This Day in Legal History: Alabama Admitted as 22nd StateOn this day in legal history, December 14 marks a significant milestone for the state of Alabama and the United States. On December 14, 1819, Alabama was formally admitted as the twenty-second state in the Union. This momentous event came after a period of rapid growth and settlement in the region, which was initially part of the Mississippi Territory. The admission of Alabama into the Union was not just a geographic expansion; it was a significant legal and political event. It reflected the ongoing debates and complexities of American federalism, state sovereignty, and the balance of power between the northern and southern states. The Constitution of Alabama, first adopted in 1819, laid the foundation for the state's legal and governmental structure, embodying principles of democracy and governance that were essential to the young nation. The original Alabama Constitution, like many state constitutions of the era, was heavily influenced by the U.S. Constitution. It established a framework for state government, including executive, legislative, and judicial branches, while also reflecting the social and economic conditions of the time. For instance, it included provisions related to land ownership, state boundaries, and the rights of individuals, all crucial aspects of state governance and individual liberties.Over the years, the Constitution of Alabama has undergone several revisions and amendments, reflecting the changing needs and values of the state's population. These changes have addressed issues such as civil rights, electoral processes, and the structure of state government, showing the dynamic nature of constitutional law within a state context. The admission of Alabama as a state is not just a historical footnote; it represents a pivotal moment in the development of the United States' legal and political landscape. It highlights the evolving nature of statehood and federalism in American history and serves as a reminder of the complex legal heritage that has shaped the nation. By examining the Constitution of Alabama and its history, one gains insight into the broader narrative of state and national development in the United States.A recent development in law school admissions has seen a growing number of institutions moving away from relying solely on the Law School Admission Test (LSAT) for student admissions. This shift is partly in response to the U.S. Supreme Court's ban on race-conscious admissions, as law schools seek alternative methods to foster diversity in their student bodies.Georgetown University Law Center and Washburn University School of Law have received approval from the American Bar Association (ABA) to admit some students without considering the LSAT. Additionally, 14 other law schools have been permitted to use the JD-Next program for admissions. This program involves an eight-week series of online legal courses, culminating in an exam. In total, 47 out of 197 ABA-accredited U.S. law schools are now cleared to use JD-Next this year. The LSAT has been a traditional staple in law school admissions, but its role has been scrutinized due to concerns over potential biases and its impact on minority applicants. Critics argue that the LSAT poses a significant barrier to aspiring minority lawyers, citing that minority test-takers generally score lower than their white counterparts. A 2019 study highlighted this disparity, with average scores for Black LSAT takers at 142, compared to 153 for white and Asian test-takers. The Law School Admission Council, however, maintains that the LSAT is the best predictor of law school performance. In response to the Supreme Court's ruling, law schools are exploring different ways to assess and admit diverse student groups without considering race. For instance, Georgetown plans to admit up to 10 students into its part-time evening program without standardized test scores, focusing instead on applicants' life and work experiences. Washburn Law's program is targeted at Washburn University undergraduates with a minimum GPA requirement, offering guaranteed admission and using the LSAT only for merit aid decisions, not admissions. This trend reflects a broader shift in college admissions, as institutions seek to adapt to legal changes and evolving perspectives on diversity and educational equity.Law schools embrace LSAT alternatives after affirmative action ban | ReutersElon Musk, the CEO of Tesla and the world's richest person, is set to confront the U.S. Securities and Exchange Commission (SEC) in a San Francisco court over his testimony regarding his takeover of Twitter. The SEC has sued Musk to compel him to provide further testimony as part of their investigation into his 2022 purchase of Twitter, which he later renamed X. The probe is focused on whether Musk adhered to legal requirements when filing paperwork about his Twitter stock purchases and if his statements about the deal were misleading. This legal battle is the latest episode in a long-standing feud between Musk and the SEC, dating back to 2018. The SEC's interest in Musk's dealings with Twitter began in April 2022, when he first disclosed his stock purchases in the company. Although Musk has already provided documents and testified via videoconference for the SEC's investigation, the agency claims it has more questions following the receipt of new documents.Musk's lawyers have called the SEC's actions harassment and argue that individual SEC attorneys lack the authority to issue subpoenas for testimony. In contrast, the SEC maintains that its officials have the legal right to seek additional testimony as investigations progress. The upcoming court hearing, scheduled for Thursday at 9:30 a.m. PST, will see both sides presenting their arguments. The SEC must demonstrate that its probe is within its jurisdiction, follows procedural requirements, and that the sought evidence is relevant and material. Legal experts anticipate the judge may favor the SEC but could impose certain conditions. The conflict between Musk and the SEC goes back to his 2018 "funding secured" tweet, leading to a settlement with the SEC and subsequent legal actions, including a shareholder lawsuit which Musk won. The billionaire's relationship with Twitter has been complex, starting with his initial declaration of being a passive stakeholder, followed by an attempted withdrawal from the $44 billion takeover deal, and culminating in his eventual acquisition of the platform in late October 2022 after legal pressure.Elon Musk and SEC to face off in court over Twitter testimonyIn a federal court in Manhattan, an attorney representing Michael Cohen, Donald Trump's former lawyer, faced scrutiny for filing a motion seeking early termination of Cohen's supervised release. The motion contained citations to cases that were either irrelevant or entirely fabricated. The court ordered the attorney, David M. Schwartz, to explain these misleading citations by providing the actual cases or providing a written explanation by a specified date. Judge Jesse M. Furman expressed skepticism about the legitimacy of the citations. One of the references cited as a Second Circuit case was actually a decision from the Fourth Circuit, unrelated to supervised release. Another citation led to a decision from the Board of Veterans Appeals, completely unrelated to the case context. The third citation seemed to have no basis in reality at all.Legal experts speculated that this might be a case of the attorney's misunderstanding or misrepresentation, possibly related to limitations in legal research tools. Schwartz faces possible monetary sanctions, but there's a possibility of more severe actions, such as referral to disciplinary authorities.A new attorney, E. Danya Perry, who took over Cohen's representation, acknowledged the errors in the citations and couldn't verify the referenced case law upon conducting her own research. She informed the court about these issues, maintaining ethical transparency.Perry, in her reply, mentioned different case law to support the motion for early termination of Cohen's release, expressing her belief in its merit. Judge Furman delayed judgment pending Schwartz's response to the order. As of the report, Schwartz hadn't responded to requests for comment. The case, known as United States v. Cohen, awaits further clarification and submissions as ordered by the court.Michael Cohen Lawyer Ordered to Explain Nonsense Case CitationsIn a patent dispute between Sonos Inc. and Google LLC, the US International Trade Commission (ITC) rejected Google's attempt to halt the import of Sonos' smart speakers. The products in question, including Sonos One, Move, Roam, Arc, Beam, and Era 100 and 300, were accused by Google of infringing patents. The ITC declined to review a judge's decision that found no infringement of valid claims from three patents held by Google.Judge Cameron Elliot's initial determination in September stated that Sonos hadn't violated US import laws as the claims it allegedly infringed upon were deemed invalid. Additionally, Google couldn't prove Sonos' infringement on another patent. Google sought a review of these findings, claiming errors in the judgment, but Sonos argued that Google failed to substantiate its grievances. This marks the most recent development in an extensive and convoluted patent battle between these companies, characterized by numerous petitions submitted to the ITC. Amidst this legal tussle, an eight-figure jury verdict was overturned, and a judge criticized the tactics employed in this dispute, labeling them as representative of the most contentious aspects of patent litigation.Sonos Beats Google Attempt to Block US Imports of Smart Speakers Get full access to Minimum Competence - Daily Legal News Podcast at www.minimumcomp.com/subscribe

See omnystudio.com/listener for privacy information.

Full article here… Ecovent Whole Home Zoning System A few weeks ago we talked about trying to keep an entire home at the same temperature by using sensors throughout the house. Ara mentioned that in his home to get the upstairs cool he needs to keep the downstairs cold. Reverse in the winter for heat. Rather than getting a second A/C unit Ara bought portable A/C units for the bedrooms upstairs. But this is a manual process albeit one that works well when there are people in the house to turn the units on. At that time we opined that it would be great if there was a way to control the vents automatically to send the air where it was needed.  Richard from San Diego heard our call and let us know about a company called Keen Home that has solved the problem with their Ecovent Whole Home Zoning System. We have no relationship with the company nor do we have experience with the product so this is just for information. We reached out to the company to see if we can get a representative to come on our show.  The following is from the Keen Home Website: The Ecovent Whole Home System replaces 80% of your home's existing airvents to optimize airflow throughout your entire home. The Ecovent Sensors, Hub, and a Sensi Thermostat enable the Ecovent App to set specific room temperatures, giving you the ultimate climate control. You adjust the temperature in any room from your app. The Sensors gather and transmit climate data in every room. Your Ecovent Vents then open and close to redirect airflow in your home and make every room the right temperature. Mark vacant rooms to allow air to go where you are. Save your favorite room setpoints and schedule them for automated comfort. Adjust your settings easily while away from home. Add your Sensi thermostat to the Ecovent app for end-to-end control of your home's HVAC system. Shopping for TVs at Costco Samsung QN85QN85BD (85”) for $3999.99 Oddly enough Samsung is selling them for the same price on their website. Amazon has it for $3997. The only difference we can see is that the 2022 model has speakers at the top that support Dolby Atmos. One listener has got in contact to suggest that their attitude towards Braille has irritated them, and that anyone unable to read Braille who is blind or visually impaired is, in their words, illiterate. It brought about a serious and thought-provoking discussion among the team which covered education, availability and advancements in technology, and the importance of Braille in our lives. There's a lot to unpack in this, and we fully expect you, dear listener, to have an opinion on it too - let us know where you stand on all of the talking points covered today, by emailing TechTalk@RNIB.org.uk (mailto:TechTalk@RNIB.org.uk) Also on the show, RNIB's Technology for Life team talk about online security, Steven's had the Echo Dot and Nest Audio devices delivered recently, so we compare them to other devices like the Apple HomePod, and the Sonos One, plus: lanyards, being fuelled by coffee, bad rapper names, extreme sports, Pay As You Go AIRA, and toe-breaking reviews. In the world of eCommerce, one of the biggest challenges the pros come across is selling something to a customer who physically cannot experience the product at the time of purchase. For Dmitri Siegel, that was one of the hurdles he has had to overcome as the Vice President of Global Brand at Sonos. Dmitri cut his teeth in the world of eCommerce at Urban Outfitters and then moved on to work for Patagonia. And while the number of products he was selling was reduced with each move, the challenge of building a platform that could connect with target buyers remained. On this episode of Up Next in Commerce, Dmitri explains all of the lessons he’s learned in facing those challenges, including the importance of culture, what a successful brand and website redesign looks like, and what some of the most important metrics are when you’re judging the success of your eCommerce platforms. 3 Takeaways: On any project, culture and collaboration is important — you have to be able to personalize and succinctly summarize your goal on paper so everyone knows what they are working toward Optimizing for margins per session can guide you on what to focus on when adding to your site In times of crisis, brands are given a clean slate to reinvent themselves, accelerate projects, and scrap things that haven’t been working For a more in-depth look at this episode, check out the full transcript below. --- Up Next in Commerce is brought to you by Salesforce Commerce Cloud. How about yourself? Stephanie: It's going well. It's bright and sunny, and even though we can't go anywhere, at least we get to hang out here, right? Dmitri: Yeah. Stephanie: So I'd love to hear a little bit, Dmitri, about your role at Sonos. What is your title, and if you can give me a little bit of background on what you do at Sonos. Dmitri: Sure. I'm the vice president of global brand for Sonos. It means I oversee all of our brand creative and marketing, product marketing. I oversee all of our digital experience and physical retail experience, so our web site and our physical store displays as well, and marketing operations. So kind of all the touch points that you have with our brand except for the product itself. Stephanie: Got it. And how did you get into that role, because it seems very wide ranging whereas a lot of people are like, I only control the web site or I just have this one vertical. It seems like you have a lot under your purview. How did you move into that role? Dmitri: I had kind of a crazy pivot in my career early on. I was at Urban Outfitters and I was the digital creative director, and this was about 15 years ago. It was very early days for e-commerce. And my boss left, and we were interviewing people to run DTC, and there just was nobody really that had much more experience than I did. And so I kind of made the dumb youthful move of being like, hey, I think I could do this job. And my boss at the time, Ted Marlow, was like, all right, well, we'll give it a shot. And so I went from really running creative and the web site product to running the whole business, and they were so good at operations and merchandising and finance and all these things that they felt like they could teach that to me. And so I just had this opportunity to run a P&L and run operations, and that gave me the sort of balanced background between those two things. Dmitri: And everywhere I've been, I've sort of since then, I've just sort of had that balance of the e-commerce business and creative side, and it just came out of basically someone taking a risk on me early on in my career. So yeah, it's been an interesting, interesting journey. Stephanie: That's awesome, really fun to hear about someone betting big on you like that. Was there anything where when you jumped into that role, you're like, I actually don't know anything about this- Dmitri: Oh yeah, so much. Stephanie: And what did you do in those moments if so? Dmitri: So much. Stephanie: And what are some examples of that? Dmitri: I mean, at that time, merchandising, I looked at everything as what would be beautiful, and so understanding this one might be beautiful, but it's low margin and nobody's buying it. That was an important thing to learn. And I also, I remember really early on in sight merchandising saying, oh look, we should put this in the upper left hand corner because it will sell more, or