A MIRACULOUS healing led to a Syrian warrior carrying mule loads of dirt from Israel back to Damascus. Why did Naaman the Syrian do that? In the ancient world, it was understood that every nation had a patron deity. For Syria, that was the storm-god Hadad, better known to us as Baal. For Israel, it was Yahweh—although Jezebel and her children tried hard to replace the God of Abraham, Isaac, and Jacob with Baal, Astarte, and the rest of the Canaanite pantheon. When the prophet Elisha instructed Naaman to wash in the Jordan to be healed of his leprosy, Naaman was angry, expecting something more elaborate—a ritual of some kind. But after following the prophet's instructions and being restored to full health, Naaman realized the true God was Yahweh, not Baal, and Israel was His home. So, Naaman loaded two mules with dirt and carried it back to Syria—not because it held magical properties, but because it was a reminder of the one God with the power to heal. The concept of “holy ground” was established after the Tower of Babel, as described in Deuteronomy 32: When the Most High gave to the nations their inheritance, when he divided mankind, he fixed the borders of the peoples according to the number of the sons of God.But the LORD's portion is his people, Jacob his allotted heritage. (Deut. 32:8–9, ESV) In other words, God allotted the people of Earth to angelic representatives who were tempted into receiving worship themselves, but He chose Israel as the conduit through which He would bring forth the Messiah to save the world from those fallen entities. We also discuss the way God delivered the northern kingdom of Israel from a prolonged siege of Samaria by the Syrians—despite the continued apostasy of Samaria. THE DEATH of Charlie Kirk Wednesday shocked the world. It was the most high-profile assassination in recent American history. The founder of Turning Point USA was in the middle of an event at Utah Valley University when his life was cut short, allegedly by a shot fired by 22-year-old Tyler Robinson. The response on social media has ranged from grief and anger by those who admired and respected Charlie, and outright joy and celebration by those who interpreted his overtly Christian message as hateful and dangerous. That's the key to understanding what is otherwise a senseless event. Jesus warned us in the last days, “They will deliver you up to tribulation and put you to death, and you will be hated by all nations for my name's sake” (Matt. 24:9, ESV). THE KING of Moab sacrificed his oldest son on the wall of his capital city, causing the combined armies of Israel, Judah, and Edom to withdraw from their siege. How do we process this? Then he (King Mesha) took his oldest son who was to reign in his place and offered him for a burnt offering on the wall. And there came great wrath on Israel. And they withdrew from him and returned to their own land. (2 Kings 3:27, ESV) On the surface, it appears the king of Moab's sacrifice was successful. But that's not how we read it. The wrath against Israel was God's anger that they didn't trust in His promise, through the prophet Elisha, to deliver Moab into the hands of kings Jehoram of Israel and Jehoshaphat of Judah. God does not honor or condone human sacrifice. We also discuss the miracles of the widow's oil, the son of the Shunammite woman, whose birth was no less a miracle than Elisha raising him from the dead, and Elisha's purification of the poisoned stew. A GROUP called the International Association of Genocide Scholars issued a statement this week declaring that Israel's war against Hamas met the criteria for genocide. Not so fast! The mainstream media not surprisingly ran with the story, but only the Washington Free Beacon did actual journalism, asking some obvious questions: Who are these people? How does one become a “genocide scholar”? How many people voted on the resolution to declare Israel guilty of genocide? It turns out there are about 600 members in the IAGS, and the only requirement to become a “genocide scholar” is paying a $125 fee. Passing a resolution to declare a genocide only requires a 20% quorum, meaning only 120 members have to vote. In this case, 129 dues-paying members of the IAGS cast ballots on the resolution, which based its findings on statistics provided by Hamas, and that was enough to convince the legacy media like AP, Reuters, Washington Post, and New York Times that Israel is committing genocide. It's a propaganda war, and Israel is losing. Also: Tucker Carlson thinks Hamas is a political organization; free speech is dead in the UK; President Trump was an FBI informant in the Jeffrey Epstein case (!); and the next blood moon. JERUSALEM IS the center of the world in the Book of 1 Enoch. That echoes Ezekiel 5:5 and 38:12, where Jerusalem is “the center [literally, “navel”] of the earth.” This is a concept probably best known from Greek religion, where the oracle of Delphi was at the site of the omphalos, the stone that was supposedly substituted for Zeus by his mother Rhea because Kronos was eating their children as soon as they were born. The omphalos represented the connection between Earth and Heaven—in other words, it was the center (or navel) of the world. Ezekiel, whose prophecies were well known to the authors of 1 Enoch, wrote that it was the city God desired for His eternal dwelling place (Psalm 132:13–14) that was the true center of all things. The description of Jerusalem in 1 Enoch chapters 26 and 27 also includes a description of a “cursed valley,” which is a reference to the Valley of Hinnom, where children were sacrificed to Molech at the Tophet. Although we didn't make it explicit