So, we are currently watching with great expectation here over a lawsuit that has been brought and filed by our good friend John Petrolino with the help and assistance of the Citizens Committee for the Right to Keep and Bear Arms. (ccrkba.org) And what is going on here is very interesting, because John, who many of you know, does excellent reporting on firearm issues, particularly on New Jersey as well. He does great extensive coverage. Well, John was instrumental in having the permit to carry statistics getting publicized and put out there. And with it being put into the ether and made part of an awareness that otherwise really wasn’t there about the key discovery he made regarding blacks, black carry applicants. African American applicants are denied more than double their white counterparts for non-criminal reasons. Okay? Evan Nappen 01:55 And John, he requested the records seeking the statistics on retired police officer carry permits to build on the coverage of all as to who has been denied. So, remember retired police officers in New Jersey can get the RLEO, the Retired Law Enforcement Officer, Card, which in effect functions as a carry permit for retired law enforcement. Prior to the Bruen decision, where it was virtually impossible for folks to get carries, Retired Officers through the RLEO were able to get their carry in that manner. Now, of course, there’s been even more progress where LEOSA (Law Enforcement Officer Safety Act) also covers law enforcement and actually covers New Jersey law enforcement, which to large degree makes even needing a retired law enforcement carry not as necessary as it used to be. But still, it is something that is done, that is issued. Page – 2 – of 11 Evan Nappen 03:14 John requested through, you know, essentially New Jersey’s freedom of information to get the records so that we can continue the further analysis. And what I have here is a news release from Citizens Committee. (https://ccrkba.org/ccrkba-director-sues-nj-officials-over-denied-records-requests/) And what it says, as noted in the complaint, “Plaintiff and the public has a strong interest in ascertaining the relationship between the demographics of carry permit holders amongst the general public and retired law enforcement officers including but not limited to county location, race, sex and the effect of potentially disqualifying criteria in the application population as well as the success rate for the appeal process within the New Jersey State Police.” “Having established Petrolino was deprived of his common law right of access the New Jersey Civil Rights Act was violated, the clear remedy is injunctive relief compelling the production of the records to Petrolino . . .” It continues, “The NJSP”, meaning New Jersey State Police, “has denied countless records requests that I’ve made over the years, never fulfilling even one”, Director Petrolino said. “When I emailed them about these denials, an unnamed person at NJSP basically told me to sue them — so here we are.” Evan Nappen 04:46 That’s right. And as further noted in the news release, “Records concerning the retired police officer permits are about as public as you can get,” says Chairman Alan Gottlieb. “Do they have the same level of perceived bias in their permitting statistics? Or perhaps worse yet, do they not? The public has a right to know this information. We laud Director Petrolino in his quest to hold New Jersey officials accountable by forcing them to be transparent with those they swore to serve.” Yes, it is very important that these records get out there, because the current records already show the institutionalized racism that occurs in carry permitting systems. That alone should stand for why we should have Constitutional Carry in New Jersey, where you do not need any permit, as do the majority of the United States. They have no permit required, and it is something that is not necessary, nor in full exercise of the Second Amendment. We should not even be required to need a permission slip. And this illustrates the reasons why. Because the surest way to avoid the racial discrimination, to avoid these type of coverups over records, is to not have to have the records at all, by having what is lovingly called Constitutional Carry. Evan Nappen 06:34 You may have heard there’s a bill federally being pursued to have National Constitutional Carry, which would preempt all states and make it so that any law-abiding citizen can carry without any permit anywhere in the U.S. Now, as a step in between getting to that would be national reciprocity, where every State has to at least recognize every other state’s carry permit, although the majority of states don’t even require carry permits anymore. So, this is what we’re working toward, because this is fundamental to our rights. The ability to carry, the ability to be defenders and not victims, and the fight continues. This is yet another important, very important, step in the fight. As it reveals, and has the potential to reveal, the flaws and other problems that go to bias, racism, arbitrary denials, discouragement built into the system itself. These are all the mechanisms that permitting systems are designed to create. They’re actually made to do this. They’re made to discourage. The idea that it has anything to do with public safety is, of course, a joke, and it’s proven by the Constitutional carry states that are doing just fine without the permission slip. So, in the states that have this still in place, it’s there to be a barrier to the exercise of our rights. Page – 3 – of 11 Evan Nappen 08:28 And you know, it’s kind of laughable to see the Left talk about how outrageous it is, unbelievably outrageous, how it’s Jim Crow 2.0, to require an ID to vote. To vote! That’s Jim Crow. But what goes on with carry permits, with gun licensing? Oh, that’s fine. Well, if that’s Jim Crow 2.0, gun laws are Jim Crow 2000. It’s insanity then, Okay? That’s what’s going on in that radical difference. Teddy Nappen 09:10 Honestly, Dad, it makes me think back to Shaneen Allen, where, you remember, we reached out to all the pro black groups, all the others, like bringing. Evan Nappen 09:22 Right! Teddy Nappen 09:22 They were going to put a single black mom in jail for doing nothing more wrong than. Evan Nappen 09:28 Seven years, with three and a half years minimum mandatory, was their best offer when I took on the case. Teddy Nappen 09:35 Yep, reached out to Al Sharpton’s group, the NCAA, anything? Evan Nappen 09:39 Everybody, right! Teddy Nappen 09:41 Nothing. Crickets. Evan Nappen 09:43 Crickets. Teddy Nappen 09:44 Because there is a built-in reason. These people, the Left are just Marxists. And when it comes to Marxists, they have no standards. It’s about oppressor and oppressee, and it doesn’t matter what position we must take. Because that’s how you end up with Queers for Palestine. That’s how you end up with the fact that they’re pushing actual racist