On this episode of the Berkeley Technology Law Journal, we sat down with Professor Rebecca Wexler to discuss the intersection between reproductive justice and data privacy. In June 2022, the Supreme Court issued a ruling in Dobbs v. Jackson Women's Health Organization. Dobbs overturned Roe v. Wade and Planned Parenthood v. Casey's holdings that the US Constitution grants a right to an abortion. Shortly thereafter, Professor Wexler co-authored with Professor Aziz Huq an article in the New York University Law Review titled “Digital Privacy for Reproductive Choice in the Post-Roe Era. Today, Professor Wexler reflects on that piece and on the need for an evidentiary privilege to shield reproductive data from use in criminal investigations. We hope you enjoy the podcast. With the recent SCOTUS Dobbs decision, Christians who have long been declaring abortion to be Biblically condemned rejoiced as their conservative theology was validated. But does the Bible actually explicitly condemn abortion? In her book, "Abortion and the Christian Tradition: A Pro-Choice Theological Ethic," Margaret Kamitsuka uses rigorous academic research to debunk the assumption that the Bible is inflexibly anti-choice, examining the patriarchal structure that early church leaders established and that contemporary church leaders reaffirm to oppress and dehumanize pregnant people. ABOUT MARGARET Margaret Kamitsuka is Professor Emeritus at Oberlin College in Ohio. After getting her PhD in theology from Yale University, she taught at Oberlin College for over 20 years, where she focused on courses in gender and religion. Now she does research and writing in the area of theological ethics--specifically reproductive issues. Her most recent book is titled Abortion and the Christian Tradition: A Pro-Choice Theological Ethic, published in 2019. She is the executive director of the New Mexico Religious Coalition for Reproductive Choice, the local connection to a national community of religious organizations and faithful individuals dedicated to achieving reproductive justice through education, organizing and advocacy. NM RCRC seeks to elevate religious voices wherever faith, policy and our reproductive lives intersect. Joan is currently working with clergy and faith leaders across the state to shift the conversation about abortion toward compassionate support of women's access to a full range of reproductive health services including abortion. Joan graduated from the University of New Mexico in 1984 with a bachelor's degree in education and worked as a teacher for 15 years prior to her work with NM RCRC. She lives in Albuquerque, NM with her partner of 25 years. She is the parent of two grown children and enjoys spending time with her grandchildren. Unable to financially manage, this single-mom searches for abortion care providers across the U.S. to terminate her pregnancy. A practicing Christian, she is referred to a Dallas-based travel program at a local church that shepherds people to New Mexico to receive abortion care. The group shepherds up to 20 individuals twice a month to New Mexico to terminate their pregnancies. The ways in which abortion is often publicly debated can result in the harmful depiction of the experience of ending a pregnancy in overly simplistic terms. Rev. Katey Zeh, CEO of the Religious Coalition for Reproductive Choice, and Author of A Complicated Choice: Making Space for Grief and Healing in the Pro-Choice Movement, talks to us about her new book, the myths and stigma that people must wade through when getting an abortion, and the vast amount of feelings and experiences many people may have when accessing care. A Complicated Choice chronicles the complicated feelings that people have around their abortion experiences. Overall, the book highlights how people can make decisions surrounding abortion and have a lot of nuanced, complex feelings around it—but that doesn't mean that it wasn't the right decision. In addition, many people experience internalized abortion stigma, due to far-reaching myths and rhetoric spread by those who are anti-abortion. This stigma can often display itself as a sense of isolation in one's experience. White Christian nationalism intertwines greatly with the stigmatization of and logistical attacks against abortion. ABORTION IS MURDER The Bible never specifically addresses the issue of abortion. However, numerous teachings in Scripture make it abundantly clear what God's view of abortion is. 10 Lies the Pro-Abortion Community Tells To Convince You Abortion Is Okay! ‍ The pro-choice movement is complex, and abortion is a polarizing topic. But, whether you're for or against abortion, there are always things you didn't know about