I think we should put this in the upper left hand corner, it's my favorite product or whatever. And I remember the merchandiser at the time going, you know what? I could sell a lot of old flip flops if we put them in the upper left hand corner too. You're not some merchandising genius. So understanding that, just learning the way that shopping actually happens in that medium and the mechanics of it, very humbling from that point of view. Dmitri: But I think having a learner's mentality is important at any stage in your career, I still have that feeling. There's so much that I don't understand, there's so much to learn, and most often honestly from the people who report to you or who are in your own organization. I think being promoted young into that role, I had to very quickly get comfortable with the fact that people who worked in my team knew more than I did and just being humble about that and learning from them, so that's part of what makes it fun to go to work, so. Stephanie: That's great. Have you seen your role at Sonos change since when you started because of the environment or consumer buying behaviors to where it is now? And if so, what are the biggest changes that you've seen? Dmitri: I think that I came in early on to really get the digital side of the business going faster, and we did a lot of the sort of fundamental blocking and tackling of re-platforming, redesigning the web site, but I think quickly realized that this is really a holistic business and a multi-channel business, and what's happening in the product marketing, for example, has just a huge impact on all the channels, including e-commerce. And I think some of the stuff in this field is very optimization oriented, and it's actually not as impactful sometimes as what your naming a product or defining the core benefits of that product that would actually help it in every channel. So my role has definitely gravitated more to the general brand and product messaging overall, and how that comes to life in e-comm is the harshest test of it, the best place to test that. But it's not the sole focus any more. Stephanie: Got it. Yeah, how do you think about bringing a product that's ... You really need experience. Nice speakers or great food or something like that, how do you bring that experience to life on a web site? Dmitri: It is challenging. I mean, the core benefit of Sonos, sound, is invisible, so you can't see it. And if you're listening on a laptop or on a phone, you're not going to experience the quality of sound that we go for and that we create. But really, I think every product has that challenge. I mean, I like to think that Sonos is more complicated and more difficult, but I think you always have to just be really, really rigorous and relentless about what the value is for the customer and then illustrate that in words and pictures in a very slavish way. And I think it has to be like a pop song. There's no guitar solo, there's no 15 part middle part. It's got to be really to the point and verse chorus, verse chorus. And I think that rigor is really, it's true for us probably more so because it is an invisible, ethereal, emotional kind of thing. But I think it applies to just about any product. Stephanie: Yep. Yeah, I agree. One thing I saw on your web site that, I don't know if it just hit home with me, but I thought it really made me think about the experience was when I was scrolling, I saw the speaker on the page and it had little sound bars bounce off the speaker, and it made me be like, oh, cool. And it gets you kind of in that music mode and just thinking about, I wonder how that sounds now. I'm assuming that was intentional, and if so, was that your project? Dmitri: Yeah, so we actually have an entire style guide of how to show sound and how to talk about sound. What are the words that you use? What are the circles that emanate from the speaker, and is this stereo sound or are we showing the tuning of the speaker? And our brand design team, I think in some of the ways that ... Oh, God, this is a random story, but I remember going to a creative summit for McDonald's, and they had an entire session on the Coke and how to make the Coke look delicious and thirst-quenching. And then there was the burger session, and that sound is that for us. We have to be really consistent and relentless again about how do you make this thing look like it sounds great? Dmitri: And there's actually different ways we do that. So in above the line media, for example, we use this very bold waves of sound coming out of the speaker that really grab your attention. When we're doing an education piece like what you saw on the web site, we want to me more articulated about what the sound's actually doing in that moment, so ... And then we have to package that up as a tool kit so that marketers all over the world and partners can show it in the same consistent way. And it's true that repetition and that consistency that I think you actually build a sound brand. Stephanie: Yeah, very cool. And how did you come up with that style guide? Was it a huge project that took a lot of buy-in and everyone had a different idea, and then did you have to train your retail partners or other people of how to interpret it? Dmitri: I think everything always starts with listening and listening to your partners and understanding what they're actually going to use basically and what they really need. And so the style guide was sort of a culmination of a lot of projects where we would have conversations about, God, I can't see the speaker in this shot. I wish there was some way to call attention to it, or the sound of the speaker is so ... You have five speakers in the sound bar, but I can't really tell that from what you're showing me. So hearing a lot of that, and then trying different things and saying, well, this really worked, or this didn't work, and then compiling it ultimately into a style guide. But we didn't set out with a white sheet of paper. It's more listening to the needs and solving the problems of the marketing organization and the go to market organization overall. Stephanie: Got it. Very cool. And I think I saw y'all just did a whole brand redesign with the colors and all that. Do you want to talk a little bit about that, because I don't see many brands doing that. It's usually like, I pick my corporate palette, and it's blue, and it has to be blue for the next 100 years. How did you think about changing that? Dmitri: Yeah, this redesign, it was the coolest one I've ever been a part of because we were able to do the site and the brand redesign at the same time. So often those are two separate projects and maybe even two separate teams where you have the brand design team that goes and comes up with this really cool, hip, exciting brand identity, and then you have this web design team that's like, I can't use any of that. I don't know how I'm supposed to get that to work on the web site. Because we're all one team, we were able to really work on it simultaneously. So we would do some brand exploration, and then we'd be like, okay, maybe the product detail page with that, okay, settle on some core messaging, does that work on the home page, and go back and forth between web design and brand design simultaneously. Dmitri: And we just have a really good team that is really collaborative, and we all had that mission in the end, we want you to see an advertisement, go to the web site, and have it be totally consistent. We don't want these disconnects where the ad sells you something and then you get to the web site and you're like, what kind of ... I thought this was that kind of company, but it's this kind of company. And so that process was really digitally driven. But a lot of times, if you just approach a ... Like we just redesigned the web site, you don't get that sort of high-level brand thinking and strategy to it and communication hierarchy and stuff. And also, you just don't get the sizzle of brand to it. You sort of can get a very functional thing, and we're a premium brand and we command a premium price point. Dmitri: And I think if people show up at your site and it looks like an out of the box thing, then they're like, I don't know if they're really going to deliver on the experience side, so ... It was really cool to balance all of those. And then as far as the question related to color and our brand identity, our product is really black and white. That's the design philosophy of the product itself is that it's really bold, high contrast black and white. And our brand identity was the same way. It was very bold black and white. And what ended up happening with that is you couldn't really see the product because everything was black and white. Dmitri: And then also our category, all of a sudden everybody was just really severe black and white. And so we just, we didn't have a great context to show the product. We weren't standing out in the market. And so our brand is more about the lifestyle of the experience of your home, having high-quality experiences with music and content. And so once we started bring the color in, it just, the product could really pop out, and also just our brand looked really different in the category, so ... We didn't choose a brand color. These colors will keep changing over time, and they're more in a digital, kind of almost a seasonal fashion kind of usage. But this definitely feels right for our company and our product. Stephanie: Yeah, no, that's a great way of thinking. Are there any best practices you learned when trying to work with multiple teams to update the brand and update the web site? Any dos and do nots or places where you're like, oh, this went wrong, but this went really well, and ... Yeah, any guidance for other companies who are listening right now, like maybe that's a good idea to do both? Dmitri: I mean, you really have to build trust in your team, and it's about culture I think first. We couldn't have done that kind of project four years ago. I think our culture is at a place where we trust each other, we're collaborative, we have a shared goal in mind. We're willing to be honest with each other about what's working and what's not working. So I think you have to have the right culture to do that. I think also, when I very first got out of college, I taught school, public school. I was- Stephanie: How cool. Dmitri: An art teacher for a couple of years, and- Stephanie: What grade? Dmitri: It was junior high and high school, so- Stephanie: Okay, that's kind of a hard age to teach. Dmitri: It's very- Stephanie: They can little meanies. I was, anyways. I was a meanie. Dmitri: I mean, when you have 30 kids in a New York City public school, and you have no carrots and no sticks, I think what I learned from that experience is just like, you have to externalize the goal. It can't be personal, and it has to actually be written down and be agreed to as, this is what we're going to do, what's on this piece of paper. It's not about me and it's not about you. It's about what's on this piece of paper. And I think that was helpful with this redesign. We just had a really shared sense of purpose that wasn't the brand team's agenda or the product marketing team's agenda. It was like an external third thing that everybody was working towards- Stephanie: I like that. Dmitri: And I think that's really important. Stephanie: Yeah, no, that's great, because then if not, you've definitely got teams kind of battling it out and competing and trying to push agendas, and it's nice to ... It's kind of like putting it on a higher authority of, well, this is what we all agreed to, and this is where we're headed, not towards either one way. That's great. Dmitri: Yeah. Stephanie: Were there any tools or technologies that you utilized or implemented that really helped with updating the web site and updating the brand? Dmitri: I don't think that technology played a huge role in it. I mean, Google Slides. We use Google Slides a lot. Stephanie: Tried and true, yep. Dmitri: But I think that the tools of the trade are pretty consistent. I think that the ... I mean, when you ask it that way broadly speaking, Zoom, Google Slides, and Slack have really enabled us to collaborate with different agencies and with different teams, often in different locations. And because we were already working that way, this current disruption is pretty seamless for us in terms of how we work. It definitely posed a challenge in terms of our typography. That's a huge thing obviously that drives design and it drives my point of view on design, and when you're working in a digital medium, it's just, it's really different. That's actually one of the places that I think brand design and digital design kind of get crisscrossed is brand design is generally this print-driven medium where you can be pixel perfect on every single bit of typography, and digital is just, it's just much more dynamic and you have less control over every application. So I think that's one where we had to carve out enough time for the digital team to solve those problems. Dmitri: Often you throw over this PDF and you're like, this is how I want it to look. I want it to look exactly like this. And they're like, well, that's going to take some custom work, because type doesn't really set up like that in a browser. So we were I think good about leaving enough time to actually do that work. Stephanie: Very cool. Yeah, that's great, and how did you think about measuring success of the redesign, or what's the impact been since you launched it? Dmitri: Our business is doing great. I think in my experience with redesigns or re-platforms, there's usually a dip when you first launch, and then it normalizes. I actually see that a lot in product reviews and app updates, and it's something I wish someone had told me when I was younger, because I used to freak out in the first couple weeks when you launch something new. But what we've seen is a lot of people understand the product better. That was our big goal is, people still were saying they didn't understand how the system worked or how the products worked. And so the customer understanding was a big goal of ours. And there were things where design choices really helped that, and then there were things where design choices didn't help that. So for example, one of the ways we did image galleries when we first launched didn't make it really super-duper clear how to click to the next image. And so we found that ... We did user testing all through before launch and after launch, and that single change, for example, had a huge impact on customers' understanding- Dmitri: The product, clicking through the whole gallery of images or finding the support link on the site for example. We kind of buried that in the original design and then found, no, that's really important, because if someone needs support, they really want to find it and they don't want to have a hard time finding it. It's been a while obviously since we launched it, but all the product launches have gone really well. The cognition and understanding of how the products work together is way up, so it's going well. Stephanie: That's cool. How do you find out what the customers are struggling with? When you're saying the support link was too low, how did you know that was a problem? Dmitri: I mean, it's a mix of quantitative and qualitative. So you're looking at behaviors, and wow, people are stuck on this page or they're clicking on this part of the page more. And then qualitative of just asking them what their experience is as they go through. So saying all right, we want you to go to the site and buy Sonos One, and then kind of narrate your experience as you're going through it. And that's where you kind of get some of the specific things that you wouldn't see in behavioral, which is why someone is doing what they're doing. It's just as important as what's happening. Stephanie: Got it. Very cool. And have you updated the technology behind your web site in the past couple years, or have you stuck with one thing? If someone was coming in and building a big e-commerce store now, is there anything you would recommend to keep up with customer demand and inventory and, yeah, everything that it takes to run an e-commerce store? Dmitri: I mean, I think that is one of the things that's changed so much in my time in e-commerce. I think 15 years ago, 12 years ago, it was really a life or death decision about what's your e-comm platform? You're going to be stuck with this. It's going to take millions of dollars and years to implement, so a lot of your success or failure was based on decisions about technology. I think that the tech has gotten a lot better. It's gotten a lot more accessible from a price point perspective. Implementation's gone a ton easier. It's still painful to switch, so switching costs are real. Dmitri: But I would say you're so much better off starting today than even two years ago. The platforms are super accessible, and in a way, I mean, I think a lot of the skillset has actually become automated and commoditized too. Search optimization or even a lot of the sort of marketing tactics that drive e-commerce, that used to be a real differentiator. If you were an analytically driven marketer, you could get an edge. But a lot of times now, you're