Today on Speaking Out of Place we are joined by three members of the University of California faculty who are part of groups that have filed a landmark compliant against the UC system.This September, faculty associations from seven University of California campuses along with the systemwide Council of UC Faculty Associations filed an unfair labor practice, or ULP charge against their employer, the University of California. A nearly 600-page complaint was presented to the California Public Employment Relations Board. What is especially noteworthy about this complaint is that it claims UC's repression of faculty and student protests against Israel's genocide in Gaza cuts to the heart of the educational process, and denies faculty, staff, and students the ability to carry on their work of learning and teaching about critical issues in the world today. Most notably, perhaps, is the fact that the faculty groups say that the university system's restrictions on activism for Palestine amount to violations of the Higher Education Employer-Employee Relations Act (HEEERA), which protects employees from retaliation around advocating for changes in the workplace. This raises the issue of just how far universities can go, and the methods they employ, to maintain their complicity with genocide and ethnic cleansing.Anna Markowitz is an Associate Professor in the Department of Education at UCLA. Her work is at the intersection of child development and policy for children and families. She is a member of the UCLA Faculty Association Executive Committee. Wendy Matsumura is Associate Professor in the Dept of History at UCSD. Her work is on the history of Japanese empire and Okinawan anti-colonialism. She is part of the UCSD Faculty Association Executive Committee. fWotD Episode 2402: Ernest Roberts (Australian politician) Welcome to featured Wiki of the Day where we read the summary of the featured Wikipedia article every day.The featured article for Saturday, 2 December 2023 is Ernest Roberts (Australian politician).Ernest Alfred Roberts (21 February 1868 – 2 December 1913) was a Labor member of the South Australian House of Assembly from 1896 to 1902 and 1905 to 1908 and then the Australian House of Representatives from 1908 to 1913. Roberts also served as an officer in South Africa during the Second Boer War, with South Australian colonial forces in 1900 and Commonwealth forces in 1902. From 1904 to 1908 he was the editor of The Herald, a left-wing newspaper published by the United Labor Party (ULP).Born in London and schooled on the island of Guernsey, Roberts initially followed his father into the merchant marine, and after briefly living in Queensland he moved to Port Pirie, South Australia. There he worked on the wharves, was active in the labour movement, and was a member of the town council. In 1893 he ran unsuccessfully for the seat of Gladstone in the House of Assembly as an independent Labour candidate. On his second attempt in 1896 he was elected as a ULP candidate, and was the youngest member of the assembly. He cemented his position at the 1899 election. In late 1899, he crossed the floor and contributed to the defeat of the ministry of Charles Kingston, attracting sharp criticism from some parts of the ULP.In 1900, Roberts served in the Second Boer War in South Africa as a lieutenant with the 4th Imperial Bushmen's Contingent raised from South Australia. After its arrival in June his unit was involved in several engagements, including the relief of the garrison at Elands River. In December, Roberts, considering the fighting almost over, asked for and received permission to return home, and resumed his seat in the assembly. Post-Federation, Roberts helped raise a unit of the Australian Commonwealth Horse and served with it as a captain in South Africa in 1902. The main operation of his unit was as part of a large-scale concerted "drive" to push the remaining Boers to surrender, and Roberts personally took the surrender of more than 190 Boers, along with the capture of a similar number of horses. Roberts' term in the assembly expired while he was absent in South Africa, and he did not contest any seat at the 1902 South Australian state election. From 1904 to 1908 Roberts edited The Herald, and he successfully ran for the seat of Adelaide in the 1905 state election. He was re-elected in the state election of 3 November 1906. He was vice-president and then president of the ULP in 1907–1908, and was also a member of the council of the South Australian School of Mines and a board member of the Adelaide Co-operative Society.When a by-election was called for 13 June 1908 in the federal division of Adelaide following Kingston's death, Roberts ran as the Australian Labour (Labor from 1912) Party candidate and won the seat, then retained it in the 1910 federal election. Roberts represented the minister for defence, Senator George Pearce, in the House of Representatives, and also while Pearce was overseas in 1911, and was appointed as an honorary minister later that year. He retained his seat at the 1913 federal election, but soon after a fierce parliamentary debate on 2 December 1913 he collapsed and died from a heart condition. He received a state funeral attended by 6,000 people. The loss of Roberts – considered a highly capable and up-and-coming member of the ULP – was felt intensely by his political comrades, along with his fire, energy and enthusiasm. Mention Orange County to the average person and