Core exercises and workouts help strengthen the muscles in your abdomen, back, and your pelvic floor. In many cases, working out core muscles may aid in your ability to do physical activities, restore damaged muscle groups, and aid in load and weight lifting. However, there are many fitness gurus and exercise routines that encourage unhelpful and potentially damaging core exercises. One of the scenarios I run into many times with my clients is that they are encouraged to build core strength through navel to spine exercises. They are taught that in order to fully engage in fitness culture, they must try to achieve a flat belly or toned abs in order to be healthy. That cannot be any further from the truth. This is the heart of what I teach in the Restore Your Core program: navel to spine does not work. Arbitrarily pulling our navel in, tightening the core to do exercise does not rewire, re-pattern, remind our bodies of what they need to do all day long. And if you are working out 1-2 hours a day and doing a lot of navel to spine but then the other 12 hours a day of waking time, your core is not reflexively doing its job – then those 2 hours on the mat are not useful. In this article, we seek to address the proper way to pursue a strong core rather than doesn't sacrifice function for sexiness. How Long Does it Take to Restore Your Core? I wish I had an insta solution for addressing Diastasis Recti, but unfortunately, I do not. Getting a functional core is a process that involves many things including alignment, breathing mechanics and finally, the right way to train using exercise. The whole goal is to train your body to react and respond appropriately to your movements and activities. (Restore Your Core program is based on this approach.) Effective Core Exercises & Training Ensure you are not a belly breather. Belly breathing causes a lot of intra abdominal pressure and that can lead to a diastasis recti and pelvic floor dysfunction.Work on your posture and body alignment as both compromise your core.Stop sucking in your belly all day because that does not work. Here is an alternate way to practice core engagement that doesn’t suck, suck, suck your belly in and it actually works. Try it: Come to your hands and knees. Ensure that your spine has neutral curves: lower back has a slight arch and upper back is slightly rounded. Booty untucked gently. Look between your hands and imagine you have a cake between them with 100 candles. Inhale and exhale to slowly blow all 100 candles out. You should feel your belly lift away from the floor and tighten. That is your deep core. Do the same thing sitting. Sit comfortably with a neutral spine. Imagine now you are blowing out a dandelion. Slowly exhale and feel how your core responds. Amazingly, these simple exercises are key to effective core training. The next step is to get more and more complicated with the exercises so that each time your body needs support of your core – that exhale will direct the support mechanism to engage. The more you do that, again and again, and the harder and more progressive the exercises – the more reflexive your core will be. Your reflexive core will kick in for you for all of your activities because your deep internal support system will be back online.
Post-pregnancy pain, whether it be pelvic floor pain or joint pain, is a shared experience among many postpartum people. However, postpartum pain, especially in pelvic pain, can vary in frequency, length, and intensity. Some people may only experience short-term pain that lasts the first 4 – 8 weeks of their recovery and others may suffer from pelvic pain for up to or over a year after they’ve given birth. Pelvic organ prolapse and other forms of pelvic floor dysfunction are very common among postpartum people. Symptoms can vary in duration and severity, but many women are likely to experience a variety of symptoms during and after their pregnancy. Whether you visit a pelvic floor physical therapist or take part in a program like Restore Your Core, movement specialist or your physical therapists will utilize exercise methods designed to strengthen and restore function to your core, pelvic floor muscles, and relieve any painful symptoms you may be experiencing. In this article I will attempt to address the most commonly asked questions regarding pelvic pain after giving birth. How Long Does it Take for Your Pelvic Floor to Recover After Childbirth? After giving birth, your pelvic floor and core muscles will be in the process of healing for at least a year. Although many women may begin being active again after the first 8 weeks postpartum, often pelvic pain and the symptoms of diastasis recti may be experienced for months postpartum. Both your core and your pelvic region have gone through significant changes in order to accommodate your baby. Attempting to quickly get back into an exercise or workout routine may be unhelpful in your recovery – especially if you are already experiencing complications or painful symptoms. Every postpartum person is different and the recovery length can change depending on many factors. Healing can take anywhere from a few months to over a year, depending on whether or not there are underlying conditions which may be increasing the pain. While there are no overnight success stories, there are many many success stories of people like you who have healed their pelvic organ prolapse by taking these steps slowly and surely. However, there are many things you can begin doing now to help begin the healing process. Here is a video summary covering some of the steps you can take to begin healing your pelvic floor. Is it Normal for Your Pelvis to Hurt After Pregnancy? Yes! Postpartum pelvic pain is very common. During childbirth, your ligaments and joints become loose as your body is adapting to your child’s weight, abdominal separation, and increased heaviness in your pelvic floor. It is common to experience pain in your pelvic girdle, hips, and joints as a result. Light recovery exercises and movement can also cause minimal pain as you begin strengthening your pelvic floor muscles. Seeing a pelvic floor physical therapist or enrolling in a yoga or postpartum exercise program can help relieve urinary incontinence, back pain, and other postpartum pelvic issues.

Copyright in a Nutshell for Artists & FilmmakersBrian L. FryeIntroductionHello! Welcome to this introduction to copyright for artists and filmmakers. I’m Brian L. Frye. I’m a professor of law at the University of Kentucky College of Law, where I teach copyright law, among other things. But I’m also an artist and a filmmaker. I earned an MFA in film from the San Francisco Art Institute, was included in the 2002 Whitney Biennial, and co-produced the documentary film Our Nixon, which premiered at SXSW and was broadcast on CNN. So, I understand copyright not only from the perspective of a lawyer, but also from the perspective of an artist and a filmmaker.The purpose of this lecture is to help you understand copyright law and how it affects artists and filmmakers. Hopefully, they will provide practical information that will be useful for practicing artists and filmmakers. Obviously, I can’t even begin to explain all of copyright law in an hour. But I will address the most important concepts and help you understand how they apply to art and movies.I’ll begin by asking why copyright exists in the first place. There are lots of ways to answer that question. For example, some people think the purpose of copyright is to help authors profit from their works. Other people think it’s to help authors control the use of their works. And still others think it’s to benefit the public, by encouraging authors to create works in the first place. Maybe all of those reasons are true. Often, they all point to the same answer. But sometimes they conflict with each other. And when they do, we have to ask which reason is the most important and why.Next, I’ll ask what copyright protects. The answer is, almost everything! Copyright protects the original elements of a work of authorship. But it is very forgiving. Essentially, an element of a work is original so long as it isn’t copied from another work.I’ll ask how you get a copyright, and what you should do once you have one. The answer is, it’s easy! As soon as you create a work, you own a copyright in all of its original elements. No need to do anything else. But you can and should register the work with the Copyright Office, if you think it might have commercial value, because you usually can’t enforce your copyright without registering it.I’ll ask how long a copyright lasts. The answer is, almost forever! Currently, the copyright term is usually the life of the longest-lived author of a work, plus an additional 70 years. The exception is that copyright in works created for an employer lasts 95 years from creation or 120 years from publication, whichever expires first. When the copyright term ends, a work falls into the public domain, which means that anyone can use it in any way they like, without asking permission.I’ll ask what copyright does. The answer is, it gives authors certain exclusive rights to use the works they create. Specifically, copyright gives authors the exclusive right to copy, sell, and show their works, as well as the exclusive right to create new works based on their works. Of course, authors can sell those rights to others. And there are also certain limits on their exclusive rights, including fair use.I’ll ask what counts as copyright infringement. The answer is, any use of a work that violates one of the exclusive rights of the copyright owner may be infringing, unless the owner gave permission. In other words, copying a work, selling copies of a work, and presenting a work to the public all may be copyright infringement. Likewise, using elements of a work to create a new work may also be copyright infringement, if the new work is sufficiently similar to the