In “U.S. Maritime Modernization: Policy Driven Changes in Ocean Shipping”, Joe Lynch and Lauren M. Key Takeaways: U.S. Maritime Modernization: Policy Driven Changes in Ocean Shipping In “U.S. Maritime Modernization: Policy Driven Changes in Ocean Shipping”, Joe Lynch and Lauren M. Beagen, the Founder of Squall Strategies and The Maritime Professor, discuss the following:  OSRA 2022: Better Rules for Shippers: The Ocean Shipping Reform Act of 2022 gave the Federal Maritime Commission (FMC) more power to stop unfair charges from ocean carriers, especially for detention and demurrage. It's all about protecting shippers and making things fairer. "Decoupling" from China? It's Complicated: The idea of moving away from China for manufacturing isn't a simple "breakup." It's more about smart diversification, spreading out where we get things to lower risks, rather than cutting ties completely. Bringing Production Closer to Home: There's a big push to move manufacturing back to the US or to friendly countries nearby. This means building new factories, finding workers, and using government help to create stronger, more local supply chains. Maritime Law: The Unsung Hero: Don't underestimate maritime law! The rules for shipping by sea are super important for how goods move around the world. They keep things fair and stable in global trade. FMC's Growing Role in Today's Market: The FMC isn't just about old rules anymore. It's actively watching and reacting to supply chain problems, making sure US interests are protected and competition stays fair in ocean shipping. Diversify, Don't Just Ditch: Instead of pulling out of existing supply chains entirely, companies are focusing on diversifying. This means finding multiple places to source from, making supply networks more resilient against unexpected issues. Politics Meets Business: What It Means for You: Big political goals, like bringing jobs back or reducing reliance on certain countries, directly impact how businesses operate in transportation, logistics, and supply chain. Understanding this connection is key to staying ahead. With over two decades of experience, Dean Boylan explains how every part of a law school application—GPA, LSAT, writing samples, letters of recommendation, and personal statements—works together to tell a candidate's story. He emphasizes the importance of authenticity, resilience, and attention to detail over perfect numbers. The conversation addresses common myths, red flags, the growing importance of LSAT writing, and why schools are shifting away from rankings to focus on outcomes like bar passage and employability. Dean Boylan also shares insider tips on choosing the right recommenders, writing addenda, and using life experience as a strength in the admissions process.

Key Takeaways: Building a Resilient Port Strategy  The first step in developing a resilient port strategy is understanding the locations of the domestic supply chain along with the location of customers. The ability to use multiple ports of entry is key for shippers because there are unexpected disruptions at ports because Panama Canal issues, labor problems, and shifting regulations at the ports. Shippers must also consider potential labor union issues with both the West Coast and East Coast longshoremen unions. The California Ports are more challenging to service because of AB5 and CARB AB5 refers to Assembly Bill 5, a California law that went into effect on January 1, 2020. It is also known as the “Gig Worker Law” or the “Independent Contractor Law.” AB5 aims to classify more workers as employees rather than independent contractors, CARB emissions refer to emissions of pollutants regulated by the California Air Resources Board (CARB). To build a resilient port strategy, shippers must consider the impact of the Ocean Shipping Reform Act (OSRA) of 2022, which includes the following provisions: Unreasonable Refusal to Deal – A provision that requires that an ocean common carrier shall not unreasonably refuse to deal or negotiate with respect to vessel space accommodation. Demurrage and Detention Billing Requirements – A new rule that seeks to provide more clarity, consistency, structure and punctuality to the demurrage and detention billing practices used by vessel operating common carriers (VOCCs), non-vessel-operating common carriers (NVOCCs) and marine terminal operators (MTOs). Unfair or Unjust Discriminatory Methods – The Federal Maritime Commission (FMC) will define what is unfair or unjust discriminatory methods used by carriers regarding concerns and complaints by exporters and small shippers. Lastly, to build a resilient port strategy, shippers should get the select the right partner – companies that have a comprehensive knowledge of the ports – companies like Port X Logistics and Squall Strategies. Port X Logistics provides drayage to and from all ports and ramps in the USA and Canada. Port X Logistics provides safe and just-in-time truckload services, unique problem-solving for supply chain solutions, worry-free crisis management services, and