images of Disneyland, Laguna Beach and high-end shopping malls may come to mind. Life science industry insiders know that beyond the county's famous landmarks is a nascent biotechnology hub—more than 63,000 people there were employed by the sector last year, and the number of startups establishing roots in Orange County is growing. In 2020, biotech startups gained a new place to set up shop when University Lab Partners, the first wet lab incubator for biotech and medtech companies in the region, opened near the University of California, Irvine campus. Karin Koch, its executive director, calls it “the Four Seasons of incubators” and says it has helped 70 companies since opening. Karin says University Lab Partners' approach—which was founded in partnership with UC Irvine's Beall Applied Innovation—is an “all-inclusive concierge model” where startups receive support services in addition to access to labs: event planning, business counseling, networking, and finding a venue when they're ready to graduate. For Karin, directing an incubator goes far beyond collecting rent—it's about offering startup founders a sense of community and helping them on their journey. Having been one of the few women in an electrical engineering class while in college, she knows first-hand what it's like to feel isolated. “Being a CEO or owner of a company, it's a very lonely place. Not a lot of people can relate to you,” she says. This is where incubators like University Lab Partners come in—they can connect founders with like-minded people who can serve as a sounding board and co-collaborator. “Part of the reason why I'm so impassioned about the work is so that women and underrepresented minorities in STEM really have this safe social network…ULP is focused on life sciences and there are severe disparities in STEM (and especially the life sciences) that we need to highly focus our efforts there.” Today, University Lab Partners has a second location in Aliso Viejo and houses a total of 42 companies that will hopefully stay in Orange County when they outgrow the incubator, as many previous tenants have. We hear more from Karin about the larger role (and responsibility) incubators play in a city's economic development and the diversity of the STEM workforce, University Lab Partners' involvement with an outreach program for high school students, and how a company's graduation day can feel like a parent sending their child off to college. In today's episode, our guest is David Greene. He is a successful real estate broker, bestselling author, and BiggerPockets Real Estate podcast co-host. He is a highly respected authority on real estate, having been featured on CNN, Forbes, and HGTV, and has appeared on over 25 different real estate podcasts. As a licensed real estate broker and lender, he runs "The David Greene Team," a top-producing real estate company in Keller Williams, where he has won multiple awards for production. [2:25] Why should I listen to you? You should listen to me because we will get into a conversation where we will discuss everything about you that is stopping you from getting the things you want in life or being happier. [3:34] Where did this come from? I grew up having a relationship with God, and I think that helps a lot, depending on how you perceive God. My perception of God had a lot to do with the fact that we're forgiven for everything we've ever done. You can operate at this level of honesty about your problems and still be loved by him. So you can take off your shirt at the pool even if you don't look good and still feel loved. When I didn't have that perception, I felt unloved. I struggled with confidence, shame, and laziness, and there was always resistance to getting out there and doing what I needed to do to make my life better. I always craved the right people who would come along as friends, coaches, and mentors and who would help me overcome my resistance. So my best friends became people who practiced with me and helped me get better. [5:20] What was the process like for you? High school basketball coaches had a big impact on me, especially one in particular. My first varsity coach asked me to play varsity as a sophomore, but I declined since they already had a good team and I didn't want to be stuck behind another player. Nonetheless, that coach believed in me, which gave me the confidence to play harder. This was important since my relationship with my dad was rough, and I often felt like he preferred more athletic kids. During my senior year, a new coach came in who had just graduated from ULP, a Division I college in Stockton that was making it to the NC double A's every year. This coach brought a Division I college program to our high school, which raised the standards significantly. This was tough, but it helped me grow stronger and understand that I needed to keep raising the bar bit by bit. While I have failed many times in my life, the standard set by my basketball coaches has been like a north star, guiding me toward improvement, happiness, better relationships, and wealth. [8:05] Can we talk about your high school? I grew up in Chico, which is located between Stockton and the waterpark. The waterpark was a popular destination, especially when I was playing basketball. At the time, Michael Olowokandi was the number one pick in the NBA draft and he had been playing with my coach. They were a dominant team, beating even the top-ranked teams in the tournament. However, my athletic