What happens when a company tries to outsmart the system - and gets caught red-handed by the DOJ in a $140 million export control scheme tied to Chinese military supercomputers? In this episode, Michael dives into the DOJ's criminal enforcement action against Cadence Design Systems - a case that marks yet another major step in the DOJ's rapidly unfolding trade enforcement strategy. We're no longer in the FCPA era. This is a whole new ballgame, where national security and trade compliance have collided, and companies that haven't adjusted are already behind. You'll hear him discuss:Why Cadence's plea deal - not a DPA or NPA - is such a big dealHow the DOJ and BIS coordinated to secure over $140 million in criminal and civil penaltiesThe simple, sloppy scheme that involved fake names, hidden aliases, and blatant attempts to skirt export controlsWhy partial cooperation didn't earn Cadence a full credit reduction - and what they failed to doThe shocking compliance gap: only one export control officer handling global riskWhat this case signals about the DOJ's growing focus on national security and semiconductor enforcementWhy ethics, due diligence, and transaction monitoring are still your best defenseHow companies can avoid getting blindsided by embracing the new trade enforcement landscapeResourcesMichael Volkov on LinkedIn | TwitterThe Volkov Law Group

Story of the Week (DR):Trump Demands Intel CEO's Resignation, Says He's ‘Highly CONFLICTED' AND Eric and Donald Trump Jr. to Own Millions of Shares in New U.S. Manufacturing SPAC MMESG Analyst Tom Cotton: Trump's attack, posted on Truth Social Thursday, came two days after GOP Sen. Tom Cotton flagged Tan's prior investments in Chinese companies and his previous leadership at Cadence Design Systems, which recently pleaded guilty to unlawfully selling its tech to a blacklisted military university in China.Intel CEO Lip-Bu Tan (~$70M golden hello in March; max potential $400M) directly addressed employees on Thursday after Donald Trump demanded his resignation over national security concerns, saying he has the full support of the board.Tan set up a venture firm called Walden International based in San Francisco that pumped more than $5 billion into over 600 companies. More than 100 of those investments were made in China, including deals with once-obscure startups such as Semiconductor Manufacturing International Corp.—today China's largest chipmaker—where he served on the board for a decade and a half.Today, the executive is still chairman of Walden International. And he's the founding managing partner at Walden Catalyst Ventures, which focuses on investments in the U.S., Europe and Israel. He also serves in that role at another venture fund, Celesta Global Capital.Tan stepped out of the venture world and joined the chip industry full-time when he became interim head of San Jose, California-based Cadence Design Systems Inc. in 2008. The executive, who had previously served on the board, went on to take the permanent CEO job the next year. He stayed in the role until 2021, when he transitioned to executive chairman, and is widely credited with restoring the company's fortunes. In late July of this year, the Department of Justice announced a plea deal that cost Cadence more than $100 million in fines. Employees at Cadence's China unit allegedly hid the name of a customer—the National University of Defense Technology—from internal compliance in order to keep supplying it. That organization had been put on the Department of Commerce's blacklist in 2015. This includes at least a 1460 on the SAT or a 33 on the ACT, which are both above their respective 98th percentiles.According to Karp, the internship was created in direct response to the “shortcomings of university admissions.”Here's the problem: there ARE shortcomings to elite colleges, mostly that they exude exclusivism and a commodity - but it's still a pretty rich for a guy who WENT to Stanford where he met his future funder and mentor to talk about how bullshit it wasJohn Stankey and the re-rise of the Jack Welch man-directive manbabies MMIt is incredibly encouraging that 73% of our employees took the time to respond to the survey, with 79% of those respondents feeling committed and engaged with their work at AT&T. Send us a textIn this engaging podcast, Shelly Morales, founder and CEO of Morales HR, takes us on an inspiring journey—from her early days working at her family's hot dog stand, “Sandy's Happy Hot Dogs,” in the Bay Area to holding influential HR leadership roles in top tech companies and ultimately establishing her own HR consulting firm. Shelly shares how grit and determination fueled her path from a receptionist manually tracking resumes to impactful HR leadership positions at companies like LinkedIn, Quantenna, Atlassian, and Cadence Design Systems. Reflecting on her growth from an HR generalist to a strategic business partner, she discusses how her dedication to connecting people with meaningful work, improving employee experiences, and advocating for flexible employment practices has shaped her career.A pivotal chapter of her career was at Atlassian, where she saw firsthand the power of technology in building connectivity and engagement within remote teams. Atlassian's early commitment to remote work, long before the COVID-19 pandemic, highlighted the essential role of tools like Confluence, Slack, and the now-retired HipChat in fostering team cohesion and a strong company culture across continents and time zones. These tools not only allowed dispersed teams to stay connected in real time but also encouraged personal storytelling that bridged physical distances. The onset of the pandemic accelerated the acceptance of remote work and highlighted how blending work and personal life could enhance productivity and work satisfaction, shifting companies' focus from rigid office hours to outcome-based performance and helping establish a more human-centered work culture.Through Morales HR, Shelly aims to create a supportive network for professionals seeking roles that align with today's flexible and dynamic work environments—from remote and fractional engagements to gig work opportunities. Her firm connects members across industries and roles, from CHROs and CFOs to customer support, without relying on traditional job postings.Kindness is at the heart of Morales HR's intake process, where prospective members engage in a personal interview to ensure alignment with the company's values. Shelly firmly believes that kindness and inclusivity are essential yet often overlooked qualities for creating a supportive workplace. By working with companies that value these principles, Morales HR builds relationships that uphold professionalism and empathy, benefiting both employees and employers.Shelly also highlights Morales HR's role in the expanding gig economy, a trend she has championed for years. While not all early predictions around the gig economy and digital currency came to fruition, Shelly notes that the demand for flexible, project-based roles has steadily grown. Shelly Morales's story is one of resilience and transformation. Her career represents the evolution of HR from administrative support to a people-centered, strategic practice that embraces flexibility, kindness, and the power of technology. Her mission is clear: to build connections between employees and employers that prioritize human connection, work-life balance, and mutual respect, setting a foundation for a thriving future in HR.Learn more about Shelly:Shelly's LinkedIn: https://www.linkedin.com/in/shellymorales/MoralesHR's webpage: https://moraleshr.com/