original.I’ll ask what happens to copyright infringers. The answer is, nothing good! The copyright owner can not only force them to stop infringing, but also force them to pay damages. Copyright owners who prove infringement are always entitled to actual damages, but many copyright owners are also entitled to statutory damages, which may be substantial, even if the cost of the infringement was trivial.And I’ll ask what fair use is and why it matters. The answer is that it’s the most important exception to copyright infringement, because it ensures that copyright permits free speech. Among other things, the First Amendment prevents the government from limiting speech, without a really good reason. Copyright necessarily limits speech, by preventing people from using works in certain ways without permission. Fair use says that copyright owners can’t stop people from criticizing or discussing their works.Obviously, there’s a lot more to copyright than these eight questions. But I think they will help you better understand what copyright is for, what it protects, what it prohibits, and what it permits. And maybe most importantly, I hope they encourage you to ask what copyright actually does, whether it is effective, and how we could improve it.What is Copyright?You may have heard people talk about “intellectual property,” a blanket term for ownership of expressions and ideas. Copyright is a kind of intellectual property that protects original works of authorship. Other kinds of intellectual property include patent, which protects novel inventions and discoveries, trademark, which protects distinctive marks used in commerce, and trade secret, which protects confidential commercial information. While we refer to all of these things as intellectual property, they don’t really have anything to do with each other, other than that they all protect “knowledge goods,” or valuable concepts.People often confuse the different kinds of intellectual property. That’s a problem, because they protect different things in different ways. For example, in order to get a patent, you have to describe your invention to the Patent Office and explain why it is new. If you get a patent, it can only protect the new thing you invented, and other people can use your invention to create other new things. In order to get a trademark, you have to use a symbol in a way that communicates information to consumers. For example, you could use the word “apple” to tell consumers who made a computer. Or you could use the word “amazon” to tell consumers who is selling a book. For what it’s worth, a commercial publisher uses the phrase “in a nutshell” to identify its legal study aids, but they did not publish this lecture or essay, and I have nothing to do with them. Are you confused?Anyway, copyright gives authors ownership of the works they create. Or rather, copyright says that no one can copy, sell, or show a protected work, without the 7author’s permission. Copyright has existed for a long time, more or less since the printing press made it possible to publish books. Copyright forced publishers to compete by selling different books, rather than by selling the same books for lower prices.The Constitution gave Congress the power to create copyright in the United States, and it did. In the United States, copyright is created almost entirely by federal law. While most other countries have also created copyright, different countries protect copyright in different ways. However, most countries have joined the Berne Convention for the Protection of Literary and Artistic Works, which provides some common ground.People disagree about the purpose of copyright. In the United States, most people think the purpose of copyright is to encourage authors to create new works. If copyright didn’t exist, people wouldn’t have to pay for works of authorship, and it would be hard for authors to make a profit. Copyright means authors can force people to pay, which encourages them to create more works. This is an economic theory of copyright, because it says that the purpose of copyright is to benefit the public, by encouraging authors to produce works the public wants.But many people think the purpose of copyright is really to protect authors. Some people think that authors have a natural right to own and control the works they create. After all, a work doesn’t exist until an author creates it. Surely people ought to be able to control the things they create? Other people think authors ought to be able to control the use of the works they create, because they express the autonomy and personality of the author. Why shouldn’t people be able to control the use of their ideas and expressions? These are moral theories of copyright, because they say the purpose of copyright is to protect the rights of authors.Theories of copyright matter, because they shape what copyright protects and prohibits. We decide what copyright should do by asking what copyright is for. Often, economic and moral theories of copyright reach the same results. But sometimes they don’t. For example, the economic theory of copyright says people can use a work, so long as they pay for it. But the moral theories say authors can stop people from using their works, even if they are willing to pay. So, is copyright about compensation or control? As always, it depends. But how we answer that question shapes both copyright and the freedom of speech.What Does Copyright Protect?Copyright protects original works of authorship fixed in a tangible medium. That’s a mouthful, but it doesn’t mean much. As a practical matter, copyright protects just about everything you create. Obviously, copyright protects books, songs, paintings, and movies. But that’s not all. Copyright protects a lot more besides. Every email, tweet, instagram, tiktok, snapchat, and text is also protected by copyright, so long as it’s arguably unique, even in the most trivial way.But I’ll be more specific. The Supreme Court held that a work of authorship is original and can be protected by copyright only if it was independently created by the author of the work and reflects some minimal degree of creativity. Independently created just means not copied. Even the most banal work is independently created, so long as it isn’t a copy of another work. After all, most emails aren’t copied, and every snapshot is by definition unique. Of course, copyright also requires creativity. While it’s unclear what creativity requires, it clearly doesn’t require much. The Supreme Court held that copyright couldn’t protect a white pages telephone directory, because it totally lacked creativity. But it implied that copyright could protect anything else.Some works of conceptual art might not be protected by copyright, if they are sufficiently abstract. But the overwhelming majority of works are obviously protected. As a rule of thumb, if your work consists of more than an abstract idea, it’s almost certainly protected by copyright.What’s more, copyright protects every original part of a work. So, if you create a work, you own the work as a whole, but you also own all of the original elements of the work. Obviously, copyright protects the sentences in a literary work and the images in a pictorial work, but it may also protect a particular way of expressing an idea in literary or pictorial form.But copyright can’t protect abstract ideas, only particular expressions of those ideas. In other words, as the elements of a work get more abstract, they get less copyright protection, until they get none at all. Or rather, copyright can protect a particular way of expressing an idea, but can’t protect the idea itself.An important thing to remember is that copyright only protects intangible works of authorship, not particular copies of those works. So, copyright protects the text of a novel, not particular books. But copyright also protects the intangible work of authorship expressed in a painting or sculpture, not the physical object itself.How Do You Get a Copyright?I bet you’ve heard people talk about copyrighting their work of authorship or telling you to copyright something you’ve created. They don’t know what they’re talking about. Copyright isn’t a verb. You can’t copyright anything, because copyright automatically protects works of authorship, as soon as they are created and recorded.The Copyright Act provides that copyright protects original works of authorship fixed in a tangible medium. In other works, as soon as you create something and create a record of what you created, it’s protected by copyright, automatically. You wrote down a poem? It’s protected by copyright. You recorded a song? It’s protected by copyright. You made a video? It’s protected by copyright.Of course, you can also register your work with the Copyright Office. Registration doesn’t create copyright ownership. But it does give copyright owners certain valuable rights, including the right to sue for copyright infringement, and the right to demand statutory damages, as opposed to actual damages, which may often bee nominal.Copyright registration is easy and relatively inexpensive, and you can do it online. If you’ve created a work you think might have commercial value, it might make sense for you to register it. You might even be able to register several works at the same time. But you don’t need to register your works in order to own a copyright in them. And it probably doesn’t make sense to register them, unless you want to be able to stop people from using them without your permission.Anyway, whether or not a work is registered, the author can only own the original elements. Sometimes, they are quite valuable, but more often than not, they aren’t. More often than not, copyright is a way for people to accept that the dream is over, because no one is offering a better deal.Who Owns a Copyright?In theory, copyright ownership is simple. If you create a work of authorship, you own the copyright in the work you