gun laws. Because that is the standard. Because it has to be. No, no. We have to make sure these people are disarmed so we can keep the oppressor / oppressee mindset continuing. Sorry, we can’t side and agree with common sense issues like civil rights. Evan Nappen 10:26 And the most fundamental of all civil rights is the right to be armed. I mean, look right now at what’s going on in Iran. Gee, why haven’t the people risen up to get rid of that evil, terroristic, ruthless regime? Page – 4 – of 11 Why? They don’t have the guns. They don’t have the guns. That’s the problem. That is the big problem. And we have, as an insurance policy in America the Second Amendment, and it’s a check on tyranny. Okay? Enemies, both foreign and domestic, all right? This is why it’s there. And you can see countries that have disarmed their civilian population, and then you see what they do to them. You can see that taking place. Not just in countries as extreme as Iran, or as extreme even as North Korea, or others, what we think of as dictatorships or totalitarian states. But just look now at the U.K. and what is going on there. And Teddy, I think in Press Checks, you’re going to be talking about that, and there you can see what. I’m not going to, we’ll just put that as a little teaser. We’re going to get into that, and it’s critical. So, I want to applaud John Petrolino and Citizens Committee (CCRKBA.org) for pushing to get these records, and as we can expose the cover up. Because why? Why not release them? What is it that they’re so afraid of us finding out, right? You know, there’s something there. Where there’s smoke, there’s fire. Let’s say Kamala won, the House and Senate are in their favor, and they followed James Carville’s, you know, we’re going to pack the Court. Also, you know, make Puerto Rico a state and everything that they can, so they can pass whatever agenda. What does that look like? I always will point to Canada and then much further along, the U.K. In the U.K., one of the things that has been very prevalent in their politics is there have been a heavy push of the anti-knife movement. You know, they already cracked down as hard as they possibly could on guns. Evan Nappen 18:07 So, now they need some other inanimate object to blame. Teddy Nappen 18:10 Correct! And I was looking to, okay, who is the “EveryTown” of the U.K.’s anti-knife movement? Who is the group that is pushing for all this? What is the driving force? Because there’s always some group. There’s always one. There’s always the, you know, Moms Demand Action, which is also funded by “EveryTown”. You also have Giffords. You have all these groups. Who is the one pushing for this in the U.K.? And they’re very proud of it. They admitted it on their site, “Blades Down” group. (https://bladesdown.co.uk/) It is an organization founded in the U.K. “Blades Down exists to protect young lives and strengthen communities. We work with young people and families to prevent knife crime through education, . . .” oh, propaganda, “. . . early intervention . . .” Ah, legislation to take away your rights. “. . . and practical skills.” Oh, practical skills, so you can make clear your argument for wanting to disarm your people. “By building confidence, promoting safer choices and equipping communities with life saving knowledge . . .” I love how they dress all that stuff up. And by the way, they love how they promote that we’ve removed 199 knives out of our community. Evan Nappen 19:30 199 knives. Oh, my. Okay. Teddy Nappen 19:35 Amazing. Okay. Page – 6 – of 11 Evan Nappen 19:36 A whole 199? Yeah, wow. Teddy Nappen 19:39 And I love the advertisement. I thought a knife would protect me. I didn’t know it would change everything. Evan Nappen 19:46 You know, interestingly, about knives and protection. That is the gateway self-defense tool for women, believe it or not. Studies have shown that when women want to defend themselves, and if they’re not otherwise trained in any other type of defense, they will often go first to a knife, because they are most comfortable with knives. Normally, you know, having grown up in the kitchen, etc, there’s a familiarity to a knife. So, the knife becomes the first weapon used by women, often those that are victims of domestic violence or have been victims of crime, etc. And then once they want to grow from the knife as their primary self-defense tool, they will often discover firearms, and that is very interesting. Because what the U.K. is doing is they want to ban knives. They want everyone to be defenseless, particularly women who would go to knives even first. Teddy Nappen 21:08 They saw the article about the little girl defending herself against the pedophile and. Evan Nappen 21:13 Correct! Teddy Nappen 21:14 With a knife, and they thought, right. We have to disarm the little girl to make sure the pedophile isn’t hurt. Evan Nappen 21:20 Yeah, so in the U.K., folks don’t realize, but historically, believe it or not, the modern, the modern gun ban, gun rights oppression movement actually came here from the U.K. after World War One. This had taken effect in the U.K., and the same political forces started the movement in the United States to go after guns. And originally, they were successful in going state by state, getting different states to pass gun laws. So much so that the NRA back then, I mean, they were naive. They actually had what were called the model gun laws, and they were putting out to states. This is the National Rifle Association. They put out to states what were the model gun laws that NRA wanted to see passed. It was essentially the NRA supporting gun laws. And they focused on, number one, things other than firearms. And remnants of that law going back 1920s era, back then. Evan Nappen 22:57 Those remnants are in New Jersey’s law. They actually have roots going back to what the NRA pursued back then, out of naivete. I mean, they were, you know, plainly naive about it. But this is why, and also the head of the NRA at the time was a kind of a, he was pro-oppression, pro-gun rights oppression. You know, he was always kind of a problematic guy that you would never think today would Page – 7 – of 11 be ahead of that organization. But regardless, they pushed these state model, state gun laws. And so, if you look, for example, where New Jersey had the ban on blackjacks, switchblades, slungshot, etc, this kind of thing, which then became slingshots because they didn’t know what a slungshot was. Well, that actually goes back to the model gun laws that NRA was pushing. It even contained elements for permitting, for carry and all that kind of stuff, way back. Evan Nappen 24:05 And that actually originated and came to NRA from England. It came over from the U.K., and it planted the groundwork in the States. Then what happened was it became too much with different states, not blah, blah, blah, and it went national. And by the time it went national, well, what was it? It was the NFA, the National Firearms Act. And the National Firearms Act was looked at, look, we can just get a one federal law. We don’t have to do these state laws. And that’s why, when the National Firearms Act finally passed in the form that it became, and I read through all the committee hearings, watching the NFA progress. It originally, the original NFA wanted to ban all handguns. They wanted to ban all, not just full auto, but all semi autos and full autos, and magazines over 12 rounds. That was the original, original NFA. And then through the committees, you saw them say, well, okay, what do we allow? 