When law enforcement got there they were unable to get inside - they found two domestic workers to let them in - and it didn’t take them long to find a horrific scene - three bodies, Charity and her two young children.     Two cases this week that expose exactly how broken the American legal system is — in completely opposite directions. In Arkansas, Aaron Spencer is heading to trial for stopping Michael Fosler, a 67-year-old man with 43 felony charges who was out on bond and actively taking Spencer's 13-year-old daughter in the middle of the night. Fosler had already assaulted her once. A no-contact order was in place. The system knew he was dangerous and let him walk anyway. When Spencer's daughter ended up in Fosler's truck heading toward Fosler's house, Spencer did what the system refused to do — he protected his child. Now prosecutors want to use body cam footage from three months earlier to argue premeditation. They want a jury to believe a father in shock, processing his daughter's disclosure, was actually planning something. The defense says this was a kidnapping in progress and Arkansas law justified every action Spencer took. In California, Rob Reiner's son Nick is accused of taking both of his parents' lives after years of addiction and mental illness that the family publicly tried to address. They had money. They had access. They had every resource available. But California law doesn't let you force an adult into treatment — no matter how sick they are, no matter how many times they've been hospitalized, no matter how obvious the trajectory is. You just wait. The Reiners waited. And now they're gone. One father acted because the system let a predator walk. One father couldn't act because the system tied his hands. Both families deserved better.     The Lumbee Tribe is celebrating the passage of the National Defense Authorization Act, which includes legislation to grant the tribe federal recognition. The U.S. Senate passed the defense bill Wednesday, as Lumbee citizens gathered in Pembroke, N.C. for a watch party. Lumbee Chairman John Lowery was in Washington D.C. for the vote, and shared a short video message saying he's the last chairman to go the nation’s capital to fight for full federal recognition. “Now our children and our grandchildren, our great grandchildren can come up here working and fighting and promoting other things for our people.” The tribe has sought federal status for more than a century. The Lumbee's effort has faced opposition, including by the Eastern Band of Cherokee Indians in North Carolina, while President Donald Trump promised the Lumbee Tribe federal recognition. President Franklin Deleanor Roosevelt in 1941 and President Donald Trump in 2025 invoking the Alien Enemies Act. This December marked the 84th anniversary of the Pearl Harbor bombing – a shocking attack that drew the U.S. into World War II and unleashed a wave of anti-Japanese hysteria. While the U.S. would join a global fight against fascism and Nazi concentration camps, it was erecting camps of its own at home, forcing tens of thousands of Japanese Americans into internment. Two of those camps were set up on tribal lands in Arizona. In the first of a 5-part series, KJZZ's Gabriel Pietrorazio examines the law that has given presidents power to imprison perceived enemies. It all began December 7, 1941, a Sunday morning in Hawaii, with the bombing of Pearl Harbor. More than 2,400 souls were lost at the naval base on the island of Oʻahu. The U.S. was suddenly swept into the Pacific Theater. “And we're going to fight it with everything we've got.” During President Franklin Delano Roosevelt's “Day of Infamy” speech, he invoked the Alien Enemies Act. It's a 1798 wartime law authorizing the president to legally detain and deport anyone suspected of engaging in acts like espionage and sabotage. “Not only must the shame of Japanese treachery be wiped out, but the forces of international brutality wherever they exist, must be absolutely and finally broken.” Weeks later, President Roosevelt directed the Secretary of War to herd more than 120,000 people with Japanese ancestry into camps in Arizona, California, Wyoming, Colorado, Utah, Idaho, and as far east as Arkansas. Two-thirds of prisoners were American-born citizens. First lady Eleanor Roosevelt had empathized with them, even touring a camp south of Phoenix in 1943. Barbara Perry says Mrs. Roosevelt was simply ahead of her time. “And certainly on how she viewed Japanese Americans, but she couldn't convince her husband of that.” Perry is co-chair of the Presidential Oral History Program at the University of Virginia. She also points out precedent was set a century prior when President Andrew Jackson signed the Indian Removal Act in 1830 – marching tribes west of the Mississippi River. “America was pretty discriminatory…” Despite not being at war, President Trump reinvoked the Alien Enemies Act on day one of his second term. “…to eliminate the presence of all foreign gangs and criminal networks, bringing devastating crime to U.S. soil, including our cities and inner cities.” This proclamation wasn't surprising to John Woolley, co-director of the American Presidency Project at UC Santa Barbara. “This is a domestic political rallying point that is very powerful with Donald Trump's base.” Part two explores why a pair of Arizona reservations were picked to house the camps. And in that moment of devastation, Spencer said something prosecutors now want to use against him: "Sometimes you've got to handle things yourself." The state is calling that premeditation. They want a jury to believe a father processing the worst news of his life was actually announcing a plan. But here's what that argument ignores — Spencer was watching the system fail his daughter in real time. He was asking deputies what kind of sentence Fosler would realistically get.     