created. But in practice, it can get complicated. After all, some works are created by many different people, and many works are created for an employer.When people create a work together, everyone who participates is an author and a copyright owner, so long as they contribute an original element that copyright can protect and everyone agrees they are a co-author. So, if you have the idea for a work, but don’t actually participate in creating it, you aren’t an author or copyright owner, because copyright can’t protect ideas. And if you edit a work created by someone else, you aren’t an author or a copyright owner, unless the original author agrees.Co-authors own the copyright in a work jointly. In other words, all of the authors own the entire work collectively, and all of the authors can use the work in any way they like, so long as they don’t harm the value of the work, and share any profits with the other owners. Of course, the owners of a work can make more complicated agreements about how to use the work and share profits, as well.If a work is created by an employee for an employer, then it is a “work made for hire,” and the employer is the author for the purpose of copyright ownership. For some works, like movies, everyone can agree that the work is a work made for hire in a signed contract. But many works, like books and paintings, can be works made for hire only if the person who creates them is actually an employee, which usually means they have to be on payroll.Copyright is a property right, so it can be transferred, like any other property right. While the author of a work is the initial copyright owner, the author can transfer copyright ownership to someone else. Authors can even transfer copyright ownership before they even create a work. In addition, copyright owners can transfer as much or as little of their copyright as they want. If you own the copyright in a movie, you can sell it to someone else, or you can sell part of the copyright, like the right to show the movie in a particular place, in a particular way, for a particular period of time.When authors sell their copyright in a work, they may eventually be able to get it back. The Copyright Act allows authors to terminate the transfer of copyright after 25 years, by following certain procedures. However, the person who created a work can terminate its transfer only if they were the initial author and copyright owner. In other words, an employee can’t reclaim the copyright in a work made for hire, because they were never the author in the first place.How Long Does a Copyright Last?The length of copyright protection has gradually increased over time. Initially, copyright lasted 14 years, but could be renewed for another 14 years. Every once in a while, Congress made the copyright last longer, until it lasted 56 years. Then, in 1976, Congress revised the Copyright Act to make copyright last until all of the authors of a work died, plus an additional 50 years. And in 1998, Congress made copyright last an additional 20 years.Today, copyright usually lasts for the life of the author or authors of a work, plus an additional 70 years. However, because the author of a work made for hire is usually a company, copyright in those works lasts for 95 years from publication or 120 years from creation, whichever ends first.When the copyright in a work ends, it enters the public domain, which means no one owns it anymore, and anyone can use it in any way they like. Every year, on January 1, works published 95 years earlier enter the public domain. So, in 2020, works published in 1925 entered the public domain.In theory, copyright is supposed to ensure that works are available to the public, by giving copyright owners an economic incentive to publish them. But in reality, most of the works protected by copyright aren’t worth anything when they are created, and even those that are worth something quickly lose their value. As a result, many works are unavailable, because the copyright owner can’t be bothered to publish them. But copyright means that no one else can publish them either. Scholars have observed that public domain works are far more widely available than works protected by copyright, precisely because people can make them available without worrying about infringement.Many people think copyright lasts too long and protects too many things. They think more works should be in the public domain and people should be able to use copyrighted works more freely. Unfortunately, the law isn’t on their side. Congress assumes people want to own whatever they create, and tends to make copyright stronger and longer, rather than shorter and weaker. In fact, the Copyright Act doesn’t even provide a way for people to put works they own in the public domain.Accordingly, people who want less copyright protection created Creative Commons licenses, which enable copyright owners to give people permission to do things copyright prohibits. After all, if copyright owners can sell their rights, they can also give them away. The most popular Creative Commons license is the CC-BY license, which permits people to use a work in any way they like, so long as they credit it to the author. But there is also a CC0 version, which declares a work to be in the public domain.What Does Copyright Do?Copyright gives copyright owners the exclusive right to use the work they own in certain ways. That’s why we call it a property right. It creates the right to exclude people from using a work without permission. Broadly speaking, copyright gives copyright owners four exclusive rights: reproduction, distribution, presentation, and adaptation.The reproduction right is the essence of copyright. It says that copyright owners have the exclusive right to create copies of the works they own. In order to use a work, you need a copy of it. The reproduction right enables copyright owners to control access to a work by controlling the creation of copies. Of course, it is often observed in the breach. People often create copies of works, without even realizing they are infringers. After all, if you’ve ever created a mixtape for your friend, or written down the lyrics of your favorite song, you’ve infringed the reproduction right.The distribution right reflects the reality of copyright ownership. The primary purpose of copyright is to enable copyright owners to profit from the works they own. Accordingly, copyright owners care about commercial uses of their works, but don’t care about private uses. The distribution right gives copyright owners the exclusive right to distribute copies of their works to the public. Or to put it more bluntly, only copyright owners can sell copies of their works.The most important limitation on the distribution right is the first sale doctrine, which says that copyright owners can only control the distribution of a particular copy of their work the first time it is sold. The first sale doctrine is why we have used bookstores and record stores. Only the copyright owner can create and sell copies of a book or record. But once they sell a copy, it’s just a thing, and the owner can sell it like any other thing.The transition from physical to digital media is a problem for copyright, because it’s unclear how to distinguish between a work and copies of a work. It used to be that copyright protected a story or a song, but not a particular book or record. But what is the difference between a story and text file, or a song and an audio file? What does it mean to own a digital file, if anything?The internet is also a problem for copyright because it makes reproducing and distributing works essentially free. Back in the day, it was expensive to make copies of a work and make them available. Now, it’s effortless and free. Suddenly, copyright ownership is pure profit, with little or no risk, once a work proves popular. But how much should copyright owners be able to charge, as their costs evaporate? Copyright was designed for a world in which reproduction and distribution were costly. Does it make any sense in a world where they are free?The presentation right gives copyright owners the exclusive right to publicly display or perform the works they own. It used to be that public display and performance was how copyright owners made money. For example, when people went to movie theaters, the public performance right enabled movie producers to profit from every screening. Today, the public display and performance rights are important primarily because they supplement the distribution right.The adaptation right gives copyright owners the exclusive right to create derivative works, or new works based on a work they own. Typically, that means translating a work into a different language, transforming it into a different medium, or creating a sequel. But the adaptation right is much broader. It gives copyright owners the exclusive right to use any original element of the work they own, which means every sentence of a book, riff in a song, or sequence in a movie might be protected by copyright.Almost everything we create is a derivative work, even though we don’t realize it. The Copyright Acts says that a derivative work is a work that incorporates an original element of a previously existing work. Well, most works owe at least something to an existing work. And quoting or paraphrasing an existing work is a great way to make your work a derivative work, at least from a copyright perspective. We tell ourselves that works are original, but in reality almost all of them are based on something else. And we like it that way. People tend to like familiar things, and dislike weird ones. Most people don’t like creativity all that much. A little bit is fine, but don’t overdo it.Anyway, while most people think copyright protects works as a whole, it actually protects every element of a work, no matter how small, as long it qualifies for copyright protection. Of course, copyright protects almost