The number of people representing themselves in family court has dramatically increased in the last 10 years. Official information shows the instances of family court cases involving a self-represented party has steadily grown each year, from 602 at the end of May 2014, to 1,888 at the end of May this year. In this episode, Laura and I get real. We lay out the options available to you for making money out of your art and the various business models you can choose from as a modern-day artist. We debunk the idea of ‘commercial art' being dirty and explain why you must make money to make art.   In this day and age, we have access to tools and technology that have never existed before. It is the best time in living history to be an artist and we need to take advantage of the opportunity. If we don't, it would be doing a dis-service to the artists who paved the way for us.   We share the four options put forward by well-known author Jeff Goins in his book “Real Artists Don't Starve” - commercial art, the patronage model, self-patronage and poverty.   Make commercial art where your art is a commodity which you sell to the market Engage in the traditional artist patronage model where a wealthy benefactor pays for your livelihood while you create your work Choose self-patronage where you find a way to fund your own art practice by getting a second job either in the art realm or outside of the art scene Where the artist chooses poverty and creates art from that struggle   We also dive into the various business models we have seen in the art arena so you can think about how you currently fit in or how you want to fit in: 1. Fine Art Galleries. This is a commercial model where your original work is your only product, and you work with high-end fine art galleries to sell your work. You are represented by a gallery and exclusivity is a factor. They provide you with direction and they take a commission. E.g., Australian artist Wendy Sharpe 2. Retail Galleries. This is another commercial model where you work with galleries such as Art to Art, Fenton and Fenton, Greenhouse Interiors or Jumbled Online. They show your art, stock your art, take a commission. Usually there is no exclusivity. 3. Self-Representation: a. Shop/Gallery. You do not rely on any sort of gallery. You have your own market stall or trade show presence or retail shop. Often you turn your art into products including prints, linen, clothing. E.g., Bromley / Ken Done / Grotti Lotti. b. Online. You do not rely on any sort of gallery. You retail your own original art, prints, products via your own website and online presence. E.g., Tahlia Stanton and Tiff Manuel. 4. Hybrid Model. This is a combination of self-representation and self-patronage where you have a job to fund your practice. Why is self representation so important? Is it as simple as how we're perceived and how we carry ourselves or is it more. And what dictates how we do those things. Often times people look at perception as a first impression, but we can all agree first impression can all be deceiving. Furthermore, you should impress your thoughts, expectations and feelings on a person based off how they look. This doesn't mean you should carry yourself in a manor that is less than what or who you are. You owe it to yourself to find a healthy balance of who you are and how you want to present yourself in a comfortable manor. On this episode, we're joined by Jerrell Gibbs. His vibrant paintings retrace family memories examining the origin of his own life by representing intimate and instantly joyous moments. Affirming the multilayered experience of the African American diaspora Gibbs plunges the viewer into an immersive experience through the realm of his childhood.Growing up in Baltimore influenced his perspective on socio-economics, body politics, race, economic disparities, and their influence on one another. Through his figurative portraits, Gibbs invigorates banal representations of black identity by depicting empathy, inviting the possibility for a spiritual connection. The works are adapted from small Polaroids into life-size paintings. Gibbs works from an archive of hundreds of family photos taken throughout the '70s and '80s from family photo albumsThe Baltimore native graduated with an MFA from the Maryland Institute College of Art, Baltimore, MD in 2020. His work is in the permanent collection of the Columbus Museum of Art, CC Foundation, X Museum, Baltimore Museum of Art, and the Los Angeles Museum of Art. In June 2018, 72 refugee representatives from 27 refugee-hosting countries gathered in Geneva for the first-ever Global Summit of Refugees.