career didn't go as planned, and I broke my ankle while training with a talented player who was the best on his college team. I used to play one-on-one with him at the gym, and although he usually won, I would occasionally win too. But when I saw him wearing Colorado basketball shorts one day, I realized that he was a guard for the team and was good. This made me shift my mindset and realize that sometimes we don't see ourselves from the best angle. [10:50] Were you injured during that period when you were with that individual? I traded with another guy, who happened to be the best player, but I had a lot of ankle injuries from repeated sprains. I didn't understand how it worked at the time. I thought my body knew how to heal from sprains faster, without realizing that each time it happened, my ligaments were getting stretched. The last time, a couple of ligaments snapped in half, and the bones crushed together and broke off. I tried to train with almost nothing, but the pain was too much to handle. Eventually, I had to get reconstructive surgery, and my eligibility was revoked. I was frustrated because I was so close to proving myself, just 99% of the way there. However, this experience taught me a valuable lesson, and it gave me the motivation to push harder in other areas. I had a chip on my shoulder because I didn't achieve what I wanted in my athletic career, which motivated me to graduate from the tough police academy and succeed as a police officer. Although this career can be full of temptations and hate, it all depends on how you let the external world affect you. From there, I became a real estate agent and investor, and my past disappointments have fueled me to push harder than others. [13:24] What are some of the challenges you faced and how did you approach them? I applied to 14 different apartments before getting hired by one. The application process is not just about settling down; each apartment had about nine or 10 steps before getting to the academy. I had to go through constant oral boards, physical agility tests, written tests, and endless driving across various departments. Even when I got 80% of the way there, I still got rejected a few times because of my past speeding tickets, or for never having done drugs or getting into fights. They thought I couldn't handle the job's stresses. Finally, I got hired by one apartment after 13 failures. When I arrived at the academy, the biggest shock to me wasn't the screaming or physical demands, which I was used to from playing sports. It was the emotional shock of being yelled at and punished for something I didn't know was wrong. In sports, coaches would show you the right fundamentals, and if you didn't follow them, you got into trouble. It was a logical approach. However, in the academy, I got in trouble for military rules I didn't know, which was very discouraging. Despite feeling hopeless, I knew I couldn't go back to applying for 14 more departments, so I stuck through it. I also saw this as an opportunity to change my life and gain confidence as a man. I felt like God had put me on this path, and if I didn't complete it, I could end up accepting being a quitter for the rest of my life. I had a healthy fear that quitting would become a part of my identity, and I didn't want that. It's okay to get injured or washed out if it's out of your control, but it should never be because you voluntarily gave up. [16:55] What was your experience of being an officer after finally making it through the journey? Did you feel settled and secure, or did you always have a lingering feeling of uncertainty? You constantly fear getting fired during the FTO program, where an experienced officer evaluates and teaches you simultaneously. It's an emotional state where they're teaching and evaluating you, and they decide whether you make it or not. It's hard, especially when you're younger, trying to remember policies, listen to radio codes, drive in an unfamiliar neighborhood, and identify penal codes. You're being watched and every mistake is noted, creating a constant fear of getting cut. You study hard, drill codes in your head, and seek comfort. It's like being a rookie in sports, where everything feels like white noise and you're a step behind everything, but with time, you cross a threshold and start seeing things before they happen. Many people don't make it through, and it's a continuous struggle even after you pass the academy because you have to learn how to do the job and earn your peers' respect. If they don't trust you, there will be conflict, and you'll be miserable every day. [24:40] What was the catalyst that made you decide to do something else after going through all the things you just talked about? There is an answer that makes me sound intelligent - I foresaw the strained relationship between the public and police officers improving, particularly in the Bay Area. The negativity of the officers around me was exponentially worsening, and it was beginning to affect my thoughts and actions. Even though my beliefs didn't align with those negative feelings, it was challenging to fight against them constantly. However, I had invested too much time and energy into my career as a police officer and wanted to be the best. It's tough to let go of something that defines your identity, especially for men. That's why people like Tom Brady continue to play football when they retire. But something inside me was changing. I'm not sure if it was