Is KTM okay or not? A year of scary news about financials for the massive Austrian maker of KTM, Husqvarna and GasGas motorcycles continues, with rumors of a make it or break it payment looming this week. It appears KTM's business partner Bajaj might have gotten the loan needed to restart the KTM assembly lines and keep the company going. Jason Weigandt gives the latest on that, then chats with Frank White of long-time American dirt bike manufacturer ATK. Yes, the ATK brand is still around, now as a parts supplier, and it has partnered with Harley-Davidson on projects before. Frank White doesn't like what he sees over at H-D these days, with the company reporting a loss of over $200 million in the final quarter of 2024. White and others would like to see the CEO of Harley ousted, and a revamp of the type of products the company produces. While a recent vote will keep the current CEO in place for at least this year, these are still times of stress at two of the biggest motorcycle companies in the world. The Racer X Exhaust podcast is presented by Yoshimura, Insta360 Cameras and OnTrack School.

Opsporing verzocht. See omnystudio.com/listener for privacy information.

The probe found that Buchanan directed business to a former romantic partner, Chandra Holt, who is the CEO of Beyond Inc. and founder of Incredibrew. Holt secured a multimillion-dollar consulting deal with Kohl's under unusually favorable terms, which Buchanan failed to disclose. As a result, Buchanan was dismissed for cause, forfeiting equity awards and required to repay a portion of his $2.5 million signing bonus. This marks the third CEO departure at Kohl's in just three years, highlighting ongoing leadership instability amid declining sales.Proxy Firms Split on Harley-Davidson Board Shake-Up MMGlass Lewis= Withhold; ISS = What's happening at Harley exactly? We have a fun twist at the proxy cage match between Harley Davidson and H Partners, who are 9% shareholders and have started a withhold vote campaign against long-tenured directors Jochen Zeitz, Thomas Linebarger, and Sara Levinson: Glass Lewis says “withhold” but ISS says “support”?Through lackluster reasoning based on hunches and not performance analytics, ISS revealed, without satire, that "[T]here are compelling reasons to believe that as a group [the targeted directors] still have a perspective that can be valuable” and, in discussing the candidacy of departing CEO Jochen Zeitz: “[I]t appears that his time in the role has been more positive than negative, which makes it hard to argue that his vote on a successor is worthless.”Testimony in House Hearing: “Exposing the Proxy Advisory Cartel: How ISS & Glass Lewis Influence Markets”A 2015 study found that 25 percent of institutional investors vote “indiscriminately” with ISS [1].In 2016, a study estimated that a negative recommendation from ISS leads to a 25-percentage point reduction in voting support for say-on-pay proposals [2].A 2018 study demonstrated that a negative recommendation from ISS was associated with a reduction in support of 17 percentage points for equity-plan proposals, 18 points for uncontested director elections, and 27 points for say-on-pay [3].In 2021, a study examining “robo-voting”—the practice of fund managers voting in lockstep with the recommendations of ISS—identified 114 financial institutions managing $5 trillion in assets that automated their votes in a manner aligned with ISS recommendations 99.5% of the time [4].A 2022 study provided further evidence that institutional investors are highly sensitive to an opposing recommendation from a proxy advisory firm. Opposition from ISS was associated with a 51 percent difference in institutional voting support compared with only a 2 percent difference among retail investors [5].During the 12 months ending June 30, 2024, negative recommendations from the two proxy advisory firms were associated with (1) a 17-percentage point difference in support for directors in uncontested elections at the S&P 500 (96.9% with the firms' support vs. 79.7% without); (2) a 35-percentage point gap for say-on-pay proposals (92.8% vs. 58.0%); and (3) a 36-percentage point difference for shareholder proposals (42.4% vs. 6.6%)Why Leo XIV? In this episode, Brian Rothenberg, Partner at Defy.vc, explores how the resurgence of the Bay Area, the rise of generative AI and the future of marketplaces are reshaping the startup landscape. It wasn't the first time their personal and professional lives had crossed.Kohl's fired Buchanan on Thursday after it discovered he had instructed the retailer to enter into a “highly unusual” business deal involving a woman with whom he has a romantic relationship, according to people familiar with the situation. The pair currently live together in an upscale golf community in the suburbs of Dallas.Buchanan met the woman, Chandra Holt, when they were both working at Walmart several years ago, the people said. His divorce proceedings show the two had a romantic relationship while he was the CEO of Michaels. The arts-and-crafts chain also tried to hire Holt during his tenure.A Kohl's board investigation by outside lawyers found that Buchanan violated the company's code of conduct in two instances with a vendor with whom he had a personal relationship and whom it didn't name, according to a regulatory filing. The filing said he directed the retailer to conduct business with a vendor founded by this person “on highly unusual terms,” and he caused the company to enter into a multimillion-dollar consulting agreement, where that person was part of the consulting team.On Thursday, Kohl's appointed Chairman Michael Bender as its interim CEO. He becomes the fourth CEO in three years at the department-store chain, which has been struggling with slumping sales.Nominating Committee:John E. Schlifske* (2011; 6%)Michael J. He referred to a 20-minute video in which Starbuck laid out his claims, including that Meta's AI falsely associated him with the Jan. 6 Capitol riot and the QAnon conspiracy theory.