Jew-hatred, xenophobia and so on. It’s been rising to scary levels even before the Covid 19 pandemic, and now we are seeing it grow so much worse. And when the extent of the financial repercussions become clear, we are at risk for seeing an even more intense rise in identity-based hate speech and hate crimes. So, how do we as educators and parents help our students and kids make great choices and combat any potential problems? Listen and find out!
As executive director of the Memphis region of Facing History and Ourselves, Marti Tippens Murphy is inspired by the stories of upstanders: extraordinary people who embraced the challenge to speak out, stand up for others, and make difficult decisions. Together, they helped to create a more inclusive, just, and compassionate Memphis. She led the commissioning of the Upstanders in Memphis History Mural in downtown Memphis. A native Memphian and Rhodes College Alumna, Tippens Murphy’s love for history and the power of story-telling led her to the Los Angeles office of Facing History in 1997. Since returning to her hometown in 2014, Murphy and her team continue to use the lessons of history and empathy to empower youth to stand up to bigotry and hate.

Nicole Jon Sievers is an activist, speaker, author, educator, Licensed Clinical Social Worker, and mother of five boys. In 2011, Nicole founded the non-profit Stand For Courage bullying-prevention program. SFC’s student-led, school-based, and community activation offers one ultimate goal: disrupt and end the cycle of bullying by celebrating stand-up bystanders with the support of media recognition and luminary partners. The school pilot program was recognized with an American Psychological Association Visionary. Nicole's book, It's Your Mind: Own It! offers neuroscience-based information and exercises for teens. It won an Indie Excellence book-of-the-year award in psychology. The One and Only You!, Nicole’s forthcoming book, is a middle school version of It’s Your Mind!: Own It! She is also a producer in the upcoming IndieFlix documentary film, The Upstanders.
Talking about race with kids is always daunting for parents. When your a light skinned mom with an African American/white child it becomes difficult because race conversations don't happen in white families. The newest episode of the Hijabi Diaries, "Upstanders and Up-standing," was originally created in April of 2017, and reflects on the effects of the 2016 Presidential elections on local Muslim people, as well as the rise in hate crimes following the election, and how Hoosiers across the state are taking their neighbors' safety into their own hands (and sometimes with them into state-level legislative sessions).
This episode features an artist who is an intrepid explorer and passionate engineer of storytelling. She is deeply intrigued by the dualities inherent in the human condition and her body of mixed media and mosaic work is the result of a committed studio practice that keeps her in a constant state of discovery, New York-based artist, Karen Kettering Dimit. Karen is the Co-Founder of the LIC Arts Open, a Senior Arts member of the St. Botolph Club, and a member the Society of American Mosaic Artists, LIC Artists. She was also the Chair of Sculpture at the Pen and Brush, NYC. Ms. Dimit has shown widely throughout the U.S., both in solo and group exhibitions. Most recently, she was juried into the 2018 Mosaic Arts International, winning the Contemporary Innovation Award. Other recent events: she was invited to show work in the 10th anniversary celebration of The Gallery at Penn College (where she showed a significant body of work in 2014), juried once again into the competitive exhibition of Mosaic Arts International 2016, held this year at the Women's History Museum in San Diego, and was invited to participate in a small group show featuring strong women at Gold Coast Art Center. Her “Medusa” won the “Best in Show” award in SAMA's juried member exhibition in Chicago, 2006; and “Miss Willendorf 2008” won “First Place” in the Pen and Brush 62ndAnnual Sculpture Exhibition in NY. Ms. Dimit lives in Manhattan and maintains a studio in Queens (LIC). She studied at the School of the Museum of Fine Arts in Boston, The Compleat Sculptor in New York, and Orsoni Mosaics in Venice, Italy. Ms. Dimit has also curated a number of well-received shows, most recently UPSTANDERS!!!, as show of 23 artists who channel their activism into their art practice.
