Tennessee's school funding formula hasn't been meaningfully changed in the last 30 years, but in late February Governor Bill Lee and Education Commissioner Penny Schwinn released a proposal that will focus funding on students. The new Tennessee Investment in Student Achievement promises more dollars to every district. In the first part of the show, WPLN education reporter Juliana Kim explains the differences between the current and proposed funding formulas, and what it will mean for local schools and teachers. Later, the conversation shifts to the hurdles unhoused individuals deal with as they try to find an affordable and safe place to live in Middle Tennessee. These complications can include mental health and addiction struggles, and something housing advocates call the "time tax on the poor" — a reference to how long it can take to navigate services. The guests speak about their own experiences living outdoors and the "housing first" approach to ending homelessness. Veterinary specialist, speaker, consultant, and mental health & wellbeing advocate, Dr. Marie Holowaychuk joins host Brendan Howard in this week's episode of the veterinary business success show. Dr. Marie's pathway into veterinary medicine started at a young age, as she grew up working in her mother's companion animal clinic in Canada. Before being accepted into veterinary school, Marie had already worked as a kennel cleaner, receptionist, technician's assistant, and veterinary assistant! However, despite her upbringing in general practice and love for it, Dr. Marie always felt like she had a calling for more. After graduating from the Western College of Veterinary Medicine in Saskatoon in 2004, Marie moved to the USA where she discovered her love of emergency and critical care. Following this passion, Marie went on to qualify as a board-certified specialist in small animal emergency and critical care from North Carolina State University in 2008. This love of emergency medicine, combined with Marie's passion for teaching led to her accepting a teaching position as the Assistant Professor of Emergency and Critical Care Medicine at the Ontario Veterinary College. Marie stayed in this role for 5 years before moving to Calgary in 2014 to continue to practice small animal emergency and critical care whilst also locuming and volunteering on several committees. However, despite doing what she loved, Marie still found herself burnt out and after getting into a car accident, Marie realized she needed a change. Instead, Marie put more of her energy into her personal and professional wellbeing. She obtained her Compassion Fatigue Training from the University of Tennessee School of Veterinary Social Work, completed a Mental Health First Aid Training with the Mental Health Commission of Canada, and gained her 200-hour yoga teacher training qualification. Now Marie is on a mission to change the pathway in veterinary medicine by raising awareness about mental health and wellbeing within the profession. Ashley Jackson can't see or hear. Yet this girl is one of the most brilliant minds I've ever met. In this episode, she shares her story of living without hearing or sight. When I first met Ashley, back when Lexie was only 10 months old, I knew a smattering of sign language. Okay, I knew most of the sign alphabet. As a child, the first "real" biography I'd ever read was about Annie Sullivan, Helen Keller's teacher, and how she finger-spelled the sign alphabet into Helen's hand to teach her...everything. I devoured the story of this half-blind teacher locking the kitchen door when tiny manic Helen clawed her way around the table, snatching people's food, and battled this wild child into folding her napkin. That story of how one woman opened the world for someone living in darkness shaped who I'd become, as a teacher, mother, writer. Yet I never dreamed I'd actually get to finger-spell into a deaf-blind hand. Not until that day on a loud, crowded church bus when this tall teenage girl climbed on the bus holding onto her cousin's shoulder. No, she wasn't just blind. She was also deaf. And if someone only knew how sign, she could understand what they were spelling by feeling their hand. I tried it. It worked. On that bouncing bus, I spelled into her hand, "M-y n-a-m-e i-s R-e-b-e-k-(bump)-h." "Oh, Rebekah. Hello." Shaking my head, I continued. "W-h-e-e d-o y-o-u g-o t-o s-c-h-o-l" (Oh yes, I did misspell a lot. For a while I honestly thought the sign for "r" was "t") "Where do I go to school? Oh, Tennessee School for the Blind. I'm just visiting here for the weekend." I raced my stuttering fingers across her palm, trying to get to know this amazing person as well as I could in the short amount of time we had. I only saw