"Il 9 luglio 2021, i 422 dipendenti della GKN di Campi Bisenzio (Firenze) vengono licenziati collettivamente per cessazione di attività. I lavoratori si mobilitano immediatamente a difesa del proprio lavoro e del proprio territorio dalla delocalizzazione e dall'impoverimento ma non solo: si mettono in connessione con altre vertenze e movimenti, in particolare a quello climatico, immaginando un futuro diverso. Ad oggi, dopo 15 mesi senza stipendio, i lavoratori GKN hanno redatto un piano industriale e avviato una procedura di azionariato popolare, a cui è ancora possibile aderire, con l'obiettivo di raccogliere 2 milioni di euro, per far ripartire la fabbrica in forma cooperativa. Im neuen Podcast erörtern Niko Härting und Stefan Brink in Querbeet (ab Minute 05:45) zunächst den geleakten Entwurf zu einem Beschäftigtendatengesetz. Einige Vorschläge waren zu erwarten, etwa zum Einsatz von KI-Systemen (§ 10) oder zu einem Verwertungsverbot (§ 11 – entgegen BAG Urteil vom 29. Juni 2023 - 2 AZR 296/22), andere wie das Mitbestimmungsrecht des Betriebsrats bei der Bestellung des internen oder externen Datenschutzbeauftragten (§ 12) überraschen. Eine deutliche Verschlechterung der Beschäftigtenrechte stellt die zulässige verdeckte Überwachung dar (§ 20), die aber DS-GVO widrig sein könnte. Dann werfen wir einen Blick (ab Minute 16:25) auf den BGH, der im Verfahren zum Meta Scraping ein Leitentscheidungsverfahren bestimmt hat (https://www.bundesgerichtshof.de/SharedDocs/Pressemitteilungen/DE/2024/2024206.html). Auf Basis des neuen § 552 b ZPO soll eine zügige höchstrichterliche Klärung trotz der Rücknahme von Revisionen aus prozesstaktischen Gründen oder aufgrund eines Vergleichs ermöglicht werden. Dann geht es (ab Minute 27:17) um das BKA Urteil des BVerfG vom 01. Oktober 2024 (1 BvR 1160/19). Hier waren die Verfassungsbeschwerden der GFF, verschiedener Rechtsanwälte und Fußball-Ultras gegen das BKA-Gesetz recht erfolgreich. Teilweise setzte das Gericht die Anforderungen an Zulässigkeit von Verfassungsbeschwerden (zu) hoch an, etwa wenn es in dieser komplizierten Materie auf der „hinreichenden Auseinandersetzung mit dem einschlägigen Fachrecht bezüglich der Trennung der Datenbestände im Informationssystem des Bundeskriminalamts und im polizeilichen Informationsverbund sowie der damit einhergehenden unterschiedlichen Gewichtung des Eingriffs und möglichen korrespondierenden Rechtfertigungsanforderungen“ besteht. Das kann kein Beschwerdeführer liefern. In der Sache erklärte Karlsruhe gesetzliche Befugnisse des BKA zur Datenerhebung (§ 45 Abs. 1 Satz 1 Nr. 4 BKAG) und Datenspeicherung (§ 18 Abs. 1 Nr. 2 BKAG) in Teilen für verfassungswidrig wegen Verstoß gegen das Grundrecht (!) auf informationelle Selbstbestimmung. Gesetzlich vorgesehene Einzelfallprüfungen von Behörden oder Gerichten genügten mangels eines gesetzlichen Regelungskonzepts nicht. Kritisch sehen die Hosts, das das BVerfG einmal mehr zum „Reparaturbetrieb“ verkommt, zu einer „Anstalt zur Optimierung von Grundrechtsbeschränkungen“ – und das ist sicherlich keine gute Nachricht.

Anna Smith sits down with Festival Director Allison Gardner, then has an exclusive interview with the director of Love Lies Bleeding Rose Glass, with Oscar-nominated director of The Teacher Farah Nabulsi, and with BAFTA-nominated director of Edge of Summer Lucy Cohen. First up, Director of GFF Allison Gardner picks out some of her festival highlights, from Ava DuVernay's Origin to Viggo Mortensen's The Dead Don't Hurt which she describes as a ‘feminist western'. Allison talks about the unique programming at GFF with 126 films included at the festival this year. She picks out the ‘Love is sweet oh!' strand programmed by Tomiwa Folorunso, the ‘Gestures of Memory' strand programmed by Natasha Thembiso Ruwona, and ‘What Will the Men Wear?' programmed by Rosie Beattie. Next up Anna welcomes back Rose Glass to Girls On Film, who first appeared in Episode 60 to discuss her debut Saint Maud, which also showed at GFF in 2019. This year Rose is back with her hotly-anticipated second feature, Love Lies Bleeding, which had its UK premiere as the Opening Gala film at GFF. With Anna, Rose talks about the ‘dream' casting of Kristen Stewart as moody heartthrob Lou, who meets amateur bodybuilder Jackie when she turns up in Lou's sleepy hometown. The pair fall hard for one another and Rose describes crafting their fantastical love story, with co-writer Weronika Tofilska, which has ‘one foot in reality, and one foot somewhere stranger'... Anna also speaks to Oscar-nominated director Farah Nabulsi, whose debut feature The Teacher is showing at GFF. Anna asked Farah about her journey into filmmaking, from a background in business to directing her first short The Present, which went on to be nominated for the 2021 Oscar for Best Live Action Short Film. Finally, Anna speaks with BAFTA-nominated director Lucy Cohen, whose coming-of-age film Edge of Summer tells the story of 11-year-old Evie on holiday in Cornwall in the early 1990s. When she meets local boy Adam, a mysterious discovery down an old tin mine changes everything. Lucy talks to Anna about her influences in exploring childhood on screen, citing Ratcatcher (Lynne Ramsay, 1999) and Walkabout (Nicolas Roeg, 1771), and about her excitement to be showing the film at Glasgow Film Festival. Re- caping the 4th of July and all the food situations I had to navigate! Then things get really real and I share my T1D diagnosis experience. It's still really emotional for me to talk about it's because I still have sadness and anger surrounding this disease. My hope is to education and spread awareness about symptoms and knowing what to look for. I hope you learn something today and have compassion for other people living with invisible diseases. We are going through a lot inside and for me, I always put on a happy face but sometimes inside I am sad and angry that I have to live with this forever. It's a freaking rollercoaster, man.
