What's up with climate change and climate law?  The U.S. Environmental Protection Agency has announced that it is going to cancel the “endangerment finding” of 2009 that provided the legal basis for regulation of greenhouse gas emissions. In July, the Department of Energy released “A Critical Review of Impacts of Greenhouse Gas Emissions on the U.S. Climate,” which downplayed the research, the impacts and the importance of climate change.  The Trump Administration has pretty much declared that is it going to eliminate anything that suggests climate change is a threat.  And fossil fuel companies have been unleashed to produce anywhere the is even a hint of fossil carbon.  At the same time, three international courts—the International Court of Justice, the Inter-American Court of Human Rights and the International Tribunal for the Law of the Sea—have issued opinions that international climate law requires countries to act now to reduce emissions.  What does the law say?  What is law's impact?Join host Ronnie Lipschutz for a conversation with Professor Alice Kaswan of the University of San Francisco School of Law. Professor Kaswan's scholarly work focuses on climate change with a particular emphasis on federalism and on environmental justice. The International Court of Justice has delivered a landmark, albeit nonbinding ruling, that countries have a legal obligation to act on climate change. In this context, climate news in this past week has raised worry for climate advocates. The New Zealand government has passed legislation to reverse the 2018 ban on new oil and gas exploration projects, which is predicted to increase the country's emissions by 14.2 million tonnes according to official analysis.  As well, the United States are seeking to negate the finding that greenhouse gas emissions pose any danger to human health, with the aim to reduce the power of the Environmental Protection Agency to restrict activities that produce these emissions. Wire Host Sara spoke to Greenpeace executive director Russel Norman about these two cases and their potential consequences for global climate action.

Heather has twenty years of experience in Indigenous, Arctic and resource development and governance. It's a post-pandemic world, and Minnesota's greenhouse emissions are following the nationwide trend of going up. Based on recent state data from 2020 to 2022, emissions rose 6.4 percent with transportation and agriculture being the biggest contributors. Now, the state is off-track to meet its climate goal of reaching net-zero emissions by 2050. “I think it will be difficult to meet,” said Walker Orenstein, a reporter with The Minnesota Star Tribune. “As the state has pointed out, if we don't start seeing big drops in sectors that aren't the electric sector, then it will be troublesome.” MPR News chief meteorologist Paul Huttner talked to Orenstein about his reporting on the biennial greenhouse gas emissions report. Emissions of greenhouse gases in Minnesota increased between 2020 and 2022, according to a new report from the state out today. It's the latest of the updates the state releases every two years on its progress toward a goal of bringing greenhouse gas emissions down to 0 by 2050.These gases, including carbon dioxide and methane, are released by burning fossil fuels and other human activities. They're also driving climate change, which scientists say is already contributing to things like more frequent severe weather and warmer winters. Minnesota Department of Commerce Commissioner Grace Arnold joined the program to talk about the new report.

 The city of Bend is exploring how it could reduce greenhouse gas emissions by 70% by 2050. The goals are outlined in the city’s Community Climate Action Plan, which it’s working on updating.  Officials are examining what strategies to prioritize and how future policies could affect Bend's businesses, affordable housing goals and economy. Recently, the city has considered how it could construct new  buildings that have electric appliances rather than fossil-fuel power sources like gas. While some climate activists applaud the efforts, others wonder how new regulations could affect the city financially and leave it vulnerable to costly lawsuits.   Cyrus Mooney is the business advocate for the city of Bend. Cassie Lacy is the senior management analyst for the city. They join us with details of the city’s plans.  

The Montana Supreme Court Friday affirmed a lower court ruling finding that state environmental regulators failed to assess the greenhouse gas emissions associated with a fossil fuel power plant.

Sea Turtle Conservation in Florida is hard and it's about to get harder with the onset of increased intensity of hurricanes and increased sea level rise. Sea Turtle Conservation has been successful over the past few decades with protection policies being implemented along Florida coastlines. Still, hurricane events and increased sea level rise can wipe out nests in one storm killing hundreds of thousands of sea turtles. In this episode of the How to Protect the Ocean podcast, host Andrew Lord discusses the challenges facing sea turtle conservation in Florida, particularly in light of climate change. While sea turtles have seen a resurgence due to decades of conservation efforts, new threats are emerging that jeopardize their future. The episode highlights the impact of climate change, specifically the increase in hurricane intensity and rising sea levels, on sea turtle nesting. The 2024 hurricane season demonstrated these vulnerabilities, with storms like Hurricane Beryl and Hurricane Debbie destroying hundreds of nests along Florida's Gulf Coast. The physical toll on nesting beaches, including erosion and loss of habitat, poses a significant threat to the survival of sea turtles. Sea turtles play a crucial role in marine ecosystems, maintaining the health of seagrass beds and coral reefs. Their decline could have far-reaching consequences for marine biodiversity. The episode emphasizes that protecting sea turtles from climate change impacts is a complex challenge that requires collective action.
