Trump's 2018 zero tolerance policy which separated immigrant children from their parents at the border with no plan for reuniting them shocked the American conscience. And even though he claimed to cease the practice within weeks, zero tolerance is rooted in American law that dates back 100 years and remains on the books today. It can easily happen again.  Efrén Olivares was on the front lines defending immigrant families, and the work was personal. Efrén himself is an immigrant, and he joins us to talk about his incredible book, My Boy Will Die of Sorrow: A Memoir of Immigration From the Front Lines.   About the Guest Efrén Olivares is the deputy legal Director of the Immigrant Justice Project at the Southern Poverty Law Center. He was the lead lawyer in a successful landmark petition to the Inter-American Commission on Human Rights on behalf of families separated under the zero-tolerance policy. He previously directed the racial and economic justice program at the Texas Civil Rights Project. His writings on immigration policy have been published by the New York Times, USA Today, and Newsweek. He has testified before Congress and at briefings on Capitol Hill about immigration and border policies. He was the first member of his family to attend college. He is a graduate of the University of Pennsylvania and Yale Law School. He is author of My Boy Will Die of Sorrow: A Memoir of Immigration From the Front Lines.

Texas Attorney General Ken Paxton said that ruling “allows Biden to continue his illegal effort to aid the foreign invasion of America.” Elite news media, for their part, suggest we seek a hallowed middle ground between those two worldviews. Corporate media are filled with debate about the best way to handle the “border crisis.” But what if there isn't a border crisis so much as an absence of historical understanding, of empathy, of community resourcing, and of critical challenge to media and political narratives — including that reflected in President Joe Biden's call to allow access for “those who deserve to be here”? AUSTIN, Texas - Civil rights attorney Roberto Lopez does not expect the Biden Administration to come to the aid of immigrants arrested under the sweeping new powers Senate Bill 4 bestows on law enforcement.Lopez, a Rio Grande Valley native, is the beyond borders senior advocacy manager at the Texas Civil Rights Project. TCRP works to defend the civil and human rights of border communities and of those migrating through the borderlands.Lopez spoke about the likely impact SB 4 will have on a recent webinar hosted by America's Voice and Congressman Joaquin Castro of San Antonio.“Two years ago, we filed a complaint with the Department of Justice. We have continued to provide supplemental complaints on all the abuses that we're documenting. We have several probable cause affidavits that are wrong, where DPS officers said that they knew someone was an alien because of how they smelled. And the federal government has not responded to that. The Biden administration is not going to come to our rescue,” Lopez said.If that is the case, what can immigrant families do? Lopez said he and other civil rights leaders will be there to help."What we're going to be doing now is working with our community, helping ensure that everybody knows their rights, documenting abuses from police as they take on these immense and incredible new powers,” Lopez said.“And we will be fighting tirelessly as these bills come into effect in the next few months to just make sure that everybody knows what this legislation does, how they can respond to law enforcement when they're pulled over. And we will be doing our best to document and fight this in court as best we can.”On the webinar, Lopez gave his analysis of Senate Bill 4.“SB 4 will subject millions of people across the entirety of Texas to racial profiling. And that is not some sort of exaggeration. This bill is not limited to the border. It is not limited to immigrants who have recently crossed (the border). This allows any officer in the entire state of Texas with a gun at their hip, to detain and arrest someone who they suspect of being here without papers.”Lopez said there is no clarity from the authors of the legislation on how it should be applied. Roberto Lopez, born and raised in South Texas's Rio Grande Valley, leads the Texas Civil Rights Project's Beyond Borders Program, which works to defend the civil and human rights of border communities and of the people migrating through the borderlands. Inspired by the United Farm Workers movement, the nonprofit Texas Civil Rights Project was founded in 1990. It has taken a strong stand against the illegality of Texas's Operation Lone Star. Beginning in March 2021, Operation Lone Star sanctioned the deployment of National Guard and state police—from Texas and other states—to the Texas-Mexico border. Under the initiative, asylum seekers and migrants are charged with criminal trespassing when they enter Texas. They are then held in state-run prisons. Recently, at least 14 Republican-led states have sent police and National Guard to Texas