I can think of no better guest to officially launch the Set For Sentencing Podcast than the incomparable Liz Vartkessian! As the Executive Director of Advancing Real Change, Inc., she understands that narrative is everything at sentencing.  She knows that our clients are more than their worst deed, and more than just a stack of paper in a file.  Her amazing organization takes an undeniably essential humanistic approach to the development of crucial sentencing mitigation in capital and serious non-capital cases. I have learned so much from Liz and the fantastic trainings her organization provides over the years, and I can't wait for you to meet her. DISCUSSED IN THIS EPISODE: How narrative is everything when it comes to sentencing mitigation; How to mine for the raw materials of a winning mitigation narrative; The fantastic work Advancing Real Change does in capital and non-cap cases; Some basic, but essential, things a lawyer can do to develop a humanizing mitigation narrative; The importance of understanding and recognizing trauma; Knowing when you do and do not need an expert; Dr. Vartkessian's groundbreaking research on the Capital Jury Project and what motivates juries to impose a life, rather than death, sentence; Advice to help lawyers communicate the humanity of their client to the decision maker(s) in their case; How to prepare innocent clients for allocution; What working with those who have committed murder can teach us about justice (and Liz's book in the works on that very subject). FREE RESOURCES: RECORD RELEASE FORMS:As Dr. Vartkessian discusses, one simple thing a lawyer can do is keep a release of records in every new file. That way, your client can sign releases at the outset and you and your team can get started on record collection.  Even if you don't recognize the need to find a particular record, you will be happy to have these signed releases when something comes up and you need to act fast.  SEND ME AN EMAIL AT DOUG@DOUGPASSONLAW.COM with “sample forms” in the subject line and I will send you the ones I use! No Shame On U (NSOU)Featuring: Miriam Ament, Founder & Executive DirectorThe most impactful organizations often come from one person who has lived through a traumatic experience and recognizes that they could be a catalyst for the solution. This conversation with Miriam Ament, the founder and executive director of NSOU is a great example of the power of one individual. Miriam realized that mental health conditions, which are often perceived at a “big negative”, shouldn't be a secret. This awareness led Miriam to focus  on utilizing her life experiences in order to normalize mental health conversations. No Shame On U is dedicated to eliminating the stigma associated with mental health conditions and raising awareness in the Jewish community and beyond. Knowing that her story helps many others, Miriam shares vulnerably. On this podcast, she tells the story of how she started No Shame On U and gives examples of the impact it is making. I was personally impressed to hear that NSOU offered 240 programs over the pandemic. They continue to increase their impact. She also provides resources and tips for those who are struggling with mental illness. Two tools, of many possible ones, that Miriam mentions on this podcast are gratitude and exercise. No Shame on U held their first official event in November, 2015. They hosted speaker/author Kevin Briggs. Kevin Briggs is known as the Guardian of the Golden Gate. Kevin is a California Highway Patrol officer noted for his work in suicide intervention, having dissuaded more than two hundred people from jumping off the Golden Gate Bridge into San Francisco Bay. In 2013, Briggs retired from the California Highway Patrol to focus his efforts on suicide prevention. He is the author of “Guardian of the Golden Gate: Protecting the Line Between Hope and Despair.” His book can be found here on Amazon. He also has a Ted Talk from 2014 found here. Most importantly,  to those with mental illness Miriam's and the message of No Shame On U is that they are not alone. I am grateful to share Miriam's story and the work of NSOU. If you or someone you know is in crisis please utilize the resources listed below. Research on Mental Health Conditions (from  No Shame On U's Website)More than one in four Americans ages 18 or older lives with a diagnosable mental health issue - 26.2%. This means that on average, every family is touched by mental illness. Yet two thirds of those diagnosed do not get treated. Research shows that stigma is one of the key barriers to people seeking mental health treatment. Founded in November, 2014, No Shame On U is dedicated to breaking the stigma associated with mental health so the people who need the help will seek it, family members and friends will know how to provide proper support, and to save lives. We achieve our mission through our community outreach programs, classes and workshops, our online presence of over 120,000 social media followers, our weekly blog, our podcast, distribution of our fact sheets, crisis information magnets and videos, and educational presentations. For No Shame On U's mission & more about their work, visit https://www.noshameonu.org/.Mental Health ResourcesIf you are in crisis, or know someone who is, you are not alone: please call 24/7 hotline: 1-800-273-8355 (TALK) OR text 741741 for a 24/7 crisis text line a live, OR go to www.imalive.org for 24/7 online crisis chat.Support the show (https://www.bridges613.org/donate)

