Tort Law and How It's Tied to Our Culture by M. Stuart Madden, ESQ.Tort Law & How It's Tied to Our Culture is a socio-legal history of the norms, customs, and eventual private laws for wrongs, or Tort. Oliver Wendel Holmes described law as "a grand anthropological document." This can be said with even greater force of Tort Law, the most dynamic field within the Common Law. Whether in the form of an unwritten lesson of a myth or folktales, or rendered as written law, Tort Law reflects a culture's superego, a guide to what individuals might forego doing in the interest of a community's safety, dignity and prosperity. The work provides an entertaining and scholarly tour of Tort Law from its beginnings in the unwritten oral traditions of folktale and myth, through the ancient law codes of Mesopotamia and the cohering work of the Greeks and the codifications of the Romans and later Gothic groups, to early religious recitations of behavioral ethics. Separate treatment is afforded the vital role of the Common Law in an increasingly statutory age, exemplary or punitive damages, and the congruence between the application of tort-type remedies in the English-speaking Common Law nations and the significant number of Civil Code nations applying law more directly descended from Roman Law and the Napoleonic Code. M. Stuart Madden is Past Distinguished Professor of Law, Pace University School of Law. B.A., University of Pennsylvania (1971); M.A. (History), London School of Economics and Political Science (1972); J.D., Georgetown University Law Center (1976). October is Domestic Violence Awareness Month and this week host Susan Guthrie speaks with Attorney Uswah Khan who has helped scores of victims of abuse obtain restraining orders in order protect themselves, and their children, from suffering further at the hands of their abusers. On average, nearly 20 people per minute are physically abused by an intimate partner in the United States. During one year, this equates to more than 10 million women and men. Restraining orders offer one of the few tools that a victim has to try to protect themselves from ongoing abuse but getting a restraining order can be scary, confusing and complicated. To make matters worse, many victims cannot afford to retain an attorney to help them navigate the court process making it even more difficult to apply for relief. Attorney Uswah Khan has spent the past few years representing and assisting victims of domestic violence as the staff attorney at The Center for Family Justice in Connecticut. In this episode, Uswah demystifies the process of obtaining a restraining order and walks you through the steps so that you are empowered to get the protection that you, and your children, need. Damage awards in litigation against physicians, hospitals, and other healthcare providers have been coming in bigger and bigger, with juries awarding more than $20 million in a string of cases that should send chills down the spines of defendants and counsel. What are the factors behind this trend? Besides the severe (or even alarming) nature of the harm alleged, what is fueling these mega verdicts? What can defense attorneys do, knowing they are facing a well-organized, well-funded plaintiffs bar? For that matter, what can defense attorneys learn from their opponents? What strategies can defense employ early in the life of a case? Joining me to discuss this high-stakes litigation is Sandra M. Cianflone of Hall Booth Smith, P.C. Sandie counsels and defends hospitals, physicians, nurses and institutional employees in a broad spectrum of catastrophic injury and medical malpractice cases. She received her Juris Doctorate from Pace University School of Law and her undergraduate degree from Fairleigh Dickinson University. This podcast is the audio companion to the Journal on Emerging Issues in Litigation, a collaborative project between HB Litigation Conferences and the Fastcase legal research family, which includes Full Court Press, Law Street Media, Docket Alarm and, most recently, Judicata. If you have comments or wish to participate in one our projects, or want to tell me how insightful and informative Sandie is, please drop me a note at Editor@LitigationConferences.com. This podcast is based on an article she wrote for the forthcoming issues of the Journal. Note that in my introduction I have created the phrase "badly wrong," which is, itself, badly wrong. Listen to the bitter end when Sandie and I discuss working from home, and how we really feel about family and co-workers. Feel free to scold me at the email address provided. I hope you enjoy the interview and this professional's practical insights into defending healthcare providers. Tom Hagy
Today, on the Legacy Purse we brought on estate planning and elder law attorney, Christina A. Sammartino, Esq., to emphasize and compliment some of the topics our previous guests have spoken about. Christina has so much experience in this area of law, both from her own personal/family experience and from years of helping clients. This episode really helps our listeners understand a very complex and complicated topic – Health Care and long-term care planning. Now, the reason this topic is so important is that many of us have elderly parents that have not yet done a plan or maybe did a plan years ago before they had to consider any major health care costs. And health care can get very expensive for elderly folks (as in $10,000 a month for nursing home care!!). So, for those listeners whose parents have homes and bank accounts in their names, this podcast is for you! Because