everything, so almost every element of a work is protected by copyright, whether or not the author even realizes it. For better or worse, any element of a work that makes people think about the work is probably protected by copyright, and lots more besides!Copyright also gives artists special protections. In 1990, Congress passed the Visual Artists Rights Act, which gave artists the rights of attribution and integrity, in order to bring United States copyright law in line with the Berne Convention. The attribution right enables artists to prevent plagiarism and the right of integrity enables artists to prevent the destruction of their works. But VARA doesn’t really do all that much. It only applies to unique works, only protects important works, and can be waived by the artist. When a work is valuable, the owner usually wants to attribute and protect it. The only time VARA really matters is when the owner of a work wants to get rid of it. Many recent VARA disputes involve graffiti. When a property owner wants to demolish a decorated building, in order to create a new one, who’s in the right? It all depends on how you think about copyright ownership.What Is Copyright Infringement?Copyright is a property right. The primary purpose of copyright is to prevent people from using a work without permission. And any commercial use of a work might be infringing. But of course, it depends. In order to prove copyright infringement, a copyright owner has to show the defendant actually copied a protected element of the work, and that the works are similar, because of the copied element.Actual copying matters, because most works are similar to each other. Or rather, copyright only protects the original elements of a work, but most works aren’t all that original, and people have a disconcerting tendency to arrive at the same ideas at the same time. Sometimes, works are similar because of copying. But often, it’s just a coincidence. It’s not unusual for people to have similar ideas at the same time.But copyright infringement also requires substantial similarity. In other words, a new work infringes a previously existing work only if it actually copies elements of the previously existing work, and is substantially similar to that work, because of what it copied.Different courts have different ideas about how to identify substantial similarity. Some courts identify the protected elements that the allegedly infringing work copied, and ask whether copying those elements constitutes infringement. Other courts just compare the two works, and ask whether they are similar. Obviously, how you ask the question affects the outcome. On one level, more copyright protection is good for artists and filmmakers, because it enables them to exercise more control over their works, and claim more profits. But on another level, its bad, because copyright makes it harder for artists and filmmakers to use existing works in order to create new works.More often than not, artists and filmmakers want to have it both ways. They want to be able to use existing works when it’s convenient. But they also want to control the use of the works they create. How should we square the circle? Should we let authors control how people use their works, or should we let people use works however they like?You’ve probably heard about plagiarism. It’s similar to copyright infringement, but different. Copyright gives authors certain rights to control how their works are used, in order to enable them to make a profit from selling their works. Plagiarism norms allow people to copy and use works without permission. They only require attribution. But if you copy a work without attribution, the plagiarism police will make you sorry.Notably, plagiarism norms protect works and elements of works that copyright can’t protect. Copyright can’t protect ideas, but plagiarism norms do. Copyright says you can copy ideas willy-nilly. But the plagiarism police will punish you if you copy ideas without attributing them to their “owner.” Similarly, copyright says you can use public domain works in any way you like, but the plagiarism police disagree. For example, copyright says that I can publish The Importance of Being Earnest by Brian L. Frye. After all, it’s a public domain work, and I can use it in any way I like. But plagiarism norms say I can’t, and the plagiarism police would punish me if I tried.What Happens to Copyright Infringers?Copyright enables copyright owners to profit from their works. But it also lets them force other people to shut up. When a copyright owner notices that someone is using their work without permission, they can tell them to stop. If the work is registered with the Copyright Office, they can also file an infringement action. Even if you prove infringement, it can be hard to prove damages. But the Copyright Act enables copyright owners who register their works to claim statutory damages, which can be substantial, even if there is no evidence of actual harm. In fact, statutory damages can be as much as $150,000 per infringement, although courts usually award less. Still, the risk of damages can encourage defendants to settle, even if the infringement claim is weak.Copyright owners can also seek an injunction, to prevent an infringer from using their work. The problem is that injunctions can infringe free speech. After all, copyright owners are usually happy for people to use their works. If they want people to stop, it’s usually because they want to control what people have to say. But sometimes, people use copyright because they don’t have any other choice. For example, some people have used copyright to suppress images and videos of themselves. It’s understandable that people would use any tool available to protect themselves. But should they have to rely on copyright? After all, it applies to some offensive works, but not others. Or should we find another way to suppress offensive works?But the internet has its own rules. Many people think the internet is a copyright-free zone. Wrong! But it can be hard to enforce copyright on the internet, not only because so many internet users are anonymous, but also because the internet is just too vast to monitor.Anyway, most copyright owners want to stop popular platforms like YouTube and the Internet Archive from providing infringing content. Not to mention illicit pirate sites. In 1998, Congress passed the Digital Millennium Copyright Act or DMCA. Among other things, section 512 of the DMCA gave websites a safe harbor to protect them from copyright infringement liability for third-party content. Under the DMCA, if a copyright owner tells a website that someone has uploaded an infringing file, the website is immune from liability if it takes down the content. If the person who uploaded the content objects to the takedown, the copyright owner has to file an infringement action. If they don’t the website can restore the file.What is Fair Use?Copyright prevents people from using works without permission. But copyright has many exceptions. The most important exception is fair use, which provides that people can use works without permission, if they have a good reason. Essentially, copyright says that copyright owners have an exclusive right to use the works they own in order to make money. But fair use says that everyone else has a right to use those works in order to talk about them, so long as they aren’t competing with the copyright owner.In other words, copyright says that the copyright owner of a book has the exclusive right to reproduce and sell copies of the book. But the fair use doctrine says that other people have the right to copy parts of the book in order to criticize it, or comment on its reception. Fair use ensures that copyright owners can’t abuse copyright, by preventing them from asserting copyright claims against infringers who are engaging in protected speech.The fair use doctrine has existed for a long time. In fact, a version of the fair use doctrine is probably as old as copyright itself. After all, when publishers invented copyright in the 17th century, it reflected industry norms and expectations, same as always. When copyright became a property right, rather than a cartel norm, courts recognized certain exceptions, which came to be known as fair use. And when the United States created copyright law, courts read fair use into the statute.Eventually, Congress codified the fair use doctrine in the Copyright Act of 1976. At least in theory, the codification wasn’t supposed to change the law. Among other things, it identified four factors that courts should consider when determining whether an unlicensed use of a copyrighted work is a protected fair use:Whether the use transforms the original work;Whether the original work is factual or fictional;How much of the original work is used; andWhether the new work is a substitute for the original work.Typically, the first factor is the most important. Courts tend to ask whether the use of a work is transformative. If they answer yes, it’s almost always a fair use. The problem is that no one knows what “transformative” means. Sometimes, a use is transformative if consumers can tell the difference between the original work and the new work. But sometimes it isn’t. After all, a court held that Blurred Lines infringed Got to Give It Up, even though no one could possibly confuse the two songs. Sure, they are similar, but they aren’t the same. Transformativeness says changing a work avoids copyright infringement, but it doesn’t tell us how much change is necessary.At the end of the day, courts don’t actually rely on the fair use factors, any more than they rely on any other doctrinal test. In reality, they ask themselves whether a use is infringing, and use the test to explain their decision. So, a use is transformative if the judge thinks it should be protected, and not transformative if the judge thinks it should be infringing.The Supreme Court has explicitly