collaborative and dedicated project management from start to finish. About Squall Strategies Squall Strategies is a maritime consulting and legal solutions company and offers a wide range of consulting services to serve a variety of businesses and clients. Whether you're a small, local business or a multinational corporation, we can help you reach new levels of success. Squall Strategies is available for advice and consultation on Federal Maritime Commission related matters, advice and consultation on supply chain and ocean freight movement, potential federal regulatory impacts on your business, federal regulatory review and analysis, general Federal Maritime Commission related inquiries, advice and consultation on demurrage, tariff/schedule reviews, and supply chain industry insight. In today's episode, I chat with Arthur Petropoulos, Founder & Managing Partner at Hill View Partners, a Providence-based investment firm that specializes in mergers & acquisitions, business sales/exits, and capital advisory services for middle-market and lower middle-market companies. Arthur founded Hill View Partners in 2016 after a successful tenure on Wall Street as an Investment Banker, Private Equity Investor, and Head of Mergers & Acquisitions and Corporate Development for a high growth Operating Company. The first half of this 2023 saw M&A activity in the U.S. experience a significant decline in dollar value, falling by 41 percent compared to the same period last year. However, the number of deals decreased by only five percent, according to a recent report from Korn Ferry. What are the common traps that many business owners fall into during the process of selling or exiting their businesses? How has the availability of artificial intelligence impacted his strategy?  How does he see this sector evolving over the next 5-10 years? Arthur was kind enough to stop by and let me pick his brain. I hope you enjoy our conversation as much as I did recording it.Arthur PetropoulosArthur Petropoulos founded Hill View Partners in 2016 after a successful tenure on Wall Street as an Investment Banker, Private Equity Investor, and Head of Mergers & Acquisitions and Corporate Development for a high growth Operating Company. This engaging history overturns the conventional wisdom about the Second Amendment--showing that the right to bear arms was not about protecting liberty but about preserving slavery. In Madison's Militia, Carl Bogus illuminates why James Madison and the First Congress included the right to bear arms in the Bill of Rights. Linking together dramatic accounts of slave uprisings and electric debates over whether the Constitution should be ratified, Bogus shows that--contrary to conventional wisdom--the fitting symbol of the Second Amendment is not the musket in the hands of the minuteman on Lexington Green but the musket wielded by a slave patrol member in the South.Bogus begins with a dramatic rendering of the showdown in Virginia between James Madison and his federalist allies, who were arguing for ratification of the new Constitution, and Patrick Henry and the antifederalists, who were arguing against it. Henry accused Madison of supporting a constitution that empowered Congress to disarm the militia, on which the South relied for slave control. The narrative then proceeds to the First Congress, where Madison had to make good a congressional campaign promise to write a Bill of Rights--and seizing that opportunity to solve the problem Henry had raised.Three other collections of stories--on slave insurrections, Revolutionary War battles, and the English Declaration of Rights--are skillfully woven into the narrative and show how arming ragtag militias was never the primary goal of the amendment. And as the puzzle pieces come together, even initially skeptical readers will be surprised by the completed picture: one that forcefully demonstrates that the Second Amendment was intended in the first instance to protect slaveholders from the people they owned.Carl T. Bogus is a Professor of Law Emeritus at the Roger Williams University School of Law in Bristol, Rhode Island. He has also held visiting positions at the George Washington, Drexel, and Rutgers University law schools. He is the author of two previous books--Buckley: William F. Buckley Jr. and the Rise of American Conservatism (Bloomsbury Press) and Why Lawsuits Are Good for America: Disciplined Democracy, Big Business, and the Common Law (NYU Press)--and the editor of The Second Amendment in Law and History: Historians and Constitutional Scholars on the Right to Bear Arms (The New Press). His writings have appeared in professional journals as well as the New York Times, USA Today, Los Angeles Times, Boston Globe, The Nation, American Prospect, American Conservative, and other popular venues.Buy the book from Wellington Square Bookshop - https://wellingtonsquarebooks.indiecommerce.com/book/9780197632222