“We're sorry for the results it shared about you and that the fix we put in place didn't address the underlying problem,” Kaplan continued. “I'm working now with our product team to understand how this happened and explore potential solutions.”Bob Monks, fierce champion of shareholders against what he saw as boardroom failings 0An American pioneer of investor activism and better corporate governance.Monks emerged as a doughty champion of shareholders against what he saw as increasingly self-serving and complacent boardroom behaviourIn 1985 he founded Institutional Shareholder Services, which advises funds that own shares in multiple companies how best to exercise their voting power. Then last year, the company moved to turn itself into a for-profit entity in which the nonprofit held a stake but didn't have control. Now, OpenAI plans to turn its for-profit subsidiary into a public benefit corporation, which would still be controlled by the nonprofit, though the size of its stake remains undetermined. Shoot us a Text.Episode #1036: Warren Buffett shocks investors with a surprise retirement announcement, Tesla sweetens the Model Y deal to boost lagging demand, and Harley's LiveWire hits a wall while the legacy brand keeps the engine running. Show Notes with links:After 60 years of leading Berkshire Hathaway, Warren Buffett has stunned the business world by announcing he will retire as CEO at the end of 2025. Buffett, now 94, made the announcement unceremoniously after nearly five hours of Q&A, stunning a packed stadium into silence. He had not previously disclosed his exact plans—not even to most of the board or Greg Abel, his named successor, who was sitting beside him at the time.Abel has already been managing most of Berkshire's sprawling empire since 2018, excluding insurance, and is described as a “quick study” with deep operational knowledge and a more involved leadership style. Buffett will stay on as chairman. Investors and analysts widely agree: nobody can replicate Buffett's investing instincts or the brand equity he brings to the table. “[Abel] would make a huge mistake trying to be Warren Buffett, and he knows that,” said Fidelity's Will Danoff.Buffett will leave behind a company with 189 operating businesses, $264 billion in stocks, and $348 billion in cash—along with a trust-based leadership culture.Berkshire Hathaway Automotive, one of the group's largest units, continues to play a key role, contributing 65% of the company's retail revenue in 2022, with over 100 franchises in 10 states.Tesla is offering low-interest financing on the new Model Y, signaling that demand isn't quite where they hoped it would be.New U.S. buyers can now get 1.99% APR or $0 down—a first for the refreshed Model Y.It follows a $2,000 discount offered just last week to early buyers.Despite being Tesla's best-seller, inventory is building up and wait times are unusually short.Tesla blamed Q1's weak deliveries on the Model Y changeover, but signs point to broader demand challenges. In Europe and China, things are worse—0% financing is already being offered to move cars.Harley-Davidson's electric offshoot LiveWire is facing serious headwinds, with sales collapsing and losses piling up—raising real questions about the brand's future.LiveWire sold just 33 electric motorcycles in Q1, down 72% year-over-year—a staggering drop for a brand once aiming for 100,000 units annually by 2026.The brand earned only $3 million in revenue but posted a $20 million operating loss, meaning it lost about $606,000 per bike.Harley blames a “volatile macroeconomic environment” and consumer hesitation amid economic uncertainty.Meanwhile, Harley-Davidson's core business weathered the storm, pulling in $1.32 billion in Q1 revenue despite shJoin Paul J Daly and Kyle Mountsier every morning for the Automotive State of the Union podcast as they connect the dots across car dealerships, retail trends, emerging tech like AI, and cultural shifts—bringing clarity, speed, and people-first insight to automotive leaders navigating a rapidly changing industry.Get the Daily Push Back email at https://www.asotu.com/ JOIN the conversation on LinkedIn at: https://www.linkedin.com/company/asotu/
May 2025 might go down as the most pivotal month of Donald Trump's second presidency. The post-Liberation Day disruption gave him room to play the chaos card — but that only lasts so long. Now it's time to deliver. And according to what the White House is telling Congress behind closed doors, a lot is in motion. Sixty countries are either actively negotiating trade terms or exchanging paperwork with the administration. Congress is being told these deals won't require their approval, which Congress, for the record, does not agree with. But this is Trump we're talking about — when has he ever waited for a vote?Still, the big names you'd expect — China, Canada, Mexico — aren't in the mix. China's radio silent, Mexico and Canada are being folded into existing USMCA renegotiations. That leaves three countries reportedly close to a deal: the United Kingdom, Australia, and most importantly, India. India isn't just geopolitically important — it's the key to rewriting how America competes with China. A deal there could shift the entire narrative. Why India Matters More Than You ThinkIndia is the crown jewel of this effort. There's personal chemistry between Trump and Modi, which helps. JD Vance just visited India, and his family ties only reinforce the good vibes. But this isn't just a soft power thing. India offers cheap manufacturing, which Trump badly needs to offset Chinese trade disruption. If you're going to tell a story about reindustrializing America and cutting reliance on Beijing, India is where you start. There's also the intellectual property angle. India doesn't have the same IP hang-ups as China, which means Trump could insert protections into this deal and claim it as a model for future negotiations — including, eventually, with China. It's the kind of pivot that's both symbolic and real. Add in niche export wins — like bourbon or Harley-Davidsons, which have demand in India but face big trade hurdles — and suddenly you've got tangible proof of progress.Fast Deals, Reversible WinsHere's the catch: none of these deals are expected to go through Congress. They're handshake deals. That means they can be reversed at any moment — by Trump himself. And that's kind of the point. Trump wants to touch every single part of the negotiation. No detail moves without his approval. That gives him the power to declare victory on anything, even if the actual text doesn't amount to much.So the real question isn't whether Trump can get a deal. It's whether he can get one that's meaningful — and fast. Because right now, the administration needs wins. Not headlines. Not vibes. Wins. The stock market is shaky, the trade war with China is frozen, and the White House knows it's currently heading into the midterms with a record that still feels unsettled. India might be the win they've been waiting for. But if it doesn't land soon, the window to define this presidency might close a lot faster than anyone expects.Chapters00:00:00 - Intro00:00:15 - Tariff Negotiations00:10:11 - Worst State Party Draft, part one00:41:37 - Update00:42:36 - Mike Waltz Goes to the U.N.00:44:48 - Alien Enemies Act Ruling00:48:55 - Ukraine Mineral Deal00:51:55 - Worst State Party Draft, part two01:34:53 - Wrap-up This is a public episode. He also knows exactly how it feels to reach 200 mph in less than 7 seconds. “I always tell everybody it's like hanging on to a bullet after it's been shot out of a gun.”