better off just going with the platform automation on these things. So I think my advice would be, the thing that always you forget is the content management piece. You can launch with a great web site, but every day, you're going to want to update it and launch new products and launch new features, so really understanding how you're going to make new templates and how you're going to add new content is the thing that generally people overlook. Stephanie: Got it. Yeah, how do you think about that intersection of your content management system, your CRM, your underlying commerce platform? How do you think about those three together? Do they work together in sync, or are they kind of separate entities? Dmitri: I'm going to be very unpopular probably for this opinion, but I mean- Stephanie: Good. Dmitri: I think you can spend so much time and money trying to create this temple to technology, everything seamlessly integrated on the platform side. But what I've learned is that, or I feel like this has changed since I got into this business, but is that if your message is consistent, then you can actually let the tools do what they do, and your customer journey will be consistent. And the more that you focus on consistency of your message and your customer journey basically, your customer communications, you can allow the different technologies to do what they do best and be less obsessive about connecting every single point of customer data. Now I mean, that's also relevant to our business. We have 10 products. If you're Amazon or Wayfair and you have just infinite complexity in your assortment ... That was more the Urban Outfitters experience. We had 20,000 styles and we launched 7,000 styles a week, and so there was this huge how do I connect the right product to the right person challenge. Dmitri: But for a lot of businesses, you're dealing with a finite product set, and as long as you're consistent in how you're showing those products and what you're saying about them, you can let your re-targeting vendor go crazy. You can let your CRM program go crazy, because it's all going to add up to the same story in the end. So I think that I often feel like people spend more money trying to back of house stuff than they do on the customer, and I always try to look at that split of, are we spending money on the things that the customer can see, or are we spending money on ourselves to make ourselves feel cool about the systems that we have, and just balancing those things. Stephanie: Got it. Is it very different with a platform that has, like you said, a huge catalog versus only 10 products, and is there a different way you would handle an Urban Outfitters model when you were there versus at Sonos? Dmitri: Yeah, I mean, it is really different. The three big brands I worked with are Urban Outfitters, Patagonia, and Sonos, and each time I've gone to a smaller and smaller assortment because it's such a pain in the ass to have a big assortment that I was like, I just want to get to a smaller assortment. But- Stephanie: You're going to be down to just one product soon, just that's all Dmitri sells- Dmitri: That's my dream. Stephanie: Just one thing. Dmitri: Live the dream. No, it's really different because all the tricks of merchandising ... I think of like, people have been shopping since the Roman forum, right? It's a very human experience to wander around and find the thing that reflects your sense of self and choose it over the other thing and buy the middle price point because it's not too expensive. All that stuff is super innate to people. And so I think when you have a big assortment, you have a lot of products to play those games with, like this is something new, so you should look over here because it's new, or this is going fast, so you should look over here. With Sonos, it's very much about getting people to understand the experience, and get it that it's like, you can mix and match all these speakers. You can buy one or you can buy three, and you can move them around the house. And they need to understand that gestalt much more than ... That's more important than them picking one speaker and having a box shipped to their house. Do you know what I mean? Stephanie: Yeah. Dmitri: They might get that idea, and they might buy something at Amazon or at Best Buy, but if they get that concept, they're a super high-value customer, for us that's more margin to better business for us to be in. So a lot of what high product count sites are about getting you to a decision and to put something in your basket and check out, and for us I think, and for a lot of businesses and a lot of DTC businesses that have these narrow assortments, it's much more about communicating the gestalt and the value of the product. Stephanie: Mm-hmm (affirmative), yeah, because I'm sure once someone buys one, two, three, then it's like you've got ... That lifetime value of that customer is bigger because they're going to come back. And now I'm looking right now, we have our Sonos speaker, hey, right next- Dmitri: All right. Stephanie: To me, but I don't know ... I mean, we have a couple in our house and all around the studio, but I don't know if I'm getting the full value of it because the only songs that seem to play on our speaker are Old MacDonald and Happy and You Know It, for my two-year-old, all day long. So I think there's a bug. I need to send it back and get that updated hopefully soon. I'm sure you have the same problem. Dmitri: It is fun, though, singing to your kids though isn't it? Stephanie: Yeah. Dmitri: I love that aspect of it, just sharing music with them and dance parties and ... We're so often with our headphones on in our little phone world, but having it be something that you can share with the kids is really fun. Stephanie: Yeah, but I also enjoy that you can ... I'll turn off the kitchen, just leave the living room running and be like, you go have your dance party out there. I can't listen to that song another time. Dmitri: Totally. Stephanie: So if you're thinking about defining success for an e-commerce platform, what do you consider successful? What metrics do you look at? Yeah, how do you think about that? Dmitri: Well, if I have to pick one- Stephanie: Yep, only one. Or you can pick two, but stack rank them. Dmitri: Oh man. I mean, the ultimate one to me is margin per session. Stephanie: Okay. Dmitri: It's not the easiest one to get at, but I think traffic is really a tough one because it's driven often by an e-mail or it can be driven by bad things or you can have a bunch of crappy traffic that's unqualified. So like, great, you've done this marketing campaign that's not converting. I think conversion, you can have people again, like you could be converting on a sale product that doesn't generate a lot of revenue profit for the company. And so I like per session because it just, it corrects for traffic basically. And then I like margin because it's like, it motivates you to sell the high margin stuff and sell the high-quality stuff, and those are generally your best products and the things that bring people back and make them more high-value customers, so that one's really, when you're really in the weeds of it, that's something that I look at. Dmitri: And then usually, you're designing a specific part of the site and so step conversion is really helpful to look at, did I get them to go from here to here? Because if I didn't, then I know they're not going to get to the final steps of the process, but ... I think that, in my role, one of the things that's important is just a very high-level business understanding of margins are basically what you can charge for the product. It's based on people's perceptions and perceptions of your brand, and you have to dedicate a certain amount of time to just faith in that. And that's a pretty high-level thing. I don't expect someone at a junior level or somebody who's responsible for the day-to-day revenue of a particular category to get, but if you don't invest some of your development time and reinforcing premium, then you just, you're not going to be able to charge the margins. And so that's one that's a little more high level, but ... I think of the brand comes through in the margin. Stephanie: Got it. I think I just heard that Amazon's switching their algorithm to showcase higher-margin items, where before it was always based off of what they thought the customer would want to see first. How do you strike that balance between maybe showcasing higher-margin products higher up ... I mean, I know there's not many, but how do you think about that versus making sure the customer experience is what they want? Dmitri: Yeah, so it is less of a challenge with Sonos because our product philosophy is to make the fewest number of products possible for the most number of applications. So we only have a couple home theater products. We only have a couple of music products. And it's really about the size of the room, but I think it's like, that's all merchandising stuff. We sell 80% black, but you always show the color because it's going to excite someone and make them feel like the experience of wearing a great new jacket. And I think with sound, it's the same thing. I kind of want to get people emotionally invested in the experience of music, which is awesome, and just remind them, listening to music is great. Dmitri: And so that's kind of the first thing that we try to lead with is just what a great experience this is and reminding people that they have ears and it's one of the only five senses they have and it can be really transporting. And so that generally is going to be more of our premium products that do that, but then they're going to ... Most people will buy the middle price point. That's just the rules. Stephanie: Yeah, got it. Very cool. So to shift a little bit to the present day, the current environment, everything with COVID-19. Do you guys see a lot of changes in your business right now with what's happening? Dmitri: Our business obviously is ... We do a lot of business in physical retail, and physical retail is closed. And so that has really been disruptive to a lot of our partners and the people that we work with. And so on a personal level, it's just, it's hugely impactful. And obviously, we are really invested in our partners and the people that we work with. And so we're doing everything we can to work with them. A lot of that volume has shifted to online channels, so most of our partners have a web site and they're seeing that too, so their business is shifting online. Our direct to consumer business is way up. Dmitri: And so I mean, I think that is a circumstantial behavior. People can't go to the stores. Stores are closed. That's a behavior, and I think what people expect ... I feel like everybody is re-evaluating everything 100%, and you have a complete clean slate as a brand, which kind of sucks if you have a great brand like ours. You're like, wait, remember yesterday you thought we were awesome. I think every brand has to kind of start over, and every action you take as a brand is going to be evaluated in this new reality, like do I need Sonos now? Do I need to travel now? What do I actually care about now? And I think that's an incredible, almost once-in-a-lifetime experience. Dmitri: And anybody who's, especially young marketers and brand people going through this right now, this is going to be the proving ground for the future. The greatest brands of the last century were defined in the world wars, and the brands that figured out how to endure the Great Depression and those disruptions, and they didn't do it by disappearing. They weren't created by going off radar. They figured out how to stay in the public consciousness and to be relevant, even when people felt so horrible. So that's what I'm thinking about a lot right now and observing in the marketplace. Stephanie: Yeah, no, I agree, definitely the clean slate idea of everything can change from this point forward is, yeah, good to remember. Is there anything that you're, like any big strategic projects or things that you're shifting either off your plate or a new thing that you're starting to work towards based off of consumer buying behavior over the past couple months? Dmitri: Yeah, we really had to take a look at how our brand shows up, as all companies and brands do. And we really, we tend to be a very aspirational brand, and I think in this moment, it's really important to be personal and to be helpful and to just kind of tone it down a little bit and be real with people. And that's a big effort when you have a global marketing offense that spans channels and geographies, and the team just did an incredible job of realizing, accepting, and taking action and is continuing to learn and adjust as we go through it. But I think we couldn't just show up the way we did two months ago. Everything you do has to in some way be relevant to what's happening right now. And so it's touching everything. Dmitri: We're fortunate in that our product roadmap hasn't changed. We haven't had to take major programs off the board in terms of not being able to fund them or whatever. And we're at an incredible busy time right now. We have these two major launches coming up. So we were in the final mile of that work, and so we've just been proceeding, but then also, yeah, got to look at it through the lens of what's happening today. Is this going to seem off, or is this going to seem weird to be doing this right now? And you have to pull the plug on it if it's going to not look good for the brand. Stephanie: Yep, yeah, completely agree. It seems like it's also a good forcing function to make larger brands be more agile and make decisions quicker and be able to adjust to the market, whereas before this, I don't think there was that forcing function. Dmitri: It's true, and I think it accelerates changes that were already happening. So I think that's a situation like this, anything you were thinking of doing, you're going to probably, you're going to have the opportunity to do. It's also just a giant dumpster fire that you can throw almost anything on. If you want to get rid of something, some old behavior or if you wanted to ... I mean, I see brands that were really struggling with their perceptions, again, they have this fresh moment. They can throw their old identity on the fire and re-introduce themselves, and it's almost like a once-in-a-lifetime opportunity to do that. So definitely looking to take advantage of that as well, like what do we want to shed? What do we want to get rid of? Because that's also part of the opportunity right now. Stephanie: Yep, yeah, I think the brands that'll experiment a bit with that as well and try something new like you said are going to be the ones that come out on top, because I've seen quite a few come through my inbox that just have the same messaging. And I'm like, did you all just hire the same PR company to just be like, title, addressing COVID-19 challenges. It's like, here's what we're doing, and it's so cookie-cutter. I'm like, I don't connect with that. But the brands who send unique messaging and you can tell they care, like you're talking about Sonos really showing that you want to be there for them and the retail partners and the customers, that's very different. And yeah, you can start from scratch and have a whole different journey from here on out depending on how you choose to handle it right now. Dmitri: Yeah, and I mean, some of that is luck of the draw. When we went into that process of self-examination, we're like, okay, our mission is to give people a really deep, immersive experience of music and content in their home. It's like, that's still pretty relevant. Our goal is to connect people to music and as a way of making their lives richer and escape. That's still pretty relevant. I mean, it's not luck, but we're very lucky that that's what our product and what we stand for as a brand is still really relevant, and then it's more about like, okay, how do we talk about this in a way that's relevant? But I mean, look at Zoom, look at Portal, products that you were sort of vaguely maybe aware of all of a sudden are completely relevant and useful in your day-to-day life. So you've got to kind of be grateful if you happen to fall into one of those categories. Stephanie: Yeah, and the fact that there's so many new customers who are sitting on the sideline that are now coming on board. I mean, I'm thinking about for Zoom, it's my grandmother sent a link and was like, family Zoom call? I'm like, Grandma, how did you know about Zoom? And then my mom's like, oh yeah, I've been using that for teaching. I'm like, you guys ... I mean, we just got on Zoom not too long ago. But it seems like a very good time to be able to bring people into your product that you never had access to before and you might never have had access to them, unless something like this happened maybe. Dmitri: I know, and I do think this is one of the things that you won't go back from. I think it'll go back to some extent, like you won't have every school in the world doing school through Zoom, but it works really well, and you can be more remote. I think about the follow-up doctor's appointment. You go to a doctor and then you're supposed to come back a month later for