Golden Nuggets From This Episode: ✨ “When we start the embodiment work, the journey is allowing the body to catch up with what the mind knows.” ✨ “The body remembers what the mind doesn't.” ✨ “Embodiment work is a journey of learning how to re-pattern our ways of being so that we're not constantly putting stress in our nervous system so that we're not constantly overwhelming our bodies.” ✨ “How our nervous systems feel will transpire into every single part of our minds and our bodies and they will control what we think, what we do, and how we feel.” ✨ “Literally, every single aspect of our lives - an emotional, physical, mental, and energetic level is impacted by stress.” ✨ “Understanding and really acknowledging where we're out of alignment is important.” ✨ “Connect to your breath before you connect to anything else.” ✨ “If your nervous system doesn't feel safe to be half-experienced, do the thing that you're wanting to magnetize, to attract, to manifest into your life, it will try to push it away at all cost to keep you safe.” ✨ “In order to really attract and magnetize the things that we want in relationships, in our lives, in our businesses, in our leadership, we get to amplify and expand our container in order to do half of that thing.” ✨ “When we are wanting to manifest and magnetize things into our lives, we need to understand that our capacity to hold those things must expand as well.” Free Offer: Join Open for 30 days free with my code: HEARTSNUGGLES ~ Your ritual starts now. Former 10,000 "No"s guest Zander Fryer met his fiance, Maddy Applin from across the world after being pushed to post a Facebook Live in his Business Group in 2017 entitled "Help Me Find Love". He was in San Diego and she was in Australia.  They now live together in Encinitas, California.  You'll hear the details of how Maddy moved halfway across the world for love, but all you need to know right now is that your approach to life, whether in business or in love, determines the results you will get.  In keeping with our theme, if you're lonely this Valentine's Day perhaps you need to examine where you are limiting your own opportunities with internal "no"s that are preventing you from meeting the person of your dreams or creating the life and career that you desire.    SHOW NOTES:  Meeting together in 2017 from a Facebook Live event, (5:07). “This is something that a lot of people do. Once you’ve had your heart broken once, you never want to have your heart broken again.”, (9:55). “You can get really comfortable just crafting your craft, and that is the comfortable piece. I got really comfortable working on myself because that is the piece that I enjoyed and that made me feel good, but actually putting myself out there and going on dates is the really scary piece.”, (11:05). Maddy listening to a podcast and finding out about Zander and his work, (13:27). Making a commitment to yourself to get out of your comfort zone with bold requests, (15:09). Maddy persevering by reaching out again after a botched “second date”, (20:45). How Maddy works with her clients around belief systems and dealing with their subconscious limiting beliefs, (27:20). “They might have the outward success and everything they have dreamed of, but they still don’t feel successful.”, (28:16). As we continue our holiday hiatus, we give you another one of last year's transformational New Year's interviews, this time with top strength coach and transformation specialist, Jay Ferruggia. If you are in the midst of beginning your New Year's resolutions, you don't want to miss this one.  Enjoy...    Jay Ferruggia is bald, jacked and tattoed.  So it's easy to be intimidated by him or judge him from afar, as I once did.  But scratch the surface and under the muscular build is a sensitive, inquisitive soul who has made it his life's work to strengthen others physically, psychologically and spiritually, as he did for me for a recent role.  Our conversation covers topics as specific as the benefits of sea salt and top training techniques, to Jay's systematic strategies to overcome his "introvert" label and become a super-connector.  Jay's transformation from a "skinny-fat" kid from Jersey to influencing tens of thousands of followers through his books, his podcast, his articles and his weekend retreat events is the stuff of movies.  You will come away knowing more about how to transform your body and, more importantly, your mind in order live up to your full potential.    SHOW NOTES:  How I judged Jay based on his appearance before ever speaking to him, (4:57).   As we continue our holiday hiatus, we give you last year's New Year's day interview again because it is so inspirational in terms of Transformation.  It applies as much as we kick off 2020 as it did at the start of 2019.  