22 handguns. And then, okay, well, how about we keep semi-autos. And then you see, and then it finally took shape to what it is as we know it today. Evan Nappen 25:23 At the time, the NRA, in The Rifleman, you know, in the “American Rifleman” magazine, said we’ve solved the gun control problem for America, and they were proud of it. And look, I’m not doing or saying this to bash NRA. It’s not why. We’ve got to know the true history of our mistakes. Okay? And it was mistake. We see it now, plain as can be. It was plainly a mistake, but it happened. We need to recognize it, and we need to try to fix past mistakes. You know, ignoring them and putting them under the rug isn’t a good idea. So, know this history, okay? Because we don’t want to repeat this history. And yet here, Teddy, you see with knives. We don’t have, yet, in this country, an anti-knife movement in the way we have an anti-gun movement. But once they take care of getting their agenda of oppressing and disarming and disenfranchising us of gun rights, you can rest assured that it’ll be knives next. They’re pushing the Government to crack down on Facebook Marketplace because people are buying kitchen knives on Facebook Marketplace without age verification. Huh? What does that sound? Quite familiar. Think of Gun Broker. Think of any other thing. This is what they do. They crack down on any forms of, you know, freedom finding a way, and by the director. And so I traced it. I went even further. Okay, who is funding this group? Who’s their Bloomberg ass group? Who is pushing for all this? Apparently, it is out of this group known as the Ben Kinsella Trust. (https://bladesdown.co.uk/facebook-marketplace-knives-being-sold-without-age-verification/) And this is the U.K. London crackdown on knives, where, you know, have pushed all the laws of trying to stop people from possessing knives. Have pushed for all the anti-knife laws. They’re the ones funding all this group. Guess who’s one of their sponsors? Facebook! Teddy Nappen 27:44 They’re literally complaining about Facebook Marketplace having that, but also Facebook is their sponsor. Evan Nappen 28:29 That’s hilarious. Well. Teddy Nappen 28:29 But this is the thing. Big tech is not your friend. They absolutely supported the Democrat Party. They are the number one funder of the Democrat movement. When it comes to rights, they do not care. So, it’s just disgusting. And remember, in the U.K. for laws, the maximum penalty for illegally carrying a knife is up to four years in State Prison. If you, quote, unquote, here’s it, “you have to have a good reason for carrying your knife.” What are the good reasons ? For your work, for religious purposes, and for a national costume. You can’t be too nationalistic here. And, of course, they have their rigmarole ban lists of knives that we’ve talked about. Evan Nappen 29:50 Well, you know, New Jersey’s knife ban, quote, unquote, does talk about, under subsection D, “manifest lawful purpose”, which seems to be pretty damn vague anyway. And with Bruen talking about right to defense outside the home, I think that law is ripe to be attacked. So, it’s in a way, similar, but it’s not. The problem there is on outside the home for carry. Whereas you’re exempted under other weapons, subsection D, you have an exemption under N.J.S. 2C:39-6e., to possess knives in your home. When it comes to carrying them, then you need a “manifest lawful purpose”, which is very similar to what the U.K. has. However, they’re actually going way further. They’re wanting to ban. They have the knife surrender bins. They’re actually doing a “dull your knife” campaign, stupid like that. Actually, you know, some people like you think, like, if you really hate somebody, it’s like, I’m going to slice you up with a dull knife, right? That’s even worse. But maybe that’s where they’re going. Teddy Nappen 31:09 Don’t worry. They’re doing their best cracking down on the rapes from going from 19,000 to 70,000 in the UK, because they let mass migration in from individuals who, you know, let’s just say don’t. It’s sharp knives. Sharp knives are the reason for the massive increase of rapes. If we at least have dull knives, we’ll address that issue, right? You can still buy unregistered knives in America. You can buy knives, and there’s no permit required. Yet! There’s no place that I’m aware of anywhere in the U.S. that requires a knife permit. Now, you may think that’s outrageous. Who would? How could they ever pass a law to require you to have a permit for a knife? Well, let me tell you, right now. I have a knife permit that permits a serialized knife that was done by Russia. Russia. Soviet Union. I have the actual permit and the knife that goes with the permit. It’s just a very basic, five-inch blade hunting knife. They had knife control, knife registration, and you needed a permit. And I bet, in the U.K., they want to do something similar, right? Breaking testimony from the Paul Caneiro quadruple murder trial. New Jersey State Police forensic analysts confirmed DNA from both Sophia Caneiro, age 8, and Jesse Caneiro, age 11, was found on clothing in their uncle Paul's basement. The children were stabbed to death fourteen miles away in Colts Neck. Sophia's blood appeared in three separate locations on a pair of jeans — shin, calf, thigh. Her DNA was also on a black surgical glove frozen to the denim. Jesse's DNA showed up as part of a mixed sample. Prosecutors argue Paul Caneiro wore those items when he allegedly killed his brother Keith's entire family, then brought them home. Sophia was stabbed seventeen times. Court findings suggest she may have still been breathing when the fire was set beneath her. Keith Caneiro was shot execution-style — a contact or near-contact wound through his hood while he lay face-down on his lawn. The night before, he'd confronted Paul about $77,000 missing from a trust account and demanded answers by 8 p.m. Prosecutors say what happened next was Paul's response. The defense is raising contamination questions, but the physical evidence linking Paul to the murders is now before the jury. So, the New Jersey Democrats are going to give gun owners a Nightmare Before Christmas. What they are doing is pushing a package of Second Amendment oppression upon us, and they decided that the perfect time to do it is right before Christmas. On