Michael Fosler was out on a $50,000 bond. He had 43 felony charges hanging over him — assault of a minor, grooming, exploitation material. A no-contact order was in place. The system knew exactly who he was and what he was capable of. And just after 1 a.m. on October 8th, 2024, Aaron Spencer's 13-year-old daughter was in Fosler's truck, being taken toward Fosler's house in the middle of the night. This wasn't a hypothetical threat. This wasn't a father acting on old anger. This was a kidnapping in progress — by the same man who had already violated his child once and was facing decades in prison if she testified against him. Spencer's daughter was the primary witness. Fosler had every reason to want her gone. Spencer pursued Fosler for 20 minutes. Prosecutors say he should have called 911. But Spencer says he was driving at high speed on dark roads trying not to lose sight of the truck carrying his daughter. When he finally forced Fosler off the road, his daughter tried to escape. Fosler allegedly grabbed her. Then Fosler allegedly came at Spencer. That's when Spencer used force. Arkansas law is clear — you are allowed to use deadly force to protect another person from imminent serious harm. Spencer wasn't hunting anyone. He was responding to an active crisis involving his own child and a known predator who had already demonstrated what he was willing to do. Legal experts say this isn't about jury nullification.     WORT 89.9FM Madison · One Man Stalled Healthcare Expansion for New Moms Currently, Wisconsin and Arkansas are the only two states that have not expanded healthcare coverage for new moms. On today's show, host Dana Pellebon speaks with ProPublica reporter, Megan O'Matz, about her investigation into Robin Vos's rejection of postpartum Medicaid expansion in Wisconsin.  Even though there is bipartisan support in the Wisconsin legislature to expand Medicaid coverage for up to a year for low-income new moms, Robin Vos has blocked a bill that would do just that. O'Matz reports that Vos broke with other anti-abortion members of his party and that this decision is timed with the overturning of Roe v. Wade. She calls it hypocritical not to give new moms healthcare past two months and claim you're “pro-life” because the early months after birth are a vulnerable period when parents often need ongoing medication and treatment. O'Matz also tracks the influence of business interests on Vos's decision, including the Uihlein family's financial contributions to the Republican Assembly Campaign Committee.  They also talk about O'Matz's most recent article on Sen. Ron Johnson's support of a discredited Wisconsin doctor whose new book on chlorine dioxide–a bleaching agent used as a disinfectant and deodorizer–spreads misinformation. Sen. Johnson has written a blurb on the book's dust jacket and has joined the doctor on panels on vaccine skepticism even though chlorine dioxide is not a drug or a medicine approved for therapeutic use. O'Matz says that we're in a place where people don't trust the CDC and that studies cited in Dr. Kory's book are not scientifically rigorous. O'Matz says that she got her start in Florida, where open records laws support journalists' work of keeping elected officials accountable. However the newspaper industry has been contracting over the years due to influence from media conglomerates. She's now with ProPublica, a nonprofit, independent newsroom that seeks to deliver a level of accountability to readers by reporting on how people with power use it. They rely on open records, data, and fact checking to foster reader trust. Megan O'Matz is a ProPublica reporter covering issues in Wisconsin and throughout the Midwest. She has been with ProPublica since 2021 and writes about voting processes in Wisconsin, a swing state, as well as stories about family court, prosecutorial blunders and predatory lending. She has also worked at the South Florida Sun Sentinel. She and her colleagues were finalists for the 2006 Pulitzer Prize for stories about widespread fraud in federal disaster aid programs after a series of devastating hurricanes. She also shared in the 2019 Pulitzer Prize for reporting on the failures of school administrators and police officers in connection with the Parkland school shooting. However there are places on Earth that could be considered hell – no not Detroit or Wichita. We're talking about actual places that look like the entrances to purgatory. And perhaps they really are. (Secret Doors to the Underworld) *** A king, a gossoon and a bear walked into a bar. No, this is not the first line of a joke, but a common occurrence in Potrero Hill in San Francisco, California, during the 1880s. The king was Frank McManus, the gossoon was Frank's baseball-playing brother, Cornelius, and the bear was a large inebriated ursine. It is something that has happened since time began, but medical experts are still baffled by it.