Beagen is a seasoned maritime attorney and the founder of Squall Strategies, which is a boutique maritime consulting and legal solutions company and offers a wide range of consulting services to serve a variety of businesses and clients. In the podcast interview, Joe and Lauren discuss solving the port problem. The number of ships waiting to enter the biggest U.S. gateway for trade with Asia reached the highest since the pandemic began, exacerbating delays for companies trying to replenish inventories during one of the busiest times of the year for seaborne freight. The port problem first became noticeable in the Port of Los Angeles and the Port of Long Beach, the ports where the majority of shipments from Asia are received. Other ports around the USA have also seen delays and disruptions. The port problem was caused by the following factors: Increased demand by US consumers who went on a buying spree. Because restaurants were closed, vacation travel restricted, and many big purchases delayed because of pandemic-driven shortages – bored, house-bound consumers bought a lot of stuff that had to be made in Asia and shipped to America's West coast ports (Los Angeles and Long Beach). Consumer spending also received a bump from government money that was generously distributed during the first year of the pandemic. While American consumers went shopping, particularly online, the Asian factories and supply chains that produce the goods were broken due to labor and materials shortages. Access to vaccines, medical care, and family issues contributed to the shortages. Labor problems in the USA exacerbated the problem as people left the workforce in large numbers due to COVID infection, money from the government, homeschooling of children, and caring for family members. The port congestion may have also been caused by a lack of digitization and technology at the ports. The National Shipper Advisory Committee (NSAC) is a team made up of both public and private sectors organizations tasked with solving the port problems. The NSAC is led by the Federal Maritime Commission (FMC), which is the independent federal agency responsible for regulating the U.S. international ocean transportation system for the benefit of U.S. exporters, importers, and the U.S. consumer. The NSAC is actively working to identify and eliminate bottlenecks. The NSAC is also working on a number of initiatives to improve the ports including: demurrage/detention standards, data standards, transparency, and digitization. Lauren and the Squall Strategies team helps shippers and logistics providers navigate Federal Maritime Commission related issues (including FMC mock audit/review), federal regulatory reviews, advice and consultation on potential federal regulatory impacts, general maritime consulting, advice and consultation on demurrage, cargo movement and shipping insight, foreign tariff and trade expertise, and emerging markets and offshore wind analysis.  Learn More About Solving The Port Problem Lauren Beagen LinkedIn Squall Strategies LinkedIn Squall Strategies Website Squall Strategies Captain's Log - YouTube Channel Captain's Log: Demurrage... aka keep 'er movin' "How Amazon Beat Supply Chain Chaos With Ships, Containers and Planes", CNBC (Beagen as featured industry expert) Federal Maritime Commission The Logistics of Logistics Podcast If you enjoy the podcast, please leave a positive review, subscribe, and share it with your friends and colleagues. There are now billions and billions of interconnected devices in the world with more coming online every day. Smart cars. Smart cities. Smart agriculture and so much more. Even our pets are connected. And you have to look no further than the Colonial Pipeline ransomware attack to see the real-world consequences of what criminals can pull off by connecting with things large and small. Worried about your privacy? Well. There is plenty to worry about. Fortunately we also have a lot of people fighting back on the technical, security, law enforcement, and legal fronts. It's not a matter of if, but when. Of course, I'm talking about a sky speckled with commercial drones, bringing us our precious products and pharmaceuticals, or performing work in high places humans find dangerous, like inspecting bridges and buildings, monitoring crops and livestock, and keeping an eye on pipelines and oil rigs. What must companies know about deploying a drone fleet? What industries are leading the way? What are the potential legal liabilities?  How does one begin to navigate the regulatory labyrinth? If one is flying over my swimming pool taking photos, may I shoot it down? And who in their right minds would ever allow a teenage boy to operate one? Joining me to discuss this emerging area of law is Kathryn M. Rattigan, a member of the Business Litigation Group, the Data Privacy + Cybersecurity Team, and the Drone Compliance Team in the Rhode Island office of Robinson Cole.  Kathryn advises clients on these matters with expertise in the relevant Federal Aviation Administration regulations. She and her colleagues also advise clients on employee and subcontractor contracts, insurance policies, privacy regulations, state and local laws, and best practices as recommended by the National Telecommunications and Information Administration.  