divine intervention, but I no longer felt the same desire to continue in law enforcement. It was as if I had a fistful of sand, and the tighter I held onto it, the more sand slipped through my fingers. One day, even the easiest call, like someone with a stomach ache, would make me angry, and I would curse the world on my way to that call. It was as if a door was closing on that chapter of my life, and it made sense to leave. Emotionally, it was a powerful decision, and I felt like I was suffocating. I needed to find a new challenge because there was no longer any joy in the job. People were depending on me, and it was an uphill battle to maintain a positive attitude every day. I knew I wasn't strong enough to overcome those challenges, so I had to move on. [26:56] Why real estate? I used to own rental properties, and I was comfortable with that. However, I became a real estate agent because I was tired of referring my friends to agents who weren't very good. In my opinion, most real estate agents are terrible, and it's hard to find good help in this industry. When my friends came back to me with questions about their agents, I would end up doing the agent's job. So I decided to get licensed and do it myself. While I was still working as a cop, I would show homes in the morning, go to work in the afternoon until late at night, then go home and repeat the process. I was also part of a group called Good Abundance, where I was encouraged to stop working overtime, learn how to be a businessman, and eventually ride off into the sunset when I made enough money. But to be honest, I hated it. I didn't like sales or having to persuade people. As a cop, it was easy to tell people what to do, but that doesn't work with scared people who are unsure about buying a house or how much to pay. I felt like a bodybuilder trying to learn yoga, but I needed to stretch and become flexible. I had to connect with people, listen to them, and share personal stories to build trust. Once I realized that personal growth led to more money, I knew what I had to do in this new industry. [29:25] What made you feel secure enough to take the risk and venture into your endeavors? Looking at a chart of how success happens when learning a new skill, it's not a linear process where you put in X hours and get X better, like in the world of work. Learning a skill, such as playing the guitar or building up your biceps, requires perseverance and patience. When I started working out, I was frustrated that my wrists would tire before my biceps during bicep curls. It took months of consistent effort before my wrists were strong enough to support my biceps, and even then, my forearms needed work too. Progress is not always linear, but rather a series of adjustments and improvements. Whether you're a major league baseball player or learning a new skill, success takes time and effort. It's important to keep pushing through the frustrating moments and trust that your hard work will pay off in the end. During this period of growth, you may not see immediate success or financial gain but don't give up. Keep at it and trust the process. Once you reach the inflection point, where progress exponentially increases, you can put even more time and effort into your pursuit. [33:50] How can someone who doesn't have the same experience as you, in real estate, learn from your success and create their version of wealth through real estate? You can't be a David Green or an Elon Musk; only a handful of people in the world can achieve what they have. However, anyone can strive to be the best employee they can be. When I worked at Todos in high school, my goal was to excel at my job just as I did in basketball. I wanted to outperform my coworkers and become the boss's favorite. This attitude worked well in the workplace because many people approach their jobs with minimal effort. When I started working in restaurants as a busboy and host, I approached every day with a positive attitude and a desire to learn. As a result, I was promoted to waiter, making grown-up money right out of high school. I learned that nobody stops you from giving your best every day, and that mindset has carried me through every profession. Instead of waiting for more opportunities, start by doing your best in the job you have and looking for ways to do more. That's something anyone can do. [43:08] What promise did God make to the world when he created you? I believe that one of the key takeaways from our conversation today is that if you put your heart and soul into pursuing your goals, there's no guarantee that you'll achieve them. However, you will inevitably develop the qualities and attributes necessary to attain what you truly need in life. My own experience attests to this truth, that if you give everything you've got, success will come. It's like going to the gym and giving it your all every single day. There's simply no way you won't become stronger. You may not end up with the same physique as Arnold Schwarzenegger or Michael Phelps, but you will undoubtedly improve your abilities and skills. The Labor Law Insider invites two experienced counsel, attorneys Terry Potter and Tom O'Day, to explore the implications of the National Labor Relations Board's decision in McLaren Macomb, issued in late February, as well as the even broader general counsel memorandum sharply curtailing employer rights to insist upon non-disclosure and non-disparagement in severance agreements. In part