Monday, December 22, the Senate will be having a voting session. They’re going to be looking at bills that we’re going to talk about right now, and you need to take action. You know, you need to let the legislators know that you oppose this. Hopefully you belong to the Association of New Jersey Rifle & Pistol Clubs. If not, you need to join. That’s anjrpc.org. They send out the news releases where you can immediately take action and let the legislature know your feelings on their oppression of our Second Amendment rights as they continue to attack them. Evan Nappen 01:33 Now, we have some very problematic laws that they’re going to be trying to jam through, and I want to make sure that you’re aware of what they are and what they mean. So, we have what is A-4974, and its companion in the Senate is S-3893. (https://www.njleg.state.nj.us/bill-search/2024/S3893) This bill establishes criminal penalties for sale and possession of machine gun conversion devices. Now, of course, these things are already banned. They’re already banned under federal law and state law, but New Jersey just can’t ban something enough, right? So, they’re just duplicating here even more bans upon bans. This is supposedly addressing so-called Glock triggers, but New Jersey usually finds a way to expand it to all kinds of other nonsense. We’ve seen these things lead off into false charges over devices that are not designed to convert to machine guns, but instead designed to simply improve accuracy and a trigger or those kind of things. So, these things are just problematic, and they’re just putting bans on top of bans. And they just want to make sure their name is on a piece of law where they’re “doing something about it”. You know, to sell red meat to their base. So, we have that to deal with. Page – 1 – of 10Evan Nappen 03:16 Additionally, we have A-4975 and the Senate companion bill is S-3894. (https://www.njleg.state.nj.us/bill-search/2024/A3894) This bill establishes a crime of possessing digital instructions to illegally manufacture firearms and firearm components. Now, keep in mind, back in 2018 Murphy signed a law banning the use and sale these digital files already, but this bill is even worse. The mere possession of the files will result in incredibly harsh penalties, even if you unknowingly possess them on a long forgotten computer, etc. So, New Jersey is turning firearm information, pure firearm digital information, into the equivalent of possessing child pornography. Simple possession of the digital file itself. Evan Nappen 04:20 It doesn’t matter that you never had any intention to actually build a firearm, but this gun information is itself being turned into contraband. Now, of course, this brings in First Amendment issues as well as Second Amendment issues, and I’m sure this will as well be subject to challenge. But nonetheless, it puts gun owners at risk that utilize internet and such for downloads of different things. Strictly for informational purposes. Even though you had no intent to 3D print a gun or not, or to use it with a CNC machine to make guns or even gun parts. So, this bill is another oppression of Second Amendment rights, and this time an oppression of First Amendment rights. But since when do Democrats care about rights? So, you need to oppose this as well. Evan Nappen 05:25 There is another bill, Assembly 4978, and the Senate companion is 3897. (https://pub.njleg.gov/Bills/2024/S4000/3897_I1.HTM) Now, this bill requires the Attorney General to report data regarding shootings that did not result in bodily injury. This type of data accumulation is used so then they can twist it into political fodder to further pass other Second Amendment oppression laws. This is their game. So, this is a step in, you know, focusing on the potential discharge law, making accidents into crimes, and using it to become automatic licensing disqualifiers, what become essentially per se felonies. This is how their evil works. This is what they do. This is their machinations, and this is the beginnings of them laying the groundwork to do that very thing. We’ve seen this playbook before, as they put data together that they then abuse in the manner that suits their purposes. So, of course, we have to fight this. Evan Nappen 06:53 Another incredibly serious other bill that’s in the Nightmare Before Christmas is Assembly 4981. The companion is S-3900. (https://www.njleg.state.nj.us/bill-search/2024/A4981) Now, this bill is a Gun Owner Gulag enhancement bill. This law will take the Gun Owner Gulag and make it even worse. So, as you should be familiar, but I want to make sure you are, New Jersey has the Gun Owner Gulag, which is New Jersey’s elimination of cash bail. In getting rid of cash bails, like so many progressive blue states took those actions to do that in the specifically during the, you know, defund police movement and all that. You normally hear about the cashless bails being utilized, where actual criminals, bona fide bad guys, you know, rapists, murders, etc, are put in a revolving door and released very quickly out in the street, particularly if they have other characteristics that the Left is favoring, such as being, you Page – 2 – of 10know, illegally in the country and things like that. They want those people out fast. So, it gets used in that way. Evan Nappen 08:15 But when it comes to weaponization of it against gun owners, well, that’s a different story. They want to imprison us. Okay? So they want to make sure that any gun owner that has a problem, well, they’re going to be subject to the Gulag, where they’re going to be held without bail until their trial, because there is no more bail in New Jersey. And what happens is the prosecutor seeks what is called pre-trial detention. And if pre-trial detention is granted, you’re going to sit in jail, having been proven guilty of nothing, until your trial, and that can be months or years. So, this is the Gulag, and that’s how it operates. Well, that’s bad enough. We fight these Gulag cases all the time, trying to get gun owners out because just about any gun offense is a felony level. New Jersey calls them crimes, and they’re normally warrant offenses. You get arrested and then you’re put through the Gulag where you’re held for 48 hours while the prosecutor decides whether to seek pre-trial detention or not. Evan Nappen 09:20 And their policies are, generally, in every gun case, they seek the Gulag, which is to hold you without bail. So, you’re going to be held at least, normally, another five days before your hearing, where your attorney will finally get to argue to get you out. And if your attorney is not successful in doing that, you are staying in with no bail. Well, this bill is an enhancement to that. It will allow the court to take even more time on any firearm offense where they get to hold you for yet another seven days, so that an operability report can somehow be provided regarding the operability of a