in our discussion, this is the origin of the idea that equates the place of eternal punishment with Gehenna (Hebrew ge = “valley”; henna = “Hinnom”), found in Matthew 5:22, 29, and 30 (sometimes rendered “hell”). Enoch was also taken to the mountain of God where he was shown the Tree of Life and the Tree of the Knowledge of Good and Evil. The mountain of God is in the midst of “seven glorious mountains,” a sharp contrast to seven burning mountains described in 1 Enoch 18:13–16 and 21:3–6, which were angels being punished for transgressions. Finally, Enoch is transported to places that seem to be Petra and Arabia—interesting, since the only other locations that can be positively identified in 1 Enoch are Jerusalem and the areas around Mount Hermon. WHAT DO YOU GET when you cross a tech billionaire with the gospel? Peter Thiel, co-founder of PayPal and Palantir, a company with multiple contracts with the U.S. government, will deliver a series of four lectures on the Antichrist in September and October. He recently gave an interview with Ross Douthat of The New York Times on the Antichrist. Why does a tech entrepreneur feel the need to expound at length on the great end times enemy of God and man? And why is he doing it off the record? Thiel's lectures are presented by the ACTS 17 Collective, a non-profit started by Michelle Stephens, wife of one of Thiel's partners, Trae Stephens, co-founder of Anduril. “Acts 17” is a reference to Paul's address to the people of Athens at Mars Hill (Acts 17:16–34). The group's stated mission is bring Jesus to Silicon Valley—a place where, until recently, it was a career-killer to openly express your faith in Christ. The irony is that through his investments in companies like Palantir and Anduril, both of which supply software and hardware to the United States government, including the military and Department of Homeland Security, Thiel is building the surveillance infrastructure needed to create the global government that will one day be ruled by the Antichrist. A group of settler activists, including young children, crossed the border into Syria on Monday in an attempt to establish a new settlement in land currently held by the Israel Defense Forces. The military said troops were dispatched to the scene, across from the border town of Alonei Habashan, after several civilian vehicles were seen crossing into Syria. Fabian fills us in. Last night, Prime Minister Benjamin Netanyahu’s government voted to approve a NIS 31 billion ($9 billion) increase to the 2025 state budget — NIS 1.6 billion ($473 million) of which will go toward humanitarian aid for Gaza. The money earmarked for humanitarian aid has angered some members of Netanyahu’s cabinet as well as opposition figures like Yisrael Beytenu chairman Avigdor Liberman. Will the Knesset ratify these additions? Ultra-Orthodox leaders have called for an international day of prayer and fasting on Thursday in response to recent government efforts to conscript ultra-Orthodox yeshiva students and arrest those who ignore government orders to enlist. Cette réglementation vise à protéger les entités critiques européennes dans un contexte d'augmentation des cyberattaques et d'omniprésence des systèmes d'information. Contrairement au RGPD qui a des applications extraterritoriales, NIS 2 se concentre principalement sur le territoire européen, mais suivra un modèle de transposition similaire dans chaque pays membre. Objectifs et philosophie de NIS 2 L'objectif principal n'est pas d'atteindre une sécurité absolue, mais d'améliorer la résilience et la capacité de réaction aux incidents. La directive vise à “effacer le bruit ambiant” et empêcher les attaques opportunistes, particulièrement les ransomwares facilement déployables. Il s'agit d'établir une hygiène de base en cybersécurité plutôt que de se prémunir contre des attaques étatiques sophistiquées. La directive prône une approche par les risques, reconnaissant que les 18 secteurs d'activité couverts ont des profils de risque variables. L'Europe souhaite également créer un écosystème résilient global, incluant le partage des menaces et vulnérabilités, ainsi que la mise en place du UVD (pendant européen des bases CVE) par l'agence ENISA. Périmètre d'application considérablement élargi NIS 2 couvre 18 secteurs d'activité, répartis entre entités essentielles et entités importantes. Les entités essentielles incluent l'énergie, le transport, l'eau potable (déjà dans NIS 1), auxquels s'ajoutent les eaux usées, la santé, l'espace et les administrations publiques. Le secteur bancaire bénéficie d'un traitement spécial avec le référentiel DORA. Les entités importantes comprennent les services postaux, la gestion des déchets, et la fabrication alimentaire. L'impact est considérable : en France, on passe de 300 entités concernées par NIS 1 à potentiellement 15 000 avec NIS 2, avec des seuils démarrant à 50 employés. Effet de cascade et impact sur les tiers Une différence majeure avec le RGPD réside dans l'effet de cascade sur les fournisseurs et prestataires. Les exigences incluent : Inventaire des actifs (retour aux fondamentaux) Gestion des ressources humaines (approche transverse) Gestion des tiers et prestataires Gestion des incidents avec critères précis de déclaration Supervision et revues régulières La directive fixe des critères quantitatifs précis pour les incidents, éliminant l'interprétation subjective. Contrairement à NIS 1 qui ne réglementait que les systèmes critiques, NIS 2 s'applique à l'ensemble du système d'information, sauf isolation prouvée des systèmes critiques. Sanctions et modèle de contrôle Les sanctions suivent le modèle RGPD : 10 