Fair warning, you may shed a tear listening to this episode, good tears of course.  Also, you might be asked to donate a toilet. Have you ever witnessed the unwavering dedication of someone determined to make a difference? That's exactly what you'll experience as Kimmy Chandler, the founder of Fluff Animal Rescue, joins us to share her incredible story. From the humble beginnings of a single act of compassion, Kimmy's journey blossomed into a thriving nonprofit animal rescue, exemplifying the power of community and the love for our four-legged family members. Throughout our conversation, we explore how a simple garage sale sparked the development of a sprawling thrift store, fueling the rescue's mission while paying tribute to the touching support from Kimmy's late father and the unwavering commitment of her family, staff, fosters, and volunteers.Getting up close and personal, we uncover the ambition and heart behind Fluff Animal Rescue's expansion into a new, versatile facility. Kimmy opens up about the monumental task of transforming a passion into a full-fledged operation that goes beyond the basics—it's about creating a multifunctional space for training, medical care, and even a pet food bank. We discuss the remarkable community effort required to bring this vision to life, from the skilled volunteers laying tiles to the generous souls fostering animals in need. It's a story that's as much about building a rescue center as it is about constructing a foundation for kindness and care within our society. Finally, we envision the future of animal welfare with Fluff Animal Rescue at the forefront. Dreams of puppy yoga, educational programs, and a summer camp for aspiring animal advocates give us a glimpse into the enrichment and expansion on the horizon. When was the last time you truly communicated with your pet? What if we told you that your furry companions are often trying to tell you something, and you just need to tune in to understand? Join us for a heartwarming chat with Shannon Spring, a gifted animal communicator and psychic medium. She opens up about her extraordinary ability to connect with animals and generously shares the most common messages she hears from our four-legged friends. Shannon shares her views on the top 10 things our pets want us to know1. Grief isn't a tribute. Please love again. Save a life, heal your hearts together. Of course I can't be replaced. Loving another soul never replaces mine. We never leave you, and you're not abandoning us when you move. We are everywhere, not in the ground or a container. We can always see, hear and feel you. Always.2. Souls live on regardless of human belief systems. It's the same as the sun setting and rising, your belief isn't required...the sun shines regardless. Souls have unlimited spiritual passports that aren't limited by human timelines or geography. So yes your childhood pets know your current ones, same as human souls not needing to meet in the physical realm.3. Please stop telling our sad stories and calling us old or sick. Words are energy and have the power to heal or infect. Let us move on from our painful pasts. 4. Please take care of yourself we worry like good parents do. We have to live your life choices. If you're in a toxic relationship, so are we. Be honest with yourself about how your choices affect us pets. 5. CLEAR THE AIR! STOP Smoking. Vaping. We need and deserve to breathe clean air. Be mindful of your energy and habits, it's all transferring to us.6. Clean the water and food bowls! Fill them with fresh, cool filtered water (even though we drink from toilet and eat poop, we still need clean water and bowls.)7. Ditch the kibble, it's hard on our digestive systems. Educate yourself on pet nutrition beyond what vets say. Fresh is always better. Wet food over dry. Just because we eat something doesn't mean we like it, it means we're hungry. 