a check-up, and you drive an hour and you sit in the waiting room, and then you go in for five minutes for them to be like, yeah, you're fine. It's like, you're not going to do that any more. You're just going to get on Zoom and be like, I'm fine, and they'll be like, cool, you're fine. Everybody's going to save a couple hours. And so I think there will be lasting effects on our behaviors and we're not going to want to go back in every way to the way things were. Stephanie: Yeah, no, that's actually a good point about doctor's office visits. I have two twins, they're seven weeks old now. And we went to their doctor's appointment, and one of them had a little baby acne or something. And they're like, well, don't come back for a follow-up. Just snap a picture of it and upload it into a Google Doc, because we can't access pictures but we can upload Google Docs and just do that. And I'm like, oh, from now on, then I'd rather just always do that. I don't want to come in here and expose my kids to maybe get sick from coming here. I'll just send you pictures and let me know. Dmitri: Yeah. Stephanie: So, yeah. Dmitri: But I mean, we're in the orbit of Los Angeles, and we have our own traffic situations, and there's so many trips that are just a total waste. Stephanie: Yep. Dmitri: My wife's a therapist, and you couldn't really do psychotherapy or therapy via Zoom. It's not secure, but there's so much innovation happening in that space right now with HIPAA compliance. And so yeah, I think less time in transit isn't a bad thing. More time at home listening to Sonos. Sounds good. Stephanie: I know. Hey, I'm all about that. I'm definitely all about that. So when it comes to leadership, whether it's in times of change or just in general e-commerce leaders, who do you brands do you look for, what brands do you look to or people in the field that you kind of keep tabs on what they're doing? Dmitri: In terms of leadership, I mean, I think we have an amazing CEO. My boss is amazing, so I feel really fortunate that I don't have to look too far for leadership inspiration. Stephanie: Yeah, that's good. Dmitri: That would suck if you were like, I don't know, I can't find it in my company so I have to go read a book- Stephanie: No one here. Yep. Dmitri: But man, leadership is one of those topics that the longer I work, the less I really feel like I understand it, or ... It's such a human one-to-one thing, and I think that what I like about our company and our CEO's approach is that you really focus on the culture overall and not this meeting practice or this latest book or whatever. It's just this consistency of how we treat each other is really the focus. And every time you go back to that, it actually helps you through a management challenge. And I think right now, the thing is just to be really, really patient with people and really understand how hard it is to do this. You've got kids crying in the next room, you've got elderly parents that you can't go be with. It's emotionally really stressful and really hard, and the best thing you can do as a co-worker, forget being a leader but just as a co-worker and a human, is to just be patient with people and to understand that it's going to ... Their first reaction, they might be coming in hot to a meeting because of something else entirely. So I think that's really important, and then ... Yeah, I think as far as brands and companies that I look to, there isn't a single company. It's interesting, we have these sort of index fund companies, like Apple, Amazon, Google. They do everything. They do every single kind of marketing, they do every single kind of branding. Dmitri: So you can always find an example there of, well, if you had unlimited money, this is what you would do. So I feel like that's kind of an interesting resource that you can always ... Or if you have contacts there or whatever, asking them questions, and we do a lot of partnerships with them. So that's always a good test I think of whatever you're thinking about. I do tend to look at smaller brands as far as just what's happening and how you want to look as a brand. It's been really interesting, again, to see how fast everybody's adapted from a branding perspective. Every single ad right now is people on Zoom or healthcare workers. I think a month ago, I was like, I don't think people are going to be able to advertise. What will be in the ad? And then it's just so fast. Everything's moving so fast. You just have to- Stephanie: Oh yeah. Every ad's that's catered to me right now is sweatpants and work from home outfits, which are basically sweatpants that look like jeans. And I'm like, man, I mean, that's what I want to buy right now. This is great. Dmitri: This is one of the challenges I think for consumers and for brands is that because everything is so automated, algorithm-driven, you kind of get into these wormholes, and you get into this, I call it a coffin of your own preferences. You can't see a way out of sweatpants, like, how am I going to get these sweatpants off my Instagram feed? And brands, that's a challenge for us too, like how do we break through that just self-reinforcing? Yeah, you probably are interested in sweatpants right now, but getting you to see something else is challenging I think, so- Stephanie: Yeah, I agree. Dmitri: Have you pulled the trigger on sweatpants at all? Stephanie: Well, before ... I mean, I own many sweatpants. Thankfully, our company is work from here a lot, so I don't have to always wear nice jeans. But I did pull the trigger on one pair of jegging pants- Dmitri: Nice. Stephanie: That look like jeans, so at least when I go on a walk, people think I'm fancy. So, I did. Dmitri: I am in the sweatshirt business right now. I get in these shopping sort of really focused trapping things, but it's almost more as a way to work through some of what's happening in the market? What's the customer's mindset? But I do it through my own experimenting on myself kind of thing. Yeah, and it's pretty extreme what's happening, whole businesses that are 70% off. And at the same time, the options are totally unlimited and it's a really, it's a time when I think you have to stay incredibly alert in the moment, because it is moving so fast. You can't sort of ... People want there to be a new normal, like, oh, we did it, the new normal of marketing and e-commerce is this. But I don't think we're going to get there for a while. Dmitri: I think people, we're going to have to be on our toes adapting for months. And that's going to be a challenge for the teams, because the teams are like, we just did all this work and now we have to change it, or what do you mean we don't want to show Zoom in any of our coms any more or something. But I think the fall into the Great Depression took four years. This took like four weeks. This is just a hyper-accelerated world we're living in, and you've got to stay alert. Stephanie: Mm-hmm (affirmative), yeah, completely agree. So if we zoom out a little bit and have a conversation on higher level e-commerce trends, are there any e-commerce trends coming that you're most excited about or that you're looking forward to? Dmitri: I think the trends that I've noticed recently is really the commodification of digital marketing and that, again, there used to be able to be a differentiator. You could pretty much get a business going by raising some money and then using these platforms to grow, and the platforms were willing to kind of subsidize your growth because it was their own growth of market share. And then about a year or so ago, that really flipped, and the platforms are like, no, we're going to take the profits now. We're going to be profitable. And so you saw these DTC brands I think really struggling that their customer acquisition engine wasn't as profitable as it used to be. So I think what I'm really excited about is I do think that there's a rejuvenation of the social channels. I think the sort of toxicness of them, at least my experience over the last month, is that they've gotten way less toxic. Even Walt Mossberg is back on Facebook. Stephanie: All right. Dmitri: That's a big deal. Stephanie: Yep, that's a good sign. Dmitri: So I think that the potential of those channels never got fully realized of as far as really being able to connect with people and brands in an authentic way and have that follow through to your business, and I kind of feel like that might be what we're going to actually experience now, where the targeting is so good, the relevancy is so high, and the community aspect is getting less toxic because of just, people are not wanting to be assholes right now I think- Stephanie: Yeah, which is a plus- Dmitri: As much, yeah, as much, and I think the platforms, I hope they'll take a little more responsibility too in this moment and go, okay, this isn't just about an election. This is life or death now. We can't allow such misinformation and just toxic behavior, because it's costing lives. So anyway, I see this sort of perfect storm there of social actually becoming the commercial channel that it never really realized in the past. And so that's one that I'm pretty excited about. It's obviously the only way we can reach people right now. And the ability to pull it through to your actual business is getting really, really good. So that's probably one that I'm excited about. Dmitri: And then I think also for us, the integration with our app and just that part of the digital experience and connecting the online to the in-app. I just had a great experience buying a printer and using the app to set the printer up and having- Stephanie: Really? Which printer? Dmitri: Yeah. I mean, I don't want to shill for another company, but I bought an HP printer, and they forced me to set it up with the app, which I was super annoyed by at first. But then I was like, wait, this is actually really cool. It's just going to measure the ink and send me the new ink when I want it? Yes, please do that. I hate- Stephanie: Oh, that's great. Dmitri: Finding out that I need to order ink. So I think this integration of IOT devices and the app component with the commerce component, I'm super excited about that for us. I think we've taken a lot of steps in that direction, but I think people are going to get more and more comfortable with it because it's actually going to be a good experience. So those are two that I see. Stephanie: Completely agree. Yeah, and especially the first one. I've seen a slow shift to brands kind of turning into media companies and not relying as heavily on certain platforms, because yeah, I know a lot of brands that had been relying on Amazon so heavily. Well, now that Amazon's shifting to, okay, well, here's what we view as essential and here's what's going to get shipped out, and I think a lot of brands are going to rethink relying on those platforms and instead maybe think about how they can rely on themselves more and promote their content on their own a little bit more. So yeah, two really good points. All right, so let's ... I think we only have a couple minutes, so I don't want to ask you too many things. Let's see. And actually, maybe we should just shift right over to the lightning round, just to respect your time. So the lightning round is when I ask quick questions, and you have to just say whatever's top of mind, and you only get one minute or less to answer the question. Dmitri: Oh my God, I was not aware of the lightning round. Okay. Stephanie: Dun dun dun. Dmitri: I want to do a couple push ups. All right, I'm ready. Stephanie: Yeah, do some push ups, do some deep breaths, just shake it out a bit. It's just for fun. But yeah, whatever just first comes top of mind. Dmitri: Okay. Stephanie: So we'll do some easy ones first, and then we'll do a hard one last. All right, so, what's up next on your reading list? Dmitri: The Last Kid Left by Rosecrans Baldwin. Stephanie: Okay. What's up next on your podcast or Audible queue? Dmitri: Stay Free: The Story of the Clash and Music Exists. That's a podcast I'm listening to that's really, it's just ... It's Chuck Klosterman and one of the guys from The Ringer, and they don't talk about specific music. It's like music concepts in general. I like it. Stephanie: Oh, cool. And you have a art background, so does that ... Do you think everyone would like that podcast, or is that more Dmitri specific? Dmitri: If you like music, I think you'll like it, yeah. I mean, they talk about like why do bands change? Why do bands change their style? Stephanie: Got it. Dmitri: That will be a topic they'll talk about, and they'll be like, okay, ACDC never changes, but this band did ... So it's that kind of thing. It's just like hanging out with your friends talking about music, but your friends are really smart. Stephanie: That sounds cool. I like that. All right, what's up next on your Netflix or Hulu queue? Dmitri: Oh man. I started watching Black AF, which is the new show from the guy who created Black-ish, and it is- Stephanie: Me too, yeah. Dmitri: It is so funny, oh my God. Stephanie: Yep. Dmitri: I basically can't wait- Stephanie: I just saw it last night. Dmitri: To ... Yeah, I can't wait to just go binge that thing. Insecure just started again, which I love that show, and My Brilliant Friend, which is on HBO, which is the Elena Ferrante books. I just, every episode I'm dying when that comes out. So those are my picks. Stephanie: Cool, I'll have to check out that last one. I haven't heard of it. What's up next on your travel destinations after we're allowed to go out into the world again? Dmitri: I want to see my parents. That's definitely- Stephanie: Where are they? Dmitri: They're in D.C. Stephanie: Okay. Dmitri: That's mostly my friends. It's like it's less destinational for me, but ... I lived in New York for a long time. I want to go back to New York. I love that city, I love so many people there. It's been through such a hard time. I want to go there. We had dreamed of going to Japan before this, so that's definitely going to happen at some point. I love going there. Stephanie: Awesome. Dmitri: My kids have never been there, so those are a couple spots. Stephanie: Yeah, Japan's great. That's definitely one of my favorite places I've been. It's so fun. The people are so nice there. Yeah, just a good, very different environment. Did you do the hot spring baths? What are they called again? Dmitri: Onsen? Stephanie: Yeah- Dmitri: Yeah. Stephanie: Did you do those? Dmitri: Yeah, I would go. When I worked at Patagonia, I would go a bunch, and it was a cool way to go there because we actually didn't spend any time in Tokyo. We would go up to Hokkaido and go skiing and go down [inaudible] and go surfing. And so yeah, it was ... The culture, even outside of Tokyo, is just so cool. Just everything is so considered, and every experience is thought through, and yeah. Stephanie: And everything's so clean, and it just feels so safe. We were in I think Hakone area, and there's a bus system that goes around, and there was kids, and I swear they were only like five or four, getting on the bus by themselves, going to school. And I'm like, oh my gosh, in America, no parent would ever let you just walk all the way down the street, get on the bus by yourself. I mean, these kids are small. But then, there, it actually did feel right for some reason. Dmitri: Yeah. So I hope you get back there. Stephanie: Yeah, very cool. All right, the last one. So it's your job to stay ahead of expectations, your competition, all that. In your opinion, what's up next for e-commerce pros? Dmitri: I think that you can't just be shipping boxes to people. I think that your site experience and your commercial experience, you've got to break the mold of, pick a box on our web site and this box will show up at your doorstep. I just think that's not a competitive advantage, and it's just not a customer advantage. And you've got to figure out some other way of engaging your customers that isn't about shipping and getting a box delivered to their doorstep. So it'll be different for every business, but I mean, I think obviously subscriptions are interesting, but also just the way that you decide what you want, it's not navigating a bunch of little squares on a page, but really learning about me and understanding and what I need and offering me a solution versus a box that's going to get shipped to my house. Dmitri: So I think the site experience and how that connects to either if you have an app or your CRM programs, all that stuff, it's ... The paradigm is just dead right now, and I think if you're not disrupting that, then you're going to just be perceived as, why am I bothered? Why would I bother shopping here? I can get a box shipped to my house by a lot of other companies. Stephanie: Yeah, completely agree. Wow, you were very good at the lightning round. You really had answers right away, so yeah, nice job there. But yeah, it's been a blast, Dmitri. Thanks so much for coming on the show. I know after this, I'm going to go and play all my Sonos speakers and put on a little surround sound techno music going on to pump me up a bit for the rest of the day. So yeah, thanks for- Dmitri: Oh, that sounds good. Stephanie: Hopping on. Yeah, it'll be a good rest of the day. So thanks so much. Dmitri: All right, bye bye.