millions d'euros ou 2% du chiffre d'affaires mondial pour les entités essentielles, 7 millions ou 1,4% pour les entités importantes. Le modèle de contrôle ressemble également au RGPD, avec des autorités nationales (ANSSI en France) effectuant des audits et contrôles, sans certification obligatoire prévue. Défis de transposition et accompagnement La transposition française accuse du retard, adoptée par le Sénat en mars et en cours d'examen à l'Assemblée nationale. Le projet “Résilience” transpose simultanément NIS 2, DORA et CER (Critical Entities Resilience), créant une complexité réglementaire supplémentaire. L'ANSSI privilégie l'accompagnement à la sanction, reconnaissant que de nombreuses entités découvrent la réglementation cyber. Des outils d'auto-évaluation et de suivi sont déjà disponibles pour faciliter la transition. Impact sur les différents types d'organisations Pour les grandes entreprises internationales, déjà familières avec l'ISO 27001, l'adaptation devrait être relativement aisée. La principale préoccupation concerne le “millefeuille réglementaire” et la conformité administrative. Les PME et administrations publiques, notamment les collectivités et hôpitaux, font face à des défis plus importants : manque de personnel spécialisé, budgets contraints, et cybersécurité éloignée du cœur de métier. Des initiatives de mutualisation émergent dans certains secteurs. Perspective et enjeux futurs NIS 2 représente un changement culturel majeur, intégrant la cyberattaque dans la gestion de crise standard. La philosophie du directeur de l'ANSSI résume bien l'approche : “ce n'est pas si vous allez être attaqué, mais quand”. L'objectif est la résilience - continuer à fonctionner malgré l'incident. Cette réglementation s'inscrit dans la volonté européenne d'uniformiser le marché, créant une prévisibilité similaire à celle du marché américain. Bien que la période d'adaptation puisse être inconfortable, elle devrait considérablement renforcer la résilience collective face aux cybermenaces. La réussite de NIS 2 dépendra de sa capacité à éviter la “conformité pour la conformité” et à véritablement améliorer la maturité cybersécuritaire de l'écosystème européen. THE PASSING of the mantle from Elijah to Elisha was spectacular: A fiery chariot pulled by horses of fire in a whirlwind carried Elijah off to heaven. The whirlwind was a theophany, an appearance by God Himself. The chariot, as Sharon noted, was believed to be the vehicle that carried human spirits to the netherworld—but in this case, Elijah was carried off to heaven. We discuss the location of the event, the plains of Moab across from Jericho, and why that has supernatural significance. For one thing, it's where Moses was buried after his death, and it's probably not coincidental that Moses and Elijah are the two who joined Jesus on Mount Hermon, the “Canaanite Olympus,” for the Transfiguration. The place from which Elijah was caught up was below the ruins of Sodom, at the southern end of the Jordan River called the Valley of the Travelers by Ezekiel. “Travelers” was a term used by the Canaanites for the spirits of the Rephaim, which were venerated by the pagan neighbors of the Israelites. It's also the Valley of Siddim, where the armies of Sodom, Gomorrah and their allies fought the kings of Mesopotamia (Genesis 14). Siddim can also be rendered shedim, which is a Hebrew word meaning “demons”--in other words, the Valley of Demons. In other words, God carried off Elijah from a place that had been notorious for demonic activity for about a thousand years by the time of Elijah and Elisha. We also discuss the final days of the son of King Ahab, Ahaziah, who turned to Baal-zebub (“Lord of Flies”) for healing instead of God. Big mistake! PERCEPTION IS REALITY. That's an old saying in advertising, but it's true in life. Sadly, a growing number of us are relying on AI to filter reality for us. If you're on X (formerly Twitter), you've undoubtedly seen somebody post this response to a story: “@Grok, is this true?” Grok is Elon Musk's artificial intelligence that's bundled into X. While we can't point to specific examples of Grok lying about things in the news, it is documented that other AIs such as ChatGPT and Claude have not only lied, threatened its programmers, and hidden its capabilities. And yet we humans are growing more dependent on AI, losing our capacity for critical thinking while trusting in technology that is demonstrably unreliable. This is dangerous enough in, say, a medical setting, where algorithms used for triage can miss red flags that a human performing manual triage would have caught, but it's especially chilling when AI is filtering information we use to make decisions about the world around us. Stattdessen sind erneut lediglich Darlehen vorgesehen. Der GKV-Spitzenverband kritisiert die fehlende Gegenfinanzierung als unzureichend und warnt vor weiterem Beitragsdruck. „Eine Gesundheitsversorgung auf Pump ist kein überzeugendes Zukunftskonzept“, so Vorstand Oliver Blatt. Neuer BVK-Gehaltstarif: 8,5 % mehr Gehalt ab Juli 2025 Der neue Gehaltstarifvertrag für Versicherungsvermittler ist am 1. Juli 2025 in Kraft getreten. Shameless plug 12 au 17 octobre 2025 - Objective by the sea v8 10 au 12 novembre 2025 - IAQ - Le Rendez-vous IA Québec 17 au 20 novembre 2025 - European Cyber Week 25 et 26 février 2026 - SéQCure 2065 Description Dans cet épisode, l'animateur reçoit Simon Du Perron, avocat spécialisé en protection de la vie privée, pour analyser deux projets de loi majeurs du gouvernement : C-2 et C-8. Ces projets législatifs, qualifiés de « massifs », ont des implications significatives sur la protection des