the subject. Today, we're breaking down the top lies the pro-abortion community tells to convince you abortion is okay. Read on to learn more about the myths, truths, and arguments surrounding abortion. The Pro-Abortion Movement Is Bipartisan The pro-abortion movement is sometimes accused of being a small group of radical feminists. They often take a skeptical stance toward the more significant "pro-life" movement, which is often seen as a group of conservative, religious conservatives. However, the movement to decriminalize and then legalize abortion has a long history of bipartisan support. While the pro-life movement is often seen as a single-issue movement, abortion laws and policies are usually decided by lawmakers who are often not very vocal about their own beliefs. You Can Tell Your Senator About Your Abortion Before You're Pregnant This is one of the most popular pro-abortion lies. You should know that the average first-trimester abortion takes about nine weeks from the first day of a woman's last menstrual period. So, if you're planning to get an abortion before you're about 37 weeks pregnant, you can't tell your senator about it. This is because abortion laws are supposed to protect women's right to make their own decisions. Still, doctors are legally prohibited from divulging the pregnancy to anyone before fetal viability. Within the first five months of pregnancy, the medical community agrees that unborn children can survive outside the womb, with organs and a heartbeat, and even begin to move. So, unless you have an excellent reason to get an abortion before you're about nine weeks pregnant, you can't tell anyone you're pregnant. Abortion Will End Human Trafficking And Abuse Will abortion end human trafficking and abuse? Um, no. Many of the victims of sexual trafficking and abuse were victims of their own decisions to get an abortion or have unprotected sex. It's also important to remember that abortion is never safe or "free." Considering that an abortion commonly costs between $300-$500, you're probably better off financially and emotionally not getting an abortion, especially if you were exploited as a victim of sexual abuse and trafficking. However, if you were raped and didn't want to parent a child, getting an abortion isn't worse. Having An Abortion Will Make You Unhappy Women report feeling a wide range of emotions after having an abortion. Some report feeling relief, while others say sadness or even anger. Depending on the person and the circumstances, it's also possible to feel regret or sadness, but these are very personal feelings. Most people feel sad or regretful when they have a loved one's death, but this doesn't mean they will be unhappy. Having an abortion should not negatively impact your life. Abortion Is Safer Than Having A Baby This is another one of the pro-abortion myths we're going to debunk. Despite what the medical community says, there's no scientific proof that having an abortion is safer than carrying a baby to term. Since the method and circumstances of each abortion vary, it's hard to generalize the safety of having an abortion. This means that you're taking a risk no matter how you choose to end a pregnancy. You Shouldn't Feel Guilty About Having An Abortion Guilt is often a very personal feeling. That's why you shouldn't feel guilty about having an abortion. If you were raped or became pregnant due to sexual abuse or exploitation, you shouldn't feel bad about having an abortion. Not only do you have the right to have an abortion if the circumstances are right, but you shouldn't feel guilty about it, either. There's Only One Right Decision For Every Woman This is another one of the pro-abortion myths that we're debunking. It's important to remember that every woman has no right decision. Some people might prefer to save their money or have another child later in life. Some might decide not to have children at all. These are all excellent choices, and no one should make them feel guilty for making their own decisions. Conclusion The pro-choice movement is complex, and abortion is a polarizing topic. But, whether you're for or against abortion, there are always things you didn't know about the subject. Today, we're breaking down the top lies the pro-abortion community tells to convince you abortion is okay. Read on to learn more about the myths, truths, and arguments surrounding abortion. Additional information Jeremiah 1:5 tells us that God knows us before He forms us in the womb. Psalm 139:13–16 speaks of God's active role in our creation and formation in the womb. Exodus 21:22–25 prescribes the same penalty—death—for someone who causes the death of a baby in the womb as for someone who commits murder. This law and its punishment clearly indicate that God considers a baby in the womb to be just as much a human being as a full-grown adult. For the Christian, abortion is not a matter of a woman's right to choose to have a baby. The baby is already present and living. Abortion is a matter of life or death of a human being made in God's image (Genesis 1:26–27; 9:6).   