Enjoy...   Charlie Rocket ran a multi-million dollar business where he managed hip-hop artists like 2 Chainz into Grammy Awards.  But he weighed over 300 lbs and was diagnosed with a brain tumor so he decided to do what he has done his entire life:  dream the biggest dream and then set about working toward attaining it, regardless of whether his family and friends thought he was crazy.  One of those dreams was to be a Nike Athlete, which came true when his fan-created commercial of his transformation from obesity to Ironman went viral and he was flown to Nike's headquarters in Oregon.  That trip led to Charlie being featured alongside Lebron James and Serena Williams in a commercial with Colin Kaepernick... something that Charlie had been writing in his journal for months prior.    His worldview has such simplicity that it is unique:  to remove the brain and allow himself to dream like a child.  But his follow-through and workmanship, fueled by these dreams, is what has so many people talking about him.  10,000 "No"s intended to be on a two month break for the holidays, but this inspiring conversation felt too pertinent to release on any other day of the year besides New Year's Day.  Launch into your 2019 with the wise words of Charlie Rocket!    SHOW NOTES:  Coming from a long line of vacuum salespeople, (8:11).  Getting fired by Soldier Boy at age 18 and deciding to rep musicians as a talent manager, (11:17).  "If you want to be successful, you have to be of servitude, (12:50).  Posting hundreds of MySpace comments for hours every single day to build an audience one person at a time, (14:00).   Driving the entire coast to 'Salute the DJ' and build an army of DJs who would ultimately help him and his artists win a Grammy, (14:45).  Serving DJs by making it easier for them to access their music better by building the biggest DJ website in the world for Urban DJs, DJservicepack.com, (16:41).  How Charlie executed these big dream ideas, (18:07).  "The key thing is, I shut down my brain...", (19:47).  Walking away from a very successful music career at 305lbs, with a brain tumor, to become an athlete, (21:41).  Why Nike was so special to Charlie from a young age, (25:17).  How Charlie turned his recurring journal entry of a year into a reality, (29:01).  Charlie's dichotomy of being a dreamer and a pragmatic practitioner, (30:46).  Being honest and asking for help from followers, (35:44).  Mobilizing a fan base to help launch a book, (37:13).  Shrinking the brain tumor through a diet of living foods, (39:45).  The word "no" really means "not yet", (40:46).   The "Buy, Cry or Die" theory, (41:01).  What Charlie learned about marketing from PDiddy, (42:39).  Bad relationship to spending money, "We spend it and get it back, we that invented that.", (45:29).  The negatives knock you down, but they're also the tools to your positives... so you can change anything, (47:49).  Charlie's lone regret about not spending enough time with his grandfather because he was chasing the flash of the music industry(48:31).    LINKS:  Website: More on Charlie  Twitter: @CharlieJabaley  Podcast: Charlie Rocket Show  YouTube: Fan Made Nike Commercial  YouTube: Nike's 30th Anniversary Ad  Pre-order Matt's Upcoming Indie Film, Limerence, on iTunes here!!! As a professional track and field athlete and Olympic Trials Qualifier, Steven Benedict has run in some of the world's most prestigious events. In addition to the Adidas Classic Diamond League and US Nationals, he spent two years running for Nike and was a Penn Relays Champion. Featured in 50 national and international magazines, such as Train, ESPN Magazine, Men's Fitness, Men's Health, and Fitness RX, Steven has expertise and contributions that extend far beyond the track.  But his story is that of a boy overcoming incredible odds to, not only compete on such a high level, but to just be alive.   Over the course of his first 8 years, Steven was moved between homes and motels with little certainty of what the next day would bring. At age 8, he and his brother were adopted by an incredible couple, who possessed traits of joy, humility, sacrifice and unconditional love. The time with these parents would be short lived, however, as both his mom and dad suffered untimely deaths within a few years of each other. The pain of these losses nearly ended Steven’s professional career but, once again, Steven defied the odds and continues to overcome his 10,000 "No"s.      