firearm, which is often irrelevant to the criminal charge, especially in New Jersey. Operability is not even necessarily required for a firearm conviction, but here the abuse of it will be added into the Gulag’s initial holding of the gun owner. So, now you’re going to be arrested on the warrant charge on whatever the allegation of the firearm offense is, even though you’re innocent, it won’t matter. It’s a gun offense. So, the 48 hours, the prosecutor by way of their policy is going to hold you seeking pre-trial detention. Then that pre-trial detention hearing has to get scheduled within, arguably, five days, and normally it’s about that, five days, before you have the hearing. Evan Nappen 10:57 But if we get to that hearing and they say, oh no, we want another seven days, at least, here the seven days to get an operability report. So, now you’re going to be in jail for approximately two weeks, two weeks, without bail, because there is no bail. And that’s just to get you to the hearing so your attorney can try to argue to defeat the prosecutor’s motion for pre-trial detention. And they’re going to now throw this into the mix. So, you can figure with any gun arrest, you know, you’re falsely accused of being in a “sensitive place” or you’re falsely accused of possession of an assault firearm, or you’re falsely accused of unlawful possession of your handgun. You know all kind of false charges and gun rights oppression that I deal with all the time in practice. Well, you’re going to be at least two weeks in jail now before we can even get you out so we can fight the charge that will eventually get you acquitted of. Isn’t that cute? And that’s if your attorney knows how to get you out and succeeds in doing so. Because if not, you’ll just sit in jail until your trial to finally prove that. So, this is the just horrible addition to the Gun Owner Gulag. Page – 3 – of 10Evan Nappen 12:20 These bills need to be fought, and they need to be fought vigorously. Make sure you make your voices heard. Make sure you belong to ANJRPC, the Association of New Jersey Rifle & Pistol Clubs. They have a full-time paid lobbyist. They have a vigorous process here trying to fight this, but of course, we’re dealing with a state where it is a tremendous battle for the forces of constitutional rights protection. Here to succeed, it’s a difficult, challenging environment, but we have to keep up the fight. We have to make our voices known, and we can make changes. As a matter of fact, that Gulag bill, the Association was able to change the original form where it was an indefinite amount of time until they finally got the report. At least it’s been modified to a mere seven days extra. So, now it’s only two weeks in jail, guilty of nothing. Simply because you lawfully exercised your rights in New Jersey. So, these laws are terrible. They are more oppression from our oppressors. We need to fight it and make sure you do. Evan Nappen 13:44 Now, on a little bit of a Christmas gift here, despite the nightmare that the New Jersey Democrats are placing upon us. I do want to mention that thanks to President Trump and his appointment of judges throughout the land, not the least of which, of course, is the Supreme Court, getting three conservative constitutionalist judges there. But also his ability to add to the judges of the Third Circuit Court of Appeals. And because of President Trump particularly adding the last two judges that are constitutional judges that understand the significance of the Second Amendment, the full panel of 14 judges has agreed to hear the appeal in the Siegel versus Platkin, which is the Carry Killer lawsuit that challenges all these sensitive places and the other onerous restrictions that were put forward in the Carry Killer bill. And as you may know, the initial appeal with the three-judge panel, the three-judge panel that had ruled not tremendously in our favor, has been wiped out, wiped out. Now, the full panel of 14 judges are going to hear and decide the Carry Killer bill. This is very good news for us. Evan Nappen 15:26 This is something that makes me cautiously optimistic that we’re going to see some protection and our Second Amendment rights enforced, and it’s very, very important. Of course, New Jersey fought tooth and nail to try to stop the full panel from granting the en banc full panel, but the Association, particularly my good friend and colleague, Dan Schmutter, was successful here in having that full panel take the case. So, this will also bode well, because by getting a decision that knocks out most, if not all, of the Carry Killer bill, it’ll also lay the groundwork for the Supreme Court of the United States. If we start getting split decisions in the circuits over these sensitive place gambit that the Second Amendment oppressionists have pulled after Bruen to try to limit our rights, we may, in fact, see even a national case killing it permanently for the country. But here in New Jersey, we stand in good stead at the moment. Evan Nappen 16:47 Keep in mind that, at the moment, where can you carry and what are the categories where you can and can’t carry right now, at the current state. Remember, you cannot lawfully carry, even with a New Jersey carry permit, within 100 feet of a public gathering, demonstration or event requiring a Government permit. You’re still barred from zoos, parks, beaches, recreational facilities or areas owned or controlled by the state, county or local government unit designated as a gun-free zone. Publicly Page – 4 – of 10owned or leased libraries or museums. Bars or restaurants where alcohol is served and any other sites or facilities where alcohol is sold for consumption on the premises. Entertainment facilities. Casinos and related facilities. And healthcare facilities. Evan Nappen 17:41 Now you currently can lawfully carry with a New Jersey carry permit, of course, while this appeal is not resolved. These things are still blocked, though, and you’re able to carry, and this isn’t a complete list. But essentially in vehicles. As you may recall, the carjacker protection law that was built into the Carry Killer law, saying that you couldn’t have your loaded gun on your person in your vehicle. That is still blocked, and we are, we may carry in our vehicle, in that manner. Private property open to the public is no longer and still is not a sensitive place. In public film locations, we are able to carry. Additionally, the ruling is still in effect blocking the insurance requirement. As you may recall, at some point, Murphy issued an Executive Order banning the sale of so-called murder insurance, where you had gun owner protection programs, and then proceeded in the Carry Killer bill to mandate by law that you get actual murder insurance. Meaning insurance if someone commits an intentional act with a firearm, essentially murdering somebody. That’s been blocked. So, we don’t have to have insurance to have a carry license. And