one of this podcast, host Tom Godar begins to explore the contours of these employee rights or employer restrictions. This change would affect all employees who would otherwise be eligible to participate in a bargaining unit under the National Labor Relations Act and bleed over as well to supervisors whose behaviors might be seen as having supported others in their protected and concerted activities. The new twist makes even presenting a non-disclosure or non-disparagement agreement to an employee—which is overbroad according to the new interpretation of the board and its GC—itself an unfair labor practice. According to General Counsel Abruzzo, the unfair labor practice would extend not only to those agreements which parties would now craft but would go back in time to agreements that include what are now considered overbroad non-disparagement or non-disclosure agreements, and that such agreements would be a continuing violation, with essentially no time limitation on when one could bring a charge based on overbroad language. Terry Potter suggests that while the instructions from the general counsel will find their way into enforcement actions brought by the board, the Administrative Law Judges before whom such cases are heard may curb the reach of the GC memorandum.It remains to be seen as to whether savings clauses that would carve out NLRB protected rights, or severability provisions, would be effective in defending against a ULP challenging the reach of the agreement. What is also missing from the GC memo is whether an agreement negotiated with counsel on both sides would have less scrutiny than one which was merely crammed down to employees who were in the process, for instance, of a reduction in force. Part two of the podcast continues to explore whether protected activity would include freedom from non-compete agreements, non-poaching agreements as suggested by the GC Memorandum.

Meet Gay Hendricks Gay Hendricks has been a leader in the fields of relationship transformation and body-mind transformation for more than 45 years. He is also a mystery novelist, with a series of five books featuring the Tibetan-Buddhist private detective, Tenzing Norbu, as well as a new mystery series featuring a Victorian-era London detective, Sir Errol Hyde. His book Conscious Luck reveals eight ways to change your fortune through the power of intention. Gay has appeared on more than 500 radio and television shows, including Oprah, CNN, CNBC, 48 HOURS, and others. His latest book is The Genius Zone. Gay Hendricks has been a mentor from afar for years, and it was such a joy to interview him and share his incredible wisdom, stories, and magic. Adding Magic To Your Life Gay Hendricks grew up with his grandparents and mother, as his father tragically died before he was born. He grew up with a lot of anger and frustration that got pushed down with food, sweets, and smoking. Gay shared that the Universe is always teaching you a lesson; it's just whether you're listening or not. He got tapped on the shoulder by the Universe when he was 24 years old in 1969. Gay was living in NH in an apartment, in a relationship and life he didn't like, and was carrying a good 150+ extra pounds. He fell on the ice and had a two-minute experience that changed his life. For the first time in his life, he could see all the levels of himself --- all the emotional layers that he hadn't felt, like anger, sadness, and eventually, in the middle was pure consciousness. He decided that day and committed to a new way of doing life. He made a declaration to himself and the Universe and committed to feeling this state of pure consciousness all the time, but without needing to fall down. He chose foods that fed pure consciousness (like blueberries instead of cheeseburgers, donuts, and blueberry pancakes) and committed to honoring his mind and body. Later that next day, he was invited to another event that also would change the course of his life. His friend took him to an event with a former Harvard professor who had gone to India and come back enlightened. He got to meet and hear Ram Dass in person and was turned on to meditation. This was just the beginning of the magic that has been a blessing in his life (like finding his wife Kathlyn) since he committed to being honest, taking responsibility, and honoring his creativity. Living in the Genius Zone Here's one of my favorites from Gay Hendricks in our conversation --- he said that 'Genius is contagious'. We are all meant to live in the genius zone. This is the zone where you are doing what you love without a sense of time lapsing while honoring your unique abilities. Gay Hendricks shared that within 20 years, he went from spending 10% of his time in the genius zone to 100% of his time in this zone, and because of this shift. And now, life feels like one continued blessing and gift. I realized that in this conversation, being your You-est You inherently means aligning and living in the genius zone. Some ways to discover your genius zone is to ask yourself what you love to do, where you lose a sense of time doing what you love, and what your specialized and unique abilities are. For example, thanks to Gay, I realized my genius zone is doing my podcast -- both in interviewing guests, sharing my thoughts, and creating a show that changes lives. The Upper Limit Problem Gay Hendricks goes into great depth about a ULP, the Upper Limit Problem. In sum, this is when you sabotage yourself when things