Failure to Plead a Viable Complaint after Four Tries Stops Everything Scott Manley moved the USDC to dismiss the two claims plaintiff Mark Esquibel asserted against him in the Third Amended Complaint (TAC) for wrongful termination in violation of public policy (“Tameney claim”) and for promissory fraud. In Mark Esquibel v. Kinder Morgan, Inc., et al., No. 21-cv-02510-WHO, United States District Court, N.D. California (October 17, 2023) the USDC explained why its patience had been exhausted. ANALYSIS Esquibel asked for leave to amend to assert totally new claims against Manley, including eavesdropping in violation of California Penal Code section 632 and invasion of privacy, harassment under California's Fair Employment and Housing Act (FEHA), and claims for intentional and negligence infliction of emotional distress based on the alleged eavesdropping and harassment.d warned Esquibel that the last order was his "last chance." Ignoring the warning Esquibel tried a new way to allege a case that had nothing to do with his first three tries. His failure ended the court's patience and the order was dismissed. Routine Business Not Protected Work Product In Aerojet Rocketdyne, Inc. v. Global Aerospace, Inc., et al., No. 2:17-cv-01515-KJM-AC, United States District Court, E.D. California (October 25, 2023) an insurance coverage dispute wastes the time of the court and are admonished by the court. FACTUAL BACKGROUND In a long-running insurance coverage dispute that was prolonged for several years by defendant Global Aerospace Inc.'s refusals to produce evidence in response to requests from plaintiff Aerojet Rocketdyne, Inc. The root of the disagreement was Global's assertion of attorney-client privilege and work-product protections. The Magistrate Judge determined the disputed evidence was not protected by the attorney-client privilege or work product doctrine, and the court denied Global's repeated requests to revisit that decision. In short, although attorneys were involved in the disputed investigation, communications with them were not privileged, and their work product was not protected; the investigation was part of the company's routine business. It was not conducted in anticipation of litigation. Several defendants, including Global, have now moved for summary judgment. Briefing is ongoing. The exhibits are excerpts of transcripts from two depositions marked “confidential” under the terms of a discovery protective order. The witnesses were Katherine Posner and Wendy Grossman, two attorneys at the center of the dispute about privilege and work product. The defendants argued the transcripts are “sensitive” and must be sealed because they “would ordinarily be protected by the attorney-client privilege and work product doctrine.” The courts of this country recognize a general right to inspect and copy public records and documents, including judicial records and documents. Although that right is not absolute, a strong presumption in favor of access is the starting point. This presumption is based on the need for federal courts, although independent-indeed, particularly because they are independent-to have a measure of accountability and for the public to have confidence in the administration of justice. When documents are filed with motions more than tangentially related to the merits of a case, such as alongside a motion for summary judgment, a party who asks to keep them secret must meet the high threshold of showing that compelling reasons that support that request. This standard applies even if the documents have previously been filed under seal or are covered by a generalized protective order, including a discovery-phase only protective order. Once confidential discovery documents are made part of a dispositive motion they lose their status of being raw fruits of discovery. From Dr. Keller, we learn that the crux of the matter tends to circle back to two central issues– how the case is shared and intentions behind sharing. Additionally, Dr. Keller shares unique data on the relation between how often a medical device company is mentioned in social media posts, how often physicians are compensated for their public endorsements, and whether or not conflict of interests are disclosed. Dr. Barraza and Dr. Keller then compare TikTok, Instagram, and Twitter's roles and potentials in medicine. The trio discuss Twitter's past, present, and future influences on medical research, networking, innovation, and education. They also consider the need for more clear, comprehensive social media posting guidelines issued by specialty societies and ideas for patient consent forms over social media posting. To wrap up the episode, the doctors discuss interprofessionalism, dealing with social media trolls/negativity, and personal vs. professional accounts. Dr. Keller