“First to 500” is Johnson's career calling card. “If you go to all the races in the year that the sanctioning body puts on,” he explains to host Mark Long on this episode of the “Driven to Ride” podcast, “and if you do it for 38 years, you'll have 500, too.” That is a competition milestone no other NHRA Pro Stock Motorcycle racer has ever reached. In fact, no one has even come close.Rather than focus on his many racing successes, however, Johnson would rather talk about his off-track efforts. Welcome to the Health Marketing Collective, where strong leadership meets marketing excellence. In today's episode, host Sara Payne sits down with Mike Cronin, Cofounder and Chief Strategist at Verve, to explore the evolving landscape of creativity in B2B healthcare marketing. Mike, whose impressive résumé includes brand and campaign strategy for UnitedHealth Group, Blue Cross Blue Shield, Optum, and revered consumer brands like Harley-Davidson and Samuel Adams, brings a rare blend of creative vision and strategic rigor to his work. His fundamental belief? That creative work's purpose is to move people, not just fill space. In this conversation, Mike and Sara dive deep into how B2B health brands can move beyond “safe” ideas and unlock emotionally resonant, unforgettable campaigns—even within highly regulated and risk-averse spaces. They discuss why simplicity is a superpower, the importance of strategic “boxes,” and how marketing leaders can create environments where big swings are encouraged, not stifled. Along the way, Mike shares memorable stories from his work (including a campaign that fused Lizzo's “Good as Hell” into healthcare advertising), offers insight into the universal human truths marketers often miss, and outlines what separates teams that produce great creative from those that simply make noise. Thank you for being part of the Health Marketing Collective, where strong leadership meets marketing excellence. The future of health care depends on it. Key Takeaways: Creativity Thrives Within Constraints: Mike challenges the conventional wisdom of “thinking outside the box.” He argues that true creativity is often unlocked not by limitless freedom, but by well-defined strategic constraints. It's within the confines of a focused brief—what Mike calls “the freedom of a tight brief”—that intelligent, emotionally resonant ideas emerge. Rather than aiming for “crazy” or “flashy,” the best creative is smart, intentional, and purpose-driven. Emotion and Human Truth are Universal, Even in B2B: B2B often gravitates toward rational benefits: cost savings, efficiency, or productivity. But, as Mike notes, even financial administrators and clinicians are humans first—they respond to messages that tap into universal emotions and experiences: hope, fear, dignity, and relief from frustration. Brands that connect on this human level, rather than just touting features and benefits, become memorable and meaningful. Strategic Alignment is the Key to Unlocking Great Creative: Teams that produce truly breakthrough work consistently prioritize strategy. When everyone is aligned on the core insight and brief, creativity can flow freely within those parameters. Conversely, weak or vague direction leads to “safe,” generic campaigns. Mike's experience shows that great creative always starts with a shared, sharp strategic foundation. Boldness is Essential for Breaking Through the Noise: Healthcare, especially B2B, often defaults to playing it safe (“everything's blue”)—but in a crowded marketplace, standing out is non-negotiable. Mike advocates for boldness that is grounded in the brand's truth and strategically anchored. The result: unforgettable, not just noisy, marketing. Leadership's Role: Foster Honesty, Empathy, and Trust: Leadership sets the tone for creativity and trust. Mike urges CMOs and marketing leaders to lead with clarity and honesty—eschewing “BS” and toxic positivity for real, truthful dialogue about challenges and opportunities. Teams (and audiences) respond to authenticity; when leaders call things as they are and create space for truth, better work results. Today I'm announcing a major multi-million dollar defamation lawsuit against @Meta, the owner of @Facebook & @Instagram.The case is WILD and has implications for ALL OF US. On top of falsely calling me a criminal, Meta suggested my kids be taken from me.Watch for the full story but here's a summary:This all started with Meta's AI falsely claiming that I was charged with a crime from January 6th but… I wasn't even in DC that day (I was in TN) and I've never been charged with a crime IN MY LIFE.We found this out in August of 2024 when I was exposing woke policies at Harley Davidson. One dealership was unhappy with me and they posted a screenshot from Meta's AI in an effort to attack me. This screenshot was filled with lies. I couldn't believe it was real so I checked myself. It was even worse when I checked. From that day I've faced a steady stream of false accusations that are deeply damaging to my character and the safety of my family. This sounds bad, right? It gets MUCH worse. Meta was notified LAST YEAR by my lawyers, yet the defamation continues today. Some lies Meta spread about me:• Meta's AI claims that I've appeared on Nick Fuentes show, that I've spoken at his rallies, and that I've supported him. I've never met him and this is all false.• Meta's AI claims I've engaged in Holocaust denial. I've NEVER denied the Holocaust.• Meta's AI tells advertisers NOT to advertise with me because of the lies it invented.• Meta tells employers NOT to hire me because of the lies it invented.• Meta suggested that MY KIDS BE TAKEN FROM ME because it would be better for them to be raised by someone more friendly to DEI and transgenderism.• Meta's ironically claimed that I've been sued for DEFAMATION and EMOTIONAL DISTRESS. I've never been sued for either.I've tried to fix this privately since last year. Instead of fixing this and instituting safeguards, Meta has given us the runaround.Meta later BLACKLISTED my name from being searched (insane) but it didn't end the defamation because Meta includes my name in news stories. You can then ask for more info about me. If you do that, Meta goes back to defaming me. In fact, the lies this week are the worst yet!Meta's AI admits that a false accusation over J6 is extremely harmful to whoever is accused. It even agrees that a court is LIKELY to rule that this was defamation with ACTUAL MALICE.With my lawsuit today, I intend to MAKE @finkd @Meta solve this problem. Why is this so important? While I'm the target today, a candidate you like could be the next target, and lies from Meta's AI could flip votes that decide the election. YOU could be the next target too. That's why I'm taking on this David vs. Goliath fight. For me, my honor, my family, for our elections, and FOR YOU!If you want to help me fight ALL the battles that I'm fighting, you can help support my team at www.RobbyStarbuck.com/fight Subscribe to be the first to know when new episodes drop!Watch video episodes on YouTube!Explore more at RobbyStarbuck.com