renseignements personnels au Canada. Le projet de loi C-2 : un régime de surveillance élargi Le projet de loi C-2, officiellement intitulé « Loi concernant certaines mesures liées à la sécurité de la frontière entre le Canada et les États-Unis et d'autres mesures connexes liées à la sécurité », constitue un projet omnibus de 140 pages modifiant près de 20 lois fédérales. Présenté par le ministre de la sécurité publique, ce projet va bien au-delà des simples enjeux frontaliers. Modifications au code criminel La partie 14 de C-2 modifie le code criminel pour accorder aux agents de la paix des pouvoirs élargis d'accès aux données. Cette modification est particulièrement préoccupante car elle s'applique de manière générale à travers le Canada. Les agents peuvent désormais ordonner aux fournisseurs de services électroniques de divulguer des métadonnées sur leurs utilisateurs sans mandat préalable, incluant l'identifiant du client, ses numéros de compte, le type de service fourni, la période d'utilisation et les informations sur les dispositifs utilisés. Cette approche contraste avec la jurisprudence récente de la Cour suprême, notamment l'affaire Bicovette, qui avait établi qu'un mandat était nécessaire pour obtenir des adresses IP. Le projet C-2 semble vouloir contourner cette protection judiciaire en facilitant l'accès aux données par les forces de l'ordre. Le régime d'accès légal La partie 15 crée un cadre juridique pour l'accès légal (« legal access »), obligeant les fournisseurs de services électroniques à maintenir des capacités techniques permettant aux autorités d'accéder aux informations demandées. Cette obligation va jusqu'à créer un pouvoir ministériel d'ordonner par décrets contraignants la mise en place de mesures spécifiques, avec des sanctions pécuniaires pouvant atteindre 250 000 dollars. La définition de « fournisseur de services électroniques » est particulièrement large, englobant essentiellement tout service permettant de mettre à disposition des informations par un moyen technologique. Paradoxalement, la loi crée une distinction entre les fournisseurs canadiens et étrangers : pour ces derniers, une autorisation judiciaire reste nécessaire, créant une situation où il est plus facile d'accéder aux données d'un fournisseur canadien qu'américain. Autres modifications préoccupantes Le projet modifie également la Loi sur la Société canadienne des postes, réduisant la protection du contenu des transmissions postales en ajoutant une exception « sauf en conformité avec une loi fédérale ». Cette modification pourrait permettre l'application des nouvelles dispositions du code criminel aux services postaux. Une modification à la Loi sur le recyclage des produits de la criminalité permet aux institutions financières de recueillir et utiliser des renseignements personnels sans consentement s'ils proviennent d'une autorité policière, dans le but de lutter contre le blanchiment d'argent et le financement terroriste. Le projet de loi C-8 : renaissance de C-26 Le projet C-8 reprend presque intégralement l'ancien projet C-26, qui n'avait pas pu être adopté lors de la législature précédente en raison d'un problème de traduction. Ce projet vise à sécuriser les systèmes de télécommunications et les infrastructures critiques. Modifications à la loi sur les télécommunications La première partie modifie la Loi sur les télécommunications pour inclure « la promotion de la sécurité du système canadien de télécommunication » dans ses objets. Elle confère au ministre de l'Industrie le pouvoir d'interdire aux télécommunicateurs d'utiliser certains produits ou services, ou d'imposer des mesures de sécurité spécifiques, sans indemnisation en cas de pertes financières. La loi sur la protection des cybersystèmes essentiels La seconde partie crée une nouvelle loi visant les secteurs critiques : télécommunications, pipelines et lignes électriques, énergie nucléaire, système bancaire, et transport de compétence fédérale. Les organisations de ces secteurs devront adopter un programme de cybersécurité, notifier les incidents au Centre de la sécurité des télécommunications dans les 90 jours, et se conformer aux directives gouvernementales. Cette approche s'inspire du règlement européen NIS 2, créant un régime de cybersécurité robuste pour les infrastructures essentielles. Les incidents de cybersécurité qui affectent la confidentialité, l'intégrité ou la disponibilité de l'information devront être signalés, créant potentiellement une double obligation de notification pour les incidents touchant aussi la vie privée. Préoccupations et enjeux constitutionnels Inspiration américaine problématique Les deux projets s'inspirent fortement du modèle américain, particulièrement du FISA (Foreign Intelligence Surveillance Act). Cette approche soulève des inquiétudes quant à la création d'un système de surveillance de masse similaire à celui des États-Unis, mais appliqué aux données de citoyens canadiens plutôt qu'aux données d'étrangers. La facilité d'accès aux métadonnées pourrait mener à la constitution de bases de données gouvernementales permettant des requêtes systématiques, transformant l'État en « courtier de données criminel ». Cette évolution vers un modèle de surveillance étatique accrue préoccupe les défenseurs de la vie privée. Absence de contrepouvoirs Contrairement à d'autres juridictions qui mettent en place des mécanismes de surveillance spécifiques pour encadrer de nouveaux pouvoirs, C-2 s'en remet principalement aux tribunaux pour baliser l'usage des nouvelles dispositions. Cette approche réactive plutôt que préventive laisse une large marge de manœuvre aux forces de l'ordre. Questions