notes that 85% of the general public turns to social media networks to seek healthcare information, which highlights the online presence of physicians and how they are often held to a higher ethical standard on social media platforms. We have recognized additional factors to justify denying an award of costs, such as their excessiveness in a particular case, the limited value of the prevailing party's victory, or the closeness and difficulty of the issues decided. See Teague, 35 F.3d at 996. Although the losing party's good faith in pursuing an action is a “virtual prerequisite” to receiving relief from the normal operation of Rule 54(d)(1), that party's good faith, standing alone, is an insufficient basis for refusing to assess costs against that party. See id. With these principles in hand, we turn to the district court's denial of costs in this case”)Cherry v. Champion Int'l Corp., 186 F.3d 442, 449 (4th Cir. 1999) (“Champion asserts that videotaping Cherry's deposition was necessary to enhance its chances of effectively impeaching Cherry at trial. While that may be so, § 1920(2), read in conjunction with Rule 30(b)(2), requires more. The concept of necessity for use in the case connotes something more than convenience or duplication to ensure alternative methods for presenting materials at trial. See Fogleman v. ARAMCO (Arabian American Oil Co.), 920 F.2d 278, 285 (5th Cir.1991) (stating that deposition costs reasonably incurred for trial preparation or for use at trial, “rather than for the mere convenience of counsel,” constitute taxable costs under 28 U.S.C. § 1920(2)). While there surely are circumstances when both a videotape and a transcript of a deposition may be necessary, Champion has not made the showing why either a transcript or a videotape would not have been sufficient for the need it identified. We cannot conclude that the district court abused its discretion in concluding, based upon the circumstances of this case, that it would deny both the cost to videotape and the cost to transcribe Cherry's deposition testimony. North Carolina March 31, 2022) (providing examples of when videography is necessary and reasonable above and beyond stenography, saying that videography was taxable where the deponent demonstrated physical gestures and answered questions by pointing to visual exhibits, whereas videography would not be taxed on the grounds of unnecessary expense where the sole purpose was to play video clips for impeachment purposes at trial, since the stenographic transcript would serve that function just as well)Craftsman Limousine, Inc., et al. v. Ford Motor Company, et al., 579 F.3d 894 (8th Cir. 2009) (while 28 USC 1920 doesn't explicitly refer to taxability of videotaping, video depositions are allowed by rule, implicitly authorizing taxation of such costs)Tilton v. This is our base for some wide-ranging travel across the Gulf States and into Southwest Georgia, where we will be catching several high school football games to watch our grandson, Matthew, Play. JENNIFER Yes, it is beautiful down here on the Emerald Coast. But it is also very hot and humid this time of year. The temperatures are in the 90’s and the humidity percentage pretty much matches it. The only place where you can get some relief is if you are on the beach. MIKE And that is exactly where we plan to be this Sunday, Sept. 1 for a meet and greet for our Fellow Travelers who are able to join us on the Gulf Islands National Seashore. We’ll meetup in the first parking lot of the National Seashore, heading west from the Navarre Beach bridge. Show up at 3PM and bring your beach chairs and whatever refreshments you want. We’ll hang out till 6PM when we do our weekly Ask Us Anything live stream on the YouTube RV Lifestyle Channel. Once that’s over, for those who want, we’ll head to a nearby restaurant for dinner. We love doing these meet and greets as we travel and we’ll have some RV Lifestyle stickers to give away and we’ll do tours of our RV. And you can meet Bo, too! JENNIFER Speaking of meet and greets, we’re a little over a month away from America’s largest RV Show in Hershey, PA, and once again, Mike and I will be there. We're back after a week off! Evryman wrapped up their June expedition in Yellowstone National Park and it was incredible. We're heading back to Yellowstone in August. But this one is different. We'll explain more towards the bottom of this post. This week's guest is one rad dude. Brendan Leonard, creator of Semi-Rad.com sits down with Dan and just lets loose. Brendan is also an author, filmmaker, Instagram cartoonist, and public speaker. He has co-produced and co-directed several award-winning adventure films, including How to Run 100 miles, Chocolate Spokes, Ace and the Desert Dog, Frank and the Tower, and The Important Places.