go well. Gay teaches how to expand your capacity and override this pattern so that you learn how to experience greater lengths of joy and good. One of the ways to do this is to use what he calls the Ultra Success Mantra (USM), which I have on my desk and say daily. The USM is: "I expend in abundance, success, and love as I inspire others around me to do the same." What's important is that you are not only expanding the good within you but also creating opportunities to do the same for others. Change Your Relationship to Time If you're like me and you're sick and tired of being sick and tired that there's not enough time, ever, then listen up. Gay Hendricks talked about what he calls Einstein time versus Newtonian time. In Einstein time, you are the cause of your time. Think of it this way, if you sat on a hot stove, a minute would feel like an hour, but if you were hanging with your beloved, an hour would feel like a minute. We are more in charge of our time than we realize. Here's the best way to change this bad habit of making time your enemy and yourself a victim (which never works out well). Stop talking about time as a victim, and stop blaming time for things you can't do. You'll never have enough time to do the things you don't want to do. Take responsibility for yourself and your time, and commit to being conscious and mindful of what you say. And, stop making time the culprit and realize you are the cause of your time, your relationships, and your life. The National Labor Relations Board, primarily through its General Counsel, Jennifer Abruzzo, has initiated a course of seeking increasingly stiffer remedies from employers who are either found to have committed an unfair labor practice, or even for those who are subject to an unfair labor practice complaint and are merely seeking to resolve the complaint through negotiation with the National Labor Relations Boards (NLRB) agent. As discussed in Part I of this Labor Law Podcast series on remedies, the General Counsel issued two memos (General Counsel memo 22-02 and General Counsel memo 21-07) admonishing the regions to seek even more inclusive remedies, as well as instructing the Regional Directors to initiate the federal court process for injunctive relief earlier in the process and perhaps more frequently than had been the case earlier. Husch Blackwell's Labor Law Insiders Tom Godar, Terry Potter, Adam Doerr and Rufino Gaytán continue the discussion, and review the NLRB's more aggressive posture for 10(j) injunctive relief, which must be granted by federal courts. In addition, the discussion reviews the potential impact of tougher remedies, including the incentive for employers to litigate more often since they gain very little relief from a settlement when the Board is seeking full remedies. This reluctance to settle a charge might be even greater given the Board's insistence that employers publicly record and distribute a notice admitting to the alleged violations of the Act, or even apologize to workers if the Board concludes that they were subject to discrimination based on their protective and concerted activities. The Labor Law Insiders emphasize that employers should take appropriate steps to avoid, or at least minimize, the likelihood that an unfair labor practice (ULP) claim will be filed. Our panel suggests that there must be a renewed emphasis on training supervisors and communicating effectively and with transparency with employees. In addition, employers should review handbooks and other policies that might invite the Board's scrutiny as it seeks to reverse Trump-era decisions and expand its interpretation of employee and union rights, especially as it relates to work rules pertaining to social media use and other employee communications. In addition, review by counsel of actions that might result in employee discipline or discharges is essential, given the greater risks and costs of facing a ULP charge. Even while this podcast was being recorded, the General Counsel issued still another remedies memo (General Counsel memo 22-06), which celebrates and advocates for very harsh remedies for alleged ULPs. In addition, the Board is seeking broad remedies related to some of the hundreds of Starbucks organizing efforts, including bargaining orders as opposed to new elections, when it believes that employees' rights to participate in an election have been violated. Those developments are the focus of a special third part to this Insider podcast series, featuring attorney Terry Potter. Terry draws on his experience and expertise to describe these changes and the further impact they have upon employee, union and employer behavior. Stay tuned for Part III of this series, which will be released very soon.
Husch Blackwell's Labor Law Insiders, Thomas Godar, Terry Potter, Rufino Gaytan and Adam Doerr, offer context to recent NLRB memoranda, including background to NLRB remedies, and contrast the historical reach of NLRB remedies to the broader approach urged by the Board's General Counsel under her more expansive definition of “full remedies”. Further, the panelists take on the implications of the General Counsel's pursuit of injunctive relief under Section 10(j) of the National Labor Relations Act, as a preventative tool rather than a remedial one.The panel also addresses the non-economic remedies that more employers will find unpalatable, including those discussed in the most recent General Counsel memorandum. These include such remedies as letters of apologies to reinstated employees, and the creation of video recordings of a NLRB agent reading notices in the presence of senior charged party officials, among others.The second part of this episode will further explore the options for reviewing and potentially resolving complaints, the incentive to defend against such ULP complaints through trial, and the steps to be undertaken to avoid, as far as can be possible, the threat of employees charging employers with unfair labor practices.
