The Evolution of Tort Law: From Contributory Negligence to Comparative JusticeThis conversation delves into the complexities of tort law, focusing on the evolution of defenses and liabilities. It begins with an overview of torts, emphasizing the importance of understanding defenses in legal education. The discussion transitions from historical concepts like contributory negligence to modern approaches such as comparative negligence, highlighting key doctrines like assumption of risk and various immunities. The conversation also covers vicarious liability and joint and several liability, providing a comprehensive framework for analyzing tort cases. In the realm of tort law, the journey from rigid, all-or-nothing rules to more nuanced standards of justice is a fascinating one. Historically, the doctrine of contributory negligence was unforgiving. Imagine being 1% at fault in an accident and receiving nothing in damages because of it. This harsh rule left many plaintiffs without recourse, prompting a shift towards fairness. The introduction of comparative negligence marked a pivotal change. This system allows for damages to be apportioned based on the relative fault of each party, ensuring that even those partially at fault can receive compensation. The transition wasn't swift; it evolved over decades, influenced by landmark cases and legislative changes. One of the most illustrative cases is Butterfield v. Forrester, where the court's decision highlighted the severe implications of contributory negligence. However, the doctrine of last clear chance emerged as a counterbalance, allowing plaintiffs to recover if the defendant had the final opportunity to avoid the harm.Today, the majority of jurisdictions have adopted some form of comparative negligence, with variations like the 50% and 49% rules, which determine the threshold for recovery. This evolution reflects a broader trend in the legal system towards balancing fairness with the need for clear, predictable rules. As we continue to navigate these legal waters, the challenge remains: how do we ensure justice while maintaining the integrity of the legal system? This question is at the heart of tort law's ongoing evolution.Subscribe now to stay updated on the latest in legal education and insights.TakeawaysThe entire ball game often hinges on surviving the defenses.Contributory negligence operated as a complete bar to recovery. The last clear chance doctrine allows recovery despite plaintiff's negligence.Comparative negligence apportions damages based on relative fault.Immunities are shields that protect certain defendants from liability.Vicarious liability holds employers responsible for employees' actions.Joint and several liability allows plaintiffs to recover full damages from any defendant. The discretionary function exception protects government actions from liability.Assumption of risk can be primary or secondary, affecting recovery. The evolution of tort law reflects a shift towards more flexible standards.torts, contributory negligence, comparative negligence, assumption of risk, sovereign immunity, vicarious liability, tort law defenses, legal education, law students, liability
A scandalous Netflix documentary called an unconventional sex-based therapy business an “orgasm cult,” all based on a sole source whose account has several flaws. But the Court of Appeal dismissed the defamation case on anti-SLAPP grounds. Tim and Jeff discuss whether any California defamation case against a media company could survive the one-two punch of anti-SLAPP and NY Times v. Sullivan. They also discuss California's unique approach to standing—it's not jurisdictional, it's purely pragmatic.Anti-SLAPP meets documentary defamation: OneTaste Inc. v. Netflix illustrates how courts evaluate actual malice when the plaintiff is treated as at least quasi-public, and how journalistic discretion can sink a claim even where the plaintiff says it provided contrary evidence before publication. Tim flags the built-in squeeze: if public-figure status and the controversy are intertwined, the plaintiff may need discovery to prove merit, but cannot get discovery without first showing merit.Standing without injury, by design, not accident: Kashanian v. National Enterprise Systems tees up a standing fight over technical FDCPA disclosure issues, think small-font compliance, with no alleged real-world harm. The takeaway is not subtle: in California, legislative authorization can do a lot of work, and no harm does not necessarily mean no case. When the statute creates the bounty, sanctions become the guardrail: The hosts debate whether CCP 128.5 and CCP 128.7 actually deter nuisance filings when the underlying enforcement scheme invites penalty-driven litigation. Is it appropriate—or wise—to use our courts as civil bounty enforcement, devoid of any harm requirement?Juror privacy is real, ask the team that wrote the $10,000 check: Don't research prospective jurors on social media.Minute entry, real consequences: A timing skirmish over whether a minute entry can function as an appeal-triggering order ends, for now, with the U.S. Supreme Court declining review. Be conservative in calculating the time to appeal