8. GO GREEN! Ditch the harsh chemicals. Lysol, Clorox, bleaches and heavy scents (many essential oils too) are killing us. Our senses are much stronger than yours and those things are making us sick. 9. Teach ALL kids pet manners. It's never cute to watch an animal be forced to tolerate rude kids. Stop asking us to tolerate pain and disrespect from adults and kids who lack boundaries. Advocate for us and say “NO” sometimes to others petting us.10. Would you like to be your pet? The gap between what the government spends and what it collects is expected to grow from about $1 trillion last year to $2 trillion for the 2023 fiscal year that ends Sept. 30, according to the latest projections from the Committee for a Responsible Federal Budget (CRFB), a nonpartisan group that advocates for reducing the federal deficit. "This would be the highest deficit we’ve ever had outside of a recession or national emergency," Marc Goldwein, a senior policy director at CRFB, told FOX Business. The sizable increase stems from a number of factors, including high inflation, more expensive interest payments and a drop in tax receipts. It comes on the heels of a record drop in the budget shortfall last year, as the deficit dropped from close to $3 trillion to roughly $1 trillion after the government's record spending during the COVID-19 pandemic in 2020 and 2021. In 2022, the government enjoyed a surge in capital gains revenue after Americans capitalized on the booming market the previous year, sold more stock and recorded large gains. The market has not fared as well since then, leading to a sharp drop in capital gains tax revenue compared with last year. The Treasury Department likewise benefited from a spike in general tax collection, because surging inflation essentially pushed up nominal income for millions of households. Although the IRS indexes the tax code to inflation, it does so on a lag. Higher federal income tax brackets and standard deductions took effect at the beginning of 2023, essentially allowing more Americans to shield their income from the IRS. Social Security and Medicare are also indexed to inflation, meaning the government is spending more money on those programs than it did in fiscal year 2022. "But mostly what’s happening is it’s coming to the new normal, from an unusually low 2022 deficit," Goldwein said. "That’s pretty scary, because normal before the pandemic was $1 trillion. And in 2015, it was $500 billion. So we went from $500 billion is the normal, to $1 trillion is the normal, to $2 trillion is the normal in less than a decade." The figures exclude President Biden's $400 billion student loan cancellation plan, which was counted in the official 2022 deficit numbers but never implemented because the Supreme Court struck the policy down. Such massive spending imbalances highlight the toll that high and rising debt can take on everyday Americans. High deficits can fuel inflation, and high debt can push up interest rates. "Mortgage rates are as high as they’ve been since well before the financial crisis," Goldwein said. "Car loan rates, student loan rates, credit card rates, they’re all really high." The deficit surge comes as lawmakers rush to avert a government shutdown. The White House has urged Congress to pass a short-term funding measure, known as a continuing resolution, in order to keep the government solvent while lawmakers continue negotiations over longer-term funding bills. Senate Majority Leader Chuck Schumer, D-N.Y., and House Speaker Kevin McCarthy, R-Calif., have both said they want to pass a short-term deal to keep the government running. However, a group of House Republicans — the House Freedom Caucus — is demanding a number of concessions as part of the continuing resolution, raising the risk of more down-to-the-wire drama on Capitol Hill. https://www.washingtonexaminer.com/news/white-house/biden-mask-indoors-jill-biden-covid Biden to wear mask indoors after COVID-19 exposure President Joe Biden will don a mask indoors after he was exposed to COVID-19 through his wife, first lady Jill Biden, according to the White House. https://twitter.com/i/status/1699269260260823345 - Play Video Now, Studies have repeatedly shown masks don't prevent Covid transmission and might even have health consequences to wearers. - But I digress. Biden, who awarded the Medal of Honor to Army Capt. Larry Taylor for conspicuous gallantry on Tuesday, is expected to depart Thursday for India and the Group of 20 leaders summit. During the Medal of Honor ceremony, Biden took off his mask for his remarks and did not put it back on to hang the trinket around Taylor's neck or to leave the East Room. National security adviser Jake Sullivan downplayed the prospect that a presidential COVID-19 diagnosis would disrupt his foreign trip based on leaders' past experience social distancing during the pandemic. https://www.theblaze.com/news/75000-sia-illegal-border-crossings 75,000 illegal immigrants flagged as having possible ties to terrorism in the last year, according to CBP data U.S. Customs and Border Protection flagged approximately 75,000 