border communities under Operation Lone Star. Lopez says residents have no idea what policies these out-of-state police are operating under, including their policies on use of force. It's June 2023, and the government just changed the rules again for asylum seekers at the southern border. So what is going on right now at the southern border? We have talked in previous episodes about Title 42, the public health law that was used as a pretext to block asylum seekers from entering the U.S. during the pandemic. On May 12, the administration ended Title 42 and rolled out a new set of policies aimed at reducing the number of asylum seekers who enter the U.S. every day, including requiring people to sign up for a limited number of daily appointments on a mobile phone app. So how is this all playing out for people?In this episode we talk with Laura Peña, Director of ProBar, which is part of the American Bar Association and provides legal services to immigrants in Harlingen, Texas. Harlingen is in the Rio Grande Valley, right across the border from Matamoros, Mexico. Laura is an immigration expert who has held many directing positions, including working at the Department of State under the Obama Administration, and leading the Beyond Borders program at the Texas Civil Rights Project.. Here's what it does.Groups Taking Action:Texas Voter Protection, Texas Civil Rights Project, Mi Familia VotaToday's Script:  (Variations occur with audio due to editing for time) You're listening to the American Democracy Minute, keeping YOUR government by and for the people.It's not yet January and the 2023 election and voting bills are already piling up in Texas like tumbleweeds.  Many of these bills are designed to prevent voter fraud, which already is as rare in Texas as the Jackalope.NBC News and the Texas Tribune report that over 62 bills have been prefiled in the legislature, many designed to increase oversight of elections and step up penalties for voting illegally.   The Houston Chronicle estimates that Texas election officials spent 22,000 hours looking for voter fraud after the 2020 election, resulting in only 16 voters with fraudulent addresses on registration forms.   HB 39 is one of five Republican-sponsored bills which increases voting related crimes from a misdemeanor to a felony.   SB 220 is one of two bills which creates  “election marshals,” similar to Florida's new state police division investigating election fraud.   Florida's force made its first arrests in August, only to have most of the charges dismissed due to the state's own mistakes.While states like Nevada & Alaska recently took steps to use a single ballot open primary system, HB 239 would close Texas primaries, requiring separate ballots for each party.   Open ballot primaries offer voters more choice, give third party candidates a chance, and tend to support centrist candidates, rather than extremists.With a Republican House, Senate & Governor, these restrictions could pass later next year.See articles outlining other proposed Texas voting bills at AmericanDemocracyMinute.org.   For the American Democracy Minute, I'm Brian Beihl.

Texas assigns unusual urgency to Democratic county's election mishapsGroups Taking Action:Texas Organizing Project, Texas Civil Rights Project, Mexican American Legal Defense & Education Fund (MALDEF) Today's Script:  (Variations occur with audio due to editing for time) You're listening to the American Democracy Minute, keeping YOUR government by and for the people.There is still a lot of finger pointing in Harris County, Texas, after widespread November 8th ballot shortages and other problems.   While partisan accusations and a lawsuit have been leveled, it appears that a combination of lack of preparedness and voting machine problems were the problem, not fraud.The Washington Post and Votebeat Texas report that Harris County's system didn't have enough paper ballots in at least 23 of its 782 polling places.   When precinct officials called for additional ballots, knowing they would run out, resupplies ran out or didn't arrive for hours.  The shortage reportedly resulted in hundreds of voters being turned away.Complicating matters, Harris County doesn't have common problem reporting software which could help monitor problems at polling places.  Such a system could have helped distribute ballots to places which needed them.   One precinct in Houston initially couldn't get its 60 voting machines to work in the morning, forcing a delay in opening.  Election officials noted it was human error, not a conspiracy.The Harris County GOP filed a lawsuit, claiming that the lack of ballots disenfranchised voters, and one GOP election official claimed Harris County election officials intentionally withheld ballots for partisan reasons.  Democrats pointed to problems in heavily Democratic precincts, too.  State police are investigating, and Harris County is conducting an internal review to assess just how many voters were disenfranchised.We have links to articles and resources at AmericanDemocracyMinute.org  For the American Democracy Minute, I'm Brian Beihl.