For decades, Alzheimer's research has focused on clearing amyloid plaques from the brain. But new drugs that successfully remove plaques have proven clinically "underwhelming", leaving the field searching for alternative approaches.Stanford neurologist Katrin Andreasson has spent twenty years pursuing a different path—investigating how aging triggers an energy crisis in the brain's immune and support cells. Her work reveals that inflammation and metabolic dysfunction in microglia and astrocytes may be the real drivers of Alzheimer's pathology. Most remarkably, her recent research—supported by the Knight Initiative for Brain Resilience here at the Wu Tsai Neurosciences Institute—shows that targeting inflammation in the peripheral immune system—outside the brain entirely—can restore memory in mouse models of the disease. While human trials are still needed, Andreasson's findings offer fresh hope and demonstrate the critical importance of supporting curiosity-driven science, even when it challenges prevailing dogma.Learn More:Alzheimer's Association honors Katrin AndreassonResearch links age-related inflammation, microglia and Alzheimer's DiseaseQ&A: How the aging immune system impacts brain healthRethinking Alzheimer's: Could it begin outside the brain? Why new Alzheimer's drugs may not work for patientsParkinson's comes in many forms. If you've ever felt the benefit of a loved one's warm embrace when you're feeling stressed or sad, it might not surprise you that strong relationships can do wonders for your wellbeing. Research over the years has shown that people with strong social ties tend to be healthier, but a 2025 study, published in Brain, Behaviour and Immunity now suggests that it could also slow down the ageing process. Researchers in the United States came up with a measure called 'cumulative social advantage', which takes into account the benefits of maintaining strong, supportive relationships over time, rather than just newer relationships. They looked at things like support from parents growing up, participation in the community, and ongoing support from friends and family. People who had these things were more likely to have a younger biological age and less inflammation in the body. Co-author of the study, Anthony Ong, says "Think of social connections like a retirement account. The earlier you start investing and the more consistently you contribute, the greater your returns". So, how are friendships so powerful? Humans have evolved over hundreds of thousands of years as social beings – we're wired for connection. For our ancestors, being part of a group wasn't just about having company, it kept us safe and made it easier to find and share food and raise offspring. And it now appears that these connections affect our bodies on a biological, cellular level. While it is always good to make new friends, there is often a greater sense of trust and dependability with people you've known for a longer time," says Hillary Ammon, a clinical psychologist at the Center for Anxiety and Women's Emotional Wellness. Of course, maintaining relationships as we get older can be difficult as people closest to us move away, or prioritise other things. Hillary says not to worry if your friends are newer, as connection is what really matters. A strong network of friends not only adds years to your life, it adds life to your years.“虽然结交新朋友当然很好,但与认识更久的人往往更容易建立深度的信任与可靠感。”
On this episode of Vitality Radio, Jared takes on a fear-based narrative that has been circulating widely in the natural health space—claims that supplements are “toxic,” “fake,” or made from alarming industrial sources. Using vitamin D3 and vitamin K2 as the focal point, Jared breaks down where tiny fragments of truth have been exaggerated into misleading conclusions, and why that kind of half-truth can be more dangerous than an outright lie. If you've ever felt confused or alarmed by supplement claims on social media, this episode will help you develop a more grounded, critical framework—one rooted in physiology, context, and practical application rather than ideology or outrage.Products:Vital D3/K2 High PotencyVital D3/K2Buy D-Mannose Powder and get CranActin FREE ($20 value) - Vitality Radio POW! Exit Interview: Sixth Juror on Survivor 49 Rob Cesternino (@RobCesternino) interviews the latest castaway voted off the Survivor 49 island, followed by This Week In Survivor History with Jordan Kalish (@JordanKalish) where Rob plays against an RHAP patron. Survivor 49 is back with Rob Cesternino leading an in-depth Exit Interview after one of the wildest Tribal Councils of the season. Rob is joined by Steven Ramm, known as the rocket scientist, who shares his firsthand account of what went wrong when the votes suddenly flipped against him. This episode dives deep into trust, shifting alliances, and one big plan that unraveled just when Steven thought he was safe. Rob and Steven break