illegal immigrants as being possible national security threats or having terroristic ties in the previous 10 months leading up to August 2023, the Daily Caller reported. CBP data showed that between October 2022 and August 2023, 74,904 illegal aliens were labeled as "SIA Encounters," which stands for "Special Interest Alien." According to a Department of Homeland Security article, an SIA is a "non-U.S. person" who potentially "poses a national security risk to the United States or its interests." "Often such individuals or groups are employing travel patterns known or evaluated to possibly have a nexus to terrorism. DHS analysis includes an examination of travel patterns, points of origin, and/or travel segments that are tied to current assessments of national and international threat environments," the DHS stated. "This does not mean that all SIAs are 'terrorists,'" the government report added. However, the travel and behavior of certain individuals "indicates a possible nexus to nefarious activity (including terrorism) and, at a minimum, provides indicators that necessitate heightened screening and further investigation." The unearthed numbers were a massive increase from the reported 25,627 special interest encounters from fiscal year 2022, and the comparably miniscule 3,675 from fiscal year 2021. Illegal immigrants can automatically be deemed SIAs based on their country of origin, such as Turkey or Uzbekistan, due to such countries' status as a "source and transit country." DHS didn’t respond to a request for comment from the Daily Caller regarding the SIA figures. CBP and the DHS are under heightened scrutiny as a result of the shocking increase in border crossing encounters under the Biden administration. A former immigration judge claimed in late August 2023 that the DHS was deliberately not disclosing the number of illegal immigrants who have been released into the United States each month. "The only reason why ICE and OFO [Office of Field Operations] would refuse to disclose that information is to hide the fact that it is releasing more than 100,000 aliens per month into the United States and to conceal the effects of those migrant releases on communities across the United States," Andrew Arthur said. Border encounters in fiscal year 2023 are on pace to match the near 2.4 million that were seen in 2022. There were just over 1.7 million encounters in 2021, while in 2020, President Trump's administration saw a little more than 450,000. https://townhall.com/tipsheet/leahbarkoukis/2023/09/05/ev-florida-n2627949#google_vignette Electric Vehicles Are Causing Issues After Hurricane Idalia Electric vehicles are catching on fire after Hurricane Idalia made landfall in Florida last week. According to local reports, at least two Tesla EVs ignited after saltwater from the storm surge damaged their batteries and other electrical components. One vehicle lit up in Pinellas Park and another car fire occurred in Palm Harbor. “Carfax says owners need to understand the fire risk doesn’t go away after their EV dries out,” ABC Actions News told viewers. “The salt water that is flooding can get into the battery and dry there and once it dries it creates what federal safety officials call bridges between cells and that can lead to fires and those fires can come anywhere from days to weeks later and once an EV catches fire it is incredible difficult to put it out,” said Patrick Olsen of Carfax. After Hurricane Ian, 21 electric vehicles caught fire in the state, prompting officials to warn residents ahead of Idalia's approach. “We saw a number of fires associated with EVs from Hurricane Ian. We know that the saltwater from storm surge can compromise these batteries, causing fires which cannot be easily suppressed,” Florida Chief Financial Officer Jimmy Patronis said at the time. “The best fire teams can do is keep water on the battery until the fuel burns out. If you’re evacuating and leaving an EV, or other lithium ion powered devices like scooters or golf carts in your garage, you’re creating a real fire threat for your home, your communities, and first responders," he added. "Take this threat seriously. If there’s even a small risk of your EV being impacted by storm surge, move it to higher ground before it’s too late.” One home that managed to survive Ian ended up burning to the ground because of a saltwater-damaged EV. EV vehicle owners are being advised to park affected cars at least 50 feet away from any structures that could catch fire.

