2022.     Sir Paul McCartney was recovering from the passing of Linda, preparing for a tour backing his "Driving Rain" album, and celebrating fifty years of Queen Elizabeth II.     The BBC gathered together a number of interesting and important figures (including Astrid Kirchherr, Jurgen Vollmer, Arthur Kelly and Kermit the Frog?)  in advance of his appearance at the Jubilee (and a little thing at Castle Leslie in Glaslough, Ireland).     Lonnie and I look back and discuss the documentary and how well it tells (at least some of) Paul's story.

Hi! This week Andy and Tom are very pleased to have Super Fan "Dino V" join us for a chat about the November 2001 release of Driving Rain. It's an album that gets a lot of chat on McCartney fan pages/sites - mostly negative. We contextualise the time period from whence it came. Discuss reasons why it gets the bad rap it has received 23 years on since it's release. 'Freedom', 9/11, The Heather factor. Too long of a record. All these points and more are discussed! It was an album that we (Andy & Tom) were majorly excited for in 2001 when it came out. But it hasn't aged well with later day epics such as Chaos and Creation In The Backyard, Memory Almost Full, Electric Arguments and New. Dino also gives us a background into his super Macca fandom. (He's truly hardcore! Having met Paul & Linda on several occasions). Having chats like this are good because it does give us a reason to go back and listen and see if our opinions have changed with time or have stayed the same. Thoughts on Driving Rain? All albums standard/covers were fair game. The albums we pulled from were Driving Rain (2001), Chaos and Creation in the Backyard (2005), Memory Almost Full (2007), Electric Arguments (2008), Kisses On The Bottom (2012), NEW (2013), Egypt Station (2018) and lastly McCartney III (2020). TRANSCRIPT OF AUDIO From the Cumberland Gap to the Atlantic Ocean, this is Virginia Water Radio for the weeks of June 26 and July 3, 2023. MUSIC – ~8 sec –lyrics: “Ah reflections in the window pane, fallin' in love, in the drivin' rain.” That's part of “Driving Rain,” by the Charlottesville- and Nelson County, Va.-based band, Chamomile and Whiskey.  The song's a love story, but its title and main phrase lead in to a legal water story—that is, how does rain, and any other water on the landscape, become water covered by the federal Clean Water Act, specifically by the Act's phrase, the “waters of the United States?”  On May 25, 2023, the U.S. Supreme Court wrote a new chapter in this story. Passed in 1972, the Clean Water Act's main goal is “to restore and maintain the chemical, physical, and biological integrity of the Nation's waters.”  The Act states that it applies to “navigable waters,” defined as “waters of the United States, including the territorial seas,” and amendments in 1977 added wetlands that are adjacent to other covered waters.  All waters covered by the Act are known as “jurisdictional waters,” and any discharges into such waters require a federal permit.  Defining what waters—particularly what wetlands and small tributaries—are jurisdictional has enormous impact on the Act's environmental and economic reach. Many questions and legal challenges have been raised over the meaning of “waters of the United States,” its relation to the term “navigable waters,” and the Act's implementation by the U.S. EPA and the Army Corps of Engineers.  The Supreme Court has a long history of decisions on these questions.  Here are short accounts of five important Court decisions, including the most recent one, affecting the Act's jurisdiction. 1.  The 1870 Daniel Ball decision held that “navigable waters of the United States” are those that support commerce between states or with foreign countries.  Later Supreme Court cases expanded that test to include waters that formerly supported, or could support, such commerce. 2.  The 1985 Riverside Bayview decision affirmed that the Act covered wetlands adjacent to other “waters of the United States.” 3.  The 2001 SWANCC decision held that the Act did not cover wetlands solely on the basis of their use by migratory birds. 4.  In the complicated 2006 Rapanos decision, a plurality opinion by Justice Antonin Scalia held that the Act covers only relatively permanent water bodies that form recognizable geographical features, plus wetlands only if they have a “continuous surface connection” to other covered waters.  Justice Anthony Kennedy's concurring opinion held that wetlands were covered if they have a quote, “significant nexus,” unquote, to conditions in other covered waters. And 5.  The 2023 Sackett decision returned to the Scalia opinion of 2006, while dismissing Justice Kennedy's “significant nexus” test.  So the Court now holds that the Act covers only, quote, “relatively permanent, standing or continuously flowing water bodies, forming geographical features…described in ordinary parlance as streams, oceans, rivers, and lakes,” unquote;  plus wetlands with a “continuous surface connection” to such water bodies.  This removes many previously regulated wetlands from the Act's jurisdiction.  