recognized that copyright owners can’t prevent people from making fun of their works. But it hasn’t done a great job of explaining the scope of the fair use doctrine. Many people think fair use protects parody, and little more. They’re wrong. Fair use can protect any critical use of a work that isn’t a substitute for the work it criticizes.Many people are critical of fair use. Some of them think it goes too far. After all, why should people be able to use a copyrighted work without permission, or even paying a licensing fee? But others think it doesn’t go far enough. The copyleft advocate Lawrence Lessig famously referred to fair use as “the right to hire a lawyer,” because it can be hard to know whether you are protected, and expensive to defend yourself, if a copyright owner disagrees.But copyright maximalists and copyright skeptics both go too far. Yes, there’s a lot of copyright infringement, and it can be hard for copyright owners to stop it. But works are made to be used. And users have rights too, whether or not authors like it. For example, fans can and should be able to use the works they love to create new works, especially when they do it for free. Sure, some authors don’t like it. But when you create a popular work, public commentary comes with the territory.As for copyright skeptics, they’re right that fair use can be dangerous ground. But at the same time, we do fair use all the time, without even thinking about it. After all, quoting an article is technically infringing, but fair use. And yet, we don’t think of it that way. Rather, we just think of it as non-infringing. The purpose of fair use is to force us to have a conversation about the kinds of uses we want copyright owners to be able to control, and the kinds of uses we want to protect.And things have begun to change, especially for filmmakers. Thanks to the efforts of copyright lawyers like Michael Donaldson, filmmakers who claim fair use can insure themselves against the risk of copyright litigation. If you can insure yourself against a risk, you can safely ignore it. As a consequence, filmmakers take full advantage of the fair use doctrine.Artists have always ignored copyright, using whatever they like to create their works. As Picasso famously observed, good artists copy, but great artists steal. Actually, he probably lifted the quip from someone else. The point is that artists usually don’t care about copyright, because they typically create and sell unique objects, not copies. But some artists have been hit with copyright infringement actions anyway. Andy Warhol copied the image he used for his popular Flowers paintings, and ultimately paid a licensing fee. More recently, Jeff Koons and Richard Prince have been sued for copyright infringement, with mixed results. Maybe artists need a way to insure themselves against copyright infringement actions, too?At the end of the day, the purpose of the fair use doctrine is to ensure that people can use copyrighted works in productive ways. Does it always accomplish that goal? No. But at the very least, fair use encourages people to think about what copyright is supposed to do, and what it is supposed to accomplish. Episode 6: In today’s episode, Trevor Smith, Louisville SSI attorney, discusses a question he often gets from parents, “Does my child qualify for SSI benefits?” He’ll explain how the evaluation criteria, issues parents need to consider and how he can assist parents in filing for SSI benefits. There are 6 domains used by the social security administration to evaluate a child for Supplemental Security Income payments: Acquiring and using information Attending and completing tasks Interacting and relating with others Moving about and manipulating objects Caring for yourself Health and physical wellbeing The child must demonstrate a “marked” limitation in 2 of the above domains or have an extreme limitation in one of them. The term “marked” falls between medium and extreme. Evidence will typically come from the school records and information provided by teachers and counselors. Trevor has a series of forms that he gives to parents for the school to complete. Judges put a lot of emphasis on the feedback provided by the teachers and counselors. Common Issues Considered Does your child have an IEP at his/her school? Is there a cognitive issue or behavioral issue (including ADHD and /or autism)? Is there a birth defect or physical issue with a limb? Is the child blind? Was the child severely injured? Interestingly, being diagnosed with ADHD or autism does not automatically mean the child qualifies. SSI Benefits can be up to $780 per month. The child will also get Medicaid. Remember though, the qualification for benefits involves an income test. If the family has resources, the child may not qualify for SSI benefits. How Does the SSI Application Work? Trevor cannot file the initial application for a child’s SSI. The parent needs to apply. However, if the application is denied, Trevor can then step in and assist the parent, on behalf of the child. Can the Social Security Administration Stop the Payments? Once the child is receiving supplemental security income payments, the social security administration may decide to stop the benefit payments. This is called cessation. Trevor can represent the family/child in appealing the attempt to stop the SSI benefits. During the appeals process, the family can elect to continue receiving payments. If the appeal is unsuccessful, the family must repay the money received during the appeal. The family can decide to not receive payments during the appeal. If Trevor wins the appeal, the payments will be reinstated and the family will receive the back pay (the money they should have received while the appeal was being handled). How Long Does the Process Take? Once the application is filed, they may not receive a decision for 180 days. If they are denied, they only have 60 days to appeal the decision (“request for reconsideration”). There can actually be a series of denials. The key point to remember is that you shouldn’t get discouraged. Be patient and don’t give up. Nenad Trunic, Offensive and Defensive Concepts For Teaching The Pick and Roll Guest: Nenad Trunic, Former Technical Director and Coordinator of Youth Basketball Program in Iran In this week’s coaching conversation, Nenad Trunic joins the Basketball Podcast to discuss offensive and defensive concepts for teaching the pick and roll. A key lecturer with FIBA Europe clinics, the Serbian-born Nenad Trunic has spread his teachings on basketball in dozens and dozens of countries, and through two books. There are plenty of pins on Trunic world map where he taught: Italy, Germany, France, Slovakia, Jordan, Poland, Sweden, Qatar, UAE, Egypt, Turkey, Portugal, Croatia, Lithuania, Ukraine, Netherlands, Romania, Canada, Israel, Bulgaria, Belgium, Norway, Iceland, Ireland, Estonia, Montenegro, Cyprus, Lebanon, and the Philippines. The Case: Jake is 3 and suddenly, he can’t sleep through the night. He doesn’t want to be in his room alone and seems scared. Mom and Dad don’t want him co-sleeping but they’re exhausted from the sleep deprivation caused by getting up multiple times a night to put him back to bed. They tried leaving his door open, keeping a light on, essential oils, and even supplementing his diet with calcium, magnesium and GABA. They knew they couldn’t go on like this, and they had to get to the bottom of this new sleep-resistance. Many parents encounter sleep pattern changes with their babies and toddlers. In some cases, it can be attributed to changes to the environment or the schedule. In other cases, the cause is unknown and the solution may not seem obvious, especially if both parents are becoming increasingly sleep deprived as they deal with their wide-awake child. The Investigation This health mystery was personal. I mean that literally. Jake, the suddenly sleep-resistant child is mine. Those bone-tired parents, that was my husband and I. Our son had been a good sleeper but as he started to outgrow his crib, something happened. He became frightened easily, refused to go to sleep unless one of us was in the room, and then he’d wake up a few hours later and we’d have to go through the whole routine again. The lack of sleep was making him unhappy and it was starting to affect our health. And, we started to give in to his demands. It meant we got more sleep, but I knew we were on a slippery slope. I reached out to Kimberly Walker, a sleep consultant to help us get to the root of Jake’s sleep pattern issue. She’s the founder of Parenting Unlimited, is a licensed social worker and has 17 years of experience helping parents as a pediatric sleep consultant. Sleep Regression When babies or kids go from sleeping through the night to struggling with sleep, it’s often called sleep regression. Kimberly says that many parents want to believe that it’s a phase; something that kids will fix on their own. However, if it’s been going on for 2 weeks or more, then Kimbely says, the child is forming a new habit and the problem won’t be solved without interaction. Plus, if it’s causing sleep disruptions for the whole family, then it’s something that parents need to take action for the health of everyone who is impacted. A lot of parents wonder ‘What happened? Why isn’t my child sleeping through the night anymore?’ There are many things that can trigger a sleep regression but Kimberly says trying to figure out ‘why’ is pointless. You don’t need to know what caused the sleep regression in order to fix it. Sleep Training vs. Sleep Teaching There are two common phrases used for helping children learn how to fall asleep (and fall back asleep) on their own. However, Kimberly says there is essentially no difference between ‘sleep training’ and ‘sleep teaching’; they both teach children the skill of putting themselves to sleep without the aid of anything. This includes learning to fall asleep without a pacifier, a parent present, or (for babies) without being rocked. Many people assume that falling asleep is an innate skill but Kimberly says it is something that we have to learn. The Cause of Bad Sleep Habits Parents often rely on their loving instincts to soothe their child. It can be very difficult not to go to their child and hold them when they are sick, scared, or unable to sleep. However, Kimberly points out that kids are smart and they learn that certain behaviour or circumstances result in getting more attention and love. They use this learning to get more of what they want (hugs, snuggles, time with mom and dad). This then creates a bad sleep pattern habit. For example, if every time they wake up in the middle of the night they cry out and mom comes running and then stays with them until they fall asleep, they will cry out every time they wake up without mom beside them. And then, the child can no longer fall asleep without mom there. Parental Emotional Challenges in Sleep Training It can be very hard for a parent who is trying to train their child to fall asleep and stay asleep without any help. Because, their instinct to soothe is going to kick in. Many worry that the anxiety caused by not being soothed by a parent will cause the child emotional stress that can harm the child physically and psychologically. Kimberly argues that the stress is happening anyway when the child wakes up in distress because mommy is no longer sitting where she was when they fell asleep. And, that when parents acknowledge the child’s emotional challenge but encourages them to work through it, it teaches the child resilience. (And the parents a bit too). Is Co-sleeping Bad? Contrary to what Kimberly teaches (that kids should be able to sleep on their own without their parents), some parents and certainly in some cultures, it is normal for the children to sleep in the bed with the parents. Kimberly respects this choice and while she does not teach this, she believes that it’s a choice that every parent has a right to make. It can be a controversial topic because some feel co-sleeping doesn’t teach independent sleep skills while others think that denying co-sleeping creates unnecessary stress and abandonment issues in children. Whichever path parents choose, the key to success is consistency. Top Tips for Sleep Training Here are Kimberly’s top tips for sleep training. For Babies: Make sure they go to bed wide awake but tired (not half asleep) Teach sleep training at bedtime (not at nap time or when they wake at night) For Toddlers: Make sure they learn to fall asleep without a parent in the room Like with babies, teach sleep training at bedtime not when they wake up in the middle of the night. If issues persist, work with a professional before the stress and strain of a sleepless family causes health issues. How Long Does it Take to Train a Child to Sleep? Kimberly says there’s a huge variance in how long it takes a child to learn to fall asleep and stay asleep on their own. Every child is different so you never know exactly how long it's going to take. Most of the time for toddlers and babies, the average is between two and seven days. For most kids and babies it’s going to be around three to five days. There are always exceptions on both sides of the average. It all depends on the individual child and the current habits they have. The sooner you deal with a new habit affecting a child’s sleep pattern, the better. And then, consistency is critical in shifting their sleep pattern back to normal. Just keep in mind, most kids don’t want to give up the attention they’re getting when they don’t sleep well. They’re smart, so they may try different things to shift the pattern. Parents need to stay vigilant and both parents need to be on the same page in order for the changes to take hold. If one parent gives in, the training will fail. Happy Ending I’m happy to report that after working with Kimberly, Jake is falling asleep and able to fall back asleep on his own. She taught me a technique that involved keeping him in his room (even when he REALLY wanted to come out) and using a stern voice (unseen from the hallway) telling him to go to sleep. It was very difficult for me to see my child so upset and not be able to comfort him. But, with Kimberly’s support, I was able to resist the temptation and soon witnessed my child falling asleep on his own. Eliminating Health Mysteries In our case, we were able to identify the bad sleep habit we had helped our son develop and then reverse it with the help of a sleep consultant. Chip “ os” and Its Healthier Counterpart – Beanfields Bean ChipsDo you love The Chips that End in “os”?If you do, then you might develop a love-hate relationship with me after reading this piece. Chances are you’ll hate me for bringing up the devils that surround …. “os” and these kinds of chips again. But, after a while, you’ll also love me for reminding you about these things once more and for adding more reasons for you to ultimately turn your back on them. Frankly speaking, how much XXX “os” can you eat from one sitting? I bet you can eat more than 12 chips, right? Well, that’s not surprising given its addictive qualities. And I specifically mentioned 12 chips, because that is equivalent to 1 serving. You get the following for every 12 chips of XXX “os”:150 calories8 grams of fat, including 1 gram of saturated fat180 mg of sodium (8% of the daily maximum intake)No vitamins and minerals (practically speaking)2 grams of fiberAlthough the nutrition facts at the back say that it doesn’t have trans-fats, XXX “os” does have vegetable oil. And in the food industry, one practice that is commonly observed is the addition of hydrogen to the oil (in a process called hydrogenation) to make it more solid and to prolong its shelf life. And the problem with hydrogenation is that it leads to the formation of harmful trans-fats. We all know that trans-fats can result in a host of negative effects on the body including heart disease and stroke. How Long Does it Take to Burn 150 Calories? For an individual weighing 150 lbs., burning 150 calories could be done by doing either of the following activities:Jog for 19 minutesRide a bicycle at a pace of 10 to 12 miles per hour for 22 minutesJoin an aerobics class for 22 minutesPlay soccer for 19 minutesHike outdoors for 22 minutesWalk at a slow pace for 53 minutesSwim at a vigorous pace for 19 minutesJoin a ballet class for 22 minutesScrub the floor for 30 minutesWhy XXX “os” Are so Addictive?If you’ve ever consumed a pack of XXX “os” by yourself, then you should tell from experience how addictive it can be. And that limiting yourself to just 12 chips or less is already a tough battle to win. But, why is that so? Building a good habit DOESN'T take a week, or 14 days, or the mythical 21 days some like to tout. The 21-day myth, in particular, gained traction thanks to its inclusion in Psycho-Cybernetics, by Dr. Maxwell Maltz, who said, "It usually requires a minimum of about 21 days to effect any perceptible change in a mental image.” Newer research actually points to 66 days to create a habit, but even this isn't a fixed number. What's critical is hitting all three major components to building a habit (according to Stephen Covey in his 7 Habits of Highly Successful People): desire, knowledge, skill—or as we've tweaked the formula, the capacity to do the work. So many people fear they will sound stupid or unprofessional but this is not something you need to worry about as even a show that is recorded live can be edited before being sent to your audience. Today I share some examples of the theories I used to edit my show Because of My Podcast: I'm Up For A Webby Award 1:49 Emily Prokop from The Story Behind podcast has been on the show before as she got a book deal "Because of her podcast" and how she has been nominated for a Webby award. PLEASE VOTE HERE Editing Your Podcast Will Make it Better 3:33 Mount Rushmore was once a mountain built of rock. Then someone editing it, and it is now a national memorial. There are movie editors, newspaper editors, book editors, etc. For me, I believe every podcast can benefit from editing. Today I share some examples and theories behind my editing decisions. Everything About Editing is An Opinion Some people do no editing, and some people will "over edit." Today I talk about my philosophies which are: Always remove low hanging fruit (and Um, or crutch word that isn't near any other words) ALWAYS Listen through the ears of your audience and ask if whatever you are listening to delivers value. Be careful about the curse of knowledge as it can leave your audience in the dark Most of my editing is me shaping my rambling questions into something a bit more focused In some cases, if a point is made late in the episode, you don't need it twice. If I have to zoom in to a very, very, very magnified level to edit the audio ( I call this "busting out a scalpel) I let it go. The goal of an interview is to make your guest sound good. In some cases, a backstory is given that is not needed. George Hrab answered this question on his Geologic podcast, and George told me a long time ago that if I ever want to use a clip I could. George's show spotlights his life as the drummer of the Philadelphia Funk Authority, but also features George's Skeptic point of view with highlights on Science as well as the "Religious Moron of the Week." George mentions that you shouldn't start a podcast to "be something" but instead make it because you can make something cool, interesting and fun. But what even is an elimination diet? For starters, it's actually not much of a diet. It's more of a short reset period during which you can discover which foods you should eat and which ones you should avoid. In a nutshell, you eliminate any foods that can potentially cause problems with your body and then add them back in one at a time to assess the issues that occur or don't occur. While you do an elimination