The First Amendment gives you an absolute right to believe whatever you want. It has never given you the right to act on those beliefs in ways that harm others. That distinction, simple as it sounds, is the one that the religious right has spent decades trying to erase, and it is the distinction that Professor Marci A. Hamilton has spent her entire career defending. Marci is a Professor of Practice in Political Science and a Non-Resident Senior Fellow in the Program for Research on Religion at the University of Pennsylvania, where she specializes in constitutional law. Marci is an intellectual leader against extreme religious liberty. She is the founder of CHILD USA, a nonprofit academic think tank dedicated to protecting children from abuse and neglect, and a leading national expert on clergy sex abuse and child sex abuse statutes of limitation, which she ran for a decade. The core argument of God vs. the Gavel is one that sounds obvious until you see how hard it is to actually enforce: religious organizations, like every other institution, must obey the law. No mandatory exemption. No special carve-out because a leader claims divine authority. Marci put it plainly: the very first free exercise case in United States history established that belief is absolute, but conduct is not. Conduct can harm others, and a functioning democracy does not allow anyone to use religion as a shield against accountability for harm. The cases that matter, she told me, are always about harm. Who then is like me?” Isaiah 44: 6-7 The Bible Stands Alone In Old Testament times, God gave his people a visible reminder of his presence called the Ark of the Covenant. There was a time when the Ark of the Covenant was captured by the Philistines who had defeated Israel in battle and claimed the ark as their prize. Since they already believed in many gods, why not add the God of Israel as well? So, they placed the ark in the temple of their god, Dagon. The next morning, when they went to worship Dagon, there he lay, facedown before the ark of the Lord! So, Dagon was put back in his place. The next morning, it was the same result—Dagon facedown before the ark of the Lord, but this time his head and hands had broken off. Message received! The ark needed to go back to Israel because Dagon could not handle being in the presence of the Lord. (1 Samuel 5) God has placed in our hearts an awareness that there is a God and a desire to know that God. Throughout the course of human history, different gods and goddesses, spirits, and mystical powers have been proclaimed as gods. But “who then is like me?” asks the Lord. The best that the false worshippers could hope for is that their gods and goddesses would send rain and grow their fields and grow their families and flocks. If they gave the right sacrifices, perhaps those gods would listen. The Lord God stands alone. He does something that sinful minds couldn’t have even imagined. He came to us, wearing our flesh and blood. He redeemed us, taking our sinful failures upon himself. He loves us, promising his presence with us through life and preparing a place in eternity with him when this life comes to its close. Truly, the God of the Bible stands alone. Prayer: Lord God, help me to see you for you who are—eternal, powerful, and singular in your love for fallen humanity. Move my heart to serve you in my life. Amen. My guest on the show today is returning guest and all-around friend of the pod David Sessions, a Boston-based freelance writer and the co-host, along with Blake Smith, of the relatively new Off Christopher Street Podcast and and Substack newsletter, about the history and present of gay male life and culture in America. David, Blake and I have recorded a crossover episode of Eminent Americans that focuses on their new endeavor, which should be out in the next month or two or three, but on this episode David and I are talking pornography, its ubiquity, the effect it may or may not have on our culture and kids, and related issues around technology, moral panic, and modern life. A few key differences between the two of us structure the discussion. One is our ages. David is 40. I'm now 50, and though it's not a huge difference from one angle, it represents a fundamentally different generational growing up experience when it comes the internet, social media, and smart phones, none of which I basically had growing up, all of which David got relatively early on.Another is kids. I have three of them. David doesn't have any. And a third is our backgrounds. I'm from a liberal secular Jewish home in the northeast where sex was discussed pretty openly, and porn wasn't permitted but wasn't really stigmatized either. David grew up in what he describes as a deeply conservative, Christian-nationalist home. He went to a Christian college, married a good Christian woman, and then came out as gay in his mid-thirties.One consequence of that background, for David, is that he's unusually attuned to some of the ways that mainstream discourse around issues like porn, smart phones, the internet, and social media has been influenced by savvy right wing Christian groups, who recognized pretty early on that if they wanted to move the mainstream they would have to find rhetorical frames that weren't aversive to establishment media. So instead of sin and god and traditional values they talk about public health harms, addiction, exploitation, objectification of women, etc.So David comes to these debates with an awareness of how they've often been covertly shaped by religious groups and motives. He also has the experience, as a gay man, of living a pretty flourishing social life that is enabled in all sorts of positive ways by the technologies that a concerned parent like me can easily fall into perceiving as purely pernicious.And one last thing I want to bring up, which I think is important as context for this conversation, is that so many of the discussions around the effects of tech on kids lack a real perspective on how it plays out differently depending on the socioeconomic class of the kids in question. Who is really speaking for, or from, the kids who aren't living with the kind of social and cultural capital that David and I both, albeit in very different ways, had growing up. Two parent homes, relatively intact communities, financially secure, high parental investment, and so on. David and I, and my kids, and his kids if he has them, have been or will be raised with psychological protective factor layered on top of psychological protective factor. What about the kids who don't have all that? Are we condescending to their parents in imagining that their kids are just at the mercy of the evil tech gods, that they're not able to sufficiently protect and nurture them. Or, alternatively, are we just basically ignoring them when we have these discussions, as elites, as though their kids are just like our kids, having basically the same experiences. I don't know, and David doesn't either, and – and this is maybe the worst part – who would I even turn to to help me answer it? So that's in the background of this conversation too.Two quick housekeeping notes. The first is a thanks to Joshua Howard for manfully editing this episode, as he has the last few. The second is that this the last episode of what I will retrospectively refer to as the scrappy, underground, indie era of this podcast. Starting in a week or two, I'll be launching a partnership with Arc Magazine, which is published out of the John C. Danforth Center on Religion and Politics at Washington University in St. Louis. I'll say more about that when we officially launch, but one thing I'll say now is that Arc's touch on the content and vibe of the show will be very very light. Occasionally I'll have on a guest who is doing something for the magazine, there will be brief promos for other Arc content, and I hope to do some fun experiments that I didn't have the bandwidth to do when it was just me and producer Robert. Some time ago Elisa led us in conversations about "tables" and how certain mealtimes moved the story of the Bible forward. For these two weeks Bill wants the group to consider the opposite—how famines (or the lack of food) was a catalyst for biblical events and a force for change in the lives of the characters of the Scriptures.Receive As we ponder why God allowed His people throughout Scripture to experience famines, we can see that God was still working to draw them closer to Him. God is at work in our life as well. When we face hardships and difficulties in our life, let's remember that God is near. How does reading about how God provided for men and women throughout the Bible help remind you that He is faithful to help you through any trial you may face? What could drawing closer to God even during difficulties look like for you? Reflect Why did God allow someone as faithful as the prophet Elijah to suffer through a famine as we read in 1 Kings 18:2? During famines, how did God provide for Elijah in 1 Kings 17:7–11 and Elisha in 2 Kings 4:38– 41? Why did the four men with leprosy mentioned in 2 Kings 7:3–5 respond to the famine the way they did? Why did Jesus mention a famine in His parable of the Prodigal Son found in Luke 15:14? Based on Romans 8:35, not even famine can separate us from God's love. How does knowing that truth encourage you during difficult times?