blocking certain permit procedures and requirements that were more administrative in nature. Evan Nappen 19:23 So, this is where we’re standing. But the good news is, with the full panel reviewing it, I’m very excited to see that outcome, and so should you. So, there is still hope. There is hope that the judiciary is going to speak for our rights, and that same full panel will be also considering New Jersey’s magazine ban and so-called assault firearm ban. I was like, okay, interesting. Now, this is technically Kiss, Kiss, Bang, Bang, which is a Christmas heist of a film. I don’t know if you ever saw it. With Robert Downey, Jr. Evan Nappen 25:26 I may have. Teddy Nappen 25:27 Kind of an action comedy. They’re carrying their Vector CP One. Evan Nappen 25:34 Oh, Vectors are in it. Huh, okay. Because, remember, the kid, he plays that clip, the black and white movie where he keeps. Evan Nappen 25:44 Well, you know, the P7 used to be the pistol of the New Jersey State Police, but they had over 40 accidental discharges with it, and they gave it up. And that’s because, although it was marketed as being one of the safest guns, the problem is, it’s a front squeeze that cocks the gun, when you squeeze the front. Unlike a 1911 that has a safety on the back, this squeeze cocks from the front. And the problem is, if you, if you’re not practiced and trained well enough, when you draw the gun out of a holster, you’re cocking it as you pull it out, and that creates a situation that is not exactly the safest situation to be in. There were numerous ADs with that gun. So, something to keep in mind. I think they’re cool and a very interesting design, but I remember seeing Superintendent Pagano talking about it. And he basically said, hey, look, it’s not the gun’s fault. He’s blaming his men. How nice of him. Yeah, right. So that was that episode of the gun, in theory, seeming like it may have been one of the safest guns, but in reality, it was prone to needing a lot of training to make sure that you didn’t cock it until you were ready to. These are mistakes that actual clients make that causes them problems, expensive problems. You get to learn for free. And this week’s GOFU is about printing. And I don’t mean printing with your computer printer. I mean about your gun showing when you’re carrying concealed. Now, in New Jersey, it’s not illegal to print. Believe it or not. A gun has to be concealed, but it doesn’t address printing while concealed. However, in New Jersey, you don’t want to print. Because not only do we need to carry concealed, but you want to keep that concealment private and secret. Evan Nappen 31:20 New Jersey is loaded with all kinds of people that are scared of guns, aren’t used to guns, and they can end up calling police because they think someone’s carrying a gun. And next thing you know, even though you’re legal to carry. You also give away tactical advantage, if people can make you as carrying. And this is an issue where individuals can make false accusations against you if they believe that you’re carrying. So, you want to make sure you don’t print when you conceal carry in Jersey. Make sure you are as discrete as possible. Also, you don’t want to inadvertently end up in a sensitive place and have a gun identified on you because you’re printing. You shouldn’t be in a sensitive place, but if you’re printing and in a sensitive place, then you’re going to have a bigger problem. So, be very conscientious when you carry, whether or not you’re printing, or whether your method of carry allows for inadvertent display of your firearm, even for a moment, because you want to stay discrete. You want your concealed carry to be concealed carry, and ultimately that gives you, if nothing else, a tactical advantage of surprise should you need your gun. Ralph welcomes Michael Mann, Professor in the “Department of Earth and Environmental Science” at the University of Pennsylvania and author along with Dr. Peter Hotez of “Science Under Siege: How to Fight the Five Most Powerful Forces that Threaten Our World.” Then we are joined by Martin O'Malley, former governor of Maryland and one time Commissioner of the Social Security Administration to refute all the lies being told about the state of Social Security.Dr. Michael E. Objective news outlets like the New York Times and the Washington Post too often engage in what we call performative neutrality, where anti-science positions are placed on an equal footing with the overwhelming consensus of the world's scientists.Dr. Michael MannPeople like to finger point at China, which currently is the largest emitter (of greenhouse gases) because they industrialized much later than the United States, more than a century later. But their trajectory is actually a downward trajectory. They've contributed far less carbon pollution to the atmosphere than we have, and they're taking greater action.Dr. Michael MannThe United States doesn't get to determine the future course of human civilization at this point. It's going to be the rest of the world. All the United States gets to determine is whether it's going to be on the front line of the clean energy transition, the great economic development of this century, whether they're going to be on board or left behind.Dr. Michael MannMartin O'Malley served as Commissioner of the Social Security Administration from December 20, 2023 to November 29, 2024. He previously served as Governor of Maryland from 2007 to 2015, following two terms as Mayor of the City of Baltimore.Once they (the Trump Administration) got rid of the heads of all of the offices of Inspectors General, they started launching these big lies, like the lie that there are 12 million dead people that continue to receive checks. And as Trump said himself to Congress, some of them are as much as 300 years old, which would have had them here for the founding of Jamestown.Martin O'MalleyThey (Republicans) are trying to wreck it (Social Security), wreck its reputation, wreck its customer service, so then they can rob it.Martin O'MalleyNews 10/3/25* Our top story this week is President Trump's chilling speech to the military high command, in which he proclaimed that “America is under invasion from within,” per PBS. Trump went on to say that he plans to use American cities – citing Chicago, San Francisco, and Portland – as “training grounds for our military.” Warning against conscientious objections by the military to this weaponization against domestic opponents, Trump added “I'm going to be meeting with generals and with admirals and with leaders. And if I don't like somebody, I'm going to fire them right on this spot.” Secretary of Defense Pete Hegseth, who has recently styled himself Secretary of War, reiterated this message, saying “if the words I'm speaking today are making your heart sink, then you should do the honorable thing and resign.” In terms of actual policy, a new draft National Defense Strategy calls for prioritizing defense of the “homeland,” over potential foreign threats, such as from China, per POLITICO. The administration followed up this declaration with a dystopian deployment in Chicago, where federal agents rappelled down from helicopters to raid a South Side apartment building, arresting Venezuelan migrants and Black American citizens alike. In a statement given to ABC7 Chicago, one man detained by feds stated “They had the Black people in one van, and the immigrants in another.” Illinois Governor J.B. Pritzker decried the presence of “jackbooted thugs roaming around a peaceful downtown,” and demanded federal troops “Get out of Chicago...You are not helping us,” per the New York Times.