The South African government has announced a two-month extension to the temporary reduction in the general fuel levy, but has warned that the R4.5-billion in foregone revenue will have an impact on the fiscal framework. In a joint statement Finance Minister Enoch Godongwana and Mineral Resources and Energy Minister Gwede Mantashe announced that Godongwana had submitted a letter to the Speaker of the National Assembly requesting the tabling of a two-month proposal for the extension of the reduction in the general fuel levy. “This will take the form of a continuation of the relief of R1.50 per litre for the first month, from 1 June 2022 to 6 July 2022, and then a downward adjustment to the relief for the second month to 75c per litre from 7 July 2022 to 2 August 2022. “The temporary relief will be withdrawn from 3 August 2022.” The Ministers warned that, unlike the previous announcement, the proposal, which is estimated to result in R4.5-billion in foregone revenue, was expected to have an impact on the fiscal framework as it will not be fully funded through a sale of strategic oil stocks. "Government remains committed to the fiscal framework outlined in the Budget 2022. "The proposed temporary reduction in the fuel levy will be accommodated in the current fiscal framework in a manner that is consistent with the fiscal strategy outlined in the Budget. "Any changes, if required, will be announced at the time of the 2022 Medium Term Budget Policy Statement." The decision to extend the temporary relief beyond May 31 was based on an assessment that a re-introduction would "contribute to an increase in petrol prices of close to R4 per litre, and push prices of 95 octane unleaded petrol (ULP) to above R25 per litre, an increase of just under 20%". The DMRE announced the following price change for implementation from midnight: Petrol (both 93 ULP and LRP) to increase by 243.00c/l; Petrol (both 95 ULP and LRP) to increase by 233.00c/l; Diesel (0.05% sulphur) to increase by 110.00c/l; Diesel (0.005% sulphur) to increase by 107.00c/l; Illuminating Paraffin (wholesale) to increase by 156.00c/l; SMNRP for IP to increase by 208.00c/l; and the Maximum LPGas Retail Price to decrease by 51.00c/kg. The adjustments, the Department of Mineral Resources and Energy (DMRE) said, were premised on an increase in international petroleum product prices and a deterioration of the rand relative to the US dollar. "The movement in product prices has led to higher contributions to the Basic Fuel Price of petrol 95 ULP and 93 ULP by 143.39c/l and 134.19c/l respectively, diesel 500ppm and 50ppm by 4.75c/l and 0.74c/l respectively, while the contribution to illuminating paraffin was 50.86c/l." Meanwhile, the rand depreciated, on average, from R14.90 to the US dollar to R15.95 during the period-on-period. The Ministers said the continuation of the Russia/Ukraine conflict, supply chain bottlenecks and a tightening of global monetary policy had led to further unfavourable changes in the two key drivers of the regulated petrol price, the exchange rate and the global oil price. "As announced on 31 March 2022, government will also take further measures to help reduce fuel prices in a more sustainable manner. "From 1 June 2022, the DMRE will remove the demand-side management levy of 10c per litre that has been applied to inland 95 ULP. "After a review and consultation by the DMRE, it is proposed that the basic fuel price also be decreased by 3c per litre in the coming months." The Ministers said government intended to continue with consultations and proposals to remove the price cap on 93 ULP, which would partially deregulate the market and introduce more competition to lower pump prices. "A review on the Regulatory Accounting System (which includes the retail margin, wholesale margin and secondary storage and distribution margins) will be completed by the DMRE to assess the potential to lower margins over the medium term."

We've tried to cover all the news coming in from the Starbucks Workers United movement on the regular show every week, but this week there was just so much news we had to give it its own episode. We start out covering Howard Schultz committing a ULP on an earnings call by threatening to withhold benefits from unionizing employees. We also cover a recent study showing just how much extra profit Starbucks has raked in during the pandemic, and how little has made it to workers. The NLRB finally responded to Starbucks' massive illegal union busting campaign this week, filing a flurry of complaints against the company for violations of the NLRA. These suits demand the rehiring of several of the worker organizers that Starbucks has fired in retaliation for unionizing, as well as changes to captive audience meetings and even changes to the Starbucks employee handbook. In weirder news, Oscar nominated actor James Cromwell glued himself to a counter at an NYC Starbucks as part of a PETA protest. Finally, we wrap up with