Donald Trump is so nervous about his debate with President Biden on Thursday that he is now demanding that the President take a drug test before the debate. Trump says that he'll gladly take one, too, but no drug tests are going to happen. Instead, Trump is setting up an excuse for a potentially poor performance at the debate so that he won't have to admit defeat if Biden over-performs on Thursday.Also, election workers in Georgia are facing an unprecedented number of threats from Trump supporters, but the local sheriff says that these threats of death and violence aren't actually crimes. Threatening speech is actually not protected by the First Amendment, which means that these threats are actually criminal acts, but right wing cops don't want to have to prosecute their fellow Trump supporters.And in a campaign email to his supporters this week, Donald Trump claimed that he was "tortured" in a Georgia prison. The only problem with this claim is that it is completely untrue, as Trump only spent enough time in Fulton County jail to get a mugshot and have his fingerprints taken - a process that he said was pleasant at the time. He even said at the time that some of the jail workers were crying as they processed him.Finally, more incriminating evidence against Donald Trump has emerged in the documents case, and this time it came from his own lawyer. Evan Corcoran, who worked with Trump to provide documents and information to the government before the FBI search of Mar-a-Lago, kept detailed notes of his meetings with Trump. It has now been revealed that those notes include mentions of Trump being afraid to turn over the documents because he thought he would be criminally charged if he did. Lauren Boebert's teenage son has been arrested in Colorado after allegedly going on a crime spree. The 18-year-old, who became a father last year, was hit with 22 charges that ranged from contributing to the delinquency of a minor, all the way to possessing a "financial device" which is typically used for identity theft and credit card fraud. This new family drama could easily put an end to Boebert's reelection chances.Also, Donald Trump has officially paid the roughly $400,000 that he owed to The New York Times after his failed lawsuit against the media outlet. Trump had sued the Times for printing some of his tax information that they got from his niece, Mary Trump, and Trump sued all of them several years ago. The judge dismissed the case against The Times and ordered Trump to pay all of their legal fees as a punishment, and this massive loss of cash is going to hurt the already cash-strapped former President.And according to a new filing by prosecutors, Donald Trump attempted to corrupt his own lawyer by instructing them to lie to the FBI about hoarding stolen classified documents at Mar-a-Lago. This lie was in response to a subpoena from federal investigators, demanding the return of all documents that Trump had in his possession at the time. The attorney wasn't specifically named in the filing, though most believe that it was his lawyer Evan Corcoran, who has been cooperating with investigators. Finally, Donald Trump's lawyers are hoping that Judge Aileen Cannon's inexperience and clear incompetence will end up throwing a wrench into the plans of Judge Tanya Chutkan. Chutkan cannot put her Trump trial on the schedule without knowing when Cannon will be holding hers, and Cannon appears to be intentionally dragging her feet on the matter to delay that decision for as long as possible. SERIES 2 EPISODE 29: COUNTDOWN WITH KEITH OLBERMANN A-Block (1:43) SPECIAL COMMENT: Is Jack Smith trying to get the Judge in the Election Subversion Trial to detain Trump or fine Trump or start Trump's trial early or issue a GAG ORDER against Trump? In Washington there is a behind-the-scenes courtroom drama playing out under seal, but which SEEMS to be – based on the half-second of light shining on it, the way a midnight thunderstorm illuminates everything and then just as quickly plunges it all back into darkness – which SEEMS to be an attempt by Jack Smith to get Judge Tanya Chutkan to PUNISH Donald Trump for shooting off his big bazoo in speeches and on social media. And that's all we know about it. Smith has made a filing with Judge Chutkan's court in which he alleges Trump has quote “made daily extrajudicial statements that threaten to prejudice the jury pool.” That's almost LITERALLY IT. The whole motion is just 345 words. The easy part is to imagine what “daily extrajudicial statements” Smith is reminding Chutkan about because they began in the overnight hours of Sunday and Monday August 14th, not 72 hours after Judge Chutkan warned Trump's lawyer “I caution you and your client to take special care in your public statements about this case” and Trump said he understood and at 12:33 Eastern Daylight Time Trump posted “How dare lowlife prosecutor, deranged Jack Smith, break into my former Twitter account without informing me and indeed trying to completely hide this atrocity from me." Revoke