constitutionnelles Le projet C-2 présente la particularité de ne pas contenir de disposition d'objets claire, contrairement à la pratique habituelle des projets de loi fédéraux qui cherchent à ancrer leur compétence constitutionnelle. Cette omission pourrait poser des défis d'interprétation judiciaire. Processus parlementaire et perspectives Le gouvernement conservateur semble pressé de faire adopter ces mesures. C-2 est actuellement en deuxième lecture tandis que C-8 est en première lecture. Tous deux relevant du ministre de la sécurité publique, ils seront probablement étudiés par le même comité parlementaire, ce qui pourrait ralentir leur progression. L'adoption de ces projets marquerait un tournant significatif dans l'équilibre entre sécurité et vie privée au Canada. Ils reflètent une volonté gouvernementale de s'aligner sur les demandes américaines en matière de sécurité frontalière, tout en modernisant les outils d'enquête face à la multiplication des plateformes numériques. Les audiences publiques et l'étude détaillée en comité seront cruciales pour évaluer l'impact réel de ces mesures sur les droits fondamentaux des Canadiens. The former editor of a newspaper linked to the regime in Iran told his 150,000 followers on X last week that Israel's success in the recent Twelve-Day War was due to its deployment of “the occult and supernatural forces.” This isn't the first time Israel's enemies have accused it of secret weapons. In 2015 and again in 2022, Hamas accused Israel of using dolphins as spies and assassins to counter Palestinian frogmen off the coast of Gaza. On a more serious note, we discuss deadly clashes this past week between Druze and Bedouin tribesmen in Suweida, a majority Druze region in southern Syria. The Druze asked Israel for help defending themselves against attacks by the Sunni Bedouins, who may have been aided by the Islamist government in Damascus. How many battles are you fighting without even being aware you're in the arena?It might seem like everything is “fine”. Sure, you had struggles, some hard times and bad luck, and things that didn't quite go your way. Many people have a story or two about the time they got fucked over BECAUSE they were doing the right thing.That boomerang can spin around and hit you when you least expect it, like it did for Tony Crescenzo.Tony grew up in a family of mechanics. Really, all the men in his family were mechanics, except for one grandfather who retired relatively young and bought a farm. They all lived in that same South Philadelphia neighborhood where the Rocky Balboa character trained for his fights with Apollo Creed. So young Tony worked Saturdays as a mechanic and Sundays on his grandfather's farm, learning the value of good, honest work.Tony's parents divorced. His mother remarried to a Navy officer and they moved to Hawaii. His stepfather's friend was an old-school Marine whose John Wayne-esque tales of service and heroism inspired young Tony to join the Marines. That's where he learned priceless lessons about teamwork, being part of something greater than yourself, and the importance of service. That's until he was assigned to NIS (which is what it was before NCIS), working in criminal investigations to bring down a paycheck scam. As the only witness for the upcoming court-martial of the accused, he soon found himself being court-martialed – and convicted – for a plethora of exaggerated charges, one of which was that he was UA (think AWOL) even though he was on an approved leave!So much for Semper Fi, right? Well, not exactly. Tony did get the conviction reversed, along with a commendation for his service and $20 for his trouble. But he decided to pivot to the private sector, working for, leading, and owning various companies and becoming a sort of “Clint Eastwood” of corporate restructuring. The thing is, his penchant for fighting was affecting every aspect of his life. Both his first and his second wives were used to Tony waking them up in the middle of the night screaming in his sleep. In his own words, he was was one of those people who goes from zero to fuck you in 10 seconds. So things weren't “fine”. It's a four-letter word. And then everything changed when he mis-Googled directions to the CIA.In a moment, when we meet Tony, he is going to give us a master class in accountability, vulnerability, and leadership including the power of meditation and an innovative method he is bringing to market for treating PTSD. While true crime has gained traction as a genre in the literary world, it's not often we see it applied to procurement. Yet, a fascinating and unsettling procurement fraud case has recently come to light within Intel Israel's operations. Every criminal investigation seeks to uncover means, motive, and opportunity, and this case checks all three boxes, with implications that go far beyond one company. Just a few weeks ago, a story broke that uncovered an alleged scheme in which a now-former employee, Natalia Avtsin, and a component supplier, Yefim Tsibolevsky from Energy Electronics 2000, teamed up to steal roughly 3 million Israeli shekels (NIS), or about $842,000 USD. Although the case is still ongoing and has yet to see its day in court, it poses a lot of questions for procurement teams across the globe. Sultânın adamları, şeyh hazretlerinin gelmek istemediğini görerek, bu âyet-i kerîmeyi okudular. Şeyh hazretleri buna karşılık, (Allahü teâlânın itâ'atine o kadar çok dalmış bulunuyorum ki, Resûle itâ'at etmekden hayâ ediyorum. Âmire itâ'ate vakt nerede?) buyurdu. Şeyh hazretlerinin bu sözü, Allahü teâlânın itâ'atini, Resûlünün itâ'atinden ayrı bildiğini göstermekdedir. Bu söz, doğru yoldan