diet, you'll want to make sure your health is good shape: no stress, easy workouts, spend time with friends and family, and get plenty of sleep. Discover which foods you can digest, ones that cause allergies, or what foods are sensitive to your body. How Long Does and Elimination Diet Take? An elimination diet typically takes 6-8 weeks to fully complete, but it may take some people more than 8 weeks. On the bright side, you'll have so much great information about your body by the time you wrap up the diet. Which Types of Elimination Diets Exist? If you're having a hard time losing weight, this could be good for you." - Rob Dionne If you have the following reoccurring symptoms that just don't seem right or normal, it could be a sign of poor nutrition health: Diarrhea Constipation Gas Bloating Stomach pain Acid Refulx Foggy mind Irritabilty Chronic migraines Chronic fatigue Uncontrollable weight gain Difficulty losing weight Insomnia Exhaustion Can't sleep well IBS Skin problems: Acne Eczema If you ignore them, they can lead to worse problems like autoimmune disease, rheumatoid arthritis, Hashimoto's Disease, or a leaky gut. How to Start an Elimination Diet "You can spend so much money on blood, genetic, or allergy tests, but the elimination diet is a really simple, inexpensive way to find out what works for you. It's less scientific, but more detailed for the individual." - Devon Dionne Begin an elimination diet by getting rid of any potential foods that can harm your body for 3-5 weeks. If there are any foods that you suspect are giving you health problems, be sure to include those. It might sound strange, but there can even be different fruits or vegetables like night shades that can also be causing you to have individual health problems. In general, night shades do have a lot of great benefits, but they can also cause health problems for some people. Reintroducing Foods Back Into Your Diet After 3 weeks, you can begin to reintroduce foods one at a time. Choose one food, eat a serving of it and then wait for 3 days to see any side effects before adding that food back into your diet. If you experience any side effects, that's a sign that your body doesn't like that particular food and we don't recommend you continue to eat them. Add back in foods that were the most important to you first or foods that provide the most nutrition the quickest: Seeds Nuts Eggs Nightshades Shellfish Dairy Legumes Grain Caffeine Any Downsides or Risks? There shouldn't be any downsides or risks, but there can be if you have diabetes. When in doubt, you should go see a doctor or even a naturopathic doctor who's familiar with elimination diets. Don't do it with your children because it could affect their growth and development. Also, certain people might have extreme reactions once they've reintroduced these foods back into your diet. Allergies, migraines, and acne for example. Contact an expert or a dietitian that specializes in elimination diets if you're worried about it. Share Your Favorite Healthy Recipes! Carrie's Introduction to Voice Acting Carrie's first job out of college was in HR. She was responsible for creating the online training program for her company. She narrated the course as well. Carrie enjoyed online training so much that she found a new job working full-time in e-learning. One day shortly after Carrie's maternity leave, she was listening to a podcast interview of a voice over actor on her commute to work. This was Carrie's first revelation that voice over work could be a full-time profession. Carrie called up the woman who was interviewed, Allison Steele, and hired her to be her voice over coach. 3 weeks later, Carrie had her first voice acting job! Just 4 months later, Carrie was able to quit her full-time job to pursue voice over work as her new profession. She's had a steady income ever since! How to Get Your First Gig Carrie shared several great tips on how to get your first gig as a voice over actor. Invest in Training. Carrie faced a bit of criticism from friends and family when she hired someone to be her voice acting coach. "Why would you hire a coach to teach you how to talk?" they asked, "you've been doing that your whole life!" But Carrie says that voice acting really is a different skill set. There are many different intricacies to voice over work. And as you get better at voice acting, you can expand your repertoire in terms of adding new voice styles, ages, and accents. Invest in a good home studio, or find a studio where you can do your work. The mid-level microphones that Sarah and I use for podcasting clearly wouldn't cut it for voice acting. You need a sound-proof environment and a very high-quality microphone. Sign up for online casting sites. Carrie got her first gigs from setting up her online profile on sites like Voices.com and Voice123.com You have to pay either an annual fee (about $400) or a monthly fee ($40) to get started, but once you submit your profile and all of the different voices you can do, auditions that meet your skill set will be sent right to your inbox. Carrie signed up for these sites thinking she'd just get some practice in the form of auditions, but she started getting booked for jobs pretty quickly! Note: since these sites are expensive, don't sign up for them until you've covered Steps 1 & 2. Practice a lot, get a coach, and get professional equipment. Network. Carrie now gets most of her voice over jobs through networking, referrals, and reaching out to her local community. Build your online presence. Carrie has also built her own online presence in the form of a website and being featured in different places online. Now companies find her all on their own. How to Audition We were pretty sure auditions for voice acting work a bit different than a casting call, but what exactly does it involve? The client generally provides a script. Sometimes they'll also provide “direction” detailing how they would like you to sound, such as female, age 30-40, really upbeat! They may also provide another commercial as reference material or to let you know that's what inspired them. You record your audition on your own in your home studio or a studio you have access to. You can submit multiple "takes" of the audition if you feel that would showcase all of the potential options for a certain gig. Submit the audition either through the client's website, via email, or however they instruct you to do so. The client listens to all of the auditions and decides who to hire. The Essential Element for Excellent Audio Believe it or not, the essential element for excellent audio is actually...quiet! Carrie says that voice actors crave true quiet. And this means complete silence - not a single sound! Carrie has visited co-working spaces who claim to have a recording space available, but as soon as she enters the room she hears creaking from the floor above or the hum of an air conditioner. This is why your best best it to have a dedicated home studio. It really can be just a dedicated closet with blankets hung or foam to pad it. (We personally used the closet method to record our audiobook -surrounding ourselves with pillows to isolate the sound!) Carrie was lucky enough to find a co-working space in Kansas City that does have a professional recording space with iso booths, but this is pretty rare. Editing Audio Does a voice over artist have to become an expert editor or does the client edit their own work? Unless Carrie is doing a "directed session" where the client is right there with her directing every take, she does all the editing herself. Most of her work happens independently. The client sends her a script, and she records it and sends it back "broadcast-ready" which means they can use it right away. Carrie may still send several takes, but they are all fully edited. This means she has removed all breath sounds, clicks, or any of the other little distracting noises a mouth can make while it's speaking! Did Carrie learn how to edit audio on her own or did she receive training? A little of both! Carrie and her husband have been doing podcasts for years, so she knew how to do basic audio edits from that. However, with her new career, Carrie has invested in classes on editing and using professional software so she can up her editing game even more. Fancy Equipment? Carrie's husband is a bit of an audiophile, so when they began podcasting, they invested in studio-quality microphone. She still uses the same microphone they purchased years ago - the AKG Perception 120. Carrie has done national radio commercials using this microphone! Carrie even brings her own microphone into the studio to use. Occasionally she tests out the equipment there and uses a new microphone for a certain job, but she generally sticks with her tried and true mic. Carrie's Recording Studio Carrie is lucky to have a local co-working space that also has a great recording studio. Most co-working spaces are designed more for “desk jobs” and they don't have great recording resources. Carrie pays $250 a month to use a local recording studio and has 24/7 access. When she isn’t in the studio she is still able to use the available office space there to get other things done. If you are interested in finding a recording studio to rent out, you'll have to do research in your local area. Carrie doesn't think it's very common yet for a recording studio to offer space to rent, but hopefully this trend will grow! Directed Recordings Carrie actually loves directed sessions for several reasons. She knows exactly what the client wants. She's not left wondering whether she recording in the correct style. No time spent editing. The client takes all the raw audio files and Carrie doesn't have to edit or finish them. She's solving a problem. Carrie makes recorded sessions enjoyable by having the right mindset. When the client gives feedback or wants another take, it's not personal. They're just looking for a particular sound and