For this episode of the Data Center Frontier Show podcast, we welcome Mark Seymour, Distinguished Engineer with Cadence Design Systems, for a discussion of the big question on everyone's mind right now in this industry: data center power demand and where it's going in the context of rapid digitalization and exponential growth of HPC and AI computing needs, and how that compares and contrasts, or even conflicts, with increasing environmental concerns and regulations.  The conversation also highlights the importance of digital twins for managing data center efficiency and the advantages of liquid cooling technology, and particularly immersion cooling, as a sustainable alternative to traditional methods. In the course of our interview, Seymour also emphasizes the data center industry's responsiveness to societal demands for sustainability, citing initiatives such as ubiquitous tree planting by project developers, and the need to adapt to new technological challenges. Here's a timeline of the podcast's key moments: 2:59 - Seymour explains that AI is essentially high-performance computing, which is now required in many data centers that previously did not need it. 12:05 - Addressing the challenges and potential of immersion cooling technology: Emphasizing its growing acceptance, but also the need for confidence in its operation. 17:52 - Talk turns to the importance of digital twins in ultimately managing data center efficiency, with Seymour highlighting the necessity for understanding the interrelated behaviors of IT infrastructure and cooling systems. 24:18 - Discussion circles back to immersion cooling as a sustainable option for data centers, with Seymour expounding on its advantages over traditional cooling methods. 27:44 - Seymour elaborates on the improvements in compute efficiency per watt in modern systems, arguing that the data center industry is responding and adapting to societal demands, rather than being inherently unsustainable. 30:42 - Seymour acknowledges the industry's focus on sustainability and environmental impact, citing examples such Cadence's tree planting initiatives and the ongoing challenge of meeting new technological demands. Joint venture partnerships can help your business grow faster and generate greater profit, but it's important to plan and carry them out carefully. Charles Byrd of Pure JV joins A.J. to discuss the strategies for fostering successful partnerships. Unlike the common trial-and-error approach that many entrepreneurs default to, Charles emphasizes the importance of a structured and systematic process for creating and managing joint ventures. He also shares his tips for maintaining a work-life balance, choosing the right partner, and measuring the success of these collaborations.About Charles Byrd:Charles Byrd is the Founder of Pure JV, which is an online training, product launch, and internet marketing company that is boosting results for niche markets. He's a joint venture expert, renowned speaker, and educator in the sphere of joint venture partnerships. As a Silicon Valley veteran and former director at a billion-dollar software company, Cadence Design Systems, Charles is commonly praised as "The Chaos Killer." After leaving his corporate role, he infused his project management skills into entrepreneurship, creating a successful online productivity course. He quickly mastered joint venture marketing for his course and developed a systematic process to strike 2-6 joint venture deals per week. Today, Charles uses his unique skill set to educate other entrepreneurs and corporations, helping them maximize their potential via strategic joint venture partnerships.Key Insights:Implement the right framework for success in joint venture partnerships. This helps avoid chaos and makes collaborations more fruitful. So, begin by mapping out your goals and building a structured process that captures every aspect of the cooperation. This will lead to increased productivity and ensure both sides benefit from the partnership. (04:25)Prioritize long-term relationships over short-term interactions. Investing your time in building trust and working towards mutual benefit with your partners will create a better foundation for growth than short-term initiatives. This will create more value over time for both sides and foster a growth-focused environment for joint venture partnerships. (12:11)Partner with those who serve your ideal clients. This cooperation enables you to present your value proposition to a pre-qualified audience and improves the potential for a successful partnership. (17:51)Align with partners who amplify your message. When both of you push the same message out into the world, it reaches more people, sounds more convincing, and helps your joint venture partnership be a big success. This alignment ultimately leads to stronger brand recognition and a wider customer base, driving substantial growth and profitability for both partners in the joint venture. (21:44)Balance personal life with business ambitions. Prioritize your personal life and aim to build your business around it if you want to be really fulfilled with your life/work balance. This means building systems that support your family life, well-being, and overall life satisfaction, such as remote work options, flexible hours, or delegating tasks, for instance. (29:45)Diversify your leads. This not only mitigates risk but allows you to tap into various pools of potential clients, increasing overall market reach and brand awareness. You can strengthen your current position this way but also futureproof your business. In this episode of Chip Stock Investor, Nick and Kasey review another stellar quarter from EDA (electronic design automation) software company Cadence Design Systems (CDNS). Some headlines have suggested the company is suffering from a weak semiconductor industry, but nothing could be further from the truth. Cadence and its EDA peers benefit from increased R&D as chip and computing system designs get more complex. Now Cadence is betting on a similar dynamic playing out among big pharmaceutical and biotech companies. Cadence is in the early stages of making its OpenEye Scientific acquisition (over the summer of 2022) a giant in computing power for drug discovery, development, and optimization. Similar trends in chip and AI could help propel this new market for Cadence higher as well. Finally, Nick and Kasey discuss valuation, and assumptions the market may have for Cadence stock. There's no denying shares trade for a very high premium, so they discuss how investors may choose to approach this top chip stock if they don't already own it.