SHOW NOTES:  Going back and forth between foster care and his biological mother’s arms at 4 months old, (4:35). “He saw fit to lay his hands on us and beat us when we were young. I was hospitalized.”, (6:15). Being forced out of childhood and into a father-figure role to take care of his brother, (6:35). “I felt that there was more stability for us going into foster care even though stability for us at that point was just to have a roof over our head, a warm bed to sleep in and a hot meal to eat.”, (7:51). Learning how observant of a person he was in foster home, (10:42). “My brother thought that was our permanent home and he was angry at my adopted parents for taking them away, thinking he was taken away from his family now.”, (11:55). Getting involved into sports, music and art with his adopted mother, (14:10). Joining track and field at summer camp when he was 9 and continued into high school, (15:20). “There’s always going to be somebody better and there’s always going to be somebody that has a little more natural talent, but I think where I make up for that is my work ethic.”, (18:45). Wondering a bunch of questions about his past, (21:21). “I had bottled up, unresolved problems from my past and that kind of overflowed in high school. I had to go see somebody to talk to about getting into fights and being hot-tempered.”, (22:15). Finding out his biological father was incarcerated and hung himself in jail, (24:15). “I took a whole year to take toll of who I was, who I was becoming and really clear up a bunch of stuff on the inside I was working through.”, (28:48). “We get angry over the smallest things, and then we let them build and accumulate into these mountains and we forget why were originally angry.”, (30:20). “I think we all evolve. If not, we’re just being stagnant, and that is one of the main things about humans is that if you’re not evolving, you’re just existing.”, (33:03). Tearing his hamstring while heading to Olympic trials in 2008 at the same time losing his parents, (35:27). “I feel like I’ve tackled all of these things so early that it has become the story. It’s not the story of just all the things I’ve come through. I’m not looking for it to be a crutch. It is more of a catalyst to me.”, (42:45). Engaging in track and field at the age of 35, (47:10). “I feel like for the first time, an actual coach is listening to the athlete and listening to me.”, (48:20). Believing in the importance of sleep, (52:21). “You have to do the legwork. You have to make a name for yourself. You have to be a brand on your own and you have to treat yourself as a business.”, (57:45). Aspiring to build a home for foster kids impacted by sports, (1:00:45). “You have to be able to accept the ‘No’, but you also have to be able to give a ‘No.’”, (1:04:15).   LINKS:  Website: More on Steve  Instagram: @steviey_b  Twitter: @benedict_steven  Interview: Training at Dragball by World of Wonder    RELATED PAST EPISODES OF 10,000 “No”s:  Ep 74: Nike Athlete, Grammy Award Winner Charlie "Rocket" Jabaley  Ep 75: Strength Coach, Transformation Specialist & Super-Connector, Jay Ferruggia  Ep 83: Real Life Shawshank Redemption, Crossfit CEO Rob Grupe    If you like what you hear, please Subscribe, leave an iTunes review and spread the word. Hello! I’m so glad you’re here. This episode is all about emotional presence – and learning how to cope with the repercussions when you’re not so present. I’ll begin with an essay I wrote called ‘How to Find the Lessons Hidden in Everyday Dilemmas’. In it, I talk about how to fit your emotions into their right space in your life. For the fact is, they can be wonderful teachers – and frankly, that letting off of steam is necessary. I end my essay with this quote from Teal, written a year before her death while on a hike through Italy. In my mind it kind of says it all. “On my way back I saw this cemetery … It was white marble and really amazing … overlooking the sea, cliffs, mountains, and towns. So I chose to meditate and I got: ‘Go to Thailand, open your heart, open your soul and be.’ “The whole ‘be’ thing really made an impact on me. I realized in life I am never really there. I tend to be thinking about the future or past or something someone said instead of being in the moment, and taking it in for all its beauty. After this meditation I knew I had been transformed because I looked out over the ocean and mountain scene in front of me and started to cry. I was really able to take it all in and I finally realized how blessed I am to be here, and how many beautiful things there are here.” Do You Have Tech Neck? An Interview with chiropractor Robert Adamich, If you’re on your phone all the time, like too many of us here in the Bay Area, you may have a cranky neck. Robert’s identified a syndrome many patients come in with, that he calls ‘Tech Neck’. Turns out it’s avoidable, but only if you take the right steps. Here’s what I learned: What ‘Tech Neck’ actually is and what causes it Why ‘Tech Neck’ is such a problem How to begin to heal it Some daily practices that can prevent ‘Tech Neck’ How much work should you do that involves bending over screens? What fluid intake has to do with ‘Tech Neck’ A healing end of the day ritual Take a listen! It’s a wonderful episode … and as ever I end with a healing two-minute meditation. Are you frustrated and fed up with struggling with unresolved hormonal health issues? Today, we dive into all things hormones with a certified naturopath, Dr. Naomi Judge, who is well-known in Australia for helping women connect the dots between their health, happiness, and hormones. Find out how a life of optimal vibrancy and joy can be your new normal! Visit https://holisticwellness.ca/podcast for complete show notes of every podcast episode Topics Discussed