Less than three hours later she had mysteriously vanished. There were no signs of a struggle, no indications of where Bobbie may have gone. Left behind were her purse and her cigarettes; the only things missing were Bobbie and her 1973 Plymouth Fury. While, at first, her family thought there might be a reasonable explanation, investigators were immediately concerned.Less than a year earlier, two other women had vanished under similar circumstances from within the same area. Police found one body, but the other remained missing. Soon it became a race against time to determine if Bobbie had been targeted by someone she knew or if she'd fallen victim to a yet unknown serial killer.FB: https://www.facebook.com/TraceEvidencePod/IG: https://www.instagram.com/traceevidencepod/TW: https://twitter.com/TraceEvPodVisit https://www.trace-evidence.com for more information, case photos, contact information and more.Merch: https://traceevidence.threadless.com/ Music Courtesy of: "Lost Time" Kevin MacLeod (incompetech.com) Licensed under Creative Commons: By Attribution 3.0 License http://creativecommons.org/licenses/by/3.0/

News broke early this morning about an officer who was shot at a Circle K in Pinellas Park. MJ has the details on what went down. Today's Morons in the News features someone who goes far beyond the tendencies of a porch pirate... This person stole a lot more than just one package! A woman comes to the rescue after MJ asks if any laundromat owners will let Shorty Shane and Fester record a new PSA video. There's an update on the man who was caught throwing whipped cream in strangers faces in South Carolina... Apparently the suspect is still at large. Roxanne got an angry e-mail from a listener about her parenting skills. Roxanne also reveals that she thinks her daughter is an amazing singer, in the least stage-mom way possible. MJ and the crew play an audio bite of her daughter singing. A video is making rounds after Bill O'Reilly, former Fox News host, was seen yelling at a JetBlue gate attendant at an airport. But this isn't the first time he's had a blow up. Fester and his wife Alyson noticed there might be a violin scam around the Bay area. Have listeners noticed this too? Froggy finds an old crank radio show when he pretended to have a monkey co-host. A tiger chomped down on a Florida man's arm after he entered an enclosure. Why did he do it? There's update on the fire that broke out at a Home Depot in California. It's time for another edition of... What Did MJ's Neighbor Order on Uber Eats? Can MJ and the crew listen to a full clip of a podcast host and Kim Kardashian speaking in vocal fry?

Jeff Sterns, I'm connected through cars with my good friend Alan Moore, and I'm really looking forward to this episode. I hope you enjoy it. Alan had an illustrious career from selling German imports and Ferrari before joining DuPont registry, and then running Boulevard customs customization for exotics for celebrities, including some world known pieces in SEMA. And finally at the Tampa Bay auto museum. He's got a fabulous history, United States, France. Take a look, I hope you enjoy. 3:47 Alan went to France as a kid and was mesmerized. 5:23 So like I drew a bunch of 911 turbos, so 911 turbos with that big whale tail. You know, the 930s like the 76. 6:35 I realized there was a lot of a lot of innovation that occurred. And you know, even in the early early 1900s, late 1800s, early 1900s in France, of course, Germany as well. 8:33 Citroen two CV, which is the French version of the Volkswagen, ....it was an air cooled two cylinder horizontally opposed front wheel drive car, with just tons of room. You can seat five or six people in it, and get 40 to 50 miles per gallon and they never broke. There's no coolant. There's, there's really it's such a simple car. So they made you know, 9-10 million of those cars. 9:23 Alan as a young man was general manager of a fast food restaurant. The owner and general manager of actually at the time, came in and recruited him to sell Honda. 12:15 Alan moves to Mercedes for the next eight years. 14:30 Alan's love of the car helped him sell the remaining Peugeots after the brand left the USA. 14:30 Alan also sold Ferrari. it was a 2.0 or 3.0 Testarossa Correct, i12:15 Ferrari 456 looked like a Ford Probe. 18:28 Dealer gives up the Ferrari dealership due to Ferrari's pressure to get into teh Challenge racing program. 19:46 Ferrari salespeople! Listen to this in case you ever have to go back to selling to get models out the door! 22:00 Jeff and Alan discuss the ethics and dynamics of "above MSRP" sellers and buyers. 28:10 Jeff proves that his 27 years in dealerships and eight years as a consultant to the business knows everything about cars... (nothing) 28:16 Alan left the retail carbon assignment to work for DuPont publishing and DuPont registry. 32:06 Carrera GT, which were the V 10, carbon fiber, mid engine, Porsche, they listed like $450,000, sticker price. 