his bail? Is that what Jack Smith has ASKED her to do? Treat him as the lethal threat he represents and revoke his bail – the terms of which he has obviously violated? Or fine him? Or institute a gag order on him? Or is it that other option? WHATEVER is going on we will know SOMETHING next week, I think. CNN reports Chutkan has ordered both sides to file additional briefs on whether or not the original Smith brief – which presumably is about or at least TOUCHES on “the defendant's daily extrajudicial statements” -should be posted on the public record. Trump's team is to answer by Monday and the Special Counsel must answer by Monday. There is also all sorts of other bad news for Trump, including his announcement that he's going to testify at his "trial." Which one? Former US President Donald Trump has pleaded not guilty to illegally hoarding classified documents at his Mar-a-Lago estate in Florida. “We most certainly enter a plea of not guilty,” Todd Blanche, Trump's lawyer, told US Magistrate Judge Jonathan Goodman. CNN reported Trump had his arms folded and periodically spoke to Blanche while in the courtroom Trump's motorcade arrived on Tuesday afternoon (EDT) at the federal courthouse shortly before he was scheduled to appear before a magistrate judge, a stunning moment in American history days after he became the first former president charged with federal crimes. The pair were digitally fingerprinted and had their birthdates and Social Security numbers taken as part of the booking process at the federal courthouse in Miami. The US Marshals Service said Trump and Walt Nauta were booked shortly after they arrived Tuesday afternoon. It's the second criminal case Trump is facing as he seeks to reclaim the White House next year. He's also accused in New York state court of falsifying business records related to hush-money payments made during the 2016 campaign. Trump has denied any wrongdoing, saying he's being unfairly targeted by political opponents who want to hurt his campaign. After his court appearance. Trump will return to New Jersey, where he's expected to hold a press event to publicly respond to the charges. Photo / AP Nauta, a Navy veteran who fetched Trump's Diet Cokes as his valet at the White House before joining him as a personal aide at Mar-a-Lago, is accused of moving boxes from the White House at Trump's direction and then lying about it to investigators. Trump rode to court with his son Eric, who accompanied the motorcade from the former president's Doral resort to the federal courthouse in Miami. CNN aired footage of Trump walking to a line of SUVs with his son by his side while someone yelled, “Let's go Trump!” The former president stopped and waved at supporters, as well as chatted with staff members. Eric Trump appeared to clap his father on the back just before he climbed in a vehicle. As he rode to court, Trump posted on his social media site that the case against him was a “witch hunt”. Via his Truth Social network, he posted: “ON MY WAY TO COURTHOUSE. WITCH HUNT!!! MAGA.” Later, outside the courthouse, Trump's lawyer Alina Habba said, “Today is not about President Donald J. Security was tight outside the federal courthouse ahead of Trump's history-making court appearance but there were no major disruptions as the morning unfolded. Trump approached his arraignment with characteristic bravado, insisting as he has through years of legal woes that he has done nothing wrong and was being persecuted for political purposes. But the gravity of the moment was unmistakable as he answers to 37 felony counts that accuse him of willfully retaining classified records that prosecutors say could have jeopardised national security if exposed, then trying to hide them from investigators who demanded them back. The case is laden with political implications for Trump, who holds the dominant spot in the early days of the 2024 Republican presidential primary. But it also poses profound legal consequences given the prospect of a years-long prison sentence. Even for a defendant whose post-presidential life has been dominated by investigations, the documents probe has stood out for the apparent volume of evidence amassed by prosecutors and the severity of the allegations. It's also a watershed moment for a Justice Department that until last week had never before brought charges against a former president. Attorney General Merrick Garland, an appointee of President Joe Biden, sought to insulate the department from political attacks by handing ownership of the case last year to a special counsel, Jack Smith, who on Friday declared, “We have one set of laws in this country, and they apply to everyone”. The arraignment, though largely procedural in nature, is the latest in an unprecedented public reckoning this year for Trump, who faces charges in New York arising from hush money payments during his 2016 presidential campaign as well as ongoing investigations in Washington and Atlanta into efforts to undo the results of the 2020 race. He's sought to project