While the Sackett decision focused particularly on wetlands, the new test articulated in the decision may have impacts as well for small streams that do not flow year-round. Through amendments, executive orders, agency actions, and litigation, defining the reach of the Clean Water Act has been a long, meandering story.  It's probably safe to say that more turns await. C. §1362(7).  The EPA ordered the Sacketts to restore the site, threatening penalties of over $40,000 per day.  The EPA classified the wetlands on the Sacketts' lot as “waters of the United States” because they were near a ditch that fed into a creek, which fed into Priest Lake, a navigable, intrastate lake.  The Sacketts sued, alleging that their property was not “waters of the United States.” The District Court entered summary judgment for the EPA.  The Ninth Circuit affirmed, holding that the CWA covers wetlands with an ecologically significant nexus to traditional navigable waters and that the Sacketts' wetlands satisfy that standard. Held: The CWA's use of “waters” in §1362(7) refers only to “geographic[al] features that are described in ordinary parlance as ‘streams, oceans, rivers, and lakes' ” and to adjacent wetlands that are “indistinguishable” from those bodies of water due to a continuous surface connection.  Rapanos v. Paul McCartneys album fra 2005, "Chaos And Creation In The Backyard", tages i denne udgave af "Toppermost"- formatet, under kærlig behandling af Andreas Smedegaard.   Albummet er blandt manges favoritter og det vandt suverænt afstemningen i "Elsker The Beatles"- Facebook-gruppen, om bedste "Macca"-album efter år 2000.   Historien forud for pladen er fyldt med store følelser, dramatiske hændelser, svære valg, og først og fremmest en stor kunstnerisk ambition fra McCartney.   En ambition der resulterer i et spændende samarbejde med Nigel Godrich. En ung succesfuld producer der var parat til at stille krav til Paul.  En disciplin mange er kommet galt afsted med gennem tiden.   I første del diskuterer vi forhistorien og vender undervejs:   * Paul efter Lindas død * De mange udgivelser i kølvandet på denne * Udgivelsen af Driving Rain albummet * Heather Mills... * Geoff Baker * De succesfulde verdensturneer * Nigel Godrich og hans karriere. [Editor's note, not in the audio: Pre-June named Atlantic storms in the previous seven years were Ana in 2015, Alex in January 2016 and Bonnie in May 2016, Arlene in April 2017, Alberto in May 2018, Andrea in May 2019, Arthur and Bertha in May 2020, and Ana in May 2021.  The first named storm in 2014 was in July.  The National Hurricane Center upgraded Potential Tropical Cyclone One to Tropical Storm Alex around 2 a.m. EDT on June 5, 2022.]Tropical storms and hurricanes are two categories of tropical cyclones, which are rotating storm systems that start in tropical or sub-tropical latitudes.  A tropical cyclone is called a tropical storm—and gets a name—when sustained wind speeds reach 39 miles per hour; at 74 miles per hour, a tropical cyclone is considered a hurricane.  Tropical depressions—with wind speeds below 39 miles per hour—don't get named if they never reach tropical storm wind speed,* but they can still bring damaging rainfall and flooding.  Hurricane-force storms are called typhoonsin northwestern areas of the Pacific Ocean. [Editor's note, not in the audio: A tropical system that never gets above the tropical depression wind-speed level won't be given a name, but a lingering tropical depression that previously was at the wind speed of a tropical storm or hurricane will have a name associated with it.]Before a tropical system of any speed or name barges into the Old Dominion, here are five important preparedness steps recommended by the National Weather Service.1.  Know your zone – that is, find out if you live in a hurricane evacuation area by checking the Virginia Department of Emergency Management's “Hurricane Zone Evacuation Tool,” available online at  vaemergency.gov/prepare, or by contacting your local emergency management office. 2.  Assemble an emergency kit of food, water, flashlights, first aid materials, a battery-powered radio, and other items that would be useful in a power outage.3.  Have a family emergency plan, including plans for evacuating and for getting in touch with one another in an emergency. 4.  Review your insurance policies to ensure that you have adequate coverage for your home and personal property. And 5.  Establish ways to stay informed, especially if the power goes out. Walk carefully around the outside of your home to check for loose power lines, gas leaks, and structural damage. Stay out of any building if you smell gas, if floodwaters remain around the building, if the building or home was damaged by fire, or if the authorities have not declared it safe. Carbon monoxide poisoning is one of the leading causes of death after storms in areas dealing with power outages.  Never use a portable generator inside your home or garage. Use battery-powered flashlights.  Do NOT use candles.  Turn on your flashlight before entering a vacated building.  The battery could produce a spark that could ignite leaking gas, if present.”