38:12 (Porsche Cararra GT customer: "How do I get out of this car, I'm gonna kill myself in this car." .38:54 Jeff: I've called surgeons, and they said, Doctor, whoever's in surgery, and I've said oh, you know, I'm just the car guy with this turbo or he was looking for, oh, he said, If you call to interrupt them. I know you've been there. I mean, I can ask any guy and and, and I'm like, Well, I hope it wasn't a heart transplant. You know, he's doing yours and the guy would just come on for a minute. 43:16 Good job getting 100 grand deposit from the European on the super America. That's not a deal. And good job getting the $550k or whatever we got for the Daytona that's not a deal even though the car is shipped already. And we got the money already. 50:06 let me let me get dealers off the hook around the world that customers get frustrated about shipping. (Jeff tells some crazy transport stories) 55:41 Audience! with Alan you've got a guy in a museum for the same reasons that he got into the business you love. 56:22 Well, so the the finance manager needs to take your car deal. And find a lender, whether it's the manufacturer or a bank, that will agree to the interest rate and terms necessary to make your deal work at the numbers that you've agreed to with the customer. 1:00:48 you and I met through DuPont registry. Right, who's gonna look at the web, 1:07:53 (origin of cars and coffee) Tom duPont came back from California. And he was out there at some event that he said, Hey, I was stopped into Starbucks on the way to the airport Saturday morning and they're having a car show out there in the parking lot of Starbucks, like Lamborghinis and Ferraris and muscle cars and all kinds of cool stuff. And apparently they do this every week. 1:08:36 Vinnie (Russo/from another episode), you know, we were doing events. And then he was running our most of our events at that point. And so we all sat down and came up with this idea for this cars and coffee and came up with a logo This was oh five june of Oh, five. I think I think you were there. That one or one of the first? 1:09:25 Jeff: I was there early. 1:11:45 "Floridians and weather" 1:12:26 Jeff: I probably even brought my 31 Ford hot rod (to cars and coffee) 1:13:08 we had one car that that left the road and bent itself. a really nice restored 440 charger, that when he left and he jumped on it got a little sideways, he overcorrected, and nosed it into the ditch and bent it 1:18:38 I have a little Smithsonian Museum of my past cell phones. 1:26:43 a museum. And I walked in there and I'm thinking, this is just incredible. You know, these, this, this is right here in Pinellas Park. There's, I don't know that there's another museum like it anywhere that has the kind of innovation that they're that they're so enthusiastic about right here in front of us. Yeah, the Honorable disco bar scene. 1:29:09 why would you want your dad to bring home a 38 Oakland for the kids to look at at night when you could bring, you know a waitress in cocaine? 1:30:41 the most interesting car we just got. You will appreciate is a 1913 wait for it. Sterns, knight, 1:34:07 Roy Jones, a fighter Phantom when that car came out. Walking, horse drawn carriages and bicycles are the way most people get around the 8.3 mile island and we had a ball. The weather was cool, brisk and a little rainy at times. High waves on Lake Huron washed over the road in a couple spots. But we rode bikes around and through the island, toured the attractions and had a ball. And yes, there were frequent fudge breaks (Mackinac Island is famous for fudge)! Look for a video in a couple weeks. As this podcast is being released, we expect to be on the road again, this time headed once again for Florida, by way of our grandson Matthew’s football games in southwest Georgia. We expect to attend as many as we can, hanging out at our condo on Okaloosa Island and also traveling Florida to do some research for some upcoming 7 day Adventure Guides we hope to publish right after the holidays. The committee said the campgrounds have outmoded infrastructure, and not enough funds to keep up with demands. The committee also wants to have senior discount blackout periods to bring in more money. You can bet this idea will stir up some heated debate! JENNIFER Keep your distance from the elk park service warns visitors in North Carolina and Tennessee The National Park Service is warning visitors to national parks in North Carolina and Tennessee to beware of elk. Elk were reintroduced to the area in 2001-2002 after over hunting and loss of habitat had eliminated them. But since their reintroduction, their numbers have grown significantly. Sex Crimes Kids  Bauer Crider & Parry Podcast Brad: Alright, you are listening to the FloridaDefense.com Podcast. We are speaking to St Petersburg Sexual Battery Defense Lawyer Mike Kenny at the Bauer Crider & Parry Law Firm. Mike, how are you? Mike: I'm very well. How are you doing? B: I'm doing well. Today we're going to be talking about sex crimes versus kids but I want to just kind of throw out there I know you guys have multiple offices. You kind of cover a wide area there in the Tampa, the greater Tampa area. Could you mention kind of, well first of all, let's talk about the offices that you have and then some of the other areas that you target. M: Well, we have an office in Hillsborough County, and