confidence in the face of unmistakable legal peril, attacking Smith as “a Trump hater”, pledging to stay in the race and scheduling a speech and fundraiser for Tuesday night at his Bedminster, New Jersey, golf club. Photo / AP “They're using this because they can't win the election fairly and squarely,” Trump said on Monday in an interview with Americano Media. The court appearance is also unfolding against the backdrop of potential protests. Some high-profile backers have used barbed rhetoric to voice support. Trump himself has encouraged supporters to join a planned protest Tuesday at the Miami courthouse, where he is expected to surrender to authorities. Trump is not expected to be subjected to a mugshot, according to a person familiar with the situation. Generally, Justice Department agencies, like the FBI and US Marshals Service, take a booking photo as part of the arrest process and the photo is uploaded into a shared law enforcement database. A small group of pro-Trump supporters and anti-Trump protesters were squabbling in front of Miami's federal courthouse as they awaited the former president's appearance. A man with “Trump sucks” spray-painted on his jacket and pants shouted at supporters of the former president as they passed by while a man held a homemade “Free Trump” banner behind others who shouted at him. Dozens of supporters wrapped themselves in Trump flags or campaign merchandise as they milled about near the courthouse. The crowd included far-right internet personality Anthime Gionet, who served a two-month prison sentence for streaming live video while he stormed the U.S. Capitol with a mob of Trump supporters on January 6, 2021. Gionet, better known as “Baked Alaska,” was live streaming video of his interactions with people around the courthouse — something the terms of Gionet's probation don't appear to prohibit. Meanwhile, Miami Mayor Francis Suarez, wearing a T-shirt with a police logo, toured the nearby media encampment and said he didn't expect any disturbances. “So far, so good,” Suarez said. “It's still early, but the crowd seems to be under control and everyone respectful and peaceful. Let's hope it remains that way.” Suarez is considering a presidential run and has suggested he could make his intentions known during a speech Thursday at the Ronald Reagan Presidential Library in California. Some Trump supporters were planning to load buses to head to Miami from other parts of Florida, raising concerns for law enforcement officials who are preparing for possible unrest around the courthouse. Mayor Suarez had said the city would be ready, and police chief Manuel A. Morales said downtown could see anywhere from a few thousand up to 50,000 protesters. Among those who arrived early Tuesday were father and son Florencio and Kevin Rodriguez, who came to the US 15 years ago as asylum seekers fleeing the dictatorship in Cuba. Wearing a shirt that reads “Jesus is my savior, Trump my president,” the younger Rodriguez, Kevin, said it was possible Trump was guilty of illegally retaining classified documents. But he questioned the fairness of the proceedings in light of other classified information probes concerning Democrats, including former Secretary of State Hillary Clinton and President Joe Biden. The Biden investigation remains open, but no evidence has emerged to suggest he acted willfully — a core claim in the Trump indictment. “We never abandon our amigos — those who love this country and our liberty,” Rodriguez added, highlighting Trump's staunch opposition to Cuba's communist government. Unlike in the New York case, where photographers produced images of a sombre-faced Trump at the courtroom defence table, the public's view will be limited. Cameras are generally not permitted in federal courts, and a judge Monday night barred reporters from having phones inside the building. A federal grand jury in Washington had heard testimony for months in the documents case, but the Justice Department filed it in Florida, where Trump's Mar-a-Lago resort is and where many of the alleged acts of obstruction occurred. Though Trump is set to appear Tuesday before a federal magistrate, the case has been assigned to a District Court judge he appointed, Aileen Cannon, who ruled in his favour last year in a dispute over whether an outside special master could be appointed to review the seized classified documents. A federal appeals panel ultimately overturned her ruling. It's unclear what defences Trump is likely to cite as the case moves forward. Two of his lead lawyers announced their resignation on the morning after his indictment, and the notes and recollections of another attorney, M. Evan Corcoran, are cited repeatedly throughout the 49-page charging document, suggesting prosecutors envision him as a potential key witness. Trump has said he's looking to add to his legal team though no announcements were made Monday. He was expected to be represented at his arraignment by Todd Blanche, an attorney also defending him in the New York case, and Florida