ayrılmış olmanın alâmetidir. Hâlleri doğru olan büyükler, böyle sözler söylemezler. İslâmiyyetin ve tarîkatin ve hakîkatin bütün basamaklarında, Resûlullaha itâ'atin, Allahü teâlâya itâ'at olduğunu bilirler. Resûlullaha itâ'at ile olmayan Allaha itâ'atin, dalâlet, sapıklık olduğuna inanırlar. Yine işitiyoruz ki, Mehene şehrinin şeyhi, şeyh Ebû Sa'îd-i Ebül Hayr ile oturuyordu. Horasandaki seyyidlerin büyüklerinden olan Seyyid Ecel de yanlarında idi. Şü'ûru yerinde olmıyan bir meczûb içeri girdi. Şeyh hazretleri, bu meczûbu, şeyh Ecelin üst yanına oturtdu. Bu hâl, seyyide ağır geldi. Şeyh hazretleri, seyyide dönerek, (Size olan saygımız, Resûlullahı sevdiğimiz içindir. Bu meczûbu ise, Allahü teâlâyı sevdiğimiz için yüksek tutuyoruz) dedi. Allahü teâlânın sevgisi ile, Resûlullahın sevgisini ayırd eden, böyle sözleri de, doğru yolun büyükleri uygun görmezler. Allah sevgisinin, Resûlullaha olan sevgiden çok olmasının, tarîkat serhoşluğundan ileri geldiğini bilirler. Böyle sözlerin söylenmesine izn vermezler. Şu kadar var ki, vilâyet derecelerinde yükselmiş olanlarda, Allahü teâlânın sevgisi dahâ çokdur.

Catherine: Hi, and welcome to Tech Law Talks. My name is Catherine Castaldo, and I am a partner in the New York office in the Emerging Technologies Group, focusing on cybersecurity and privacy. And we have some big news with directives coming out of the EU for that very thing. So I'll turn it to Christian, who can introduce himself. Christian: Thanks, Catherine. So my name is Christian Leuthner. I'm a partner at the Reed Smith Frankfurt office, also in the Emerging Technologies Group, focusing on IT and data. And we have a third attorney on this podcast, our colleague, Asélle. Asélle: Thank you, Christian. Very pleased to join this podcast. I am counsel based in Reed Smith's London office, and I also am part of emerging technologies group and work on data protection, cybersecurity, and technology issues. Catherine: Great. As we previewed a moment ago, on October 17th, 2024, there was a deadline for the transposition of a new directive, commonly referred to as NIS2. And for those of our listeners who might be less familiar, would you tell us what NIS2 stands for and who is subject to it? Christian: Yeah, sure. So NIS2 stands for the Directive on Security of Network and Information Systems. And it is the second iteration of the EU's legal framework for enhancing the cybersecurity of critical infrastructures and digital services, it will replace what replaces the previous directive, which obviously is called NIS1, which was adopted in 2016, but had some limitations and gaps. So NIS2 applies to a wider range of entities that provide essential or important services to the society and the economy, such as energy, transport, health, banking, digital infrastructure, cloud computing, online marketplaces, and many, many more. It also covers public administrations and operators of electoral systems. Basically, anyone who relies on network and information systems to deliver their services and whose disruptions or compromise could have significant impacts on the public interest, security or rights of EU citizens and businesses will be in scope of NIS2. As you already said, Catherine, NIS2 had to be transposed into national member state law. So it's a directive, not a regulation, contrary to DORA, which we discussed the last time in our podcast. It had to be implemented into national law by October 17th, 2024. But most of the member states did not. So the EU Commission has now started investigations regarding the violations of the treaty of the functioning of the European Union against, I think, 23 member states as they have not yet implemented NIS2 into national law. Catherine: That's really comprehensive. Do you have any idea what the timeline is for the implementation? Christian: It depends on the state. So there are some states that have already comprehensive drafts. And those just need to go through the legislative process. In Germany, for example, we had a draft, but we have elections in a few weeks. And the current government just stated that they will not implement the law before that. And so after the election, the implementation law will be probably discussed again, redrafted. And so it'll take some time. It might be in the third quarter of this year. Catherine: Very interesting. We have a similar process. Sometimes it happens in the States where things get delayed. Well, what are some of the key components? Asélle: So, NIS2 focuses on cybersecurity measures, and we need to differentiate it from the usual cybersecurity measures that any organization thinks about in the usual way where they protect their data, their systems against cyber attacks or incidents. So the purpose of this legislation is to make sure there is no disruption to the economy or to others. And in that sense, the similar kind of notions apply. Organizations need to focus on ensuring availability, authenticity, integrity, confidentiality of data and protect their data and systems against all hazards. These notions are familiar to us also from the GDPR kind of framework. So there are 10 cybersecurity risk management measures that NIS2 talks about, and this is policies on risk analysis and information system security, incident handling, business continuity and crisis management, supply chain security. Security in systems acquisition, development, and maintenance, policies to assess the effectiveness of measures, basic cyber hygiene practices, and training, cryptography and encryption, human resources security training, use of multi-factor authentication. So these are familiar notions also. And it seems the