* Speaking of conflicts abroad, this week Trump unveiled his proposal for a peace deal in Gaza. According to CNN, “The plan calls for Israel to release 250 Palestinian prisoners with life sentences, as well as 1,700 Palestinians detained since the start of the war, in exchange for Hamas freeing 48 hostages.” Once these exchanges have been completed, Israel is to gradually withdraw from Gaza and turn over administration of the enclave to a “Board of Peace,” which will include Trump himself along with former British Prime Minister Tony Blair, in a bizarre historical echo of the British mandatory rule over Palestine. If this process proceeds, it will supposedly create “a path for a just peace on the basis of a two-state solution.” The odds of success however are slim.* In more Gaza news, the Global Sumud Flotilla has been intercepted off the coast of Gaza and Israel has detained the activists on board. Video evidence shows the IDF detaining activist Greta Thunberg specifically. According to Congresswoman Rashida Tlaib, “The Israeli government has illegally abducted over 450 participants of the Global Sumud Flotilla, including nearly two dozen U.S. citizens…We must demand their immediate release and their protection from abuse and torture in Israeli detention. End the siege and genocide of Gaza now.” According to the Flotilla organizers, one of the ships – the Mikeno – got as close as 9.3 miles from the coast, within Gaza's territorial waters, before they lost its signal. While disappointing, given that this is the largest aid flotilla to Gaza in history and came so close to the shore, it seems that at least the flotilla gave fishermen in Gaza the opportunity to go out on the water without interference from the Israeli navy – a crack in the all-encompassing blockade.* Meanwhile, Fox News reports that Israeli intelligence hijacked all cellphones in Gaza in order to forcibly broadcast Prime Minister Netanyahu's United Nations General Assembly speech last week, in which he accused the leaders of western nations who recently recognized the state of Palestine – France, Australia, and the U.K. among others – of being “Leaders who appease evil rather than support a nation whose brave soldiers guard you from the barbarians at the gate,” adding, “They're already penetrating your gates. When will you learn?” Netanyahu's speech was also blasted into Gaza via loudspeakers on the Israeli side of the border. The families of the hostages still held in Gaza released a statement decrying this provocative action, writing “We know from our children…that the loudspeakers were placed inside Gaza. This action endangers their lives, all for the sake of a so-called public diplomacy campaign to preserve [Netanyahu's] rule…He is doing PR at the expense of our children's lives and security. Today we lost the last shred of trust we had in the political echelon and in the army leaders who approved this scandalous operation.”* In Latin America, Trump is planning to bailout Argentina, which has suffered tremendous economic shocks under the stewardship of radical Libertarian President Javier Milei. According to Newsweek, Treasury Secretary Scott Bessent has offered Argentina a, “$20 billion swap line and other forms of assistance to help stabilize the Argentine peso, and said the U.S. remained ‘prepared to do what is necessary' to sustain the ‘important strides' taken by Milei.” This kind of ideologically driven foreign assistance flies in the face of Trump's supposed “America First” policies, but beyond that it has infuriated domestic interests, especially in the agricultural sector. American Soybean Association President Caleb Ragland posted a statement reading, “The frustration is overwhelming…U.S. soybean prices are falling, harvest is underway, and farmers read headlines not about securing a trade agreement with China, but that the U.S. is extending…economic support to Argentina.” This is a particular twist of the knife because following Trump's offer, Argentina lowered export restrictions and sent “20 shiploads of Argentine soybeans to China in just two days.” Republicans representing agricultural interests share this fury. Iowa Senator Chuck Grassley wrote “Why would [America] help bail out Argentina while they take American soybean producers' biggest market???...We should use leverage at every turn to help [the] hurting farm economy. Family farmers should be top of mind in negotiations by representatives of [the] USA.” North Dakota Representative Julie Fedorchak added “This is a bitter pill for North Dakota soybean farmers to swallow.”* Moving on from foreign affairs, this week saw the release of a new batch of Epstein files, demanded by Democrats on the House Oversight Committee and turned over by the Jeffrey Epstein Estate. These files include “phone message logs, copies of flight logs and manifests for aircraft,” along with “copies of financial ledgers and Epstein's daily schedule.” These new releases implicate many big names, including Elon Musk, Peter Thiel, Steve Bannon, and well-documented Epstein associate, Prince Andrew of the British royal family, per the BBC. The release of these files is the latest victory in the campaign to expose everyone involved with Epstein's underage sex ring, a campaign Republicans in government – led by President Trump – have resisted. According to the Hill, Speaker Mike Johnson is refusing to allow the swearing-in of Adelita Grijalva, who was elected last week in a special election to fill the seat vacated by her father's death. In this move, many see an attempt by Speaker Johnson to stave off the discharge petition to release the Epstein files. Grijalva has already committed to signing the petition.* In the wake of the Charlie Kirk assassination, Republicans have hammered the left for what they see as violent rhetoric, with the White House going so far as to classify certain ideas – among them anti-fascism, anti-capitalism and “extremism on migration, race, and gender” – as potentially punishable under domestic terrorism laws. Meanwhile, however, the Arizona Mirror reports a Republican lawmaker in the state has called for the Washington Democratic Congresswoman Pramila Jayapal to be “tried convicted and hanged.” The lawmaker, state Representative John Gillette, was responding to a video in which Jayapal counseled protestors on “non-violent resistance” to Trump's policies. Gillette on the other hand has vocally supported the January 6th insurrectionaries, labeling them “political prisoners” and calling for their release. Asked for comment, Gillette said “The comment is what it is.” For her part, Congresswoman Jayapal has called for “All political leaders, of all parties, [to] denounce” these comments.