lawyer Chris Kise, who joined Trump's stable of attorneys last year. Under the rules of the district, defendants have to have a local lawyer for an arraignment to proceed. The Justice Department unsealed Friday an indictment charging Trump with 37 felony counts, 31 relating to the willful retention of national defence information. Other charges include conspiracy to commit obstruction and false statements. The indictment alleges Trump intentionally retained hundreds of classified documents that he took with him from the White House to Mar-a-Lago after leaving the presidency in January 2021. The material he stored, including in a bathroom, ballroom, bedroom and shower, included material on nuclear programmes, defence and weapons capabilities of the US and foreign governments and a Pentagon “attack plan”, the indictment says. The information, if exposed, could have put at risk members of the military, confidential human sources and intelligence collection methods, prosecutors said. Trump attorney Evan Corcoran could appear before a grand jury investigating the classified documents case as early as Friday. It comes as Corcoran and Mike Pence's lawyers challenge a subpoena for the former vice president's testimony in the January 6th case. Plus, the grand jury in the hush money probe is expected to meet again on Monday.
Even as he faces indictment in Manhattan, Trump has to watch his back on the federal classified documents investigation. The recent courtroom fight over Evan Corcoran's testimony “indicate[s] that prosecutors have continued to build a case and that the inquiry remains a serious threat to Mr. Trump,” per the NYT. Corcoran will testify again today, and the Times reports that he doesn't plan to plead the Fifth. The feds also want to talk to Trump lawyer Jennifer Little in the probe. The latest revelation: Trump lawyer Timothy Parlatore testified before a grand jury in December in the documents probe, ABC's Katherine Faulders and Alex Mallin scooped. That came shortly after he told authorities that Trump's team had just found four more documents with classified markings. Meanwhile, in the federal Jan. 6 investigation, a judge heard arguments yesterday over whether special counsel JACK SMITH can force former VP Mike Pence to testify, CBS' Robert Costa and Robert Legare report And as Biden meets with Trudeau in Canada, the two countries have reached a deal on immigration that will give each side the ability to send back asylum-seekers who illegally crossed the border, the L.A. While Alvin Bragg ghosts tailgating protesters, now would be a great time for someone other than the Manhattan DA to indict Donald Trump. The D.C. Circuit Court of Appeals is ordering Trump lawyer M. Evan Corcoran to turn over documents which on their own could send Trump to prison. Bragg's case is not insignificant but establishes Trump's MO for the other prosecutions. A different indictment would certainly throw Republicans running defense off their game. And, probably a few of their other games as well. Other than maybe jail, Donald Trump isn't going anywhere. You'd assume that Donald's followers would be virulent racists supporting Trump's virulent racism, but Trump's “Yee Haw, I'm racist!” vote is in fact outnumbered by his “I'm not a racist, but...” voters, which are of course, legion. For those people, “Woke” is their new N-word. (Which the woke won't let them say.) The woke won't let them equate gun safety legislation with the Holocaust, but forces 6th graders to look at marble peen. Sure, it all sounds confusing to the uneducated… Ron DeSantis spends every waking moment hoping to appeal to those people, but don't worry about him being president. DeSantis is doomed. Fox could be also, but that might be too much to hope. Tucker Carlson is stuck between sinking Fox or telling the truth, and we all know which way he's heading. Fugitive MAGA mogul Guo Wengui wants to burn it all down, and so his lair conflagration doesn't seem a huge surprise.
EPISODE 160: COUNTDOWN WITH KEITH OLBERMANN A-Block (1:41) SPECIAL COMMENT: The Stormy Daniels Grand Jury reconvenes at mid-day Thursday amid a reporting consensus that one last witness will be heard, to rebut the pro-Trump attorney Robert Costello who appeared Monday. But nobody is certain if that will be a Michael Cohen redux or an entirely new witness (CNN even threw out the name Stormy Daniels). So far Costello's main contributions have been the standard Trump hyperbole about "600 pages of evidence the DA has hidden" (almost none of which seems to have any relevance to the Daniels payoff) and one of the great malapropisms of the Trump era. Costello insists he "threw a wrench into their monkey works" - which isn't a thing. The Grand Jury is not expected to do anything but hear testimony so an indictment would seem to shift to next week. But so far everything that seemed logical has proved not to be the case. Happily, the Special Counsel's push to erase Attorney-Client privilege for Trump lawyer Evan Corcoran seems to be clarifying nicely.