her two or three times after that. Each time, I'd learned a few more signs. Just hoping I could talk to her again. So imagine my delight when I met Ashley a decade later (last year). Now she was a senior at UT Martin, even more brilliant and polished. I began driving her to church sometimes, and on one of those trips she let me interview her so you can also hear her story. Ashley lost her eyes before she turned a year old. Her prosthetic eyes are lovely, but she sees nothing. Her hearing was lost shortly afterward, but thanks to God's gift of brilliant minds and medical technology, she now has cochlear implants that somehow transmit sound waves to her brain and allow her to understand speech. That's how I was able to interview her while driving. She still "hears" through finger spelling, but she has also learned to understand speech. You'll hear more about that in the interview. What's most impressive to me is Ashley's hunger to learn, and even more, to share with others. She's graduated from the University of Tennessee at Martin and dreams of opening the world up for children with disabilities. This one quick truck ride didn't allow us time to share her entire story, and Ashley's a gifted speaker. On March 5, 2018, the Supreme Court decided U.S. Bank National Association v. Village at Lakeridge, LLC, a case involving how appellate courts should review a lower court’s determination that a person related in some way to a bankruptcy debtor is an “insider”--and therefore subject to special restrictions that the federal Bankruptcy Code imposes on insiders. In 2011, the Village at Lakeridge (“Lakeridge”) filed for Chapter 11 bankruptcy, which seeks to facilitate a reorganization that allows the debtor to maintain viability while restructuring debts. At the time, Lakeridge owed millions of dollars to its owner MBP Equity Partners (“MBP”), as well as to U.S. Bank. Lakeridge’s proposed reorganization plan placed both creditors in separate classes and would have impaired their interests. U.S. Bank objected, which precluded a consensual plan, but under the Code MBP’s status as an “insider”--being the owner of Lakeridge--meant that MBP could not provide the requisite consent to force a “cramdown” of the plan over U.S. Bank’s objections. Lakeridge was therefore faced with liquidation unless MBP could transfer its claim against Lakeridge to a non-insider who would agree to the reorganization plan. Kathleen Bartlett, a member of MBP’s board, persuaded retired surgeon Robert Rabkin--with whom she was romantically involved--to purchase MBP’s multimillion-dollar claim for $5,000. Rabkin then consented to the reorganization plan. U.S. Bank again objected, arguing that the transaction was not truly at arm’s length due to the romantic relationship between Bartlett and Rabkin; Rabkin was essentially a “non-statutory” insider. The Bankruptcy Court rejected this argument, deeming Rabkin’s purchase a “speculative investment,” and noting that Rabkin and Bartlett lived separately and managed their own affairs. The U.S. Court of Appeals for the Ninth Circuit affirmed that judgment, concluding that it could not reverse unless the lower court had committed a “clear error.” The Supreme Court then granted certiorari to address the proper standard of review.By a vote of 9-0 the Supreme Court affirmed the judgment of the Ninth Circuit. In an opinion delivered by Justice Kagan, the Court held unanimously that the Ninth Circuit acted properly in reviewing the Bankruptcy Court’s determination of non-statutory insider status for clear error rather than undertaking de novo review.Justice Kennedy filed a concurring opinion. Justice Sotomayor also filed a concurring opinion, which was joined by Justices Kennedy, Thomas, and Gorsuch. Crash! The U.S. tort system provides civil redress when one party unfairly harms another. Plaintiff lawyers represent clients who allegedly suffered physical, emotional, and economic injuries as the result of somebody else's negligent or intentional action. Despite the alleged harms, in the vehicle collision world, the injured rarely file lawsuits and trials almost never happen. In this episode, we talk to Tricia Dennis, a graduate of the University of Tennessee School of Law. She's been a personal injury attorney in Chattanooga, TN for almost 30 years. While she's become extremely successful in her solo practice specializing in vehicle collisions, she provides a sobering look at how small law firm economics impact new and experienced practitioners. From dealing with sexist attorneys to corralling tough clients, Tricia reveals several challenges she's faced in her career. She walks us through client intake, negotiations, and settlement from a plaintiff lawyer's perspective.