in this Episode: Some of the common complaints and issues that women are struggling with The impact of hormones on our cycles Things you can do to help you gain a deeper understanding of your cycle Things that drive food sensitivities The link between estrogen dominance and food intolerances Some everyday foods that we can include in our diets to better support detoxification and our hormonal health The top strategies you can do to achieve your new normal The benefits of grounding Simple things that we can do to support our adrenal health Hormones and skin health Key Takeaways: During our cycle, estrogen changes our immune system, so we’re more likely to get coughs and colds at certain times of the month, and we’re more likely to be more susceptible to getting allergies. When you’re looking after your hormones, the first thing you need to do is clean your bowel, your liver, and your gallbladder. Focusing on self-care is really vital to balancing your hormones. If you’re busy all the time, running from task to task, and constantly feeling stressed, your hormones are not going to get a chance to settle down and you’re going to be in your sympathetic nervous state the whole time. When your hormones are beautifully balanced, it brings you that bright, vibrant look, and it's the best way to prevent premature aging. When they are imbalanced, your looks could change drastically in a short period of time, where your skin is dry and you notice more fine lines and deeper wrinkles. Action Steps: Really look at things and track things that have to do with your cycle so you can understand more about it and understand what’s related to your hormones. Rather than using an app to track your cycle, write things down. Track your food sensitivities based on your cycle. Achieve your new normal: Start by balancing out your macronutrients and recognizing what a good meal is for you. Learn what meal suits you so that you can start with just having three meals a day and stop having so many snacks, stop craving sugar, and stop feeling hungry after each meal. Also, remove your trigger foods from your diet. Focus on self-care. Re-balance your nervous system: Do deep breathing exercises. Eat slowly. Naomi said: “You feel more in control when you understand that there are things within your control that are driving these symptoms. It’s not something that’s just happening to you… It’s because there are other things going on with your hormones that you can effectively get under control.” “I think we’re now coming to a realization that what we need as women to get through this busy, stressful time is more focus inwards, more focus on ourselves, and more of that kind of quiet time.” Thanks for listening! Are you excited to have fun under the sun this summer? Naturopathic doctor and clear skin expert Dr. Jen Newell shares some really great insights and advice about taking care of our skin, what brands to choose and what to look for in a sunblock. It's a really great conversation to have as we head into the summer months but also to have beautiful, clear, glowing skin all year round.Topics Discussed in this Episode:Why sun care is importantThe difference between UVA and UVB raysWhat the SPF number tells usWhat ingredients to look for and what ingredients to avoidHow to treat sunburnWhat to do with hormonal acneWhat really happens to our skin and our hormones when we apply toxic products on our skinClean beauty care and the clean beauty brands you should check outCaring for your skin from the inside outCustomized cosmetic proceduresKey Takeaways:Applying sunscreen is the best thing that we can do to reduce the signs of aging. About 90% of the signs of aging that we actually see on our skin is due to sun exposure since childhood. It's important to consider not only the SPF but whether or not the sunscreen is broad spectrumAntioxidants amplify the benefits of your sunscreen and help undo some of the damage that's been done to the cells. When zinc oxide or titanium dioxide is included in the ingredients of a product, then it has some degree of sun protection.A lot of the topical acne treatments that are available in drugstores actually have ingredients in them that prime the skin for more pimples later. The ingredients that are in cosmetics are becoming a women's health issue because they affect hormones so strongly. Our skin is not a sponge. It's a great barrier that's meant and designed to block things from being absorbed. Unfortunately, synthetically-produced ingredients that are causing hormonal imbalances often act as accelerators and amplify the absorption of other ingredients.Action Steps:Wear at least SPF 15 sunscreen on a daily basis even when it's cloudy.Use aloe vera on sunburns.Choose a moisturizer that contains antioxidants.Keep yourself hydrated.Use clean beauty products.Dr. Newell says:“Your skin is a great barometer of internal health.”“Eating every color of the rainbow is key.”Thanks for listening!Check out my six-week online program, CleanBeautyU, where I guide women through how to holistically and naturally take care of both the internal and external side of skin care.