Sadiya Hashmi is a third culture kid. Born in Pakistan, raised in Bahrain, and earned her MBA in the US. She and her family now call Canada their home. My first introduction to her was The Great Canadian Baking Show where she was a contestant. As a fellow homeschool mom, and woman of colour in Alberta, I wanted to connect with her immediately. Sadiya grew up in a culture that valued rigorous education from a very young age. In Bahrain most 3 year olds are expected to be reading and writing. Your education reflected your status. What would happen if she let her kids be? What would happen if she allowed them to learn and develop naturally? We dove into the beliefs homeschool tested for her and her husband. What it means to learn. If the report card defines how smart you are. What she felt school did not give her that she gained later in life. Sadiya is candid and gives a great perspective. One that we don't always hear from in the homeschool community.  Fusion Baking and The Great Canadian Baking Show Sadiya has experienced many cultures, ideas, and tastes. She says you can learn a lot about a culture through food. Baking has been a way for her to bring these experiences together. And a way she can introduce these worlds to her sons. It were her boys that encouraged her to go on the show. They fell in love with the British version of the show and wanted her to audition. She promised her sons that if it ever came to Canada she would audition. And guess what? It came, she auditioned and she made it on! It was her international fusion baking that sold it. Sadiya says The Great Canadian Baking Show is an impactful experience. Her presence is impactful for her boys to see her follow a passion. It is nice to see a homeschool mom well represented. But it is also impactful for girls that look like her to see themselves on TV. We spoke more about the importance of self representation in the media we watch and in the literature that we introduce to our children. Alex Falconi is the creator of the “Our Nevada Judges” website and “The Proper Person” YouTube channel. Alex started his journey as the result of a high conflict custody battle with his ex. His fight lasted nearly eight years but at the end of the case he won full custody and had his ex’s parental rights terminated. This resulted the creation of the website and youtube channel to help people going through similar experiences. Links to find out more! Alex and I met last year and he was the first person I ever interviewed on my YouTube channel. We have remained in contact over the year and this is the first time we’ve been able to meet in person to sit down and chat. Family Court System and Representing Yourself 01:59 - Alex talks about his experience in the family court system and why he represented himself. He talks about how people think you should never represent yourself but that oftentimes it implies it is a choice. Typically it isn’t a choice and you are left with giving up or representing yourself. To represent yourself through a high conflict case it can cost well into the hundreds of thousands of dollars just because it becomes a game for the opponent. He also talks about his experience with the family court system wanting him to be “gainfully employed” and how that could have ruined his career by having to drop out of college. What is the “Our Nevada Judges” website 05:59 - Alex explains the Our Nevada Judges web site and how the idea originally came about. He initially thought the system and laws were the problem but that was until he started winning appeals. Then he started to consider maybe the system wasn’t the problem maybe it was the judges weren’t applying the law correctly. Alex then started to research online to see how many mistakes the judges were making but he realize there was no information available about their records. The problem with the family court system is most people don’t appeal the judges decisions whereas criminals and civil there are routine appeals. The purpose of the site is to compile the data on the judges in the state of Nevada for how often their decisions are reverse. Alex talks about how some of the local judges have an error rate of 50% in having their decisions overturned. It wasn’t a sprint it was a marathon 09:38 - Alex talks about the eight year process it took to fight in family court. It wasn’t a sprint it was a marathon to navigate the family court system, learn the process, and then to start winning appeals for errors made. During this time each appeal typically took six to nine months to get a ruling. Alex also talks about the instance where one appeal was won within three months and how the family court judge was shocked but the result. How long as Our Nevada Judges been active 10:36 - Alex talks about how long the Our Nevada Judges website has been active and how it transitions in the early days to just a handful of judges and attorneys to where it is today. He started the site in May 2014 and how even though it was small it was still used and supported especially during the election cycles. Now the site has election data, term history, election history, results and includes a lot more detail there now within the site. The benefit of this system is how you can look up the data for your family court system to really understand who you are getting and what to expect. People have been able to use the site to do a Peremptory Challenge of Judges to get a new judge for their case. The plans for the future 12:42 - Alex is planning to expand into the political area and is creating a site called Our Nevada Politicians to track the state legislature and the executive branch. This project is going to be more difficult because he won’t be able to rate they based on appeals. Instead the site will focus on their term history, election data, and their articles. He hopes some day to extend both sites to cover all 50 states. To expand into other states though he is going to need people manage and run those sites. A lot of people say they are done and move on 15:01 - Alex talks about how once people are through they are done and don’t want to look back. People are churned through the system and once they get through nobody wants to go back and help the others through. He talks about the pattern he’s seen of people