Bryan: He should let people know that. [Laughter] Alison: He really doesn't gloat about that enough, but yeah. Jeff: So Alison you use your phone on a daily basis. [Laughter] Alison: The face ID, I'm still, I find myself still kind of getting used to this new thing called face ID. Jeff: I want to see the Grinch again this year. Bryan: So you want me to come visit? [Laughter] Big smiles okay, three, two one, welcome back to yet another episode of that blind tech show. I know it's been a very long time since we've been here in fact you've probably heard a lot of us on other great technology podcasts. I know our friend Allison Hartley recorded one of her regular tech doctor podcasts as well as she was on with the great people over at main menu. And you may have heard Jeff Thompson on with AT Banter and I believe he's got another podcast coming out with the good folks over at Mystic Access and you may have heard me on Blind Bargains but we finally got the band back together again and we're here to talk you through some of the holidays and the goings on now, so I'm going to go ahead and say yeah how you doing over there Allison. Alison: I'm doing okay, it's the day three of a four-day weekend so I'm just kind of milking the the time off work for all it's worth, I've been reading good books that I'll talk about later and eating lots of food, lots of pie, so much pie. Bryan: There's never such a thing as too much pie. Alison: No never. Bryan: What about you Jeff, how has your Thanksgiving holiday been? Jeff: Well pie is a continuum. Alison: Yep. Jeff: It's been great here, I've been bacheloring it, the family's been gone, and I'm living it here with the dogs, happy Thanksgiving, it's Thanksgiving everyday now. Bryan: I'm actually down in Florida still recording you see, we're all about bringing you the show. Holidays don't stop us. One thing I was very excited though on the plane ride down here, I was very excited some of you might have heard about therapy pigs getting kicked off planes. [Pig noises] I'm happy to report there was no therapy pig on my plane down here, just get old Nash in me. How about you Allison, have you ever been on a plane with a therapy Pig? Alison: I have never been on the plane with anything more exciting than another guide dog, I have to say. Bryan: What about you Jeff have you ever traveled with any pigs? Jeff: No but it, it would wouldn't be that bad if it was therapy bacon. Alison: Oh yeah. Bryan: That is true, that is true and for those of you not hear about that story it's actually not the first time a therapy pig has gotten kicked off a plane so, go ahead and check that out, it was one of the more humorous stories and, you know, it's great that they stand up for our rights as guide dog service dog users, but seriously, therapy pigs. [Pig noises] Now Allison, I think you're probably the only disappointed one because I'm hearing the Soup Nazi said no soup for you, no home pod for you this year? Alison: Yeah I mean I have really no reason to be disappointed. I have speakers coming out of my ears. [Spring noise and laughter] Alison: Quite literally right now cuz I'm wearing headphones but, I am, I am still interested in getting the home pod when it comes out, home pods I should say, cuz I want to get a stereo pair. I have my Lady A controlled Sonos speakers now, and I'm finding that that is honestly filling a lot of my needs in terms of playing satellite radio and playing any song that I could possibly think of. I do still want to get the home pods because I hear that the sound quality is gonna be even that much better than the Sonos speakers, but I'm not, I'm not tearing my hair out, if these new Sonos hadn't come out I might have been a bit more disappointed, but I'm okay. Jeff: Now you said they're gonna be better sounding than the Sonos? Alison: They are, they're going to have more tweeters and better far-field microphones for understanding you, the only limitation in my opinion it's gonna be Siri, I know this is a controversial subject on an Apple themed podcast but, Siri is terrible. Bryan: You will get no argument out of me, Siri and I, we're not even dating anymore, the relationship is over and.... Unfortunately this is not surprising news, Apple you know when they used to meet their deadlines, we talked about it this summer, it was a little odd that Apple was talking about this, it almost reminds me of you know back 10 years ago when they used to say there's an attack coming, it's not coming today, it's not coming tomorrow, but it's coming, and I kind of feel that's the same thing with (inaudible) Alison: Yeah. Bryan: Apple pod, they're not gonna be out today, they're not gonna be out tomorrow, but they will be out, probably around the same time that the Amazon app comes to the Apple TV. Alison: I would, I would say you're probably right there, and I would say that when they do come out they're gonna be a couple of years behind all of the other smart speakers with better AI. It's really, it's kind of gonna be sad almost. I really I want to see Apple push forward in this arena, but unfortunately you know, I, I've played now with Google assistant, I've had a Lady A in my life, I have been playing even with Bixby on a, on a Samsung phone, and yes you give something up in terms of your data, and in terms of your privacy, but when you're putting security above all, the AI, and the assistance itself becomes very limited in what it can do, and it's really starting to show in Siri when there are so many more worthy competitors. Bryan: Yeah, the Apple really missed the boat on the the home assistant and you know, Tim Cook was wishy-washy on it for several years and now it's just gonna be a speaker, I really have no interest, I mean I'm very happy with my Echo devices, heck, I got a small apartment you know, I've got one in the living room. They're $30.00 now over you know, the weekend... Alison: God Yeah. Bryan: I just don't have, I'm like, well do I really need another one, and I'm like, I've got one in the living room, one in the bedroom, and I don't spend much time in the kitchen so you know it's, there's no point really in getting another one but I, you just can't say no at that price and, how was the Google assistant, did you like it? Alison: I do, I actually I have a Google home speaker that I don't have plugged in at this point but on the Galaxy I mean it's just, you can just ask random questions and instead of saying, let me check the web for that, here's what I found, it actually just gives you the answer to your flipping question. Bryan: Yeah. Alison: It's really amazing and then you can ask like follow-up questions and it jives with what you were talking about and it answers intelligently. I just, you know maybe the home pod speakers will come out and something about Siri will blow us out of the water or something out of the speakers, about the speakers will blow everything else out of the water because they've had a little bit more time, but I'm starting to get a little impatient with Apple's obsession with, I know they want to get it right, and I know they want to have a really polished user experience, but that user experience is starting to suffer because of that need to be so meticulous, and so perfect. Jeff: Well I think they've actually, having it come out next year might be a good plan for their stocks in a way because people are buying the eight, or the ten, those are big items, and you're talking about $349.00 here. It's hard to comBryan when everybody else is you know flooding the market with these $29.00 minis, and dots, and Amazon, what do they have seven different items now in this department? The Look, the Show, the Tap. Alison: Now Google has three, I mean, it's a lot. Bryan: And, I'm hearing about headphones, Bose, I think there is a set of Bose headphones which you know, I couldn't afford those, but that have the Google Home built into them so we're starting to see more and more even headphones with these kind of assistants built into them and, I think Apple, you know, they've just been left behind and, not every company needs a home assistant so, I really don't see what the marketplace unless you are a big music listener, you know, or have capitol to spend, I really don't see the point to it, I guess I don't have a fine ear for music because I think the Echo speaker sounds fantastic and everybody I know that's into music says, "Are you kidding?" Alison: Oh no, oh God, no no no no no. Especially the Dot. The Dot is barely passable for spoken word, but even the big Echo, drives me crazy because it tries to simulate fake stereo, but it doesn't quite get it right on the one speaker so, it's, it drives me nuts. Bryan: What's the opposite of perfect pitch? Because that's what I have. [Laughter] Jeff: Either you have it, or you don't. Alison: Yeah. [Laughter] Jeff: So with the Sonos, you have two of them, that's the Sonos one you have two of them. Alison: Yep. Jeff: That does perfect stereo? Alison: It does, yeah I have them equal distant from each other on a table, and the stereo separation is amazing, it's really beautiful. Jeff: Oh that's great. Bryan: Are there multiple different kinds of Sonos? I've just heard phenomenal things about Sonos speakers, or is there one product line or are there different kind of product lines for the Sonos speakers. Alison: There are in the non smart, non Lady A connected Sonos products, there are three, well four technically different tiers of Sonos products, and it all depends on the number of tweeters that are in each speaker, and with all of them you can pair to get a stereo pair with the Play Ones, Play Threes, and Play Fives, but they become very expensive, and they have a sound bar, and they have a subwoofer for the television, but you couldn't pair Lady A with a skill now, to make all of your Sonos products somewhat controllable via Lady A, but the Sonos One's which are the newest iteration of the Play One, they look exactly the same except they have microphones, are the ones that have Lady A built-in. Bryan: Yeah well everything, everything seems to be getting smarter except Apple News, which you know, I often go through Apple news and my subscriptions when I'm putting this show together and, lately I've been noticing there's about two articles and then everything goes back six weeks, and they just don't seem to be coming out with a lot of content and as Jeff and I were talking about, a lot of ads you'll see an article, title of an article, title of an article, then an advertisement, and then a bunch of text, this is something about Apple and an ad and everything. Jeff have you been using Apple News, and have you noticed how down hill it seems to have gone? Jeff: I've noticed it's changing a little bit at first, the ads you can't even read the ads because that, all it does is give you description of it, and you have to skip over it, so they're not trying to sell to the blind. The thing that I noticed about Apple News is Apple shuts down at about four o'clock on Friday, there's no new news, they just kind of rehash the same stuff until Monday, and it's just like looking for an app update. If I get one on on Saturday/Sunday, someone paid extra to have that pushed out. Bryan: Yeah maybe I should go back to Newsify and actually reading my RSS feed for technology news. I'm not seeing that much content coming through there, I was I was really excited when Apple news came out because I thought it was gonna be great and I enjoyed it at first, I was using it all the time, but now I'm seeing less and less content and a lot of that content, there's nothing worse than when you're reading an article and like a paragraph into the article, all of a sudden advertisement is starts being read to you... Alison: Yep. Bryan: It drives me absolutely bonkers, and Jeff you actually said, and I'm curious because I read a lot of television recaps in Safari, where I'll say, Arrow episode, season six episode three recap, and it will, I'll find an article that will describe the action and a lot of times these articles, a paragraph in it starts reading an ad to me, you just got a pop-up blocker, now do you think those pop-ups might block those in article advertisements, or just really block pop-ups. Jeff: Actually it's not a pop-up blocker, that is native to the Safari app where you can turn that on or off and it blocks pop-ups. Now some colleges, if you're a college student, they use pop-up so you might want to beware that you might be shutting off something and not being able to gain access to so, try it out. What I got was Purify and that's P U R I F Y, it's a content blocker, and when you get that you, you purchase it, and I got it for a dollar ninety nine, I don't know if that was a Black Friday deal or a special over the holidays but, a dollar ninety-nine, it's very popular app according to Nick, my buddy up in Canada, and what it does is it works on your browser. So what you do is you purchase it and then you have to go into your Safari app settings, go down and just below pop-up blocker, you're gonna find content blocker, and then you have to enable it by turning it on. Bryan: Allison, have you ever used any kind of pop-up or ad blockers or anything? Alison: I do also use Purify and I find that that eliminates a lot of the ads on the websites that I use. What I love now also is reader mode for specific websites in iOS11, if you activate reader now, it's an actionable item and you can go to Auto reader and you can tell it that I either want reader to be active on this website all the time or, all the time for everything, so I have some very specific websites for which I just have reader all the time and I never have to worry about any extra crap on the webpage. Bryan: Where is that setting where you could set it specifically for an individual website? Alison: When you actually turn on reader and you've got reader selected, then there's an actions available, it might even be available for you to select it, and one of the actions is automatic reader when you flick down. You double tap that and then it comes up with a message that says do you want to enable reader for all websites or just on this domain and, you could turn it on for just on this website, and so like 9 to 5 Mac for example and a couple of other more the, more of the busy Apple news sites, I have since I do so much Twitter reading on