that office is actually right across the street from the courthouse on Twiggs Street in Tampa. So that office is kind of designed for our Tampa clients and our Tampa type cases which covers anything from Plant City, Wesley Chapel, New Tampa, obviously the entire Tampa area. We have an office in Clearwater, and that's kind of more of our Pinellas County office and obviously it's gonna cover all of your cases throughout Pinellas County which will be Clearwater, Clearwater Beach, St Petersburg, St Pete Beach, Largo, Tarpon Springs, you've got Pinellas Park, Kenneth City, obviously Pinellas County is a large area and we definitely cover a lot of cases throughout the county there. We have two offices in Pasco County. We have one in Port Richey and one in Trinity Florida. Obviously our Pasco County reach covers New Port Richey, Dade City, Port Richey, Holiday. The Port Richey office also covers Brooksville cases which I tend to handle on a repeat basis and the main area in Hernando County that I cover is going to be Brooksville and obviously then we have our Trinity office. Our Trinity office also covers, because we do a lot of work in Pasco County, covers the same places in Pasco County, New Port Richey, Port Richey, Holiday, Dade City, Hudson. B: Great. So you guys are pretty much all over the place in the Tampa area with four different offices to choose from.  M: Sure.  B: Well, let's - Mike, let's go ahead and jump in. Let's talk a little bit about sex crimes versus kids or versus a child and I'll just kind of if you can kind of just give us an overview of that. M: Alright, well, so there's two types of sex crimes, or two categories of sex crimes involving children. And there's actually, now that I think about it there might actually be even three if you want to kind of divide it up even further. But the sex crimes are initially the battery - whether or not there's a sexual battery. Battery, as I talked about in a previous podcast talks about essentially penetration. That's what you're looking for. Sexual battery is defined as oral, anal, or vaginal penetration by or union with the sexual organ of another or the anal or vaginal penetration of another by any other object. So that's kind of what you look for if you're talking about was it a sexual battery or not? And there's other types of crimes and crimes that don't involve penetration but involve touching - that's where you get the term molestation.  3:46 (skipped per Brad's request) 3:54 But those types of crimes are crimes that don't involve any type of sexual battery, whether it be penetration of the mouth with a sexual organ or the penis or vagina. So in that set of circumstances, you've got that category and then the next category is the age. Obviously, as we talked about before, the age of consent for sexual activity in Florida, generally speaking, is 16 years old. So the key age that we look for in a sexual battery case is the victim has to be 15 or younger. So if the victim is under the age of 15, that becomes a crime if there is either a molestation or there is a penetration, sexual battery type situation. So if you have a scenario where there has been alleged sexual activity like actual intercourse between someone over the age of 15 - and that could be 16, 17, 18, whatever, you don't even have to be an adult, but someone over the age of 15 having sexual intercourse with a 15 year old, that is a lewd or lascivious battery. And that's a specific crime that addresses sex of a person younger than 16 - basically 15 and older than 12 - it's a lewd or lascivious battery. If a person, this is the next category that I was going to talk to you about - this third unique category. If a person who is a victim of a sexual battery is under the age of 12, that in Florida is defined as a Capital Sexual Battery. Years and years and years ago that crime was punishable by death. Now it is obviously punishable by life in prison without parole. So if a person is convicted of a sexual battery, there is no other option for that person other than a life in prison type sentence. So the age matters very much because it completely changes the term of years a person might be facing and the severity of sentence the person might be facing. If a person's under 12 and it's sexual intercourse, it's gonna be a life imprisonment sentence if they get convicted. If a person's under 15, it's gonna be much less significant, it's not even gonna be a life sentence at all. The next question or category of concern is the molestation type charges. A lewd or lascivious molestation can happen above or under the clothing so situations where a person is fondled over their shirt, for instance, that can qualify as a lewd or lascivious molestation.  