* Turning to local news, incumbent New York City Mayor Eric Adams has dropped his bid for reelection, Reuters reports. Adams has been mired in scandal of all kinds, including a federal indictment for bribery. Speculation abounds as to why he chose to suspend his campaign now. It is too late to take his name off of the ballot and he declined to endorse any other candidate, making it unlikely that he did so to bolster the chances of disgraced former Governor Andrew Cuomo, who is still continuing his independent bid for the mayoralty despite lagging behind Democratic nominee Zohran Mamdani by a substantial margin. On the other hand, Adams has previously been offered incentives by President Trump to drop out of the race, including potential protection from prosecution and an ambassadorial post in Saudi Arabia. Curtis Sliwa, the Republican nominee, claims “Seven different people,” have offered him a “total of $10 million,” to withdraw from the race, but he adamantly refuses to do so, saying “you can't bribe me, buy me, lease me, I'm not for sale.” This from the New York Post.* Next, on September 25th, Black liberation activist Assata Shakur passed away at the age of 78, per Democracy Now!. Shakur had been convicted of killing a New Jersey state trooper in 1973, though serious doubts remain about her role in the death. She escaped from prison in 1979 and fled to Cuba, where she received asylum in 1984 and continued to maintain her innocence until her death. In 1998, Pope John Paul II visited Cuba and faced calls to demand Assata's extradition to the United States to “face justice” for the murder. In a highly-publicized letter, Assata wrote “The New Jersey State Police and other law enforcement officials say they want to see me brought to ‘justice.' But I would like to know what they mean by ‘justice.' Is torture justice?... When my people receive justice, I am sure that I will receive it, too.” Rest in power, Assata.* Our final story comes to us from, where else, but Hollywood. Variety reports, AI production studio Particle6 has created an AI “actress” who is “named” Tilly Norwood and thereby created a firestorm within the entertainment industry. Tilly's creator, Eline Van der Velden argues that she sees, “AI not as a replacement for people, but as a new tool…Just as animation, puppetry, or CGI opened fresh possibilities without taking away from live acting…nothing – certainly not an AI character – can take away the craft or joy of human performance.” However, SAG-AFTRA – the union representing screen actors – has issued a blistering statement, writing “To be clear, ‘Tilly Norwood' is not an actor, it's a character generated by a computer program that was trained on the work of countless professional performers — without permission or compensation…It has no life experience to draw from, no emotion and, from what we've seen, audiences aren't interested in watching computer-generated content untethered from the human experience.” The statement continues, “It doesn't solve any ‘problem' — it creates the problem of using stolen performances to put actors out of work, jeopardizing performer livelihoods and devaluing human artistry.” This episode is simply the latest clash within the entertainment industry between workers and the rising tide of AI. Her mother, Sue Quackenbush, knew something was wrong when Danielle stopped answering her texts and calls. Sue reported her daughter missing to the New Jersey State Police. Investigators scoured the forest in southern New Jersey and eventually located Danielle's car on Lost Lane, but found no sign of her. The case remains open and active. Dateline's Josh Mankiewicz speaks with Danielle's mother, a New Jersey private investigator who is working the case, and Monica Caison and Lisa Valentino from the Cue Center for Missing Persons. Danielle Lopez is 5'4”, and at the time of her disappearance weighed 135 lbs. She has brown hair, and green eyes. Danielle would be 38 years old today. CUE is offering a $5,000 reward for information that leads investigators to Danielle. The reward is in effect until July 31, 2025. You learned about his rise in the boxing world at a young age, his battle with Polio that tragically ended his career too soon, and Joe's eventual rise within the mafia. For a while, things were looking good for Joe, but by April of 1971, a mafia turf war was raging. Several of Joe's associates, including his partner, had been murdered. Joe was warned that he was next. He was a marked man.In the weeks leading up to his disappearance, Joe had a tense encounter at his doorstep. FBI agents, along with his older brother, Dennis, an investigator for the New Jersey State Police, offered Joe a way out: become an informant and receive protection. But Joe refused. He wasn't a rat.Not long after, Joe hosted a going-away dinner for one of his higher-ups. This event was supposed to mark a new chapter for him. But before the party even started, Joe stepped out for what he claimed was a quick errand, and he never returned. His wife, Cynthia, arrived at the party only to find her husband missing. Daniel King, a 30-year-old man from Millville, New Jersey, died in the custody of New Jersey State Police troopers on July 9, 2023. Troopers responded to a 911 call from King himself at his residence, and upon arrival King told the trooper he wanted to remove some property from his home. Trooper Mark Allonardo seemed to be mediating a civil dispute before the situation became strange and escalated. King eventually bit Allonardo into the face, drawing blood and nearby civilians jumped into the fight to help the trooper. King was transported to a station where he later suffered a medical emergency which led to his death, and the case was eventually brought before a grand jury. Did the trooper act improperly? Now, according to a New York Times report, the federal Justice Department is looking into allegations of gender bias and racial discrimination among the New Jersey State Police. Tragically, guns were fired, people were killed, and in the aftermath, a political standoff between Shakur and state law enforcement began.  On the fiftieth anniversary marking the incident, WNYC reporters Nancy Solomon and Tracie Hunte share their reporting with host Kai Wright. Bush and former NYPD and U.S. Customs Commissioner Ray Kelly whose views and legacy on racial profiling are tough to suss out. You'll learn about cops who defended racial profiling, such as Steve Young, Gary McLhinney, and Bernard Parks.