my phone, I've got automatic reader turned on and it's changed everything. Bryan: Yeah that's something I'll have to, you know I I use the reader all the time, but I, and I remember hearing about, that you know, you hear, about so many new settings but I've never played around with it so, that's something I'm really gonna have to make use of, and by the way if you're out there and if you know of any specific ad popup blocker that might work in individual apps, let us know, you could tweet us in at BlindTechShow or shoot us in an email at thatblindtechshow@ gmail.com, let us know about that. This next thing is really interesting because I was down here listening, I have an app where I'm able to get any NFL audio feeds and everything, and the one thing that drives me bonkers because my dad's a little older so sometimes he forgets is I'm watching the Washington Redskins game here on Thanksgiving with him and I'm listening to the Redskins radio, the only problem is streaming audio is a good minute and a half to two minutes behind real time, and he keeps commenting about what's on TV and it's just driving me insane, I'm like Dad, remember it hasn't happened again you know, so, one thing that would be nice is if FM radio actually just worked on your iPhone which supposedly it could according to this article, we'll put in the show notes that it's built into the phone but Apple just will not activate it. Have you guys been following this story? I know it's been in the news a lot lately. Alison: I've heard two things about this, I've heard that Apple for whatever reason has just decided not to activate it but then I've also heard that the newer modems actually don't have the FM radio so it's a moot point. Bryan: Mmm okay, what about you Jeff if you've been following along to this? Jeff: Yeah I have but, you know it's to me it's like, is it, is it, am I dying for it, I don't know, I really don't know. Bryan: I think it'd be nice, just, you know to be in real time. I don't understand why they can't get streaming audio to be at least maybe you know a second or two behind. I mean it's just such a significance difference, I've got it put on do not disturb, otherwise I'll get notifications about a score in a game, you know, before it happened. The fascinating thing is during the, the Yankees playoff run, I went to my local bar with a pair of my head with the headphones with FM radio, and sure enough FM radio would get it like 30 seconds before television would. [Laughter] Alison: So there's no perfect solution. Bryan: No, there's not, I'd be like, I'd yell out "damn it" and people were like "What are you talking about, they've yet to throw the pitch". [Laughter] So yeah, there's there's no perfect solution. Jeff: I like tuneIn radio, I like stuff like that. Alison: Yeah. Jeff: If there's an emergency or something we got those alarms that go off and everything. I don't see myself turning it on, I don't know, it's just, it so interesting, there's so many resources, so many different avenues that I can get information that, just one more to be on the phone and then, where's my antenna. Alison: Yeah. Jeff: You know it's, now that we're Bluetooth everything so, do we have to wrap it in tinfoil? I don't know. Bryan: You just hold it up in the air while you're walking down the street like an umbrella. [Laughter] Am I getting a signal now? Damn it, the signal is better over here. You know it's funny because the one thing my headphones don't get is AM radio. Jeff: I think it's just as important to think about this. Now do we really want that on there because everyone was so excited when like your Amazon device could make phone calls. As soon as you make that phone call you're standing there for about two minutes going I can't walk away. Alison: Yeah, yeah. Jeff: It's not fun. Bryan: No no no, like I've said for a very long time, the worst app on the iPhone is the phone, and it's also my least used app. I wonder if I could take it out of the dock and put it on like page nine. [Laughter] Alison: You could yeah. Bryan: Yeah, you know it's funny yeah I've been down here in Florida like I said for a week and everything, so I've been in a lot of automobiles which in New York City you know I'm not in cars a lot, and I've noticed my phone still thinks I'm driving sometimes. Alison: My phone thinks I'm driving when I'm not even in a car, like I'll be laying in bed and all of a sudden that do not disturb while driving thing will pop up and I'll be like I'm just reading a book, can you go away? [Laughter] Bryan: But do you have a waterbed so maybe you're moving. [Laughter] Jeff: Too much coffee. Alison: Unfortunately no waterbed, but it's crazy I wish, I have it set on activate manually, so it should not be popping up at all, but it's driving me nuts. Bryan: Real quick for a millennial crowd, water beds were beds with water in them in the 1980s. [Laughter] Look them up. Jeff: California has regulations on waterbeds. Alison: Yeah. [Laughter] Right. Jeff: The other thing is someone told me about the notifications you know that, while you're in a car if you turn it to what is that the Bluetooth setting in your car mode, that that's supposed to trigger it, I don't know sometimes that some things are on, some things are off, I don't know. Bryan: Yeah, and I've got mine set the manual where I'm supposed to be able to turn it on, I have read in a lot of places and I think we may all be running different versions of betas, or some people may be having this problem, others may not and supposedly some people claim it's fixed in a certain beta. I don't even know if I'm running that beta, I think I'm one update behind, you know there's been so many betas out that I can't keep up with them, and a lot of updates coming out too, I notice all the time I seem to have like 80 to 90 updates every few days cuz, I self update, what about you? I know you guys self-medicate, do you self update? Alison: Well I'm constantly working on self improvement, self updating, oh oh you mean apps, yeah. [Laughter] Bryan: The apps, I like to make sure tha,t I like to read those little release notes, and the worst is we update our app fairly regularly, we're not going to tell you what we're doing. Alison: Nope. Jeff: If you get a self-improvement app, would that be self defeating? [Laughter] Bryan: I don't know, you know what, email us and let us know what you think. You know a lot of people are big fans of the Star Wars saga, but have you guys been following the blindfold game saga. Alison: It's been it's been rather epic. Bryan: It has, there's been multiple parts you know. We had, we even had my favorite was Blindfold game Strikes Back you know. Alison: And they did to their credit. Bryan: They did, they struck back hard. I'm a, you know I am a big fan of the games. Blindfold Uno, I've bought plenty of them, I know some people don't like them, I think Marty does a phenomenal job and, God I love the trivia games, and there's nothing like when you've got a, you're sitting in the store you got a few minutes to kill. I've actually set my Blindfold Uno to unlimited scoring so I've got like thirty thousand points in there, it just keeps... [Laughter] Every time the computer gets within ten thousand points of me I think it's cheating you know, but, he really does a great job with a lot of those games. Marty is a businessman and he makes these games you know, out of his love of making games for the community as well as to make money and... Alison: Sure why not. Bryan: I couldn't believe what, when Apple was telling him he needed to roll them into tab less apps in the App Store. It really seemed like Apple didn't know what they were talking about I, you know you could Google Marty's website, I'm not sure the exact site but blindfoldgames.com probably, or just google it, and he's got a blog that'll explain everything that happened if you're not aware of it but, I was really shocked at the stance Apple took against him starting out. Alison: I can summarize briefly if you'd like. Bryan: Sure. Alison: I've been fairly involved in reading about it. So essentially what happened was, and there's a whole detailed timeline on the website. Bryan: Start with episode 1. Alison: In episode one Apple was going through the review process for some iOS11 related updates for Marty's games and they noticed that a lot of the games used the same template. Now Apple technically has a rule that apps cannot be clones of one another, and not looking at the content of the games which are all different decided that these games are too similar and so we're going to have to reject these updates because they have the templates are too similar and you have to make the the gameplay different. Well the whole beauty of the blindfold games is once you know how to play one, you can pretty much figure out you know, several more, so Marty defended himself and said look while these templates are all very similar, the content within them is very different, but Apple didn't want to hear it, they heard, they're like 80 apps is too much. You have to compile them into less. Bryan: A handful, yeah. Alison: Amounts of apps. So Marty's stance, with which I agree, is that then that would make the apps too large to download because they all contain different voice files, and sound effects, so they're already you know pretty sizable downloads anyway, and it would hurt discoverability. For example if all the card games were in one app, somebody might only play one or two, and that might hurt his chances at making more revenue, and the man has got to be able to make some sort of money off it. Bryan: Sure. Alison: I get it. So eventually it came down to a lot of members of the community myself included, advocating with Apple to make them understand that this is a different type of situation than just the average you know, Yahoo up there trying to clone a bunch of flappy bird apps for example. And it worked, they understood, they eventually understood and had a conversation with Marty about, hey we understand that these games are different and now it's it's okay, when the review was passed and Marty at one point he was going to be taking down the games because he just didn't have the resources, either financial, or time wise to do the rewrites that Apple was starting with, so I'm really glad that this ended up, ending happily, and I got into some, some real Twitter spats with a couple of people who really think that, that oh, it's just blind people whining. No, it's, it's people advocating for games, which are truly different in the App Store, and yes blindness does have a little bit to do with it because we have a shortage of accessible games as it is, so don't take our choices away. Bryan: Would you summarize saying basically that Marty basically after the the Clone Wars beat the Empire? Alison: He did. Bryan: Yes. Yes. [Laughter] A Star Wars theme, yeah, no, not to make light of it, it was great that Apple reversed it's course and, Jeff, any comments? Where you following along on the Blindfold saga? Jeff: I was more or less following Allison on Twitter, I'm stalking again Allison. Alison: Oh no. Jeff: But Jonathon Mosan wrote a letter, other people in the community got going on, it was nice to see everybody come together for that you know, like some people were pretty negative, they were saying like "oh yeah, they come together this, but not for jobs" Alison: Some people were jerk faces about it, and I will call them out for that. Jeff: Other people were saying like "Oh Apple, they played the blind card to Apple" it's not that, it's like Allison just explained, it's more like that. It is kind of neat to sit back and watch how different people rise up to certain things and other people take sides, you know the bottom line is the guy is doing something. he has to make money. If he bundles them all up, and you only like one of them, you're not going to buy 8 you know, it makes sense, business sense for him, and I'm glad Apple saw it that way. Bryan: I think he's got a great price plan, because you know, yes, he's got a ton of games you know, nobody buy them all. You could test them out, you know he gives you a free amount of games with each one which I think is fantastic. How many mainstream games out there allow you to test it out before buying it? Alison: It's true. Bryan: So basically what we are saying Marty, "Stay Strong!" Jeff: And may the Force be with you. Bryan: You know something that just came to the app store new and I, I've gotta actually take a look at this, because I haven't exercised since last millennium, The Eyes Free Fit, you know Blind Alive some of you may know it as, I looked up Blind Alive, i couldn't find anything related to exercising. But if you look it up under Eyes Free Fitness, and this just came to the app store last week, and I looked through it, you gotta buy the programs, but it looks like they got a ton of different exercises in there, and I know they've been around for quite a while and on a lot of podcasts. Have either of you guys ever done any of their exercise programs? Alison: A long time ago I bought Cardio Level 1, and it is really great, and really descriptive. I did it a couple of times, I'm really bad with sticking with exercise routines no matter how accessable they are. So, it's really a motivation issue, its not an issue with the workouts themselves, but now I did put the Eyes Free Fitness app on my phone and I am hoping that, you know buying some of the workouts through that, i will literally have no excuse not to do it because my phone is always with me no matter where I go. Bryan: Yeah. How about yourself Jeff? You're an outdoor mountain man, have you ever indoor exercised? Jeff: I was actually testing her website with her so I got to get a few of those and she was next to me in the booth at ACB in 2016. It was in Minneapolis, it was really fun, it's really great that she's taken it to this level now that, you can even hook it up to your health app inside your phone too so.... Bryan: Wait a minute, there's a health app in the phone? [Laughter] Jeff: Page 9 Brian, Page 9. Alison: Page 11 yeah. [Laughter] Bryan: It's next to all of my pizza services. [Laughter] Jeff: So I suggest if people want it, it's Eyes Free Fitness, it's well described, that's the whole intent of it. She uses people who are professionally trained to come up with these