B: Mike, can I jump in real quick there. That is similar to - you said that you don't necessarily have indecent exposure there in Florida, but that's kind of what that's referring to, is that correct? M: No, that's another unique, it's not really a crime where there's contact with another person, but in Florida, obviously everyone can imagine there's crimes that involve people exposing themselves to other folks. In Florida that's called a lewd or lascivious exhibition. A lewd or lascivious exhibition, the key phrase there is lewd or lascivious, that the person is exposing him or herself in a lewd or lascivious manner, which means of a sexually oriented nature. For instance, give you an idea, a guy who's driving on a long trip and had a lot to drink beverage wise and needs to get out of the car and use the facilities of the forest, that person is not committing a lewd or lascivious exhibition if he gets caught by police urinating on the side of the road. Now, there is another crime for that. That's generally speaking a disorderly conduct type crime, but there's also a crime called exposure of sexual organs. That's a misdemeanor and it's not a sex related crime per say, you don't have a sexual registration requirement or anything like that, but exposure of sexual organs comes up when a person's (obviously sexual organs being a penis or a vagina) are exposed and there's nothing about the act in and of itself that shows it's of a sexually motivated manner. There isn't any talk about sex, there isn't any fondling. There isn't anything that would indicate other than the person is exposed. So that's a misdemeanor. But if a person exposes himself and exposes himself to a person under the age of 16, that's when you start to get into the lewd or lascivious exhibition problem. That's when you get to the felony aspect of it. It has to be both an exposure and it has to be an exposure in front of a person under the age of 16, you need a witness to it who is under the age of 16, and it has to be again, of a lewd or lascivious manner. So it's got to be something that is sexually oriented and I'm sure we don't need to go over every single scenario where that could be, but some unique cases have come up where there have been cases that have been litigated and actually gone up to appellate courts where a person fought a lewd or lascivious exhibition conviction because he or she answered the door and he happened to be naked from the waist down and there happened to be some children who were at the door. Some discussion about those cases talked about how he might have been in his own home but he clearly knew that there was children coming to the door to sell something. Sell raffle tickets, girl scout cookies, and even talked about whether or not there was - the sexual organ itself was flaccid or not. So there's a lot of things that the court looks to to describe the intentional exposure of a sexual organ designed to be in a lewd and lascivious manner.  B: Alright, one thing we didn't talk about is child pornography, which is obviously a sex crime versus a kid, right? Might be a whole another podcast, but is there anything that you want to touch on that? M: Well, the and we kind of had a podcast before talking about computer crimes, but the issue of possession of child pornography that the basic idea behind it is the person either has an image either on paper - tangible like he can hold it - or he or she has it in his computer and they're images of children. And they're not photographs of baby pictures, right? I'm sure everybody has a baby picture somewhere of his or her own child. But these are photographs that have the children in a sexually provocative manner. It's not just a naked child, but it's a child in a sexually oriented fashion. A lot of these images that get caught and punished are horrible images of children involved in sexual activity with other children or even adults. So it's not something where someone can get in trouble just for having a naked picture, because that's not necessarily pornography. Pornography has to have a sexual element attached to it. The sex crimes that we were talking about where we have the under 12 which is a life felony if it's a sexual battery. If it's not a sexual battery but a molestation, which is a hand touching the chest or the buttocks or the sexual organ of the other person, those are molestation type cases. And if the person is under 12 in that case, but it's not a sexual battery, it's still a life type felony. When I say a life type felony, those cases are punishable by 25 years to life. So the idea here, is the legislature is very hard on sex crimes to begin with and the laws are very strict, but they are even more severe when the children become of such a young age that we're talking 10 or 11 years old - anything under 12. As a prosecutor, I prosecuted tons of capital sexual battery cases. I went to trial on several and those folks who got convicted are still sitting in prison and they're going to spend the rest of their lives in prison. So the penalty is severe. That's why, if you find yourself accused of something this horrific, the first thing you're gonna want to do is make sure you find yourself a lawyer who you trust and a lawyer who you believe has got the ability to defend you. Because the cost is great.        B: Alright, anything else on that Mike?  M: No Sir, I think that covers it. B: You've been listening to the FloridaDefense.com Podcast. We've been speaking to St Petersburg Criminal Defense Attorney Mike Kenny at the Bauer Crider & Parry Law Firm. We will see you on the next podcast.