down all the chaotic events after Immunity, including the confusion over the “Knowledge is Power” advantage and the shocking moment when Sage and Kristina chose to betray Steven. Listeners get an insider perspective on the signs of betrayal Steven noticed, why he stuck with his original plan, and how Survivor's unpredictable alliances can change the game in an instant. Steven recounts the uneasy feeling he got when Kristina and Sage had secret beach discussions without him—setting off alarm bells. Rob asks Steven to reflect on whether playing his advantage actually put a bigger target on his back, and if not having it could have kept him in the game. Steven reveals why he didn't trust Yellow Sophi after being lied to, and instead saw Savannah as a more reliable, if dangerous, ally. The duo explores how Rizzo's idol theatrics might have annoyed the jury and why Steven didn't see Rizzo as a big endgame threat from his vantage point on the island. Steven opens up about the complexity of working with allies who didn't always seem to “play basketball the same way,” and how missed connections led to his blindside. Heading into the finale, Rob and Steven weigh whether the tight alliances on the other side have made it impossible for underdogs to make a comeback. And Dr. Roger Seheult shares how vitamin D, rest, and gentle exposure to heat and cold can help the body build resilience and fend off infection. In this episode of Biotech 2050, host Alok Tayi sits down with Jay Hartenbach, President & COO of Diakonos Oncology, to unpack one of the most unconventional—and promising—approaches in cancer immunotherapy today. Jay traces his journey from biomedical engineering into biotech operations, sharing how Diakonos was built outside the traditional venture playbook and why the company chose to tackle two of the most punishing cancers first: glioblastoma and pancreatic cancer. He reveals how Diakonos' dual-loading dendritic cell platform creates an exponentially stronger immune response—essentially tricking the body into launching a viral-level attack against cancer. From capital-efficient clinical execution to nontraditional fundraising and early signs of durable patient responses, this conversation offers a rare, behind-the-scenes look at how bold science, disciplined operations, and relentless persistence can reshape what's possible in oncology. Biography: Jay Hartenbach is a distinguished leader in the biotechnology and wellness sectors, known for his passionate commitment to advancing innovative healthcare solutions and transforming patient outcomes. He currently serves as President and Chief Operating Officer at Diakonos Oncology, where he is leading the team through the development and clinical advancement of pioneering immunotherapies targeting some of the most difficult-to-treat cancers, including glioblastoma and pancreatic ductal adenocarcinoma. Since joining Diakonos Oncology, Jay has been instrumental in achieving significant milestones such as attaining FDA Fast Track and Orphan Drug Designation for the company's lead candidate, DOC1021, securing greater than $30 million in financing, and establishing research collaborations with leading cancer centers to advance the clinical trials of the company's novel dendritic cell vaccine platform. Before his role at Diakonos, Jay co-founded Medterra, a globally recognized wellness company that set industry standards for quality and innovation, and where he continues to serve as Chairman of the Board, shaping high-level strategic direction. He also co-founded Perland Pharmaceuticals, an early-stage biotech firm focused on developing therapies for arthritis conditions, and has held leadership and board advisory roles across several life sciences ventures. Jay holds a degree in biomedical engineering from the University of Miami and a Master of Engineering Management from Duke University, grounding his entrepreneurial leadership with scientific expertise.

280: Today I'm joined by Aaron Siri, Managing Partner of the law firm Siri & Glimstad LLP and a leading voice in the vaccine safety movement. He takes an evidence-based approach to the world of vaccinology, and is presenting a practical look at why vaccines have become more like religion than science. If people were given a resource that laid out the chronology of immunization, would they still vaccinate? Billions of people, all across the world, have either received a shot or been recommended to get one. And every day, novel injections are being developed, tested and rolled out to the public. While many are refused proper informed consent, others remain ignorant to the dangers of these products because of censorship. That is why Shaz Khan has written a tool, referencing over fifteen hundred years worth of information, pertaining to the timeline of vaccination. This essential resource is made for everyone — whether a parent or practitioner, student or scientist, representative or researcher. Find out more about its release with Shaz Khan and Paul Thomas on “Pediatric Perspectives” this week!