In this podcast episode we discuss several topics. Indian Motorcycle sales were down for the forth quarter of 2024, Harley-Davidson dealing with tariffs, and motorcycle jump starters. Indian Motorcycles, founded in 1901, is one of America's oldest and most iconic motorcycle brands. After dominating the market in the early 20th century with models like the Scout and Chief, the company struggled and ultimately ceased operations in 1953. Over the next five decades, several revival attempts failed until Polaris Industries acquired the brand in 2011. Polaris successfully relaunched Indian, preserving its heritage while expanding with modern designs and a broad lineup of seven motorcycle families. The introduction of the FTR1200 in 2019 marked its only major innovation in recent years. The brand reestablished itself as a serious rival to Harley-Davidson, especially in the North American market, where it achieved record sales of 43,219 units in 2022. SUPPORT US AND SHOP IN THE OFFICIAL LAW ABIDING BIKER STORE However, Indian's resurgence has hit a plateau. Sales have declined since 2022, with global registrations dropping to around 37,000 units annually. In 2024, the downturn steepened, with an overall decline of 12.4% through August, including a 15% dip in the U.S. and 9.9% in Europe. The brand's heavy reliance on the maturing U.S. market, which accounts for 64% of its business, and a lack of consistent product innovation, are seen as key factors in its recent struggles. Despite its rich legacy and strong branding, Indian faces challenges in sustaining momentum without broader international expansion and a more aggressive approach to new model development. CHECK OUT OUR HUNDREDS OF FREE HELPFUL VIDEOS ON OUR YOUTUBE CHANNEL AND SUBSCRIBE! With President-elect Donald Trump suggesting a 25% tariff on goods from countries like Mexico, Canada, and China, concerns are rising about how such measures might impact American companies—Harley-Davidson being a prime example. During Trump's first term, Harley was caught in a trade war between the U.S. and the EU, leading to potential tariffs as high as 56%, which the company estimated would cost over $200 million annually. Though it initially avoided these tariffs by exporting from its Thailand plant, recent EU rulings have closed that loophole. With Harley-Davidson's international operations accounting for nearly 40% of its motorcycle sales—particularly in Europe and Asia—new tariffs or retaliation from other countries could severely affect its bottom line. Beyond international trade tensions, there's now speculation about the U.S. imposing tariffs on Harley's own Thai-built bikes being sold domestically for the first time—an unprecedented move that could reignite past threats. While some voices continue to dramatize Harley's situation, citing minor downturns as existential threats, the company remains profitable, recently reporting a $119 million quarterly profit. Still, its visibility as an iconic American brand makes it a convenient target in trade disputes. As global politics shift, Harley-Davidson must navigate both economic realities and its symbolic status, balancing manufacturing strategies and diplomatic crossfire. Tech Bro NonsenseFormer Google CEO Tells Congress That 99 Percent of All Electricity Will Be Used to Power Superintelligent AIbillionaire tech tycoon and former Google CEO Eric Schmidt comments to the House Committee on Energy and Commerce: "What we need from you is we need the energy in all forms, renewable, non-renewable, whatever. It needs to be there, and it needs to be there quickly.""Many people project demand for our industry will go from 3 percent to 99 percent of total generation... an additional 29 gigawatts by 2027 and 67 more gigawatts by 2030. If [China] comes to superintelligence first, it changes the dynamic of power globally, in ways that we have no way of understanding or predicting.”Meta Says It's Okay to Feed Copyrighted Books Into Its AI Model Because They Have No "Economic Value"In the ongoing suit Richard Kadrey et al v. Meta Platforms, led by a group of authors including Pulitzer Prize winner Andrew Sean Greer and National Book Award winner Ta-Nehisi Coates, the Mark Zuckerberg-led company has argued that its alleged scraping of over seven million books from the pirated library LibGen constituted "fair use" of the material, and was therefore not illegal.Meta's attorneys are also arguing that the countless books that the company used to train its multibillion-dollar language models and springboard itself into the headspinningly buzzy AI race are actually worthless. Meta cited an expert witness who downplayed the books' individual importance, averring that a single book adjusted its LLM's performance "by less than 0.06 percent on industry standard benchmarks, a meaningless change no different from noise." Thus there's no market in paying authors to use their copyrighted works, Meta says, because "for there to be a market, there must be something of value to exchange," as quoted by Vanity Fair — "but none of [the authors'] works has economic value, individually, as training data." Other communications showed that Meta employees stripped the copyright pages from the downloaded books.Tellingly, the unofficial policy seems to be to not speak about it at all: "In no case would we disclose publicly that we had trained on LibGen, however there is practical risk external parties could deduce our use of this dataset," an internal Meta slide deck read. The deck noted that "if there is media coverage suggesting we have used a dataset we know to be pirated, such as LibGen, this may undermine