On Friday, federal authorities issued an internal bulletin that warned of the potential for violence from domestic extremists during the midterm election season.The same day, a federal Judge in Phoenix refused to stop a group from patrolling outdoor ballot boxes. Members of the group have been showing up heavily armed, often masked and wearing tactical vests. Critics say this is intimidating voters. The judge said that barring the group would violate their constitutional rights.From election deniers who continue to insist without evidence that the 2020 election was stolen, to a flood of recent state laws that make voting more difficult, for many Americans, voting feels much more fraught. The House select committee investigating the insurrection is reportedly soon going to seek an interview with Virginia Thomas, the wife of Supreme Court Justice Clarence Thomas. She was found to have lobbied former White House Chief of Staff Mark Meadows to pursue a plan to overturn the 2020 presidential election, sending 29 texts on the subject. Immigration advocates, lawmakers, and health officials are urging President Biden to overturn Title 42, a Trump administration policy used to block migrants at the borders from seeking asylum due to COVID-19. Karla Marisol Vargas, an immigration attorney at the Texas Civil Rights Project, joins us to discuss the policy and the legal battles against it. Monday marked the start of in-person early voting in Texas ahead of the state's March 1st primary. Texas is just one of nearly 20 states that will hold elections this year with more restrictive voting laws in place, a result of Republican-led efforts to validate former President Trump's lies about the 2020 presidential election. President Biden presided over the launch of his virtual “Summit for Democracy” on Thursday. Biden warned the more than 80 leaders of democratic nations that the threat to democratic forms of government is pressing and all “the date we're seeing is largely pointing in the wrong direction.” The statements may have fallen a little hollow as the U.S. is one of the nations that has been newly placed on the list of nations considered democratic backsliding nations. While the White House put out a list of actions it says its taken to protect the vote, one lawyer from the Texas Civil RIghts Project told The Guardian, “you have to be kidding me,” the actions are nothing but “minor tweaks on the edge of the problem.”  Angela Merkel's 16 year reign as German chancellor came to an end this week as the new chancellor from the Social Democratic Party (SPD), Olaf Scholz, took the oath of office. He will lead a coalition between the SPD, the Greens, and the libertarian inclined Free Democrats. Scholz will be the first chancellor to lead a cabinet to include as many women as men. The coalition also has ambitious plans to fight climate change by phasing out coal and prioritizing renewable energy.  And this little ditty from The Independent: “Patagonia CEO Ryan Gellert has called out big businesses for their alleged duplicity on the climate crisis as well as their opposition to the Biden administration's ambitious Build Back Better Act. 'The [corporate] sector has historically been full of s***, and the sector is still full of s***,' Mr Gellert told Fast Company on Monday." Workers in Buffalo, NY become the first to get a union at a Starbucks. UAW workers win the right to directly elect their leadership, bringing new measures of rank-and-file democracy to a powerful union.  Canada bans conversion therapy and France moves to make it a criminal offense. All I want for Christmas are legislative maps!  Maps, maps and more maps!  The Pennsylvania House Republicans released their congressional map drawn by former Lehigh County Republican Commissioner Amanda Holt.  It's a solid GOP gerrymander.   Then Senate Democrat Sharif Street released a “compromise map” that's a 6-11 GOP Gerrymander.  Why?  Well, that map places a congressional district in his backyard and would set up a potential primary between Congressman Brendan Boyle and Sharif Street. State and national Democrats are pissed to say the least, calling the map a non-starter. Lastly, the Legislative Reapportionment Committee, which is responsible for drawing the state house and senate maps, is getting ready to release their maps and vote on them in the coming weeks.  The AP reported this week that Pennsylvania's right-wing billionaire Jeffrey Yass is looking to spend $20 million on his endorsed candidate for Governor and all the usual suspects from the Commonwealth Foundation and the Commonwealth Partners are at the center of it.      Hospitals in rural PA are facing are sounding the alarm in the face of rapidly increasing COVID cases. According to PennLive, “Geisinger hospitals throughout north-central Pennsylvania are operating at well over 100% percent of their capacities, with unvaccinated COVID-19 patients responsible for most of the strain.”  The Philly Inquirer reports that COVID hospitalizations are at the highest rate since January - the peak of the last COVID surge.  Scientists just discovered a planet that is 11 times as massive as Jupiter orbiting a dual star system, the b Centauri system. The discovery is changing scientists' understanding of the conditions under which planets can form.