exercise routines, but then there's also some stretching ones, and all that stuff. So it's pretty versatile, and they got some Yoga stuff in there, and then there's.... Alison: Pilates. Jeff: Yeah, lots of good stuff in there. Bryan: Yeah, yeah, my only complaint about this app and what she does, is she makes the rest of us look lazy. [Laughter] Can I set a New Years resolution in November, where that's my plan is to, exercise and, you know, a lot of people say they want to get in better shape. I would just like to get into a shape so.... [Funny sound effect and laughter] Alison: See it's a good time for me to get back into this because now I'm walking everyday with Gary with our neighborhood in Napa being so walkable that I actually am in a little bit better shape, so I feel like these exercises would be really great, you know especially if on the weekends when we walk less, it would really help me to get in even better shape. I'm still a far cry off from where I want to be and I still eat to much, but that'll never change. [Laughter] Bryan: I don't even eat that much, I just eat all of the wrong things, I've learned if I like it, it's bad for you. Alison: Yeah, that's kinda where I'm at too, I don't find that I eat these ginormous portions, I mean although I do like a healthy portion of food, but yeah, it's not the good things. It's a little light on the leafy green vegetables and such, although I like fruit. Jeff: You know one of the main things about exercise and all this stuff that we're talking about is the mindset and it takes a while to get your mind wrapped around it. I've been using a trainer for, it'll be coming up on a year and I finally got my mind wrapped around it after 10 months. I mean, it really takes something, I used to be in really good shape, I used to do a lot of stuff, I used to run and all sorts of stuff. But I am not being chased anymore so... you know. Bryan: It's may favorite line, "Do you still run?" "Only when chased" [Laughter] Jeff: Yeah, I think people who want to get back into it sometimes it takes a little commitment. You can buy these from $19.00 to $25.00 or something like that, but you have it, you can do it in the privacy of your own home, it's accessible, and it describes all of the stances, all the positions, well described steps, so if that's what it takes to get your mindset involved in it, it might be a good start for you. Alison: Yeah. Yeah can get as of out of breath or sweaty as you want, as quickly as, however quickly it takes and it doesn't matter because it's just you and yeah. Jeff: But make sure you have your phone notifications for driving set right. [Laughter] Bryan: Either that or in my kind of condition make sure you have 911 on speed dial. [Laughter] I got a good work out there, you know we're recording this the day after Black Friday, it's not even Cyber Monday yet but you'll hear this after Cyber Monday, and it was a low tech Black Friday for me because I got some clothes and everything, no technology but I wanted to ask you guys, what about yourself Allison was it a techie Black Friday Cyber Monday for you or no? Alison: No cuz I, I bought what I want throughout the year, I don't, I don't have the the impulse control to wait three months for something to go on sale on Black Friday, I just buy it when I, when I have the money and what I want it / need it. So Black Friday / Cyber Monday are always kind of a bit of a letdown for me cuz I'm like, oh this thing's on sale, oh wait, I already have it, this thing's on sale, wait I already have it. ]Laughter] Bryan: Got it got it got it got it got it need it you know. Alison: Yeah. Jeff: I just went shopping at Allison's place, I just walk to her house. [Laughter] I'll take that, that, that. [Laughter] Ain't got it, ain't got it, ain't got it. Bryan: You know it's not a big tech year for me because I'm not upgrading, I do need to get a new key chain cuz I have one of those key chains with the Lightning charger and for some reason the Lightning charger broke off of the key chain so, one of the things I heard somebody talking about was you know I've got all these kind of what I call lipstick chargers where you have to plug the cord into the charger. I heard they now got a charger out there that has the lightning charger built into it as well as a USB built into it and I think I'm gonna probably get something like that. Alison: Send me that when you find it. Because, send me the link, yeah because that is something, you know, I love my anchor batteries. I have the ones that are like even 20 thousand milliamps witch are a little bit bigger but I just put them in my purse, but yeah you've got to have the little the cables for your Apple watch and for your micro USB devices and your, your lightning cables all together and it's just it's a little bit much, it gets to be a little bit much to carry around. Jeff: Jack really makes a couple of these. One is a six thousand, one is a ten thousand fifty claiming that X needs more power so they made that one. They do have two cords, one is the Lightning port cord and the other is for all the Android stuff, your mini USB plug, and there's a third you can plug a USB into it so you technically you can actually have three by both outputs going at one time. My concern since their dedicated cables on there, are you committed to that if, what if the cable goes bad you know, I, I don't know but it does get a 4.5 out of 5 ratings on Amazon. Myself I like the big ones. Alison: Oh yes send me that one. Jeff: Cuz size does matter. Alison: It does. [Laughter] Bryan: Hey hey, this is a PG podcast. [Laughter] Alison: What, we're talking about, we're talking about batteries. Bryan: Oh. Jeff: I must admit I like big batteries. Bryan: I've heard that about you. Now Allison you've had the iPhone for a while now what are your thoughts? Alison: I basically really like it, it's nice and fast, I like the size, I have it in a leather case because it's glass on both sides and I do not trust myself with glass on both sides and I have dropped it and the leather case has saved me a couple of times. The face ID I'm still, I find myself still kind of getting used to this new thing called face ID. I find that it's very accurate. I find that even when it doesn't get your face it learns from the experience and it has been consistently doing better but it's not as fast as touch ID, the gestures for bringing up home and app switcher are pretty fluid and elegant I think. Bryan: Are you used to doing those after having the press on the home button for so long or does it take a little training yourself? Alison: I'm used to it now, I've had the thing now for a couple of weeks so I've gotten it back into my, into my muscle memory now that this is just what you have to do because there's no home button and luckily I'm not using any other older devices to confuse me, that's convenient but yeah it's it's never going to be as fast I don't think. Jeff: So Alison you use your phone on a daily basis? [Laughter] Alison: Pretty much almost every minute of every day. Bryan: Are you happy with the purchase, are you happy with the upgrade? Alison: I am because I wanted, I wanted the latest and greatest technology and now I've got it and I realized that sometimes that comes with some caveats so I am happy with it, there are some times though when I have just become resigned to entering in my passcode. For example if I'm laying in bed and I want to unlock my phone, I don't want to have to sit up put the phone all the way in front of my face, get face ID to authenticate me, wake up the husband, wake up the dog, so I just enter in the passcode and it's that's even become a little bit faster. Bryan: My dad was having trouble with his phone recently and I finally found out what the problem was. Alison: Yeah. Bryan: He's running an iPhone 4. [Laughter] Alison: Oh for goodness sakes. Bryan: Yeah, I said.... Jeff: Wait, you, you said it's running. Bryan: Yeah, barely, yeah he can make phone calls that's about it, I said no wonder you're having so many issues with everything else and yeah, he's getting ready to get a new one because my mom did order the iPhone 10 and he's gonna get the hand-me-down. I guess he's gonna move up to a 6 which is all he really needs. Alison: Yeah. Oh that'll be quite an upgrade for him. Bryan: Oh yeah, yeah, so but, my mom's got the 10 coming, she's got the, she ordered it online and has the two to three week wait so, I will not, not get to play around with it while I'm down here and everything but I've been you know listening to you on with Dr. Robert Carter not to be confused with Dr. Richard Kimble. Not that anybody but me. Alison: Not to be confused with John Kimble yeah. [Laughter] Bryan: I thought of Richard Kimble immediately but I'm probably the only one that did that so but you know you guys had a great walkthrough of the iPhone 10 and somebody in New Zealand had something about unboxing one very early before the rest of the world which... Alison: Oh yes Jonathan was very very happy that you know, when these items come out he gets them a day ahead of everyone else because New Zealand is a day ahead. Jeff: He should let people know that. [Laughter] Alison: He really doesn't gloat about that enough no but yeah. Bryan: Allison did I hear you do laundry every now and then? Alison: Every now then, you know I, the house-elves or my husband will not comply and I have to do my own. Bryan: Are you testing out that new GE, was it the GE product that you're testing out? Alison: Yeah so, so I have purchased the GE talking laundry box and actually we were in the market for a new washer and dryer anyway so we got the compatible washer and dryer and I've actually been doing a lot more of my own laundry and enjoying the heck out of it now that we have this talking machine because it's so easy to set all you really have to worry about is the start button and the little knob that controls the settings because the different wash cycles, because it verbalizes everything, you turn the knob, it verbalizes if you're on like cold wash, or towels and sheets, or casual wear, or bulky items, and you press Start and it says starting load on bulky items with an estimated 70 minutes remaining and there's a button on the box that you can press if you need an update of what, of time remaining and the dryer is much the same you just mess with the one knob, you can set your cycle and it just works. Our old washer and dryer we had the little arrows marked, but the one thing would spin, and there was another arrow that you could accidentally move, and Jeremy was really the only person who could set it without getting the other thing to spin, so I'm glad to be able to have some agency over my laundry once again. Bryan: And this works with all GE washer and dryers I believe right? Alison: So on the website it does say that it is, should be compatible with most, it should be compatible with the ones that have the ports in the back, the technician ports, but then it says these are the compatible models and it lists just a couple of different models. Slightly more expensive, that are compatible, I think that you can get this to work with older GE models if it has the port for technicians to hook up, but it's better I think in terms of the software working is optimally as it can if you can buy the the newer ones. Bryan: Yeah full disclaimer if your washer and dryers from 1974 and is GE..... Alison: Probably not going to work. Jeff: I do laundry and the thing on my washer and dryer mostly my washer is, there's that plastic cover that covers things up so you can't really tell the dial, so I took a needlenose pliers, it was excruciating sounds but I got that piece off of there, then I put some little markers on there, so now I just put my finger down there and I just turn it and everyone uses it that way so, yeah I don't recommend anybody to take a needle nose and tear that apart unless you know what you're doing but, yeah that's how I access that. Bryan: Yeah when you're like me and you live in New York it's great because I've got like fluff and fold where they pick it up and deliver it and it's pretty cheap and yeah I'm spoiled like that I think I've mentioned that on the show before. One of the things we did want to mention to the listeners if you do not have knfb reader you're just making your life harder, and it's a phenomenal app, I believe and don't quote me on this but I believe it's on sale at least through Christmas for about 50% off. Normally it's $100.00, I believe now it's $49.95. Go ahead and get that app, you'll make your life a lot easier if you want to read your bills or anything along that. Jeff: I really think if you're a student that that's the app to have. Seeing AI is a good app for a convenience, it's just a quick shuffle through the mail, but if you're gonna do bulk reading or if you want to save it and all sorts of things, you know, that's a workhorse the knfb reader app. Alison: I agree. Bryan: Yeah luckily I think all of us have easy names to pronounce, but I have a friend named Keith Strohak, and every time I tell Siri call Keith Strohak, it says did you mean Keith Sholstrum, did you mean Keith Beyer. It drives me bonkers, I have to go in and manually do it and I will put this link in the show notes. Did you know that you could teach Siri how to save names properly? Jeff: Mm-hmm. Alison: Yeah. Bryan: Okay I was the one who didn't. By the way ask Siri to pronounce Charlize Theron because I heard that's another name that she can't pronounce. Alison: Oh boy. Bryan: Yeah so if you're if you're one of those people and your name is Mustafi Mustafasin or something, go ahead and read this link and you know, maybe you could teach Siri how to read your name and everything. Jeff: The trick about it is that it asks you for the first name and then it asked for the second name, well I didn't know it was doing that so I said Laurie Thompson that's my wife, and then I said Laurie Thompson again. I wondered why it asked me twice, so every time she calls, are you sure you want to call Laurie Thompson Laurie Thompson? I left it I thought it was kind of cute. Alison: That is. Bryan: Now Jeff was a great guy and he posted you know happy holidays to everybody on the Blind Abilities Facebook page and I chimed in with my typical bah humbug and he thought that was you know the happiest he's