She handles product defect, personal injury, and property damage litigation, too.  Kathryn is a frequent contributor to the excellent Robinson Cole Data Privacy + Cybersecurity Insider blog.  She holds a J.D. from the Roger Williams University School of Law and a B.A. (magna cum laude) from Stonehill College.    This podcast is the audio companion to the Journal on Emerging Issues in Litigation, a collaborative project between HB Litigation Conferences and the Fastcase legal research family, which includes Full Court Press, Law Street Media, Docket Alarm and, most recently, Judicata. If you have comments or wish to participate in one our projects, or want to tell me how insightful and informative Kathryn is, please drop me a note at Editor@LitigationConferences.com. This podcast is based on an article she wrote for the forthcoming issues of the Journal. Just to clarify. Kathryn does own a drone, but not a "sheep drone." I regret the error, but wouldn't have it any other way.  Thanks to Kathryn for speaking with me about this fascinating area of the law. Tom Hagy

In today’s episode, Patrina has the distinct pleasure of speaking with her friend and phenomenal woman, Karima Mariama-Arthur. Karima is a leading authority in cutting edge Adult Education, and she advises individuals and organizations on the dynamics of leadership development, complex communication, and performance management. She is an accomplished author and highly sought-after national and international speaker. Karima received her Bachelor of Arts in Political Science from the University of California, Davis, and her Juris Doctor from the Roger Williams University School of Law. Patrina and Karima met in 2015, when they were both invited to participate in a discussion with White House and Congressional leaders regarding topics of interest in particular concern to minority women business owners. They made an immediate connection, and Patrina has been inspired by Karima’s brilliance, generosity, and consistency in showing up in excellence ever since. Karima delves into her path to entrepreneurship, overcoming fear, and the value that her past experience as an attorney brought as she launched her own business, WordSmithRapport. She discusses the importance of family support, and her grandmother’s encouragement to “break the chains that bind” and become a life-long learner. Karima also talks about writing her book, Poised for Excellence: Fundamental Principles of Effective Leadership in the Boardroom and Beyond. She shares her passion for giving back and mentoring young women of color, her love of wine as a Sommelier, and Patrina finds out how Karima has found her joy during the pandemic.  Episode Highlights: Karima and Patrina’s first encounter at the Walker’s Legacy discussion and the experience of having so many brilliant, inspiring minority women together Karima’s path to entrepreneurship and her  TEDx Talks  Overcoming fear while starting a new profession or launching a business Trusting yourself and being your own best barometer The knowledge and experience Karima gained as an attorney laid the foundation for everything she does now The influence of family support and Karima’s grandmother in particular Karima’s book Poised for Excellence: Fundamental Principles of Effective Leadership in the Boardroom and Beyond Her favorite principles for excellence Saying no and owning it Giving back through mentoring and her work with the Women’s Global Leadership Initiative Karima’s background as a Wine Sommelier Finding joy in being one with herself through the pandemic Quotes: “I feel like we don't often get that experience as minority women business owners, and so just to have that many of us in the same room, I was encouraged and inspired. I am so glad that we actually had the chance to meet and we have maintained our friendship since that meeting.”   “The whole idea of moving from Law, let me start there, was a scary proposition. I think once you spend your entire career focused on one thing, and the thought of moving away from that just represents the abyss because you don't know what is next and how you can really leverage that.”   “So that Talk was an opportunity for me to share my initial fear around transforming and jumping out of Law into something that I found so much more fruitful and useful for me in terms of a profession, and being able to talk to other people who were looking at entrepreneurship as a way towards freedom, to share my experience and to encourage them to pursue it. Because a lot of people get stuck and really don't see the utility and so they just say, ‘Forget it,’ and throw it all away.”   “There are some principles that I’ve learned along the way and the first one is to really trust yourself and to be your own best barometer.”   “I found that my role as an adviser really primed the pump for everything I do now. Dealing with corporations, and mentoring, and teaching, really laid an important foundation and a critical level of credibility that I wouldn't have, had I not gone through my experience as an attorney.”   “I don’t think we can ever do anything alone.”   “Everyone, no matter what they want to do in life, has an idea of what success looks like. And if it's up to me - as my role as an adviser, I want to make sure that all my clients are positioned or poised for excellence. So I thought about, the principles inside are principles that anyone, if they're willing to commit to the work, can master. My work is all about self mastery.”   “‘Get out of the way and stop sabotaging your success,’ is one of my favorite [principles] because I just really believe, especially in the work that I do, that a lot of us do things...that prevent us from doing our best work and prevent us from being our best self.”   “I think it's always important to give back, and I love working specifically with young people, women of color, because we share a lot of common struggles, and I think that it's important to share how you got over, so that people don't have to make the same mistakes.”   “Do what makes you happy and make it a priority.”     Links:   Joyfully You Life homepage   Joyfully You Life Instagram   Joyfully You Life Facebook   Joyfully You Life Twitter   Joyfully You Life linktree   WordSmithRapport website   Women’s Global Leadership Initiative website

He graduated from Providence College on an Army ROTC scholarship in 2002. Upon graduation he was commissioned as an officer in the U.S. Army. After a 13-month tour of duty in Iraq as an Armor Platoon Leader, he completed his service to the U.S. Army and received an honorable discharge in 2010. Upon leaving the U.S. Army, JLD enrolled at Roger Williams University School of Law in Bristol, Rhode Island. Dropping out after one semester, he took a job in corporate finance at John Hancock in Boston. Later, he went to New York City, where he worked for a technology startup until departing to San Diego in 2009 In San Diego, JLD began a career in real estate. Upon a friend's suggestion, he began listening to podcasts in order to pass the time during his long drives. He started listening to NPR, while exploring other shows such as Pat Flynn's Smart Passive Income and Cliff Ravenscraft's Podcast Answer Man. After moving back to Maine in mid-2011 to pursue a career in Commercial Real Estate, Dumas thought of starting a different venture. He realized none of his favorite Podcasts offered daily content. This gave him the idea of starting his own podcast. He developed the concept of a daily podcast that would feature the story of successful entrepreneurs. He named it EOFire, short for Entrepreneur On Fire. EOFire launched September 22, 2012. As his subscribers grew, he published Podcast Launch in the Amazon bookstore. Podcast Launch is a guide of the exact steps he took to launch EOFire. In 2013, JLD launched Podcasters' Paradise, a community of podcasters. JLD hosts a free, live Google Hangout Podcast Workshop as an introduction to podcasting every other week. EOFire has featured several entrepreneurs including Seth Godin, Gary Vaynerchuk, Barbara Corcoran, Tim Ferriss, and Brian Tracy. The show was named Best of iTunes in 2013. EOFire generates 7 figures in revenue annually and JLD continues to openly share his income breakdown in a monthly report on his site, verified by a CPA. In 2016, JLD launched The Freedom Journal, a faux leather-bound journal to help individuals set and accomplish a goal in 100 days. JLD launched The Freedom Journal via a Kickstarter campaign in January 2016, which became one of the most funded publishing campaigns in the history of Kickstarter, with over $350,000 pledged in 33 days. This Federalist Society Faculty Book Podcast features Professor Elizabeth Price Foley’s new book, The Tea Party: Three Principles. -- As Publisher Cambridge University Press states: "In The Tea Party: Three Principles, constitutional law professor Elizabeth Price Foley takes on the mainstream media's characterization of the American Tea Party movement, asserting that it has been distorted in a way that prevents meaningful political dialogue and may even be dangerous for America's future. Foley sees the Tea Party as a movement of principles over politics. She identifies three "core principles" of American constitutional law that bind the decentralized, wide-ranging movement: limited government, unapologetic U.S. sovereignty, and constitutional originalism. These three principles, Foley explains, both define the Tea Party movement and predict its effect on the American political landscape. Foley explains the three principles' significance to the American founding and constitutional structure. She then connects the principles to current issues as health care reform, illegal immigration, the war on terror, and internationalism." -- Professor Foley, a Professor of Law at Florida International University School of Law, is joined by critical commenter Jared Goldstein, a Professor at Roger Williams University School of Law, to discuss the book.