What does the Bible say about abortion? Simply put, abortion is murder. It is the killing of a human being created in the image of God.   A common argument against the Christian stance on abortion is "What about cases of rape and/or incest?" As horrible as it would be to become pregnant due to rape or incest, is the murder of a baby the solution? Two wrongs do not make a right. A child resulting from rape or incest could be given in adoption to a loving family. Many families, some unable to have children on their own, stand ready to receive and love a child from any background. The baby in this situation is entirely innocent and should not be punished for the evil act of their mother or father or any family member.   It's also important to keep in mind that abortions due to rape or incest account for a tiny percentage of total abortions: only 1 percent of abortions can be traced to cases of rape or incest (Torres and Forrest, cited by Physicians for Reproductive Choice and Health and the Alan Guttmacher Institute in An Overview of Abortion in the United States, October 2001, www.abortionfacts.com/facts/8#cite-1, accessed 9/9/21).   Another argument often used against the Christian stance on abortion is, "What about when the mother's life is at risk?" Honestly, this is the most challenging question to answer on the issue of abortion. First, let's remember that such a situation is exceedingly rare. Dr. Landrum Shettles, a pioneer of in vitro fertilization, wrote, "Less than 1 percent of all abortions are performed to save the mother's life" (Landrum Shettles and David Rorvik, Rites of Life, Zondervan Publishing House, 1983, p. 129). When testifying before the U. S. Senate, Dr. Irving Cushner, Professor of Obstetrics at the UCLA School of Medicine, when testifying before the U. S. Senate, was asked how often abortions are necessary to save the life of the mother or preserve her physical health. His response: "In this country, about 1 percent" (testimony before the Senate Judiciary Committee's Subcommittee on the Constitution of the United States on October 14, 1981, quoted in The Village Voice, July 16, 1985).   Other medical professionals state that abortion is never necessary to save the mother's life. Over 1,000 OB-GYNs and maternal healthcare experts signed a statement in 2012, saying, in part, "As experienced practitioners and researchers in obstetrics and gynecology, we affirm that direct abortion—the purposeful destruction of the unborn child—is not medically necessary to save the life of a woman" (Dublin Declaration on Maternal Health, www.dublindeclaration.com, accessed 9/9/21). Further, in 2019, "medical leaders representing more than 30,000 doctors said intentionally killing a late-term unborn baby in an abortion is never necessary to save a mother's life" (www.lifenews.com/2019/03/05/30000-doctors-say-abortion-is-never-medically-necessary-to-save-a-mothers-life, accessed 9/9/21).   Second, let's remember that God is a God of miracles. He can preserve the life of a mother and her child despite all the medical odds against it. Third, even in the small percentage of abortions performed to save the mother's life, most of those abortions can be prevented by an early induced delivery of the baby or a C-section. It is infrequent that a baby must be actively aborted to save the mother's life. Ultimately, if the mother's life is genuinely at risk, the course of action can only be decided by the woman, her doctor, frequently the father of the child, and God. Any woman facing this complicated situation should pray to the Lord for wisdom (James 1:5) as to what He would have her do.   Most abortions performed today involve women who simply do not want to have the baby. As indicated above, just 2 percent of abortions are for rape, incest, or the mother's life is at risk. Even in these more difficult 2 percent of instances, abortion should never be the first option. The life of a human being in the womb is worth every effort to preserve.   All sins can be forgiven (John 3:16; Romans 8:1; Colossians 1:14). For those who have had an abortion, remember that the sin of abortion is no less forgivable than any other sin. A woman who has had an abortion, a man who has encouraged abortion, and a doctor who has performed an abortion can be forgiven by faith in Jesus Christ.