Send us a textWhat if your immune system could learn to stand down the moment your heart felt safe? We dive into the quiet power of the thymus—nestled behind your breastbone and aligned with the heart chakra—and unpack how this small organ teaches T cells what to attack and what to leave alone. When heartbreak, loss, or chronic stress hits, that lesson blurs, and the body can slip into hypervigilance, shallow breathing, and autoimmune flares. We connect the dots between emotional memory, the heart's intrinsic nervous system, and the flare patterns many women see during perimenopause and menopause.Together, we map why adverse childhood experiences train the body to scan for danger and how that pattern can carry into adult relationships and hormone balance. You'll hear how the heart's “memory” shows up physiologically, why modern medicine rarely targets the thymus directly, and where complementary practices can fill the gap. We talk candidly about autoimmunity—lupus, rheumatoid arthritis, MS, IBD—and why symptoms often intensify during times of grief or reminders of past harm. Then we get practical. You'll learn step-by-step, accessible tools to bring your immune system back toward tolerance: gentle thymus tapping with safety-centered affirmations, heart-focused breathing to lengthen the exhale and engage vagal tone, and simple Reiki-style hand placement to soothe the chest and upper back. We also share compassion journaling prompts that shift the nervous system from self-surveillance to self-support. For women navigating midlife, we outline how shifting hormones interact with stress and why restoring heart-centered safety can reduce flare risk.Want to go deeper? As part of our Hidden Killers 2025 Year in Review series, we're going beyond the headlines to examine the psychological machinery behind one of the most explosive celebrity trials of the decade — Sean “Diddy” Combs and the disturbing allegations that have shattered his empire. In this powerful two-part special, Tony Brueski is joined by psychotherapist Shavaun Scott to break down the alleged behavioral profile of Diddy — not from a place of gossip, but through a clinical lens. Scott explores whether Combs' reported actions align with narcissistic personality traits, psychopathic tendencies, and patterns of coercive control often seen in long-term cycles of abuse. From alleged emotional domination and financial control to threats, surveillance, and sexual coercion, Scott unpacks how power and pathology intertwine — and how high-profile abusers weaponize influence, fear, and fame to keep victims silent. It's a chilling look at how manipulation can masquerade as charisma, and how the psychology of celebrity can distort accountability on a global scale. Then, in the second half, Tony delivers a full breakdown of the most pivotal week of the Diddy federal trial (June 12–16, 2025) — a stretch of testimony and evidence that could decide whether the hip-hop mogul spends life in prison or walks free. Among the bombshell moments: Six firearms with defaced serial numbers found near alleged “freak-off” supplies. Homeland Security's discovery of AR-15 parts, drugs, and lubricants allegedly tied to a sex-trafficking operation. The emotional testimony of “Jane,” who confronted Diddy in court after describing years of abuse and coercion. Immunity witness Jonathan Perez, Diddy's former assistant, whose drug procurement testimony both strengthened and complicated the government's case. Kanye West's surreal courthouse appearance, adding a spectacle to an already volatile trial. And the controversial dismissal of Juror #6, a decision now under scrutiny for potential bias. Together, these two lenses — the psychological and the procedural — reveal the full picture of a man once untouchable, now facing the reckoning of his own creation.

Twice a year, 40 scientists gather together for five days to decide what strains of influenza to vaccinate against for the next flu season. It takes around six months to prepare the vaccine – which usually includes protection against three different strains of flu. Europe and the US are heading into a flu season that some are warning could be particularly severe this winter. While even as summer approaches in Australia, the country is still registering high numbers of cases after a record-breaking flu season earlier in the year. So how does the process of deciding on a flu vaccine each year actually work? And does what happens in the southern hemisphere influence the way the virus circulates in the northern hemisphere? In this episode, we speak to Ian Barr, deputy director for the WHO Collaborating Centre for Reference and Research on Influenza, based at the Peter Doherty Institute for Infection and Immunity, part of the University of Melbourne. Barr is one of those 40 scientists who attend the meetings to decide what strains to focus vaccination efforts on. This episode was produced by Mend Mariwany, Katie Flood and Gemma Ware. ALL ABOUT THIS WEEK'S SERIES Welcome to The Roman Power Code: 7 Days to Inner Authority and Calm. If you've ever felt your energy drain away in a stressful situation, if your hands shake before a presentation, or if you struggle to maintain focus under pressure, this series is for you. We often try to solve problems of confidence and anxiety with our thoughts—we argue with our inner critic, we try to logically reason our way into feeling secure. But the ancient Romans understood a profound truth: Your body is the source of your authority. The Roman Empire was built on more than just discipline; it was built on an embodied presence that they called Gravitas—a personal weight, seriousness, and undeniable importance. This journey is a practical masterclass in self-command. By the end of this series, you won't just feel more confident—you will have a physical, repeatable, and accessible code to embody that confidence whenever you need it. This is day 6 of a 7-day meditation series, The Roman Power Code: 7 Days to Inner Authority and Calm," episodes 3416-3422. YOUR WEEKLY CHALLENGE: Intentional Micro-Posturing Quest: Check your posture, adjust your shoulders, back, relax your jaw, and hold the Gaze of Authority (steady, calm eye contact). This challenge forces you to consciously apply the Roman techniques in low-stakes situations, building the neural pathways for Embodied Power to become automatic.