there can be MAJOR financial consequences for families if your parents do not do the proper planning for long-term health care. (it's bad!)Christina earned her Bachelor's degree in legal studies in business from Hofstra University, and then went on to obtain her law degree from Pace University School of Law. Christina is an Associate of Berwitz & DiTata LLP, and she has worked for many years in all areas of estate planning, trust and estate administration, and Elder Law. It's now been more than 18 months since the world was besieged by the novel coronavirus pandemic. In addition to the human toll, it disrupted our lives in ways big and small, new and old, as it raced across continents, first visiting North America in January 2020. There are an estimated 15,000 lawsuits relating to the outbreak, with some 350 filings directed toward the healthcare and medical communities. The number of insurance coverage suits is fast-approaching 1,800. Litigation has been initiated against aging services, hospitals, and healthcare providers, with the next anticipated wave likely to surround vaccines themselves. What will be the basis of these claims? What defenses will we see? And what can healthcare providers do now in anticipation of this onslaught? Joining me to discuss this out-of-the-blue rash of litigation is Sandra M. I hope you enjoy the interview, and especially a brief story (after we wrap up) about Sandie's experience delivering a baby in the Age of COVID-19. This episode of Electrify This! explores urgent questions facing climate resilience in the electrified future including: What exactly is resilience, and how can we make it a priority? Tristan Taormino welcomes Intactivist Georganne Chapin from Intact America to educate listeners on the anatomy and sexual importance of the foreskin of the penis. No professional medical association in the United States or the rest of the world recommends routine circumcision, yet it’s incredibly prevalent in America. We discuss the debate surrounding routine circumcision in male infants. What are some of the arguments about why circumcision is necessary, and how many of them stand up to fact-checking and science? Does opposing circumcision devalue cultural and religious practices? We talk about what role the foreskin plays in solo and partnered sex and how leaving the penis intact affects people’s sex lives. There has been a global outcry about female genital mutilation (FGM), but not about penile circumcision, a similar procedure—why is that? How does the Intactivist Movement to end child genital cutting intersect with efforts to end FGM and activism to stop doctors from medically intervening when someone is identified as intersex at birth? How does the everyday person bring up the subject with a loved one, a spouse, a sibling, or a close friend? This episode is made possible by Calm and Intensity by Pour Moi. Georganne Chapin has dedicated her life to promoting human rights and fighting injustice. Georganne is a leader in the growing national movement to end routine circumcision of baby boys. Twelve years ago, she co-founded and became executive director of Intact America, the largest national organization working to end child genital cutting in this country and to ensure healthy sexual futures for all people. Prior to that, she founded the Hudson Center for Health Equity and Quality (which she also currently heads) and is the former president and CEO of Hudson Health Plan, a large nonprofit Medicaid managed care organization in the Hudson Valley. She has her MPhil in Sociomedical Sciences from Columbia University and her JD from Pace University School of Law.

The Harmful Effects Of Glyphosate, The Most Common Agrochemical | This episode is brought to you by Tushy and ButcherBoxWe’re living in an age where it’s increasingly hard to avoid exposure to toxins. Some of the most ubiquitous are right on our food, on some of the most commonly eaten items in the American diet. It’s no wonder that illnesses related to toxicity, like cancer, infertility, and neurological diseases, are on the rise. The most widely used pesticide in our food supply is glyphosate. It’s used all over the world on more than 70 different food crops, including corn, soy, and wheat and is linked to some serious health risks, including non-Hodgkin lymphoma. It’s terrifying to consider that a bowl of Cheerios has more glyphosate per serving than vitamins D and B12, both of which are added to try to boost nutritional value. We need to change our food system if we want to change our health, and it’s issues like these that need our help. I was so happy to sit down with my good friend Robert F. Kennedy Jr. to dig into the topic of glyphosate and corruption in the agricultural industry. Bobby Kennedy serves as President of Waterkeeper Alliance, Chairman of the Board and Chief Legal Counsel for Children’s Health Defense, and of counsel to Morgan & Morgan, a nationwide personal injury practice. He was previously Chief Prosecuting Attorney for the Hudson Riverkeeper, Senior Attorney for the Natural Resources Defense Council, and a Clinical Professor and Supervising Attorney at Pace University School of Law’s Environmental Litigation Clinic. Bridget Crawford and Emily Gold Waldman are Professors of Law at Pace University School of Law and are at the forefront of efforts to repeal sales taxes on feminine hygiene products, dubbed the Tampon Tax, across the country. Their research not only points out policy reasons for repealing the Tampon Tax but also puts forth arguments as to why it is unconstitutional as well.