The stigma of having an abortion is still rampant, especially among highly conservative people of faith. This led to Katey Zeh's passion for navigating how to bridge these two worlds. It is important to provide care and compassion to those who decide to go through abortion because, at its core, abortion is still part of the human experience.  Statistically, most people who have abortions are already parents. And oftentimes, it is a parenting decision they need to make to care for their living children. A lot of times, these are people who have caregiving responsibilities. Regardless of whether people should have access to it, it's just important to recognize that most people who have abortions are parents. On the other hand, some people choose not to ever have kids. And unless they know that they won't be stigmatized, harassed, and pressured by society, only then is that choice made out of enthusiastic consent.  In this episode, Katey Zeh talks about her new book, A Complicated Choice. Fighting Back Against Repressive Anti-Choice Laws in Arizona & Texas

In 2016, Senate Republicans stopped President Barack Obama's nomination of Merrick Garland to the Supreme Court to replace Justice Antonin Scalia. Senate Majority Leader Mitch McConnell said it was too close to the election and that the new president should choose the new supreme court judge. Despite nationwide outcry against this, the Supreme Court functioned for months with only eight justices. After President Donald Trump took office, he nominated Judge Neil Gorsuch in January 2017,  Judge Brett Kavanaugh in July 2018, and Justice Amy Coney Barrett on September 2020, just months before the 2020 election. (I guess according to Mitch McConnell rules are meant to be broken.)The US is currently suffering the aftermath of these three conservative appointments. Multiple Republican-controlled state legislatures have passed restrictive anti-abortion bills during the past decade. Since the Supreme Court has taken a decided hard turn to the right with the Trump era appointments, states like Texas and Arizona are in the forefront with anti-choice legislation designed to challenge Roe v Wade. Now US Attorney General Merrick Garland is mounting a legal case against the Texas ban on abortions after six weeks. In Arizona, there is a lawsuit to stop SB1457, which criminalizes the woman, her doctor and anyone who helps her get an abort a fetus with a known birth defect, regardless of severity of the diagnosis or life expectancy after birth. My guests Rep. Terry Williams from the Ohio Religious Coalition for Reproductive Choice.  The Ohio Senate Committee on Health, Human Services, and Medicaid approved Senate Bill 155 and Senate Bill 208 on Tuesday, and there were floor votes in Ohio Senate session on Wednesday. The bills push harmful false narratives about abortion, and each would charge physicians with third degree felonies for not complying with medically unnecessary rules. In the Ohio House Committee on Ways and Means, House Bill 297 received its second hearing. This bill would create a tax CREDIT to give money from taxpayers to donors of fake women's health centers (AKA crisis pregnancy centers or CPCs). In Dayton, Kelley is continuing to organize supporters of Women's Med Center. That is why the work of the Ohio Religious Coalition for Reproductive Choice is so important—Ohioans need to know that people of faith trust them to make their own reproductive health decisions.”   Elaina Ramsey, ORCRC's new executive director: “It's an honor to partner with the NARAL Pro-Choice Ohio team in bringing the moral power of religious communities to the reproductive health, rights, and justice movement. A dedicated community organizer and campaign strategist, Ramsey is the first woman of color to lead ORCRC. She is committed to communities of color, low-income women, and immigrants.”   Copeland, a longtime advocate of reproductive freedom, has path forward for reproductive rights in Ohio without engaging more people of faith. Both organizations remain independent but have begun to share office space, resources, and strategies. Through innovation and collaboration, the groups seek to equip secular and faith communities in securing reproductive healthcare for every Ohioan—including access to birth control, comprehensive sexuality education, and safe, legal abortion. Together, NARAL Pro-Choice Ohio and ORCRC will protect the moral and constitutional rights of all Ohioans to make their own reproductive health decisions without shame and stigma and without interference from the state.

Description:   This week, Kelley, Elaina, and Gabe discussed the US Senate vote to defeat Skinny Repeal that would destroy Americans' access to affordable health care and block Planned Parenthood from Medicaid funding. Also, they talk about this week's federal court hearing to challenge John Kasich's latest plan to defund Planned Parenthood at the state level. Elaina spoke up against Ohio Right to Life's latest announcement that they really, really, don't support rape survivors. She has a letter in the Columbus Dispatch: “As a rape survivor and a committed Christian, I'm deeply disturbed by Ohio Right to Life's decision to only endorse candidates that “hold a ‘pro-life' position with no exceptions to abortion stemming from rape or incest (Dispatch article, last Friday).” “No woman should be forced to carry a pregnancy against her will, no matter the circumstance. As the executive director of the Ohio Religious Coalition for Reproductive Choice, I faithfully advocate for compassionate reproductive care for all — including full access to contraceptives, adoption, abortion, and foster care. Anything less violates the lived experiences and moral agency of Ohio women, particularly survivors of rape and incest. Given that 1 in 3 women will experience physical or sexual violence, Ohio Right to Life's hard-line agenda perpetuates a rape culture. Rape survivors should not be punished and traumatized further to carry a pregnancy to term without their full consent. Whether or not to become a parent is a sacred decision and should remain personal and private. While Ohio Right to Life claims to be nonsectarian, it has a long history of using toxic Christian rhetoric to restrict women's reproductive health-care access. The actions of Ohio Right to Life do not represent my faith, that of other religious traditions, nor the will of most women across our state.” ~ Elaina Ramsey   NARAL Pro-Choice Ohio Executive Director Kellie Copeland issued a statement: “This new low standard in the Ohio Right to Life endorsement criteria further solidifies their alignment with extremists like President Donald Trump who believe that women who have abortions should be punished. These values are not Ohio values. Women deserve access to safe, legal abortion care in their communities without judgment or political interference—regardless of the reason she is unable to continue a pregnancy. Here at NARAL Pro-Choice Ohio, we trust women to make their own reproductive health decisions, and we will continue to back candidates that do as well.”   Also in the Dispatch, the newspaper issued their third editorial criticizing Ohio Supreme Court Justice Sharen Kennedy for participating in an anti-abortion event before hearing a case about Toledo's last abortion clinic: “The high court should modernize its process for handling complaints against one of its own. This is disappointing given that this court has been open with the public. This falls short of its own standard.”

