Often witnesses have misconceptions about the litigation process or concerns about ramifications of their performance in the deposition, which need to be addressed before any prep can start. Bill and Linda share how they help witnesses open up so they can address any distracting thinking patterns that will prevent the witness from doing well in the prep and also talk about the biggest issue that they deal with which is witnesses trying to "win" the deposition. They explain why witness brains are hard-wired to certain thought patterns and how they have to ""rewire"" the brain in order to break these ingrained ways of thinking.

But here's what most researchers do agree on: a significant chunk of them are negative, and a startling number are repeats from yesterday. Your brain is running the same playlist on loop, and a lot of those tracks were recorded a long time ago by a much younger version of you who was just trying to stay safe.Last week we introduced metacognition as the practice of watching your thoughts. This week, we get into what you'll actually find when you start watching. Cognitive distortions are the biased thought patterns that warp how we see reality, and they're not a character flaw or a sign that something is broken in you. They're patterns your brain got good at, often for very good reasons. Naming them is the first step toward not being completely at their mercy. In this episode, we dig into:A clearer picture of what cognitive distortions actually are (and why calling them "distortions" doesn't mean you're broken)All-or-nothing thinking: why high achievers are especially prone to this oneCatastrophizing: what to do when your brain fast-forwards to the worst possible outcomeShould statements: the sneaky way they disguise themselves as high standardsLabeling: why the words you use about yourself (and others) carry more weight than you thinkPermission to be in-progress without labeling yourself as a failure for still working on itSami shares the story of getting called to the principal's office in high school, expecting the worst, and finding out there was a snapping turtle in her car. They catch themselves doing all-or-nothing thinking and overgeneralizing in real time, which is maybe the most honest advertisement for why this work matters.If you've ever told yourself you're bad at something after one rough moment, jumped to the worst-case conclusion when your boss asked to see you, or slapped a permanent identity label on yourself or someone you love, this episode is the one. Bill Kanasky, Jr., Ph.D. discusses negative thought patterns of witnesses and how critical it is to identify and address these negative thoughts during prep. Bill shares a story about a recent witness he worked with and the process he took with this witness who was struggling with ruminating and negative thoughts. He advises attorneys to make the time to confront these emotional, negative thought patterns, to be prepared for them to resurface during prep, and to address them throughout the process until they are fully resolved because they can completely derail the witness's performance.

Just pause for a moment TAKE A BREATH Notice your breathing as you breath in and out - use 7/11 breathing technique OBSERVE - What thoughts are going through your mind right now? - Where is your focus of attention? - What are you reacting to? - What sensations do you notice in your body? PULL BACK - PUT IN SOME PERSPECTIVE - What's the bigger picture? - Take the helicopter view. - What is another way of looking at this situation? - What advice would I give a friend? - What would a trusted friend say to me right now? - Is this thought a fact or opinion? - What is a more reasonable explanation? - How important is this? How important will it be in 6 months time? - It will pass. PRACTICE WHAT WORKS - PROCEED - What is the best thing to do right now? - Best for me, for others, for the situation? - What can I do that fits with my values? - Do what will be effective and appropriate. HOW TO USE STOPP - Practice the first two steps often for a few days - many times every day at any time. - Read through the steps often. - Carry written reminders with you (use the printable resources below). - Practice STOPP by running through all the steps several times a day, every day...when you don't need it. - Start to use it for little upsets. - Gradually, you will find that you can use it for more distressing situations. Like any new habit or skill, it will become automatic over time. THE STEPS EXPLAINED STOP! Say it to yourself, in your head, as soon as you notice your mind and/or your body is reacting to a trigger. Stop! helps to put in the space between the stimulus (the trigger, whatever we are reacting to) and our response. The earlier you use STOPP, the easier and more effective it will be. TAKE A BREATH Breathing a little deeper and slower will calm down and reduce the physical reaction of emotion/adrenaline. Focusing on our breathing means we are not so focused on the thoughts and feelings of the distress, so that our minds can start to clear and we can think more logically and rationally. OBSERVE We can notice the thoughts going through our mind, we can notice what we feel in our body, and we can notice the urge to react in an impulsive way. We can notice the vicious cycle of anxiety, sadness or anger. Noticing helps us to defuse from those thoughts and feelings and therefore reduce their power and control. PULL BACK / PUT IN SOME PERSPECTIVE The thought challenging of CBT. Thinking differently. When we step back emotionally from a situation, and start to see the bigger picture, it reduces those distressing beliefs. We can do this by asking ourselves questions. PRACTICE WHAT WORKS / PROCEED This is the behavioral change of CBT. Doing things differently. Rather than reacting impulsively with unhelpful consequences, we can CHOOSE our more helpful and positive response. Right now, inside your skull, sits the most sophisticated wealth-creation machine ever designed. But here's what neuroscientists discovered when they put millionaire brains under advanced imaging technology - their neural networks fire in completely different patterns than everyone else's. When a millionaire sees a financial opportunity, specific clusters of neurons light up that remain completely dormant in average earners. When they process risk, different pathways activate. When they calculate time and money relationships, entirely separate neural networks engage. The wealthy don't just think different thoughts - they think with different parts of their brains.