a roundup of the results of the 14 union elections since our last episode. BOB [still gasping and ouchy] Oh! Goodness... Um, [gasps in shock] Don't just stare at me! CARMELITA Why not? You're human again. SOUND PULLING THE TABLECLOTH, DISHES RATTLE CARMELITA Stop that! BOB [panicking] But I'm.... nude. CARMELITA As if I have never seen a nude man before. BOB Um.... I've never... BEEN nude before. CARMELITA [with interest, teasing] Oh? BOB You wouldn't have some pants somewhere? CARMELITA I'll go and check. You might want to close the curtains, beefcakes. BOB [panic] Ahh! Jackass he may be, but I can't see leaving him a goat forever. CARMELITA I'll give him a couple of weeks. Then turn him back, let him try and explain what happened. SHERRY I can just see the Judge Judy episode where he tries to sue your pants off. BOB [muttered] Only if you have pants... CARMELITA She would laugh him out of court. "But really, this bitch turned me into a goat for two weeks..." SHERRY She'd say "turned you? [slowing losing it to laughter as she goes along] The defense has a laundry list of witnesses ready to swear you already were a goat..." CARMELITA [laughing almost hysterically] BOB What about me? SHERRY [calming down] Honestly, Bob. I think you'll be fine. BOB But ...work? SHERRY Didn't even miss you. [backpedaling] I mean -- everyone feels you're about due for a mental health day. Or five. CARMELITA But I still don't see how you managed it? SHERRY Simple. You told me all about his moves. His technique. BOB I know. Do guys really DO all that? Just to get-- CARMELITA Shh. We'll talk later, darling. [with feeling] Later. BOB Ulp! SHERRY [chuckling a bit] So it was easy. Once I put the fizzy stuff in his drink, he got all huffy and wouldn't drink it, even though I offered to take it myself. BOB I wouldn't either. [shuts himself up suddenly] CARMELITA And so? SHERRY You said he was big nibbler. I put the real potion all over my neck and shoulders. Didn't take long before - poof! BOB I know you've done me a huge favor here, Sherry, and I owe you plenty, but could you do one last teensy thing? SHERRY [sigh] What's that? BOB Pants? SHERRY Pants? BOB Bring me some? This blanket won't get me home - at least not without being arrested. SHERRY [sigh] Pants it is. CARMELITA Not too quickly. BOB [panicky] Huh? After working with 1000's of different people over the years, Gay has discovered one thing that really surprises him.We get dozens if not hundreds of opportunities on a daily basis to open up to our genius.In the Big Leap he calls this the “upper limit problem.” A lot of people shorten it to ULP.In the new book, The Genius Zone, Gay coined a new term to replace an “upper limit problem.” He calls it an “upper limit opportunity”, or ULO.An ULO is like a sign that says “speed bump, slow down” rather than plowing right over it at 60 miles an hour and rattling your teeth.We get little moments in life, which look like upper limits, but they're really invitations to let your genius shine through.It might sound trite to say to BE IN THE NOW, but a lot of times we get into situations with certain expectations and those expectations either get met or they don't. Either way you go in with a certain energy that doesn't allow the open spaciousness of possibility where you could have something different occur. Gay goes after making the most of every individual moment so that if you have an interaction with somebody that you're not looking forward to, for example, the thing to do is to open up and wonder, “What am I expecting here? What am I afraid is going to happen?” The moment you can do that rather than going into a situation with fixed expectations, you open up a whole new way of relating to the world. Another important point in the new book is Gay's distinction between true creativity and ordinary creativity. From the time Gay was 19 until he was 23, he was a disc jockey at a top 40 radio station. The whole time he worked there he was using his creativity but using it to serve someone else's vision.He made good money but he couldn't wait to get out of a job where other people were telling him what to do. He loves serving his own vision.The moment you begin to say “what do I want to create in the world, how do I want to employ my genius for my own goals and visions?” That's the magic moment. Even entertaining those questions begins to send a new surge of creative energy through your body.In his travels, one thing he's noticed is that people everywhere are suffering because they don't have an outlet for their creativity. They're suffering just as much in Beverly Hills as they are in Berlin or Bombay.Everywhere in the world, it's exactly the same kind of suffering… not being open on a daily basis to your creative genius. One of the legacies that Gay wants to be known for is helping people open up a conversation with themselves about what they really love to do and how could they express that in the world.He's been around the world 37 times and he's seen a lot of people who are not doing that because of economic circumstances or because they're one of 28 children.There's so much suffering on our planet because of lack of connection to our creative expression and Gay wants to make sure that he's spoken to that passionately during his time here on earth.Listen to the whole episode to hear about three more important moves in the book.One is a new way to access creativity by asking yourself something Gay calls a WONDER QUESTION.