Harry Knox, President and CEO of the Religious Coalition for Reproductive Choice will join Welton in the studio to talk about the widely misused Helms Amendment. Created in the wake of the Roe v. Wade decision, this law blocks U.S. funds from supporting pregnancy termination as a form of family planning. Because it’s been applied way beyond its original scope, as Rev. Knox and the religious leaders he’s mobilizing point out, this stops the U.S. from helping ISIS’s and Boko Haram’s victims of rape and abuse. Tune in to hear what these religious and secular leaders are doing to change this policy. EEOC v. Abercrombie & Fitch: How Religious Freedom Complementing Civil Rights in a Way Hobby Lobby II Did Not On Monday, the Supreme Court released their decision in the religious freedom case, EEOC v. Abercrombie & Fitch. Many had feared a repeat of last year’s disastrous decision in Hobby Lobby, but the ruling – which defended the right of a Muslim woman to wear a hijab on the job – was remarkably positive. Welton ends our show this week by sharing his thoughts on what the Court got right about religious freedom this year, and what they missed last time around.

Meg Riley - Senior Minister for the Church of the Fellowship Meg gives you an inside look at the history of the church, its mission, and it's future. Learn about the prison outreach and the impact it has. Here about what's provided for the members who range from busy business people to people in remote areas and those that may not have the ability to come to a brick and mortar church. Meg shares her journey becoming a UU and what it was like being with people who were less than happy about her choice. Meg Riley Bio I am thrilled beyond words to serve what I consider the most creative, unusual, spiritual community in the world! In this congregation without walls, my responsibilities include spiritual leadership, working with others to envision our future, preaching, counseling, and being a general gadfly. Before coming to the CLF, I served the Unitarian Universalist Association in a variety of positions including directing the Advocacy and Witness Programs, Washington Office for Advocacy, Office of Gay, Lesbian, Bisexual Transgender Concerns, and Youth Office. I directed the Standing on the Side of Love campaign and the Unitarian Universalist response to Hurricane Katrina. I have served many national boards of directors including the Interfaith Alliance, Americans United for Separation of Church and State, and the Religious Coalition for Reproductive Choice. I’ve been founding president of two organizations, Faith in Public Life and Equal Partners in Faith. In short, I have spent my life’s work advocating for a world of peace and justice. In so doing, I became quite interested in the media revolution taking place, and in the opportunity to create deep and meaningful community on the internet. Guest: Kenneth Edelin, MD Host: Martin Samuels, MD In 1974, one year after Roe v Wade, Dr. Kenneth C. Edelin, a young black doctor, was the chief resident in obstetrics at Boston City Hospital. Three months before completing his residency, Dr. Edelin was indicted for manslaughter after he surgically terminated a pregnancy. Convicted and sentenced to a one-year probation by a secret grand jury, before the decision was overturned by the Supreme Judicial Court of Massachusetts a year later, Dr. Edelin's case drew national attention. Dr. Edelin is emeritus professor of obstetrics and gynecology at Boston University School of Medicine and author of the book, Broken Justice: A True Story of Race, Sex and Revenge in a Boston Courtroom. He joins host Dr. Martin Samuels to discuss his personal involvement in this landmark legal case and the issues it raised, which remain points of discussion in American society today.