general requirements are something that organizations will be familiar with. However, the European Commission in its NIS Investments Report of November 2023 has done research, a survey, and actually found that organizations that are subject to NIS2 didn't really even take these basic measures. Only 22% of those surveyed had third-party risk management in place, and only 48% of organizations had top management involved in approving cybersecurity risk policies and any type of training. And this reduces the general commitment of organizations to cybersecurity. So there are clearly gaps, and NAS2 is trying to focus on improving that. There are other couple of things that I wanted to mention that are different from NIS1 and are important. So as Christian said, essential entities are different, have different regime, compliance regime applied to them compared with important entities. Essential entities need to systematically document their compliance and be prepared for regular monitoring by regulators, including regular inspections by competent authorities, whereas important entities only are obliged to kind of be in touch and communicate with competent authorities in case of security incidents. And there is an important clarification in terms of the supply chain, these are the questions we receive from our clients. And the question is, does the supply chain mean anyone that provides services or products? And from our reading of the legislation, supply chain only relates to ICT products and ICT services. Of course, there is a proportionality principle employed in this legislation, as with usually most of the European legislation, and there is a size threshold. The legislation only applies to those organizations who exceed the medium threshold. And two more topics, and I'm sorry that I'm kind of taking over the conversation here, but I thought the self-identification point was important because in the view of the European Commission, the original NIS1 didn't cover the organizations it intended to cover and so in the European Commission's view, the requirements are so clear in terms of which entities it applies to, that organizations should be able to assess it and register, identify themselves with the relevant authorities by April this year. And the last point, digital infrastructure organizations, their nature is specifically kind of taken into consideration, their cross-border nature. And if they provide services in several member states, there is a mechanism for them to register with the competent authority where their main establishment is based, similar to the notion under the GDPR. Catherine: It sounds like, though, there's enough information in the directive itself without waiting for the member state implementation that companies who are subject to this rule could be well on their way to being compliant by just following those principles. Christian: That's correct. So even if the implementation international law is currently not happening. All of the member states, companies can already work to comply with NIS2. So once the law is implemented, they don't have to start from zero. NIS2 sets out the requirements that important and essential entities under NIS2 have to comply with. For example have a proper information security management system have supply chain management train their employees and so they can already work to implement NIS2 and the the directive itself also has an access that sets out the sectors and potential entities that might be in scope of NIS2 And the member states cannot really vary from those annexes. So if you are already in scope of NIS2 under the information that is in the directive itself, you can be sure that you would probably also have to comply with your national rules. There might be some gray areas where it's not fully clear if someone is in scope of NIS2 and those entities might want to wait for the national implementation. And it also can happen that the national implementation goes beyond the directive and covers sectors or entities that might not be in scope under the directive itself. And then of course they will have to work to implement the requirements then. I think a good starting point anyways is the existing security program that companies already hopefully have in place so if they for example have an ISO 27001 framework implemented it might be good to start but with a mapping exercise what NIS2 might require in addition to the ISO 27001. And then look if this should be implemented now or companies can wait for the national implementation. But it's recommended not to wait for the national implementation and don't do anything until then. Asélle: I agree with that, Christian. And I would like to point out that, in fact, digital infrastructure entities have very detailed requirements for compliance because there was an implementing regulation that basically specifies the cybersecurity requirements under NIS2. And just to clarify, perhaps digital infrastructure entities that I'm referring to are DNS service providers, TLD name, registries, cloud service providers, data centers. Content delivery network providers, managed service providers, managed security service providers, online marketplaces, online search engines, social networking services, and trust service providers. So the implementing regulation is in fact binding and directly applicable in all member states. And the regulation is quite detailed and has specific requirements in relation to each cybersecurity measure. Importantly, it has detailed thresholds on when incidents should be reported, and we need to take into consideration that not any incident is reportable, only