our negotiating position with regulators on these issues."Lauren Sánchez in Space Was Marie Antoinette in a Penis-Shaped RocketKaty Perry Boasts About Ridiculous Rocket Launch While NASA Is Scrubbing History of Women in Space“It's about a collective energy and making space for future women. It's about this wonderful world that we see right out there and appreciating it. This is all for the benefit of Earth.”Last month, the Orlando Sentinel first reported, NASA scrubbed language from a webpage about the agency's Artemis missions declaring that a goal of the mission was to put the first woman and first person of color on the Moon; just a few days later, NASA Watch reported that comic books imagining the first woman on the Moon had been deleted from NASA's website.A webpage for "Women at NASA" is still standing, but pictures of women and people of color — astronauts, engineers, scientists — have reportedly been removed from NASA's real-world hallways amid the so-called "DEI" purge. Per Scientific American, the word "inclusion" has been removed as one of NASA's core pillars. And as 404 Media reported in February, NASA personnel were directed to remove mentions of women in leadership positions from its website.OpenAI NonsenseOpenAI Is Secretly Building a Social NetworkOpenAI has been secretly building its own social media platform, which The Verge reports is intended to resemble X-formerly-Twitter — the social media middleweight owned by CEO Sam Altman's arch-nemesis, Elon MuskOpenAI updated its safety framework—but no longer sees mass manipulation and disinformation as a critical riskOpenAI said it will stop assessing its AI models prior to releasing them for the risk that they could persuade or manipulate people, possibly helping to swing elections or create highly effective propaganda campaigns. The company said it would now address those risks through its terms of service, restricting the use of its AI models in political campaigns and lobbying, and monitoring how people are using the models once they are released for signs of violations.OpenAI also said it would consider releasing AI models that it judged to be “high risk” as long as it has taken appropriate steps to reduce those dangers—and would even consider releasing a model that presented what it called “critical risk” if a rival AI lab had already released a similar model. Previously, OpenAI had said it would not release any AI model that presented more than a “medium risk.”Saying 'please' and 'thank you' to ChatGPT costs OpenAI millions, Sam Altman saysBeing nice to your AI chatbot requires computational power that raises electricity and water costsAltman responded to a user on X (formerly Twitter) who asked how much the company has lost in electricity costs from people being polite to their models: “Tens of millions of dollars well spent — you never know,” the CEO wrote.AI models rely heavily on energy stored in global data centers — which already accounts for about 2% of the global electricity consumption. Polite responses also add to OpenAI's water bill. AI uses water to cool the servers that generate the data. A study from the University of California, Riverside, said that using GPT-4 to generate 100 words consumes up to three bottles of water — and even a three-word response such as “You are welcome” uses about 1.5 ounces of water.Antitrust NonsenseTrump DOJ's plan to restructure Google hurts consumers, national security, says exec: 'Wildly overbroad'Kent Walker, Google's president of global affairs: "We're very concerned about DOJ's proposal. We think it would hurt American consumers, our economy, our tech leadership, even national security. The proposed reform from DOJ "would result in unprecedented government overreach that would harm American consumers, developers, and small businesses — and jeopardize America's global economic and technological leadership at precisely the moment it's needed most."8 revelations from Mark Zuckerberg's 3 days on the witness stand in Meta's antitrust trialThe FTC alleges Meta "helped cement" its illegal monopoly in the social media market with its acquisition of Instagram and the messaging app WhatsApp more than a decade ago.8 revelations:Antitrust worries surfaced years agoTwo years before the FTC initially sued Meta over allegations that it violated US competition laws, Zuckerberg considered breaking Instagram out into its own company to avoid potential antitrust scrutiny, according to a 2018 internal email revealed by the government at trial."I wonder if we should consider the extreme step of spinning Instagram out as a separate company," Zuckerberg wrote in the email to company executives. "As calls to break up the big tech companies grow, there is a non-trivial chance that we will be forced to spin out Instagram and perhaps WhatsApp in the next 5-10 years anyway." If a break up were to happen, Zuckerberg wrote, history showed that companies could end up better off.Asked about this view at trial, Zuckerberg said, "I'm not sure exactly what I had in mind then."A 'crazy idea' to boost Facebook's relevanceZuckerberg's "crazy idea" for Facebook in 2022 involved purging all users' friends. The CEO — fearful that Facebook was losing cultural relevance — made the proposal in a 2022 email to the social network's top brass."Option 1. Double down on Friending," Zuckerberg wrote in the message. "One potentially crazy idea is to consider wiping everyone's graphs and having them start again."Sheryl Sandberg wanted to play Settlers of CatanZuckerberg once offered to give Sheryl Sandberg, the former COO of Meta, a tutorial in the board game Settlers of Catan. The lesson offer came up in 2012 messages in which the two discussed the fresh $1 billion purchase of Instagram, partially redacted missives presented by the FTC during Zuckerberg's testimony showed."We would love it. I want to learn Settlers of Catan too so we can play," Sandberg told Zuckerberg in the message. He responded: "I can definitely teach you Settlers of Catan. It's very easy to learn."Meta's rivalry with TikTok has only just begunDuring his testimony, Zuckerberg hammered home Meta's argument that the tech giant faces massive competition from other apps, especially TikTok."TikTok is still bigger than either Facebook or Instagram," Zuckerberg testified. "I don't like it when our competitors do better than us. You can sort of bet that I'm not going to rest until we are doing quite a bit better than we are doing now.”Facebook Camera app struggles were a source of worryInstagram's early rise shook Zuckerberg. As his company struggled to mount