who “didn’t win” where they just gave up because the system failed them. This wasn’t because they fought in trial and lost but instead the system broke them down and they gave up. It’s hard to look at your situation and continue to have hope when everything looks so overwhelming. Alex talks about how originally he didn’t have the confidence to appeal decisions and early on he didn’t. It wasn’t until later that he realized he did have the ability to fight, and win. Every loss with a high conflict ex empowers them 18:42 - Alex talks about how every loss, or perceived victory, with a high conflict narcissistic ex empowers them. It gives them fuel so you really have to pick carefully what you are going to take to court. With these personality types you “have to win” because it makes it worse if you lose. However, sometimes when you lose you don’t really because it gets overturned on appeal. Alex and Duane discuss how you don’t really get “your day in court” its more like your 5 minutes in court. There are so many cases that it is difficult for the family court judge to give more time and attention. Alex also talks about how, even though his judges started to “recognize” him it wasn’t an overall positive. Family Court judges are prone to mistakes because lack of oversight 20:37 - Alex talks about the unique dilemma in Family Court where they are not challenged. In criminal and civil courts there are routine appeals so they are constantly reviewed. In family court people rarely appeal so the family court judges are operating without a lot of oversight. Criminal and Civil courts are getting appealed all the time so they are getting feedback from the Supreme Court. So when no one is watching the judges they become the upon themselves. We have to learn to use the law to our advantage. The only way to guarantee a review of their decision is with an appeal. The “appeal” is the only thing that requires a review other actions “might” be reviewed. You have to make sure you are appealing a mistake that was made but things like temporary orders can not. What are the typical things people want to appeal but can not 23:42 - Alex answers the question of what people lately have bene trying to appeal which is contempt orders. In Nevada within the last ten years a ruling has been made that you can no longer appeal contempt orders you have to challenge them through writ petition. The second most common is people who want to appeal temporary orders. The third most common is when someone wants to appeal a decision that hasn’t been finalized. Helping people to avoid a trap 25:09 - Alex discusses the channel of not providing “legal advice” to people but trying to help them avoid tramps. The goal is to help them so they don’t become jaded and quit the process. What is the most common thing people are able to appeal 25:33 - Alex talks about the 3 things . The first thing is attorney fee sanctions when they lose a case. In Nevada that is not enough and there are specific criteria that has to be met to be forced to pay attorney fees. For attorney fees to be levied against you they have to show you filed without a reasonable basis which is really difficult to prove. The second most common is imputation of income. Judges routinely impute wages on child support that is something in Nevada you can’t do unless you satisfy two criteria that you are willfully unemployed and for the purpose of avoiding child support. How does imputed wages effect the “stay at home” parent 29:41 - Alex talks about how the system in Nevada handles the stay at home parent and how the family court system does show a bias in these situations. He further discusses how the “paying” parent can be seriously effected if there is a change of circumstances and child support needs to be changed. In joint custody situations this law is not being evenly applied. The person who has a job is expected to stay employed and earning money and impact their ability to go to school and increase their earning potential. Couples who work together work as a team and are able to make decisions to improve their lives even if it means making less money, but in family court that routinely is not allowed. Advice for people at the beginning stages 35:06 - Alex provides his thoughts and advice for people just starting out in a high conflict divorce. His first peace of advice is that you should not “wig it” when preparing for a family custody case. A lot of times people feel if something doesn’t “go right” they can go back and fix it later. Court doesn’t work that way, you need to put all of your attention into your case now. Alex also advises you learn as much as you can about the different terms and mechanisms so you understand the process and what is going on. The final piece of advice that Alex offers is this, when it comes down to it what works in court is “the law”. The only thing that controls the courtroom is the law and learning it as best you can is what you need to do. One of the purpose of the channel is to provide those terms are and what all of this means. If you don’t know anything you are going into court with a hand and leg tied behind your back. You have to know as much as you possibly can. The judges don’t have time to help you through the process. You can take a lot more control over your case than you think. Cecilia Bennett considers the use of the English language in black Atlantic narratives. These include Olaudah Equiano's 1789 work, The Interesting Narrative of the Life of Olaudah Equiano, or Gustavus Vassa, the African, Written by Himself, and Andrea Levy's 2010 work, The Long Song. She explores the way in which a tension between the English language and black voice has evolved over time and the extent to which it continues to influence modern thought.

Media and Cultural Representations

This talk by Professor Kerry Mallan of QUT's Faculty of Education will canvass a range of issues relevant to the lives of young people growing up in a network society. In particular, the discussion will draw on a current Australian Research Council (ARC) funded research project as well as other research to illustrate the ways in which youth give accounts of themselves and interact with friends and others in online networks such as MySpace, Facebook, MSN, and blogging sites.
