Rulemaking Notice-and-Comment Rulemaking under the Administrative Procedure Act (APA) A process that requires agencies to publish proposed rules, allowing the public to comment before final rules are enacted, ensuring transparency and public participation. Exemptions and Exceptions to Notice-and-Comment Requirements Certain situations, such as emergencies or matters of minor significance, may exempt agencies from the full notice-and-comment process. Final Rule Issuance and Publication After considering public comments, agencies finalize and publish rules in the Federal Register, making them official and enforceable. Legislative vs. Interpretative Rules and Policy Statements Legislative Rules: Have the force of law and affect individual rights and obligations. Interpretative Rules: Clarify or interpret existing statutes or regulations without the force of law. Policy Statements: Indicate how an agency intends to exercise its discretionary powers. Adjudication Formal vs. Informal Adjudication Formal Adjudication: Involves a trial-like hearing with an administrative law judge. Informal Adjudication: Less formal processes without a hearing, often based on written submissions. Due Process Requirements in Agency Adjudications Agencies must follow due process, providing fair notice and an opportunity to be heard, ensuring decisions are made impartially and based on evidence. Hearings, Evidence, and Decision-Making Hearings allow for the presentation of evidence and arguments. Agencies must base their decisions on the evidence presented, adhering to legal standards. Appeals and Judicial Review of Administrative Decisions Decisions can be appealed within the agency and may be subject to judicial review, where courts examine the agency's compliance with the law and due process. Judicial Review of Agency Actions Standards of Review: Chevron Deference, Skidmore Deference, Arbitrary and Capricious Standard Chevron Deference: Courts defer to an agency's interpretation of ambiguous statutes it administers. Skidmore Deference: Courts give weight to an agency's interpretation based on its persuasiveness and expertise. Arbitrary and Capricious Standard: Courts review whether an agency's action was based on a consideration of relevant factors without clear error in judgment. Exhaustion of Administrative Remedies Individuals must typically go through all available administrative remedies before seeking judicial review. Standing, Ripeness, and Mootness in Challenges to Agency Actions Standing: The right of an individual to bring a lawsuit based on their stake in the outcome. Ripeness: Whether a dispute has developed sufficiently to be ready for judicial review. Mootness: Whether there is still an actual controversy to resolve, affecting the court's ability to provide relief. Administrative Procedures Act (APA) Overview and Significance of the APA The APA is a key statute that governs how federal administrative agencies may propose and establish regulations, ensuring transparency, fairness, and public participation. Procedural Requirements under the APA for Rulemaking and Adjudication The APA sets out detailed processes for rulemaking and adjudication, including notice-and-comment procedures and requirements for formal hearings. Judicial Review Provisions in the APA The APA provides standards and procedures for courts to review agency actions, ensuring they comply with the law and respect individual rights. Open Government and Accountability Freedom of Information Act (FOIA) FOIA allows for the full or partial disclosure of previously unreleased information and documents controlled by the United States government, promoting transparency. Government in the Sunshine Act This act requires that meetings of certain federal agencies be open to the public, further ensuring transparency and accountability. We're back after a brief hiatus due to a guest cancelling, the holidays, and me feeling a bit under the weather, but our third season is still off with a bang. If there was a fascinating episode to drop after being away, this is IT. International playwright Ren Powell visited remotely with an aspect of playwriting and theatre I couldn't have been prepared for. We discuss going international, cultural differences, and the task of tackling translating from a cultural perspective as well as playwriting and also as an approach to learning a language. We touch upon Norwegian playwriting on the page and stage and their appeal to deconstructing theatrical works. Ren also speaks of her use of "erasure" in her adaptation of Shakespeare's King Lear and her advocacy of free speech against literary prosecution in the realm of human rights and human obligation. We also talk about new or obscure forms of theatre including pub theatre, pantos, and Norwegian variety/vaudeville style theatre (revits (sp?)) and Norwegian improv. I also chime in a bit (a lot) with my frustration of authority in academia. It truly is a fascinating conversation I hope you will enjoy. My guest today is a poet, playwright and teaching artist born in Anaheim, California and currently based in Oslo, Norway. She has a Ph.D. in Creative Writing from Lancaster University in England, a BA in Theater Arts from Texas A&M University, and teaches at Vågen Upper Secondary School for the Visual and Performing Arts. Her work often juxtaposes mindsets with landscapes, culture with nature and often reflects on the themes of identity, place/displacement, mental disorders, human rights and obligations. In Episode 4 in a five-part series on Rias Baixas,  the Wine Thieves speak with winemaker Emilio Rodriguez of the Terras Gauda winery in O Rosal, the largest privately owned winery in Rias Baixas. Emilio has been at Terras Gauda for longer than he can remember, and he is a big fan of some of the other native grapes of the region beyond Albariño, especially caiño blanco.  He speaks about the sweeping changes that occurred in the region, bringing Rias Baixas out of the middle ages of homespun winemaking and into the modern, quality-focused industry it is today. O Rosal is in the spotlight, the third most important sub-zone of Rias Baixas in size after the Salnés Valley and Condado do Tea. A coastal region in the southwestern corner of Galicia, bordered by the Minho River and Portugal to the south, Condado do Tea to the east, and the Atlantic Ocean to the west. O Rosal accounts for about 11% of total plantings in Rias Baixas,  and sits in temperature between that of Condado do Tea, the warmest, and Val do Salnés, the coolest.Albariño is the main variety here, but complementary white varieties loureiro, treixadura, caiño and even godello have a role to play.  Terraced, south-facing vineyards along the north bank of the Minho enjoy excellent sun exposure, maximizing the nearly 2200 sunshine hours per year. Ripeness is nudged to a slightly higher degree than in the Salnés Valley, enabling even late varieties like caiño to deliver. Another distinguishing feature of Rosal is the band of schist bedrock that runs through the region, a variation on the otherwise granite-derived soils in most of the rest of the Rías Baixas D.O. You can expect the white wines of O Rosal to tilt more towards stone fruit flavours and relatively generous and rounded palate.Grab a glass of your prefered Atlantic white and join John & Sara on their continued journey across the misty terroir of Rias Baixas. Salud!

Our sugar journey is almost complete as we round out the third installment in the Brix series. I hope the previous podcast episodes helped open your mind to some of the challenges we face in talking about sugar in the coffee industry.Today's episode focuses on ripeness and how counterintuitively sometimes measuring Brix can lead to lower quality coffee.And to help illustrate this point I'm sharing a lesson from one of my favorite industries: the cork industry. Specifically cork wine stoppers. In 2013 I was invited to visit Portugal as part of a Quality Control trip on behalf of the winery I worked for.In this episode we will talk about Brix and fruit maturity (ripeness), I will discuss the results of research done on a Brazilian coffee farm and we will see if there isn't a better instrument than a refractometer to help us look inside the coffee fruit and determine what will make a quality cup of coffee. It's been a while since we've gotten into the background of the Supreme Court, so this week, Brett and Nazim discuss the self-imposed scope of the Supreme Court's Power by way of a weird behind-the-scenes nuance of the San Francisco v. Sheehan case on police force.  Much like any powerful individuals with unfettered power, the Supreme Court has had a strange amount of discretion in the limits of what it can do under the Constitution and has defined its role in the government carefully.  By discussing judicial review, Marbury v. Madison, and standing, Brett and Nazim illustrate how they're basically a government institution with the same morals as Spiderman.