its response with the Facebook Camera app, the CEO began to lose his patience."What is going on with our photos team?" Zuckerberg wrote in a 2011 message to top executives, as revealed by the FTC in court. Zuckerberg then described a number of individuals, whose names were redacted, as being "checked out." He added another person didn't want "to work with this team because he thinks this team sucks."In May 2012, Facebook launched a photo-sharing app called Facebook Camera, which aims to make it simpler for the social network's users to upload and browse photos on smartphones. Only weeks after Facebook spent $1 billion on a similar photo-sharing app called Instagram. Zuckerberg tried to buy Snapchat for $6 billionZuckerberg's failed bid to buy Snapchat was highlighted by the government to bolster its argument that Meta sought to maintain its dominance in the social media market through acquisitions rather than competition.Facebook isn't really for friends anymoreWhile under questioning by the FTC, Zuckerberg said that Facebook had greatly evolved since he launched the platform more than 20 years ago and that its main purpose wasn't really to connect with friends anymore. The FTC argues that Meta monopolizes the market for "personal social networking services.""The friend part has gone down quite a bit," Zuckerberg testified. He said the Facebook feed has "turned into more of a broad discovery and entertainment space."Not impressed by WhatsApp cofounderZuckerberg wasn't too impressed with one of WhatsApp's cofounders after a 2012 meeting he had with company leadership."I found him fairly impressive although disappointingly (or maybe positive for us) unambitious," Zuckerberg wrote in an email to colleagues after the meeting, it was revealed at trial.Jan Koum and Brian Acton cofounded WhatsApp in 2009. Zuckerberg said in his testimony that he thinks he was referring to Koum. Asked about his email, Zuckerberg seemed uneasy. He said that Koum was clearly smart but that he and Acton were staunchly opposed to growing their messaging app enough to be a real threat to Facebook. Zuckerberg would go on to buy WhatsApp in 2014 for $19 billion.Mark Zuckerberg's Meta Platforms adds former Trump advisor to the board days before an antitrust showdown with the FTCMeta Platforms is further boosting its lineup of heavy hitters with the additions of Stripe CEO Patrick Collison and Dina Powell McCormick to the mix. He added: “This historical result serves as a wake-up call to BP's board and emphasises investor expectation for robust governance mechanisms and genuine leadership on ESG issues.”Starbucks CEO faces major backlash after details of his work routine are revealed: 'Ill-conceived decision'A press release from the National Center for Public Policy Research reported on the hypocrisy of Starbucks CEO Brian Niccol's transportation practices when considering the company's public commitment to eco-friendly practices.Niccol travels regularly from his home in Newport Beach, California, to Starbucks' headquarters in Seattle, Washington, via private jet. Each 2,000-mile round-trip commute releases nearly nine tons of carbon dioxide. The National Center for Public Policy Research's Free Enterprise Project's director Stefan Padfield pointed out the discrepancy of policy and practice during his presentation of Proposal 8 requesting an annual report on emissions congruency. He noted that each round trip made by Niccol "is roughly the annual energy-consumption footprint of the typical American household."This analogy paints a vivid picture of the hypocrisy between Starbucks' public environmental commitments and the practices of the CEO. Gaps are apparent. Target CEO Cornell meets with Sharpton to discuss DEI rollback as civil rights leader considers boycottCEO Brian Cornell met with the Rev. Al Sharpton in New York on Thursday as the retailer faces calls for a boycott and a slowdown in foot traffic that began after it walked back key diversity, equity and inclusion programs, the civil rights leader told CNBC Wednesday. The meeting, which Target asked for, comes after some civil rights groups urged consumers not to shop at Target in response to the retailer's decision to cut back on DEI. While Sharpton has not yet called for a boycott of Target, he has supported efforts from others to stop shopping at the retailer's stores.“You can't have an election come and all of a sudden, change your old positions,” Sharpton told CNBC in a Wednesday interview ahead of the meeting. “If an election determines your commitment to fairness then fine, you have a right to withdraw from us, but then we have a right to withdraw from you.”IBM Informs Staff of DEI Retreat as Trump-Era Scrutiny GrowsEmployees were told of the changes earlier this week, in a memo that cited “inherent tensions in practicing inclusion.” Legal considerations and shifting attitudes to DEI were among the factors for the company. IBM CEO Arvind Krishna discussed the changes in his monthly video update to employees Thursday.Anti-DEI activist Robby Starbuck said he first contacted the company in February to question its policies. IBM confirmed it discussed its changes with Starbuck. The company (-10% gender influence gap) also disbanded a diversity council that represents the views of employee groups as part of its reevaluation.Exxon Faces No Shareholder Proposals for First Time in 25 YearsThe absence of requests in Exxon's proxy statement comes a year after the company sued two climate-focused investors to remove what it described as their “extreme agenda.” It also tracks with the US Securities and Exchange Commission's decision to back guidelines that make it easier for corporations to block votes on shareholder resolutions at their annual meetings.Exxon said in a statement late Monday that it received only one proposal this year and the SEC agreed it should be discarded because “it tried to micromanage the company.”Occidental Petroleum Corp., Valero Energy Corp. and Dow Inc. are other companies with no shareholder proposals up for vote at this year's annual meetings.Exxon said this year marks “the first time in recent history that our proxy includes zero proposals from activists.” It was just four years ago that a small fund scored a victory over Exxon, placing three directors on the company's board.Climate activist shareholder group Follow This pauses big oil campaignClimate activist shareholder group Follow This said on Thursday a lack of investor appetite has forced it to suspend its nearly decade-long campaign seeking stronger commitments from major oil and gas