  On this episode, we look at how nonprofits can continue to advocate for a fair and safe election during election days. We intentionally say “days” because many states are offering vote-by-mail (“VBM”, also known as “absentee voting”) or offer early in-person voting well before Nov 3rd, 2020. States took these measures to mitigate some of the challenges presented by the COVID pandemic that we talked about in Part 1 of this series.     Our attorneys for this episode   Leslie Barnes  Tim Mooney  Quyen Tu    Shownotes  Because voting doesn’t just happen one day this year, here are things that 501(c)(3)s, as trusted messengers, can do during the voting days to support a free and fair election.    Encourage people who are not at high-risk to COVID-19 to step up and work as poll worker and early voting officials More Than a Vote - https://www.facebook.com/watch/?v=322130045738998  Educate your community and constituents about their different voting options. It is important to note that these rules will vary by states and sometimes even by counties!  Preparing for in-person voting  Vote-by-mail rules and deadlines  Provisional ballots and what that means    Facilitate voting by offering rides to polls, childcare services, translation services, pay off fines.  Promote election protection: be a poll monitor or staff voter protection hotline.  Have a game plan to address voter intimidation.  Help people understand that we likely won’t have definitive elections results the night of Nov. 3rd, especially in close races.  Litigation  Mobilize public support for safe and fair election (including protests) when anything happens that will prevent voting or the administration of voting.   A special note for private foundations:  It’s not too late, you can fund all nonpartisan efforts except for voter registration drives. In this episode, I interview Robert Lopez, a community organizer with the Texas Civil Rights Project, one of several groups suing the Department of Homeland Security to stop it from detaining unaccompanied minors in hotels and deporting them without a court hearing. Activists like Lopez charge that the Trump Administration is using the COVID-19 pandemic as an excuse to expedite the deportation of children and asylum seekers at the border. Deportation has long been a lucrative business for private companies under contract with Immigration and Customs Enforcement (ICE), from providing deportation flights to now allowing minors to be housed in hotels. Activists are calling these hotels "black sites", especially because ICE is not providing information about the whereabouts of children under federal custody. Since the story broke last week, the Hampton Inn & Suites is no longer doing business with ICE, according to the Hilton hotel chain.

In this special episode, Laura Gomez-Horton explains how the mental effects of the COVID-19 crisis are showing up and we talk about how to take care of yourself. About Laura Laura Gómez-Horton is a licensed Clinical Social Worker and Board-Approved Supervisor through the Texas State Board of Social Work Examiners. She received a Bachelor and Master of Social Work from the University of Texas at Austin in 1996 and 1997, respectively. She is currently the clinical director at the YWCA Greater Austin whose adopted mission is “eliminating racism, empowering women, and promoting peace, justice, freedom and dignity for all.” Laura has extensive experience providing bilingual services and working with individuals, children, families, and groups in the areas of domestic violence, sexual assault, depression, anxiety, PTSD, immigration, parenting, cultural identity, prenatal/postnatal mental health, grief and loss, and self-advocacy. Previously, as the Social Services Coordinator at the Texas Civil Rights Project, Laura established the social services program for their statewide offices and developed the Austin Promotora program, a grassroots self-advocacy group comprised of women who had qualified to adjust their legal status in the U.S. as authorized by the Violence Against Women Act (VAWA). She also worked at the School of Social Work at the University of Texas at Austin as part of the clinical faculty and provided therapeutic services through SafePlace (now the Safe Alliance), a local non-profit addressing issues of domestic violence and sexual assault in Austin. In addition, she provided therapeutic bilingual services through independent practice and co-founded Within Your Reach/A Su Alcance, a program providing bilingual personal-development workshops. Her experiences in the Austin area culminated in developing a focus on providing therapeutic services and advocating for clients who are Spanish-speaking, immigrant, and/or marginalized. Laura has participated in training videos, and various English and Spanish-language radio and television news interviews discussing mental health issues and current events impacting the community. She has provided extensive presentations/workshops and has developed, coordinated and facilitated various therapeutic and support groups. She currently co-facilitates the monthly dialogues on Issues of Racism and Discrimination at the YWCA Greater Austin. Laura is also a Member of National