those incidents that are capable of causing significant disruption to the service or significant impact on the provision of the services. So please take that into consideration. And NISA also published implementing guidance, and it's 150 pages, just explaining what the implementing regulation means. And it's still a draft. The consultation ended on the 9th of January 2025, so there'll be further guidance on that. Catherine: Well, we can look forward to that. But I guess the next question would be, what are some of the risks for noncompliance? Christian: Noncompliance with NIS2 can have serious consequences for the entity's concern, both legal and non-legal. On the legal side, NIS2 empowers the national authorities to impose sanctions and penalties, breaches. They can range from warnings and orders to fines and injunctions. Depending on the severity and duration of the infringement. The sanctions can be up to 2% of the annual turnover or 10 million euros, whatever is higher for the essential entities, and up to 1.4% of the annual turnover or 7 million euros, whichever is higher for important entities. NIS2 also allows the national authorities to take corrective or preventive measures. They can suspend or restrict the provision of the services and take the or order the entities to take remedial actions or improve the security posture. So even if they have implemented security measures and the authorities understand or determine that they are not sufficient in light of the risk applicable to the entity, they can require them to implement other measures to increase the security. On the non-legal side, it's very similar to what we discussed in our DORA podcast. There can be civil liability if there is an incident, if a damage occurs. And of course, the reputational damage and loss of trust and confidence can be really, really severe for the entities if they have an incident. And it's huge because they did not comply with the NIS2 requirements. Asélle: I wanted to add that, unfortunately, with this piece of legislation, member states can add to the list of entities to which this legislation will apply. They can apply higher cybersecurity requirements, and because of the new criteria and new entities being added, it now applies to twice as many sectors as before. So quite a few organizations will need to review their policies, take cybersecurity measures. And it's helpful, as Christian mentioned, that, you know, NIS already mapped the cybersecurity measures against existing standards. It's on its website. I think it's super helpful. And it's likely that, the cybersecurity measures and the general risk assessment will be done by cybersecurity teams and risk compliance teams within organizations. However, legal will also need to be involved. And often policies, once drafted, they're reviewed by in-house legal teams. So it's essential that they all work together. It's also important to mention that there will be an impact on the due diligence and contracts with ICT product providers and ICT service providers. So the due diligence processes will need to be reviewed and enhanced and contracts drafted to ensure they will allow the organization, the recipients of the services to be compliant with NIS2. And maybe last point, just to cover off the UK, what's happening in the UK for those who also have operations there. It is clear now that the government will implement a version of NIS2. It's going to follow the European Union in its steps. And we recently were informed of a government page on the new cybersecurity and resilience bill. It's clear that it's going to be covering five sectors, transport, energy, drinking, water, health, and digital infrastructure. And digital services, very similar to NIS2, such as online marketplaces, online search engines, and cloud computing services. We are expecting the bill to be introduced to Parliament this year. Catherine: Wow, fantastic news. So it should be a busy cybersecurity season. Arab Affairs reporter Gianluca Pacchiani and reporter Sue Surkes join host Amanda Borschel-Dan on today's show. Syria’s de facto leader Ahmed al-Sharaa spoke on Al Arabiya and gave a glimpse of his plans for the country, including divulging that holding elections in Syria could take up to four years and that drafting a new constitution could take up to three years. Pacchiani weighs in. For the past week and more, swaths of Israelis from many parts of the country have found themselves seeking shelter in the middle of the night as the Houthis continue their campaign of projectiles, vowing to continue their attacks on Israel “until the aggression on Gaza stops and the siege is lifted.” We hear when they rose to power — and how? Sweden-based Yemeni activist Luai Ahmed, 31, has become something of a celebrity in Israel and he comes by it genetically, it seems: After fleeing Sanaa in 2014, Ahmed, who is openly gay, received refugee status in Sweden and later acquired Swedish citizenship. But his family still lives between Yemen and Egypt, and his mother, Amal Basha, is one of the most prominent women’s rights advocates in Yemen. We hear about Ahmed. Surkes has done a deep dive into Israeli international aid organizations and has discovered that their funding has dried up for two main reasons: antisemitism -- people don't want to give to a Zionist body -- and patriotism -- funders prefer to donate to a group doing work inside Israel proper. She explains why. The Energy Ministry has identified geological formations capable of holding 10 million tons of carbon dioxide a year and kickstarting a carbon storage industry worth an annual estimated NIS 1 billion ($275 million).