producers to emission cutsHarley-Davidson slams activist investor, saying its campaign is messing up its CEO searchIn early April, H Partners' Jared Dourdeville, who had been a Harley director since 2022, abruptly resigned from the board, saying among other things that Harley had “cultural depletion” because of its work-from-home policies and the exit of several senior leaders. And that was not his only point of contention with the rest of the board.Investment firm H Partners, a major investor with 9.1% of Harley's shares, in an open letter filed on Wednesday, urged fellow shareholders to remove three longtime directors from Harley's eight-member board at its annual meeting in mid-May by withholding votes for them. H Partners said the board had not held Harley CEO Jochen Zeitz accountable for what it called his repeated “strategic execution failures” and “severe underperformance.”CEO/Chair Zeitz (2007, 30%)Lead DIrector Norman Thomas Linebarger (2008, 13%)Sara Levinson (1996, 20%)"We believe Mr. Zeitz, Mr. Linebarger, and Ms. Levinson should be held accountable for the destruction of shareholder value,"Harley's bylaws stipulate that directors who win less than 50% of votes in an election must tender their resignations.Harley announced last week that Zeitz, CEO since 2020 and board member for 18 years, would resign but stay in his role until a successor is found. H Partners wants him out now. That followed a letter issued a day earlier by Harley-Davidson, which accused H Partners of “publicly campaigning” against it and saying that those efforts are also “adversely impacting the CEO search process and ongoing execution of the Hardwire strategic plan,” referring to a turnaround plan it launched in 2021.Harley said that it began a CEO search late last year after Zeitz expressed interest in retiring and has interviewed three potential CEOs, including one supported by Dourdeville, but declined to offer any the job. The company has also said that Dourdeville had cast only one vote against the majority during his time as a director and that as recently as November 2024 he had expressed support for Zeitz.Harley-Davidson faces board fight from H Partners amid calls for CEO to exit soon

In this episode of The Excellence Project, Eric Worre sits down with Ken Schmidt, the former Director of Communications at Harley-Davidson who played a pivotal role in one of the most celebrated brand turnarounds in business history. Ken shares the inside story of how Harley-Davidson transformed from a struggling motorcycle manufacturer on the brink of bankruptcy to a lifestyle brand with unprecedented customer loyalty. Throughout the conversation, Ken reveals the powerful strategy of creating "visual words" that differentiated Harley from competitors, the importance of humanizing business interactions, and practical ways any business can shift from being product-focused to becoming truly memorable in customers' minds. TimeStamps [00:00:40] - Ken's Beginning at Harley-Davidson - How Ken joined Harley-Davidson in the mid-80s when the company was struggling and most expected it to fold after 80+ years in business. [00:05:02] - The Market Situation - Ken explains how Harley went from owning 95% market share to collapsing as Japanese competitors entered with lower-priced, well-made motorcycles. [00:09:40] - The Mission to Reposition - Ken describes his job to improve Harley's image and attract investment despite the company's Chapter 11 status. [00:15:40] - The Three Questions That Changed Everything - Ken shares the three simple questions he typed out that became the foundation for Harley's brand transformation. [00:22:15] - The Five Visual Words - The afternoon brainstorm that produced five powerful words—lifestyle, freedom, camaraderie, individuality, and rebellion—that still drive Harley's brand identity today. [00:35:05] - Humanizing the Business - Ken's insights on why people naturally humanize businesses and the importance of being known for who you are, not what you do. [00:41:31] - Direct Customer Engagement - How bringing bikes to events and asking customers direct questions provided invaluable insights that couldn't be captured in surveys. [00:48:07] - Getting Executive Buy-in - The story of how Harley executives personally experienced customer feedback, which catalyzed total organizational commitment to the new approach. [01:09:38] - Remember and Repeat (R&R) - Ken's personal philosophy about creating memorable experiences that customers will share with others. [01:17:44] - Leading with Humanity, Not Products - Why showing genuine interest in people creates preference in a world where every product is seen as a commodity. Shoot us a Text.Episode #1023: From tariff talk taking over the New York Auto Show to Toyota rethinking RAV4 production, and LiveWire's electric leap into law enforcement—we've got you covered.Show Notes with links:Automakers came to New York looking to celebrate new vehicles, but found themselves answering the same old questions—about tariffs. Despite flashy debuts and high-octane reveals, the weight of trade policy loomed over every conversation.Subaru U.S. chief Jeff Walters debuted the all-new Outback, only to field immediate questions about tariffs instead of the vehicle.Nissan embraced the tension with a tongue-in-cheek window decal reading “FREE from new tariffs” on its U.S.-built models. They also revealed plans to build 80% of U.S. inventory domestically, up from 50%, citing flexibility amid tariff volatility.Tariffs dominated nearly every conference panel, with one moderator finally pausing and saying, “Ladies and gentlemen, the bar is open.” It was 10 a.m.Our friend John Bozzella of the Alliance for Automotive Innovation called for more time and flexibility, warning that rushed tariff policy could mean “increased prices and a slowing of sales.” “The key is time for adjustment,” Bozzella said. “This is a massive industry.”Toyota is reevaluating its production strategy for the next-gen RAV4, exploring a shift to U.S. manufacturing as a hedge against 25% import tariffs and currency swings.Toyota sold over 475,000 RAV4s in the U.S. last year—its most popular model, making up 20% of its U.S. volume.Originally planned for export from Japan and Canada, U.S. production in Kentucky is now under serious consideration. The shift would help meet expected demand and mitigate tariff-related costs, with potential U.S. output beginning in 2027.While plans aren't final, Toyota noted it “continually studied ways to improve its manufacturing” but declined to confirm speculation.LiveWire, the electric