For this first week of 2022, we listen in on one Virginian's annual New Year's challenge to the laws of physics and chemistry—water-temperature physics and chemistry, that is.  Have a listen for about 35 seconds. SOUNDS AND VOICE - ~35 sec – “It's the New Year, on the shore of the New River. It's 22 degrees and perfect time for a swim. Happy New Year, everyone! Happy New Year! [Series of exclamations about the cold.] Ah, welcome to Antarctica.” You've been listening to Blacksburg resident Alan Moore during the 2014 version of his annual New Year's Day wade into the New River.  The watery welcome to that January 1st—unaided by a wet-suit—lasted only a few seconds, not as much because of the 22-degree air temperature as because of the 39-degree water temperature.  Water that cold can cause exhaustion or unconsciousness within 15 to 30 minutes, and even water at 60 or 70 degrees can be dangerously chilling over one to two hours, depending on a person's body size and other factors. Water's capacity to chill a human body is much greater than that of air at the same temperature, for two reasons.  First, liquids generally conduct heat more rapidly than gases, because liquids are denser (that is, the molecules are closer together).  And second, liquid water has chemical attractions between molecules that can absorb high amounts of energy, such as heat energy coming from a person's body.  These and other interactions among water, heat, and temperature are part of water's thermodynamics, and they exert a big influence on weather, aquatic environments, biology, and taking a plunge on New Year's or any other day. EXTRA INFORMATION ABOUT COLD WATER SAFETY The following is quoted from the National Weather Service, “Cold Water Hazards and Safety,” online at https://www.weather.gov/safety/coldwater. “Warm air doesn't always mean warm water in lakes, streams or oceans.  Fifty-five degree water may not sound very cold, but it can be deadly.  Plunging into cold water of any temperature becomes dangerous if you aren't prepared for what the sudden exposure can do to your body and brain.  Warm air temperatures can create a false sense of security for boaters and beach goers, so if you are planning to be on or near the water, arrive knowing the conditions and how to protect yourself.  Cold water drains body heat up to 4 times faster than cold air.  When your body hits cold water, “cold shock” can cause dramatic changes in breathing, heart rate and blood pressure.  The sudden gasp and rapid breathing alone creates a greater risk of drowning even for confident swimmers in calm waters. VOICES - ~51 sec – Excerpts from March 20, 2017, recording at Virginia Tech. “You’ve already paid with a credit card for two samples?”“That’s exactly right, yep.” …“All the instructions are on there.  Have you participated before?”“No.”“Ok…so the sample instructions are in there…There’s a survey you’ll want to fill out, as well.  The big thing is -- one of the big things is -- to let the water sit in the pipes overnight, [from say] 10 o’clock…And then the first thing in the morning, [at] the tap you’re going to collect from, collect that bottle with the X first, and then you can collect the other bottles in whatever order you want to.  OK?” …“If we have questions, is there somewhere to send them to by chance?”“There’s a link on the Web site that’s in there….”“Ok.” …“Have you participated with us before?”“I have.  And if there’s basic instructions in there, I’m good to go with those.” …“And the drop-off’s Wednesday morning.”“Good deal.”“All right?”“Thank you.”“Thank you, and you all have a good one.”“Thank you.” You’ve been listening to citizen participants and Virginia Tech faculty at a Virginia Household Water Quality Program clinic kick-offin Montgomery County on March 20, 2017.  The program offers drinking-water clinics in which people who rely on private wells, springs, or cisterns can get their water tested inexpensively and receive a report interpreting the results.  Citizens pick up a sampling kit and instructions, collect water from a household faucet (or in some cases, directly from a spring or other water source), and return the samples two days later.  Tech laboratories analyze the samples for bacteria, lead, arsenic, nitrate, iron, sulfate, and several other constituents.  After about four weeks, program faculty hold a meeting to give participants their confidential results, offer interpretation of the analyses, and provide other information on managing water systems.  The clinics in 2021 began in February and run into late November, serving over 60 Virginia localities.  In operation since 1989, the program has covered the Commonwealth several times, with the results providing valuable information to specific homeowners and offering broader snapshots of groundwater conditions within localities. In a companion program—the Virginia Well Owner Network—trained Virginia Cooperative Extension agents assist Virginians with water-well questions and problems.  Both programs are administered by Virginia Tech’s Department of Biological Systems Engineering, through Cooperative Extension. Driving Rain sparked the beginning of the later day renaissance period for Paul which continues to this very day. This week's installment features an interview with Musician and pianist, Gabe Dixon. Gabe played keyboards, organ and backing vocals on "Driving Rain." Gabe tells Tom and Andy a bit of his roots in Nashville, his early influences, first musical experiences, and finally connecting with Paul McCartney and Producer David Kahne. Gabe also has been a very prolific musician pre and post his Paul experiences. He has toured with Loggins and Messina/Supertramp and is the founder of the Gabe Dixon Band. He has two albums out currently "One Spark" and "Turns To Gold". SOUND – ~4 sec This week, a Mallard duck’s quacking that somewhat resembles human laughter opens an episode that I hope will bring some actual human chuckles.  