Association for Social Workers (NASW) and sits on the advisory board for the R.E.A.L. (Social Justice) Committee for NASW-TX. She also sits on the board for Wells Branch Elementary PTA and Lone Star Victims Advocacy Project. For 13 years, she has been an attorney, public servant, advocate, and criminal justice reformer. She currently works as the Director of Legal Affairs for Harris County Commissioner Rodney Ellis in Precinct One, where she helped draft and finalize the settlement in the misdemeanor bail reform lawsuit, ODonnell v. Harris County. Immediately before this, she was the Director of Criminal Justice Reform at the Texas Civil Rights Project. As the director, Natalia was counsel and advocate for hundreds of parents along the United States-Mexico border after being forcibly separated from their children under Trump's unlawful family separation policy. She also settled TCRP's debtor’s prison lawsuit against the City of El Paso to end the City’s practice of incarcerating people for their inability to pay traffic tickets, expanded the project’s investigations against the Texas Department of Criminal Justice and its cruel treatment of its prisoners in solitary confinement, and worked with local partners to decrease criminalization of juveniles who interface with the criminal justice system. Her opponent is incumbent George Powell in the Democratic Primary. Arlene Hecht is running unopposed in the Republican Primary. Sema Hernandez: I am the daughter of immigrants. The sacrifices my parents and grandparents made are part of what fueled my decision to run for the U.S. Senate. I grew up in a migrant working family, and I understand the struggle of people who are burdened by crushing debt, job insecurity, environmental racism, and lack of healthcare coverage. These are the common struggles of the working class. I worked in acute healthcare for six years, caring for insured and uninsured patients. Through my background in healthcare, I experienced first-hand the flaws of our healthcare system. As a mother, I became a volunteer baseball coach and a volunteer organizer for local baseball organizations, where I served on the board of directors. Our 2018 primary campaign for U.S. Senate was historic, promoting progressive issues, policies, and solutions. A lot has happened since US Attorney General Jeff Sessions announced in May a “zero tolerance” policy for illegal crossings at the southwest border. The family separation policy that contributed to dividing nearly 3,000 children from their guardians was halted and now the US government is working to reunite families. In this episode, Mimi Marziano, president of the Texas Civil Rights Project, talks about why she thinks the situation is a “horrendous human rights crisis” that’s far from over. Her organization is representing 381 of the families who have been affected by the separation policy. Jeffrey Rosen, host of “We the People,” moderates a panel discussion at the Aspen Institute’s Ideas Festival about the Supreme Court’s momentous recent term. Note: This event was held several hours before Justice Anthony Kennedy announced his retirement from the Court. Emily Bazelon is a Lecturer in Law and Senior Research Scholar in Law at Yale Law School. She is also a staff writer at the New York Times Magazine Judge Nancy Gertner is a senior lecturer at Harvard Law School. The political trial of Fethullah Gülen, a moderate Turkish religious scholar and leader, at the turn of the 21st Century, helped greatly to expand civil liberties and strengthen democracy in Turkey. The trial began in 2000 in an Ankara state security court (now disbanded) and ended in 2008 in an appeals court in Gülen’s favor. Jim Harrington explores Gülen’s trial, examines the evolving process of Turkey’s efforts to enter the European Union, and discusses ways that the EU’s insistence on expanding civil liberties in Turkey and reforming the judicial system affected the outcome of the trial (and vice versa). He also discusses how the Gülen movement has helped the progress of democracy and civil society in Turkey and its prospects for the future, especially in light of the current government’s sustained attacks on civil and human rights generally, and on Gulen himself and Hizmet in particular. Harrington provides helpful in-depth background information for understanding the Gülen-related Hizmet movement in Turkey and around the world and the civil society movement it fosters, as well as reasons for opposition to the movement, especially in Turkey. James C Harrington, a human rights attorney with nearly four decades of experience, is founder and director of the Texas Civil Rights Project. He graduated from the School of Law at the University of Detroit, from where he also holds a Masters in philosophy. He has taught at the University of Texas School of Law as an adjunct professor for twenty-six years. Harrington has handled landmark civil rights cases, written and published widely, and served on human rights delegations in different areas of the world.Jim Harrington was born in Lansing, Michigan, and received his law degree in 1973 from the University of Detroit, from where he also had earned a Master’s degree in philosophy (1969)