ever heard me, and that's because he didn't hear how mad I was that my old Grubhub app that I've been running for several years because GrubHub has refused update is now officially dead. I finally had to update it and I don't know what I'm gonna do because this happened shortly before I left New York. I kept getting server error, server error, and I could not do anything so I had to update the app, GrubHub prepare for the barrage because I am gonna be hammering you every day now with fixing your heading navigation. I don't know. Alison: Now that your life depends on it yeah. Bryan: Yeah you know. Jeff: It's time to get that Blind Alive app, get that exercise going. Alison: Yeah. Jeff: Screw GrubHub. Bryan: I still gotta order dinner. I still gotta order dinner and everything. Alison: Try Postmates, try Doordash, you said Eat24 doesn't.... Bryan: Doordash I just heard about so yeah that's one I want to check... Alison: Yeah Postmates is also very good. Unfortunately in Napa our only choice really is Eat24, and that only has a couple of options. Bryan: Yeah you know one of the other things I plan to do when I get back from Florida is, because I've been running my old laptop here my Mac air, and it's so nice because it's running Sierra, and things have been running so smooth, as soon as I get home one of my first acts to do, I'm rolling High Sierra back, have you guys, I know Jeff's been playing High Sierra, Allison, are you still using High Sierra..... Alison: I am and for the limited number of things that I do on my Mac it's absolutely fine, I haven't really had any problems. Bryan: Editing text, when you're working with a lot of text and emails or documents and everything, it just befuddles me and everything, you know sometimes you gotta use the option key, and I did report this to Apple, quick nav does you know, when you use quick nav with words, it does not follow the insertion point, we did test it it is getting kicked up to engineers, there is a navigation problem with quick nav in Hi Sierra. Alison: That's unfortunate. Jeff: Yeah I'm using the beta's and you know it keeps on changing so I don't really complain about it I just keep using it and I know, I know it'll get better, so I just putz with it. Bryan: Yeah well Jeff you said you're running the latest beta and it's, you've noticed an improvement so, maybe it won't be the first thing I do when I get back to New York you know, maybe I'll give it one more update. I am not running the beta so I never run the betas on my computer and the word to the wise if you value productivity do not run those betas. Alison: Yeah, or have a partition on your hard drive or a separate hard drive on which to run them. Jeff: Oh my MacBook Pro [Inaudible] I'm not doing the betas on that so I can always go back to that if I need to but, you know I I usually forget that I'm slowly tweaking my muscle memory like you said Allison, and pretty soon I'm just readjusted. Changes happen and I don't know. Alison: Yep. Bryan: Chit chit chit chit oh wait, do we have to play now to use that song? In a more positive segment, I know we've rolled through some some negativity here, we don't want to be negative all the time but you know these are just some things that were pissing Brian off now because, Brian's been known to get pissed off. I always like to hear you know, what you guys watching, what you're reading, you know especially the holiday time of the year, there's a lot of great content out there. Netflix just seems to be piping everything out. Allison what you watching, what you reading? Alison: Well I'm still trying to work my way through Narcos, I have not had as much time for for Netflix recently, but I've been reading this really great book, I'm not sure if it's available on any of the freebies, unbarred or well book sure it's not free but it's practically free. I got off of Audible it's my Brandon Sanderson it's called "The way of Kings" it's part of the Stormlight archive series, it's an epic fantasy series, long long books, the first book I think is 45 hours long and I'm about 2/3 of the way through it, and it is absolutely amazing it's quite frankly taken over a lot of my life this holiday weekend. [Laughter] But it's amazing. Bryan: Well we're thankful that you were able to fit time in for the podcast. [Laughter] Alison: I did, I did have to interrupt my reading to.... [Laughter] Bryan: That 45 hours, that might take me 4 and 1/2 years to get through. Alison: Well I read at speed, I'm not gonna lie, I cranked it up to 3x and I can understand it just fine, so I'll get through it pretty quickly, but there's then two other main books, and then a little novella in the middle to read so. Bryan: That's a, that's a big.... Alison: It's gonna be ten books so... Bryan: Wow, wow, what about yourself Jeff, you been reading anything, watching anything? I know you've had some time alone there or are you just thinking in the dark? Jeff: I really got nothing, I guess I am thinking in the dark, family's been gone and I've been catching up on a bunch of other things that I hadn't been able to get back t,o and yeah, I got to get back to it so sorry you don't have anything to contribute. Bryan: That's okay Jeff. Jeff: Oh sorry. Bryan: I just finished down here with my parents you know I, they they were very nice and they watched, because their sighted with described video, the second season of Stranger Things, and the first season if you have not seen it as phenomenal I said to myself I don't know how they're gonna do a second season. It was really good so, it was very enjoyable, if you have not checked out Stranger Things on Netflix, you're definitely gonna want to check that out. I know we're gonna watch another series on Netflix that just came out I'm blanking on the name, the guy that was in Dumb and Dumber, not Jim Carrey, Jeff Daniels is in it, it's a Western that just came out on Netflix. I'm hearing great things about it of course I'm, like I said, God, Godlessness, or Godless or something, it's a Great Western, and I've heard from other people it's very good and everything and, yeah I've still got the same four books. You know it's so funny I'm one of those people that loads up all the audio digital content to all the devices for the travel and then I end up listening to podcasts that I have on my phone. [Laughter] During the travels so, like I said this is a That Blind Tech Show, we're gonna wrap it up here. We are at Blind Tech Show on Twitter. thatblindtechshow @gmail.com if you want to email us in let us know what you think, let us know what you like. You can download our feed through the Blind Abilities podcast speed of your podcast player of choice, victor reader stream or download the Blind Abilities app. Allison what do you have coming up the next few weeks leading into what's that holiday Christmas? Alison: Just a quiet Christmas at home, gonna take maybe a couple of days off and just probably still be reading the Stormlight archive honestly, although I, although I may do a reread of Harry Potter, I lead such an exciting life. [Laughter] Bryan: Nothing wrong with that, nothing wrong with that. What about yourself Jeff, family coming back or have they given up on you? Jeff: My folks for 17 years they've been going down the Texas but they stayed up this year for the holiday so I got to go to spend time with them Thanksgiving. We were all up there and so they're here so we're gonna have Christmas there and my daughter and grandkids will be coming up mid-December, we try and offset it each year and so yeah, a lot of lot of family holidays and I want to, I want to see the Grinch again this year. Bryan: So you want me to come visit? [Laughter] Yeah I'm not a big holiday person so Thanksgiving I guess is our big holiday and, we just wrapped that up down here and Thanksgiving, I'll be heading back to New York in the next few days and you know, it's funny I'm sitting here in shorts and it's 80 degree weather so it doesn't feel like November, and then I'll go back to the 30 degree weather and, yeah amazingly Nash is not even shedding that much here in Florida, you would think he would get rid of that winter coat, but he is panting like it's August. This is That Blind Tech Show, maybe we'll have one more before the year hopefully, you know, all of our schedules have been so crazy we haven't been on a regular schedule, we plan to hopefully eventually get on it, but for now we are out. When we share what we see through each other's eyes, we can then begin to bridge the gap between limited expectations and the reality of blind abilities. This week, we present a classic encore episode featuring John Martellaro, Senior Editor, Analysis & Reviews for The Mac Observer. John’s talking points include the HomePod, and whether some of the critical reviewers, including Consumer Reports magazine, were expecting too much from it. He also brings up a possible sensitivity with nearby objects, where the presence of a salt shaker close to a HomePod seriously hurt sound quality. The discussion moves to 4K/UHD TV, which John says has finally come of age. In a slightly technical discussion, John explains how the expensive iMac Pro can exploit up to 18 cores and whether any of that holds any value for the typical Mac or PC user. There’s also a discussion about a blogger’s curious and overwrought reaction to a pair of visits to an Apple Store that, after some delays, had a favorable result. And why is Apple’s complex product lineup “perfect?” You’ll also hear from Josh Centers, Managing Editor for TidBITS, and author of “Take Control of Apple TV” and other titles, who explains how he got an Apple TV 4K at a big discount, and why he’s becoming disenchanted with the product and why he likes Google Chromecast more and more. In turn, Gene reminds listeners that his VIZIO TV has an embedded Chomecast system known as SmartCast, and why he hasn’t used his Apple TV, an older model, in over two months. And what about the HomePod and the so-called scandal involving white rings being left on oiled or waxed wood surfaces by its silicone base? Should Apple have explained this limitation earlier? What about reports that the Sonos One leaves white traces from its silicone feet? Josh also explains why he’s about to give up on Apple Music.

While most reviewers have noted the HomePod as the best sounding speaker they’ve ever listened too, Consumer Reports claims Google Home Max and Sonos One sound better. “The HomePod will serve many music fans well, but CR testers did hear some flaws. The HomePod’s bass was a bit boomy and overemphasized,” wrote Consumer Reports. “And the midrange tones were somewhat hazy, meaning that some of the nuance in vocals, guitars, and horns was lost   Audiophile Review: HomePod 'Sounds Better' Than $999 KEF X300A Digital Hi-Fi Speakers https://www.macrumors.com/2018/02/12/homepod-audiophile-review-standing-ovation/ Reddit user WinterCharm posted exhaustive audio performance testing results for HomePod to the Reddit audiophile community. Using specialized equipment and a controlled testing environment, the review features in-depth analysis of the smart speaker's output when compared to a pair of $999 KEF X300Adigital hi-fi monitors, representing a "meticulously set up audiophile grade speaker versus a tiny little HomePod that claims to do room correction on its own”. "I am speechless. The HomePod actually sounds better than the KEF X300A. If you're new to the Audiophile world, KEF is a very well respected and much loved speaker company. I actually deleted my very first measurements and re-checked everything because they were so good, I thought I'd made an error. Apple customers started noticing that HomePod can damage wood furniture by leaving a white ring after resting on a table for just a few minutes or days. Apple confirmed the problem today, saying “the marks can improve over several days after the speaker is removed from the wood surface.” Apple also suggested owners “try cleaning the surface with the [table] manufacturer’s suggested oiling method.”If the white rings don’t disappear, Apple says you can just refinish the furniture. Apple also recommends putting the HomePod on a coaster if you’re worried about the speaker damaging your table.   Erfon listens to HomePod for the first time...  https://www.youtube.com/watch?v=_Lz7dxfNXL8   How Apple Plans to Root Out Bugs, Revamp iPhone Software - leander https://www.bloomberg.com/news/articles/2018-02-12/how-apple-plans-to-root-out-bugs-revamp-iphone-software Apple will start focusing on the next two years of updates for its iPhone and iPad operating system, according to people familiar with the change. The company will continue to update its software annually, but internally engineers will have more discretion to push back features that aren't as polished to the following year. Software chief Craig Federighi laid out the new strategy to his army of engineers last month, according to a person familiar with the discussion. His team will have more time to work on new features and focus on under-the-hood refinements without being tied to a list of new features annually simply so the company can tout a massive year-over-year leap, people familiar with the situation say. The renewed focus on quality is designed to make sure the company can fulfill promises made each the summer at the annual developers conference and that new features work reliably and as advertised. The decision to give engineers more time to perfect software is a major cultural shift. At Google, teams update apps on their own schedule and aren’t tied to the annual Android release. At Apple, all new features are tied to a big release in the fall, when Apple rolls out its splashiest new software, and a more modest update in the spring   Apple hiring spree means something big is on the way - leander https://www.cultofmac.com/527819/apple-hiring-spree-means-something-big-way/ Apple has been busy hiring a record number of engineers over the last few months. I like my Echo. In my house, we use it to play radio stations, to get the weather, and to answer questions like "When was the Edo period?" One thing I don't often use the Echo for is music. That's because it sounds terrible. As good as Amazon's Alexa voice service is, the Echo's black tin can croaks out audio just a notch better than the 20-year-old Coby FM radio I keep in the garage.