Welcome to Heels of Justice; these are the stories of women lawyers who are trailblazers in their field and paved the way for the rest of us. Today, the Heels of Justice interview Maja Hazell is the Global Head of Diversity & Inclusion at White & Case. She oversees the Firm’s global diversity and inclusion strategy as a member of the Business Services Leadership team. She has led diversity and inclusion and career development initiatives for over twelve years, working for law firms, Fried Frank LLP, as their Director of Diversity and Inclusion, and Simpson Thacher & Bartlett LLP, as an associate. She also served as an Assistant Dean for Career Development at Pace University School of Law. Key Takeaways [0:30] Sarita welcomes Maja to the Heels of Justice podcast and asks her to talk about what being head of diversity and inclusion means. [1:15] Considering the increasing resources being invested in diversity and inclusion practices in general, Maja shares the purpose of her role in the organization. [2:47] Sarita asks Maja to break down what the good, the bad, and the ugly are; what is the state of diversity is in the legal profession. [2:58] The good! There is an increase in awareness and the numbers are there in terms of interest for the profession; the question becomes how do they fare once they get in. [4:25] The bad mainly resides in talent management practices; how do we assign and evaluate work but also in the “star-making” ethos that firms historically perpetuate. [8:27] How do talent management practices and actionable feedback play out in real life? Maja talks about the necessary underpinnings on which a successful D&I practice hinges. [10:33] The ugly is what keeps Maja up at night about the world: backlash. [12:31] How does Maja approach people who do have that resistance to inclusion and diversity. [14:26] Maja gives some examples of what she might advise a person to do — even when they’re afraid she’ll ask them to “act like a man”! [18:06] Maja supports leaders for them to become better leaders and she is passionate about helping women navigate the professional environment. [19:21] Sarita asks what drives Maja to do this work and how she discovered this passion to help the underdog when she first learned about the civil rights movement and the role lawyers played. She also shares some of her formative work experiences. [28:07] Maja talks about how she advocates for herself: you need to get a good idea of who you are and what you bring to the table and don’t be too attached to the outcome. [30:57] Sarita asks Maja what her mantra is and thanks her for sharing so much of her experience on the Heels of Justice podcast and she signs off until next time. You’re from this firm?... Is anyone else coming?” — Clearly he thought a lawyer from a white shoe, 100-year-plus law firm could not possibly be a little black girl from the Bronx, and he didn’t feel the need to hide his reaction — I was so deflated and felt so awful that when I went back to the hotel I called my assigned partner-mentor and I told him what happened, he replied “Listen Maja, he’s an a**hole, you’re there to do a job and I know you, you are going to be great at that job.” He just affirmed me and built me back up.”

I get lots of questions from folks interested in agricultural law. What majors should I consider in undergrad? What courses should I take in law school? What does an agricultural lawyer really do? What are your best tips for someone interested in law school? I rounded up some of the best in the business to answer these questions. I'm hoping that by offering different thoughts and perspectives, this episode will be helpful in illustrating there really is no one path to a career in agricultural law. We've got two practicing attorneys. Cari Rincker, a Pace University School of Law alum, owns her own law firm with offices in Illinois and New York City. Amber Miller is a partner at a law firm in Lubbock, TX and went to law school at Drake University. Next up, I interviewed Jennie Zwagerman, a law school faculty member at Drake University who is the incoming Director of the Drake Agricultural Law Center and works in career services. We wrap things up with a current law student, Austin Vincent, who is in his second year at Texas Tech University. In this episode, Bridget J. Crawford, James D. Hopkins Professor of Law at Pace University School of Law, and Emily Gold Waldman, Professor of Law and Associate Dean for Faculty Development & Strategic Planning at Pace University School of Law, discuss their article "The Unconstitutional Tampon Tax," which will appear in the University of Richmond Law Review. Crawford and Waldman observe that many states exempt "necessities" from sales tax, but do not exempt menstrual hygiene products, which puts a significant financial burden on women, especially low-income women. They argue that burden is unconstitutional, because a tax on menstrual hygiene products is a de facto tax on women. And they explain how opposition to "tampon taxes" relates to current movements to secure women's rights. Thank you for being part of Tranquility du Jour! I don't remember how I first discovered your podcast, but I'm sooooooo very glad I did. What I do remember is you were and continue to be my walking companion. At that time I was trying to get back to a daily habit of walking for exercise and you and your guests helped me get there. I loved it! It was so motivating for me. I believe when I started listening you had been recording for at least a year if not more, so it was really fun to start at episode 1 and then proceed from there. I couldn't wait to walk the next day so I could listen to the next episode and it's still that way to this day. Now my favorite thing to do is ride my bike while listening. The longer the episode, the longer the bike ride. So relaxing. Of course, I have to stop and take notes quite often, ha!! I absolutely love your podcast. It is by far my favorite. Thank you so very much for what you do. Through you and your guests I have learned and grown so much in my life in the most positive way. - Cindy, Texas You are my ear buddy on runs. Environmental law and policy raise profound questions about Congress's role and responsibilities. Many environmental regulatory statutes leave the Environmental Protection Agency with broad discretion. Although these grants of discretion create flexibility and take advantage of EPA expertise, they also invite congressional passivity, create administrative problems, and increase special-interest pressures on the EPA and Congress alike. Congressional-EPA relations matter now more than ever because many major federal environmental laws are now more than 40 years old. The EPA is using currently enabling language from old environmental organic acts to regulate global climate change and other cutting-edge problems. What are the proper relations between Congress and the EPA? If these relations are out of alignment, can Congress realign them and how? Panelists will explore these questions with examples ranging from hydrofracturing through clean water and clean air regulation. -- This panel was presented at the 2015 National Lawyers Convention on Saturday, November 14, 2015, at the Mayflower Hotel in Washington, DC. -- Featuring: Prof. Eric R. Claeys, Professor of Law, George Mason University School of Law; Mr. Matt Leggett, Policy Counsel on Energy, Environment, and Agriculture, U.S. Senate Republican Policy Committee; Prof. Nicholas A. Robinson, University Professor on the Environment, and Kerlin Professor Emeritus, Pace University School of Law; and Prof. David Schoenbrod, Trustee Professor of Law, New York Law School. Moderator: Hon. Steven M. Colloton, U.S. Court of Appeals, Eighth Circuit.