spin-off from Harley-Davidson, is getting into the public service game with a new line of police-spec electric motorcycles. The new fleet includes emergency lighting, sirens, and reinforced mounts, tailored for urban patrol, motorcades, and event security.Benefits include low maintenance, silent operation, and instant torque—ideal for quick maneuvering through tight city traffic.Custom ride modes, regenerative braking, and one-handed operation aim to reduce officer fatigue and improve shift efficiency.Police departments can choose from a suite of configurations, reinforcing the model's flexibility in law enforcement roles.Join Paul J Daly and Kyle Mountsier every morning for the Automotive State of the Union podcast as they connect the dots across car dealerships, retail trends, emerging tech like AI, and cultural shifts—bringing clarity, speed, and people-first insight to automotive leaders navigating a rapidly changing industry.Get the Daily Push Back email at https://www.asotu.com/ JOIN the conversation on LinkedIn at: https://www.linkedin.com/company/asotu/

Greek philosopher Plato is credited with the expression, “Our need will be the real creator,” which, loosely translated centuries later, became, “The true creator is necessity, who is the mother of our invention.” Peter Dering knows this feeling all too well, having come up with a device that, in the words of his company, Peak Design, “would make carrying and using a camera an absolute joy.”As he explains to host Mark Long in this episode of “Driven to Ride,” Dering moved to San Francisco for a construction engineering job. With his first bonus, he bought a Honda Nighthawk 750 and an SLR camera. “I used to ride with my camera slung across my chest every day,” says Dering. “Whoever designed the camera strap basically said, “Here's a business idea for you.”Nowadays, Peak Design offers a medley of innovative products, from unique backpacks and duffels to vibration-damping mobile-phone mounts and sturdy camera accessories. “We try to solve problems that we ourselves, the users of the product, encounter,” says Dering. “That's what we're known for, giving a solid rethink to products that are out there in the world.” Connect with Us:Website: www.driventoridepodcast.comInstagram: www.Instagram.com/driventoridepodcastFacebook: www.facebook.com/driventorideEmail:hello@driventoridepodcast.com

Shoot us a Text.Episode #1017: Today we talk Polestar's bold Tesla takedown with a $20K lease play, Jeff Bezos' stealthy new EV startup with big aspirations, and GM's pause on BrightDrop van production despite rock-bottom pricing.Show Notes with links:A secretive EV startup based in Michigan is gaining attention fast. Funded by Jeff Bezos and stocked with talent from Ford, GM, Harley-Davidson, and Stellantis, Slate Auto is taking a bold swing at building a $25,000 electric pickup.Founded in 2022 via Re:Build Manufacturing, Slate has already raised over $100 million and closed a Series B round. The company is targeting late 2026 production near Indianapolis, building a minimalist two-seat pickup truck.Slate's strategy flips the usual EV script—start affordable and scale with accessories, not luxury trims. Its product roadmap includes personalization, merchandise, and “Slate University” for customer-led upgrades.“We built it. You make it,” is the company's trademarked mission to empower buyers with customization.Polestar is going big to lure Tesla owners, offering a jaw-dropping $20,000 incentive for drivers to lease the new Polestar 3 luxury EV crossover—an offer good through the end of March. The deal includes a $15,000 “Clean Vehicle Incentive” plus a $5,000 “Conquest Bonus” for current Tesla owners. The offer applies only to leased 2025 Polestar 3s; delivery must be taken from existing inventory before March 31.The Polestar 3 is sleek, spacious, and built in South Carolina with top-tier tech and sustainable materials.Performance specs include up to 517 hp, a 0-60 time of 4.5 seconds, and up to 350 miles of range. The Polestar offer says: “The Polestar 3 offers more comfort, tech, and style than the aging Model Y,”GM is hitting the brakes on production of its all-electric BrightDrop van at its Ontario facility due to soft demand—despite deep discounts and compelling incentives that still make it a standout EV deal.Production at CAMI Assembly will pause April 14 and remain idle until October 2025 for retooling. The move affects nearly 500 workers and drops the plant to a single shift post-relaunch.Only 274 BrightDrop vans were sold in Q1 2025—a modest 7% increase year-over-year.The announcement follows market jitters caused by Trump's tariff threats and broader EV hesitations.“It's a crushing blow to hundreds of working families in Ingersoll,” said Unifor President Lana Payne.Join hosts Paul J Daly and Kyle Mountsier as they connect the dots across car dealerships, retail trends, emerging tech like AI, and cultural shifts—bringing clarity, speed, and people-first insight to automotive leaders navigating a rapidly changing industry.Get the Daily Push Back email at https://www.asotu.com/ JOIN the conversation on LinkedIn at: https://www.linkedin.com/company/asotu/

I had the privilege of attending the 2025 Harley-Davidson press event in Austin, Texas, where the motor company unveiled something truly extraordinary. Behind closed doors, away from prying eyes, sat a motorcycle never seen before—until now. By the time you read this, the embargo will have lifted, and I can finally introduce you to the 2025 Harley-Davidson CVO Road Glide RR, a machine that takes inspiration straight from MotoAmerica King of the Baggers racing. This is not just another touring bike. The 2025 CVO Road Glide RR is a limited-production, handcrafted masterpiece, designed for those who demand top-tier performance and exclusivity. With only 131 units being produced and sold exclusively through select U.S. dealers, this is a collector's dream. Before you dismiss the $110,000 price tag, consider what this bike represents. It's Harley-Davidson's most powerful and dynamic production motorcycle ever, a statement piece showcasing the company's engineering excellence and commitment to performance. I only had 10 minutes with this bike, but that was enough to recognize its sheer presence. Every time I review my video footage, I notice new details—a testament to the level of craftsmanship poured into this machine. This isn't just a motorcycle; it's a bold statement from Harley-Davidson. Whether you love it or hate it, you have to respect what they've accomplished here. Now, I want to hear from you!