style. Carrie knows if she can solve their problem and give them exactly what they're looking for, she's done her job. Carrie is great at being flexible. This trait allows Carrie to offer a wide variety of styles so she can make sure the client hears just what they want. She knows that for many clients, they don't quite know exactly what they want until they hear it. (She's done up to 50 takes in one session before!) Listen to Carrie's Voice on this AT&T Commercial. Isn't it incredible?! Find more examples of her work right here. How to Sound 20 Years Younger (or Older!) A lot of voice over work requires sounding a specific age. Carrie doesn’t do child voices (although many voice actors with high-pitched voices do!) but she is really great at doing a teenage girl voice. The teenage girl talks faster, with a higher pitch, and uses different inflection and words. Carrie has found that there is a lot you can do with your voice if you change your mindset. When trying to sound older she just “thinks older”. If you try to get into character and think about how the person would sound that can be very helpful for matching your voice to a certain age and character. Carrie has done voice acting from teenager through 50 year-olds. How Long does it Take to Record a Session? Sometimes a recording session can be very quick, particularly when the client is present, knows exactly what they want, and everyone is prepared. In these cases, Carrie can show up, record the spot, and be done in 8 minutes! Some sessions however can take days to record such as educational content. It all depends on the gig itself and what the client is looking for. For Carrie, it also depends on how many spots or commercial she is recording at one time. One client hired her to record 8 commercials at once, so naturally, this session took longer. Some spots have the same copy but a different city, whereas some are completely different. As you'll discover below, you tend to be compensated for the extra time you put into each gig. Audiobooks end up paying more as you spend more time recording and editing them. But, you can also get more bang for your minute by booking national spots. How Much Does a Voice Actor Get Paid? Every job is quite different, but there is a union for voice over actors that has a suggested rate scale. Carrie is not part of the union, but the rate scale is helpful for figuring out a fair rate. We found an example rate scale at voices.com. Internet, television, radio, and audiobooks are all different beasts. Carrie says that a 30 second national radio spot is about $500 based on the scale created by the union. The sample scale above indicates that the rate would be $1000. An audiobook can range from $150 to $300 for a finished hour. A finished hour would include all of the work you did to record it such as editing, rerecording, etc… Most clients go in with a budget and then you can work with them and decide if it will work for both of you. The rate sheet example we found suggests that the highest rate (per minute at least!) comes from doing a national TV commercial. This comes in at around $2000. A Flexible Career Option for Moms Voice over work is a great option for moms looking for flexible work that they can do from home. But Carrie doesn't want to deceive women into thinking they can just grab any old microphone, start talking, and book high-paying gigs. While voice acting can be very lucrative, Carrie wants to remind everyone that you are still running a business. Success does not come easy and it can be a very competitive. You have to practice and hone your craft constantly. You have to invest money initially for coaching, equipment, and membership on job sites. Finally, you need to market yourself and run your business. Carrie is running a business just like the rest of us, and we all know that growing a business doesn't come without a lot of hard work! Do you Need an Agent for Voice Acting? While Carrie says that most of her jobs come through networking or applying on large sites, having an agent is great for working with really large clients. Carrie recommends waiting until you have a professional package to present before seeking out an agent. You need to have a great demo tape. Make sure you are ready so you won't waste your time or the agent's. Sharpen your skills first. Marketing Yourself Carrie’s marketing strategy revolves around one thing: Exposure! She shared several great tips for gaining more exposure and getting more work. Create online profiles. Create profiles on as many platforms as you can find. Submit a thorough profile which includes all of the different voices you can do along with demos. Create your own website. It can be very simple, but your website needs to have 2 things: Samples of what you can do, and a way to contact you. Create social media profiles. Again, this is an easy way to build up your online presence and be found in more places. Get Business cards. Carrie says that while this may sound old school, it's very effective in her line of work. She attends in-person networking events frequently, and she's ready with her information and a way for people to contact her. Join your local Chamber of Commerce. This goes hand-in-hand with the point above. You can network with business owners and be ready when they're looking for a voice-over artist. Keep your ears open! You'd be surprised at how much voice-over work is all around you. Your local grocery story may have spots played over the intercom that are specific to that store. (They hired a voice-over artist to do that!) Your local car dealership uses voice-overs. Kickstarter campaigns (like this one Hayley did) often use voice-overs too. Beth Anne's idea: Attend writers' conferences so you can help writers turn their books into audiobooks! Addi Ganley did just that, and the audible commissions are quite a bit better than just selling on Amazon. More Than a Great Voice There is a lot more to voice over work than just having a nice voice. You need to be able to connect with the audience. Carrie says that even the most unique voices can find work if they are great at acting. Find a specialty and find a way to connect. Conversely, having a great voice alone won't get you very far. Your ability to act and express a certain feeling is what will make you stand out. Is Carrie Olsen a Brit? Carrie indulged us with a few of her different voice impressions. She shared her British Accent, Teen Girl, and The Know-it-all Mom. Her voices were spot on, and they were cracking us up! Clearly voice acting requires a lot of talent! How do you measure advertising and marketing ROI? Before any business invests money they have the desire to get a return on their investment (ROI). While major companies such as Apple, Google, GE and IBM will sink money into research and development, the ultimate goal is to make more money in the long run. The same is true when it comes to advertising. Before spending $3 million on a Super Bowl ad, GoDaddy does the research to determine their return on the investment. How can you determine you return on investment? How to Measure Advertising To measure advertising you need to be able to plot two points. A "before" point is measured before you begin advertising, and your "after" point is measured either along the way or after your ad campaign is complete. It these two points that will tell you whether your advertising was successful or not. In any advertising campaign you will be able to implement a tracking layer. For a TV commercial the correct tracking method might be a unique website address or to purchase a specialized 1-800 number to verify where the calls or contacts are coming from. When it comes to a digital advertising strategy there are a number of analytics programs available including Google Analytics for Business. With these analytics programs you can very easily track new visitors to your website along with many other important metrics. Even within social media platforms there are many different insights that can be measured including likes, retweets, and shares. Metrics, and analytics are just a few of the reasons most businesses should be on Facebook. Throwing spaghetti at the wall and then turning around before seeing if it sticks is a very bad business practice. Measuring advertising can be a challenge but it is necessary to determine your ROI. And if it's worth doing, it's worth measuring. Where Can You Get the Most Bang for Your Buck? This can be a tricky question for most business owners as no one wants to spend money where there is very little to no ROI. But how do you know where you can get the most bang for your buck? Time and again we are asked this question, and the answer is different for every business. Understanding your customer is extremely important when it comes to effectively advertising and getting a return. Just because a company in another industry is doing a certain form of marketing does not mean that you should do the same. Print advertising may be right for them, and completely wrong for you. But, if no one else is doing it you may end up getting rock bottom prices which will return even more ROI in the long run. The key to this equation is how can you reach the highest potential audience for your services at the lowest possible price. The only way to figure this out is to fully understand your potential customers. When you fully understand your customer, you will fully understand how to reach them with the highest ROI. How Long Does it Take to Get a Return? This is a question that can only be answered after creating a very detailed advertising plan. Advertising can be very effective very quickly, and it can also be very effective over the long haul. Your marketing plan will dictate the speed with which you achieve success. The reason is that some marketing plans work really hard upfront, and disappear just as fast. Others, in particular digital marketing start slower but work much harder longer term.