As the extraordinarily difficult year 2020 winds down, it seemed worthwhile to devote an episode to a bit of water-related comic relief—that is, water jokes!  So here are nine selected from a collection by David Ladner’s environmental engineering research group at Clemson University; some have been modified slightly by Virginia Water Radio. 1.  The other day I opened my water bill and my electricity bill at the same time.  I was shocked! 2.  Why do sharks swim in salt water?  Because pepper makes them sneeze. 3.  What do you get when you cross a rabbit with a water hose?  Hare spray. 4.  What kind of bear enjoys hanging out in light rain?  A drizzly bear. 5.  What did one ocean say to the other ocean?  Nothing, it just waved. 6.  Thirty people are sheltering under an umbrella.  How many of them get wet?  None; who said it was raining? 7.  What do you call water that’s healthy for you?  Well water. 8.  Would you like to hear a solid water joke?  That would be ice. And 9.  Did you hear that the ocean and the beach had fraternal twins?  Yep, one was a buoy or the other was a gull. Even with this year’s public health and economic challenges, I hope your world has some humor, aquatic or otherwise. MUSIC – ~ 5 sec – Instrumental That excerpt of “Driving Rain,” by the Nelson County, Va., band Chamomile and Whiskey, opens an episode about something rain affects: that is, animals getting water.  Many animals, of course, get water simply by drinking from rivers, lakes, puddles, and other water sources.  But animals have several other ways to get water.  In this episode, I’ll play five kinds of animal mystery sounds, each for a few seconds.  After each sound, I’ll identify the animals and tell you something about how they get water. SOUND - ~ 6 sec - Whale That was the sound of a whale spouting water as it surfaced.  Whales and other sea mammals get most of their water from their food, including the water produced when food is digested, which is known as metabolic water.  All animals get some of their water through that process. SOUND - ~ 5 sec – Rattlesnake That was a rattlesnake rattle.  Snakes drink water, including water that collects on their skin, and rattlesnakes in desert areas have special skin structures that allow them to capture rainwater. SOUND - ~ 7 sec – Gray Catbird That was a [Gray] Catbird with a series of calls mimicking other birds.  Birds get water from food, including metabolic water, and from drinking in various ways, including pelicans opening their beaks to capture rainwater and small birds drinking from dew drops.  Some birds are able to use salt water as a water source. SOUND - ~ 6 sec – Frogs and toad (Spring Peeper, American Toad, Gray Tree Frog) Those were the calls of three kinds of frog or toad.  Frogs, toads, and other amphibians can absorb water through their skin. The one unfaced fear that Dan and Janice have had in 53 days on the road was faced today: Towing the trailer in the rain. Just about 90 minutes before they had to leave the Black Hills for the Badlands, the rain started and it didn't let up. Dan got wet hitching up, Janice truckered up, and off they went (after a quick picnic at the dump station that is). It was miserable work, but they made it to the Badlands and they learned they could do the one thing they hadn't yet had to do. Get wet with The Hitch.

About this episode: Today’s guest is a Nashville-native and one of the most talented piano musicians of our time. Songwriter/artist Gabe Dixon, began playing music at age 7, with exposure to household names like Elton John, The Allman Brothers and Paul Simon. Natural talent and interest in music, led him to pursue a career writing songs and performing alongside names like: Gavin DeGraw, Alison Krauss and Union Station, OAR, Supertramp and many others. NWP welcomes lead guitarist to Sir Paul McCartney, Rusty Anderson!  I talk with Rusty just days before he heads to Japan with Paul McCartney on their world tour. In 2001, Anderson, got a call from producers Mo Jackson and David Kahne to play and sing on Sir Paul McCartney's record Driving Rain; this became the birth of the Paul McCartney Band. After finishing the record and performing at The Concert for New York City, the band went on the road for a critically acclaimed tour, playing well over 100 shows in the US, Japan, Mexico and Europe, including those at the Roman Colosseum, Live 8 UK and Red Square in Moscow. Following the success of this tour four DVDs were released, all featuring Anderson on guitar: Back in the U.S., Back in the World, Paul McCartney in Red Square and The Space Within US. In addition to Anderson's solo songwriting career, he has written with and produced acts such as Chris Shaffer of The Why Store, Jordan Lawhead and Emma Burgess, resulting in song uses in TV shows Cold Case, Men In Trees, Kyle XY and Wildfire.

THE GABE DIXON BAND was formed with Dixon - then a classical piano major at the University of Miami - and his two college roommates, bassist Winston Harrison and drummer Jano Rix.Gabe played keyboards on Paul McCartney�s CD, Driving Rain. CAROLINE HERRING digs deep into the rich soil of American music for her sound on her new CD Lantana. Her album cements her status as a story teller. The subject matter on the album is deeply rooted in the rural south.
